CHESAPEAKE, Va., June 17 (UPI) -- A Virginia man accused along with his wife in the abuse death of his 5-year-old daughter was denied bond Wednesday.

Joshua Sawyer, 24, is charged with second-degree murder in the June 11 death of Carly Sawyer, The (Norfolk) Virginian-Pilot reported. His wife Brandy, who was Carly's stepmother, is charged with first-degree murder

CHESAPEAKE, Va. - Punishment for the little girl with long chesnut curls, big brown eyes and a soft little smile was taking time-out in a cardboard box with her wrists bound with mesh, according to an affidavit filed in Chesapeake Circuit Court.

Carly Sawyer, 5, was also cut, burned, whipped with a belt and starved before she was killed, according to the document.

omg! that reminds me of a case where the "father" took the kids away from their mom. His new wife got tierd of the kids being hungry or whatever and they just put them in a closet till they died, FOR THE SAME reason!

Adela... This is what I am talking about.. These Creeps are trying to save them selves $$ I am going through the same thing and I would think that that my sons father wouldn't do this to my child. But you just never know. That is why he will NEVER have joint custody! EVER!!

I could show you photo's of a 10 year old child who had bruises upon bruises upon bruises, caused from beatings she was given by her Father and the woman he lived with. The child had been punished with beatings given by a paddle and she was marked from just below her shoulder to just above the knees on her back side.
The child dared not to say a word for fear of being beaten more. They lived in a rural area, 14 miles from a town where the child's Mother & other relatives lived. Finally the little girl decided to try to run away from home. She was caught and beaten again. A few days later the girl went to the home of a neighbor and ashed the neighbor to call her Mommy. The mother told the child to show the neighbor lady where she was hurt, and the woman reported to the Mom that she had very bad bruises. The Mother made the trip to get the girl and took her to the local ER under Police escort. The girl has never had to return to her Father's home again. She is now nearly 14 and still refuses to even speak to her Father. It is a wonder she was not killed. I believe, the woman this man lived with was the driving force behind the beatings.

the last months of her life, Carly Sawyer was put into a cardboard box as punishment.

Sometimes she was tied up with mesh netting. Other times, her father, Joshua Sawyer, and stepmother, Brandy Sawyer, withheld food, or spanked her with a belt.

Chesapeake police filed search warrants Tuesday that provided new details about the murder cases against Carly's father and stepmother. The affidavit for the warrant - which police use to convince a magistrate that they have probable cause to search private property - notes that Joshua gave a statement to police.

In the last days of her life, Carly arrived at a hospital with cuts, bruises and burns on her body and ligature marks on her wrists.

She was unconscious, and further examination revealed she had no brain activity, police have said.

The 5-year-old died Thursday. A day later, police charged Joshua Sawyer, 24, with second-degree murder and felony child neglect. Brandy Sawyer, 21, is charged with first-degree murder and felony child neglect.

Joshua Sawyer is scheduled to have a bond hearing this morning, a bond hearing for his wife is scheduled for Friday.

According to police, last Wednesday, one of the Sawyers called 911 after Carly became unconscious. It's not clear who called - there are two search warrants, and one says it was Brandy. The other says it was Joshua.

When medics arrived, they thought Carly's cuts and bruises looked suspicious and requested that police investigate, the warrants show.

The Sawyers told police that Brandy Sawyer had spanked Carly, and the girl had thrown herself to the floor. Later, Joshua Sawyer admitted to "using netting material as restraints, restricting the child to a cardboard box as a form of discipline, withholding food and spankings," according to the warrant.

Handwritten, a detective added "with a belt" with his signature next to it.

"We knew that it was something to this effect," said Carly's grandfather, Robert Kimery, whose daughter Jennifer is Carly's biological mother. "We just didn't know to the extent."

The medical examiner who looked at Carly determined the cause of her death was blunt-force trauma, although contributing factors included starvation, ligature restraint and medical neglect.

"Starvation doesn't just come in a matter of a week or more," Kimery said. "They've both done something to do this to her. It's not just a one-time incident."

Police seized two cardboard boxes, one bloody paper towel, a roll of blue mesh, a digital video camera, two insurance documents for Carly, nine photos of the girl, and a black leather belt from the two-story home that the Sawyers were leasing on Oliver Avenue, according to the warrant.

Police also searched for computers and computer equipment, although none are listed among the items seized.

According to the warrant, police found Brandy Sawyer's page on the social-networking site Facebook, on which she refers to an e-mail account she used to send messages to her friends "about how stressed she was over the children."

On her Facebook page, Brandy Sawyer wrote multiple times about being depressed.

Feeling "really down and depressed," she wrote May 14. On April 24, she wrote "I give up omg I just give up."

The page also includes multiple photo albums with pictures of her children - Carly and two other girls. There are pictures of Carly picking flowers, riding a bike and holding her baby sister. One is from Halloween, another from Christmas. One is titled "Pics of my angels."

Child Protective Services is caring for the couple's other two children, police said Monday.

Joshua Sawyer's lawyer said he could not comment Tuesday. Brandy Sawyer's lawyer did not return a phone call.

In November of 2008, we covered a case involving Dana Browning. She was a 19-year-old mother who was arrested after police found her newborn child wrapped in a trash bag and placed in a dumpster.

