So, if LE looks at the cell phone records for Rachel's phone that was found, they can see the numbers for the received calls and find out where they originate from.

Here's the latest news, So Sad. Things are not working in Rachel's favor, sadly :pale:

CLARKSTON - The family of 40-year-old Rachael Anderson is again asking for the public's help, this time wanting everyone in the area who has property to make sure they search it.

Anderson's daughter Amber Griswold said landowners should look for anything suspicious or out of place.

She said the family is looking for any clues that might lead them to Rachael.

Clarkston Police Chief Joel Hastings said Thursday they had nothing new to release about the case, but the task force to find Anderson is continuing to work hard and follow leads.

Anderson has been missing under suspicious circumstances since April 16. If you have any information about her whereabouts call the 24 hour police dispatch center at 509-758-2331.

I certainly hope that's what they are doing. All I found on the ex in the AZ public database was some minor infractions and a DUI. Some counties don't report and some of the DV stuff is not reported, supposably for the victim's protection.

Husband of missing Clarkston woman arrested in Moscow

May 6, 2010, 12:48 pm


The estranged husband of a missing Clarkston woman has been arrested for allegedly violating federal firearms laws, Moscow Assistant Police Chief David Duke said.

Charles A. Capone was arrested on a Bureau of Alcohol, Tobacco, Firearms and Explosives warrant at approximately 10 a.m. in Moscow, Duke said.

Duke said Capone is being transported to Coeur d’Alene, where he will be arraiged in federal court.

Capone’s estranged wife, Rachael Anderson, was last seen in Moscow on April 16. The arrest was not made in connection with Anderson’s missing persons case, Duke said.

Anderson’s case is being treated as a suspicious missing persons case because she failed to show up for work at the Pathologists Regional Laboratory in Lewiston, which is highly unusual for the woman, officials have said. http://www.websleuths.com/forums/showthread.php?t=103445

POKANE -- Charles Capone, the estranged husband of a Clarkston woman who disappeared in mid-April, was arrested Thursday morning by the ATF on a weapons charge.
Capone, a convicted bank robber who also had a history of assault and burglary, was arrested at his business in Moscow by agents with the Bureau of Alcohol, Tobacco, Firearms and Explosives. His wife, Rachael Anderson, disappeared on April 16th, four months after she first reported that her husband had pushed and strangled her on January 2nd. Five days later she filed for divorce from Capone, who she had been married to for three months.
On April 28th, about two weeks after Anderson was reported missing, a man went to the Moscow Police Department to report that he had given Capone a Lock Model 22 .40 caliber pistol back in February as collateral for a Dodge Dakota pickup truck he wanted to purchase from Capone.
When the man decided he couldn’t afford the truck he went to get his pistol back, only to be told by Capone he had taken it to a friend’s house for safekeeping but that friend was out of the country so he couldn’t get the gun back. Capone later purchased the pistol from the gun’s owner, which under law he was not allowed to do as a felon.
The next day, April 29th, task force investigators looking into Anderson's disappearance searched the home of the man that Capone had been living with from early February through April of this year. The man let him stay temporarily as he knew Capone was having marital problems. In mid-February the homeowner says that Capone brought a Glock pistol to the home and, knowing Capone had ongoing marital problems, volunteered to store the pistol for him.
The man also said that Capone had taken the gun with him in mid-February down to Lewiston to follow her and figure out if she was seeing someone else Suspect . The homeowner took investigators to where he had stored the gun and turned over the Glock pistol to them, adding that he had asked Capone to leave his home because he was aware of the ongoing investigation into his estranged wife's disappearance and because he was leaving on a business trip.
Because Capone is a convicted felon and was in possession of a firearm agents with the Bureau of Alcohol, Tobacco, Firearms and Explosives arrested him at his business Thursday morning.
Rachael Anderson's family has been afraid for her life since her disappearance. Anderson's daugher Amber Griswold said that her mother had been receiving strange text messages, phone calls and her tires had been slashed over the last few months. There is no doubt in my mind that the husband is responsible. I am so angry that his "roommate" knew he was taking a gun with him to see if his estranged wife was seeing another man and didn't seem to do anything about that!

LEWISTON - Members of Rachael Anderson's family say they are happy that Charles Capone was arrested Thursday and hope it leads them to answers.

"I knew him well enough to know that I didn't like him," said Rachael's daughter Amber Griswold.

Griswold said her mom married Capone in September but quickly wanted an annulment.

"She was so excited to get married to him, she wanted to be with him forever," said Griswold. "She thought it was like a fairy tale. She was basically tricked into it, that's what I felt like."

Anderson filed for divorce in January, just days after her family says Capone choked her. But Amber said there were many other incidents before that.

"'He's grabbing something, it looks sharp, his stabbing the tire,' she's (Rachael) like screaming this over the phone, so scared," said Griswold. "I don't remember how she made it home that night. I think a friend came and got her."

Amber said those are the reasons why the family thinks Capone was the person stalking and harassing their mother and perhaps knows about her whereabouts.

