Casey Anthony in court April 5th/Judge Strickland rules in favor of T ES and they do not have to turn over info to Anthony's defense team!/ State seeks transcript from August hearing/ Defense won’t get illegally recorded interview with searcher
ORLANDO, Fla. --
Casey Anthony is expected to return to the courtroom as her defense team seeks records they hope could prove her innocence.
Judge Stan Strickland scheduled a hearing for Monday morning.
Anthony's defense attorneys want the volunteer group Texas EquuSearch to turn over all records relating to searches done in or near the area where Caylee Anthony's remains were found.
Officials with Texas EquuSearch said the request would invade the privacy of the many volunteers who assisted in the search.
The hearing is scheduled to begin at 10 a.m.

I could have sworn they already had that hearing and Strickland denied Baez. It was the same hearing where Richard Grund was in the court room regarding something to do w/Jesse and the judge shot Baez down.

Yes they have already had this fight - but Baez just doesnt get it -however, if he goes up against Nejame
it will be difficult. I wonder if Perry Mason - ah, I meant
Cheney Mason will appear for the defense!

I would love to see Mason and Nejame go toe to toe. Nejame wouldn't put up w/Mason's shenanigan's in court.
Mason strikes me as someone who enjoys mocking people and that is a very ingenuous "trait" as a lawyer and as a lay person. Just MHO.

A lawyer for the volunteer group that helped search for Casey Anthony's daughter, Caylee, will be in court Monday for a hearing about access to its records.
Months before Caylee Marie Anthony's remains were found in December 2008, thousands of volunteers for Texas EquuSearch scoured acres throughout Orange County in search of the 2-year-old. The group claims 32 volunteers searched near the wooded area where the remains were later found but not the exact spot.
Last year, Orange Circuit Court Judge Stan Strickland ordered EquuSearch to allow the defense team to review its records of those 32 people.
Casey Anthony is charged with first-degree murder in the death of Caylee. The state is seeking the death penalty, and a trial is set for May 2011.
Anthony's defense team wrote in a request to the judge that the team found volunteers who weren't on the list of 32 and did search the spot Caylee's bones were found, but those volunteers noticed nothing unusual. That's why the defense now wants access to all of EquuSearch's records
In a written response filed in court today, Texas EquuSearch's attorney Mark NeJame wrote that the defense team never came to his office to review the files on the 32 people.
In October, NeJame's office had the records hand delivered the material to the defense team, he said.
NeJame also disagrees with the defense that there were volunteers who searched the exact area. However, if the defense identifies some, Texas EquuSearch can show Strickland the documents on those searchers behind closed doors to determine if the material should be released.
The hearing is at 10 a.m. Monday.

Isnt that just like Baez and his loser "team" to not show up to review the asked for documents at Nejames
office. Strickland needs to get this guy under control.
Waste of time and taxpayer monies - all these requests and then they dont follow up - and file new motions which are repetitive. UGH!

Casey’s Defense Accused Of Wasting Tax Money
Texas EquuSearch accused Casey Anthony’s defense team of wasting tax money and wants her to pay the volunteer group's legal fees for having to handle what it calls frivolous defense motions.
EquuSearch says the defense never reviewed records it requested on the 4,000 people who helped search for Caylee Anthony.
Also, in court papers released Thursday (read motion), EquuSearch says, if Casey's lawyers had reviewed those records, they would know whether or not what they're looking for exists instead of having to file more motions.
Taxpayers are now paying Casey's defense costs.
In the meantime, Friday is the defense's deadline if it wants to ask the judge to seal 50 letters Casey wrote to another Orange County inmate. Investigators say the letters are incriminating and the judge has said he'll probably release them.

Let them be released!!!!!!!!!!!!!!
And if Bozo and team are broke, how could they afford to pay legal fees reference the Tim Miller b.s. motion? Are the taxpayers suppose to pay for things like that, too? I don't thinks so!!

