LAYTON, Utah - A state judge Friday ordered a Layton mother accused of killing her two young children to remain in jail. Sun Cha Warhola, 44, was arrested and booked into the Davis County Jail Thursday morning on two counts of aggravated murder. The charges could carry a potential death sentence if she is convicted. Papers filed say 8-year-old James and 7-year-old Jean Warhola were found dead inside a bedroom of their home Wednesday night.

The court judge also set a Sept. 20 date for another hearing.

Charging documents released late Thursday night give more disturbing details of the siblings' deaths.

According to the documents, the children's father, Kenneth Warhola, arrived home from work to find his son's bedroom barricaded from the inside. Sun Cha had reportedly pushed a bed against the door. When Kenneth returned several minutes later, he pushed his way into the room and saw the children lying on the bed covered with a blanket. When he touched his sons face, police say he felt that it was cold.

Kenneth then called 911 from a neighbors residence, asking officers to check on his children inside their home at 2184 N. Snowqualmie Circle.

"Police arrived, there was no answer at the door," said Layton Police Lt. Quinn Moyes. "Officers entered the home and found a 7-year-old girl and an 8-year-old boy unresponsive in a bedroom."

Ambulances were summoned and the children were pronounced dead. Moyes told Fox 13 the childrens' mother was found in another room of the home.

Detectives spent the night collecting evidence and questioning the parents. Ultimately, Warhola was booked into the Davis County Jail about 4 a.m., shortly after officers finished questioning her.

Police say it appears the children may have been strangled to death, but the official cause of their deaths will be determined by the state medical examiner once the autopsies are completed.

"There was a sign of a struggle inside in a bedroom," said Moyes. "The two children have markings on their throat and neck area that would be consistent with a type of strangulation case that we have seen."

Charging documents also say the children had what appeared to be defensive wounds on their arms and legs, along with distinct ligature marks.

The arresting officer said Sun Cha had wounds on her body consistent with a struggle. She is now facing two counts of aggravated murder and criminal homicide.

Neighbors say they knew the marriage between Ken and Sun Cha was troubled, but never saw signs the children were in danger.

Neighbor Steve Bailey says he knows of one struggle between the mother and father.

"I mean I'm not here during the day, but the neighbors told me that police were fairly regular in the past couple of weeks and there was a incident we saw him pull out and she chased him down the road," he said.

Bailey said the children were fun loving.

Both Kenneth and Sun Cha pleaded guilty to assault charges from a domestic violence incident in January. Police also say there was a sexual assault allegation against Ken Warhola by his wife, but that those charges were dismissed.

Police have not yet speculated on a motive.

Davis County Schools Public Information Officer Chris Williams said the children attended East Layton Elementary School at 2470 East Cherry Lane. The school says there will be a team of seven grief counselors on hand to deal with students' psychological health.

Just a few weeks before Sun Cha Warhola was charged with killing her two children, she apparently called a Korean newspaper asking for help.

"She said she needed a lawyer who could help her," said Inseon Cho Kim, who works for the Korean Times of Utah. "She was insecure, scared to death. … She said she wanted to divorce her husband but didn't want to give her children to him."

Two weeks later, Warhola, 44, was charged with their deaths. Ed Brass, an attorney qualified to handle death penalty cases, was appointed Friday to represent the Korean woman who police believe strangled her two children in a bedroom of the family's Layton home.

Warhola was charged Thursday with two counts of aggravated murder, a capital offense, in connection with the deaths of her children James, 8, and Jean, 7.

"We spoke to Mr. Ed Brass, and he's ready to accept an appointment in this case," Davis County Attorney Troy Rawlings said during Warhola's first court appearance Friday. "Mr. Brass is clearly Rule 8 qualified and is known as one of the best attorneys in the state, if not the country."

Police and prosecutors believe the mother killed her children inside James' bedroom at their Layton home, 2184 N. Snoqualmie Circle. The children and their mother all had multiple wounds on their arms and legs that police say appear to be defensive wounds, indicating a struggle occurred.

Warhola searched among a number of predominantly Korean friends who came to court to support her Friday, and some even attempted to speak with her after the hearing.

A judge ordered that Warhola remain in the Davis County Jail with no bail.

Defense attorneys Todd Utzinger and Julie George represented Warhola Friday and filed an order preventing anyone but the woman's attorneys from visiting her in jail.

The order states any others interested in visiting Warhola will have to obtain written permission.