Dana's sister, Brandy Sawyer, was quite oustpoken on this site - expressing outrage at her sister's behavior and making the case that her sister should be punished for her actions.

In the interest of full disclosure - I did have a telephone conversation with Brandy. I try to keep an open line of communication with family members who are close a case, because it directly effects their lives.

During my conversation with Brandy, I found her to be very passionate about seeing justice for the little child who was thrown into the garbage. She was polite and chose her words carefully - but minced no words when it came to "stopping" her sister from hurting any more kids.

And Now For The Bad News

On June 13th I learned that Brandy Sawyer, along with her husband Joshua Sawyer was arrested for the murder of 5-year-old Carly Sawyer.

Joshua Sawyer, the little girl's father, had recently won custody of Carly after a 2+ year court battle with the child's mother. Now police say Joshua and step-mother Brandy repeatedly abused Carly.

According to police, emergency workers were dispatched to the Sawyer's home on Wednesday on a report of an 'unresponsive child'. Carly was rushed to Children's Hospital in Norfolk - however the child's injuries were significant. She was pronounced dead on Thursday.

An autopsy revealed the child died from blunt force trauma to the skull. Doctors say Carly suffered severe brain damage from the fatal blow that would eventually claim her life. The story, unfortunately does not end there. Doctors believe the little girl was a victim of long-term child abuse as well.

Medical examiners say starvation, abuse and medical neglect also contributed to the Carly's death. According to reports, Carly was cut, burned, whipped with a belt, tied up and then placed in a cardboard box before her death. Carly's wrists had been bound with wire mesh, causing ligature marks on her arms.

Detectives say Joshua Sawyer admitted to "disciplining" Carly by placing her inside the cardboard box, withholding food and whipping her with a belt.

Brandy Sawyer reportedly admitted to spanking Carly - but the first-degree murder charge she faces suggests that police are holding her accountable for the trauma that finally took Carly's life.

Brandy Sawyer has been charged with first-degree murder and felony child neglect. Joshua Sawyer has now been charged with second-degree murder and felony child neglect.

Carly's mother, Jennifer Kimery, had to go to court to gain custody of Carly's body so she could bury her daughter.

"How could you hurt such a beautiful child," said Kimery. "All she wanted to do was bring love and happiness into the world."

What kind of an upbringing did Dana and Brandy have? I don't even know what to say about these sisters. I feel sick!
I wonder if these child killer sisters have any other siblings. I would love to know more about their parents........

Dana Leigh Browning, a 19-year-old Hubert, North Carolina woman has been arrested on multiple charges after police say she delivered a full term baby, stuffed it's naked body into a trash bag and then threw it away.

According to the Onslow County sheriff's office, deputies were contacted on Oct. 27 after the body of an infant was discovered in the back of a garbage truck at around 7:00 a.m.. Deputies arrived on the scene in to discover the decomposing remains of a newly born infant girl, which had been collected during the disposal company's morning run.

Onslow County Medical Examiners performed an autopsy on the infant and determined that the child had been delivered at full term. Because of the state of decomposition, examiners were not able to determine if the child was born alive.

Detectives launched an investigation into the mother's identity and whereabouts, and were able to trace the child back to Browning's apartment. Authorities then obtained search warrants that inevitably identified Browning as the dead child's mother.

Investigators say Browning delivered the child, placed her naked body into a plastic bag and then threw the bag into the garbage without informing anyone about the birth.

"When initially questioned, Mrs. Browning lied to investigators," said Onslow County sheriff, Ed Brown. "The Mother has continued to be uncooperative throughout the investigation."

Browning was charged Thursday with concealing the birth of a child, failure to report a death and obstruction of justice. She was booked into jail pending a $9,000 bond.

The father and stepmother of a 5-year-old child who was beaten to death will go on trial on murder charges.

A Chesapeake Grand Jury heard the case on December 1 and determined there was enough evidence to take the case to trial.

Police arrested 25-year-old Joshua Sawyer and 21-year-old Brandy Sawyer in the June death of his daughter, Carly. Joshua Sawyer was charged with second-degree murder, his wife with first-degree murder. Both were charged with felony child neglect. They are being held without bond.

Authorities say Carly was confined in a box, tied up, hit with a belt and denied food.

A medical examiner ruled the cause of Carly's death was blunt force trauma. Starvation and medical neglect also contributed to the child's death.

The next court date for this case is January 24. At that time, a trial date will be determined.

Joshua S. Sawyer pleaded guilty Thursday to murdering his 5-year-old daughter, and unsealed court records today described a child long-battered and neglected before her death from an inflicted brain injury.

The 25-year-old father's plea, made as part of an agreement with prosecutors, came on what was scheduled to be a hearing on legal requests six weeks before his planned June 21 trial.

Under an Alford plea, he didn't admit guilt but acknowledged the prosecution had enough evidence to convict him of killing Carly Sawyer. He faces 20 years to life in prison when he's sentenced Sept. 13.

The plea agreement specifies that there is no agreement about sentencing. Under it, the commonwealth's attorney’s office dropped prosecution of a child abuse charge against Joshua Sawyer.

