ORANGE COUNTY, Fla. -- The case against Casey Anthony will be back in court Monday afternoon at 1:30pm, but Casey is not expected to attend. Judge Perry said she doesn't have to come to the monthly status hearings, which won't involve arguments on major issues.

WFTV.com will have a livestream of the hearing starting just before the 1:30pm start time.

Attorneys from both sides will meet for a status hearing with Chief Judge Belvin Perry Jr. and the judge could decide whether a jury should be allowed to hear Cindy Anthony's incriminating 911 call. This could be an important ruling for the case for a number of reasons.

“There's something wrong. I found my daughter's car today and it smells like there's been a dead body in the damn car,” Cindy Anthony said in the 911 call (hear it).

Cindy Anthony made the frantic 911 call minutes after Casey told her that Caylee had been missing for 31 days. Cindy allegedly told co-workers that George thought the car smelled like a dead body. It was the reason her manager made her leave work that day and get to the bottom of why Casey's car was towed and where Caylee was.

The defense is claiming the 911 call was not an excited utterance, but rather hearsay that should not be allowed in as evidence. Prosecutors, however, say they want a jury to hear that third 911 call and Cindy's first call to 911, which reveals Casey’s claim about Caylee disappearing with a nanny named Zenaida Gonzales. That is what Casey told her mother to explain why Caylee was missing.

The issue could come up during Monday’s hearing, but the defense now wants a hearing on the issue before the judge rules whether it stays or goes. color me confused. Isn't what this HEARING is for today? Baez needs to just stop this b.s.!

I think today's hearing is just to check on the status....meaning whether or not the defense has actually done anything other than file motions! I also think Sindy's GMA appearance last week (wherein she once again denied the smell of death) was orchestrated by the defense in order to push this motion forward because I've read the defense filed a response to the state's response this past Friday (although I cannot find it) which mentions that Sindy has denied smelling anything--she just wanted the police to show up quicker! Yeah, right! I find it quite offensive that the defense thinks the general public as well as the prosecution are so stupid as to believe this.

Great post, Frogs. I agree with you. This entire interview was orchestrated by the defense so Cindy could say she "just mentioned the dead body smell to get the cops out there asap". BS

Wrap, I watched the hearing, but I didn't see anybody that looked like Cindy on the defense side. There was somebody leaving from the state side after the hearing that had shorter hair than she has been having, but it cut away before I could tell if it was her or not...Why would anybody believe that the statement about the smell in the car was not an excited utterance? It so obviously is!
Maybe these Roy Kronk witnesses are going to be so much trouble that Judge Perry will just dismiss that motion. It is ridiculous anyway--trying to bring in his past to suggest that he had something to do w/ Caylee's death!
If I understood correctly, they are going to argue the admissability of the 911 calls on July 15...

It looked like Cindy cut her hair and was sitting all alone behind Cheney Mason.

I agree about Krunk. Perry pronounced it wrong. LOL. I love the way LDB talks. She puts it all out there with a hint of sarcasm toward the defense.

Oh, shoot, I deleted my TruTv video when I finished watching it, but I think that woman was a reporter from one of the TV stations (I forget which one)...She has blonde hair and I think she had it pulled back in a bun or a ponytail...I almost thought of her name, but it escapes me right now...I have seen her at all of the hearings.

I just looked at the hearing on WFTV and I saw the woman you were talking about, Wrap...I don't know who she is, but it was not Cindy...I don't think she was there today.

However, Judge Perry decided during the less than 30 minute hearing that the issue over 911 calls will be heard at an already-scheduled hearing July 15.

WFTV also learned Monday, there's new information about the site where Caylee's body was found. The defense has now flip-flopped on claims it has made all along, claims it made that it had evidence that EquuSearch volunteers had already looked for Caylee in the woods where she was found months earlier and found nothing.

That was the cornerstone of their argument that someone put Caylee's body there after Casey was kept behind bars. The defense argued Monday for throwing it out.

The case against Casey Anthony started with the frantic 911 call, made by her mother Cindy just minutes after finding out that Caylee had been missing for 31 days. In the call, Cindy stated that Casey’s car smelled like a dead body and that got the attention of Orange County deputies. But now Cindy claims it was all an act to get them there sooner, even though Casey's lawyers admit Cindy said the same thing to her co-workers that same day; her co-workers forced her to go home, call police and get to the bottom of it.

The defense is claiming the 911 call was not an excited utterance, but rather hearsay that should not be allowed in as evidence.

“There wasn't anything excited about it. It was contrived and planned and several hours lapsed by," defense lawyer Cheney Mason said.

The judge will hear both sides' arguments next month.

Meanwhile, the defense has completely reversed itself on whether Texas EquuSearch volunteers searched the woods late in the summer of 2008, where Caylee was found months later, but it's still trying to disprove what prosecution experts say, that Casey put her daughter Caylee's body there in June.

“What do you have that shows she was not there in June?” WFTV reporter Kathi Belich asked Mason.

“That's when Caylee was missing. We don't know when she disappeared,” Mason replied.

“The problem for the defense is that the forensics support the fact that that child's body was there in late June or early July at a time when Casey was not incarcerated,” legal analyst Bill Sheaffer said.

The defense also appears to be backing off of the claim that Orange County meter reader Roy Kronk, who found Caylee's remains, should be a suspect in Caylee's murder. It asked for more time to decide whether to list Kronk's ex-wives as witnesses after they made wild accusations against him, one of them involving duct tape like the tape that was found over Caylee's face.

Casey Anthony will have to appear at the next court hearing. Both sides will be back in court on July 15. They will once again discuss Cindy’s 911 call and records from the group Texas EquuSearch; volunteers from EquuSearch helped to look for Caylee shortly after she was reported missing.

Also, more evidence is expected to be released in the next few weeks.

you know what, it doesn't matter how it was phrased or how hard the defense tries to color it out of the equation, the tone in Cindi's voice might be the only thing that was Truthful.

No, I saw Holly Bristow. If you play the above tape from today you can see her at 38 seconds. Before that, you can see her, too. Standing up. She is too overweight to be Cindy, so I was mistaken.

Nite, I agree with you. The tone of voice was desperate. She can say anything she wants now. It's on tape and anyone who hears that 911 tape (and I cannot imagine anyone who hasn't) can hear the clear desperation in her voice.

It certainly was NOT a planned, contrived utterance as Cheney Mason tried to claim after court yesterday! And even if she did go back to work, etc., she had just found out that Caylee had been missing for 31 days...She was putting 2 and 2 together and what came out of her mouth was AN EXCITED UTTERANCE!
