Alexis Rasmussen Brutally Murdered~Eric Millerberg gets 6 years to Life for 1st Degree Felony Child Abuse Homicide,Wife Dea Millerberg Pleads Guilty to 3 Felony Charges.

“Late yesterday afternoon police were led to an undisclosed grave site in an isolated area of Morgan County by a confidential source,” North Ogden Police Chief Polo Afuvai told reporters at a brief news conference.

Afuvai said the body was taken to the medical examiner’s office for an autopsy to determine the identity and cause of death. Investigators are also processing evidence recovered from the scene to determine if the remains are those of

Rasmussen, described as an “endangered and missing juvenile” by Afuvai, was last seen while babysitting about a mile from her house on September 10. Her mother reported her missing after she did not return home the next day.

Police released few other details about the discovery or condition of the body Wednesday.
Rasmussen’s mother, Dawn Miera, told CNN affiliate KSL last week that her daughter has run away before, but never for very long and never without taking clothes or other items with her.
On September 10, Rasmussen went to the home of Eric and Dea Millerberg to babysit for their two children. KSL reported that surveillance video showed Rasmussen went to a Walgreens with Dea Millerberg around 10:20 pm that night.

At 11:30 pm, Miera texted her daughter and told her to just spend the night at the Millerbergs’ house if they were still out, but Rasmussen never responded to that text or several others before it. According to KSL, Rasmussen did exchange texts with a boy around 12:30 am on September 11, but the content of those messages is unknown.

There were several possible sightings of Rasmussen reported in the following weeks, but none were ever confirmed.

Eric and Dea Millerberg were arrested on unrelated drug charges earlier this month. Since their arrests, police have conducted several searches of their house, but detectives would not say whether they were connected to the drug investigation or the Rasmussen case. They would not comment on what they were looking for or what, if anything, they found, KSL reported.

Afuvai called Rasmussen’s disappearance “a very complex and difficult case” Wednesday. Police would not release the names of any possible suspects in the investigation.

I generally do not like the label "victim." But in this case, I insist it is fully appropriate.

No matter what else comes of the current investigation by North Ogden Police, Alexis Rasmussen must be remembered as the victim of a terrible crime.

Alexis was just 16.

She, like every other teenager, was just finding her way in life.

Had she hit some rough patches? Apparently, if you believe the sworn affidavits filed by investigators in court. And yes, this father of four read every sickening word of those affidavits.

Even so, the only thing I can say with any measure of confidence is that the mistakes of her life-cut-short were probably worse than some but not as bad as others.

Whatever she was going through in her personal life, she did not deserve for that life to be taken from her.

This much I declare with certainty: Alexis is the victim.

Her death and burial in a shallow, hidden grave is an outrage.

As a child, Alexis was entitled to believe the adults around her would look out for her. That is something we all agree to as members of this society. We hold that children are entitled to the protection of adults. And yes, at 16, Alexis was still two years shy of what the law considers, in most cases, the age of majority.

We also hold that adults are fully to blame for harm inflicted on a child, not the child.

NOT THE CHILD!

Two adults have been labeled by the Weber County District Attorney as persons of interest in the death of Alexis Rasmussen.

If those "persons of interest" disregarded the societal contract and lured her down dangerous and ultimately deadly paths, then they must be exposed and punished.

As for Alexis, I choose to remember her as a life incomplete... a life barely begun... a story stopped in the formative chapters, long before a happy ending could be written.

Alexis was a 16-year old girl who deserved so much better that what she got.

Details emerge from warrants in Alexis Rasmussen's death

Alexis Rasmussen — the 16-year-old teen whose body was found this month in Morgan County — was paid in drugs for baby-sitting by a North Ogden couple, the Standard-Examiner reported Tuesday.

Eric and Dea Millerberg have previously been named by prosecutors as "persons of interest" in the girl’s death.

According to search warrants obtained Tuesday by the Standard-Examiner, Dea Millerberg drove the girl to obtain drugs on Sept. 10, the night Rasmussen disappeared.

Dea Millerberg and Rasmussen met a friend of Rasmussen’s who sold the girl prescription narcotics for $100 and a small amount of marijuana, the Standard-Examiner reported.

Rasmussen’s body was found by police — acting on information from a confidential source — on Oct. 18 in Morgan County.

According to the search warrants filed in Ogden’s 2nd District Court — obtained just before they were sealed at the request of prosecutors — two people associated with Eric Millerberg said they were asked to help him get rid of something on Sept. 10 and told "to bring a car and don’t ask any questions," the Standard-Examiner reported.

One of the persons was quoted telling the police, "I can’t believe he killed a little girl."

Tammy Reed, the aunt of Alexis Rasmussen, on Tuesday told The Salt Lake Tribune that the new developments surrounding the case cast a new shadow over the tragedy and are "just sad" to her.

"We are going through a hard enough time as it is," Reed said.

"It sucks that it has to come out this way," she added. "Things are just going to get uglier and uglier."

Reed said there were many aspects of the case she was trying to protect her children from hearing, but "the whole drug thing surrounding this" makes it even harder to deal with.

At a fundraiser for Alexis’ family in Ogden on Tuesday night, about 200 people showed up to celebrate the teen’s life with memories and laughter.

Melissa Rowley, a close friend of Alexis’ parents, said the family is having a hard time. Some of the family members attended the fundraiser but not Alexis’ parents.

"Now that things are going to start coming out in the news it’s kind of scary to know about it," Rowley said, adding that her friends had no knowledge of information that was made public through the search warrants.

"I was floored. I didn’t know," she said.

Rowley said her friends would rather get the info from police before hearing it on the news so they have a chance to process it.

Rowley said everyone wants closure, but they don’t want the memory of Alexis tainted.

"She still a child. Her name doesn’t need to be dragged through the mud no matter what the outcome is," she said.

According to ABC 4 News, investigators found traces of human blood inside the Millerbergs’ home in a spot where the carpet and pad had been recently removed.

One of the warrants said that investigators tracked down a car that had been sold by Eric Millerberg through a website to a person in Utah County. The investigators later located the car and discovered that the carpet had been removed from the car’s trunk, according to ABC 4 News.

One police witness was in the same jail unit as Dea Millerberg — arrested in October on prescription fraud charges — when she obtained the information that she put in the form of a letter sent to investigators and received on Oct. 9, according to ABC 4 News.

Some of the witness statements include:

• "Dea knows everything that happened. The girl is buried somewhere in the state she’s not gone, but not alive."

• "It’s something she [Dea] can’t fix. Only her, her husband and one other person know about it."

ABC 4 News said the witness called Rasmussen’s death, "Drug-related, something to do with a case. Find the car you find an answer. She’s dead."

In statements collected by officers on Oct. 8, another witness told an investigator that an unidentified member of the same gang to which Eric Millerberg belongs, "... received a phone call from Eric "Rooster" Millerberg, who asked [him] to bring a car and not to ask any questions," according to ABC 4 News. Millerberg is an ex-con prosecutors have said is affiliated with the Silent Aryan Warriors — a white supremacist prison gang that originated in Utah.

