Comedian Roseanne Barr speaks out for the first time after joining forces with online activist group Anonymous to tackle the case against two high school football players accused of raping a girl in Steubenville, Ohio.

The case made national headlines when a video surfaced online of students joking about the alleged rape. Roseanne tells Nancy Grace she continues to support the alleged victim and vows to keep the case alive on Twitter and on her radio show.

It started at a back-to-school party on August 11, 2012 in the small town of Steubenville, Ohio. Innocent enough until two teenagers, both football players at the small town's high school, allegedly raped an unconscious 16-year-old girl.

The two teenagers, Trent Mays and Ma'lik Richmond, both 16, reportedly raped the victim, who has not been identified, while she was drunk.

What happened next could be the key to charging both teens with the crime.

Partygoers instagrammed and tweeted about the attack, posting lewd comments about the victim and joking about the nature of the incident.

According to CNN, one of the Twitter accounts said:

"Song of the night is definitely "Rape Me" by Nirvana."

Two days later, the incident was reported to the Steubenville police, and a few days later the boys were charged.

But details emerging about that night have been igniting the media and tearing the small football town apart.

May's defense attorney, Adam Nemann, contends that the victim sent a text message to one of the teen boys that said the following:

"I know you didn't rape me," it read, according to Nemann. He declined to show CNN the message.

When asked why he thought the alleged victim might send such a message, Nemann answered: "Because I don't think she thinks she was raped."

The defense has asserted that the girl was conscious enough to consent to sex, but that text has yet to be confirmed. But when a photograph showing the teenagers carrying the limp body of the victim surfaced, a firestorm of protests started about the way the case was being handled.

According to CNN:

Robert Fitzsimmons, attorney for the alleged victim, declined to comment on the alleged message and the widely circulated photograph.

However, he stressed the girl was unconscious and cited a common saying: "A picture speaks a thousand words."

The case hit a pinnacle when the activist hacker group, Anonymous, posted an unpublicized video of partygoers cracking jokes about the rape. Comments included the following:

"They raped her harder than that cop raped Marcellus Wallace in Pulp Fiction."

"They raped her quicker than Mike Tyson raped that one girl." (0:50 mark)

In response, the New York Times published an eight-page investigation into the assault in December about how social media has played an interesting role in the case. They also divulged disturbing details about the rape that were previously unpublicized.

Twitter posts, videos and photographs circulated by some who attended the night long set of parties suggested that an unconscious girl had been sexually assaulted over several hours while others watched. She even might have been urinated on.

Defense attorneys lashed back, saying that the social media content has been taken out of context.

The divide comes on the heels of many rape cases in the media, questioning society's tolerance of rape and violence against women. Town residents have voiced concern, both on the side of the victim and of the alleged rapists. While some believe that the rape brings negative attention to the small town, others say that nothing would be done about the rape had it not gained national attention.

It is also worth noting that Steubenville, a city of about 18,000, dotes on its Big Red high school football team. Activists and protestors believe that the two teens are getting special treatment for the crime because they are football players. They also contend that while Mays and Richmond are clear suspects in the crime, others should also be charged for allowing the rape to take place.

That group -- Anonymous -- and other critics have accused community leaders of trying to paper over rampant misconduct by team members, and have suggested that other students took part in the assaults or failed to do enough stop them. Authorities have declined to say whether anyone else could be charged.

The group is enraged by the "cover-up" by the authorities and school officials in the town where "football is king."

In an effort to sift through the information from the case, the police chief and City Manager Cath Davison set up a blog dedicated to "disseminate the most accurate information" about the case.

According to the LA Times:

The city's blog also took the unusual step of distancing investigators from the video purporting to show students mocking the rape victim, at one point slipping into italics to mark its repugnance.

"Nothing in Ohio’s criminal statutes makes it a crime for someone to ridicule a rape victim on a video or otherwise say horrible things about another person," the blog says. "Further, nothing in the law allows someone who says repugnant things on Twitter, Facebook or other Internet sites to be criminally charged for such statements. Steubenville Police investigators are caring humans who recoil and are repulsed by many of the things they observe during an investigation."

Over the weekend more than 1,000 town residents gathered to protest the way the charges are being handled and to call for more charges to be brought against the teens in the video. Protests also focused on the social media aspect of the crime, prompting investigators to take a serious look at what role, if any, the teenagers had in the rape.

The Sheriff announced this weekend that no other arrests will be made.

Back in October, the victim's mother said that she has been ostracized since the attack and she cries at night. No other information has been released about the victim.

The trial is set for Feb. 13.

Rape should certainly not be tolerated, no matter the clout that these football players have in their town. This story is developing.

If one of these idiots were my son's, I would slap him silly!! What is WRONG w/today's youth when a girl is passed out, raped and these morons sit around laughing and saying horrible things?? Rhetorical. The PARENTS evidently are not raising their sons to have respect for females.

Steubenville, Ohio, is a place where “everybody knows everybody,” a judge said. Work at steel mills and coal mines was once plentiful there. But a lack of jobs has more residents leaving.

Steubenville Police Chief William McCafferty is bothered when he hears people say Big Red players get away with crimes. If crimes are being committed, he said, they are not being reported.

Coach Reno Saccoccia said because he had not seen online postings about the night in question, he had no basis for benching players.

HOURS AFTER SUNSET, the cars pulled up, one after another, bringing dozens of teenagers from several nearby high schools to an end-of-summer party in August in a neighborhood here just off the main drag.

For some of the teenagers, it would be one last big night out before they left this decaying steel town, bound for college.

For others, it was a way to cap off a summer of socializing before school started in less than two weeks. For the lucky ones on the Steubenville High School football team, it would be the start of another season of possible glory as stars in this football-crazy county.

Some in the crowd, which would grow to close to 50 people, arrived with beer. Those who did not were met by cases of it and a makeshift bar of vodka, rum and whiskey, all for the taking, no identification needed. In a matter of no time, many of the partygoers — many of them were high school athletes — were imbibing from red plastic cups inside the home of a volunteer football coach at Steubenville High at what would be the first of several parties that night.

“Huge party!!! Banger!!!!” Trent Mays, a sophomore quarterback on Steubenville’s team, posted on Twitter, referring to one of the bashes that evening.

By sunrise, though, some people in and around Steubenville had gotten word that the night of fun on Aug. 11 might have taken a grim turn, and that members of the Steubenville High football team might have been involved. Twitter posts, videos and photographs circulated by some who attended the nightlong set of parties suggested that an unconscious girl had been sexually assaulted over several hours while others watched. She even might have been urinated on.

In one photograph posted on Instagram by a Steubenville High football player, the girl, who was from across the Ohio River in Weirton, W.Va., is shown looking unresponsive as two boys carry her by her wrists and ankles. Twitter users wrote the words “rape” and “drunk girl” in their posts.

Rumors of a possible crime spread, and people, often with little reliable information, quickly took sides. Some residents and others on social media blamed the girl, saying she put the football team in a bad light and put herself in a position to be violated. Others supported the girl, saying she was a victim of what they believed was a hero-worshiping culture built around football players who think they can do no wrong.

On Aug. 22, the possible crime made local news when the police came forward with details: two standout Steubenville football players — Mays, 16, from Bloomingdale, Ohio, and Ma’lik Richmond, 16, from Steubenville — were arrested and later charged with raping a 16-year-old girl and kidnapping her by taking her to several parties while she was too drunk to resist.

The case is not the first time a high school football team has been entangled in accusations of sexual assault. But the situation in Steubenville has another layer to it that separates it from many others: It is a sexual assault accusation in the age of social media, when teenagers are capturing much of their lives on their camera phones — even repugnant, possibly criminal behavior, as they did in Steubenville in August — and then posting it on the Web, like a graphic, public diary.

Within days of the possible sexual assault, an online personality who often blogs about crime zeroed in on those public comments and photographs and injected herself into the story, complicating it and igniting ire in the community. She posted the information on her site and wrote online that the police and town officials were giving the football players special treatment.

The city’s police chief begged for witnesses to come forward, but received little response. In time, the county prosecutor and the judge in charge of handling crimes by juveniles recused themselves from the case because they had ties to the football team.

“It’s a very, very small community here,” said Jefferson County Juvenile Judge Samuel W. Kerr, who recused himself. His granddaughter dated one of the football players initially linked to the incident. “Everybody knows everybody.”

After more than two months in jail, they are under house arrest on rape charges, awaiting a trial that has been set for Feb. 13. Mays, a star wrestler, also faces a charge of disseminating photographs of a nude minor. The kidnapping charges were dropped.

The parents of the boys, who declined requests for extended interviews, said that the boys were innocent. The boys’ lawyers assert that the boys have been tried unfairly online, and vow they will be exonerated when all the facts are known.

The case has entangled dozens of people in and out of this town.

Three Steubenville High School athletes became witnesses for the prosecution and testified against Mays and Richmond, their friends, at a probable cause hearing in October. The crime blogger and more than a dozen people who posted comments on her Web site have been sued by a Steubenville football player and his parents for defamation. The girl’s mother, in several brief interviews last month, said her family had received threats, so extra police have been patrolling her neighborhood.Note: JVM had the "crime blogger" on her show Monday night & the case was dismissed with prejudice.

“The thing I found most disturbing about this is that there were other people around when this was going on,” Steubenville Police Chief William McCafferty said of the events that unfolded. “Nobody had the morals to say, ‘Hey, stop it, that isn’t right.’

“If you could charge people for not being decent human beings, a lot of people could have been charged that night.”

A Bright Spot in Steubenville

Steubenville is an industrial city in Appalachia — locals love to note it is hometown to the Rat Pack crooner Dean Martin, the porn actress Traci Lords and the oddsmaker Jimmy Snyder, known as Jimmy the Greek. The city once was teeming with so much gambling, prostitution and organized crime that Steubenville was given the nickname Sin City. But now the downtown is a skeleton of its former self: though the Steubenville visitors center sells life-size cutouts of Dean Martin and “Dino Lives!” T-shirts, many stores are abandoned, boarded up long ago.

The Grand Theater, once a lavish Art Deco movie house, last showed a film in 1979. Around the corner, Denmark’s women’s clothing store is now a graveyard for discarded hangers and broken clothing racks. In the window of the store is a dusty Woman’s Home Companion magazine from 1948, just about the time Steubenville began its long and painful turn for the worse.

The steel mills that used to employ thousands and draw people here have all but ground to a halt, and the once-plentiful jobs in the coal mines are dwindling. The lack of jobs scared off residents at such a frenzied pace that Steubenville had by far the steepest decline in population of any metropolitan area in Ohio from 1970 through 2000, according to a study by Ohio State University.

And among those who have stayed — about 18,400 in Steubenville — many are struggling. The median household income is $33,188, about a third lower than the national figure. More than one quarter of the residents are living below the poverty level. Also, the police say the city’s drug problems are growing, with heroin addiction the latest vice. In recent decades, new residents arrived from Chicago, bringing “Chicago-style violence,” like drive-by shootings in the tough parts of town, said McCafferty, the police chief.

Despite all those components to this depressed city, a bright light remains for the people here: the Steubenville Big Red football team.

The team recorded its first season in 1900 and quickly became a legend in Ohio high school football. It has won nine state championships, including back-to-back undefeated seasons in 2005 and 2006.