Prosecutors and Sawyer's lawyer had asked Judge Randall D. Smith to seal documents and photos in the court file, including a written statement of the facts of the case that the two sides agreed upon. Stephanie Pass, assistant commonwealth's attorney, argued that releasing the documents would make it harder to find an impartial jury for Sawyer's co-defendant, Brandy P. Sawyer, his wife and Carly's stepmother who is awaiting trial on similar charges.

Smith temporarily kept the documents private while Pass sought more precedents for her argument, but denied her request late Thursday in a ruling released this morning.

The agreed-upon facts in the court record show Joshua Sawyer telling police his wife “popped” Carly as punishment for urinating on herself the evening of June 10, and that the girl fell forward on her face, bloodying her nose and becoming unresponsive. But hospital examinations and a later autopsy revealed multiple injuries and scars, new and old, over much of her body, including 11 contusions of the face and head, and ligature marks on her arms and an ankle.

Joshua Sawyer told police his wife spanked Carly with a belt, they withheld some food to punish the girl for not using the bathroom, and they would tie her hands together and stick her in a box at night so she wouldn’t sneak food, according to the statement of facts.

"The court will note that evidence is substantial against the defendant," Smith said quietly after several minutes of reading the five-page statement of facts.

Police answering a 911 call on June 10 found Carly unresponsive in the Sawyers' Oliver Avenue home in South Norfolk. She died the next day from blunt-force trauma, with her other injuries and malnutrition contributing, her autopsy concluded.

Brandy Sawyer, 22, faces a June 14 jury trial on murder and child abuse charges.

Brandy P. Sawyer pleaded guilty Friday to murdering her 5-year-old stepdaughter through abuse and starvation.

Like her husband a few weeks ago, she wouldn't admit she committed a crime. They were disciplining Carly Sawyer for wetting herself, she told police.

Brandy Sawyer hit the child with a belt, according to a statement of facts she signed as part of a plea agreement in the case.

The Sawyers also made the girl run up and down a staircase and do push-ups.

They denied her food and tied her hands behind her back so she couldn't get food out of the refrigerator.

And they stuck her in a cardboard box in the living room, where she sometimes slept.

An autopsy after Carly's June 11 death revealed much more. Doctors determined that she died from an inflicted brain injury, exacerbated by new and old abuse injuries and malnutrition, according to the statement. Doctors found bruises and scarring over much of her body. Those included defensive wounds on her arms.

Carly weighed 34 pounds when she died.

Brandy Sawyer, 22, made an Alford plea to first-

degree murder, under which she didn't admit guilt but acknowledged that enough evidence existed to convict her. Under the agreement, prosecutors won't try her on a felony child-abuse charge. There's no agreement on sentencing, which could range from 20 years to life in prison.

Told by Circuit Court Judge Randall D. Smith that as a matter of procedure she still had to plead guilty or not guilty, she said "guilty" in a low voice, shaking her head.

Sept. 13; Brandy Sawyer on Sept. 21.

Paramedics and police answering a 911 call June 10 at the Sawyer's Oliver Avenue home in South Norfolk found Carly unresponsive. She died the next day.

In succeeding interviews with police, according to the fact statement, Brandy Sawyer's story changed. She told police she hit Carly with a belt, and the upset girl threw herself on the floor, hurting herself. She later said she went to "pop" Carly with the belt when the girl threw herself down. Carly often hurt herself by throwing herself to the floor or against walls, Brandy Sawyer said.

Weeks later, she told police that Joshua Sawyer knocked down Carly, whose hands were tied after being in the box all day. Brandy Sawyer said she cut Carly's hands free, and the father kicked the kneeling girl under the buttocks. Carly didn't get up, she said.

Brandy Sawyer told police that "things got weird" when Carly turned 3, while her other two children were "normal." Carly smeared her excrement and wouldn't eat in addition to hurting herself by flailing around. But the parents never took her to a doctor, Brandy Sawyer said.

When a detective described Carly's overall injuries and how she was treated at home, Brandy Sawyer said, "Well, when you say it like that, it doesn't sound good."

The detective asked her to explain how to make tying up a 5-year-old in a box and not feeding her sound good.

"I guess you can't," she replied.

Fighting to avoid spending the rest of her life locked up, Brandy P. Sawyer blamed her husband for the abuse that killed her 5-year-old stepdaughter, Carly.

She blamed her passiveness on being abused herself as a wife and child. She apologized. She wept.

But in the end Friday, Circuit Court Judge Randall D. Smith said he had little choice. With no way of knowing when she might be safe to the community or to herself, he sentenced the 22-year-old to life in prison. He left her hope for eventual freedom in the forms of a rare governor's pardon or a "geriatric release" due to age or illness.

"We have a situation where a child was tortured to death," Smith said. "It has to be one of the most horrific murders the court has considered."

Carly died in June 2009. Police and the medical examiner said she had been repeatedly beaten, denied food, tied up and made to sleep in a cardboard box in the Sawyers' rented South Norfolk home.

Brandy Sawyer pleaded guilty in May to first-degree

murder under a provision that allowed her to admit only that prosecutors had enough evidence to convict her. Her husband, Joshua S. Sawyer, 26, pleaded similarly that same month, and received a life sentence in October. Carly was his daughter from a previous marriage.

Three other children - one Brandy's and two both of theirs, including a son born after Brandy was jailed - live with relatives.

