SAN DIEGO -- A registered sex offender behind bars Monday in connection with the disappearance of a 17-year-old Poway High senior might be linked to at least two other incidents including the disappearance of Amber Dubois.

Chelsea King has been missing since Thursday, when she did not return home from a run at Rancho Bernardo Community Park.

John Albert Gardner III, 30, of Lake Elsinore, was taken into custody Sunday afternoon near a bar in Escondido, San Diego County Sheriff Bill Gore said.

The arrest prompted Kelly and Brent King, the parents of Chelsea King, to release the following statement Sunday evening:

Physical evidence led authorities to Gardner, who was questioned by homicide detectives, Gore said. The evidence has not been described.

"This investigation is ongoing and specific criminal charges are still being determined," he said.

Gardner is a registered sex offender listed on the Megan's Law Web site, which indicates he lives in Lake Elsinore and committed lewd and lascivious acts on a child under 14 years old. Gore said investigators searched Gardner's Lake Elsinore home and other addresses prior to arresting him.

One of those addresses searched was a townhouse on Matinal Road near West Bernardo Drive, where Gardner was staying with his parents. The townhouse is about a mile from the park where Chelsea likes to run.

Gore said there was "a strong possibility" Gardner may be connected to an attack on a female jogger at the same park on Dec. 27, The San Diego Union- Tribune reported.

He said authorities were also investigating whether Gardner was connected to the disappearance of Amber Dubois, who went missing while walking to Escondido High School just over a year ago. Dubois, who was 14 at the time, has not been found. Dubois' last known location near Escondido High School is just six minutes from where John Gardner lives.

The search for Chelsea was expected to expand Monday beyond the Rancho Bernardo park and nearby Lake Hodges, where search teams have been looking since she disappeared Thursday.

"There are several searches going on around the county," Gore said. "We are going to refocus some of our search efforts."

Chelsea's parents, Brent and Kelly King, reported her missing Thursday evening when she did not come home from a run at the park. Brent King found her car in the parking lot at the park.

Hundreds of volunteers and law enforcement personnel have been searching for her since then. Several agencies pitched in, searching the Lake Hodges area by foot, air and boat.

The search for the teen has also generated a lot of traffic online to a Facebook page and the Web site findchelsea.com.

Investigators looked for clues on Chelsea's cell phone, which was found in her car, and her home computer.

The Poway High School senior is a straight-A student and a member of the San Diego Youth Symphony.

A registered sex offender was arrested today in connection with the disappearance of Chelsea King, a 17-year-old straight-A student who disappeared Thursday after going for a run in a San Diego park, police said.

John Albert Gardner III, 30, of Lake Elsinore, was arrested outside a restaurant in Escondido, San Diego County Sheriff Bill Gore announced at a news conference this evening.

The charges against Gardner had not been determined, Gore said.

The investigation into what happened to King is not over and the sheriff's department and other agencies are still working to find the girl, who ran cross country at Poway High School and was a member of the San Diego Symphony.

Numerous pieces of physical evidence led investigators to Gardner, and there was a strong possibility that he was connected to an assault on a woman that occurred in December in the area where King disappeared, Gore said.

Gardner, who was convicted of lewd or lascivious acts with a child under 14 years, according to the California sex offenders registry Web site, was being interviewed at San Diego Police Department headquarters this evening, the sheriff said.

Investigators are holding out hope that King is still alive and they are refocusing some of their search and rescue efforts, he said.

King disappeared after parking her BMW sedan outside the Rancho Bernardo Community Center on Thursday afternoon, and when she was late coming home, her parents called police, according to the San Diego County Sheriff's Department.

Her disappearance struck a chord throughout the community, and hundreds of volunteers have turned out every day to help the sheriff's department along with members of the FBI, the San Diego Police Department, the San Diego Fire-Rescue Department and the Del Mar Lifeguard Service in their search.

More than 800 people were out today searching the rough terrain of the Rancho Bernardo Community Park, divided into 45 teams to scour the trails, streams and shoreline of Lake Hodges.

According to the sheriff's Web site, Gardner was booked into San Diego Central Jail on suspicion of rape by force and first-degree murder. Nonetheless, Gore told Good Morning America that law enforcement and volunteers would search for Chelsea today, hoping to find her alive.

Paul Levikow, spokesman for the District Attorney's Office, said Gardner was scheduled to be arraigned in a downtown San Diego courtroom Wednesday afternoon.

The 30-year-old resident of Lake Elsinore in Riverside County is described as being 6′2″ and 230 pounds. He has a previous conviction for lewd or lascivious acts with a child under 14 years of age.

