Defense Will Not Release Mitigating Factors

ORLANDO, Fla. -- The state attorney's office released five aggravating factors on Thursday that it will rely on to argue that Casey Anthony deserves to die if she is convicted of first-degree murder in the death of her daughter.
Judge Belvin Perry forced the state's hand at a hearing on Tuesday, forcing it to reveal the aggravating circumstances it intends to prove to justify the death penalty.
Anthony's daughter, Caylee, was reported missing in July 2008. Her remains were found five months later in a wooded area near the Anthony family's east Orange County home.
One of the factors is that the slaying was committed in the commission of another crime, which, in this case, would be aggravated child abuse. Anthony faces that charge as well. If she is convicted of that and murder, the aggravator will be proved.
The next two factors will be more difficult for the state to prove. First, the state must prove that the killing was especially heinous, atrocious or cruel. Next, they must prove that the crime was cold, calculated and premeditated.
The duct tape found on Caylee's skull, the high levels of chloroform found in the trunk of Anthony's car and the fact that Anthony was seen with her boyfriend, arm-in-arm renting a movie at the same time the state argues that Caylee was dead or dying, could all help the state, but there is a lot of speculation and aggravating factors must be proved beyond a reasonable doubt.
The last two factors would be easier to prove, that the victim was under 12 and that she was in familial custody, or, with her mother when she was killed. There would be no doubt that Caylee was in Anthony's custody if Anthony is convicted of first-degree murder.
The defense's mitigating factors, or reasons why Anthony should not be put to death if convicted, have not been disclosed. The judge said the defense will not have to release those in advance.

ORLANDO, Fla. -- Prosecutors filed a document Thursday afternoon telling the defense which legal reasons they're using to justify the death penalty in the murder case against Casey Anthony.

If Casey is convicted of murdering her daughter Caylee, prosecutors will argue five of the 15 possible aggravators to the jury.
The aggravators they are using are:
The murder was committed during aggravated child abuse, for which Casey is also charged
The murder was especially atrocious
The murder was committed in a cold, calculated and premeditated manner
The victim was younger than 12 years old
The victim was particularly vulnerable because her killer was her mother

Very good post lisette. I have no doubt The State can prove that KC murdered Caylee in a cold, calculated and premeditated manner.

After reading this I popped over to Blink, and someone there asked her if she still believed in the "O" theory and she said yes. I am shocked. She is such a tireless, advocate for Caylee but I do not think she can wrap her head around the duct tape being the murder weapon. I am just afraid others will feel the same way. Whereas to me it is a no-brainer. The ME stated it was placed prior to or just as decomposition was be

More about Tuesdays hearing - it seems that Casey
Anthony actually told her mother Happy Mothers Day at the last hearing!

Prosecutor Jeff Ashton made a major revelation in court on Tuesday.
"We were accused of seeking the death penalty because the defendant wouldn't accept some phantom plea," Ashton said.

For the first time, with the words "phantom plea," prosecutors denied they had offered Casey Anthony a deal if she would plead guilty to the death of her daughter.

Also in the courtroom this week, Anthony was able to communicate with her family when she told her mother, "I love you" and "happy Mother's Day."

The "O" theory is that after Caylee died, KC was bothered by the opening of the mouth (the "O" factor---the shape of the mouth opened) and seepage of fluids so she covered Caylee's mouth at that point with the tape--after she was already dead.

I don't think the duct tape would stick like it did if she put it on after death. I believe we will see in the trial that the medical examiner will say the same thing and is one of the reason the State went for the ultimate "death penalty".

I have never been able to think the tape was applied after death, due to the mandible being held in its normal position. After death, the jaw drops down and back. Hard to bring it back into place even minutes after death and hold it in place. (unless of course one is trained in doing such a thing. I am not, and know from experience this is not something easily done.)

I truly believe the tape was the murder weapon...the cause of death, as does the prosecution.
This "O" theory was brought up on a popular blog site, along w/ the theory that the chloroform was George's!!!
I am really shocked as this blog site is owned by a fearless Caylee supporter. Sorry, I just had to vent my feelings! 🇳🇴