The same witness said that the fellow gang member claimed to be, "... very nervous when she saw him after the incident with ‘Rooster.’ "

The witness also told investigators that the fellow gang member, "... told [the investigator] that [he] even went to an attorney and talked to him about what ‘Rooster’ had told him."

Eric Millerberg was in and out of prison between 1997 and 2006 for convictions that include burglary, discharge of a firearm and failure to stop at the command of police, according to Department of Corrections records. He is now jailed on a probation violation.

Rasmussen was baby-sitting the Millerbergs’ two young children on the night she disappeared.

An anonymous phone tip led investigators to a shallow grave near a highway in Morgan County on Oct. 18, where Rasmussen’s body was recovered and sent to the state medical examiner’s office.

A defense attorney for Dea Millerberg has said that prosecutors told him some sort of homicide charge would be filed within a month against the Millerbergs.

Prosecutors have said they are awaiting autopsy results, which are expected later this month.

On the night before she was reported missing, Alexis’ mother had given her permission to stay over at the Millerbergs’ home because it was late, police have said. The Millerbergs have claimed that between 11 p.m. and midnight, Alexis told them she was leaving to meet a friend at a nearby school, police said.

Alexis’ parents called police after she didn’t return home, saying that although she had previously run away from home she had always let her mother know she was safe.

LOS ANGELES - Utah parents who hired a neighborhood teen to watch over their child have been deemed "persons of interest" in the beautiful babysitter's mysterious death.

Alexis Rasmussen, 16, vanished Sept. 10 after babysitting the child of ex-con and alleged white supremacist Eric Millerberg and his wife Dea.

Her decomposing body was finally recovered Oct. 18 in a shallow grave off an interstate highway after a confidential source directed police to the location, a prosecutor said Tuesday.

A prosecutor said Tuesday there's enough evidence to file charges, but authorities are awaiting a full autopsy report, which could take weeks.

"I've been told by the county attorney that charges will be coming against both [Millerbergs]," defense lawyer Michael Bouwhuis, who was assigned to represent Dea Millerberg on unrelated prescription fraud charges, said Wednesday, according to The Salt Lake Tribune.

But while investigators appear to be getting closer to making an arrest, Rasmussen's parents are frustrated because they have yet to learn how their daughter died.

"It's every parent's worst nightmare to have a child disappear and not know the cause of death or if they suffered," the family's Mormon bishop, Ron Flamm, told the Daily News.

"The authorities, if they know, haven't released any information to the family, and it's very frustrating."

The Millerbergs told police that Rasmussen left their North Ogden house - about 40 miles north of Salt Lake City - before midnight on Sept. 10, saying she was going to meet a friend.

But there is no evidence that suggests Rasmussen's friends were involved in her death, Weber County Attorney Dee Smith said Tuesday, according to KSTU-TV.

"I think there is an obvious connection between where she was last seen and his [Millerberg's] residence; beyond that, I really don't want to comment on what evidence we have," Smith said.

Investigators believe the bubbly teen died from unnatural causes in a home on Sept. 11 and was then dumped near Interstate 84.

The movement of her body means prosecutors are considering filing a charge for desecration of a corpse, among other counts, if an arrest is made, Smith said.

Eric Millerberg, 36, was affiliated with the Silent Aryan Warriors - a white supremacist prison gang that originated in Utah, The Tribune reported.

He was back in court Tuesday for a probation violation hearing, and a judge found that he had possessed heroin and Oxycontin and failed to report to his probation officer, the paper reported.

The judge reinstated Millerberg's original sentence of up to five years in prison, court officials said.

Millerberg spoke during his court appearance, but didn't reference Rasmussen. He said he needed the drugs as painkillers because he has a metal plate and screws in his neck.

Dea Millerberg, 37, remains jailed after being charged Oct. 7 with two prescription fraud felonies. Her preliminary hearing is set for Wednesday, along with a press conference from the victim's family.

OGDEN — A North Ogden woman who has been called a "person of interest" in the death of Alexis Rasmussen is facing new criminal charges.

Dea Millerberg, 38, was charged Tuesday with one count of endangerment of a child or a vulnerable adult, a third-degree felony, in 2nd District Court. There was no probable cause statement attached to the single charge explaining the alleged crime. The charge alleges that on Oct. 4, Millerberg "did knowingly or intentionally cause or permit a child or a vulnerable adult to be exposed to, inhale, ingest or have contact with a controlled substance, chemical substance, or drug paraphernalia."

There is no mention in the charges who the child or vulnerable adult may have been.

Millerberg is also facing two counts of falsely obtaining or dispensing of a prescription, both third-degree felonies, in connection with incidents in May and July of this year. Her husband, Eric Millerberg, was sentenced to zero to five years in prison on Oct. 25 for a drug-related probation violation. (ZERO to 5?? WTH??)

The couple has been identified as persons of interest in the death of 16-year-old Alexis Rasmussen. Rasmussen was last seen the night of Sept. 10, when she was babysitting the couple's two young daughters. Her body was found on Oct. 18 in Morgan County.

According to search warrants that were served on the Millerberg home, Rasmussen's friends said the teen was often given drugs in exchange for babysitting services. The warrant states that the couple was known to give various drugs to teenagers.

On the night Alexis went missing, Eric Millerberg allegedly asked one friend to "bring a car and don't ask any questions," the search warrant states.

One friend Eric Millerberg had asked to help apparently later talked to an attorney. That friend commented to the attorney, "I can't believe he killed a little girl. I'm not getting involved with that," the search warrant states.

Eric and Dea Millerberg have not been charged in connection with Alexis' disappearance and death.

OGDEN, Utah (ABC 4 News) - A person of interest in the death of Alexis Rasmussen was in court on Wednesday to appear on charges not related to the case.

Dea Millerberg's defense attorney says the charges are so new, he needs more time to work on the case.

A judge agreed and ordered that her drug and endangerment cases be continued until November 30.

Prosecutors say Dea Millerberg endangered one her own children by exposing them to drugs.

Dea's defense attorney Michael Bowhuis told ABC 4 News, "Based on hair follicle test done on one of the children, they got results back showing children had been exposed to drugs."

Bowhuis also addressed the potential charges related to Alexis Rasmussen's disappearance and death.

He believes charges are coming, but prosecutors are waiting for an autopsy report.

As for Dea's involvement in Rasmussen's death, Bowhuis says Dea continues to claim no responsibility.

Rasmussen was last seen while babysitting Dea and Eric Millerberg's children on Sept 10. Her body was found more than a month later in Morgan County. Eric and Dea have been named 'persons of interest' in the case, while an affidavit obtained by ABC 4 News on November 1 show that witnesses implicated Eric in the death and disappearance of 17-year-old Alexis Rasmussen.

Ogden • Through her attorney, Dea Millerberg — a North Ogden woman previously named a person of interest in the death of 16-year-old Alexis Rasmussen — has denied causing the girl’s death.