Gardner is scheduled to be arraigned at 1:30 p.m. Wednesday, March 3, in Department 12 at San Diego Superior Court downtown.

Gardner's mother lives in the Westwood development of San Diego near Rancho Bernardo Community Park and Lake Hodges. It’s believed he had been staying there for several days.

San Diego County Sheriff Bill Gore announced the break in the case at a Sunday night news conference. He said physical evidence found on the south end of Lake Hodges lead investigators to Gardner. Reports indicate underwear found near the lake contained DNA that lead investigators to Gardner.

Gardner’s home has been searched and he is being questioned by investigators.

Gore said searchers will continue looking throughout the night for Chelsea. When asked if the 17-year-old Poway High student is still believed to be alive, Gore said, “we’re holding out that hope.”

I cannot even imagine. My oldest is a 17 year old straight "A" student on the track and tennis teams. She always goes out alone for runs. Makes me sick. You almost let your guard up a little when they are 17 years old, and focus and worry more on the safety of the younger ones. You can't. 🇳🇴

She is a straight 'A' student, a talented musician, and a long distance runner. Now the investigation into the disappearance of 17-year-old Chelsea King is focusing on one man. He's convicted sex predator, 30-year-old John Albert Gardner.

"We've gathered numerous pieces of physical evidence and some of that evidence led us to identify Mr. Gardner," said San Diego sheriff William Gore.

Gardner is being questioned about Chelsea's disappearance, and about the disappearance of another teenager, 15-year-old Amber Dubois, almost exactly a year ago.

The distraught fathers of the two missing girls came to face to face as Amber's dad, joined the search for Chelsea.

Amber's father, Maurice Dubois, said, "It's an awful club of families to be in. It's not something anyone wants to go through, but once you've gone through it you basically know your role. You want to be there to help the next family. Get them through some of the hurdles that slowed you down."

John Gardner was convicted of a sex act with a 13-year-old eighth grade girl in 2000 and sentenced to six years in prison. He was living in San Diego, just 1,100 feet from an elementary school. That would be a violation of California's restrictions on sex predators.

"The urges are always going to be there. It's a sickness, and unfortunately, our system puts these people back on the streets," said Dubois.

It was an emotional moment as Chelsea's parents appeared on the Early Show Monday, and talked about the possibility Chelsea may have been murdered.

"Ultimately, regardless of that, the focus is still on bringing Chelsea home," said Mrs. King.

Anchor Harry Smith appeared visibly moved by the courage of Chelsea's parents. "We are so sorry. We are so so sorry," said Smith.
The search for Chelsea continues, using high-tech equipment like a pilot-less predator drone similar to those used by the C.I.A. in the war in Afghanistan. Others volunteers are going low-tech, using horses to comb every inch of this San Diego area park where Chelsea planned to go running last Thursday.

Chelsea's car has been found with her cell phone and i-Pod inside, but still no trace of the pretty strawberry blond teen.

Police say they suspect Gardner in an attack last December when another jogger was assaulted. She escaped after she elbowed her assailant.

The Jaycee Dugard case and sex offender Phillip Garrido thrust the issue into the spotlight in August when she was freed after more than 18 years of alleged captivity at his California home.

Now it's the disappearance of 17-year-old San Diego high school senior Chelsea King, pictured above, and arrest of sex offender John Albert Gardner, who police suspect raped and murdered the teen, that is raising some uncomfortable public safety questions.

A sex offender from southwest Riverside County was being held Monday on suspicion of murder and rape in the disappearance of a 17-year-old San Diego County girl last week.

A massive search for Chelsea King was under way Monday as authorities questioned John Albert Gardner III, 30, who was arrested Sunday at a restaurant in Escondido and was being held without bail.

Steve Walker, a spokesman for the San Diego County district attorney's office, said a decision on charges would be made by Wednesday.

The Poway teen disappeared Thursday after going for a run near Lake Hodges at Rancho Bernardo Community Park in San Diego, a regional park full of trails. Her BMW, with her cell phone and iPod inside, was found later.

Sheriff William Gore, appearing Monday with the girl's parents on ABC's "Good Morning America," said Gardner was arrested after investigators discovered a piece of physical evidence linking him to the case. He did not elaborate.

"We're confident that we have the right man in custody," Gore said. "Now we've just got to find Chelsea."

Investigators also suspect Gardner could be tied to a Dec. 27 assault on a female jogger from Colorado who fended off her attacker in the same park.