Some former players call it a highlight of their lives to play at Harding Stadium, a gleaming shrine to football also called Death Valley. The stands seat 10,000, more than half the town’s population, and the home side is packed every game, sometimes so packed that it is standing room only. Tailgating in nearby parking lots usually begins about 9 a.m. for a 7:30 p.m. game. Several years ago, Halloween trick-or-treating was postponed because it fell on game day.

Inside the stadium, a big thrill for fans is seeing a sculpture of a rearing red stallion called Man O’War shoot a six-foot flame from its mouth, marking each time Big Red scores.

The team’s Web site declares that Big Red is “Keeping Steubenville on the map.” That is probably true.

“Everybody around here goes to games on Friday nights, and I mean everybody — people come for miles,” said Jim Flanagan, 48, who grew up in the area. “It’s basically the small-town effect. People live and die based on Big Red because they usually win and it makes everybody feel good about themselves when times are tough.”

But emphatic pride over high school athletes, Flanagan said, has turned into something that can feel ugly.

“The players are considered heroes, and that’s pretty pathetic, because they’ve been able to get away with things for years because of it,” Flanagan said. “Everyone just looks the other way.”

A Night Takes a Grim Turn

Just before 10 a.m. on Aug. 11, fans who are part of what is called the Big Red Nation poured into Harding Stadium clad in the team’s colors, red and black, to see Big Red’s second scrimmage of the season and to get a sense of how the team would fare this year.

What they saw were two players who stood out from the rest: Mays and Richmond.

Mays, who hails from a nearby town and who went to Steubenville High because of its successful football and wrestling programs, showed off his strong arm at quarterback. Richmond, who the police say came from a troubled home and has lived in Steubenville with guardians since he was 8, dominated as a quick and tall wide receiver. He also was a star of the Big Red basketball and track teams.

The two athletes gave hope to fans that Big Red might be headed back to the top.

Of Mays, one person at the time wrote on JJHuddle.com, a Web site for Ohio high school sports, “If he has the composure, could be very enjoyable to watch that young man grow up with Ma’lik.” Mays and Richmond helped Big Red prevail that day in the scrimmage, before heading off to a night of parties.

Across the river, in a well-kept two-story colonial house in a solidly middle-class West Virginia neighborhood, the 16-year-old girl told her parents that she was going to a sleepover at a friend’s house that night. She then headed off to those parties, too.

She is not a Steubenville High student; she attended a smaller, religion-based school, where she was an honor student and an athlete.

At the parties, the girl had so much to drink that she was unable to recall much from that night, and nothing past midnight, the police said. The girl began drinking early on, according to an account that the police pieced together from witnesses, including two of the three Steubenville High athletes who testified in court in October. By 10 or 10:30 that night, it was clear that the dark-haired teenager was drunk because she was stumbling and slurring her words, witnesses testified.

Some people at the party taunted her, chanted and cheered as a Steubenville High baseball player dared bystanders to urinate on her, one witness testified.

About two hours later, the girl left the party with several Big Red football players, including Mays and Richmond, witnesses said. They stayed only briefly at a second party before leaving for their third party of the night. Two witnesses testified that the girl needed help walking. One testified that she was carried out of the house by Mays and Richmond while she “was sleeping.”

She woke up long enough to vomit in the street, a witness said, and she remained there alone for several minutes with her top off. Another witness said Mays and Richmond were holding her hair back.

Afterward, they headed to the home of one football player who has now become a witness for the prosecution. That player told the police that he was in the back seat of his Volkswagen Jetta with Mays and the girl when Mays proceeded to flash the girl’s breasts and penetrate her with his fingers, while the player videotaped it on his phone. The player, who shared the video with at least one person, testified that he videotaped Mays and the girl “because he was being stupid, not making the right choices.” He said he later deleted the recording.

The girl “was just sitting there, not really doing anything,” the player testified. “She was kind of talking, but I couldn’t make out the words that she was saying.”

At that third party, the girl could not walk on her own and vomited several times before toppling onto her side, several witnesses testified. Mays then tried to coerce the girl into giving him oral sex, but the girl was unresponsive, according to the player who videotaped Mays and the girl.

The player said he did not try to stop it because “at the time, no one really saw it as being forceful.”

At one point, the girl was on the ground, naked, unmoving and silent, according to two witnesses who testified. Mays, they said, had exposed himself while he was right next to her.

Richmond was behind her, with his hands between her legs, penetrating her with his fingers, a witness said.

“I tried to tell Trent to stop it,” another athlete, who was Mays’s best friend, testified. “You know, I told him, ‘Just wait — wait till she wakes up if you’re going to do any of this stuff. Don’t do anything you’re going to regret.’ ”

He said Mays answered: “It’s all right. Don’t worry.”

That boy took a photograph of what Mays and Richmond were doing to the girl. He explained in court how he wanted her to know what had happened to her, but he deleted it from his phone, he testified, after showing it to several people.

The girl slept on a couch in the basement of that home that night, with Mays alongside her before he took a spot on the floor.

When she awoke, she was unaware of what had happened to her, she has told her parents and the police. But by then, the story of her night was already unfolding on the Internet, on Twitter and via text messages. Compromising and explicit photographs of her were posted and shared.


Within a day, a family member in town shared with the girl’s parents more disturbing visuals: a photograph posted on Instagram of their daughter who looked passed out at a party and a YouTube video of a former Steubenville baseball player talking about a rape. That former player, who graduated earlier this year, also posted on Twitter, “Song of the night is definitely Rape Me by Nirvana,” and “Some people deserve to be peed on,” which was reshared on Twitter by several people, including Mays.

The parents then notified the police and took their daughter to a hospital. At 1:38 a.m. on Aug. 14, the girl’s parents walked into the Steubenville police station with a flash drive with photographs from online, Twitter posts and the video on it. It was all the evidence the girl’s parents had, leaving the police with the task of filling in the details of what had happened that night. The police said the case was challenging partly because too much time had passed since the suspected rape. By then, the girl had taken at least one shower and might have washed away evidence, said McCafferty, the police chief. He added that it also was too late for toxicology tests to determine if she had been drugged.

“My daughter learned about what had happened to her that night by reading the story about it in the local newspaper,” the girl’s mother said.

“How would you like to go through that as a mother, seeing your daughter, who is your entire world, treated like that?” the mother said. “It was devastating for all of us.”

Mays and Richmond were arrested Aug. 22, about a week after the girl’s parents reported the suspected rape.

Taking Sides on Blogs

Alexandria Goddard, a 45-year-old Web analyst who once lived in Steubenville and writes about national crime on a blog, heard about the case early on and rushed to investigate it herself. She told The Cleveland Plain Dealer in September that she did so because she had little faith that the authorities would do a thorough job.

Before many of the partygoers could delete their posts, photographs or videos, she took screen shots of them, posting them on her site, Prinniefied.com. On Aug. 24, just after the arrests, she wrote on her site that it was “a slam dunk case” because, she said, Mays and Richmond videotaped and photographed their crime and then posted those images on the Web. Goddard pressed her case.

“What normal person would even consider that posting the brutal rape of a young girl is something that should be shared with their peers?” she wrote. “Do they think because they are Big Red players that the rules don’t apply to them?”

She cited by name several current and former Steubenville athletes, accusing them of having a criminal role in the suspected assault by failing to stop it and then disseminating photographs of it. According to court documents, Goddard responded to a comment that read, “Students by day ...gang rape participants by night” by writing that the football coach should be ashamed of letting players linked to the incident remain on the field. In another post, she added, “Why aren’t more kids in jail. They all knew.”

Of the Big Red athletes who were with Mays and Richmond that night, she said: “No, you are not stars. You are criminals who are walking around right now on borrowed time.”

Anonymous commenters on her blog took aim at Steubenville High, its football coaching staff and the local police for not disciplining more players or making more arrests in connection with the rape accusation. On another site, Change.org, a person started a petition demanding that the school and the coach publicly apologize to the girl. The petition also asked that the Steubenville schools superintendent admit that there was a “rape culture and excessive adulation of male athletes” at Steubenville High.

In a day, 100 people signed the petition, and 169 signed before no more signatures were accepted.

Around town, the discussion of what might have happened that night in August raged, growing more heated by the day. The accusations on Goddard’s blog, posted by Goddard and others, sparked more debate. The local newspaper, The Herald-Star, ran a letter to the editor from Joe Scalise, a Steubenville resident, who criticized the blogger’s site, saying it “has lent itself to character assassination and has begun to resemble a lynch mob.”

Even without much official public information about the night, some people in town are skeptical of the police account, like Nate Hubbard, a Big Red volunteer coach.

As he stood in the shadow of Harding Stadium, where he once dazzled the crowd with his runs, Hubbard gave voice to some of the popular, if harsh, suspicions.

“The rape was just an excuse, I think,” said the 27-year-old Hubbard, who is No. 2 on the Big Red’s career rushing list.

“What else are you going to tell your parents when you come home drunk like that and after a night like that?” said Hubbard, who is one of the team’s 19 coaches. “She had to make up something. Now people are trying to blow up our football program because of it.”

There is no shortage of people who feel the opposite. They absolutely accept the account of sexual assault, and are weary of what they call the protection and indulgence afforded the football team. That said, more than a dozen people interviewed last month who were critical of the football team and its protected status, real or perceived, did not want their names used in connection with comments about the team, for fear of retribution from Big Red football fans.

One man said he wanted to see the accused boys go to prison, but insisted he remain anonymous because he did not want his house to be a target for vandalism.

Bill Miller, a painter who played for Big Red in the 1980s, said the coach was to blame because he was too lenient with players regarding bad behavior off the field.

“There’s a set of rules that don’t apply to everybody,” he said of what he called the favoritism regarding the players. “This has been happening since the early ’80s; this is nothing new. It’s disgusting. I can’t stand it. The culture is not what it should be. It’s not clean.”

Others attacked Goddard, the crime blogger, for her commentary regarding what she called the town’s twisted football culture and its special treatment of football players, including a player who is suing her for defamation. As part of the legal action against her by the player and his family, the court has allowed the family’s lawyers to seek the identities of those people who disparaged the player by name on the blog. The player has not been charged with any crime.

Goddard, who has not been located by the court so it can serve her with a copy of the complaint, did not respond to an e-mailed request for comment. She remains active on her blog.

Goddard’s lawyers, Thomas G. Haren and Jeffrey M. Nye, said that their client was a journalist whose work was protected by the First Amendment.

“This case strikes at the heart of the freedom of speech and of the press,” they said in a statement. “We intend to see those constitutional guarantees vindicated at the end of the day.”

Seeking Evidence

Despite the seeming abundance of material online regarding the night of the suspected rape and the number of teenagers who were at the parties that night, the police still have had trouble establishing what anyone might regard as an airtight case.

A medical examination at a hospital more than one day after the parties did not reveal any evidence, like semen, that might have supported an accusation of rape, the police said. The Steubenville police knocked on doors of the people thought to be at the parties, but not many people were forthcoming with information. In several instances, the police seized cellphones so they could look for photographs or videos related to the case.

Eventually, 15 phones and 2 iPads were confiscated and analyzed by a cyber crime expert at the Ohio Bureau of Criminal Investigation. That expert could not retrieve deleted photographs and videos on most of the phones.