"She denies causing the death of Alexis Rasmussen. That’s all I can say," defense attorney Michael Bouwhuis told news reporters Wednesday.

Millerberg had appeared in 2nd District Court Wednesday on a new charge of child endangerment, a third-degree felony.

Bouwhuis said the charge involves one of Millerberg’s children allegedly testing positive for exposure to drugs. The testing occurred as part of an investigation by the Division of Child and Family Services, he said.

Millerberg was previously charged with prescription fraud for alleged doctor shopping.

She will return to court Nov. 30 for a scheduling hearing on both cases. Meanwhile, she is being held at the Weber County jail in lieu of $15,000 bail.

Prosecutors, meanwhile, say they are awaiting autopsy results on Rasmussen before filing potential homicide charges against Millerberg, 38, and her husband, Eric Millerberg, 36, who both have been called "persons of interest" in the teen’s death.

Rasmussen was baby-sitting for the Millerbergs the night of Sept. 10, when she disappeared, North Ogden police have said.

After the girl’s disappearance, the Millerbergs were each arrested on unrelated charges. Eric Millerberg was arrested Oct. 3 for violating his probation, and has been returned to prison. Dea Millerberg was charged Oct. 7 with prescription fraud.

On Oct. 18, the girl’s body was found near the Weber River, within two miles of Interstate 84, according to Weber County Attorney Dee Smith. Police have said they were directed to the location by a confidential source.

Smith has said that the girl died in a house on Sept. 11 or shortly thereafter — not from natural causes — and that her body was then transported to where it was buried near I-84 in Morgan County.

Dea Millerberg is scheduled for an appearance Wednesday to determine whether she will face a preliminary hearing.

Millerberg is charged with felony endangerment of a child or vulnerable adult and two counts of felony prescription fraud.

The 38-year-old woman and her husband, Eric Millerberg, were arrested last month on separate drug charges that grew out of an investigation into the September disappearance of their babysitter, 16-year-old Alexis Rasmussen.

The girl's body was discovered Oct. 19 in Morgan County.

The couple has been labeled "persons of interest" in her death, but no charges have been filed in that case.

A North Ogden woman named “a person of interest” in a teenage girl’s death has posted bail to get out of jail.

Weber County Jail staff verified Tuesday that Dea Millerberg is no longer at the facility.

Cash bail was posted for $5,000 on Dec. 6 in her case involving one count of third-felony degree of cause/permit child or vulnerable adult to be exposed to a controlled substance, according to court documents. A bail of $10,000 also was posted on the same date on a second case in which she is charged with two counts of third-degree felony, falsely obtaining/ dispensing a prescription, court documents show.

On Dec. 5, both defense and prosecuting attorneys agreed during a telephone conference that Millerberg was entitled to bail, court documents state.

The documents also show the bails were posted by Millerberg’s step-father.

She is scheduled for court Wednesday for a preliminary hearing before Ogden 2nd District Court Judge W. Brent West on the prescription charges.

Prosecutor have said both Millerberg, 38, and her husband, 36-year-old Eric Millerberg, may have been involved in the death of 16-year-old Alexis Rasmussen. The teen disappeared Sept. 10 while baby-sitting for the couple, but no charges have yet been filed in that case.

Rasmussen’s death is still being investigated and prosecutors are awaiting autopsy results from the state Medical Examiner’s Office, as well as test results of evidence at the State Crime Lab.

Rasmussen’s body was found Oct. 18 buried in a shallow grave near the Weber River in Morgan County.

OGDEN — The Weber County attorney said Wednesday he is "getting very close to making some decisions" related to the death of 16-year-old Alexis Rasmussen.

Dee Smith made the comment following a hearing for Dea Millerberg, 38, who has been named a person of interest in Rasmussen's death and is currently facing unrelated drug charges.

"This is a complicated case because of the time that elapsed from the death until the discovery of the body," Smith said "It's taken a little bit of time, more than would happen in a typical case."

Rasmussen was last seen the night of Sept. 10, when she was baby-sitting for Dea and Eric Millerberg. Rasmussen's body was found Oct. 18 in Morgan County.

Eric Millerberg is currently in prison for a drug-related probation violation. Dea Millerberg has been charged with two counts of falsely obtaining or dispensing a prescription, a third-degree felony, and endangerment of a child or a vulnerable adult, a third-degree felony.

A trial date was set Wednesday for May 24.

The charges are not related to Rasmussen's death or disappearance, but the Millerbergs are both being investigated in the North Ogden teenager's death.

Smith said the majority of the toxicology and autopsy reports have been received in Rasmussen's case. But an analysis was delayed in the wake of a shooting that left a police officer dead on Jan. 4.

He declined to comment on Rasmussen's cause of death.

Subpoenas issued for Eric Millerberg hearing

OGDEN -- Subpoenas have been issued for next month's preliminary hearing for Eric Millerberg in the death of Alexis Rasmussen.

Most prominent on the list of those scheduled to testify against him is his wife, Dea Millerberg.

Officials declined to comment on the witness list, which is included as part of the case file.

The hearing April 19 before 2nd District Judge Scott Hadley is a mini-trial held to ensure the case meets the court's minimum standard of evidence, known as probable cause, to advance Millerberg to trial. Probable cause is a lower standard than the "beyond a reasonable doubt" plateau needed at trial for conviction.

Millerberg is charged with child abuse homicide, obstruction of justice, unlawful sexual activity with a minor and abuse or desecration of a body, all alleged to have occurred Sept. 11. Rasmussen was reported missing that same weekend, her last known whereabouts baby-sitting for the Millerbergs.

The 16-year-old's body was recovered Oct. 18 near the Weber River in Morgan County.

Police subpoenaed to testify are North Ogden police detectives Mike Tribe and Bill Aeschliman and Weber County Attorney's Office investigator Shane Minor, who heads the countywide homicide task force that joined North Ogden in the investigation.

Bonnie Cain and daughter Brenna Cain, who live across the street from the Millerberg home in North Ogden, are also subpoenaed. Assistant State Medical Examiner Joe White completes the list.

Dea Millerberg is charged with abuse or desecration of a body related to the attempt to hide the remains of Rasmussen. She is scheduled for an April 25 status conference on the charge, as well as two unrelated cases, before Judge W. Brent West.

In filing the charges last month against the Millerbergs, prosecutors declined to release details such as what drug Rasmussen died from in the Millerbergs' North Ogden home or elaborate on the sexual offense. In search warrant affidavits, police say the Millerbergs had an ongoing relationship with Rasmussen that included partying and her selling prescription drugs to school friends, supervised by Dea Millerberg.

Eric Millerberg is currently in prison on unrelated drug probation violation charges filed the first week in October. Dea Millerberg also was arrested that week on prescription drug charges, for which she made bail and awaits trial.

Days after their arrest, a search warrant was executed at their home Oct. 9 as the search for the missing Rasmussen had become a homicide investigation.

