Parents of slain Manitoba girl blamed each other in video statements Share WINNIPEG — A Manitoba man convicted last week of first-degree murder for his role in the abuse and death of a five-year-old girl spoke out from his jail cell Thursday, pointing the finger once again at his co-accused, the girl's mother.

"I know I'm the most hated person in this province and, probably, the whole country," Karl McKay said in an interview with the Winnipeg Free Press at the Winnipeg Remand Centre.

McKay and his former lover, Samantha Kematch, each face an automatic life sentence — with no chance of parole for 25 years — for the murder of Kematch's five-year-old daughter Phoenix Sinclair, a brutal case of sustained parental abuse that horrified the nation. Both are expected to file appeals.

Jurors heard during the month-long trial that Phoenix was repeatedly beaten, terrorized and neglected for several months, ending with her death in June 2005 inside a home on the Fisher River First Nation, about 200 kilometres north of Winnipeg.

McKay and Kematch then buried her body near the local garbage dump and hid the death months before McKay's two teenage sons went to police in March 2006.

Police were eventually led by McKay to the burial site, where Phoenix's remains were found once the ground thawed. An examination by forensic experts revealed numerous new and old fractures, indicating a pattern of violence against her.

McKay and Kematch blamed each other during the trial for Phoenix's abuse and death. Kematch told the Free Press earlier this week that she loved Phoenix, but was powerless to save her from the controlling, abusive McKay. She denied abusing Phoenix and claimed McKay was the real culprit.

"That's BS," McKay said Thursday. Speaking with his lawyer by his side, he said he wanted to set the record straight about his role in Phoenix's death and allegations made against him by Kematch.

"Samantha hated Phoenix. I know this because I was around. She's just trying to clear her name."

McKay, a long-distance trucker by trade, claims Phoenix was always terrified when he'd hit the road and leave her alone with Kematch. McKay said Kematch was addicted to crack cocaine and would spend most of her money on drugs.

"I'd come home from a trip and Phoenix would come hug me, not wanting to let go," said McKay. He relayed incidents of Kematch throwing out Phoenix's Christmas presents, scolding her for eating several pieces of bread at a time and watching as her own alcoholic mother gave the little girl a beer and a cigarette.

McKay and Kematch admitted in their lawyers' closing arguments to being "terrible" parents who deserved to be punished for the horrible neglect, abuse and death of Phoenix. But they pleaded with jurors to only find them guilty of manslaughter, which carries no mandatory minimum penalty.

The jury didn't buy it. Graphic details of Phoenix's abuse emerged during the trial. Court heard how the little girl was confined to a cold, dark basement where she was frequently beaten and forced to sleep on the floor naked.

One of McKay's sons testified McKay would make a game of shooting the girl with a pellet gun, telling her to "run," then shooting her repeatedly in the back, making her cry out in agony.

The child was forced to eat her own vomit, jurors heard.

The boy testified that McKay repeatedly played a "game" with Phoenix he called "chicken," which involved picking her up by the throat, wrapping both hands around her neck and "choking her out."

"Then he'd throw her to the ground," said the teen. "She'd make this weird scream. It was like someone had cut off her arm, like she was screaming to death."

McKay said Thursday his biggest mistake was staying in a relationship with Kematch, who he claims was responsible for Phoenix's death.

"I should have listened to my heart and not her," he said.

"I can't imagine a mother would be that evil."

McKay said Kematch had plenty of time when she was alone with Phoenix, which is when he said he suspects most of the damage to her was done.

McKay denied Kematch's claims that he was physically abusive towards her, noting there are no records of police reports.

"Sam knew where the door was. I'd kick her out so much, but she'd always come back, like a stray dog," he said.

McKay said Kematch was a master manipulator who used him for his money.

"I was a good catch, with financial stability, a place of my own. She had a (drug) problem. I believe I was the fuel for that problem," he said, adding he was attracted to Kematch because she was 20 years younger than he was.

"I thought hey, I'm this old, I still got it."

McKay admits he has abused other women in previous relationships but said he was a different person back then, largely because of excess alcohol use.

"People change, people can change overnight. I was a drinker back then, I had many binge blackouts. But that was then, this is now," he said.

McKay acknowledges his own two teenage sons provided key evidence at trial against him. On his lawyer's advice, and because of the likelihood of an appeal, McKay declined to talk about the testimony of his sons or why they'd say things he claims are untrue.

"I love my sons. I know what they said in court. I love them. They mean everything to me," he said.

McKay said it was Kematch's idea, not his, to bury Phoenix's body once it was obvious she was dead. He said it was also Kematch's idea to pass off a young relative as Phoenix once child welfare officials began investigating the case.

He said Kematch was "white as a ghost" when she realized the truth was about to emerge and was desperate not to have her other two young children by McKay taken away from her.