In the end, the expert recovered two naked photographs of the girl. One photograph showed the girl face down on the floor at one party, naked with her arms tucked beneath her, according to testimony given at a hearing in October. The other photograph was not described. Both photographs were found on Mays’s iPhone. No photograph or video showed anyone involved in a sexual act with the girl.

Anonymous complaints and chatter on the Internet about a less than fully aggressive investigation have perhaps not surprisingly proliferated.

It has left McCafferty, the police chief, fuming and frustrated.

For weeks after the girl’s parents came forward, he again pleaded to the other partygoers to come forward with information about the possible sexual assault. Only one did, he said.

“Everybody on those Web sites kept saying stuff that wasn’t true and saying, why wasn’t this person arrested, why aren’t the police doing anything about it,” he said. “Everybody wanted to incriminate more of the football players, some because some of the other schools in the area are simply jealous of Big Red.”

McCafferty, who has been the police chief for 11 years, is sensitive when it comes to criticism of his police force. He took over in the wake of a United States Department of Justice inquiry into the Steubenville Police Department’s patterns of false arrests and excessive force. And he now goes out of his way to try to assure residents that they can trust the police department again.

He said it bothered him when he heard people say that Big Red players got away with crimes in town. If crimes are being committed, he said, they are not being reported. He said no one had ever given him a concrete example of players’ receiving special treatment.

In 23 years on the force, he said, he can only remember one player before Mays and Richmond being arrested; that player was convicted of assault.

“It’s always, ‘They said players are getting away with things,’ but when I ask who ‘they’ is, no one can tell me,” McCafferty said.

Standing by His Players

In this part of the football-obsessed Ohio Valley — where at least several houses in every neighborhood have a “Roll Red Roll” or a “Big Red” sign out front — everybody knows Coach Reno Saccoccia. He has coached two generations of players at Big Red and has won 3 state titles and 85 percent of his games, according to the team’s Web site. The football team’s field is named Reno Field.

This season, the coach, who is used to winning, had to do without Mays and Richmond. But others who were at the parties and might have witnessed the suspected assault continued to play on the team. Saccoccia, a 63-year-old who brims with bravado, was the sole person in charge of determining whether any players would be punished.

Saccoccia, pronounced SOCK-otch, told the principal and school superintendent that the players who posted online photographs and comments about the girl the night of the parties said they did not think they had done anything wrong. Because of that, he said, he had no basis for benching those players.

The two players who testified at a hearing in early October to determine if there was enough evidence to continue the case were eventually suspended from the team. That came eight games into the 10-game regular season.

Approached in November to be interviewed about the case, Saccoccia said he did not “do the Internet,” so he had not seen the comments and photographs posted online from that night. When asked again about the players involved and why he chose not to discipline them, he became agitated.

“You made me mad now,” he said, throwing in several expletives as he walked from the high school to his car.

Nearly nose to nose with a reporter, he growled: “You’re going to get yours. And if you don’t get yours, somebody close to you will.”

Shawn Crosier, the principal of Steubenville High, and Michael McVey, the superintendent of Steubenville schools, said they entrusted Saccoccia with determining whether any players should be disciplined for what they might have done or saw the night of Aug. 11. Neither Crosier nor McVey spoke to any students about the events of that summer night, they said, because they were satisfied that Saccoccia would handle it.

In an interview last month, Crosier maintained that he was not aware of what might have happened to the girl, even with all of the talk in the town, until three Big Red athletes testified in early October. At the same time, he said that he might have read the online petition that called for a public apology from the players and the team. He said that if he had, he had not thought much of it.

McVey said he was not aware of the team having any off-field issues before this one.

“If this happened as a pattern, it would have set off an alarm,” McVey said of the possible sexual assault. “But we think this was an isolated incident.”

Neither Mays nor Richmond had a record, the police said, and each had numerous community members testify as character witnesses for them at the hearing in which the judge determined they should be tried as juveniles, not as adults.

Saccoccia was one of those witnesses, as was Michael Haney, the school’s varsity basketball coach, who said Richmond was such a talented player that he ranked in the top 100 high school players in the state.

Yet the football season went on without Mays and Richmond, two of the team’s stars. And Big Red’s record reflected the gap in its roster.

The team finished the season 9-3 after losing in the second round of the playoffs. It was the end of a disappointing year for the program and the fans who expect so much from Big Red players.

The fans from a perennial rival, the Massillon Tigers, took advantage of the team’s legal troubles and taunted players.

In the Tigers’ cheering section at the game against Steubenville was one fan who painted on his chest the words, “Rape Big Red.”

Players and Families Wait

Big Red’s season ended in early November, and the daily conversation in town is less and less about the suspected rape than it is about how the team will perform next year.

But inside a courtroom at the county jail, less than two miles down a hill from the football stadium, the debate over what happened to the girl that summer night is still unfolding.

The hearings in the case are open to the public, but court documents regarding the matter are sealed because the defendants are juveniles. Mays and Richmond were released to their families or guardians last month, though they must wear electronic monitoring devices and are allowed to leave home only to attend school at the county jail or church. On school days, they head to classes at the jail, wearing their new uniform: green sweat pants and tan shirts, which have numbers on their left sleeves.

Last month, Mays’s father, Brian, declined to be interviewed, saying, “It’ll all work out.” From the street outside his house, two shelves filled with athletic trophies could be seen inside a second-story room.

Richmond’s father, Nate, said his son was innocent. In September, he camped outside the county jail next to a banner that read, “Set my people free.”

“He didn’t do anything,” Richmond said.

Ma’lik Richmond now lives with his legal guardians, Jennifer and Greg Agresta, in a middle-class neighborhood with neatly trimmed lawns. A basketball hoop sits on the street in front of his house. Greg Agresta is a member of the school board.

Richmond’s grandmother, Mae, said the charges surprised her because Ma’lik had been so focused on sports and school, with hopes of leaving Steubenville for a better life and having a better life than his father, who has served time in prison and been charged with many crimes, including manslaughter.

“Me and Coach Reno was talking, and he said Ma’lik was just in the wrong place at the wrong time,” she said.

Adam Nemann, Mays’s lawyer, said the case was unusual because the police collected no physical evidence or testimony from the girl who asserts she was raped.

“The whole question is consent,” he said. “Was she conscious enough to give consent or not? We think she was. She gave out the pass code to her phone after the sexual assault was said to have occurred.”

Walter Madison, Richmond’s lawyer, said his client was already at a marked disadvantage because so many people discussed the incident online, through blogs and on Twitter.

“It’s an uphill battle because you’ve got social media going on and people formulating opinions, people who weren’t there and don’t know what happened,” he said. “In a small community, it exponentially snowballs out of control. I think the scales are a bit unbalanced.”

He said that online photographs and posts could ultimately be “a gift” for his client’s case because the girl, before that night in August, had posted provocative comments and photographs on her Twitter page over time. He added that those online posts demonstrated that she was sexually active and showed that she was “clearly engaged in at-risk behavior.”

The lawyers for the boys also said the three athletes who testified against their clients had credibility issues. The lawyers said that the police had found photographs of nude women on the phone of one of the witnesses, and that two witnesses had admitted recording some aspect of the suspected assault. Those alone could be crimes, the lawyers said, but the witnesses were given immunity from prosecution. Their testimony, the lawyers suggested, might have been given in a bid for leniency.

The special prosecutors on the case, Marianne Hemmeter and Jennifer Brumby of the Ohio Attorney General’s Crimes Against Children unit, declined to comment because the investigation was open.

But in court, they have rejected the defense’s claims. The girl, they have said, was in no condition to give consent to sexual advances that night — and the teenagers there knew it, the prosecutors said.

At a hearing in early October, prosecutors told the judge in the case that the defendants treated the girl “like a toy” and “the bottom line is we don’t have to prove that she said ‘no,’ we just have to prove that when they’re doing things to her, she’s not moving. She’s not responsive, and the evidence is consistent and clear.”

At a hearing last month, the girl’s mother said her daughter remained distraught and did not want to attend school. The girl’s friends have ostracized her, and parents have kept their children away from her, the mother said.

The girl does not sleep much, said the mother, who testified that she often hears her daughter crying at night.

The mother said the obsession with high school football in Steubenville is partly to blame. It shocked her that Saccoccia testified as a character witness for the defendants last month, she said.

In the courtroom that day, she remembered thinking, how dare he?

“Just Coach Reno saying he would testify for those boys, saying he was so proud of them, that speaks volumes,” she said. “All those football players are put on a pedestal over there, and it’s such a status symbol to play for Big Red, the culture is so different over there.”

The mother added: “I do feel like they’ve had preferential treatment, and it’s unreal, almost like we’re part of a TV show. It’s like a bad “CSI” episode. What those boys did was disgusting, disgusting, and for people to stand up for them, that’s disgusting, too.”

STEUBENVILLE, Ohio — For more than three hours Saturday, chants, signs, and speeches filled the cold air outside the Jefferson County Courthouse as a crowd of 800 to 1,000 people demanded a more thorough investigation into the alleged rape of a 16-year-old West Virginian by football players from this Ohio Valley community.

Two members of the Steubenville High School football team, Trent Mays and Malik Richmond, both 16, have been charged with assaulting the young woman in August and face trial in February.

The case has attracted national attention because of recent Internet postings, including a 12-minute video of a former Steubenville student recounting the alleged sexual assault in graphic detail.

Initially, online conversations focused on a series of alcohol-fueled parties attended on Aug. 11 by football players in which the girl, who was inebriated and largely unresponsive, was carried from place to place, photographed, and assaulted, according to witnesses.

Later postings featured criticism of the teenagers’ behavior and the investigation that followed.

“I will not stand idly by and let a young girl’s life be ruined because she believes everyone is apathetic,” said Sable Foster, a 23-year-old Kent State University senior who spoke to the crowd through a bullhorn. Later, she said the initial investigation by Steubenville police lacked thoroughness.

“We need the actual culprits. It takes more than two people to … transport a body from party to party. There are some liquor stores that will sell to Big Red [Steubenville High School] football players. We don’t want to see it tried in juvenile court. That’s an adult crime.”

Ohio Attorney General Mike DeWine is leading the prosecution because the local prosecutor and judge recused themselves.

Saturday’s demonstration was organized by the online activist group known as Anonymous, which has taken a role in keeping national attention on the case.

Members of the group have hacked into email accounts and Web sites of people connected to the alleged crime and have posted images and documents online, including the 12-minute video of the former student recounting the rape.

Anonymous supporters wear the Guy Fawkes mask made popular in the film V for Vendetta, and many such masks were present at Saturday’s demonstration.

Milissa Snider of Wintersville, Ohio, carried a placard that read, “Your ‘Rape Crew’ is Over,” a reference to what some of the football team members are said to have called themselves.

More than a dozen women stood in front of a microphone on the courthouse steps.

Many spoke briefly, and some wept openly while recounting their experiences as rape survivors.

One woman, who gave her name as Robin, said she was molested 58 years ago.

“How proud I am of this woman for standing up. It is not your fault,” she said.

James Lancaster, a father of five who lives in Steubenville, applauded the women. Like some demonstrators, he wore a mask but removed it before speaking.