Sometime after the Oct. 9 search of the home, Dea Millerberg was charged with child endangerment after hair-follicle tests done on the couple's infant daughter showed positive for methamphetamine exposure.

OGDEN — When investigators found Alexis Rasmussen's badly decomposed body, she was kneeling, face down.

But North Ogden police detective Mike Tribe said the recognizable evidence — the neon toenail polish and the ankle bracelets — led him to believe this body was that of the girl he had been searching for. Finally, it was her jaw that convinced him.

"After hours of looking at her photographs, I knew it was her teeth," he said. "It was her smile."

Tribe was the last witness to testify Monday before 2nd District Judge Scott Hadley ordered Eric Millerberg, 36, to stand trial on charges of child abuse homicide, a first-degree felony; obstruction of justice, a second-degree felony; and unlawful sexual activity with a minor and abuse or desecration of a human body, both third-degree felonies, in connection with the 16-year-old Alexis' death.

Eric Millerberg's wife, Dea Millerberg, testified against him in the preliminary hearing, detailing the couple's relationship with the girl who was once their baby sitter. Dea Millerberg said she and her husband met Rasmussen in the spring of 2011 through another 16-year-old girl in their neighborhood. Though Rasmussen baby-sat for their daughters a few times, the relationship quickly turned social.

We decided police were not going to be called. I dressed her, wrapped her in a blanket. I had a foot locker-type box (we put her in) and put her in the trunk of the car.

Dea Millerberg said the teenager would come over to drink and occasionally smoke marijuana, but eventually started asking for and smoking methamphetamine. In August 2011, Eric Millerberg injected Rasmussen with methemphetamine for the first time and the three of them engaged in various sexual acts, Dea Millerberg said.

The night of Sept. 10, 2011, started out with Dea Millerberg calling and asking Rasmussen to baby-sit, but instead they "hung out." She said Eric Millerberg prepared three syringes of heroin, one of which Dea Millerberg said he injected into Alexis.

She and the girl ran an errand to fill a prescription, before returning and shooting up methamphetamine. It was then that Dea Millerberg said her husband shot the drug into the teenager's neck. After Eric Millerberg and Alexis engaged in oral sex, the three shot up again and Rasmussen said she was "as high as she has ever been," according to Dea Millerberg.

Each time, she said, Eric Millerberg prepared the drugs and he was also the one to inject them into the teenager's arm and neck.

"(Alexis) became disoriented," Dea Millerberg said. "She didn't seem to know where she was. Her mood, her demeanor kind of changed. She seemed kind of shaky."

The three smoked cigarettes, before Alexis said she was cold and took a bath. She later got out and laid on the couple's bed. It was there they later found her dead.

"I walked in and she didn't look OK," Dea Millerberg testified. "She wasn't breathing. She had mucousy stuff coming out of the right side of her mouth."

Dea Millerberg attempted CPR to no avail. Then, "it was really a panic," she said. The couple talked about their two young children and Eric Millerberg's status on probation.

"We decided police were not going to be called," Dea Millerberg said, crying. "I dressed her, wrapped her in a blanket. I had a foot locker-type box (we put her in) and put her in the trunk of the car."

They "drove all over the place before deciding to leave the body up Weber Canyon in Morgan County."

"We opened the trunk, pulled her out and then (Eric) placed her behind some trees," she said.

They threw the box and Alexis' purse in a Dumpster on their way home. In a separate Dumpster, they threw the carpeting from the trunk "just in case there was any evidence on it."

Prosecutors say 16-year-old Alexis Rasmussen was having a "relationship" with Eric Millerberg that involved him providing her with drugs before she died.

The teenager's friend and neighbor to the Millerbergs said she and Alexis went over to the couple's home often to use drugs and said it was Eric Millerberg who taught them how to smoke methamphetamine.

Eric Millerberg told a member of his gang whom he met in jail that he was a "watcher of the flock" and that he would administer drugs to teenagers that came to him "so they wouldn't go elsewhere and try it on their own," North Ogden police detective Bill Aeschlimann testified, reading from a statement prepared by the jailmate, Casey Peterson.

The man told police that Eric Millerberg talked about giving drugs to Rasmussen and the sexual acts between the teenager, his wife and himself. He also told Peterson that the girl had died at his home and that he couldn't revive her.

"I was paranoid and I did not want to be involved," Peterson said in the statement. "I have a 16-year-old daughter."

But it was Eric Smith, another friend of Eric Millerberg's, who led police to the teenager's body. He said Eric Millerberg called him late on Sept. 12 and asked for help. The pair drove up Weber Canyon to Morgan County and found Rasmussen's body. They attempted to dig a hole in which to bury the body, but the ground was too hard.

Instead, Smith held the flashlight as Eric Millerberg moved Alexis' body further from the dirt roadway. Later, police came to Smith and told him his name had been mentioned in connection with Alexis' disappearance. The man initially denied knowing anything, but eventually told the truth.

"I wanted the family to have closure," he said. "Then again, they came at me and said they knew about my involvement in it and that they'd give me immunity if I helped them."

Dr. Joseph White, assistant Utah medical examiner, said the teenager's body was badly decomposed when he examined her Oct. 19, 2011 — nearly five weeks after her death. Still, he was able to identify her through dental records and take samples from her muscle and insect larvae found in her body.

He determined there was both morphine, most likely from the use of heroin, and methamphetamine in her system. Her cause and manner of death were undetermined.

"The circumstances of the death and discovery of the body are suspicious," he wrote in a report, before clarifying in court, "(That statement) was made to indicate that it seemed highly unlikely this was a natural or accidental death."

Prosecutors have called Dea Millerberg's involvement "minimal" compared to her husband's role. She has pleaded not guilty to one count of abuse or desecration of a human body, a third-degree felony.

She filed for divorce from her husband on Feb. 9. Eric Millerberg is currently in prison on a separate drug-related probation violation. He entered pleas of not guilty to each of the four counts immediately after he was bound over for trial.

His next hearing has been set for May 15.

Defense attorney Randall Marshall said he does not think the state will offer any deal that does not require Millerberg to plead guilty to the homicide charge. Most likely, he thinks it will go to trial.

"Her death is a tragedy, clearly, but that doesn't mean Eric is guilty of anything," he said.

In court, Marshall questioned whether Eric Millerberg could be charged with child abuse homicide under the statute. Weber County Attorney Dee Smith countered that any adult who causes a substantial risk of death, impairs a child's health or causes a child to stop breathing can be charged under the statute.

"As you look at the facts of this case, we have an adult who injects a child with heroin and methamphetamine," Dee Smith said. "(Dr. White) said the injection alone would cause a risk of death. Adults have a responsibility to provide appropriate care to children."

OGDEN — Defense attorneys for a man charged with killing a 16-year-old North Ogden teenager are looking to impeach the man's wife in advance of his trial.