The Sawyers said they punished Carly for soiling herself. But on Friday, Brandy Sawyer testified that the abuse was virtually all Joshua's doing, from forced runs up stairs to whippings.

She said she initially took the blame herself because he forced her to. She said she didn't know how serious Carly's condition was. She said her husband also abused her, by hitting and choking that grew worse after the family moved from North Carolina to Chesapeake in 2008.

He cut her off from her family, limited her outside contacts, checked the mileage on the family vehicle to see whether she went anywhere, and threatened to keep her children if she left, she said. With apologies to his parents, she said he forced her to watch and then participate in sexual threesomes with other men - anything to keep him happy and the family together.

"Are you telling the court you were a prisoner in your own house?" asked Steven Shames, her attorney.

"In a way, yes," Sawyer responded.

Sawyer spent 42 minutes on the witness stand giving her first public explanation. She described an abusive, neglectful upbringing by a single mother who would trade sex with the 13-year-old Sawyer and an even younger sister to a drug dealer for a fix.

A. Weare Zwemer, a forensic psychologist, examined Sawyer. He testified that she grew up with no model for good parenting, and learned to cover up things. She attempted suicide and mutilated herself by cutting. She suffered from depression, anxiety and post-traumatic stress disorder.

"Ms. Sawyer accepted suffering as her lot in life," Zwemer said. "And I think she identified with Carly."

He said she wasn't the "driving force" in Carly's abuse.

"I was a coward. I'd sit on the couch and cry," Sawyer said.

She said she loved Carly as she did her own daughters. Carly wouldn't eat, so she'd put her food in a blender and try to spoon-feed her, she said. But Carly also tried to sneak food, Sawyer said, an inconsistency that Judge Smith noted.

Assistant Commonwealth's Attorney Stephanie Pass asked why she didn't escape while Joshua was at work, and why she texted him from home that Carly wet herself, leading to the fatal attack.

"No, I was not scared. I felt stuck," Brandy Sawyer said.

"Too stuck to save yourself or the children?" Pass pressed.

"You felt stuck," Sawyer answered in a low voice. "I had nobody."

"Joshua Sawyer was the driving force; Brandy was a soldier," Shames argued. "All this garbage in her head, and she finds herself now with basically nowhere else to go."

"She parented her own children just fine," Pass said. "She knew not to tie them up. She knew not to put them in a box."

She also noted that Sawyer was able to get away from a previous relationship, in Ohio. Pass called her not a soldier, but a "general."

"They were in this together," she said. "They waged war on Carly's little body. And she's not with us anymore."

Carly's mother, Jennifer Kimery, watched from a front row, dabbing at tears.

She told reporters afterward she was happy with the sentence, before her companions pulled her away. Sawyer's family and friends declined to comment.

Carly's mother, Jennifer Kimery, had to go to court to gain custody of Carly's body so she could bury her daughter.

"How could you hurt such a beautiful child," said Kimery. "All she wanted to do was bring love and happiness into the world."

I found this upthread...Also someone said that they had read on another blog that the father went after custody so that he wouldn't have to pay child support...But I wonder why he was able to get custody.

The father and stepmother accused of killing their 5-year-old daughter stood before a judge for the first time Monday morning.

Joshua Sawyer, 24, and Brandy Sawyer, 21, were arraigned in Chesapeake Juvenile and Domestic Relations Court at 8:30 a.m. The pair are being held without bond but have bond hearings scheduled later this week.

Joshua Sawyer is charged with second-degree murder and felony child neglect. Brandy Sawyer is charged with first-degree murder and felony child neglect.

Court records revealed further details Monday about a custody dispute between Joshua Sawyer and his ex-wife, Jennifer Kimery, that preceded Carly's death on Thursday. The fight started when Carly was 2 years old and involved at least one child neglect complaint against the girl's mother.

Joshua Sawyer and Jennifer Kimery were married Nov. 27, 2003, court records show. They were both 19. Carly was born about two months later, on Jan. 24, 2004.

Sawyer, who was a Marine corporal, was in Iraq when he learned of a October 2005 social services investigation stemming from a child neglect complaint against Kimery, according to a custody complaint he filed in Onslow County, N.C.

Records of the complaint were not available - a spokeswoman for the North Carolina Division of Social Services would not comment on whether the agency had any cases involving Carly's family.

Kimery, who was in the Air Force, said in an interview that a complaint was filed by a supervisor who, while helping Kimery move, noticed a knife in a roommate's bathroom and adult videos in her bedroom - areas Carly didn't have access to, Kimery said.

The Onslow County Department of Social Services terminated its investigation after Sawyer's parents got involved in Carly's care, according to the custody complaint.

Problems continued after Sawyer got back from Iraq in March 2006.

After his return, Kimery said, the marriage went downhill. She decided to leave her home for Georgia, where she had friends. She left Carly with Sawyer, she said, because she would be sleeping on a couch and didn't want to bring her child down until she got settled.

Sawyer's custody complaint says Kimery abandoned the family, leaving home for at least a week in March and leaving for Georgia to live with her boyfriend, the complaint alleges.

The problems peaked in July 2006, when Sawyer accused Kimery of returning to North Carolina and using "subterfuge" to gain control of Carly and take the girl to her parents' home in Louisiana, according to the complaint.