"(We said) it's Charles mom, it's Charles, we know it's Charles," said Griswold. "But he would say 'I'm getting text messages too. I'm getting voicemails like that too. I'm getting stalked also.' So, it was kind of a common thread where she could call him and say 'are you getting text messages too? What are they saying?'"

On Friday there will be a bake sale from 7:00 a.m. to 4:00 p.m. at St. Joe's, just outside of the cafeteria, to help pay for expenses for the family.

COEUR d'ALENE - The federal case against Charles A. Capone names him as a person of interest in the disappearance of his estranged wife Rachael Anderson, who has been missing for three weeks.

Capone, 48, was arrested at his place of business Thursday morning in Moscow by Alcohol, Tobacco and Firearms agents for being a felon in possession of a firearm.

Capone was arraigned in U.S. District Court in Coeur d'Alene via video Thursday morning before federal Magistrate Judge Larry Boyle. Court records say the prosecution is requesting Capone be held with no bail prior to trial. The prosecution cites a serious risk that Capone will flee and poses a danger to others.

A preliminary exam and detention hearing will be held on Monday afternoon.

According to documents filed in federal court, Chase Ervin went to Moscow Police on April 28th saying in February he gave a 40 caliber pistol to Capone as collateral for a truck Ervin wanted to buy. But then he decided he didn't have enough money for the truck so went to ask for the gun back, but was told it was at a friend's house and that the friend was out of town.

Then in March Ervin says Capone gave him $450 dollars for the gun. The next day the task force investigating Anderson's disappearance searched the home of Robert Bogden in Viola. Capone had reportedly stayed there from February to April 20th.

Bogden told police that Capone followed Rachael in mid-February to see if she was seeing another man. Bogden said Capone carried a gun with him while he followed Anderson. The model 22 Glock was seized by police at Bogden's home.

Police say Capone stopped staying at the house because Bogden was leaving on a trip and was concerned about the investigation into Anderson's disappearance.

Capone faces up to 10 years in jail and a fine up to $250,000 if convicted.

Capone has a criminal history, including bank larceny, aggravated assault and burglary.

Anderson filed a report with Clarkston Police on January 2 saying Capone pushed and strangled her. She signed divorce papers on January 6. The two were married in September of last year.

MOSCOW - The Rachael Anderson Task Force is hoping to get more information from Charles Capone.

Capone is being held in the Boundary County Jail without bail on federal charges of unlawful possession of a firearm by a felon.

Captain Dan Hally, of the Asotin County Sheriff's Office, and a lead investigator on the task force, said Monday that Capone's statements to the media that he wants to talk to investigators, would be welcome, if that is what he really wants to do.

Hally said they continue to review data along with new tips about the whereabouts of Rachael Anderson and her contacts on April 16th in Moscow and Clarkston.

Capone, Anderson's estranged husband, was the last person to report seeing Anderson on the 16th in Moscow.

Hally said they are also continuing to develop information regarding possible stalking activity with Anderson as the target.

The task force has yet to get results back from the state crime lab for testing done on the White GMC Yukon that Anderson was reportedly driving before she disappeared. It was found in North Lewiston on April 21st.

The task force is asking that anyone who noticed suspicious activity, possibly involving the SUV, on the night of April 16th or early morning hours of the 17th, on the highways or back roads between Clarkston and Moscow or areas just north of Moscow, to call police at (509) 758-2331.http://www.klewtv.com/news/local/94783164.html

I really don't know the answer to that, but, rumor has it that's why he didn't want RA to take his name---be connected....which I thought was odd. Rachael was the fourth wife and he the same for her. The girls are from the first marriage, oldest boy from second, and the smallest from the third. Boys are now with their dads in the same town. Rachael and CC were only married in Sept., I believe, and it lasted only till Jan. Rumored big fiasco around X-Mas with him spanking the oldest boy and destroying his and his mom's presents.
The proceedings in the divorce did not get far--whether being time, money or both, but the harrassment and stalking began just weeks thereafter. He was truly nickel and diming her to death with various car repairs, changing phones, numbers, etc. She was terroristically petrified and he was very good at his game. She was described as someone very strong minded and willed, and as you all prolly know, this could also be detrimental in a controlling situation.

Thanks for your comments Margo! I have read a LOT about this case on other sites and have been following the FB page as well. It is so sad, because my Aunt was friends with her at work and is so sad for this family. The entire community is saddened by this case.

I hope he ends up talking!! I hate to say it, but I fear the worst has happened to Rachael, as so much time has passed. :pale:

I only wish someone would come forward if they saw that white yukon on any back road that seemed suspicious. I know there is a lot of wooded and remote areas he could have taken her! 🇳🇴

I wasnt following this case, but after reading the comments, I see that her ex-husband (of three months!) is the killer. Another one. Where does it end?
What in the world did this woman see in this man that she married him in the first place? I guess for some women having a man around is better to them than having no man. I just dont get it.
This woman was young only 40, my daughter is going to be 39 so to me she was young anyway. She had grown childen and grandchildren so I guess she married very young. I guess its the gullibility factor
so many young women and girls are so gullible. You have to look at men with a more jaundiced eye today is my opinion. Or just keep your eyes wide open!