Eric Millerberg, 36, is facing child abuse homicide and other charges in the death of Alexis Rasmussen. His wife, Dea Millerberg, is facing a charge of abuse or desecration of a human body.

Dea Millerberg, 39, was a crucial witness at a preliminary hearing last month, testifying that it was Eric Millerberg who injected heroin and methamphetamine into Alexis' veins the night she died. But Eric Millerberg's attorney, Randall Marshall, doesn't believe the woman is a credible witness.

"We need to do some research on Dea Millerberg's background," Marshall said Tuesday. "She's their key witness and she's impeachable. "She has motive to lie."

Prosecutors have called Dea Millerberg's involvement "minimal" compared to her husband's role. She filed on Feb. 9 for divorce from her husband.

Marshall also said he wants an expert to review the toxicology reports and take a closer look at Alexis' cause of death, which was classified as "undetermined" by the state medical examiner.

Dea Millerberg testified that the couple met Alexis through a girl in their neighborhood and used her as a babysitter for their two children. Eventually, though, she said the relationship turned social and the teenager would often come over to smoke and drink.

According to Dea Millerberg, Alexis began asking for methamphetamine and Eric Millerberg injected the teenager. The night of Sept. 10, the couple asked Alexis over to baby-sit, but instead they "hung out" and used heroin and methamphetamine.

The girl later became unresponsive and died. The couple took her to a remote area in Morgan County, where her body was found Oct. 18.

Eric Millerberg is currently in prison. He was sentenced to zero to five years for a separate drug- related probation violation in October.

Marshall said prosecutors have made offers in terms of a plea agreement, but they are "not offers we think are acceptable." Currently, the case is headed for trial.

In addition to first-degree felony child abuse homicide, Eric Millerberg is also charged with obstruction of justice, a second-degree felony; and unlawful sexual activity with a minor and abuse or desecration of a human body, both third-degree felonies.

Dea Millerberg also faces criminal charges from unrelated cases, including two counts of falsely obtaining or dispensing of a prescription, a third-degree felony, and endangerment of a child or a vulnerable adult, a third-degree felony.

OGDEN — Eric Millerberg’s attorney says the public has yet to hear the whole story of Alexis Rasmussen’s death.

“I am eager for the public to understand that everything Dea said on the stand isn’t necessarily true,” public defender Randall Marshall said in an interview after Eric Millerberg’s status conference Tuesday.

Marshall was referring to Dea Millerberg’s immunized testimony last month laying the blame for the death of 16-year-old Rasmussen on husband Eric Millerberg.

Eric Millerberg is charged with homicide in the Sept. 11 death of Rasmussen, the couple’s baby sitter who police say joined their drug-abusing lifestyle.

At Eric Millerberg’s April 9 preliminary hearing, Dea Millerberg testified that Eric injected the fatal doses of methamphetamine and heroin into Rasmussen.

Dea Millerberg is only charged in the hiding of Rasmussen’s body, found Oct. 18 in Morgan County.

“The court, the public, has only heard one side of the story, and it’s from Dea, and she has motive to lie,” Marshall said.

He declined to comment further on where she strayed from the truth, saying the rest of the story would come out at trial.

But Tuesday’s hearing before 2nd District Judge Scott Hadley was continued to June 26 without the setting of a trial date.

Marshall has said previously prosecutors have offered a plea bargain in the case, but it doesn’t include dropping the first-degree felony homicide charge — which Marshall reiterated after Tuesday’s hearing that his client refuses to plead guilty to.

Marshall said he’s still preparing for trial, but he’s not ready to set a date.

Eric Millerberg is currently in prison for probation violations from an unrelated drug bust.

Dea Millerberg is out on bail, awaiting trial on her unrelated drug bust from October. Trial is set for May 24-25, with a May 23 pretrial conference before 2nd District Judge W. Brent West.

Her charge of desecration of a corpse stemming from Rasmussen’s death is “trailing” the drug case, meaning it will be addressed after the drug trial.

Also trailing is a child endangerment charge filed after her October arrest. It stems from hair follicle testing of her youngest child, then a year old, which came back positive for methamphetamine.

Earlier this year, Dea Millerberg filed for divorce.

Eric Millerberg is contesting the terms of the divorce regarding custody and visitation of their two young daughters, according to court records.

The divorce is set for a status conference June 12 before 2nd District Judge Ernie Jones.

Ogden » Prosecutors have not yet offered a plea deal to Dea Millerberg, despite the testimony she provided against her husband last month.

Weber County Attorney Dee Smith on Wednesday said Millerberg — who along with her husband, Eric Millerberg, is facing charges in connection with the death of North Ogden teenager Alexis Rasmussen — would be expected to plead guilty to at least one felony if a deal is to be reached.

"We’ve said from day one she’ll either have to go to trial or plead guilty to some felonies," Smith told reporters after Millerberg made a brief appearance in 2nd District Court.

Judge W. Brent West set December trial dates for the 39-year-old Millerberg in the woman’s drug case. She also faces felony charges of desecration of a human corpse for allegedly moving Rasmussen’s body after the teen died from a drug overdose in the Millerbergs’ home last year.

Defense attorney Michael Bouwhuis said Millerberg’s trial was pushed back so that she could continue cooperating with the state in her husband’s case and receive further counseling and treatment as she fights to win back custody of her two young daughters.

Millerberg has been drug-free for eight months, her attorney said.

"A lot of people say, ‘I’m going to straighten up and do better,’ and they don’t," Bouwhuis said. "She’s kept her word."

At a preliminary hearing last month, Dea Millerberg testified at length against her husband — whom she is in the process of divorcing — detailing a history of drug use and sex involving the couple and 16-year-old Alexis Rasmussen.

Dea Millerberg said her husband injected a fatal mix of heroin and methamphetamine into the teen and that the couple, in a panic, then dumped the girl’s body in a remote part of Weber County last September.

Her defense attorney says he anticipates a plea deal at some point for the woman’s cooperation, adding that she is willing to testify against her husband if he goes to trial.

Eric Millerberg, 36, faces charges of child abuse homicide, a first-degree felony, as well as obstructing justice, desecrating a body and having unlawful sexual activity with a minor. He is scheduled to appear in court on June 26.

Dea Millerberg, whose charges include desecration in connection with the teen’s death, and drug possession, was given immunity that will keep prosecutors from using her testimony against her.

North Ogden man charged in teen’s death alters tattoo

Ogden • The North Ogden man charged with homicide in the drug overdose death of 16-year-old Alexis Rasmussen has altered a tattoo honoring the wife who’s now testifying against him.

Eric Millerberg has added to a neck tattoo that read "Dea." It now says "Death."

It’s unclear when the tattoo was changed, but it was visible during an April 9 preliminary hearing when Dea Millerberg testified against him. She told the court the couple spent a weekend with the teenage babysitter that involved drugs and sex.

Alexis Rasmussen’s body was found near the Weber River in Morgan County in October, about a month after her death.

Eric Millerberg’s public defender told the Standard-Examiner (http://bit.ly/KoCXsb) he had no comment about the tattoo.