“These are our daughters, our sisters, our wives. We need to teach our children right from wrong,” said Mr. Lancaster, who is a mental health coordinator for the mentally handicapped.

Over and over, the protesters demanded the resignations of Reno Saccoccia, the Steubenville High School football coach who was criticized after the incident for not disciplining other players who were at the party, and of Jefferson County Sheriff Fred Abdalla.

The sheriff is accused of not taking enough responsibility in the investigation.


Sherrif Abdalla watched the crowd before addressing it. He was dressed in uniform and wore a teal ribbon, a symbol of support for rape victims.

Nancy Snodgrass, 49, of nearby Follansbee, W.Va., said she would have walked three miles to attend the demonstration but hitched a ride with a friend.

“These women are so brave to step forward. We need to stand up for these women.”

Ms. Snodgrass criticized Sheriff Abdalla.

“He’s playing Pontius Pilate. He should be doing something about this,” she added.

Sheriff Abdalla called the women’s stories heartbreaking.

He told the protesters that he advises third and fourth graders to be wary of strangers and warns them to watch out for relatives too because “we’ve arrested fathers and grandfathers and stepfathers and boyfriends.”

After a demonstrator asked him when he first saw the 12-minute video, Sheriff Abdalla replied, “The first time I saw it was three days ago.”

“Liar, liar, pants on fire,” the crowd shouted.

Sheriff Abdalla responded to reporters’ queries as he left the courthouse steps.

He said the boy who narrates the 12-minute video “wasn’t there when the alleged rape happened. He made that video based on what people told him,” Sheriff Abdalla said. “Three individuals witnessed the sexual contact.”

Earlier in the day, Steubenville City Manager Cathy Davison spoke at a news conference to unveil a Web site called SteubenvilleFacts.org, sponsored by the city and its police department “to disseminate the most accurate information” about the case.

The Web site was set up by Mark Weaver, who was Ohio’s deputy attorney general from 1995 through 1999. The former prosecutor, who lives in Columbus, runs a business called Communications Counsel.

Mr. Weaver said he was hired last week. His appearance followed by two weeks the New York Times’ publication of an in-depth story about the case.

During Saturday’s briefing, Ms. Davison did her best to put distance between the city’s seven-member council and local authorities.

The Jefferson County prosecutor and sheriff, she said, are elected by county residents.

“The city has no authority over the schools or the prosecutor,” Ms. Davison said. “The city does not run the school or the football program.”

Steubenville Police Chief William McCafferty said police obtained the 12-minute video, narrated by a male teenager, in August.

He said some residents have received harassing phone calls and one man had to turn off his phone.

Brian Yontz, a 21-year-old security guard who grew up in Steubenville, and his aunt Michele Thomas were among the first to arrive for the rally and brought with them a pile of colorful signs.

“No football player should think that they can do whatever they want and get away with it,”
Mr. Yontz said.

Mr. Yontz, who played left tackle on the football team and graduated from Steubenville High School in 2009, said he left the team in his sophomore year after missing several practices because his grandfather, who later died, was gravely ill.

Coach Soccaccio, Mr. Yontz said, “thinks football is above everything else and it’s not.”

CINCINNATI -- A rape case in Steubenville, Ohio, has split this city, drawn international attention, become a social media sensation, and this week drew a crowd of protesters in Guy Fawkes masks.

And now, a retired judge from Delhi Township, Ohio, is at the center of the case.

Tom Lipps, a retired Hamilton County Juvenile Court judge, is presiding over the Steubenville rape case where two 16-year-old players on the tight-knit city's football team are accused of abducting and raping an apparently drunk 16-year-old girl.

That August incident resulted in criminal charges against the football players, with the local judge and prosecutor stepping down from the case because of their close connection to those involved in the case or potential conflicts of interest.

The case may be moved from Steubenville -- with Cincinnati as one of many possible sites -- because witnesses are worried about their safety and reputations.

Attorneys for the two charged teens suggested Tuesday that the Feb. 13 trial may have to be moved. It possibly could be moved to southwest Ohio because Lipps lives there. With a population of about 18,000, Steubenville is more than 250 miles and four hours east of Cincinnati, located almost equidistant between Pittsburgh and Wheeling, W. Va.

The Ohio Supreme Court doesn't keep statistics on change of venues, a spokesman said Tuesday. State law offers little guidance on where or how far a criminal trial can be moved.

Lipps retired in 2010 after 12 years as a Hamilton County Juvenile Court judge and 25 more in that court as an administrator and magistrate. After his retirement, Lipps was named a visiting judge by the Ohio Supreme Court, allowing him to be appointed in any Ohio county. His strong background in juvenile court made him a good candidate to preside over the case. The teens are charged as juveniles.

"I'm pleased to hear that he's in the middle of that firestorm. He'll make sure justice is done," said Alex Triantafilou, an attorney and president of the Hamilton County Republican Party. Lipps wouldn't comment Tuesday.

"Tom is the quintessential judge," said Sylvia Hendon. She currently is a judge with the Cincinnati-based Ohio 1st District Court of Appeals, but served as a Hamilton County Juvenile Court judge with Lipps for eight years.

"There is nobody is the State of Ohio, and I mean including the legislators who wrote them, who knows the Juvenile Court laws better than Tom Lipps."

Before spending 17 years as a Juvenile Court administrator and magistrate, Lipps was a probation officer. He was appointed judge in 1998. Lipps has already refused a request to close the Steubenville proceedings from the public.

According to reports, the 16-year-old girl from a West Virginia town just across the river from Steubenville was taken to Steubenville and later seen in photos, apparently drunk, being carried by smiling teen males by her arms and legs.

Since the judge and prosecutor in Jefferson County, home to Steubenville, have stepped down, Ohio's Attorney General's office is prosecuting the case.

Public interest in the case increased with the circulation online last week of an unverified video that purportedly shows a young man joking about the 16-year-old girl. The video apparently was released by hackers who allege more people were involved and should be held accountable.

In the last week, demonstrations have called for the case to be properly prosecuted despite the football-crazed city's high school team's players being accused.

The demonstrators wore Guy Fawkes masks, which were recently made popular when they were worn by the main character in the movie "V for Vendetta."

STEUBENVILLE, Ohio -- One of the teens who recorded himself mocking the girl at the center of an Ohio rape case "did a really dumb thing and regrets it" but did not commit any crime, his lawyer said Monday.
The attorney, Dennis McNamara, said there was "no excuse or justification" for the jokes Michael Nodianos made, "and with some sober reflection, he is ashamed and embarrassed to hear them himself."
"He sincerely regrets his behavior and his comments and the effect that it's had on the parties involved, including his own family," McNamara told reporters in Steubenville, the small Ohio town that has become the focus of national attention because of the case. "He was not raised to act in this manner."
Two 16-year-old members of the town's powerhouse high school football team are charged with sexually assaulting a girl after a series of parties in August. They are set for trial in a juvenile court in February.
McNamara said Nodianos, 18, has been interviewed by detectives "at some length" and is not the subject of an investigation.
"Michael is a really good kid from a really good family who did a really dumb thing and regrets it," he said. "Beyond that, he has no involvement in the criminal case or in any of the underlying activity that led to the filing of the criminal charges."
The case gained national attention after The New York Times published a lengthy piece on it in December. The activist hacker group Anonymous and other critics have accused community leaders of trying to paper over rampant misconduct by football players, and suggested that other students took part in the assaults or failed to do enough stop them. Anonymous helped organize a weekend protest in Steubenville that drew a crowd of hundreds to the town, a community of about 18,000 on the Ohio River across the river from West Virginia.
Then last week, Anonymous posted the 12-minute video that featured Nodianos -- a video the attorney said had been taken offline in the days following the incident. In it, he makes joke after joke about the girl's condition, saying she must have died because she didn't move during one assault.
McNamara said the video had been recorded in the pre-dawn hours following the parties. Nodianos was drunk, "but that's not a justification or excuse," his lawyer said.
McNamara said Nodianos wasn't at the house where the alleged rape took place, nor did he witness anything himself: The details he recounted "came from the reports of a couple of other young people that had been present or had seen these things, or at least claimed to."
McNamara said his client graduated from Steubenville High in 2012. He had perfect attendance, played on the school's baseball team and won an academic scholarship to Ohio State University.
Nodianos was enrolled at OSU in the fall but has left college for the time being, McNamara said. Meanwhile, he said, hackers have gotten into Nodianos's e-mail, his parents e-mail accounts and reactivated his closed-down Twitter account. They and are posting new tweets, "but he has nothing to do with that," McNamara said.
The defendants in the rape case, Trent Mays and Ma'lik Richmond, are both 16. Their attorneys have said both teens are not guilty, and say they will seek to get the trial moved because of the excessive publicity the case has received. Both are charged with rape, while Mays faces an additional charge of illegal use of a minor in nudity-oriented material.
At an October hearing, witnesses say they saw the girl stumbling, vomiting and eventually unconscious, having to be carried by the hands and feet. One of the witnesses said she didn't respond when Richmond performed a sexual act on her in the basement of another student's home.
CNN is not identifying the girl, a juvenile, in accordance with its policy not to release the names of alleged rape victims. Although the suspects also are juveniles, CNN is identifying them because they have been publicly named by a juvenile court judge, by defense attorneys and in media accounts.

I went to the first rally and will also be attending the next one !! I find it important for those kids and all the others to know that first of all this is not a laughing matter and that nobody is above the law! It should not matter who you are what you do who you know or if you are able to trow a ball. Rape is a crime and you should be in jail for it !! The ignorance in this town is beyond me and we have been told by store owners that they can't wait for us to be gone so they can go back to the football games in peace .... yeah it's not gonna happen

Riley's Mom, good to see you here! Had no idea you lived in or near Stuebenville. I know that town was infamous decades ago for the mafia. My mother lived and taught in East Liverpool and spent plenty of time there in her younger years.

This is NOT the first time we have seen football players or athletes think they can literally get away w/any crime they commit because they w/have the backing from local LE. To HELL w/the football b.s.!!

This type of mindset has GOT to Stop!! I can't imagine how this poor girls parents must feel. Nor can I imagine being a parent to ANY of the kids at that "party" that witnessed this and did NOTHING, and that video of those idiot boys mocking her is beyond deplorable!

Could not agree more !! It is about a 50 min drive for me I'm from Moundsville WV ...but so worth it ! It kinda gives me that feeling that there is still hope for mankind to see all those people come together and fight to make things right for this one person a girl they don't even know ! Greg and Jennifer Agresta, the former legal guardians of 16-year-old suspect Ma’lik Richmond, spoke to Matt Lauer on TODAY Tuesday alongside Richmond’s attorney, Walter Madison. Richmond and fellow Steubenville High School sophomore football player Trent Mays, 16, were charged with raping a 16-year-old girl on the night of Aug. 11 after photos and video from the alleged incident were posted on social media. The trial is set to start next month, and both defendants have pleaded not guilty.

The Agrestas became Richmond’s legal guardians when he was 8 years old and played on a youth football team coached by Greg Agresta. Richmond lived in a troubled home and his parents could not take care of him, so the Agrestas took him in for two years before he returned to his biological parents. Richmond is currently on house arrest and is living in the Agrestas’ home, but the couple said they have not asked him specifically about what happened on the night in question.