Just heard that the oldest boy is being bullied at school and had a counselor check in with them tonight. They suggested they hold a memorial as a way of closure for family. JMO...but I think it's too soon for that...it's only been a month. I thought they were to help you through difficult times, not telling you to just have a memorial, let LE do their thing, and you get on with your life?
The Lewiston Tribune ran an article (which I can't read because I'm not a subscriber) with LE asking for any tip or information of a sighting of RA or the Yukon between Moscow and Clarkston; also the area just north of Moscow and all back roads between the two for late Friday the 16th or the 17th. The full article is on the daughter's FB a/c for RA--link in the timeline link upthread. There's also a rumor of someone seeing the vehicle in Pullman and later outside an abandoned grain elevator. These kids are so torn and the whole family turned upside down. It's heartbreaking.

I agree, eyes, ears and your radar. You don't even have to be gullible, some men are just too good at hiding their real self. Look at Bundy. Hurt my arm-- please help me load this in my car--- and bingo. Others, for whatever reason, and how "mature" just can't tell the truth.

4/19/10 Police in three states are on the lookout for a missing woman from Clarkston.
Reported missing by her daughters after not showing up for work.
"There have been harassment reports made by Miss Anderson in the last two months," said Hastings. "Those have previously been investigated. There were no arrests made on those cases. The detectives are reviewing those reports and have followed up on information they thought was necessary to look into."
On Monday night, police searched a field off of Warner Avenue, the last place they could track Anderson's cell phone to, but found nothing.
Hastings said the FBI has not been notified yet but that they may be called.
“On the day that my sister and I reported our mother missing,” Rachael said, “our mother was supposed to meet with detectives to try and find out who was stalking and harassing her. Interestingly, my mother also had documented information which she was compiling together that is now missing.”

4/21/10 After a 12:30 pm tip today, police found the vehicle, a white 1997 GMC Yukon, that was loaned to Anderson, behind the Dynamart station, which is also a Greyhound bus stop, in North Lewiston, ID on Wednesday. The chief said detectives took evidence from the Yukon and sent it to the state crime lab.
Lewiston Police said there is security video from the bus stop where the SUV was found. They said they are going through three days worth of video from several different cameras.

4/22/10 Friends organized a prayer vigil Thursday night at Beachview Park in Clarkston at 8 p.m. The public was invited.
Police have organized a task force comprised of officers and deputies from various local agencies. The FBI has also been notified but has yet to directly join in on the case.

4/23/10 Law enforcement officials confirmed a Moscow building where missing person Rachel L. Anderson was last seen was searched Thursday night in Moscow.
Detectives have searched both a car and a building where a Clarkston woman was last seen in an attempt to pinpoint her whereabouts. Anything they thought was possibly of value was collected and sent to the (Idaho) crime lab,” Hastings said
Moscow Assistant Police Chief David Duke said the Moscow Police Department also is working on getting a search warrant for a storage shed Anderson rents in Moscow. Duke said police will look for background information in the shed if they receive the warrant.
On Friday, Clarkston Police Chief Joel Hastings, who is also acting as the spokesperson for a six-agency task force dedicated to the case, said police on Thursday searched the GMC Yukon reportedly being driven by Anderson before she disappeared. It was found by the Dynamart in North Lewiston, next to a Greyhound bus stop.

4/24/10 Anderson’s family has converged into the area from all across the Northwest to aid in the search. Griswold says she just can't sit and wait by the phone. She has set up a Facebook page, organized a candlelight vigil and continues to search the field where police tracked her mother's cell phone
The search for a missing Black Hills woman continues in Washington state Saturday night. Rachael Anderson is originally from the Belle Fourche area but now lives in Clarkston, Washington with her children and grandchildren.
Anderson's brother, Robert says she is a very caring mother, and for her to go days without being heard from is very uncharacteristic.

4/26/10 Clarkston Police Chief Joel Hastings told KREM 2 News they found her cell phone in her abandoned SUV. Detectives are now looking through the phone for clues.

Hastings said that because of the many jurisdictions involved, an eight-person task force is working on the case. “They are making this case their primary duty right now,” he said. “It’s a suspicious missing persons report.” He confirmed that Rachael Anderson had reported incidents of harassment about two months ago.

4/27/10 Anderson's daughter Amber Griswold said members of the family and others were spread throughout the area Tuesday, looking for clues. Griswold said she was headed to Riggins while others were going to Pomeroy.

4/28/10 Out of town relatives have flown in from as far away as Wisconsin to pass out fliers and posters with Anderson's picture, hoping someone has seen her. Her sister is praying for the best, but worries Anderson is hurt. Her family is asking that the farmers and large landowners keep an eye out for her. They are hoping to set up a cash reward for information on the case.

LEWISTON, Idaho -- The pace of tips being received about the whereabouts of a missing southeastern Washington woman, who was last seen in April, has slowed, detectives say.

Meanwhile, Rachael Anderson's estranged husband - the last known person to see her - remains in an Idaho jail awaiting separate federal weapons charges.

Anderson has been missing since April 16. Early this year, the Clarkston, Wash., resident petitioned for divorce after alleging her husband, Charles A. Capone, strangled and shoved her.