Dea Millerberg’s lawyer says he couldn’t speculate about a motive for it.

Ogden » The attorney for a man charged with injecting a teenage babysitter with fatal amounts of heroin and methamphetamine says prosecutors do not have a "slam-dunk case" as the matter moves toward trial.

Eric Millerberg, 36, appeared in 2nd District Court, alongside his defense attorney Randall Marshall Tuesday morning, asking for county funds to pay for an expert witness.

Marshall said the witness would focus on the cause of 16-year-old Alexis Rasmussen’s death.

"There are a lot of questions about how the death occurred," the attorney said. "The science is important."

Equally important for the defense is rebutting the testimony of Millerberg’s estranged wife, Dea Millerberg. The woman has testified that she helped her husband move the teen’s dead body from their home to a remote part of Weber County in September 2011.

"She literally has every reason to lie," Marshall told reporters Tuesday. "We anticipate we will be able to rebut much of her testimony."

Dea Millerberg, 39, faces charges of desecration of a corpse and drug possession. Her attorney has said she is cooperating with prosecutors in an effort to regain custody of her two daughters.

According to her testimony during an April preliminary hearing, the couple had a history of drug use and sex involving Alexis.

Judge Scott Hadley will consider Marshall’s request for funds after a hearing later this year.

Weber County prosecutor Teral Tree said his office was prepared Tuesday to set a trial date.

"The state took months and months to put their case in chief together before they ever charged Mr. Millerberg," Marshall said after the hearing, adding that Millerberg is looking forward to his day in court.

OGDEN — Eric Millerberg’s defense attorney intends to hire an expert to challenge the official cause of death for the teenager Millerberg is accused of killing.

On Tuesday, public defender Randall Marshall told Judge Scott Hadley he would be petitioning the court to appoint an expert to evaluate the state medical examiner’s findings in the Sept. 11 death of 16-year-old Alexis Rasmussen.

The teen was supposedly baby-sitting for Millerberg and his wife, Dea, on Sept. 10, but she was actually continuing the drug-riddled relationship she’d fallen into with the Millerbergs, who were twice her age.

At Eric Millerberg’s April 9 preliminary hearing, Dea Millerberg testified to helping hide Rasmussen’s body after she died from an apparent overdose of meth and heroin injected by Eric Millerberg. She testified she witnessed the multiple injections that night.

“There are a lot of questions about how the death occurred,” Marshall told reporters after Tuesday’s hearing. “They (prosecutors) have several experts. We just want one.”

Marshall also said the case against his client “is not a slam-dunk case for the state. He’s anxious, when we’re prepared, to have his day in court.”

Marshall also called it ironic “that we have to get funding from the county, the same county that’s prosecuting” Millerberg.

The Weber County Attorney’s Office has a role in approving county authorizations for public defenders, such as Marshall’s request for an expert. To avoid any perceived conflict of interest, the office’s civil division, not criminal prosecutors, represents the county in court regarding such funding requests.

Marshall also has slighted the case as being dependent on Dea Millerberg, which he reiterated Tuesday to reporters, saying, “she has a motive to lie, to protect herself. We anticipate we will be able to rebut much of her testimony.”

Dea Millerberg testified with immunity at the April 9 hearing, but she is still charged for her part in hiding Rasmussen’s body.

She also has two pending drug-related cases, one for a charge of forging prescriptions for painkillers and the other for alleged child abuse for methamphetamine found in her infant child’s hair after follicle testing.

The official cause of death for Rasmussen was “undetermined,” according to testimony from a deputy state medical examiner on the autopsy of Rasmussen’s badly decomposed body.

But the high levels of meth found in the body allowed for the listing of a drug overdose as “highly plausible” as a cause of death.

Hadley set a July 10 deadline for Marshall to file his motion requesting expert witness fees, with oral arguments to be scheduled likely in September.

“We’re ready to set a trial date,” Deputy Weber County Attorney Teral Tree told the judge. “I want it on the record that we’re ready to go to trial today.”

“Well, we’re not,” Marshall said, “not until I have an expert and can anticipate what he’s going to give me.”

Rasmussen failed to return home Sept. 11 and was reported missing by her family. Her body was found Oct. 18 in a remote area of Morgan County.

Dea Millerberg’s next court appearance is set for December.

She is set for trial on the prescription drug case, with the charge related to Rasmussen’s death “trailing,” meaning it will be resolved after the drug trial.

Eric Millerberg was returned to the Utah State Prison, his fifth trip to Point of the Mountain, on a probation violation for a prior drug conviction before he was formally charged with Rasmussen’s death.

DRAPER — Dawn Miera is taking the tragedy of her daughter’s death and turning it into a way to help others.

Miera’s 16-year-old daughter, Alexis Rasmussen, vanished last September while babysitting for a North Ogden couple. Her body was found a month later alongside a Morgan County road. The couple she was babysitting for, Eric and Dea Millerberg, are facing criminal charges in connection with her drug overdose death.

In an interview with FOX 13 on Thursday, Miera said the past year has had “ups and downs.”

“There’s things that make me cry, things that make me smile,” she said. “I see her friends and they’re flourishing. And I see a lot of kids her age and that does me good. But it’s not over.”

Miera is preparing for a trial for Eric Millerberg. He’s charged with child abuse homicide, obstruction of justice, unlawful sexual activity with a minor and desecration of a human body.

“Hopefully it brings awareness,” Miera said of the trial. “I mean, there’s a lot of people that think their neighborhoods are safe or think that these things don’t go on. And they do. And I think that people need to be more aware.”

It’s that awareness about teen drug abuse that has prompted Miera to create something she calls “Lexi’s Legacy.”

“Obviously, I’ve found that I can’t change the past,” she said. “So we’re hoping that we can change the future. Maybe even just help one kid.”

Miera is joining with dozens of other charitable causes for a big fundraiser Saturday in Draper. She is raising money for a local rehabilitation center that would take people who can’t afford to get drug treatment.

“They’re actually raising money for their own cause,” said Amber Brosig with the group Children and the Earth. “So we’re able to help multiple causes.”

Other participants in the “Brainwave” and “Ride for Life” include missing West Valley City mom Susan Cox Powell’s family, who is raising money for a memorial, and local children who need money for medical treatments.

“I think it will be pretty cool,” said Tristan Chidester, a 10-year-old boy who is fighting bone cancer.

Miera said Alexis’ memory has already had an impact. Some of the girl’s friends who were making bad choices have turned their lives around, she said.

“She made a difference,” Miera said. “Maybe not in the way she’s here, but she made a difference.”

OGDEN — A six-day trial has been set for Eric Millerberg in the drug overdose death of the family’s baby sitter, Alexis Rasmussen.

At a scheduling hearing Tuesday in 2nd District Court, Judge Scott Hadley set the trial for July 22-Aug 1, 2013. It was the earliest date available on his calendar that could accommodate a six-day block of time and fit the schedules of the prosecution and the defense.