“It doesn’t matter to us,’’ Jennifer Agresta said. “We love him regardless of what happened that evening. We want him to know that we support him. When he left our home as a young child, the last thing I said to him when I dropped him off was, ‘Ma’lik, if you ever need anything, good or bad, we are a phone call away.’ When he called us…we had to be there for him.’’It doesn't matter? OMG!

“He knows we love him dearly,’’ Greg Agresta said. “He knows that if he’s convicted and if he’s found guilty, whatever may happen, we love him and support him.’’

'Everybody was surprised'

The Agrestas described Ma’lik as a “laid-back kid,’’ so the charges were stunning to them. Prosecutors have said that Mays and Richmond treated the victim “like a toy’’ while the group was party-hopping and drinking heavily that night. Mays allegedly attacked her in the back of a car while a friend took pictures that were later deleted, and later that night both players attacked her while she was passed out in a basement, according to prosecutors. The defense for both players claims that everything that happened was consensual.

“I think everybody was surprised,’’ Jennifer Agresta said. “It’s out of character for Ma’lik. I think everybody was in shock.’’

“I was very disappointed in the judgment that (was) allegedly exercised at that point in time,’’ Greg Agresta said. “It’s completely out of Ma’lik’s character. That’s not the type of person that he is.’’
When asked by Lauer if they felt Richmond could have been involved in what has been alleged, the Agrestas were silent before Madison interjected.

“That’s a very difficult question for them,’’ Madison said. “ Under advice of counsel, I’ve shielded the family, and I’ve tried to protect the integrity of this attorney-client relationship.’’

The Agrestas said they are very private people, so they were initially reluctant to appear and speak in Richmond’s defense.

“The right thing to do is always the hardest thing to do,’’ Greg Agresta said. “Even when (Ma’lik) went back home with his mom and dad, he’s always been a part of our family. The problems you have in society today, too many people want to share the good times. When individuals and family members run across difficult times, right or wrong, they want to bail.’’

Anonymous gets involved
The case has received heavy attention because of the role of social media and the concern by some in Steubenville that the football players are being treated as above the law. The hacker group Anonymous has gotten involved, taking over a high school booster site last week and threatening to release personal information about other people they feel should be charged in the incident.

Local authorities felt that so much misinformation was being disseminated online that the Steubenville Police Department created its own website called “Steubenville Facts” to disseminate information that it has collected about the case.

A particular video released by Anonymous that has caused outrage depicts a teen crudely joking about the alleged rape, but the teen was not present during the incident and is not being investigated for any crimes, his attorney said Monday. A photo also was posted by Anonymous online of Mays and Richmond carrying the alleged victim, who appears to be unconscious. However, attorneys for the football players contend that the girl was conscious and able to consent.

Madison confirmed that it is Richmond in the photo.

“He is seen in that photo,’’ Madison said. “The other problem becomes that the photo, taken in conjunction with the video, draws this negative inference that has gone way out of proportion.’’

The attorneys for both defendants are trying to get the trial moved far away from Steubenville and hope to delay the proceedings until the emotion surrounding the case dies down. Madison does not feel his client can get a fair trial in Steubenville.

“It has gone to the point where witnesses are reluctant to participate for fear of being vilified and (having) their personal information placed on the Internet,’’ Madison said.

“At the end of the day, you have the best judicial system in the world,’’ Greg Agresta said. “Embrace the process and let it work. We respect those people for the opinions that they have as far as protesting. In turn, embrace the legal system. It will work, and it does work, right or wrong.’’

Two Ohio high-school football players accused of raping a teenage girl may not get a fair trial after a photo and video allegedly associated with the case were posted on the Internet by the computer hacking group Anonymous, a lawyer for one of the accused said on Friday.

The players, both 16 and members of the Steubenville High School football team, are charged with raping a 16-year-old fellow student last August, according to statements from their attorneys to local and national media.

Their juvenile court trial is scheduled for February in Steubenville, a city of 19,000 about 40 miles west of Pittsburgh.

The case shot to national prominence this week when Anonymous activists made public a picture allegedly of the rape victim, being carried by her wrists and ankles by two young men, and of a video that showed several other young men joking about an alleged assault.

Walter Madison, the lawyer for one of the defendants said on CNN that his client was one of the young men in the photograph, but does not appear in the video.

But the picture "is out of context," Madison said. "That young lady is not unconscious," as has been widely reported.

"A right to a fair trial for these young men has been hijacked," Madison said, adding that social media episodes such as this have become a major threat to a criminal defendant's right to a fair trial.

"It's very, very serious and fairness is essential to getting the right decision here," he said.

Adam Nemann, an attorney for the other defendant, could not immediately be reached for comment on Friday. In an interview on Thursday with Columbus, Ohio, broadcaster WBNS-10TV, Nemann raised concerns about the effect the Anonymous postings could have on potential witnesses in the case.

"This media has become so astronomically ingrained on the Internet and within that society, I am concerned witnesses might not want to come forward at this point. I would be surprised now, if there weren't witnesses now who might want to start taking the Fifth Amendment," Nemann told the station.
The Fifth Amendment to the U.S. Constitution offers protection against self-incrimination in criminal proceedings.

The case has also been a challenge for local officials because of conflicts of interest. Both the local prosecutor and police have close ties to the school that the defendants attend.

As a result, the case is being investigated and prosecuted by Ohio Attorney General Mike DeWine's office.
Interviewed on CNN on Friday, DeWine said it was not unusual for his office to prosecute or investigate cases in small towns where close ties within the community caused conflicts of interest to arise.

He also voiced concern about how social media may affect the case.

"This case needs to be tried not in the media, not in social media," DeWine said.

He said Anonymous' attempt to shame the alleged attackers had actually harmed the victim.

Not only is the victim hurt by the initial crime, but "every time something goes up on the Internet, the victim is victimized again," DeWine said.

They all just want this to go away. If Anonymous would not have made a big deal out of it nobody would have even known about it !
Like I said I'm not that far away and i never even heard of it till i went back on facebook and saw it while searching for those freaks from the WBC. I have never seen anything in the news and i watch every morning. And yet again all they do is concentrate on Anonymous so nobody talks about the real problem in this town ..corruption and double standards . I think it's time for Abdalla to resign and privately go on a vendetta against Anonymous and for this town to get a new sheriff one who cares and is not the brother of the largest importer of cocaine in Jefferson County ... just saying

Shocking images have been found on a cellphone showing two more girls, facedown and partially naked on the floor of the same basement where the Ohio rape of a 16-year-old girl allegedly took place, it can be revealed today.

The photographs were stored on a cellphone belonging to a teammate and friend of the Steubenville case accused, Ma’lik Richmond and Trent Mays – and raise the chilling possibility of two more, as yet unknown, victims.


The images were not taken on the night under investigation and it is not clear whether their subjects were conscious or aware of being photographed.

The friend, a fellow wrestler and footballer, who cannot be named for legal reasons, was present on the night in August when the girl was allegedly raped by the two.

He provided eyewitness testimony at the probable cause hearing last October at which the rape charges were upheld.

MailOnline has seen the 300-page transcript of the hearing in which the full horror of that night in Steubenville is revealed.

The existence of these earlier photographs, retrieved by forensic analysts, emerged only under cross-examination and the witness repeatedly denied all knowledge of them in spite of their presence on his phone.

In a tense courtroom exchange Walter Madison, Richmond’s attorney questioned the witness: ‘There is a photograph here of a woman on the same carpet as the carpet in xxxx’s basement. Do you recall that photo on your phone?’

The witness replied ‘No sir.’ Asked about a second picture the witness claimed, 'I have never seen those pictures in my life.'

The pictures show two girls, both face down and in a state of undress on the carpet. They are strikingly similar to an image taken in August and produced as evidence at the hearing. It shows the 16-year-old at the centre of the current investigation stripped naked and lying face down, on that same basement floor, identifiable by its distinctive carpet.

Her arms are tucked underneath her and, according to eyewitness accounts, she was silent, motionless and unconscious as the accused carried out sexual acts on her and some of those present recorded it on their cellphones.

Two of the three teammates who gave testimony in the probable cause hearing admitted to having taken photographs and in one instant filming the alleged assaults. Both deleted the evidence from their cellphones before police seized them.

In all police seized fifteen cell-phones and two iPods over a period of several days.

According to Judge Thomas Lipps, the only reason neither of the youths who admitted recording events in this way are facing criminal charges is ‘because we cannot find the photos you took.’
“Do you understand how lucky you are?’ he added.

His comments and the discovery of these further pictures are sure to add fuel to the anger of protesters who took to the Steubenville streets in their thousands at a rally organized by hacking group Anonymous.
They voiced frustration that only two have been charged in this case and to claim that rapes have gone unreported for fear of retribution in a small town with a culture where footballers and their clique are deified and victims tarnished and blamed.

It is a case that has divided the economically deprived Ohio town and scandalized America.

In the hours after the alleged attack images were circulated among footballers who were present at the series of back-to-back High School parties that led to the alleged rape.

Boys who knew – even dated – the alleged victim tweeted and crowed with callous disregard for the fact that they were discussing an horrific ordeal suffered by the 16-year-old girl who goes to a religious school nearby.

One had ‘cheered and offered money’ to people to urinate on her as she lay in the street.

Among the most shocking elements was YouTube footage showing former Steubenville High student and baseball star, Michael Nodianos, laughing as he referred to her as ‘dead’ and ‘so raped.’
Nodianos also tweeted, ‘Song of the night is definitely, “Rape Me,” by Nirvana’ and ‘some people deserve to be peed on.’

Nodianos has since apologized for his words, saying he is ‘ashamed and embarrassed.’ Others who posted offensive tweets in response to a picture of the victim being carried by her arms and ankles have similarly retracted their words, seeking to dismiss them as merely ‘stupid.’ They can RETRACT their words till they are blue in the face but that You Tube has gone viral. You simply can't Fix Supid! grrrr

But the transcript seen by MailOnline chronicling the details of that night suggests something far more sinister and corrosive – a male gang mentality in which their teenage victim was, in the words of her attorney, ‘a toy to them that night.’ Wonder if the transcript w/be released.

The Big Red teammates and their friends and supporter were in a party mood that day.
Mays tweeted ‘Huge party!!! Banger!!!’ as they embarked on their night of revelry. They had just won a game and a group, including the accused, were eating at a friend’s house when, according to witness statements, they started trying to get a group together to party.

Jefferson County Sheriff Fred Abdalla claimed to MailOnline that the second girl had recanted her story, despite the investigation being ongoing

They texted the alleged victim and encouraged her to come before heading to the first of the night’s party houses.

Mays and Richmond left along with two players, who subsequently testified at the hearing, and the alleged victim. By then, she was, one witness said: ‘Very loud… Her friends tried to get her to stay with them but she said she wanted to come with us.’

None of those quizzed by police recalled seeing her drink after that first party though each recalled her appearing increasingly, and ultimately catastrophically, intoxicated.

When she was drinking earlier in the night she was drinking from a cup and no-one said they could see what she was drinking.

Too much time had elapsed between the alleged assault and its report for a toxicology test to be run to establish whether or not she had been drugged.