"It was a precautionary measure to protect her interests," Utzinger said after the hearing. "We want to make sure people with more prurient interests won't have access to her."

Rawlings said it's much too early to predict whether his office will pursue the death penalty for Warhola but called it a "potential sentence."

Prosecutors do not have to officially declare for several months whether they will seek the death penalty in Warhola's case, but since the potential exists, a death-qualified attorney was appointed.

Attorneys in death penalty cases must be qualified to do so under state law. To be eligible to work on a capital murder case, attorneys must meet a number of requirements. They must have taken six felony cases to a verdict within the past four years; at least one of the two appointed attorneys must have worked on a capital or a felony homicide case that went before a jury and ended in a verdict; and they must complete or teach a legal class dealing with the trial of death penalty cases. They must also have at least five years' experience practicing law.

When he came home from work Wednesday, Kenneth Warhola, 46, discovered the door to the bedroom was closed and blocked from the inside. His wife was inside the room and told him to wait 10 minutes before entering, prosecutors say.

Several minutes later, the father forced his way inside.

"His wife was inside, and she asked him not to look at the children who were lying on the bed covered with a blanket," the charges state.

He said after realizing that James' face was cold to the touch, he called 911 from a neighbor's house because he said he couldn't find his house phone.

The mother told police that no one else had been inside the home except her and the children, the charges state.

Sun Cha Warhola's next court hearing is scheduled for Sept. 20.

Farmington • Sun Cha Warhola was no stranger to police.

Officers responded to incidents involving Warhola more than a dozen times during the past four years — including four times in the three weeks before she allegedly strangled her children to death.

Layton Police released 10 reports Monday that show Warhola initiated most of the contacts for problems ranging from fights with her husband to a claim that an acquaintance had stolen her wedding ring from her finger as she slept. In late August, Kenneth Warhola told police his wife was mentally ill.

Preparations for their son James’ birthday party triggered one argument that got out of hand, the reports show. Several arguments started when Warhola accused her husband of infidelity, including a 2007 fight that led police to charge Kenneth Warhola with domestic violence.

This year, both Warholas were charged with domestic assault after a fight in the parking lot of the Layton Post Office in February.

In March, police responded to a verbal fight at the Warholas’ home and Sun Cha Warhola asked for help getting marriage counseling, an incident report notes. Police told her to contact a therapist.

Whatever problems the couple had appeared to escalate in mid-August, when James called 911 after his parents began fighting in a park near their home. On Aug. 22, Warhola went to the Layton Police Department and alleged her husband had sexually abused their children.

Police contacted the Utah Division of Child and Family Services and Warhola was advised to stay elsewhere with the children while the allegation was investigated.

Sun Cha Warhola smiled and waved at supporters in 2nd District Court Monday as she left the courtroom where her attorney requested a month’s delay before a roll call hearing is held.

Warhola, 44, is charged with two counts of aggravated murder in connection with the deaths of her children, Jean and James on Sept. 8 in their Layton home.

Warhola’s court appointed attorney, Ed Brass, asked Judge David Connors for a month to review the case, and an Oct. 18 date was set for the roll call hearing. In addition to Brass, Warhola had an interpreter by her side.

A roll call hearing is generally brief. Usually it is the first time an attorney and defendant appear together, and a plea may be entered.

Earlier this month. Judge Michael Allphin appointed Brass as Warhola’s attorney. He is certified to handle death penalty cases. However, prosecutors have not said yet if they’ll try the case as such.

On Monday, in addition to family, the press and some members of Bikers Against Child Abuse, representatives of the Korean-American Women’s Association of Utah (KAWA) were in attendance.

However, Warhola’s husband Kenneth did not attend.

Following the hearing Nan Davis, a member of KAWA, told the press they attended to support Warhola. “We want to let her know she is not alone.”

Another friend, Soon Boke Smith, said she had been friends with Warhola for 18 years, and during that time, “She was a great aunt to my daughter and great sister to me.”

Warhola is accused of strangling her two children. Kenneth Warhola found the children’s bodies in his son’s bedroom after he returned home from work.

Police say they had been to the residence in an east Layton neighborhood several times in the past.

Neighbors of Jean and James Warhola have hung a large banner in their neighborhood to deliver a simple message: “We will always remember you.”

The effort was one way for those close to the children to show their love and deal with the grief of their deaths. Prosecutors have charged their mother, Sun Cha Warhola, with two counts of aggravated murder for allegedly strangling 7-year-old Jean and 8-year-old James on Sept. 7 in their Layton home.