"I was so scared, so confused. She was very evil, controlling," said McKay.

"I was protecting that bitch. That's the biggest mistake of my life, listening to her."

McKay said Kematch got more aggressive towards Phoenix after they moved from Winnipeg to Fisher River in the early spring of 2006, so he could be closer to his ailing father. He said Kematch was upset because it was harder to get drugs on the remote reserve.

At one point in the interview, McKay described Phoenix's death as an "accident." His lawyer, Mike Cook, clarified that McKay meant it was an unintended killing.

McKay said he was relieved when the truth finally came out, which is why he agreed to take police to the burial site.

"I wanted to have the closure. I wanted to show this. I wanted to do the right thing. I knew Sam wouldn't have shown them because of her cold heart," said McKay.

McKay said he is happy a provincial inquest will be held into Phoenix's case.

"People, in general, should love their children. This is a wake-up call to love your child," said McKay.

"I just don't want this to happen to another child. It's just not right."

Phoenix Sinclair (Sun Media files) A little girl whose tragic life and horrific murder outraged an entire province will finally be laid to rest today.

Phoenix Sinclair should have celebrated her ninth birthday today. Instead, friends and family will gather at the Indian and Metis Friendship Centre on Robinson Street starting at 10 a.m. to attend her funeral.

Phoenix died in June 2005, alone on a cold basement floor after enduring months of abuse and cruelty. Her body was buried in the bushes on Fisher River First Nation and her death hidden from Child and Family Services officials for nine months.

Her mother Samantha Kematch and Karl McKay, Kematch's then-boyfriend, were convicted last year of first-degree murder.

Phoenix was a ward of CFS for much of her life before her mother regained custody after walking away with the girl during a visit to her foster mother's home in 2004.

Her death became a symbol of a broken child-welfare system, but her father would like the public to remember her as much more than that.

"She was just a person like everyone else," said Steve Sinclair yesterday, speaking publicly for the first time about his daughter. "She loved to swim and have fun. She was a typical kid.

"I remember her smile, her laugh, everything. How she used to wake me up on the couch and say 'Dad, time to get up.'"

Sinclair, who never saw his daughter after Kematch took Phoenix, remembers how much the child loved watching Armageddon while eating breakfast, and how she loved to visit her cousins down the street.

When asked how he pictures the image of Phoenix in his head, Sinclair replied "pudgy." Then he laughed.

"I still love her and I still miss her," he said. "I look at her little sister and I see her in there. I look at all the nine-year-olds and wonder how she'd be now. She'd probably be scrawny like me."

For more than three years, Phoenix's body has been in police custody as the murder trial slowly made its way through the courts. Now the wait is over and the child can finally be laid to rest.

Sinclair has not cut his hair since before Phoenix was born, but intends to cut off a good portion of his long locks during her burial today and lay her to rest with it.

"It's to honour my daughter. Her life is on my head," he said, referring to his hair.

He and Kim Edwards, Phoenix's foster mother, co-founded a charity called the Phoenix Sinclair Foundation in 2007. The framework is in place, but they are waiting for appeals of the murder convictions to play out before going full-steam ahead.

"I want it to be an advocate for the children that are in care, even those who aren't," Sinclair said. "I want to work to change the system, like when you throw a pebble in the water, you get ripples, and it reaches the whole length of the pond."

Edwards expects even strangers to come out and wish Phoenix the best at this morning's funeral. "Manitoba fell in love with her," she said. "She became their little girl."

This is evidence that not all the "monsters" are in the USA - Canada apparently has some too! I just saw this on our Canadian news today, but it apparently happened a few years ago. This is just sickening, and really angers me that this child was abused so horrorifically until she was finally murdered.

The one "good" thing out of all of this, is that the "mother" & her boyfriend were convicted of first degree murder! It is also comforting to know that the child's father is helping start a charity (Phoenix Sinclair Foundation) to help protect other children from a similar fate.

A common-law couple who beat their five-year-old daughter to death after she endured months of horrific abuse saw their first-degree murder convictions upheld Thursday by the Manitoba Court of Appeal.

Phoenix Sinclair was routinely punched, slapped, beaten with metal rods, confined to a filthy basement, forced to eat her own vomit and shot with a BB gun before her death on or around June 11, 2005.

Her death was not reported until almost nine months later. Her remains were found buried near a garbage dump at the Fisher River First Nation, about 200 kilometres north of Winnipeg, in April 2006.

Samantha Kematch and Karl McKay appealed their convictions for several reasons, including a claim that the trial judge erred in allowing some evidence in the trial and in her instructions to the jury. They also said they should have received separate trials, and Kematch alleged the verdict against her was "unreasonable."

Most notably, the pair argued they should not have been convicted of first-degree murder because Phoenix was not "unlawfully confined" at the end of her short life. A murder becomes first-degree if the death occurs while the victim is confined.