Two days had elapsed before the crime was reported and any investigation started. It might all have gone unrecorded had it not been for the fact that the alleged victim’s mother was sent an text containing an image of her daughter from that night.

Court papers disclose that the girl was allegedly sexually assaulted after she vomited and stumbled into a car with suspects Ma'lik Richmond, Trent Mays and two others

That shocking discovery and the postings on social network sites is what prompted the 16-year-old’s parents to take her to hospital and to the police.

By then she had showered, washing away any hope of physical evidence. She has no recollection of that night after leaving the first party.

By the time she had reached the second party, a five-minute car-ride away, she was ‘very drunk... she wasn’t fully capable of walking on her own. She was like stumbling as she was walking. Trent and Ma’lik helped her.’

She vomited in the street on leaving that party before getting into a car with Richmond, Mays and two other guys. The first alleged assault took place in the back of that car.

While Mays sat in the middle the alleged victim sat behind the driver. On the drive to the second house Mays allegedly digitally penetrated her and exposed her breasts. One of the witnesses admitted to filming it but subsequently deleted the footage.

‘She was kind of talking,’ he said. ‘But I couldn’t make out the words that she was saying.’ By the time the final house of the night was reached, ‘She wasn’t really saying anything. ‘

An image circulated of the 16-year-old slumped between two males, one holding her ankles, the other holding her wrists was posted on Instagram at 1.04am. In it she is clothed.

But by the time she was being carried into the final basement in a similar fashion according to one eye witness her shirt was off. She was sick one further time and, the transcript records: ‘Was sitting on the floor… then she fell to her side..’

The case has scandalized America and prompted huge protests in the small town

Another witness who arrived at the house shortly after described going down to the basement to find the alleged victim, ‘completely naked... laying on her stomach.’ He claims to have witnessed Richmond raping her while Mays apparently tried to wake her ‘by shrugging her shoulders.’ ‘But she didn’t respond.’ The witness’s reaction, like that of others around him, was to take pictures. Nobody intervened. Nobody sought to cover her or help her or take her home.

Quite how or when the alleged victim got home is not recorded and she has no memory of the night beyond the first party. An eye witness recalls seeing Mays asleep on the couch next to the unconscious girl in the early hours but by morning he was on the floor.

Mays and Richmond go to trial on 13 February. Ma'lik Richmond is charged with rape. Trent Mays is charged with rape and disseminating photographs of a nude minor.

The only reason there are not more of Steubenville’s revered Big Red athletes joining them in the dock is because they had the presence of mind, and the time, to hit ‘delete.’

Steubenville Begins Healing Process

For a once proud steel town, no matter where you go or where you look, the Steubenville rape case has gripped an entire nation. Now the question becomes how does the city heal?

"The fact that the city has responded through SteubenvilleFact.org with a positive message about this city, of our government, how our police department handled the investigation and our response is that we are doing everything possible. We don't condone the actions of the teenagers," says City Manager Cathy Davison.

Officials and some residents say Steubenville has been unfairly targeted with accusations of corruption. Others say they are only shining a spotlight on an alleged sexual assault by two Steubenville football players that has now turned into a national outrage. But the city is working to develop programs for residents to help heal and rebuild their image.

"Mayor Mucci and Councilwoman Angela Suggs have been meeting with mental health providers and agencies within our community that are going to put together resources to help our community heal," says Davison.

Jefferson Behavioral Health, Family Services, Jefferson Recovery and Prevention Board and other private providers are offering their services to residents who may be having a hard time with the negative attention.

Davison says that although this is a terrible thing that has happened to Steubenville, it has also taught everyone a lesson, such as how to have an open dialogue on how to treat people and respect, that sexual assault is a horrible and offensive action and how we need to educate our children and our youth about respect and proper use of social media.

Unfortunately, there is now a negative connotation placed on the city of Steubenville and people who have grown up there and moved away.

"It's sad because the people that say they're from Steubenville, they're proud of being from here and we should be proud of being from Steubenville and our community should not be judged on the actions of a few," says Davison.

The city is now looking to move forward and create a positive image and remind residents of the community that Steubenville really is.

"One of the things that's interesting on our unofficial logo, the tag line is "Where You Always Have a Home" and I truly believe that's the feeling in our community and maybe that's something we can use with pride in Steubenville because we truly always have a home here no matter if you move away and come back, it's always home," says Davison.

The Most Reverend Bishop Jeffrey M. Monforton of the Diocese of Steubenville released a statement Thursday regarding the Steubenville rape case. The statement reads:

"In recent months, the Steubenville community has attracted local and national interest in a context no community desires. However unwelcome, we cannot and should not ignore our attention to these events and those 
involved. As we approach the court date for the case of alleged rape, hurt, shame, and concern are abundant among all involved. Sides have been taken and emotions are visible for all to see. Our community is in need of justice and healing as best as can be determined by our civil
 means," Bishop Monforton said.

"Silence has proven an ineffective salve to ease the pain and suffering
of social or familial wounds. In these troubling days, self-reflection
 and prayer can be the most effective catalysts to guide our conduct
 and to nurture healing. As members of the human family, let us place
 ourselves in God's presence, requesting him to guide all involved in
 this case and the entire community of Steubenville through his mercy and
 his healing love. God will not abandon us and only wishes that we remember to turn to him in this and in all difficult times."

There will be a peaceful rally on Saturday at Noon in Jim Wood Park called "Stand Up for Youth."

CNN) -- A defense lawyer in a rape case that has roiled the town of Steubenville, Ohio, officially asked the court Friday for a change of venue.

Attorney Walter Madison, who represents accused 16-year-old Ma'lik Richmond -- one of two defendants in the case -- filed three motions in Juvenile Court.

In addition to relocating the trial, two other motions ask the court to postpone the February 13 trial, and to close the trial to the public.

A hearing is set for January 25, when defense lawyers and prosecutors are expected to argue the motions before Judge Tom LipMadison said no other motions were filed Friday.

The lawyer for co-defendant Trent Mays, 16, could not be reached for comment.

"We are reviewing the motions and we will respond in kind," Dan Tierney, spokesman for Ohio's Attorney General Mike DeWine told CNN.

Defense battles social media blizzard in Ohio rape case

On Sunday, Mays' lawyer, Adam Nemann, also said he planned to file at least two motions including a change of venue "given its publicity and what we perceive as threats to individuals, perhaps witnesses, and also defendants and even defense counsel."

Media attention and an explosion of online postings about the case are part of the reason, according to Nemann.

"We're concerned about safety issues at this point," he added.

On Sunday, Tierney would not discuss whether there are any alleged threats.

Opinion: Teach young men to treat women with respect

"The investigation is ongoing and it includes all aspects of the case including evidence put out in social media, Tierney told CNN.

Mays and Richmond are each charged with raping a 16-year-old girl during late-night partying and drinking last August, according to prosecutors.

CNN is not identifying the girl, who is a juvenile, in accordance with its policy not to release the names of alleged rape victims"She was unresponsive, not in a position of consent, and they knew about it, and let's be clear, they knew she was drunk," special prosecutor Marianne Hemmeter told a judge at probable cause hearing last October.

A judge from Cincinnati is hearing the case after a local judge recused himself to avoid an appearance of conflict of interest.

Police Chief William McCafferty says many people in the small eastern Ohio town know someone who may have a connection to the case.

Online outrage prompts city website

Often trials are granted a change of venue because of fear of a tainted jury pool. This trial is a bench trial, meaning the judge will determine the teens' fate.

But defense attorney Nemann said he has another reason to ask for the change. He plans to tell the judge his case may be hamstrung by hesitant witnesses."I'm concerned about whether or not the case should be tried in this area. Perhaps the fact that it is in the Steubenville area is going to prohibit certain people from wanting to come forward and testify," Nemann said.

Some potential witnesses who attended the parties where the alleged sexual assaults occurred are refusing to talk with his defense team, the lawyer said. He would not say how many witnesses.

The motions will be filed under seal, Nemann said.

Lawyers for both defendants have said their clients are not guilty of the charges.
"We deny the accusations completely. We deny the lack of consent. We deny that there was sexual activity. We deny that there was a rape. And we steadfastly maintain that," Nemann told CNN.

Steubenville has LONG been associated w/the mafia. They are trying to make this town look like Sunnybrook Farm. Their priorities are completely skewed. Seems to me the "powers that be" Sarcasm in that town are More concerned w/what the general population thinks of Stuebenville and their high school football team than they are these girls that are being raped and publicly ridiculed. umno

Ohio Rape Controversy Consumes Small Town

On the evening of August 11, 2012, authorities say high school students in the small town of Steubenville, Ohio, including many popular football players from the local high school, attended a house party where there was allegedly widespread underage drinking. “What started as an end-of-summer party for a group of teens wound up a national scandal,” Dr. Phil says.

According to witnesses, a 16-year-old girl, who was allegedly drunk, vomiting and barely able to walk, left the party with several males and was allegedly sexually assaulted by two of them while she was unconscious. It has been reported that the young woman learned of the evening's events through friends and social media, and days later, her parents went to authorities with a flash drive containing photos, videos and tweets implicating the accused.

Several days later, high school football players Trent Mayes and Ma’lik Richmond, both16, were arrested for sexual assault and kidnapping. The kidnapping charge was later dropped.

Dr. Phil says media reports of preferential treatment for the players took this story to another level.

On December 23, 2012, Internet hacker group Anonymous threatened to release information on the high school players allegedly involved in the incident unless a public apology was made to the alleged victim and her family by January 1. When the deadline passed without an apology, Anonymous posted an Instragam photo online of the alleged victim being carried by two males along with a 12-minute video showing one teen joking about the alleged assault. Anonymous also posted the names of other partygoers who were allegedly present and reportedly did not intervene. “Everyone who witnessed it is just as guilty as the people who did it,” Anonymous said via its YouTube channel.

The community of Steubenville erupted in protests and the school was put on lockdown because of threats. “Will life in Steubenville ever return to normal?” Dr. Phil asks.

Ma’lik Richmond’s attorney, Walter Madison, and crime blogger Alexandria Goddard, who once lived in Steubenville and now reports on national crime, join the show.

Dr. Phil asks how 40 to 50 teenagers were allegedly underage drinking. “Where the hell are the adults in this situation? Why isn’t there supervision? Why do they feel so safe that they can talk about this so openly?”

Jeno is a football player and friends with the accused. “Around Steubenville, being on the high school football team is celebrity status," he says. He maintains that he was not at the party that evening, but he does support his friends. His mother, Jill, says she worries Jeno is having nightmares and will face backlash for standing up for his friends.

“I had someone tweet me that the entire football team should kill ourselves,” Jeno says. “Another threat said all football players need to be lined up and shot in the head.”

Jill says she’s concerned about the safety of the children of Steubenville. “There is so much hate,” she says.

Walter explains why he didn’t want Ma’lik to appear on the show. And, does he think his client can get a fair trial in Steubenville? Plus, watch video referencing the alleged incident that even Walter calls “offensive.”

Robin Sax, a formal prosecutor specializing in sex crimes against children, worries that raping a drunk girl can make for the perfect crime. And, Dr. Phil shares his most serious concerns.

Jill fiercely defends her town and her son’s allegiance to his friends.