SEX OFFENDER

Gardner was required to register as a sex offender because of a San Diego County conviction for lewd or lascivious acts with a child under 14. Gardner lives in Lakeland Village, an unincorporated area outside Lake Elsinore. His mother lives in San Diego County.

San Diego County court records show Gardner was sentenced to six years in prison in 2000 for molesting a 13-year-old who lived near his San Diego County townhouse. The girl said he invited her to his home to watch a movie, then began to touch and kiss her, pulling down her pants despite her protests, court records show. Gardner hit the girl repeatedly in the face as he sexually assaulted her. Eventually, the girl ran to a neighbor's home for help.

A psychiatrist who interviewed Gardner at the time said he "would be a continued danger to underage girls in the community" and recommended the "maximum sentence allowed by law," court records show.

Gardner pleaded guilty to committing lewd acts on a child, court records show. He was released from prison in September 2005 after serving about five years and was on parole until Sept. 26, 2008, according to the California Department of Corrections.

Gardner also has a 1998 conviction for disturbing the peace in the San Bernardino County community of Twin Peaks, court records show.

Inland Connection

On Sunday, investigators searched Gardner's home in the 33200 block of Gillette Street. Authorities also searched his mother's San Diego home, said San Diego County Sheriff's Department spokeswoman Jan Caldwell.

On Monday, journalists and TV news vans lined Gillette Street in a blue-collar neighborhood of older homes overlooking the lake. No one answered the door at Gardner's two-story, gray stucco house, but neighbors said he lives there with his grandmother and another couple. They had seen him outside in recent months working on a Cadillac.

Vern Ray, 63, a next-door neighbor, said Gardner stayed off and on at the house. Gardner often helped with household tasks and yard work. Ray said the grandmother, whose name he did not know, is in the hospital. .The family moved in six to eight months ago, Ray said.

"They were quiet people," Ray said. "Sometimes they'd have a beer in the backyard and get a little rambunctious."

Linda Terrill, 45, who lives up the street, said FBI agents watched the house for a few hours on Sunday afternoon, then battered in the door. She, her housemate and relatives who live down the street recognized Gardner when agents showed them his photograph.

"It's kind of scary because we have teenage nieces who walk the street all the time," said Terrill's housemate, Cathy Pozza, 50.

The neighbors said they check the Megan's Law Web site to keep track of area sex offenders, but they were not aware Gardner was one.

"You never know who's living next door to you," said Terrill's mother, Barbara Terrill. "You could have Jack the Ripper."

A search involving 1,500 law enforcement personnel, dogs and volunteers failed to find Chelsea on Sunday. About 100 agents searched a rugged, four-square-mile area of the park on Monday. The FBI used sonar equipment to search Lake Hodges and 14 miles of shoreline.

The search for the straight-A senior at Poway High School also took to the Internet, where a Web site was created at findchelsea.com

Chelsea's parents, Brent and Kelly King, said they last saw their daughter when she went to bed about 9:30 p.m. Wednesday after playing French horn in a school concert.

"She is one of the most driven, personable, caring people that you could ever meet," Brent King said. "Her goal in life is to brighten everyone's day. That's what she does, and when she walks into the room, you know she's there."

Court documents paint a disturbing picture of John Gardner III, the convicted sexual predator arrested Sunday in connection with the disappearance of 17-year-old Poway teen Chelsea King.

Gardner was required to register as a sex offender after being convicted 10 years ago of molesting a neighbor girl.

According to Superior Court documents Gardner picked up his 13-year-old victim as she waited at a school bus stop on March 16, 2000.

The victim willingly went with Gardner to his mother's Rancho Bernardo home to watch a movie.

According to court documents, Gardner began touching the victim inappropriately and rubbing himself against her.

When she objected, he allegedly hit the girl in the head repeatedly before she managed to escape to a neighbor's house.

Gardner pleaded guilty in May 2000 to two counts of forcible lewd act on a child and false imprisonment.

He was sentenced to six years in prison. He served only five years and was released in September 2005.

Court documents show a staff psychiatrist who interviewed Gardener urged a longer sentence stating that Gardner "would be a continued danger to underage girls in the community."

The psychiatrist said Gardener showed no remorse and recommended the maximum sentence allowed by law which is 11 years.

"It is my opinion that [the defendant would be a continued danger to underage [girls] in the community," Dr. Matthew Carroll wrote in a report. "It is unlikely the defendant would be amenable to treatment."

Gardner remained on parole until September 2008, and after that was required to register as a sex offender.