At the end of their trial, the couple told the court they should be found guilty of manslaughter.

The appeal court rejected the couple's arguments, saying the trial judge had done nothing wrong.

The court noted the unlawful confinement charge should stand, because while Phoenix may not have been physically barricaded in her bedroom or in the rat-infested basement, her parents clearly controlled her movements through fear and intimidation.

"I would dismiss all grounds of appeal advanced by each accused and confirm their convictions for first degree murder in the death of the child Phoenix Sinclair," wrote Justice Michel A. Monnin.

Kematch's lawyer said Thursday his client maintains McKay was responsible for the child's death.

"Mr. McKay was the cause of death," said Leonard Tailleur. "He beat her — there was no dispute about that.

"(Kematch) is an aboriginal woman who's been in a difficult position her entire life and now for this to come upon her it is disappointing, yes."

Tailleur said his client is considering an appeal to the Supreme Court of Canada.

The horrifying details of Phoenix Sinclair's short life and brutal death have led to widespread calls for a provincial government inquiry into how Manitoba's child welfare system may have failed to protect her. Sinclair had been a ward of the province prior to her death.

A provincial government spokesman told Global News such an inquiry would not proceed until Kematch and McKay have exhausted all avenues of appeal.

"We owe it to Phoenix Sinclair and her loved ones to get real answers about the child welfare system in Manitoba and how it failed to protect this little girl," said Manitoba Conservative leader Hugh McFadyen. "With the criminal case effectively resolved, there is no reason why this long-promised inquiry can't occur."

During the trial, the testimony of McKay's young teenage sons provided the most harrowing picture of Phoenix's life.

They told the court how Phoenix was beaten, forced into the basement, and denied food and basic care from her parents. It was Daniel Stevenson, McKay's 12-year-old son, who told his mother that "his dad had killed someone," according to the appeal.

Testifying for the Crown, a biological anthropologist who examined Phoenix's remains told court she had "never seen that many injuries on a human skeleton."

Okay, now I can see why this is just making news today! The "monster mom" and her boyfriend (who tortured & killed a precious 5 year old girl) had appealed their first degree murder conviction. Thank God they lost their appeal!!

If you think the American justice system is bad, you should take a look at Canada's "justice" system! It tends to be much more lenient towards the criminal.
However, today's ruling is giving me hope that maybe changes are finally being made!! Bravo

I think that pendulum swings. That is why I much prefer the dp to a life sentence. Years down the road the old guy in jail might not seem so menacing, his crimes so atrocious, and the parole board may be more lenient.

Yes, laga... I definitely agree! I would much prefer that they both got the death penalty, but at least being in jail for 25 years (that is a "life sentence" in Canada) will give them plenty of time to think about the terrible crimes they have committed. And I am sure that their fellow inmates won't be very "nice" to them either!

The lawyer for the man who lost his appeal in the murder of Phoenix Sinclair says his client may try taking the case to the Supreme Court. Phoenix was neglected and severly abused. She died in June 2005 at the age of five. Manitoba's Court of Appeal has upheld the first-degree murder convictions of Samantha Kematch and Karl McKay. Kematch and McKay argued that they should be convicted on a lesser charge because the death was not premeditated. But the appeal court has found the conviction is appropriate. McKay's lawyer, Mike Cook, says he expects his client will try appealing the case to the Supreme Court.

Thanks, BJ! I love that photo of Phoenix - she was such a beautiful girl. I still can't believe what she endured at the hands of those who were supposed to love & care for her.

I truly hope that as a result of her death, changes have been made to the foster system here in Canada, esp. among the native community. No child should ever have to go through what she went through! crying

All children are beautiful! It's just so sad that these evil doers don't realize what a gift they are and treasure them. Did no one make these abusers and killers feel that they were special when they were children and they don't know how to love? IDK! It just makes me ill!

Ok...they were convicted of NEGLECT and severe abuse which resulted in death and they want to appeal to supreme court on grounds death was not premeditated??? WTF First of all, legally, premeditated does not have to be a long time, it can occur in one second. And they are charged with neglect which obviously does not occur in one second but over time. How can they claim the death was not premeditated? Maybe they can claim they didn't think about murdering this child, the thing is their not thinking about this child is what caused her death. I hope if they are able to make an appeal the court makes their sentence more severe.

WTF First of all, legally, premeditated does not have to be a long time, it can occur in one second. And they are charged with neglect which obviously does not occur in one second but over time. How can they claim the death was not premeditated? Maybe they can claim they didn't think about murdering this child, the thing is their not thinking about this child is what caused her death. I hope if they are able to make an appeal the court makes their sentence more severe.