Millerberg’s public defender, Randall Marshall, told the judge he might be filing pretrial motions.

“There are still plenty of things we need to look at,” he said. Marshall declined to elaborate afterwards.

Marshall had asked for seven days for the trial after Deputy Weber County Attorney Chris Shaw said prosecutors only needed five days.

Millerberg appeared in court looking less like a white supremacist skinhead officials have described, having shaved his beard and grown his hair out since his last court appearance June 26.

He faces a number of charges in the girl’s death, including child abuse homicide. He is also charged with unlawful sexual contact with a minor for an alleged sexual relationship with the girl.

The body of 16-year-old Rasmussen was found hidden in a remote location in Morgan County a year ago, five weeks after prosecutors believe she died while partying with the Millerbergs in their North Ogden home.

Millerberg’s wife, Dea, has testified against him, saying he injected the teen with the drugs that killed her.

Dea Millerberg is charged for her alleged role in the hiding of the body. She is to be in court today for a status conference on the charges in Rasmussen’s death and two other unrelated drug cases. Trial is set for her in December on prescription drug charges.

Marshall has questioned Dea Millerberg’s account of events, for which she has been granted immunity, saying she has reason to lie. The case also features members of Eric Millerberg’s white supremacist gang cooperating with police, according to testimony, even leading them to Rasmussen’s body.

The weekend of Sept. 10-11, 2011, when police came looking for Alexis at the Millerberg’s home, her last known whereabouts a baby-sitting appointment there, the Millerbergs said she had left around midnight the night before to meet a friend at a nearby school. But the couple had already secreted the body by then, according to the allegations, at a site by the Weber River near Taggart in Morgan County.

OGDEN — Dea Millerberg’s trial was bumped out almost a year Wednesday in 2nd District Court.

She is implicated in the death of the family’s baby sitter, Alexis Rasmussen, along with her husband, Eric, who is charged with Rasmussen’s murder.

Eric Millerberg’s trial on Tuesday was set for six days beginning July 22, 2013. Unlike his estranged wife, he is directly charged with 16-year-old Rasmussen’s death in September last year, accused of injecting her with drugs that caused an overdose.

Dea Millerberg’s trial had been set for December, but officials rescheduled it Wednesday to follow her husband’s trial to ensure her continued cooperation in the case. Prosecutors generally hold off resolving charges on a cooperating witness to maintain their motivation to testify.

She has testified against her husband at his preliminary hearing earlier this year, saying she witnessed him inject the teen with meth and heroin.

She has been given immunity for her testimony, but after her hearing Wednesday before Judge W. Brent West, Weber County Attorney Dee Smith reiterated that she has been made no promises regarding resolution or sentencing on any of three cases she has pending.

Her trial now set for Aug. 26-27, 2013, is actually for one of two unrelated drug cases against her, charges of forging painkiller prescriptions.

Mike Bouwhuis, Dea Millerberg’s public defender, said his client is hopeful of keeping custody of her two young children and is still in deliberations in juvenile court with the state Department of Child and Family Services. She has one infant child with Eric Millerberg, whom she is divorcing, and an elementary school-age child and an older teenager from a previous marriage. In relation to Rasmussen’s death, she is only charged for her role in hiding the teen’s body, one count of third-degree felony abuse or desecration of a dead human body.

She is also charged with child endangerment for methamphetamine allegedly found in hair follicle testing of her infant daughter after police served a search warrant on her North Ogden home pursuant to Rasmussen’s death.

Those two cases now “trail,” in court parlance, the prescription drug case, meaning they will be resolved after the prescription drug trial.

Eric Millerberg’s numerous charges in the death include child abuse homicide and unlawful sexual contact with a minor for an alleged sexual relationship with the girl.

Rasmussen’s badly decomposed body was recovered Oct. 18 at a site by the Weber River near Taggart in Morgan County.

OGDEN — Dea Millerberg has dropped her divorce proceeding against husband Eric Millerberg, the latter facing trial in July for the 2011 overdose death of his baby sitter.

Both are charged in the death of 16-year-old Alexis Rasmussen, Dea Millerberg as an accomplice and Eric Millerberg charged with her homicide.

Her divorce was dismissed Wednesday “without prejudice,” meaning it could be re-filed, according to court records. She filed the divorce Feb. 9, 2012, a little more than a week after the couple was charged in Rasmussen’s death.

Dea has testified, with immunity, against her husband, saying she witnessed him inject Rasmussen with the fatal drug dosage when they partied with the young girl in their North Ogden home.

Prosecutors declined to comment on how or if the path of the divorce case might impact the criminal case.

“Dea plans to follow through with the divorce, but has been strapped for money and when a case lingers too long it gets dismissed,” her public defender on the criminal charges, Mike Bouwhuis said. “She plans to re-file it later.”

There is no indication in the court files on the divorce if either Millerberg ever hired a divorce attorney, although the judge advised it at one point when the two had disagreements on custody and visitation issues regarding their children. God Help these children!!!

Dea Millerberg is free on bail and going through juvenile court proceedings as the state Division of Child and Family Services retains custody of her children. Eric Millerberg has been in the state prison since October 2011 on parole violations tied to drug abuse.

Rasmussen was last seen the weekend of Sept. 10-11, 2011. When police came looking for her at the Millerberg’s home — her last known whereabouts being a baby-sitting appointment there — the Millerbergs said she had left around midnight the night before to meet a friend at a nearby school.

But the couple had already secreted the body by then, according to the allegations, at a site by the Weber River near Taggart in Morgan County.

Rasmussen’s body was found hidden in that remote location on Oct. 18, 2011, five weeks after prosecutors believe she died. Dea Millerberg’s next court appearance on the criminal charges against her is not scheduled until August, a month after her husband’s trial in Ogden 2nd District Court.

On Tuesday, Millerberg’s attorney, Randall Marshall, said new evidence, in the form of hair follicle tests in the possession of the Division of Child and Family Services, will not be available in time for a trial scheduled in July. WHY?????

Marshall said outside of court the tests were done on Millerberg but could also include other people.

Deputy Weber County Attorney Christopher Shaw said prosecutors agreed the trial should be delayed in order to give Millerberg’s attorneys time to sort through the new information and determine if any of it will be relevant at trial.

"I’m not happy about it," Shaw told 2nd District Judge Scott Hadley. "But I don’t see any other way to handle it. Mr. Millerberg deserves a fair trial."

Jury selection for Millerberg’s trial was set to begin on July 23. Instead, Hadley set a new trial date for Feb. 10.

Millerberg also is charged with felony counts of obstructing justice, desecrating a body and having unlawful sexual activity with a minor.

Millerberg’s wife, Dea Millerberg, 39, is charged with desecration of a human body related to the girl’s death.

Her case has been trailing her husband’s, and no trial date has been set.

It took a Utah jury just two hours to find a man guilty of killing a teenage baby sitter and dumping her body in the woods after prosecutors say he gave her a lethal dose of drugs during a night of sex that also included the man's wife.