Kimery said Monday that she took Carly back to her family because she believed her daughter wasn't being cared for properly and feared for her safety. She says she filed a complaint of abuse against Sawyer with Child Protective Services in North Carolina.

Sawyer filed the custody complaint days after Kimery took Carly. A judge granted him temporary custody that year and ordered Kimery to return the child.

Joshua Sawyer and Jennifer Kimery were divorced on June 13, 2007 - when Carly was 3 years old.

Kimery said this week that she wishes people had listened when she said she was concerned for Carly's safety.

"Somebody could have stopped this happening," she said. "They didn't listen. They let my Carly down."

Sawyer, a data network specialist, left the Marine Corps in June 2008, military records show. He was last stationed at Camp Lejeune in North Carolina. He was awarded several medals, including the Marine Corps Good Conduct Medal and Iraq Campaign Medal.

Carly died Thursday at Children's Hospital of The King's Daughters in Norfolk. The cause of her death was blunt-force trauma; contributing factors include starvation, ligature restraint, and medical neglect, police said.

Social services officials in Chesapeake did not comment on whether they had been involved with Carly's family before her death. Chesapeake Social Services officials get calls or letters from social service agencies in other states - but only if child abuse or neglect cases are founded or substantiated and only if the agency knows that a family has moved.

Joshua and Brandy Sawyer's neighbors on Oliver Avenue said they didn't know much about the new family that had moved in a few months ago.

They said the couple never talked to anyone, although when they first moved in, Carly and the family's two other children would play outside, riding bikes in the driveway, said Tamara Givens, who lives a few doors down.

Carly would usually wave.

But Givens said she hadn't seen the children outside in a while, and she hadn't met Joshua or Brandy Sawyer in the five or six months they lived there.

"The first time I saw her was when she was sitting in back of the police car," Givens said.

A Hubert woman accused of dumping her dead baby in a curbside trash can two years ago pleaded guilty Wednesday to obstruction of justice for lying to investigators.

Dana Leigh Browning, 21, was sentenced to 36 months of supervised probation and 100 hours of community service. The court ordered her to submit to a 7 p.m. curfew, to complete parenting classes and continue mental health treatment until her attending doctor determines otherwise.

Browning’s obstruction charge was consolidated with a previous misdemeanor larceny count stemming from her involvement in stealing gift cards from Target, her employer at the time, and using them to obtain merchandise. She was ordered to pay $400 in restitution.

The court also asked Onslow County Department of Social Services to conduct a quarterly inspection of her home while she is serving probation. Browning has a 3-year-old daughter and has since remarried.

N.C Superior Court Judge Gary Trawick had the option to sentence Browning to six to eight months behind bars but felt that the sentence “would be here and gone” after which Browning could leave the state and not be under any supervision.

Browning’s attorney, Jacksonville Lawyer Walter Vatcher, said Browning became pregnant sometime in early 2008 but was unaware she was carrying a baby.

On Oct. 26 of that year, Browning began experiencing sharp cramping pains in her stomach and drew a hot bath. She lost consciousness and awakened hours later surrounded in a pool of blood mixed with water. She drained the tub to find a fetus at the bottom, Vatcher said, adding that she had a blurry recognition of the events that followed.

A garbage truck driver found the baby’s unclothed body in the back of his garbage truck Oct. 27, 2008, while at Sandy Oaks Apartments on Crystal Lane just off N.C. 172. He told The Daily News at the time that he originally thought the baby was some type of animal because he was used to seeing carcasses in the trash.

Senior Assistant District Attorney Mike Maultsby told the court Browning gave conflicting statements to investigators with the Onslow County Sheriff’s Department. Browning was charged in November 2008 with concealing the birth of a child, failure to report a death and obstruction of justice for lying about putting the baby in a plastic bag then putting the bag in the garbage.

Authorities were precluded from filing murder charges against Browning because although medical examiners were able to determine the baby was full term, they were unable to definitively say whether the baby was born alive due to the state of decomposition of the remains.

Vatcher told the court his client had experienced a trying upbringing by her mother, Janet Mogelnicki who is currently serving an 18-month sentence in the N.C. Correctional Institution for Women in Raleigh on convictions of forgery and credit card fraud. Vatcher said when Browning was 11 years old her mother drove her to a known crack house on Swansboro-Belgrade Road and gave her to the occupant for the evening.

Browning’s parents divorced in 1999.

Browning’s sister was sentenced to life in prison by a Virginia court last week for beating and starving to death her 5-year-old stepdaughter last year. Brandy P. Sawyer, 22, and her husband, 26-year-old Joshua Sawyer, a former Camp Lejeune Marine, pleaded guilty to murder earlier this year in the June 2009 death of Carly Sawyer.

Joshua Sawyer — who was given custody of Carly in 2007 by an Onslow County court, left the Marine Corps in 2008 and moved to Norfolk, Va.— was sentenced to life in prison in October.

Her parents didn't do this to her. Her sorry excuse for a "father" and his new wife did this to her. I'm her mother and I did everything in my power to keep this from happening. I just wanted to clear that up. I love my daughter more than my own life.