I really can't get this lil' girl out of my mind. Maybe b/c I have a 5 year old daughter. They are little people...with personalities, feelings, etc...I just keep on thinking how she must have lived in fear of what might happen to her the next day. The thing around the neck till she gave out a blood curdling scream makes me feel so sick and ENRAGED!! How could they do this to her? Look at her! Beautiful, innocent, so deserving to have a chance. Really, this is so upsetting.

Thank God McKay's sons went to the police and testified at trial. Obviously, they have probably also been abused to some extent.

It has taken me this long to read the entire thread as just from reading the comments, I knew this was graphic. It is so hard to understand, as BJ stated, WHY anyone would hurt, neglect and abuse a child. If they don't want their child, give it up for adoption. There is NEVER an excuse to abuse!!!!!!!!!!!

A Manitoba couple found guilty in 2008 of killing five-year-old Phoenix Sinclair has lost a bid for an appeal.



The judgment was released Thursday by the Manitoba Court of Appeal.

"I would dismiss all grounds of appeal advanced by each accused and confirm their convictions for first-degree murder in the death of the child Phoenix Sinclair," stated the judgment, written by Justice Michel A. Monnin and co-signed by Justice Martin H. Freedman and Justice Richard J. Chartier.

Sinclair's mother, Samantha Kematch, and stepfather, Karl McKay, were convicted and sentenced in December 2008 in a case that made international headlines.

They are not eligible for parole for 25 years.

Submissions to the appeal court were made in October 2009.

In separate briefs filed with the court, Kematch and McKay argued they were unfairly convicted and should have been tried separately instead of together.

During the trial, defence lawyers did not deny the abuse Sinclair suffered at the hands of her parents but argued there was not enough evidence to convict the couple of first-degree murder.

The defence teams suggested that manslaughter was a more appropriate sentence because it was not clear who had delivered the final fatal blow to the little girl.
Body wrapped in plastic and buried

Sinclair was killed in the basement of a home on the Fisher River First Nation, about 180 kilometres north of Winnipeg. Her body was wrapped in plastic and buried in a shallow, unmarked grave near the garbage dump of the reserve.

During the trial, court heard that Kematch and McKay routinely beat Sinclair with their fists, feet and metal bars and forced her to eat her own vomit.

Sinclair was also choked until she passed out and was shot with a pellet gun.

Court was also told she had broken bones throughout her body when she died.

Her body wasn't found until March 2006, after police laid charges against Kematch and McKay and the latter showed RCMP the burial site.

Under the Criminal Code, a slaying committed while forcibly holding someone elevates the crime to first-degree murder rather than second-degree murder or manslaughter.

During submissions to the appeal court, lawyers for Kematch and McKay argued the girl was not physically locked in the basement and would frequently come upstairs to eat or play with siblings.

One of the defence lawyers suggested Sinclair may have stayed in the basement voluntarily to get away from her parents.

There were no locks on the doors, and no doors to the basement where she was kept, defence lawyers noted, adding that a complete lack of physical restraint means the conviction should have been reduced to second-degree murder or manslaughter.

That theory received a rough reception from the three appeal judges, one of whom said he had a hard time believing a young girl would want to stay in a basement away from her parents and siblings.

I am so glad they lost their chance to appeal. Gotta love their defense lawyer, first it's agreed that one of them killed her but since it's not known which one issued the fatal blow you can't charge them with murder, and it wasn't premeditated because they didn't plan to kill her, they were content to just keep beating her and they didn't lock her in the basement, heck no, she stayed down there on her own, she didn't like the beating they gave her.

It is unimaginable how depraved some "people" can become! I think I read that the "mother" was addicted to drugs? I seriously can't believe that she was allowed to have custody of the poor child. I hope they fired all those well paid "officials" who were supposed to be protecting her - they blew it big time!!

I agree, Wrap! There are so many loving families out there that would have been overjoyed to care for the precious girl. She just wasn't given the chance...

I don't know how anyone could defend those two monsters!! IMO, there is no defence when a helpless child is brutally tortured, murdered, and thrown out like garbage!! Thankfully, the judge came to that conclusion also.

It boggles my mind what this precious little child went thru on a daily basis. If she was addicted to drugs Social Services should have been on top of this...surely a family member or friend had some suspicions about what was going on over there. SICK SICK SICK. crying crying crying head bang head bang

i hear ya! my lil girl is going to be 5 in two months. and yeah they are their own little people with their own personality and feelings.. crying she deserved a life, a hug a kiss, an "i love you" "you are the world to me" i can't picture my baby being treated like that, she is the sweetest most loving lil person in the world.. i hope those monsters suffer in jail and ya'll are right! those inmates will make sure they wish they where dead! :mad:
and those stupid lawyers, how can they have the heart to defend those monsters?? :mad: crap

I agree!! I truly hope their time in jail will not be a pleasant experience, and that they will be haunted every night with the memories of what they did to this precious girl!