The same court records indicate that Gardner may have had another run-in with authorities the year before.

In the fall of 1999, when only 19, Gardner also fondled a 14-year-old girl.

The documents indicate that incident was consensual.

In addition to Chelsea King's disappearance, investigators say they have positively linked Gardner to the Dec. 27 attack of a jogger at the same park where Chelsea disappeared, San Diego police Capt. Jim Collins confirmed Monday.

He said investigators also were looking into the possibility of a connection between Gardner and Amber Dubois, who disappeared while walking to Escondido High School on Feb. 13, 2009.

Ending a long local search for the Poway teen, Chelsea King’s body was found near Lake Hodges at approximately 2 p.m. on Tuesday, according to numerous local sources. There are unconfirmed reports of a knife found near the body, according to San Diego 6 CW.

The scheduled afternoon briefing on the search for Poway High School senior Chelsea King has been postponed, according to a sheriff’s spokeswoman. A news conference with Sheriff Bill Gore is schedule for 3:45 p.m.

Authorities announced Tuesday afternoon that the body of 17-year-old Chelsea King, who disappeared while jogging in Rancho Bernardo Community Park last Thursday, has been discovered in or near Lake Hodges.
The teen's body was found around 2 p.m. A candlelight vigil planned for the teen is still scheduled to happen tonight.
Earlier Tuesday, hundreds of volunteers and law enforcement personnel fanned out over fields, swamps and marshes around Lake Hodges for a sixth straight day Tuesday in a determined effort to find a Poway High School senior who went missing while on one of her regular jogs in the scenic area.
John Albert Gardner, 30, is in jail and awaiting a Wednesday arraignment on suspicion of raping and murdering King.
Gardner was arrested Sunday afternoon after authorities said his DNA was found on King's underwear, which was located in the Lake Hodges area.
The sheriff's department reported at 3:15 p.m. that they had rescheduled an earlier news conference for 3:45 p.m., which NBCSandiego.com will livestream. No other details are available yet.

News conference. Body was found in a shallow grave in an area that has been searched extensively. LE found the body...... spotted her (from the water) on the shoreline about ten feet from the waterline. Medical examiner has been called. Her body was found about 1PM about half a mile from the parking lot. Arraignment for the suspect is scheduled for tomorrow. Will not comment on the condition of the body. Most questions from the press are not being answered.

In the wake of the discovery of the dead body of Poway High school student Chelsea King and the arrest of convicted sex-offender John Gardener who lives in Lake Elsinore, the subject of “Megan’s Law” and what it is supposed to do is once again in the news.

The right of individuals to know if a registered sex offender is living in their area stems from the 1994 tragedy of Megan Kanka, a 7-year-old girl living in Hamilton Township, N.J. Megan was brutally raped and murdered by a neighbor who had been convicted twice of sexual crimes against young girls. The man was on parole at the time and nobody in the area was aware of his background.

In the aftermath of the horror, and sparked by outraged parents who wanted to know why such a man could live in anonymity next to young children, the New Jersey legislature quickly passed a law requiring police to notify residents that a high risk, convicted sex offender was living near them. It was coined “Megan’s Law” after the young victim.

Under Megan’s Law only the name, photo and vital statistics of the individuals deemed high risk will be made available. People won’t be given a list with the addresses of all registered sex offenders in the city limits. They will be able to look-up an individuals name to see if that person is listed, but that is all we will release.

Supporters of the law say it is a valid tool that can help police and parents protect children. In California, the Department of Justice in Sacramento has prepared a CD-ROM with the names of convicted sex offenders who must register with police. This information is provided to police agencies who have the discretion to decide which information will be released to the populace. To view the CD-ROM, one should contact their local police or sheriff’s department.

California enacted its own version of the law in 1996. The law says that the public has a right to know where all those convicted of sexual crimes are located. It requires police to notify residents when a high risk convicted sex offender moves into their neighborhood. Furthermore, all buyers of homes must be notified where they can access the Megan’s Law data base.

Two other areas of offense besides sexually related crimes require those convicted to register with police. Deemed psychological crimes, the other two are arson, and certain types of drug-related convictions.

In the case of arson, an offender must register for life, as with sex offenders. In the case of drug conviction, depending on the seriousness, one must register while on probation, and then for an additional five years after probation has been lifted.

Normal If he had been given the 11 year sentence he would have still be in prison and Chelsea would be alive.

John Albert Gardner III received a very light sentence in 2000 after prosecutors ignored a a psychiatrist’s warning and suggestion of a stronger sentence.