Excuse me, but you have NO idea what I went through. Maybe you should her my side of the story before you pop off at the mouth and hide behind anonymity on the internet. Carly was given to Josh despite the fact that I brought her to a doctor and got proof that she had been molested severely while in his care. You don't know my story and have no right to judge me. Do you know what it's like to hear her screaming for you in your head? Of course you don't. You're just some judgemental, self-righteous person that has nothing better to do than kick people while they're down. Hope you're proud of yourself.

Well, first, CPS dropped the ball. After that, money and connections in a small town. It's just that easy, believe it or not. I had an examination from a doctor, pictures, and people willing to testify that my daughter was severely molested while in Josh's care. He ended up with her anyway.

Welcome to VH Carlys Mommy!
First let me tell you how sorry I am for your loss of Carly, I cannot imagine going thru' my child's death, let alone something as horrific as what dear little Carly went thru'. I'm sure that the other members of VH will feel the same as I do.
We only know what is reported via the media unless we have someone as yourself to give us the 'other side of the story'. From what I've read the media didn't seem to be tough on you but there could have been publications that weren't posted here at VH.
We would sincerely like you to tell us about beautiful little Carly and please tell us why CPS dropped the ball on Carly. If you read further on this site you will see many posts of CPS dropping the ball resulting in a child's death and you will see that we are not easy at all on CPS.
Looking forward to hearing about your beautiful daughter.

The comments from the articles that most made me wonder why this beautiful girl ended up with these monsters instead of you, her mother were:

I hope that you, as I would have, would have gone and taken her forcibly out of that situation if you had known how bad it had really become. I guess I was just so frustrated that this tragedy had been allowed to happen that I just lashed out at you, her mother, because you were just the easiest target at the time. Your post made me realize how rash and thoughtless that was of me without trying to find out more about the situation. Please forgive me. I'm usually more sensitive, and this has reminded me to be less quick to jump to conclusions. Carley's Mom welcome to Victims Heartland. Lisette is a compassionate person. She has shown dedication to the "Victims" in these cases. As you can see from Lisette post she is a class act.
I just want to say I understand your frustration and loss. I am glad you came here to tell your side of the story. Grief counseling is very important to helping your heart and soul heal from what you have been through. Many funeral homes offer this service free of charge. I urge you to take advantage of what is out there to help you.

I accept your apology, hun. Thank you. Here's the story behind the neglect claim made to CPS. I was moving out of my apartment where I had a roommate. Some members of my command came to my house to help me move, despite the fact that I didn't invite them to. I had issues with this group of people giving me a hard time before this. It's almost like they came to "help" just to get into my business. There was a knife on the counter in my roommate's bathroom. They made a big deal about this even though it was behind 2 closed doors. Also, Carly wasn't allowed in my roommate's bedroom, not to mention that she couldn't reach the doorknob, much less open the door. Then, they made an even bigger deal out of the case to an adult DVD, which belonged to my roommate, as well. It was on a stack of stuff to be thrown in the trash. It was completely out of reach and sight of Carly. She wasn't even tall enough to see what was on the counter, and it was going to be thrown away with the rest of the trash that day before Carly would be in the house again. I had to go see a case worker one time. She determined that there was nothing wrong with Carly and I had not neglected her. I never abandoned my daughter. I left my husband. He put our personal business out to his entire Battalion. People were threatening to assault me because of things that Josh had told them. I didn't want to live in a place where I was surrounded by people that were constantly insulting me and threatening me. I went to live in Georgia. I didn't want this to negatively affect my daughter and wanted the transition to be as smooth as possible. So, Josh and I agreed that Carly would stay with him until I got an apartment. I was sleeping on someone's couch and didn't see that as a fitting environment for my daughter. At the apartment that Josh and I shared, she had her own room, a bed, and a routine. I was doing what I thought to be the best for my daughter. I did forcibly take my daughter out of a bad situation, but the courts forced me to return her. I went to North Carolina for a visit. Carly was acting odd, so I asked Josh to bring her to get examined to see if anyone had messed with her. He refused. I called Onslow County DSS and asked them to examine my daughter. Four hours later, the case was dismissed. The case worker, without ever actually seeing my daughter, told me that they believed this was an attempt to make Josh look bad. At the time we were going through a divorce. So, I took my daughter. I ran with her all the way back to Georgia and had her examined by a doctor. It was determined that she had been severely sodomized for the months that she had been with Josh. There were pictures taken and reports made. Carly was taken to a place called The Sunshine Home. She was examined by a child psychologist to try to determine who had molested her. I also made a report to NCIS. A few weeks later, I received a message from the Sheriff of the county that I lived in. I was to return Carly to Josh's custody by a certain date. I tried to gather information from the hospital where my daughter was examined, but I was turned down. I was told that they didn't want the integrity of their investigations to be put into question. I tried to get the information from NCIS, but kept getting the run around. A lot of things happened that I didn't understand in that court room, and Josh left with my daughter. That's the last time I saw her alive. NCIS still won't release the information that they have. It's been said that Carly actually identified Josh as the one who touched her, but I'll probably never know.