The tips are still coming in, but "it's obviously a lot slower than it was to begin with," Clarkston Police Detective Dan Combs told the Lewiston Tribune.

Amber Griswold, Anderson's oldest daughter, says waiting for word of her mother has been difficult for the family. Anderson's birthday earlier this month was especially tough, she said.

Capone, a resident of Moscow, told authorities he last saw Anderson, 41, in Moscow, while she was driving a white GMC Yukon that was recovered in Lewiston several days later.

A task force dedicated to the case had been meeting twice a week, but is now coming together only on an as-needed basis. The task force last met on June 11.

Still, police say they haven't given up.

"It's still an active investigation," Lewiston Police Lt. Doug Clark said. "The case is going to remain open until there's developments."

Capone, 48, served time in an Idaho prison after a felony burglary and aggravated assault conviction stemming from a 1997 incident where a woman accused him of threatening her with a knife.

In that incident in Latah County, court records show Capone broke into the woman's bedroom.

He's now in federal custody of the Bonner County Jail in northern Idaho without bond on two counts of unlawful possession of a firearm. Capone has pleaded not guilty; a trial is set for July 6.

Capone has not been charged in connection with his wife's disappearance, nor has he been named as a suspect.

Charles A. Capone pleaded guilty Tuesday to one count of being a felon in possession of a firearm.

The Moscow man appeared in U.S. District Court in Couer d'Alene. An additional count of the same charge was dropped as part of the plea agreement.

Assistant U.S. Attorney Mike Mitchell said Capone will be held in the Boundary County Jail until his sentencing on September 27th.

In a separate investigation, Capone has been named a person of interest in the disappearance of his estranged wife, 41-year-old Rachael Anderson of Clarkston. Anderson has been missing since April.
Authorities say Capone told a friend he carried a gun while following Anderson in February to determine whether she was seeing someone else.


Capone was arrested on the gun charges in May.

The husband of a Clarkston woman last seen shortly after she filed for divorce will remain in federal custody after pleading guilty to a federal weapons charge Tuesday in Coeur d’Alene.

Charles A. Capone pleaded guilty to one count of unlawful possession of a firearm, which carries a maximum sentence of 10 years in prison and a $250,000 fine. He’s to be sentenced in September.

Capone is the last person known to have seen his wife, Racheal Anderson, a 40-year-old who’s been missing since April.

Capone has felony convictions for aggravated assault, burglary and bank larceny, which prohibits him from possessing weapons. He was arrested in May after police learned Capone had bought a Glock .40 pistol that he was storing in an acquaintance’s safe.

That acquaintance told police Capone gave him the gun for storage in February, according to federal court documents. Investigators seized the gun, leading to the federal charge against Capone.

Capone is in federal custody in the Bonner County Jail.

Normal Capone sentenced on gun charges

The families of Charles A. Capone and Rachael Anderson sat on opposite sides of the courtroom here Monday as Capone was sentenced to 33 months in federal prison.

The 49-year-old Moscow man and convicted felon was praised by those close to him during a hearing in U.S. District Court, but criticized by the family of his estranged wife, who disappeared more than five months ago.

"You talk a good game, you say the right things, and you present yourself very well," U.S. District Judge Edward Lodge said in handing down his sentence. "But a lot of your criminal history isn't consistent with that."

The judge sentenced Capone to prison, followed by three years of supervised release and a $3,000 fine, after Capone's guilty plea to unlawfully possessing a .40-caliber Glock pistol earlier this year.

He faced a maximum penalty of up to 10 years in prison.

Capone appeared Monday wearing black-rimmed glasses and a yellow Bonner County Jail jumpsuit. He told the judge he accepted responsibility for the crime he committed and asked the court to look at the accomplishments since he last appeared before the court.

He told the judge he's not always made the right decision, and said taking the Glock in trade for a down payment on a pickup truck was a poor choice.

"It's my own fault, I became a convicted felon who wasn't able to go hunting, who wasn't able to use guns," Capone said, but added no one would come out "squeaky clean" through the microscope he's been under.

He made no mention of his wife. Capone was the last person to see Anderson in Moscow April 16. He has been named a person of interest by a task force investigating Anderson's disappearance, but has not been charged, nor named a suspect in the suspicious missing-persons case.

Lodge ordered Capone to wear a key around his neck during a previous sentence so he would know he held the key to his future. The judge reiterated the message Monday, and said Capone is the one who'll determine if he's again a productive member of society.

Capone may have been a good neighbor and friend, but Lodge said he also exhibited disturbing juvenile behavior and was diagnosed with both adjustment disorder and a habit of lying.

No witnesses were called during the hearing, but multiple letters were sent to the judge, and two people spoke to the court on behalf of Capone. Anderson's family did not speak at the hearing because the gun charge is unrelated to her disappearance.

John Merrick, who attends the same church as Capone, praised his friend as an honest man and an honest mechanic who was always ready to help people in need.