Prosecutors noted John Gardner’s lack of criminal history, and tossed in the standard “wanted to spare the victim the trauma of testifying” card when seeking the five year prison term for the sexual assault of a 13 year old girl.

John Albert Gardner III faced an eleven year maximum sentence under a plea agreement arranged a decade ago; however lenient prosecutors urged only six of those and the Judge complied.
Gardner plead guilty to assaulting a 13 year old girl. He served five years. A mere five years.

Prosecutor’s acknowledge in an eleven page memo that John Albert Gardner “never expressed one scintilla of remorse for his attack upon the victim.”

Dr. Matthew Carroll gave his opinion in the sentencing memo also, stating: “There is no known treatment for an individual that sexually assaults girls and does not admit to it in any way.”
This psychiatrist warned the powers that be that Gardner would re-offend. He pleaded for a 30 year prison term.

Now Chelsea King, 17, beloved daughter, honor student, athlete, friend to all, has gone missing and John Gardner is behind bars. It’s expected that he will be charged with rape and murder tomorrow morning, Wednesday, March 3rd, 2010.

Another beautiful life snuffed out by this plague of insanity running rampant!!!! This country needs to take a second and third look at this situation and do something different, because the status quo in controlling these offenders and sickos is not working. We need stronger, more enforced laws. This is all too much reading day after day of innocent victims, often times the perp already has done time for child rape or the like and is out doing it again and again. I am sick over this, so pardon my rant please.

Just in the last hour, on the nightly national news, they spoke of Clara County, CA having over 3000 registered sex offenders in it, and credited the county with doing random checks on these individuals to make sure they are keeping themselves clean. Then they went over to Cleveland, OH and interviewed LE, who said that Ohio does not have enforceable laws, so their hands are tied and they cannot do what they are doing in CA to try to stem the tide of repeat offenders. I say reopen Alcatraz and send them all there after their first offense and keep them out of society forever. angry crying

I agree TerryRose!! How many more will be murdered, abused, tortured, raped until someone stands and shouts ENOUGH! Does someone somewhere think these offenders will somehow someday be a benefit to society? Registration, notification, it all seems like a pretense of doing something. I am sitting here crying, trying to get my thoughts out, I keep typing and deleting, typing and deleting. Then I realize I have no words to adequately express my feelings of anger and helplessness.

On NG, her father said even after they found her body he was praying she was still alive.

San Diego Police are investigating graffiti on the garage door of the parents of John Gardner, the suspect in the apparent rape and murder of 17-year-old Chelsea King. A body suspected to be King's was found yesterday.

Garnder is due in court for arraignment today on rape and murder charges. He was arrested Sunday.

Reporting from Poway, Calif. - The intense search for Chelsea King ended Tuesday when authorities unearthed a body in a shallow grave near the lakeside park where the teenager had gone running last week.

There is a "strong likelihood" that the body is that of the 17-year-old Poway High School senior, though a positive identification had yet to be made, said San Diego County Sheriff Bill Gore.

The teenager's family was devastated, he said at a news conference, adding: "They were holding out hope, as we all were, that we would find Chelsea alive."

A dive team found the body on a tributary of Lake Hodges, in a wooded area that had been the focus of an extensive search since Saturday, after a shoe was found there. A diver working his way up the tributary saw debris about 10 feet from the water, which led to the grave, Gore said.

The site is about half a mile from the parking lot at Rancho Bernardo Community Park, where King had left her car before heading out on the trail.

News of the discovery quickly spread in the upscale San Diego suburb, where thousands of volunteers -- students, senior citizens, friends and family -- had joined hundreds of law enforcement officials hiking for miles in rough terrain to help find the missing girl.

"Everybody is asking the same question: Why?" said Paula Bunn, a bereavement counselor at the Chelsea King Search Center, who consoled several of King's distraught friends. They were still wearing "Bring Chelsea Home" sweatshirts.

The suspect in the case, John Albert Gardner III, a 30-year-old registered sex offender, is expected to be charged at a hearing scheduled for Wednesday, according to the San Diego County district attorney's office.

Authorities have expanded the investigation in recent days after linking Gardner to an attack in December on another young, female jogger in the same park.

They are also looking into whether he had anything to do with the disappearance of a 14-year-old girl last year in Escondido.

In the December incident, a 22-year-old woman was approached by a man who tackled her and demanded money. She escaped after hitting him in the face, bloodying her elbow. San Diego police did not disclose how they linked Gardner to the attack.

