Why Did the Judge Give Garrido ANY BAIL???
$30M bail set for Calif. kidnap suspect
PLACERVILLE, Calif. – A judge on Monday set bail at $30 million for a Northern California man accused of kidnapping a girl and holding her captive for 18 years.
Phillip Garrido, 58, and his wife, Nancy, have pleaded not guilty to kidnapping, rape and false imprisonment charges and had been held without bail in an El Dorado County jail.
The couple are accused of kidnapping 11-year-old Jaycee Dugard from her home in 1991, then holding her captive in a backyard jumble of tents and sheds for nearly two decades. Authorities say Phillip Garrido fathered two daughters with Dugard.
El Dorado County Superior Court Judge Douglas Phimister set the high bail amount, citing the serious nature of the charges, injuries to the victim and the fact that Garrido was on parole at the time of the alleged abduction.
Nancy Garrido continues to be held without bail, something her attorney did not object to during the Monday morning hearing.
Phillip Garrido appeared in court with a bandage on his nose and a newly grown beard. He and his wife both appeared solemn at the 10-minute hearing, during which Phillip Garrido's attorney requested a psychiatric evaluation for her client and Nancy Garrido's attorney also reserved the right to request one.
Both are due back in court for an Oct. 29 hearing.

:x 3 million dollars will be hard to come up with. But still he should have been held without bond. This is not his first rodeo.

No bail for wife, yet they set a bail amount for him. Even if it is next to impossible for him to make it, it is still NUTZ!

Garrido's lawyer is laying the groundwork again to have him declared mentally incompetent to stand trial.
Some paparazzi apperentley took pictures of jaycee and her family while they were on vacation last weekend and the Globe and the Enquirer bought them. The tabloids did agree to blurt out her daughters faces.
On a bright note, the first anniversery of the reunion approaches! :celebration:

Bull dookey. Any man that could have pulled off such a scam for 18 years knew good and darn well what he was doing. IMO he is very competent to stand trial. Sick Sick Sick.justice4kbl wrote:Garrido's lawyer is laying the groundwork again to have him declared mentally incompetent to stand trial.

Re: 8/20/2010 / Garrido's lawyer is laying the groundwork again to have him declared mentally incompetent to stand trial
update: gellman (garrido's lawyer) got the judge to stop proceedings so garrido can have a pysch eval. they both claim garrido appears 'disintrested' during proceedings.
Of course he does......because no one is asking him to talk.........and jaycee isnt telling everyone that 'heartwarming story' he believed she would by now.
But it turns out jaycee will be telling HER Story. She has inked a deal to write her memoirs, and already in the process of doing so.
The book is due out next year some time.

10/01/10 - Garridos expected to be arraigned this afternoon
[You must be registered and logged in to see this image.]
The East Bay couple accused of kidnapping Jaycee Dugard and holding her for 18 years will be arraigned Friday afternoon.
Reports say Phillip and Nancy Garrido have been indicted by a grand jury.
An indictment would eliminate the need for a preliminary hearing, keeping Jaycee Dugard and her two daughters from having to testify against the Garridos at that time.
The Garrido's are accused of kidnapping dugard when she was 11 years old and keeping her in their backyard.

Jaycee Dugard’s abductors finally face court
After ten years of captivity and more than a year of legislative limbo, kidnap victim Jaycee Dugard will finally see her abductors face justice today.
A withering indictment by a Grand Jury yesterday means the accused couple, Phillip Garrido, 59, and his wife Nancy, 55, must appear in court in El Dorado county today to face their long-stalled arraignment.
Phillip Garrido faces 29 criminal counts, while his wife is due to be charged with kidnapping and rape. Both are expected to enter a plea.
Jaycee was kidnapped at a school bus stop in South Lake Tahoe, CA on June 10, 1991 – within sight of her home.
Today the court will hear charges that allege the 11-year old was then held captive by the Garridos in their backyard for 18 years, only being discovered by chance when Philip Garrido visited his parole office on August 26 of last year, and took Jaycee along.
The prosecution also alleges that Garrido bore two children with Jaycee, who were 12 and 15 years old when she was found.
And this is not Garrido’s first time facing such charges – In 1972 he was charged with sexually assaulting a 14-year-old girl. Then in 1973 he married his high-school classmate, Christine Murphy – and kidnapped her when she tried to leave him.
Three years later he kidnapped 19-year old Katherine Callaway and raped her in a warehouse. But they were found by police, and in June 1977 Garrido began serving 50-years at Leavenworth Penitentiary – where he met Nancy. But he was released on parole in 1988. And that’s when he moved to Lake Tahoe.
Today’s trial was originally due to open last week, but Garrido’s defense attorney claimed his client was ‘Not mentally competent.’ But Garrido was evaluated by a court-appointed psychologist and that claim was swiftly dismissed.

Re: 8/20/2010 / Garrido's lawyer is laying the groundwork again to have him declared mentally incompetent to stand trial
Phillip and Nancy Garrido, the couple accused of kidnapping and raping Jaycee Dugard, have been indicted by an El Dorado County grand jury on 18 charges plus multiple special allegations on Friday.
The indictment charges the couple with three counts of kidnapping, six counts of rape, seven counts of forced lewd acts upon a child and one count of false imprisonment by violence and one count of possession or control of child pornography.
The indictment also makes special allegations of two prior felony strikes against Phillip Garrido, one strike of a forcible rape conviction, two habitual sexual offender allegations and prior sexual offense.
Nancy Garrido testified before the grand jury – she was arraigned and entered a plea of not guilty.
Phillip Garrido has yet to be formally charged, pending an evaluation of his mental competency. The indictment is expected to allow the case against Nancy Garrido to proceed to trial.
The indictment was filed on Sept. 21 and replaces the El Dorado County district attorney's original 29-count criminal complaint filed against the Garridos.
The Garridos were arrested on Aug. 26, 2009. They are alleged to have abducted the then 11-year-old Dugard off a street near her South Lake Tahoe neighborhood on June 10, 1991, and kept her in a backyard encampment at their Antioch home the next 18 years.
The grand jury indictment means prosecutors will bypass the preliminary hearing and that Dugard likely won't have to testify until the trial.
The Garridos’ next court hearing is scheduled for next month.

Arraignment?!? What the heck is taking so long for this to come to trial? I just don't understand it. I guess I should just be happy the Garridos are behind bars.