"My relationship with Charles and what I know of him has been very positive over the years,"

Capone's sister, Teresa Capone-Mullen, described her brother as a caring man who changed his life around since his last run-in with the law. Capone built his business from the ground up, she said, and family members had to liquidate Palouse Multiple Services after Capone was arrested.

But Assistant U.S. Attorney Michael Mitchell said those statements and Capone's criminal history painted very different pictures.

"I think it is evident with the letters filed with the United States, there is a private life of individuals and then there is this kind of public life," Mitchell said in recommending a 41-month prison sentence, the high end of the range under federal sentencing guidelines. "Even if you know the person, you don't really know them."

The prosecutor detailed a criminal history dating back to when Capone was placed in a juvenile group home as a teen. He was later charged in the 1986 robbery of a convenience store, and Mitchell said he conspired to steal $88,000 from a safe 11 years later. That conviction was followed by convictions for aggravated assault and burglary in 2nd District Court for breaking into the residence of another woman and allegedly contemplating whether to kill her.

"People can say that Mr. Capone is not a violent individual, but if you were in front of him in a convenience store in 1986, you would have deemed him a violent individual then," Mitchell said.

In addition to a prison sentence, Mitchell asked for a $1,000 fine for each of the three guns Capone is alleged to have possessed. Capone pleaded guilty to one count of unlawful possession of a firearm as part of a plea agreement.

Defense attorney Roger Peven countered his client had built a reputation in Moscow of helping others in need. Recommending Capone serve less than 24 months in prison, Peven argued Capone never acted violently with the firearms.

According to federal court records, Capone allegedly told a friend he carried the Glock while he followed Anderson around in February to determine if she was seeing someone else.

Anderson's daughter Amber Griswold and a handful of other family members in the courtroom wore black T-shirts with Anderson's name and the date of her disappearance emblazoned in pink lettering on the back. "Stalking isn't love" was printed on the front of the shirts.

Griswold called Capone's statements to the court "a lot of lies."

"It's hard to hear him say he's lost his business, what about his lost wife?" Griswold asked. "He does not even care a bit."

Her family is hoping someone comes forward with any information or that someone talks about their mother's disappearance.

Anderson and Capone married last year, but she filed for divorce in January after allegations Capone strangled and shoved her at her Clarkston home, according to court records.

Detectives have netted few leads in finding Anderson. The borrowed white GMC Yukon she was driving the day she disappeared was found parked and unoccupied at a North Lewiston gas station a few days later. Her cell phone was found inside the car.

Griswold said the family was disappointed in the sentence but glad Capone will be behind bars for at least some period of time.

"We hope that we get more people standing behind us and not forgetting about this," she said.

This story is so sad. There is a part of me that really hopes she just got on that bus or train and took off out of town to get away from this sicko, but hearing how much she cared and loved her sons and daughters, I don't her as the one to just leave and never come back.

He had 2 almost 3 days to cover his tracks and make sure they never find her.. IMO, I imagine this will be one of those cases where he body is found by a hunter or outdoorsman, sometime down the road.. as hard as it is for me to type that.. it just never looked good from he beginning. Our only hope now is that Capone will open up to someone in jail 🇳🇴 crazy 1 crying huge waste

The mother of four was last seen in Moscow two years ago today, and posters of the dark-haired woman with a big smile are still hanging in storefront windows and pinned to bulletin boards across the region.

At this point, police believe she was murdered, and detectives haven't stopped searching for clues in their investigation of what happened to Anderson on April 16, 2010.

Asotin County Detective Jackie Nichols said police know there are people out there who could provide the answers, and they are making progress in piecing together evidence.

"We will leave no stone unturned," Nichols said. "We are getting closer."

Anderson's family wants closure, but they also know it's going to be difficult to hear the cold, hard facts of what transpired. They say Anderson, who was 40 at the time of her disappearance, wasn't the type to run off and leave her kids, so something terrible must have happened.

"It is hard to believe it's been two years," said her oldest daughter, 26-year-old Amber Griswold of Lewiston. "I feel frozen in time. I want a resolution, but it's frightening both ways - not to know and to know the truth."

Griswold said the passage of time hasn't made it any easier to accept that her mother is probably never coming back. The family can't move on or grieve properly because Anderson is still missing.

"I think about my mom multiple times a day and she is in every single one of my dreams," Griswold said. "I feel like we're at a standstill. It's discouraging because there's nothing the family can do right now."

Anderson's younger sister, Kristina Bonefield, said it's taken a toll on everyone in the family. The 33-year-old woman lives in Belle Fourche, S.D., where Anderson grew up.

"It's just so hard to say goodbye to someone when you don't know where they are," Bonefield said in a phone interview with the Tribune. "How can you not think about a missing family member? She's my sister, and I miss her. I feel so sorry for her kids."

In the beginning, family members almost felt guilty if they even thought for a minute she wasn't coming back, Bonefield said, breaking into tears.

"You felt like you were giving up hope. Now it's been two years. She definitely didn't run off and leave her children. She has a new grandbaby who was born in February, and she wasn't there. She made a big deal out of birthdays and stuff. It's like a huge part of our lives is gone."

Capt. Dan Hally of the Asotin County Sheriff's Office said one of the most frustrating parts of this case is not being able to provide answers that would give the family some closure.