I'm thinking that they have to give them until the end of the day (business day?)...Sooo, it will probably be Monday before they will actually be released, but :idk:

The TV Guy/ Casey Anthony: When is the deadline on her jail letters?
What’s the deadline for Casey Anthony’s defense team to review letters she wrote to another inmate? Good question, because we have disagreement.
Judge Stan Strickland gave the defense team 15 days to examine her 50 letters before they become public.
Stations disagreed about the deadline in reports tonight.
WESH-Channel 2 Jim Payne put it this way this afternoon: “One insider tells WESH2 the 15-day deadline imposed by Judge Stan Strickland is up Sunday. There’s a hearing in the case Monday on another issue.”
WFTV-Channel 9, however, said today is the deadline. Anchor Bob Opshal said, “The clerk’s office is closed today, and as far as we can tell, Casey’s attorney’s did not file a motion to keep those letters private. Investigators say the letters are incriminating, and the judge has said he will probably release them.”
What’s the right answer on the deadline? The clerk’s office is closed, as Opsahl noted. Maybe we’ll learn Monday.
Anthony is charged with first-degree murder in the death of her daughter, Caylee.

Maybe the defense knows they can fight the release of the letters but in the end would lose. The Sunshine Law will prevail in Florida. I do think that witch KC is throwing her parents under the bus. Which to me sucks because they are her strongest supporters. GA and CA are victims of KC and it drove them right over the edge of "sanity". They are so ill they are delusional.

Oh God Pookiebear...I hope to God that is only a rumor. In my gut...I know...I know that it was no accident. It was planned in advance. It all had meaning...from the tape, the heart sticker, the wording on the shirt, to the final resting place. It was a sick, twisted plan that a very evil person carried out. Once it was done, this "mother" appeared relieved of her troubles and responsibilities and went on with her life. Makes me so ill.
I was always afraid the accident theory would be brought in, b/c they have nothing else. Is that why GA's affair w/ the resultant accident theory became public? To show reasonable doubt?

The duct tape makes the accident theory not plausible for any human being to have any doubts.

I respectfully beg to differ. This is all conjecture.lindamarie wrote:The duct tape makes the accident theory not plausible for any human being to have any doubts.
IF it were an accident (she gave her too much xanax, etc.) and she knew she would go to prison, she concocted the Zanny the Nanny story, put the duct tape on Caylee post-mortem to make it look like a kidnapping; thus the "accident theory is plausible" (and really, I hope that is what happened because the mere thought of that psycho covering her mouth and nose w/duct tape while she is still alive is too much to bear!)

Me too, wrap. Me too....
remember everyone...they did state specifically that while the window was small that the tape could have been applied post mortem as well as before death. There IS the chance it was an accident. and for caylee's sake (NOT casey's) i really hope it was...i hope the little girls last minutes were not spent watching her mother kill her and not care. I hope somehow, some kind of proof can come out, that show it was an accident. Casey will still not get off free anyhow, but at least then we know caylee didnt know her mother was killing her.

I have always kinda thought that it was probably an accident...That she gave her too much chloroform or something else to knock her out and she died...She had probably been doing it to keep Caylee out of her way for awhile, but she overdosed her this time...KC knew that she caused the death by her negligence and illegal activity, and came up with the kidnapping story...Maybe on the spur of the moment...She was just absolutely crazy to go on with her life as if no one would ever try to find out what happened to Caylee...She had to gave gone psycho or something when this happened--maybe some type of defensive denial mechanism...IDK, but whatever happened, she needs to pay, and because she has caused all this waste of time and money, she needs to pay dearly...However it happened, she is responsible for Caylee's death!! She couldn't have ever really loved Caylee or she would never have put her own desires before the welfare of that child!!

I really believe that it was premeditated. The computer searches...she cannot deny those! Who searches how to make chloroform, neck breaking, shovel, missing children....and then a few mos. later...your child is dead! You are the last person to be seen with the victim, etc...
The normal, prudent person..."if" this were an accident would have called 911, fessed up early on...and would have been upset, terrified and hysterical...for starters!! She has never, from what we have seen...been upset for Caylee. Instead we hear comments like "all they care about is Caylee". OMG...how cold and twisted!!!
This worries me though. Still some want to believe in the accident theory or the "O" theory.
It may be the fact that nobody really wants to believe that a "mother" could do this to their child. For me, the circumstantial evidence and KC's behavior after the fact...tell me she was happy with her new life. That is, until she got caught.

You have a point, Cherylz. I do think though, at some point, she considered chloroforming her parents or at least Cindy and/or breaking her neck. I think she actually wanted her parents or Cindy DEAD. She figured she and Lee would get the house. I am not sure of the timeline on the looking up of these posts but suppose she read about the chloroform and the neck breaking and realized trying to knock off her parent's was futile. So she then looked up "missing children" and shovels thinking of ways to rid herself of her daughter. Just a theory and probably wrong. The computer searches...she cannot deny those! Who searches how to make chloroform, neck breaking, shovel, missing children....and then a few mos. later...your child is dead!
This nut case needs to pay!