“My hope is that in time everybody will remember the sweet little children, James and Jean, instead of the manner in which they died,” said neighbor Kat Lee.

Kenneth Warhola buried his children after a Mass on Thursday at St. Rose of Lima Catholic Church in Layton.

Lee said the funeral was attended by family and friends as well as military and nonmilitary personnel from Hill Air Force Base where Kenneth Warhola worked.

“It was a very beautiful albeit sad occasion,” Lee said.

Davis County School District spokeswoman Shauna Lund said Thursday the pair will be memorialized on school grounds at East Layton Elementary with the planting of two trees. The names of Jean and James also will be added to a rock outside the school that bears the name of another student who died, Lund said.

Neighbor Coleen John said she attended Thursday’s services to remember how special both children were. She nearly came to tears when she saw that Jean would be buried in a pink-trimmed casket, while James had a blue one.

“I’ve got shoes older than those children were,” John said after the services. “What really upsets me is to think about how much life they were cheated out of.”

Layton mother charged with murder in deaths of her 2 children

LAYTON -- The mother of two children found dead inside a Layton home Wednesday evening has been charged with two counts of aggravated murder.

Sun Cha Warhola, 44, was booked into the Davis County Jail shortly before 4 a.m. Thursday, suspected of strangling her children to death. Thursday night, the Davis County prosecutor filed charges against the Layton mother.

Children's bodies found Wednesday night

Police responded to the home near 2200 North and 3200 East around 6:45 p.m. after receiving a call from the Kenneth Warhola. Apparently he had come home and found the door to the children's room closed. He tried to get in, but couldn't.

He then called out to his wife, who was inside the room, and she asked him to give her 10 minutes. When he came back, he forced the door open and found his children lying on the bed, covered by a blanket.

A probable cause statement says Sun Cha Warhola asked her husband not to look at the children, but he felt his son's face and found it cold to the touch.

"Trying to put yourself in that situation: You have children yourself, and so that's my first reaction is what a devastating, horrible situation that any human being would have to suffer through, let alone children," said Davis County Attorney Troy Rawlings.

Kenneth Warhola then went to the neighbor's house and called 911.

Lt. Quinn Moyes of the Layton City Police Department said, "Police responded to the home to check on those children. Nobody answered the door. Police made entry into the home and that's when they discovered a 7-year-old female and an 8-year-old male unresponsive inside the same bedroom."

The children, 7-year-old Jean Warhola and 8-year-old James Warhola, were both dead.

"There were signs of a struggle in the bedroom," Moyes said. "The two children have markings on their throat and neck area that would be consistent with a type of strangulation case that we've seen."

Court documents say the children had defensive wound son their arms and legs, and their mother had injuries to her arms and legs that were consistent with a struggle.

Parents have a history with police, courts

Neighbor Rick John says Layton police officers were at Warhola home regularly for the past two weeks, sometimes two hours at a time.

The couple has had problems with the law. A court record search brought up cases dating back 10 years.

The most recent case was in January. Prosecutors charged Sun Cha Warhola with assault. She later pleaded guilty to a lesser charge.

Kenneth Warhola was also charged with assault on the same date. He too plead guilty to a lesser charge.

Back in 2007 and 2008, prosecutors charged Kenneth Warhola with simple assault and domestic violence in the presence of a child. Both charges were dismissed.

Police say Sun Cha Warhola recently accused her husband of sexually abusing their children, but Davis County declined to file charges.


Rawlings says those allegations are "baseless and completely unfair" to Kenneth Warhola.

John said the family just got back from Disneyland a couple weeks ago. After that, he says, domestic issues started coming up again.

"The kids should have been taken out of the home or something," John said.

Another neighbor, Steve Bailey, told KSL that a few weeks ago he saw Kenneth Warhola pull out of the driveway and Sun Cha Warhola run after the vehicle screaming at him.

Neighbors told police they did not hear any arguing or other sounds indicating a problem at the home. They say Sun Cha Warhola was friendly, but that the couple often kept to themselves.

"She was always friendly," said John. "I never saw it coming, you know? You should look and say, ‘Why aren't these kids taken care of?'"

Court records also show that Sun Cha Warhola was charged with disorderly conduct and intoxication in 2002 and 2008.

Neighborhood, community mourns children's deaths

Meanwhile, neighbors are remembering Jean and James Warhola as very well behaved children who showed no signs that anything was wrong at home.