I know it's easy to jump to conclusions about things, but you have to stop and think about what other people are going through. Comments like this send me into a deep depression and I've made attempts on my life because of them. It really hurts when I know that I love my daughter more than I love myself and would trade places with her if I could. If Josh and Brandy wanted to hurt someone, I wish they would have called me. I would've taken the beatings. I would have let them tie me up and throw me in a closet. I wouldn't have even fought back if it meant that my daughter would be okay and alive. I would have gladly died in her place. It's all very frustrating, hun. This is so senseless. Just don't be so quick to say things that might hurt the people left behind. Thank you for your condolences.

Carlysmom Im sitting here with tears running down my face. I for one have no faith is CPS at this time in my life. Im sure there are people who do this work and truly care and want the best for children but im beginning to think they are few and far between. I dont think the sentence these people got was anywhere near severe enough. My heart goes out to you. I so wish I could bring your baby back to you. If you ever need a shoulder im here. Many of us have lost our faith in a system that is suppose to protect the children but don't. I enjoyed looking at the site created to honor Carly. The pictures are very precious. Thank you for sharing it.

CarlysMommy, I want to tell you how sorry we are that you lost your precious little girl. Carly was beautiful.

I want to reiterate what Linda Marie stated. Lisette is a wonderful, compassionate human being. She is also extremely intelligent and a very involved advocate for missing, abused, murdered children.

As the Founder of VH, please know that I trust Lisette 110% and know without a shadow of a doubt that she is truly sorry for her comment.

Linda Marie stated many of us have lost faith in the court system when it comes to children. We have also lost faith in CPS, DPS or whatever the name of the child protective service is called in your area.

Look at the Zahra Baker case. That is a Perfect example of a step-mother who continually abused a ten year old who got through two types of cancer, hearing loss and an amputated leg..only to be brutally murdered and dismembered. Child services were called multiple times to no avail. Bottom line, they did absolutely Nothing to protect Zahra.

I find it ironic and despicable that due to a knife in the bathroom and a pornographic CD, it was deemed you were "unfit" and temporary custody was given to your ex husband and his wife.

I know this is very, very difficult for you, but were you abused by Joshua? It's quite evident he is not only abusive, but is not at all what child services saw in him and his wife. BOTH are at fault, Both played a part in what they did to your daughter.

Your frustration level and suicidal thoughts are completely understood. You are young. How you've gotten through these past years is mind boggling!!

I am so sad for you and want you to know that we at VH are very happy you have joined. We are here to help you in any way that we can. If you need to vent, we are here to listen.

In researching via Google, I came across Carly's obituary and noted that your name is not mentioned. I would love to know WHO authored it! This infuriates me!!!

I don't know how many times I have been to this thread in the last 24 hours.....I have had posts written and deleted because believe it or not, I am at a loss for words. Like Slys Hunny I absolutely WEEP every time I come to this thread. Just as I am now. This time I will hit send......

Let me start with (and please forgive me members) - I know how you felt when you read some of the posts in the beginning CarlysMommy. Trust me, much worse has been said about me on another site (which I won't even say the name of the site as it MAKES ME SICK) and it is beyond devastating. I know that lisette's apology is sincere and truly from the heart.
I am guessing you are speaking of me there Wrap with saying there is another member her who has lost a child. Yes.....Our Dear Sweet Leah Freeman. My precious Leah, murdered almost 11 years ago. Leah was 15 when her life was taken. Her boyfriend is in jail now and the trial starts in about 10 days. All those years of nothing but frustration, tears, sadness and even anger. I have no idea how this trial will turn out, but when all is said and done, at least I can say we finally got to this point.

Enough about me......I went to Carly's site and I have to tell you....It Is Beautiful. Just like Carly. I didn't leave a comment (sorry) because my heart felt like it was going to drop to the floor. I WILL return to her site when I am feeling stronger and leave a comment. I am so so sorry for your loss CarlysMommy. So, sadly enough, we share a common bond.....The loss of a child. I can't help but think.....With Carly only being 5 your memories of her are not as many as mine with Leah. Damn. This is hard. I daydream quite a bit. I dream of that last good bye. That last hug. That last I Love You. Although it's just a fantasy or dream, it all seems like a dream I never want to wake up from. Like a fairytale. I think it's ok to fantasize like that. It seems to help me. That being said, I would NEVER give away mine and Leah's last good bye. That unforgettable kiss on the cheek she gave me as she left home that day. Little did I know that would be the last time I would ever see my Daughter again. No viewing or anything like that because the FREAK that killed her dumped her off over an embankment miles away from home and left her poor little body there to rot like some kind of animal. Many things stick in my head like Did she cry for her Mom while being murdered? Or did she even have time? I hope for the later. I hope and pray she died quickly. Crap! Didn't I say enough about me??? I'm sorry. This is just hard for me. So much going on in my head with the trial so close.

I hope you continue to be a member here at VH CarlysMommy. It's a wonderful site with wonderful members that can truly lift you up. I know they have me when I have been down soooooo low. They are all special people with good ideas and views.

CarlysMommy, I just visited Carly's precious website. It really helped explain the whole situation, and the pictures are priceless. It breaks my heart that I could have contributed to your depression. How true that: "Whoever keeps his mouth and tongue keeps his soul from troubles."(Proverbs) I want you to know that I have learned a valuable lesson. Though I have never lost a child, I know that it must be a deep valley to go through. Please don't allow yourself to become so hopeless that you decide to give up, no matter what ANYBODY says...Just remember that such comments come from ignorance of the true story. YOU know, and Carly knows, that you did EVERYTHING you could have because of your love for her. And because of your experience, you can touch the lives of others that are going through it better than anyone else ever could. Whenever you start feeling at your lowest, reach out to someone. Don't let Josh and Brandy win by destroying you and your desire to live. Let Carly's legacy be that her mother lived a life that overcame evil with good. You are in my thoughts and prayers.