There are persons of interest in the case, including Anderson's estranged husband, Charles A. Capone, Hally said. He is in prison on a federal firearms charge and scheduled to be released in September.

"Even though the evidence has led us to focus somewhat on specific individuals, we still continue to investigate all possibilities, and we haven't drawn any conclusions," Hally said.

Nichols keeps a picture of Anderson on her office wall and continues to follow up on leads and search for her whereabouts at every opportunity.

"At a certain point, it is going to be very difficult for some people to explain away the mounting evidence we have compiled," Nichols said. "This is by no means a cold case."

CLARKSTON, WA - The decision to dismiss an attempted strangulation case against a Moscow man, considered to be a person of interest in the 2010 disappearance of Rachel Anderson, shocked the community on Monday.

Rachael Anderson has been missing since 2010, and many in the community have closely watched the case against her estranged husband, Charles Capone, that's related to a separate incident. The case has been one of the most talked about, watched and read cases within the region. Anderson's daughter Amber Griswold and her family have been caught up in the interest generated by all the media attention.

"It is a wave of emotion," said Griswold. "Sometimes it seems like it's been a real long time and we've been waiting for results and nothing's happening and other days it feels like it just happened yesterday."

With the latest bombshell that the State case will be dismissed to make way for new federal charges against Capone, Anderson's family is cautiously hopeful.

"We were hoping for this, so it's something we've been anticipating and I didn't think it would happen as soon as it is now," said Griswold.

Griswold's caution stems from the fact that if the federal government takes no action by May first, Capone will be set free.

"The worst situation that could happen is Charles Capone be released from jail," said Griswold.

Many who were present in the Asotin County courtroom for the shocking turn of events were caught by surprise when Asotin County Prosecutor Ben Nichols and Capone's Attorney Mark Monson made a motion to dismiss the charges.

"It's just weird to see someone that doesn't have any emotion towards it himself, but what's hardest about being in court is when they bring up statements, statement that my mom has said or statements that other people have said," said Griswold.

Rachael Anderson's family continues their search for her, even though the answers and anonymous tips they seek out may bring with them a truth that no one is ever truly prepared for.

"I think that I have faced it, like I say yes I hope that we find her body, but I don't think that in reality I actually can grasp what that means," said Griswold.

Griswold said that she hopes that justice is served and that the family finds some closure and peace.

"I hope for an ending," said Griswold. "I hope to have my mom's body and be able to put her to rest."

The below post(s) will not be in order and they will be prior to this date. I was not aware that Rachael's husband Capone has been arrested on state charges of his attempt to strangle her the January before she disappeared. I'm just trying to catch us all up.

ASOTIN — A warrant for the arrest of Charles A. Capone was signed this morning by Asotin County Judge Ray Lutes.
Capone, 51, of Moscow is currently being held in the Sea-Tac Federal Detention Center in Seattle on a federal firearms conviction. He was due to be released on Wednesday, said Asotin County Sheriff Ken Bancroft. Instead, Capone will now be transported to the Asotin County Jail and held on a $250,000 bond.

He is being charged for second-degree assault in Asotin County for allegedly attempting to strangle Rachael Anderson on Dec. 27, 2009. Anderson reported the domestic violence incident to Clarkston police on Jan. 2, 2010.
Anderson, a Clarkston mother of four, disappeared more than two years ago on April 16, 2010. She is still missing, and Capone, her estranged husband, is a person of interest in her disappearance, police said.
In 2010, Capone was arrested for being a felon in possession of a firearm and sent to prison on the federal offense. He has been convicted of crimes in other states, including a 1998 burglary conviction in Moscow, according to police reports.
A task force of law enforcement officials from several agencies has been concentrating on finding Anderson.
“In the process of investigating her disappearance, we uncovered evidence of other (alleged) crimes committed by Capone, and this is one of them,” said Detective Jackie Nichols of the Asotin County Sheriff’s Office.
Second-degree assault is a Class B felony.
Bancroft said federal authorities are still interested in the case and more charges may be pending.

CLARKSTON, WA - A Moscow man, who remains a person of interest in the disappearance of a Clarkston woman, faces new charges.

Charles Capone is behind bars after a warrant for his arrest was signed Monday morning by an Asotin County Judge.

It's been nearly a year and a half since anyone's seen 40-year-old Rachael Anderson after she disappeared on April 16th, 2010. Investigators continue to search for Anderson's body and are yet to name a suspect. Charles Capone remains a person of interest in her disappearance as he is Anderson's estranged husband. Capone was arrested in May of 2010 after pleading guilty to possession of a firearm as a felon and is scheduled for release on Wednesday.

However, the Asotin County Sheriff's Office determined there was enough information to issue a warrant for Capone's arrest on a charge of Second Degree Assault stemming from an incident with Anderson.

"We approached the prosecutor with that information and he agreed that we had enough, that went to the judge and we got the warrant for his arrest," said Asotin County Sheriff Ken Bancroft.