Please don't think that I think KC is any less cold and cruel because she might have accidentally killed Caylee while trying to silence her...I think she needs to die just for the fact that she was even doing that to her child...She obviously didn't care that much that she had killed her, or she would have called 911 or done something...She is still a cold-blooded murderer whether it was done on purpose (which I don't totally discount) or accidentally while wanting to get Caylee out of the way...She probably would have eventually killed her deliberately if it hadn't happened now...KC didn't love her, and she was "cramping her style." Caylee was going to start telling what she was doing to her, and she couldn't keep her around to do that.

I know Lisette...either way it is horrible what happened to an innocent, loving child. I just see KC as a total psychopath. She fits the description of one to a "T". She will pay for what she has done...if not in this life...then in the next.

I agree. I think she would lie in her bed and think of ways to be rid of her w/out giving Cindy custody. I think Casey "loved" Caylee as much as she could. She is a true sociopath and narcissist & they are incapable of loving anyone but themselves. IMHO, Caylee died due to Casey's disdain/hate/fear/jealousy of Cindy. No way would Casey let Cindy have custody. She is still a cold-blooded murderer whether it was done on purpose (which I don't totally discount) or accidentally while wanting to get Caylee out of the way...She probably would have eventually killed her deliberately if it hadn't happened now...KC didn't love her, and she was "cramping her style." I agree that kc loved Caylee as much as she was capable. I think people like kc, and many others do not think of children as people, but as their possessions to do with as they see fit. With most people these feelings don't extend to murder, just control and lack of letting the child blossom with encouragement and acknowledgement of the child's unique personality, likes, talents, etc.
As much as I have disdain for kc and her actions, the defense attys make me angry and sick also. It is not their duty nor responsibility to pull every trick and maneuver possible to help someone get away with murder. I realize with all the evidence clearly indicating guilt, they have few options, but I think they should have gone for a plea deal and saved everyone time, anquish, and money.
I hope the judge can do something to limit the spending of tax dollars for hopeless and useless pursuits.

I cannot find a way to believe in the accident theory, though I have tried and wish I could. My gut and my logic always come back to it not making sense for me.
I do not see any evidence of Casey's thinking process being analytical enough to "plant duct tape" after an accident. Everything that she did reeks of operating by the seat of her pants.
I doubt that she had the Zanny story together until later, and that she stayed away for so long because she had no story. If she truly had it together, as a plan, I think she would not have disappeared, but come forward with the story and tried to be more credible than someone who has not reported her child missing for a month. I also do not think she would have put Caylee in those woods, if she knew that she was going to claim a kidnapping. She was pretending to herself that it never happened, living a life she wanted I think she did not even have a story when Cindy brought her home, but was actively reaching for one...when she came up with it and shared it with Lee, it was preposterous and every step of following it led to incongruous facts.
We know that she was researching incriminating information, yet, I do not know to what degree the actual final act with Caylee was premeditated or in a desperation, a culmination of all of her seeking to create a new life, in one way or another...I do think she is mentally ill, but not legally insane. Far different. I do not think she put that shirt on her as a telling of things to come, and I do think she loved Caylee in the way that she could; such a narcissistic personality is limited in love as we know it, but I am sure that she believed that she loved her. And she likely has missed her deeply on some level, but it did not change her ability to kill her at that moment in time.
That moment in time is something that we all wish we knew, after so much time and energy and love invested...as hard as the subject matter is, we do want to know what happened. Unfortunately, I doubt we will ever know more than she died at Casey's hand. :-(
Caylee is free. We can only hope that Casey never will be.

Heike, your theory makes a lot of sense and I love the way you explain the psychological aspects as well; however, Casey had been talking about Zanny the Nanny for quite sometime prior to her taking Caylee's life. So, I think since she concocted Zanny I believe a year before Caylee's demise..Casey had a vague plan in the back of her demented mind to use this concocted Zanny as a skapegoat. She figured since she had been talking about her for a year or so, her family and friends would buy her ridiculous story, as would LE.I doubt that she had the Zanny story together until later, and that she stayed away for so long because she had no story.

Yep Wrap, I agree. On some level this was preplanned w/ Nanny being introduced early on...even researching that One tree Hill episode. Once confronted she ran with the Nanny story. What else could she say? The computer searches began in March. I think KC was a very symbolic driven person...as evidenced by her icons found on her computer screen. I think a lot of what she did had meaning to her...ie. the heart sticker, the shirt. She was contemplating this for some time and the rage towards CA the night of the 15th was the final straw for her. Of course, in my opinion only!!