Some residents and people posting comments on the Chelsea King Facebook page have criticized law enforcement authorities for not posting warning signs in the park after the December attack. Gore declined to comment at the news conference.

The search began Thursday night after the teenager, a straight-A student and member of the San Diego Youth Symphony, failed to return home after going for a run.

Brent King, Chelsea's father, found his daughter's locked car in the parking lot.

"Fear gripped me and I took off running, searching for my daughter, calling her name at the top of my lungs," he said in an interview with KUSI-TV Channel 9 in San Diego.

Gardner was arrested Sunday afternoon outside a restaurant near the lake after unspecified evidence linked him to the crime, authorities said. The 230-pound Gardner, who is registered as living in Lake Elsinore, had been visiting his mother in Rancho Bernardo last week.

In 2000, Gardner pleaded guilty to molestation charges involving a 13-year-old girl.

He served five years of a six-year prison term and wore a global-positioning system tracking device until 2008, when his parole term ended.

John Albert Gardner III was arraigned in a downtown San Diego court Wednesday, pleading not guilty to charges of murder and rape in the death of Poway teen Chelsea King.

Amid a horde of media, about 15 King family members and protesters holding signs that state “Castrate Rapists” and “No Parole 4 Molesters” outside the courthouse, Gardner made his plea.

He was taken into custody without bail. A preliminary hearing to determine whether to continue to pursue felony charges will take place on March 18. The district attorney’s office is not expected to plea bargain in the case.

The court hearing came a day after the discovery of a body in near Lake Hodges that is suspected to be King’s.

Thousands gathered at a Poway church Tuesday for a candlelight procession for King. Authorities said earlier that day a body found in a shallow grave on Lake Hodges is likely the Poway High School senior.

The grim discovery was made on Tuesday by authorities who combed more than 14 miles of shoreline and a four-square mile area of terrain around Lake Hodges and Rancho Bernardo Community Park. King went for an after-school run in the park Thursday. Her locked, parked car was found with her cell phone inside, and there was no trace of the girl.

The search for King was aggressive. Organizers of the volunteer search and rescue effort say more than 4,000 people helped with the search. More than 1,000 arrived Monday, still hoping to find King alive even after authorities arrested Gardner, on suspicion of murder and rape in the case. Authorities have not said what evidence led them to the suspect.

I wholeheartedly agree, Terry Rose! There definitely needs to be changes made to our "justice" system (both in the USA and Canada)... I say send all the sexual predators to some deserted island in the North Pole! Either that, or mandatory castration!!

I also think it is time for young women to start realizing that this world is not a safe place anymore! If they want to go for a jog in a remote park, they should always have a "jogging buddy" and/or a weapon of some kind. I am 42, and I have never been attacked by a predator. But, I have always been very careful when & where I jog - in daylight hours and in a public place. I think it is up to the mothers of the young women, to really get this message through to them - it could save their life!!

As John Albert Gardner III pleaded not guilty Wednesday to murdering 17-year-old Chelsea King, the court-appointed psychiatrist who recommended at Gardner's first sex assault case that he be put away for a long time was furious that his warnings went unheeded.

Dr. Matthew Carroll was appointed by the court in 2000 after Gardner sexually assaulted a 13-year-old neighbor in his mother's house. Noting that Gardner denied the evidence and showed no remorse, Carroll warned the court Gardner would be a "continued danger to underage girls" and urged the maximum sentence, 30 years.

Instead, Gardener struck a plea deal for six years, was out in five, and wore a GPS device until his parole ended in 2008. Now Gardner, 30, is charged with the murder of King and with a Dec. 27 assault, with the attempt to commit rape, against a jogger who escaped. Investigators were also looking at Gardner in the disappearance of 14-year-old Amber Dubois of Escondido. If convicted on the charges filed Wednesday, Gardner could get the death penalty.

'Frustrated and Angry'

"He's frustrated and angry they didn't listen to what he said," says Dr. Mark Kalish, a psychiatrist who shares offices with Carroll and spoke on his behalf. "He said: 'Give him the maximum sentence,' and psychiatrists generally don't do that."

He says the prosecutors agreed to the plea deal to avoid the time and trouble of a trial and to spare the victim the trauma of testifying. A San Diego County District Attorney's spokesman tells PEOPLE the office can’t comment on the earlier case because the facts of the prior assault are now a component of the new case.

King disappeared last Thursday and her body was found Tuesday in a shallow grave near the park where she'd gone jogging. Her case has quickly received national attention and outrage, drawing comparisons to other recent high-profile cases, including Jaycee Dugard and Sandra Cantu, in which victims suffered horrible fates after the system allegedly failed to take seriously the threats that the defendants posed to others.