Anderson married Capone in October 2009. Three months later, she filed for divorce and in April she disappeared. Anderson's sister Kristina Bonefield said she believes Capone is responsible for her disappearance, is ready for justice to be served and for her sister to come home.

"I don't think he deserves to be a free man ever," said Bonefield. "For what he's caused and done to our family, and to my sister, and to her children above all else."

"We're not giving up hope yet," said Bancroft.

While Anderson's family may have their own strong suspicions about Capone's involvement in her disappearance, he's yet to be charged in direct connection with her disappearance.

A detainer has been placed on Capone who will be in Asotin County Jail no later than Thursday.

Capt. Dan Hally of the Asotin County Sheriff's Office said Charles A. Capone is now considered a suspect, rather than a person of interest, in Rachael Anderson's disappearance. The mother of four vanished three years ago today.

CLARKSTON, WA - New evidence that's surfaced has changed the status of a Moscow man from a person of interest to suspect in the disappearance of a Clarkston woman.

KLEW news examines what that distinction means for the future of Charles Capone, as Rachel Anderson has been missing for three years now.

It's been three years to the day since Rachael Anderson went missing. And in the wake of the anniversary of her disappearance, the Asotin County Sheriff's Office said they have enough evidence to name her estranged husband, Charles Capone as a suspect in the case.

"At no time during this investigation have I been more confident about our ability to hold anyone involved accountable," said Asotin County Sheriff's Office Dan Hally. "We're comfortable now at this point, in naming Charles Capone as a suspect."

Anderson went missing in 2010 shortly after she filed for divorce from the 51-year-old Moscow man. Capone has always been considered a person of interest in the investigation, but Hally said they weren't able to name him a suspect until Monday.

"A case of this magnitude puts a strain on all agencies, big and small," said Hally. "And I really commend the command staff of all of the agencies involved."

Charges of 2nd-degree assault domestic battery were filed against Capone for allegedly attempting to strangle Anderson before her disappearance. But they were recently dropped to make way for a federal indictment in the case of her disappearance. He'll be held in custody until May first when the federal government decides to file charges or the local county prosecutor files charges.

"Justice will be served in this case," said Hally.

In the case that the federal or state government does not file charges by May first, Capone is scheduled to be released.

Normal BREAKING: Two Men Charged With Murder In Disappearance Of Missing North Idaho Woman

MOSCOW, Idaho - Charles Capone and David Stone now face first degree murder charges in the disappearance of Capone's estranged wife, Rachael Anderson. But that is not the only charge the Latah County Prosecutor filed Wednesday morning.
Capone also faces conspiracy to commit murder, failure to notify a coroner or law enforcement officer of a death, and conspiracy to commit failure to notify a coroner or law enforcement officer of a death.
Capone was previously charged with second degree assault. Investigators believed all of these crimes were committed in Latah County and is the reason why he is facing these charges there and not in Asotin County. Asotin County dismissed all local charges against Charles Capone. He was previously facing an assault charge stemming from an incident with Rachael Anderson three years ago.
In outlining the reason for the first degree murder charge, investigators made the following comments in court documents:
1. Charles Capone and David Stone surveiled, stalked and followed Rachael Anderson.
2. Charles Capone exchanged text messaged and telephone communications with Rachael Anderson for the purpose of luring her to Capone's business in Latah County, Idaho.
3. Charles Capone gave an ultimatum to Rachael Anderson for her to return to him and not pursue divorce.
4. David Stone sought and received instructions on the operation of a backhoe.
5. Charles Capone stole a prescription drug known as Ambien.
6. David Stone went to Charles Capone's business on April 16, 2010.

7. Charles Capone and/or David Stone put Ambien into Rachael Anderson's beer for the purpose of drugging her.
8. Charles Capone and/or David Stone killed and murdered Rachael Anderson.

"All of our investigative information has led us to believe these crimes happened near Moscow," Asotin County Sheriff Ken Bancroft said.
Investigators said they still have no "solid leads" on where Rachael Anderson's body may be. "We've excavated a lot of dirt in the past three years," Bancroft said. "But no signs of her body." Capone is set to be extradited to Latah County to face these charges.

Bancroft says Capone was served papers to face murder charges early Wednesday morning in jail. Charles Capone has denied he has ever had any involvement with Anderson's disappearance.
Investigators believe the crimes Capone committed against Anderson happened in Latah County and is why he is facing charges there. Investigators say they have no "Solid Leads" on where Anderson's body may be. Bancroft says "We've excavated a lot of dirt in the past 3 years."