I have no faith for CPS, either. It's seems to be mostly people that are there to collect an easy paycheck. I'm not saying that everyone working for CPS is like that. I'm sure there are people that honestly care about the children that they handle; however, I've yet to be proved wrong. No sentence will ever be enough for what my daughter went through. After Brandy's sentencing, I was rushed out of the courtroom because there were some rather unsavory males that were apparently looking for me. One of them had testified on Brandy's behalf. I was told later that I was rushed out because I was in danger. It's all a bit blurry. One of the news reporters that were trying to follow us asked me if I was happy with the sentence. I nodded my head. She asked me how I felt. I stopped and stared at her. People were pulling my arm to keep moving, but I remember shaking them off. I had no answer for her. How was I supposed to feel? Happy? Satisfied? I wasn't sure what they wanted to hear. I wanted to scream to everyone that this day never had to happen. I wanted to tell them that I really didn't care what happened to Brandy and Josh because nothing would ever bring Carly back. There was so much I wanted to say, but I just looked at her with tears rolling down my face. I was pulled away by someone shortly after I stopped.

I just wanted to clarify that a knife and adult DVD case was the cause of the child neglect claim against me. I'm not even sure of how they deemed me unfit. I never stepped into a courtroom about custody of my daughter. I had no idea what was going on. My lawyer turned out to be fishing buddies with Josh's lawyer. He told me a bunch of pretty lies and, before I knew what was happening, my daughter was gone.

Josh never abused me. He's never intimidated me, either. Brandy's defense testimony was a bunch of cow manure. Josh has always been a spineless turd.

The obituary that you saw was authored by Josh's parents. It was published about a month after Carly died. Josh's parents always viewed me as Southern white trash. His mother hated the fact that I wouldn't convert to Catholicism, therefore, I was a heathen. The obituary that was authored by myself is on Carly's website. I honestly don't know how I've made it through the past few years. I've been diagnosed with Bi-polar depression, PTSD, and generalized anxiety disorder. Some were diagnosed before Carly died and others after. I don't take medication, nor do I see a doctor for my conditions anymore. I found that the prescriptions make me feel like a zombie with no appetite and the doctors only care for the half an hour that you pay them for. Some days, I'm okay. Other days, I'm consumed by grief and depression. Everyone keeps telling me how strong I am, but I don't consider myself to be anything outstanding. I break down and cry on a regular basis. I just keep going because one day, I'll see my Carlyboo again. I know this is going to sound nuts, but I see her, feel her, and hear her all the time. She's always with me. It brings me some comfort and helps me get out of bed in the morning. I still wish that I could trade places with her.

I feel so welcomed here at VH. Thank you all so much for caring about my daughter and her story.

Those judgements are made based on our own life's experiences and through the lens colored by what we have seen in our lifetime. Jennifer, My son frequently gets the same question -

as I wait for another court date. I think he has come to terms with there is no way he could have done this and kept a job let a lone an active duty military career.

The last two years have just been crazy . You fought in the way you were able none of us could have dreamed this - I always thought we'd end up with our girl but not in the way did .I thought She would just get tired of the daily grind and give her up . People don't seem to believe that Her Dad was loading trucks for Afganistan and that the Army over road a supoena
so he testified by phone . I keep laughing at how naive I was to think it would all be settled in days.
I thought I'd just be driving to Chesapeake and picking
SM up-6 months of Foster Care for no reason. Even though I love the Foster Parents dearly and credit them with starting her back to real life.
I didn't have the same experience as you with CPS.
I live in Trumbull County in Ohio and even though things go wrong I now know the county I live in has some of the strictest polices in the United States. I would have fallen apart numerous times without their support. I haven't aggreed with CPS on everything but they did everything in their power to help.
Hard to believe she starts kindergarten this year already.
I know my son never intended for me to have one of his children on a permanent basis but again he couldn't/wouldn't put up with the process and Thank God for my husband's personality cuz there are days I want to go balistic on them and he takes over. I didn't see a link to the Jacksonville NC story which is a wonderful twist to this - An additonal arrest in the family sent me spinning - I don't know if people without money can win in these situations I often wonder how many poor people has been hustled like you were, and like Jorge was orignally. Keeping in mind we fired the Court appointed attorney Jorge had. 3 Hearings and all the Lady said on his behalf was " I haven't talked to my Client" Well DUH he is in Afganistan ya butt. Ohio is enacting laws to protect Military Parents too late and wrong state for you and Carly I know. One of the reasons I represented myself.
Figured if I was going to have an Ass for an Attorney I'd rather it was my own ass. I have alot of faith in Kristan hopefully it will be finished at the next court date. They will be facing a 3rd rejection on the Custody Appeal and my fake contempt of court charges. I'll let ya know as we get a court date.
You know these are the only criminals I have ever been involved with and it takes a court order to put them in life. ....