Bailey said they "seemed like normal kids" who would often stop by his yard with their dog. He said the family has lived in the neighborhood for about five years.

John told KSL the kids were very well behaved. "They were good little kids, really good," he said. "She took care of her brother like you can't believe."

Another neighbor, who only wanted to be identified as Kat lives next door to the family. She said that James and Jean came over to her house frequently to chat.

"Just to think that those two sweet children were the victims of something they had no control over, I find it hard to believe," Kat said. "It just fills you with grief and sadness.

Counselors were on hand at East Layton Elementary School Tuesday to help students, faculty and parents deal with the deaths of the Warhola children.

"Some Students sit there and wonder, 'How about if I don't feel sad now? Should I feel sad? Or if I feel sad now, is it OK to feel happy later in the day?' And parents don't necessarily know how to deal with it either," said Chris Williams, community relations director for the Davis School District.

Williams said the students at East Layton Elementary School belong to a tight-knit community and there are a lot of emotions they are dealing with.

What's next for Sun Cha Warhola

The Davis County Attorney's Office has now charged Sun Cha Warhola with two counts of first degree murder. Rawlings says he hasn't officially made the decision, but based on the facts he's reviewed he's leaning toward pursuing the death penalty.

"If the facts as we believe them to be justify it, then we will do it; and right now that's the track, and that's the avenue we're on based on what we know early on in this case," Rawling said.

Sun Cha Warhola is scheduled to appear in court Friday, Sept. 10 at 1 p.m.

A beautiful Layton neighborhood became the scene of horrific violence last week as a woman allegedly murdered her two children while they fought desperately for their lives.

Layton Police reported that Ken Warhola returned to his home at 2184 N. Snowqualmie Circle about 5:45 in the evening Wednesday, and when he went inside the house he couldn’t find his wife, Sun Cha, or the couple’s two children, 8-year-old James and 7-year-old Jean Marie. Police say Ken found the door to the bedroom where the three were barricaded by a bed. Sun Cha allegedly said to “give her 10 minutes” before coming into the room.

After waiting as requested by his wife, Ken Warhola reportedly pushed open the barricaded door. Sun Cha allegedly asked Ken not to look at James and Jean Marie, who were lying on their bed, covered by a blanket.

Police said Ken immediately felt James’ face, which was cold to the touch.

Ken searched the house for a phone but could not find one, so he ran to a neighbor’s house where he contacted police.

When police arrived at the home they forced their way into the barricaded room where reports indicated they found Jean first and then James. Both children appeared dead.

“It was obvious when the police checked on the children that they were deceased,” said Lt. Quinn Moyes with the Layton Police Department.

Police reports indicate that not only were James and Jean Marie dead, but they had probably died in a violent struggle with their mother. The medical examiner will determine the official cause of death, but police report that James and Jean Marie had “multiple injuries, including what appeared to be defensive wounds on their arms and legs. They also had ligature marks on their necks.”

Ligature marks are often due to strangulation.

The mother of the children was examined by police, and she had multiple injuries on her arms and legs consistent with a struggle. In addition, Sun Cha told police the only people in the house had been her and her children.

“The children had injuries and marks around their necks that are consistent with serious trauma,” Moyes said. “There are also marks on their bodies and the mother that would indicate that the children fought.”

Police, still investigating the case, were unable to guarantee exactly what had occurred in the children’s room a week ago, but there was enough evidence that Sun Cha Warhola was taken into custody after a short stay at Davis Hospital and Medical Center.

Warhola has been charged with criminal homicide and aggravated murder, and Ed Brass has been appointed as her public defender by Judge Michael O. Allphin. Brass is an attorney qualified to handle death penalty cases, although it is not yet known if Sun Cha Warhola will face that possibility.

Warhola made her first court appearance on Friday, where she was informed of the charges against her. She was very quiet, used an interpreter and appeared to understand the charges levied against her.

After court, some suggested she had wanted help to protect the children from their father. Police said there is no indication whatsoever that Ken Warhola ever harmed his children.

“We have no complaints about child abuse against Mr. Warhola,” Moyes said. “We have had several calls to the residence where the family lived, but I am not really at this point able to discuss those calls.”

One neighbor who knew the children well also said she never had any reason to believe the children were in harm’s way.

Karra Porter is one of the neighbors to the Warholas and interacted on a regular basis with James and Jean Marie.

“I never had any reason to believe these children were in an abusive situation,” Porter said. “They were just regular happy kids, and I never saw the kind of bruises or anything at all that would suggest they were in danger.