Legal commentator Robin Sax, a former sex crimes prosecutor for the Los Angeles County District Attorney's Office, says most sex offenders are family members and not strangers, and most don't kill their victims. She says it's not uncommon for a sex-crimes prosecutor to agree to a plea deal to avoid the risk of losing the case altogether and watching the defendant go free.

However, she adds, she feels that prosecutors often worry too much about subjecting the victim to testifying. "If you warn the victim that if they don't testify, the rapist goes free, then they do it," Sax says. "And if the jury still doesn't convict, then it's on the jury."

I think it is up to the mothers of the young women, to really get this message through to them - it could save their life!!

Rainbow-I totally agree.
Years ago when Richard Ramirez was terrorizing our community my parents wouldn't let me go anywhere alone. I could not drive with the top down on my car at night. I was not allowed to walk the dog by myself.
I had to drive straight home from work if I worked at night.
You really do have to be vigilant. He ended up brutally beating some women and killing a young girl just blocks from my parents' home.

As a mom of a 17 yo daughter, I was telling my husband about this horrible case, and how I will now worry when Sarah goes out for runs by herself. Do you know what his response was? "Things like that don't happen around here"!!! OMG! It can happen anywhere!!

Cherylz, Why must Sarah jog alone? If she must please make sure she wears a whistle around her neck, carries pepper spray in her clinched fist and has a cell phone with gps. What your husband thinks is common...it will never happen to me....guess what that is what everyone thinks, until it happens to them. Maybe he should become a member of VH and read about real life and how it can be ugly anywhere.

I know Laga. She will sometimes run alone when it is off-season for the High School track team. It is always in our neighborhood, but still. One can never be too safe. She carries her cell phone with her. A whistle is a good idea!

I agree with you Cherylz it can and does happen everywhere! Laga gave some good advice you just can't be too careful anymore no matter where you live.It's just my opinion but I think men in general don't understand how many SO are luring around looking for their next victim. Men don't carry pepper spray or hold their car keys in their fingers to use as weapons when they jog or go out at night. Sadly it's a different world now and we have to teach our children to protect themselves.

Back in the late 60s a shirt tail relative of mine was killed at school early in the morning. Her dad took her to school early so she could practice for a band competition that was coming up. He body was found behind the stage curtains in the gym; she was 14 years old. Another student (it came out in his trial that he was gay) had "tried" to rape her and when he "couldn't" he killed her. He testified, at trial, that she had begged for her life and told him to do anything he wanted to her, but "please don't kill me". He was committed to a mental health facility until he was 21 and, soon after he was released, his car hit a tree and he was killed.

I know Janie...and then you still have to worry about them getting behind the wheel.
BJ...that is horrible. I worry about my 15 yo son. He was cyber-bullied last year. And this year it seems like the 14-15 year old boys all want to get into fights w/ each other. See, I find this out b/c I have his password for Facebook. It is the only way I will let him have one. The stuff I see on there! :oops:

Normal Chelsea King Case: Outrage Over Sex Offender Monitoring Reaches White House

John Walsh, host of "America's Most Wanted," said he met with President Obama Wednesday to discuss child protection laws and funding for the Adam Walsh Act, signed three years ago by President Bush.

The law promised to create a national registry of sex offenders and keep closer track of the most violent of them, but it did not come with the funds needed to carry it out.

"President Obama said yesterday, 'As the father of two girls, John, I will get the Adam Walsh law funded,'" Walsh told "Good Morning America" today.

Walsh, whose 6-year-old son for whom the law is named and who was kidnapped and murdered in 1981, knows firsthand the grief King's parents are experiencing.

"They're in the worst place a parent could be," he said. "They look in that courtroom and see a guy who should have never been out on the streets."

King, a well-liked honors student, vanished after heading out for a jog in a semi-rural San Diego County park. Her body was found less than a week later, buried in a shallow grave near the shore of Lake Hodges, about a half-mile from her car.

But the outrage grew with the arrest of Gardner, a known violent sex offender who has since been charged with the December assault and attempted rape of 22-year-old Candice Moncayo in the same park where King's body was found.

"I think everyone asks the same question," Walsh said. "Why was this animal out on the streets?"

"The law should be once you offend, you're done, you're toast, you're in the slammer or you are executed," one angry woman said as she stood among protestors outside the courthouse.

Former San Diego County District Attorney Paul Pfingst was slightly more objective.