STEUBENVILLE, Ohio -- A judge planned to rule on whether the upcoming trial of two high school football players charged with raping a 16-year-old girl should be open to the public or closed at the request of the girl, the state attorney general and one defendant.

At issue are concerns about protecting the girl and worries raised by an attorney for defendant Ma'Lik Richmond that keeping the trial open could lead to potential witnesses on his behalf being intimidated.
News organizations including The Associated Press have argued that openness is the best way to ensure public confidence in the proceedings.

Judge Thomas Lipps, a special judge brought in from Hamilton County to oversee the trial, was set to hold a hearing Friday to take testimony from both sides, then decide. The judge has already rejected a request to try the two players separately.

The football players are accused of attacking the girl twice after an alcohol-fueled party in mid-August in Steubenville in far eastern Ohio. Three other students who witnessed the attack but weren't charged are expected to testify at next month's trial. The girl attends a different high school across the river in West Virginia.

The girl and her parents want the trial closed to keep evidence that a judge might rule inadmissible from becoming public, their attorney argued in a court filing Tuesday. That could include "harmful" and "legally non-relevant" evidence, said attorney Robert Fitzsimmons.

Keeping the hearing closed will also protect the girl, who has maintained her anonymity through the proceedings, Fitzsimmons said.

The AP generally doesn't identity people who say they are the victims of sexual assault.

Attorney General Mike DeWine, whose office is prosecuting the case, says it will be difficult enough for the girl to testify, let alone in a public hearing open to the media.

News organizations arguing to keep the hearing open say the case is already subject to speculation that it won't be fully investigated and prosecuted because it involves the city's popular football team. Keeping it open eliminates that speculation, according to arguments by the AP, ABC, CNN, CBS News, The New York Times and WEWS-TV.

The lawyer for Richmond wants the trial closed out of concern that intense publicity and social media commentary could lead to witness intimidation. The attorney, Walter Madison, cited threats he said were made by the hacker-activist group Anonymous to retaliate against people perceived as helping his client.
The other defendant has asked that the case be delayed and moved but not closed.

COLUMBUS, Ohio -- Two high school football players go on trial this coming week on charges of raping a nearly passed-out-drunk 16-year-old girl during a night of partying in Steubenville. Around the football-powerhouse city, some are demanding to know why at least three other teens aren't facing charges, too.

After the athletes' arrest last summer, one of the many rumors that swirled around town proved all too true: Three boys, two of them members of Steubenville High's celebrated Big Red team, saw something happening that night and didn't try to stop it.

Instead, two pulled out their cellphones and took video and a photo.

The allegations shocked and roiled the city of 18,000, but prosecutors brought no charges against the witnesses, fueling months of furious online accusations of a cover-up to protect the team – something law enforcement authorities have vehemently denied.

One blogger wrote a post was headlined: "Steubenville Big Red Rape Accusations: The Other Perpetrators."

"Anyone that they can show had firsthand knowledge and was partly in some way responsible for the event, the rape, they should be charged," said Jackie Hillyer, president of the Ohio chapter of the National Organization for Women. She is among those pressing, at a minimum, for charges of failure to report a crime, which is punishable by up to 30 days in jail and a $250 fine.

Longtime Steubenville resident Willa Wade said: "I feel personally that if they were there, they knew it had happened, they did not report it or stop it, then they ought to be brought up on the same charges as anybody else."

The Ohio attorney general's office, however, told the three witnesses in a letter last fall that while they may not have conducted themselves "in a responsible or appropriate manner," their behavior "did not rise to the level of criminal conduct," and they would not be charged. BS

Legal experts said it is clear prosecutors sorely need the witnesses' testimony to make their rape case because there is little physical evidence against the defendants and the girl may have been too intoxicated to remember much.

"This prosecutor more than anything else wants to get a conviction of the culprits and he does not want to jeopardize that single-minded goal," said Christo Lassiter, a University of Cincinnati criminal law professor. "That's the conservative approach. Above all else, get the main culprit. If you can get the other folks along the line, fine."

Ma'Lik Richmond, 16, and Trent Mays, 17, go on trial Wednesday in juvenile court in Steubenville. They are charged with digitally penetrating the girl, first in the back seat of a moving car after a mostly underage, alcohol-fueled party Aug. 11, and then in the basement of a house. Witnesses said the girl was so drunk she threw up at least twice and had trouble walking and speaking. She was also photographed being carried by the two young men.

If convicted, they could be held in a juvenile jail until they turn 21. They have denied any wrongdoing.

The Associated Press normally does not identify minors charged in juvenile court, but Mays and Richmond have been widely identified in news coverage, and their names have been used in open court.

They were charged 10 days after the party, after a flurry of social media postings about the alleged attack led the girl and her family to go to police.

The scandal brought a barrage of accusations and insinuations, mostly online, with some townspeople supporting the defendants and others complaining that the football team has unusual sway over the city. Ohio Attorney General Mike DeWine's office took over the case after the local prosecutor stepped down because her son is a football player at 700-student Steubenville High.

Big Red football is a big deal in Steubenville. The stadium, dubbed Death Valley, sits on a hill above town, and the team is a nine-time state champion, with back-to-back titles in 2005 and 2006. Man O' War, a red statue of a rearing stallion, shoots flames from its mouth each time a touchdown is scored.

Three students – Anthony Craig and football players Mark Cole and Evan Westlake – testified at a hearing in October, just days after receiving the letters assuring them they would not be prosecuted. Prosecutors said at the hearing that Cole and Craig would have been charged if they hadn't deleted the images on their cellphones.

At the same proceeding, Westlake was asked by a prosecutor why he didn't stop the alleged attack.

"I was stunned at what I saw," he said. "I just wanted – I wanted to get out of there and I _I – I didn't know what to do, I mean."

The defendants' lawyers also raised the possibility that the witnesses did not know what they were seeing that night. Under questioning, the teen witnesses said that the girl was able to tell some of the boys the password to her smartphone and that they never heard her say "no" or "stop."

"So, you don't consider it a sexual assault?" attorney Adam Nemann asked Cole.

"I feel it's not my place to make that decision on whether it was or wasn't," Cole responded. "I can just tell you what I witnessed."

"And if this was a sexual assault I'm sure you would have called and told someone, right?" Nemann said.

"I would assume, yes," Cole said.

On a blog run by former Steubenville resident Alexandria Goddard, some anonymous posters have demanded others at the party be charged, including football player Cody Saltsman. Saltsman sued Goddard for defamation, and the case was settled with Goddard saying there was no evidence Saltsman was involved in the alleged attack.

Then, in January, a YouTube video was posted featuring another student, Michael Nodianos, apparently cracking jokes about the alleged rape just hours after it occurred, while others in the background chimed in. NOW is demanding prosecutors charge Nodianos with failure to report a crime, but Nodianos' lawyer said the young man had no "firsthand knowledge of the facts."

COLUMBUS, Ohio — Attorneys for a high school football player facing rape accusations in Ohio are asking a judge to dismiss the case against him because they say the "unavailability of material witnesses" denies him his right to a fair trial.

A West Virginia judge last week rejected requests that three juveniles be called to testify at the eastern Ohio trial of two high school football players charged with raping a 16-year-old girl. The girl is from West Virginia.

The juveniles' testimony was expected to bolster the players' defense against the charges.

Attorneys representing defendant Trent Mays argue in a motion to dismiss the case that one of the witnesses was a friend of the girl's and can testify to the alleged victim's alcohol intake and relationship with Mays.

"Additionally, the witness will testify that she spoke to the alleged victim immediately following the alleged incident, and will provide information about the victim's words, conduct, and state of mind," Mays' attorneys wrote in their motion obtained Monday by The Associated Press.

Mays and Ma'Lik Richmond go on trial Wednesday in Jefferson County juvenile court in Steubenville on charges they attacked the girl after an alcohol-fueled party last August. Their attorneys have denied the charges.

Mays' attorneys Brian Duncan and Adam Lee Neeman argue that the multiple out-of-state witnesses are "essential to presenting a complete defense."

They say the witnesses have participated in videotaped or documented interviews with Steubenville police and have offered statements that would support their client's position that he did not rape the girl.

A second witness allegedly received a nude photograph of the girl from Mays, the attorneys wrote in their motion. Another witness saw Mays and the girl the following morning and "can provide essential information regarding the interaction between the Defendant and the alleged victim, the alleged victim's appearance, and statements made by the alleged victim," according to the motion.

Richmond's attorney did not immediately respond to a message Monday night seeking comment on the request for dismissal .

Bob Fitzsimmons, a lawyer for the girl's family, said, "The family wants this matter over so they can move on with their lives and their daughter's healing."

In an order last week, Hancock County Judge Ronald Wilson ruled that no legal case was cited from anywhere in the country to support the argument that the three West Virginia juveniles can be compelled to testify in Ohio.

Ohio and West Virginia law is different for a juvenile delinquency hearing compared to a criminal trial, Wilson said in the four-page ruling on Wednesday.

The request for the subpoenas came through Ohio Judge Thomas Lipps, after defense attorneys filed motions with him asking that the three witnesses appear at the trial.

Dozens of witnesses for both sides are expected to testify at the trial. Their testimony is considered crucial because the girl was severely intoxicated that night and appeared to be passed out at times, according to several witnesses. She is not expected to testify herself.

Wonder if this will be live streamed???

I think ALL of the people at that party that witnessed this despicable act and did NOTHING are guilty and should pay for what they didn't do...and these football players need to serve prison time.

STEUBENVILLE, Ohio — On the opening day of testimoy in the trial of two high school football stars accused of raping a 16-year-old girl, witnesses for the prosecution testified about the girl’s increasingly inebriated state at a series of parties on the night of the incident.

At one point during the night last August, the girl was sitting on the street with her shirt off next to her own vomit, said Patrick Pizzoferrato, a classmate and friend of the defendants, Trenton Mays, 17, and Ma’lik Richmond, 16.

“She was kind of just sitting there. I thought I heard her mumbling,” Mr. Pizzoferrato, 17, testified on Wednesday. She was so drunk that he joked, he said, about offering $3 to anyone who would urinate on her, adding that no one did. OMG!! WHY didn't this idiot cover her up and at least take her to the ER????

Mr. Mays and Mr. Richmond were members of Steubenville High School’s powerhouse Big Red football program, which for years has been a salve while the local economy has withered, and their trial has ripped through this town. They were charged days after photographs and social media postings involving the incident appeared online.

Another prosecution witness, Julia Lefever, 17, said that over a four-hour period earlier that night she and the girl had split about half a bottle of vodka — mixed with blue slushed-ice drinks they got at a convenience store — and then the girl had a beer before leaving after midnight with Mr. Mays for another gathering.

“It seemed like she got drunk extremely fast,” said Ms. Lefever, who testified that she had never seen her friend that intoxicated. “She was slurring her words and she would stumble when she walked.”

The swift-moving testimony underscored how much the case revolves around the prosecution’s argument that the girl was too drunk that night to consent to sexual relations with Mr. Mays and Mr. Richmond.