“No one could have seen this coming.”

Members of the Korean community also offered support to the Warhola family. The children and their mother were well known in that community.

“We are all heartbroken and our community is severely devastated for the family and especially the children,” said Sung Kang. “This is a tragedy for everyone involved.”

Farmington • The defense team of the Layton woman accused of strangling her two children last month will file a motion to determine if she is mentally competent to stand trial.

Defense attorney Edward Brass said the motion will be filed between now and Nov. 19, the date set for the next hearing in 2nd District Court.

Sun Cha Warhola, 44, is charged with first-degree felony aggravated murder — which carries the potential for the death penalty — for allegedly killing her 8-year-old son, James, and 7-year-old daughter, Jean, after barricading herself in their bedroom Sept. 8 at the family’s Layton home.

Brass also asked Judge David Connors for the scheduling hearing to be continued because there were police reports and witness interviews the defense has yet to obtain from the state.

Warhola was assisted during the brief hearing by a Korean interpreter.

The defendant repeatedly looked into the court audience at a group of women who have been attending the hearings to support her.

After the hearing, one of the women, Chang Hui, said she felt sorry for Warhola. A former neighbor of the defendant, Hui said she was shocked when she first heard the news of the slayings. “You have to be mentally ill. It has to be a mental case. It’s the only way,” Hui said.

Warhola is due back in court Nov. 19.

FARMINGTON -- The husband of a woman accused of killing her two children has filed for divorce, according to court records.

Kenneth C. Warhola filed for divorce from Sun Cha Warhola on Nov. 24 in 2nd District Court in Farmington.

His attorney, Christina L. Micken, also filed a motion to have the file sealed.

Sun Cha Warhola, 45, is charged with two counts of aggravated murder in connection with the strangulation deaths of the Warhola children, James, 8, and Jean Marie, 7. Kenneth Warhola found his children's bodies in a bedroom with his wife on Sept. 8 in Layton.

Sun Cha Warhola is being held in the Davis County Jail on no bail. Her next hearing concerning the murder charges is set for Jan. 14.

If convicted of the murder charges, Sun Cha Warhola could receive the death penalty.

Court officials said Judge David Connors will not rule on the motion to seal the Warhola divorce proceedings until after hearing arguments concerning the pending divorce of Nathanael and Stephanie Sloop.

This is truly one of the most saddest and senseless cases we have here at VH. I feel so sad for the father. He must be completely heart broken.

I saw the picture of these two beautiful children on the "home" page, and it just breaks my heart! Their father looks like he truly loved them, and it must be such a difficult time for him. As for Sun Cha - I hope that she gets the DP!! angry

This is the first I've heard of this one - it's very sad :(
I wonder if more could have been done to help the mother? she was obviously very sick - in the head to have committed such a horrible crime against her own flesh and blood. I'm not saying this is the case here, and not accusing the father in any way - but I wish more men would take a more active role to help these women who can't cope. It also didn't help that there was obvious domestic abuse problems, and nothing was done to protect the children? I think the state failed them in that aspect. Why was CPS not called?
The children are beautiful, and I feel sorrow for their father, I know he couldn't have expected this would happen.

I agree, rebel belle... it would be good to have more info about her mental state. It seems that she just "snapped", but I'm sure there must have been earlier signs. The children did look well-cared for & happy... it is all so very sad!!crying

This makes me angry. Those poor children weren't given a chance before she murdered them, yet she's given more and more time for a competency hearing. I so feel for the Father, the family and friends of these dear children, what they've been thru' and again they have to wait for this egg donar and her so called rights. It\\'s Not Fair

I get the impression that the father was very good to his children and tried to make a "normal" lifestyle for them.

The DP is on the table but I think her attorney will try to get the insanity plea. And, from what I have seen and read, it is a possibility. MOO!

Farmington [,Utah] • Sun Cha Warhola, accused of strangling her two children last year, is incompetent to stand trial for now.

During a short hearing in 2nd District Court on Friday, Warhola’s attorney, Ed Brass, said two psychologists had evaluated the 45-year-old woman and determined she needs to undergo “significant treatment” before she could be tried.

Warhola, 45, will likely be sent to the State Hospital in an attempt to restore her competency.

Warhola is charged with two counts of first-degree felony aggravated murder for allegedly strangling 7-year-old Jean and 8-year-old James last September in their Layton home.

Warhola’s husband arrived home Sept. 8 to find his wife had used a bed to barricade herself inside their son’s room. After forcing his way inside, the man found his children dead, lying on a bed and covered by a blanket, according to police.

