Casey Anthony: The Prosecution Strikes Back
It was reported in the Orlando Sentinel yesterday that Assistant State's Attorney Jeffrey Ashton had responded to the defense motion to dismiss the charges against Casey Anthony due to "spoliation of evidence".

Ashton first points out that the term "spoliation" relates to civil law, and that it refers to:

... the failure of the government to turn over, or under our circumstances destroy, evidence materially favorable to the accused.

oh man the Defense must be referring to the residue from the heart shaped sticker, that the FBI destroyed. They will say it held proof that someone besides Casey applied the tape!

lindamarie has very little confidence in LE, and it looks like she may be right!

Found it interesting that the defense is trying to use a loop hole which is ONLY allowed in CIVIL law.

((the term "spoliation" relates to civil law))

Can we say "not the sharpest crayon in the box" What a waste of tax payers money. The frivolous motions filed by the defense should be charged to the defense and not the tax payers.