In an opening statement to Thomas Lipps, the juvenile court judge who is hearing the case without a jury, one of the prosecutors, Marianne Hemmeter, said that “the state doesn’t have to prove” that the girl was unconscious. Instead, she said, the case hinges on showing that the woman was so substantially impaired that she could not consent to sex and that the defendants exploited the knowledge of her impairment. She also said that later witnesses would testify that Mr. Mays penetrated her with his fingers, and at one point tried to have oral sex with her. Mr. Richmond is also accused of penetrating the girl with his fingers.

For its part, the defense team said there was no rape, and that anything that did happen was consensual. Most of the defense team’s cross-examinations sought to show that the girl, while under the influence of alcohol, was walking and talking and capable of making decisions that night. BS BS BS BS

“We don’t dispute that there was some level of intoxication,” said Adam Nemann, one of the defense lawyers, in an interview after the first day of testimony. “The question is, was she so intoxicated that she did not give consent?” He said the state’s case is “difficult to prove, especially when you have various stages of drinking, various times in which the alleged sexual conduct occurred which still hasn’t been pinned down yet.”

Though the most significant testimony expected is still to come, Mr. Pizzoferrato’s appearance added new detail to the prosecution’s case.

He said that late in the night — after the scene he described with the girl sitting in the street — he was shown a picture on a cellphone of the girl on her hands and knees while Mr. Mays was “standing beside her, off to the side a little bit,” and he was forcefully touching her buttocks.

“I thought he had had sex with her,” Mr. Pizzoferrato said. He also said that he did not see the girl’s face in the photo, did not know when it was taken, and did not see any sexual penetration.

Under questioning by a defense lawyer for Mr. Richmond, Walter Madison, Mr. Pizzoferrato said that the girl had said she was “fine” and did not need a ride back to an earlier party. But he also characterized her as “kind of” slurring her words and stumbling.

Asked whether she had been unconscious, Mr. Pizzoferrato replied: “I think she was a little bit while she was on the couch” at a later party she attended.

Ms. Hemmeter, in a one-question redirect examination, then asked Mr. Pizzoferrato whether the girl “was the drunkest person in the room?”

“Yes,” he replied.

The next morning, Ms. Lefever said, she was in the car with the girl, who she said “laid down in the back seat and started crying” and said she did not remember what happened. crying

Prosecutors displayed an enlarged version of the now-infamous picture of the girl being carried by her hands and feet. Another prosecution witness, Elayna Andres, a Steubenville High School student, testified that she was present when the picture was taken. She described the girl at that point as being conscious, but drunk enough that she could not keep her head up. At one point on Wednesday, Ms. Andres broke down in tears.

When he cross-examined Ms. Andres, Mr. Madison drew out testimony that the girl had refused Ms. Andres’s suggestion to go back to an earlier party where she had friends, and even pushed her hand away.

“Does that sound like a person who has no idea what’s going on?” Mr. Madison asked.

Testimony is expected to resume Thursday morning. If convicted, Mr. Mays and Mr. Richmond face confinement until they are 21 years old.

A blizzard of text messages sent and received by Steubenville, Ohio rape suspect and football player and his friends paint a harrowing and horrifying portrait of the night of the alleged gang rape. Yahoo! Sports reported that for more than two hours on Tuesday, forensic specialist JoAnn Gibb read selections from the thousands of text messages that were sent and received on the night of the incident and in its aftermath.

Two suspects, 17-year-old Trent Mays and 16-year-old Ma’lik Richmond are facing rape charges and are being tried in joint trials in Steubenville. Both boys are players on the town’s champion football team, a factor which has purportedly clouded the investigation and caused prosecutors to drag their feet rather than risk opprobrium by dragging two of the town’s young heroes before the court.

Nonetheless, the texts, pulled from the phones of 17 students, paint a damning portrait of Mays and his codefendant, as well as many of the town’s young people. The messages range from profane to disturbing, enraging to pathetically sad.

The sheer volume of texted information taken in as part of the investigation was like nothing Katie Hanna of the Ohio Alliance to End Sexual Assault had ever seen before, one of the largest cell phone culls in state history.

“It was an extraordinary level of evidence and detail,” said Hanna. “I’ve never heard of anything like it.”


On the August, 2012 night in question, Mays and Richardson allegedly took photos and video as they manually penetrated the dazed, unconscious girl and allowed other boys to urinate on her. The victim, a 16-year-old West Virginia girl attended a neighboring high school and was either very drunk or under the influence of drugs on the night of the assaults.

At 2:20 a.m., when a friend texted to ask Mays what he was doing, he replied, “We’re hitting it for real.”

Texts followed from other boys seeking lurid details. “Did you f**k her?” they asked.

Mays sent out images of the assault, including images taken in of him in a car inserting his fingers into the unconscious girl’s vagina.

“Hey buddy,” one student texted, “you want to send me that pic because you love me?”

Some of the boys called her “the dead girl” and opined that intercourse with her would not be pleasurable in her unconscious state.

“LOL,” Mays replied, “she couldn’t even move.”

The girl, he wrote, “was like a dead body.” He claimed he didn’t try to orally sodomize her because she “would have thrown up.”

Among the texts Gibb read to the court were subsequent messages from the victim, whose memories of the whole night were lost to whatever deadening substances were in her system at the time. Friends contacted her as images from the night of the alleged assaults began to circulate on the web and between the teenagers’ smart phones.

“If that is [semen] on you that is f\'ing crazy,” a friend texted her.

“I hate my life,” the victim wrote. “I don’t even know what the f**k happened to me.”

“OK, tell me right now what the f**k happened last night and don’t lie to me,” she wrote to Mays. “We need to talk about this right now.”

“Nothing happen [sic] last night,” Mays replied. “You f\'d last night and that’s it.”

In an email she sent Mays later, she wrote, “Why the f**k would you let that happen … seriously, you have no f\'ing respect … why wouldn’t you try to help me?”

The question could be applied to any of the teenagers who were aware of the crime as it happened. One boy, 16-year-old Michael Nodianos, made a video where he laughed about the rape, making jokes and saying of the victim, “She is so raped right now.”

It was that video, leaked by the hacker collective Anonymous, that drew attention to the Steubenville case worldwide.

The court also heard messages on Thursday that indicated that Mays believed that his football coach, Reno Saccoccia, was pulling strings locally to keep the incident and investigation under wraps.

Mays was concerned that the texts he was sending would incriminate him.

“(I)f they press charges, they are going to look at all my texts,” he wrote.

But then later, he said, “I got [football coach] Reno [Saccoccia] to take care of it … Like, he was joking about it, so I’m not worried.”

None of the text messages will carry the weight in the trial as actual witness testimony, which begins Friday.

Thursday’s testimony ended with 18-year-old Sean McGhee, who took the stand to testify that he had seen the victim earlier on the night in question, clearly heavily intoxicated, stumbling and slurring her words. When word reached him of what was transpiring in the late hours, he reacted with fury directed at Mays.

Borrowing a friend’s phone — his own was out of battery power — McGhee wrote, “This is Sean, you are dead wrong. I’m going to choke the hell out of you for that. You could go to jail for life for that. What the f**k. Sean McGhee.”

Mays and Richmond are being tried as juveniles. If convicted, the maximum term they can serve in prison will be until each of them is 21.

STEUBENVILLE, Ohio (CNN) -- Three teens testified Friday they saw two star Steubenville, Ohio, high school football players accused of rape engage in sexual contact with an allegedly drunk 16-year-old girl.

The testimony came during the third day of a trial that has gained national attention over its focus on text messages and cell-phone pictures and videos surrounding the alleged sexual abuse of the girl.

Trent Mays, 17, and Ma'lik Richmond, 16, are accused of raping the girl during a series of end-of-summer parties in August 2012.

One of the witnesses, a 17-year-old, told Judge Thomas Lipps that he used his cell phone to record Mays putting his fingers inside the girl's vagina during a drive from one party to another. The boy said he deleted the video the next morning when he realized it was wrong.

Defense lawyers tried to dismantle what prosecutors said was the central argument in the case -- whether the girl was too drunk to understand what was happening to her. The defense challenged whether all three witnesses were reconstructing events from memory or from the text messages and cell phone images.

According to prosecutors, Richmond and Mays each penetrated the victim's vagina with their fingers, an act that constitutes rape under Ohio law.

Mays also is accused of illegal use of a minor in nudity oriented material.

Lawyers for the accused teens say the two are innocent.

The teen witness, whom CNN is not identifying because of his age, was identified as a friend of Mays and Richmond as well as a Steubenville High School football player and wrestler.

The teen also told the court Mays later attempted to have the girl perform a sex act on him in the basement of a home, where they ended up after the initial alleged incident in the car.

"She didn't really respond to it," he said.

CNN is not naming the girl in line with its policy of not identifying the alleged victims of sexual assault. CNN also is not naming the minors who are testifying but is identifying Mays and Richmond, whose names have been used by court officials and their attorneys and in multiple media accounts.

A second witness, 18-year-old Evan Westlake, told the judge he saw Richmond digitally penetrate the girl in the basement of the home where they ended up after the parties.

On cross-examination, Richmond's attorney, Walter Madison, challenged whether Westlake's was trying to right a wrong through his testimony.

"I felt a lot of regret, difficult to face my family knowing they knew what I had done," Westlake testified.

A third witness, 18-year-old Anthony Craig, testified he saw Richmond digitally penetrate the girl in the basement.

"She wasn't moving. She wasn't talking. She wasn't participating," he told the court. Craig was identified in as a Steubenville High School wrestler and friend of Mays and Richmond.

The teen, who testified the alleged victim was also a friend, admitted to taking a cell phone picture of the girl when she was naked in the basement and then showing it later to friends. Asked why, he responded: "It was stupid."

The teens testified only after Lipps, who is presiding over the trial without a jury, granted them immunity from prosecution. All three initially attempted to invoke the Fifth Amendment against self-incrimination.

The testimony came a day after prosecutors presented text messages they said were between Mays and various people, and the alleged victim.

Prosecutors contend the texts between Mays and his friends and classmates on August 12 detail a night of heavy drinking and the sexual abuse of the girl.

Some of the messages were between Mays and the alleged victim.

In one message she asks what happened "last night."

"And don't lie about anything. I need to know the truth. People keep asking. Idk (I don't know) what to say," the message said, according to Joann Gibb, a computer forensic investigator with the Ohio Bureau of Criminal Investigation, who read the messages to the court on Thursday.

Mays responded that "nothing happened last night," but he told her in the message she performed a sex act on him, Gibb testified.

In some of the messages from Mays, according to Gibb, he writes that he had sex with the girl. In others, he says the girl performed a sex act on him.

One message asked Mays: " Did u do it?"

He responded, according to Gibb: "No, lol. She could barely move."

Still another graphic message from Mays to a friend appeared to detail his anger over being accused of rape.

"I'm pissed all I got was a hand job, though. I should have raped since everyone thinks I did," the message said, according to Gibb.

The defense questioned the validity of the messages, with Mays' attorney asking computer forensic expert Gibb whether she could be absolutely sure the messages were from his client.

"I can't put a person behind a cell phone," she said.

In earlier testimony, teens who attended some of the booze-soaked parties testified the girl
appeared to be drunk, stumbling and slurring words.

But on cross-examination some said she seemed to be able to walk and answer questions.

The trial, which is likely to stretch into the weekend, is moving quickly to accommodate the schedule of the judge. A verdict is expected by Sunday.