"I am of the view that people who do harm to teenage girls should go to Gitmo and stay there for the rest of their lives and be waterboarded," he said.

Authorities said Gardner may also be linked to the February 2009 disappearance of 14-year-old Amber DuBois, who vanished on her way to school, not far from where Gardner was living at the time.

"The girls are the exact similar build," Maurice DuBois said of his daughter and King. "Both white girls, both five-five, both 130 pounds."

Detectives across California are now looking into other unsolved cases involving young girls and considering whether there are any more possible links to Gardner.

Gardner pleaded guilty in 2000 to charges of committing lewd and lascivious acts on 13-year-old girl in his parents' home. He served five years of a six-year sentence and was on parole until 2008.

In court Wednesday, Gardner was flanked by two court officers. His head was shaved and his hands were manacled around the waist of his blue prison jumpsuit.

Keeping his eyes down, Gardner, 30, only answered "yes" to the judge's question about whether he understood the charges.

No bail was set, and the prosecutor did not mention any of the details of the alleged crime. Gardner was assigned a public defender for the arraignment, but that lawyer may not represent him at trial.

Prosecutors said the severity of the accusations, including a "special allegation" that a murder was committed during a rape, could carry the death penalty. The decision to seek capital punishment, however, is weeks away.

"The special allegation does make the defendant eligible for the death penalty," Deputy District Attorney Kristen Spieler said at a press conference following the arraignment. "That decision is made by the DA, typically after the preliminary hearing and before a trial."

If the district attorney does not seek the death penalty, the charges carry a penalty of 25 years to life.

Dr. Matthew Carroll, a court psychiatrist, who evaluated Gardner before his release from prison on the 2000 conviction, had pushed for the maximum sentence, as many as 30 years, and said Gardner "would be a continued danger to underage girls in the community."

Dr. Alex Kalish, a colleague, said Carroll was angry that his recommendations were ignored a decade ago.


"Dr. Carroll told the court that [Gardner] showed no insight and expressed no responsibility and that he is a danger. You can't make a stronger statement than that," said Kalish. "The guy is violent and a predator who shows no remorse.

"There was no effort to consider his report. Apparently the DA did what was expedient to get a conviction. It is frustrating that no one considered the psychiatric input. Why ask for it, if you don't consider it," Kalish said.

WHAT??? The charges could carry a sentence of 25 years to life? This type of criminal never needs to see the light of day again after being convicted. Remember the 100 yr old offender. They never stop until they are stopped.

I agree with you all and disagree with the thoughts of Cherylz's hubby. I like the idea of reopening Gitmo and waterboarding these evil perps and keeping them there with no parole.

Years ago when Richard Ramirez was terrorizing our community my parents wouldn't let me go anywhere alone. I could not drive with the top down on my car at night. I was not allowed to walk the dog by myself.
I had to drive straight home from work if I worked at night.
You really do have to be vigilant. He ended up brutally beating some women and killing a young girl just blocks from my parents' home.
I remember that. Was living in Sherman Oaks. Came home from work and Coldwater Canyon was blocked off. I had to show ID to get through to my apt. He had attempted to break into one of the tenant's window's. I slept w/my gun until he was arrested.

BJ, loved your Karma story. I know you said earlier he didn't look like a perv, or words to that effect. It's gotten to the point that it's hard to know who to trust with your children. And women are getting as bad as the men.

Gitmo sound good, TR!! I hope Obama and John Walsh do whatever it takes to ensure (sp??) that these pathetic, demented losers don't see the light of day after the first offense.

I am pretty sure you gals with young children or teenagers are extremely aware of what can happen and in keeping your kids safe. But still, we cannot be with them 24/7 once they start school.

OMG charming! I bet your parents were so frighten every time you left your house. I remember Richard Ramirez the Night Stalker his crimes were so brutal! It had to be a nightmare till he was caught! BJ I'm so sorry about your cousin I'm glad the person who did it got what he deserved!

Oh, it gets worse.
I have had former students of mine killed in drive-bys.
My best friends brother (who was the same age as my bro and in the same classes at the high school) was killed by some guy he met at the mall. He had stood up another friend of mine for lunch that day. When he didn't report for work after school at his uncles meat shop the family went looking. He was missing for more than a week when his cousin saw someone driving HIS CAR on the freeway and followed the guy home. It was reported to the police and he lead them to Matt's body on the side of the freeway, where he had been dumped after being shot 5 times.
Arcadia, Ca is one of the best places to raise your kids in the country, however, you have to be vigilant.