BOISE, Idaho (AP) — Two men charged with murdering an Idaho woman who disappeared three years ago had a pact to kill each other's wives, according to court documents released in the case.
Rachael Anderson, of Lewiston, was 40 when she disappeared in 2010. On Wednesday, her estranged husband, Charles Capone, of Clarkston, Wash., and David C. Stone, of Moscow, Idaho, were charged with first-degree murder and conspiracy to commit murder in 2nd District Court.
One of Stone's former co-workers at the city of Moscow, Christopher Porter, told law enforcement agents that Stone originally wanted him to kill his wife, Alisa Stone.
But Stone later called off that plan, after telling Porter that he and Capone had agreed to kill each other's wives, according to a probable cause motion that accompanies the charges. Latah County Sheriff's Department Corporal Tim Besst wrote that Porter told him Stone would have paid him $10,000 to kill his wife, who had a large life insurance policy.
"In early March, 2010, Stone contacted Porter and advised he no longer needed him to kill his wife," Besst wrote, citing his interview with Porter. "Stone said that he and Capone had come up with a plan to kill each other's wives."
Alisa Stone, wife of David Stone, didn't immediately return a phone call seeking comment on Friday.
According to court documents, she confirmed to authorities that she had a life insurance policy.
Both Stone and Capone are being held in Latah County Jail.
Stone's lawyer, Ray Barker, has declined comment. Charles Kovis, Capone's public defender, wasn't available for comment Friday.
Anderson, a mother of four, disappeared April 16, 2010. She was last seen in Moscow.
Authorities now indicate that they believe Capone and Stone may have drugged, then killed Anderson before disposing of her body, which hasn't been found.
According to court documents, authorities are also relying on statements they say Capone made to other inmates while in jail on a federal weapons conviction in January 2013.
Brent Glass, an inmate in the Asotin County Jail in Clarkston earlier this year, told law enforcement agents on Jan. 15 that Capone became angry about being teased by other prisoners about Anderson and her whereabouts.
"Capone jumped up and walked away and Glass walked with him," according to the documents. "Capone said, 'I buried the body so deep they'll never find it.' "
After completing his federal sentence in September, Capone had been in Asotin County Jail in Washington on a $1 million bond since Oct. 3 after being charged with domestic violence assault against Anderson in a case stemming from an incident before she went missing.

Latah County Prosecutor Bill Thompson is not seeking the death penalty in the state's case against Charles Capone, the Moscow man accused of murdering his estranged wife three years ago and then disposing of her body, nor will the prosecution pursue capital punishment for Stone's alleged accomplice, David Stone.

Thompson stated in notices filed in Latah County Second District Court that after reviewing Idaho Code and consulting with the family of Rachael Anderson, who went missing in April 2010 and is presumed dead, he determined that pursuing the death penalty for Capone and Stone is not appropriate.

Normal Judge rules enough evidence for trial in wife-murder case

MOSCOW, Idaho -- An Idaho judge determined there is probable cause to try two Moscow men in the death of a Clarkston, Wash., woman who went missing more than three years ago.

2nd District Court Magistrate John C. Judge ruled Thursday after a three-day preliminary hearing for 52-year-old Charles A. Capone and 49-year-old David C. Stone.

The men are charged with first-degree murder and conspiracy to commit first-degree murder in the death of Capone's estranged wife, Rachael Anderson. Her body has not been found.

Testimony at the preliminary hearing indicated Anderson died at Capone's shop in April 2010, where she was last seen with both men. Capone reportedly bought a tarp the next morning.

Defense attorneys argued there was no evidence of Anderson's death in the state of Idaho.

The pre-trial hearing began Tuesday morning in the case.

Investigators believe Capone was the last person to see Rachel Anderson alive. Anderson's Family said Capone stalked her after they separated and she disappeared months later.

Anderson's oldest daughter, Amber Griswold and a man who says Stone orignally asked him to kill Stone's wife and later stated he and Capone were going to kill eash other's wives may testify for the prosecution.

Witnesses also include a number of officers, detectives and deputies from Lewiston and Moscow.

Stone's attorney questioned the Captain why he didn't record the interview with Stone during the murder investigation.

The Latah County Prosecutor will not seek the death penalty for Charles Capone and David Stone if they are convicted of murder.

Capone is charged with first degree murder for the 2010 death of Anderson, 40. She vanished in April 16th, 2010 as the couple was preparing to divorce.

Court documents stated that Capone murdered Anderson with the abatement of David Christopher Stone, 49. Authorities arrested Stone Wednesday. Stone and Capone both faced a judge in Latah County the same afternoon.

Capone and Stone were charged with principal to murder in the first degree, conspiracy to commit murder in the first degree, failure to notify coroner or law enforcement of death, conspiracy to commit failure to notify coroner or law enforcement of death according to court records.

Investigators wrote that Stone and Capone conspired from January 2010 to April 2010 to murder Anderson. Documents alleged that Capone and Stone stalked, and followed the victim.

The couple separated on December 27th, 2009 and filed for divorce on January 6th, 2010. Capone demanded that Anderson decide by April 16th, 2010 whether she was going to continue divorce proceedings.

Court documents stated that Capone text messaged and called Anderson to lure her to his business near Moscow. All three people met April 16th at Capone’s business, Multiple Service, along South Main Street. Documents alleged that Anderson came to pick up her vehicle. She borrowed a Yukon from a friend to drive to the shop.

The documents alleged that Capone and/or Stone put Ambien into Anderson’s beer during the visit and killed her. Investigators said Capone and Stone later hid and disposed of Anderson’s body. The pair also cleaned the Yukon to destroy evidence of the murder according to records. They also stated that the suspects drove the Yukon from Latah County to Lewiston and sent text messages from Anderson’s phone to hide her death.