Prosecutors on Friday did not attempt to challenge the evaluations of Warhola’s competency.

Outside the courtroom, Brass told news reporters, “I think people realize she’s profoundly disturbed, and whatever happened is related to [that] fact.”

He added that she could “ultimately be punished for something she might not even remember.”

Another review of Warhola’s mental state is scheduled for November.

I also agree up to a point. I believe there are some individuals who are just plain "insane".

Take Charles Manson as an example. He is clinically insane, schizophrenic, and had the ability to brainwash many. I realize they were all hopped up on LSD and God only knows what else..but my point is that Yes-there are a small percentage of people who for all intents and purposes are capable of murder who are literally out of their minds.

A Layton woman accused of strangling her two children remains unfit to face the aggravated murder charges against her.

After being ordered to the Utah State Hospital in May for treatment, Sun Cha Warhola had been expected to appear in Farmington’s 2nd District Court on Friday for a review hearing.

But a new report suggests the 45-year-old Warhola remains legally incompetent to stand trial and will continue receiving treatment, according to a court docket.

Warhola is charged with two counts of first-degree felony aggravated murder for allegedly strangling 7-year-old Jean and 8-year-old James in their Layton home in September 2010.

Warhola’s husband arrived home Sept. 8 to find his wife had used a bed to barricade herself inside their son’s room. After forcing his way inside, the man found his children dead, lying on a bed and covered by a blanket, according to police.

Warhola is slated to next appear in court on May 25, 2012.

I agree, Linda, but I do think she is mentally ill. So damned sad. I do not see her as a cold blooded killer..I see her as sick in the head and I would bet she is confused and probably schizophrenic.

Warhola has been at the hospital receiving treatment since May 2011. She is charged with two counts

That poor man. I so hope things are getting a bit better for him. As for the egg donor, I sure hope she's deemed competent for trial and is given life without parole at the very least.

I don't think she will be deemed competent. I think she is clinically insane and w/be ruled as such.

My heart truly breaks for Mr. Warhola. His children were adorable and this is so unfair. No parent should have to go through this.

A Layton mother charged with killing her two children two years ago is still not competent
to stand trial, according to mental health evaluators.

A new competency review date has not been set, but Brass requested that a June court
date be scheduled. That will be the eighth time a competency review has been scheduled
for Warhola, according to court records.

Warhola has been receiving treatment at the Utah State Hospital since May 2011.

She is charged with two counts of first-degree felony aggravated murder for allegedly
strangling 8-year-old James and his 7-year-old sister, Jean, in their Layton home in
September 2010.

Warhola’s husband arrived home Sept. 8 to find his wife had used a bed to barricade
herself inside their son’s room.

After forcing his way inside, the man found his children dead, lying on a bed and
covered by a blanket, according to police.

LAYTON, Utah – A Layton mother accused of killing her two children in 2010
has been found incompetent to stand trial.

Sun Cha Warhola allegedly strangled her 8-year-old son and 7-year-old
daughter in Sept. 2010.

She was to appear in court last week for a competency hearing, but her
attorney filed a motion indicated a psychologist had determined that
Warhola remains incompetent to stand trial.

This was her seventh scheduled competency review. She continues to
receive treatment for mental illness at the Utah State Hospital.

Thank you so much, "Liberty Square", for these updates. It's pretty evident she IS Insane and Unfit to stand trial. would wonder if Mr. Warhola saw any significant signs of her gross instability.

FARMINGTON – The Layton woman accused of strangling her two children on Sept. 8, 2010 is still not competent to stand trial.

Sun Cha Warhola, 48, was scheduled to appear in 2nd District Court on Monday, but her attorney, Edward Brass, filed a motion earlier in the morning to move Warhola’s competency hearing to the fall of 2015.

In his motion, Brass said his client is still incompetent to stand trial, but that there is “a substantial probability that she will be restored to competency in the future.” She has been receiving treatment at the Utah State Hospital since May 2011.


Warhola is charged with two counts of first-degree felony aggravated murder for allegedly strangling her children, James, 8, and Jean, 7, in their Layton home.

Her husband, Kenneth Warhola, came home to find Sun Cha Warhola barricaded inside the son’s room with both children. They were found lying on the bed covered with blankets.

Sun Cha Warhola was found incompetent to stand trial in May 2011 after her attorney argued she was mentally incompetent and had no recollection of the matter.