Thanks Kathie, Hi cherylz!
Yes, Zanny certainly was introduced early on to explain something or cover for something...and maybe Casey knew that she was going to use her in her story, but I am not sure that she had it all sorted out until she had to. She certainly did not do a good job of it! If we only knew!

Where was this Joe Jordan? I think it's very telling that he didn't show up for the hearing! Baez was so unprepared! Casey didn't even glance at CA and GA once, even though CA was leaning toward her as she was leaving. That long time that she sat there while the lawyers were in chambers, she didn't even turn around and wave or smile...I think that she is through with them!

i noticed that to lisette. That baby killing witch is throwing her own parents under that short bus. No doubt in my mind. All her problems and issues will be blamed on her parents.

I am convinced that the total purpose of this motion by the defense is to influence the jury pool by implying reasonable doubt...Bozo even used that term at one point in his "argument"...They know that these hearings are covered extensively by the media, and that some people will just hear bits and pieces, and some are inclined not to trust the justice system anyway...SO reasonable doubt is planted...They don't have anything else, but to deceive the public to get this killer off!!

Casey Anthony attorney blasted by Texas EquuSearch lawyer
[You must be registered and logged in to see this image.]
Casey Anthony sits in court today.
Casey Anthony's lead attorney came under fire this morning as her defense team tried again to obtain records about volunteer searchers with a group called Texas EquuSearch.
Casey Anthony's attorney Jose Baez complained that Texas EquuSearch has not turned over all of the names of people who searched the area near the Anthony home in east Orange County where Caylee Marie Anthony's remains were ultimately found.
Texas EquuSearch attorney Mark NeJame said Baez hasn't taken time to come to his office to look at the documents and it's incredulous to suggest there's a bombshell hidden in them.
NeJame said Baez's lack of reviewing the records is "either laziness or sloppiness."
Later, Baez proclaimed: "Why is everyone so afraid of uncovering the truth in this case?"
Casey Anthony, 24, is charged with first-degree murder in the death of Caylee. The 2-year-old's remains were found in December 2008 — five months after the toddler was reported missing by her family.
The state is seeking the death penalty.
"They are trying to kill Miss Anthony, and we are trying to save her," Baez said. "How can we do it if we are handcuffed at every twist and turn?"
Casey Anthony is in the courtroom this morning, seated between Baez and Cheney Mason, the newest Orlando attorney to join her team.
Also present are prosecutors Jeff Ashton and Linda Drane Burdick.
During a period in 2008, while Caylee was still considered a missing child, thousands of volunteers with Texas EquuSearch scoured acres throughout Orange County on two separate occasions.
The group claims 32 people searched the woods around the location where the remains were later found but did not go to the exact spot.
Flooding at the time kept the volunteers out, the group said.
Last year, Orange Circuit Court Judge Stan Strickland ordered EquuSearch to allow the defense team to review its records of those 32 people.
Casey Anthony's defense team says they have found other volunteers who were not on the list but did search the area where the remains were found and didn't see anything unusual.
These witnesses may be key for defense attorneys who may argue that someone other than Casey Anthony left the toddler's body in the woods.
The defense is asking Strickland to allow its team to review all of EquuSearch's records.
NeJame told the judge that Jose Baez never tried to review the 4,000 documents provided by Texas EquuSearch.
The state has reviewed the documents, as have George and Cindy Anthony's attorney, Brad Conway.
Baez wanted to send a copying company to NeJame's office to make copies of the documents, but that is not allowed by the court order.
NeJame then invited Baez to come to his office to review the records.
Near the end of the hour-long hearing, attorneys on both sides discussed an illegal recording made by EquuSearch volunteer Joe Jordan. The man illegally recorded a conversation between an investigator with Casey Anthony's defense team, himself and his lawyer.
In Florida, it's illegal to record someone without their knowledge.
Drane Burdick told the court she has not listened to the recording because it's a third-degree felony to do so.
Shortly after an exchange between Drane Burdick and Casey Anthony's attorneys, the group of lawyers approached the bench and then agreed to meet privately outside of the courtroom. Strickland left separately to go to his chambers.
During the ten minutes while the lawyers were out of the courtroom, Casey Anthony flipped through papers on the desk in front of her and fidgeted with her hair. Court deputies moved closer to her, in case she made an attempt to move from the table.