Eric Millerberg, 38, faces up to life in prison after being convicted Friday of child abuse homicide, unlawful sexual contact with a minor, obstruction of justice and desecration of a dead body in the 2011 death of 16-year-old Alexis Rasmussen.

Sentencing was set for March 18.

During a three-day trial, prosecutors brought detectives, medical examiners, prisoners and Millerberg's wife, Dea Millerberg, to the stand to show that he recklessly injected Rasmussen with lethal doses of heroin and methamphetamine.

Prosecutors told jurors that Eric Millerberg and his wife then dumped Rasmussen's body in the woods of northern Utah and lied to police as the girl's mother desperately searched for her for more than a month.

Dea Millerberg, 40, is awaiting her own trial in April on charges of desecration of a body. She testified against her husband.

Family and friends of Rasmussen cried when the verdict was read. It was emotional for family and friends that dearly miss Rasmussen and have been waiting more than two years for this day, said Scott Rudd, the victim's uncle.

"We are extremely thrilled about it. It helps with a little closure," Rudd said. "But the fact of the matter is we still don't have Lexi."

Weber County Attorney Dee Smith said the case hit home not only with Rasmussen's family and friends, but police officers and prosecutors who worked the case since she went missing. The teenager was missing for 38 days until her body was found.

The verdict showed the jury had little doubt about Eric Millerberg's guilt, Smith said.

"It's not going to change what happened, it's not going to bring her back," Smith said. "But it's important for the family to know the person responsible is being held accountable and will spend a significant time in prison."

Eric Millerberg's attorney, Randall Marshall, told reporters his client was disappointed. Marshall said he expected guilty verdicts on some charges, "but I was a little disappointed in some of it."

Smith had started his closing argument Friday by showing the jury a picture of a smiling Rasmussen holding her little sister about one year before her death. Then, he showed a picture of her dead body covered by a muddy piece of foam in the woods of northern Utah.

Smith said the Millerbergs dumped her there, "discarded like a piece of trash," and then lied to police for more than a month about her whereabouts.

Smith called Eric Millerberg's actions with Rasmussen deplorable, saying he had supplied her with drugs and had sex on previous occasions as well, later bragging to fellow prisoners that he partied with teenage girls. Smith reminded the jury that laws exist to protect teens who are prone to experimenting and making mistakes when they aren't with their parents.

"Ordinary people don't inject little girls with heroin and methamphetamine," Smith said, later adding: "You don't have sex with 16-year-olds when you're a month away from turning 36. You don't look for dates with juniors in high school."

Marshall argued that the case against Eric Millerberg is based on lies by Dea Millerberg meant to protect herself. He reminded jurors that she struggled to remember details during cross-examination about the night of Rasmussen's death.

"Dea Millerberg told a great story, but it doesn't add up," Marshall said.

He said there's no evidence, other than Dea Millerberg's account, to prove Eric Millerberg injected Rasmussen with the drugs.

"How do we know Dea didn't shoot her up?" Marshall said.

He reminded jurors that the state medical examiner stopped short of declaring Rasmussen's cause of death was a drug overdose. Marshall also suggested to the jury that Dea Millerberg was responsible for the death and recruited her husband to help her dump the body.

Earlier Friday, an assistant medical examiner, Joseph White, testified that Rasmussen had seven times the lethal amount of methamphetamine in her system and high levels of morphine and amphetamines, and that likely caused her death.

"These are obviously significant results," White said. "Certainly, enough to explain the death."

But White said he couldn't rule out other possibilities such as strangulation, stabbing or blunt-force trauma because the girl's body was badly decomposed.

Rasmussen's body was found in a remote, wooded area in Weber County.

"It's a foul circumstance, and it seemed clear that somebody else was involved," White said, while later adding, "I felt it was most intellectually honest to list the cause and manner (of death) as undetermined."

Defense attorneys didn't bring any witnesses to the stand during trial, and Eric Millerberg also declined to testify.

He sat with his attorneys during the trial wearing glasses, and a suit and tie that largely hid his array of neck and arm tattoos. He occasionally spoke to his attorneys but remained largely stoic.

Family and friends of Rasmussen filled the front row of the gallery, carefully listening to testimony as they whispered to each other. Rasmussen's mother cried during the prosecution's closing arguments.

Millerberg and his wife, Dea, had a drug-fueled, salacious sexual relationship with Rasmussen that caused her death in September 2011, police have said.

A Utah judge handed down a maximum life sentence for a man who in 2011 drugged and dumped the body of his 16-year-old babysitter, as the girl’s mother told the court she cries every day over the memory of “one of the most amazing people in the world.”

A distraught Dawn Miera broke down as she remembered Alexis Rasmussen, who died after Eric Millerberg, 38, injected the girl with methamphetamine and heroin at their North Ogden home in September 2011.

Millerberg and his wife, Dea Millerberg, buried the girl’s body in a shallow grave after she overdosed.

Authorities found Alexis’s remains some five weeks later.

Dawn Miera broke down as she remembered her daughter, who died after being injected with a deadly mix of heroin and meth by an ex-con white supremacist.
"I will never be as happy as I was when she was more than just a memory," Miera told the court, The Deseret News reported. "Something as small as her empty chair at the dinner table can send me spiraling into sadness. We had to create a new normal because, even though one of the most amazing people in the world is gone, time goes on."

A heavily-tattooed Millerberg showed little emotion as his sentence was handed down. He’d been found guilty of several felonies, including child abuse homicide and abuse or desecration of a human body, during a trial last month.

The jury took less than 90 minutes to convict the man, the newspaper reported.

Millerberg will serve a minimum of six years locked up, to a maximum of life behind bars.

"This homicide it is not a typical one, if there is such a thing," Judge Scott Hadley said, according to the Deseret News. "Intentionally injecting a young lady with dangerous drugs multiple times … it's just beyond reckless."

The Millerbergs originally hired the pretty blond-haired teen to watch the couple’s two young daughters. But the babysitting gig quickly transformed into raunchy drug-fueled sex orgies between the parents and teen.

On the night she died, Alexis was supposed to watch the kids while the parents shopped for a birthday gift.

Instead, the trio ended up shooting heroin and meth and having sex.

Millerberg said her husband injected the teen in her arm and her neck, and sometime later, Alexis started “freaking out” and asked to take a hot bath because she was cold.

Hours later, they found the girl dead on their bed.

The couple stuffed the body in a trunk and hid it in a secluded spot in Morgan County.

Eric Millerberg, an ex-con white supremacist, apologized to the family but placed much of the blame on his wife, who testified against the man during his trial.

"I'm willing to shoulder the responsibility for the role I played and the things that I have done," he told the court, the Deseret News reported. "There's no way it's all mine."

Dea Millerberg is due in court March 26 to face a single charge of abuse or desecration of a human body.

She had testified her husband was the one who injected the girl with drugs and therefore, responsible for her overdose death.

Eric Millerberg plans to appeal to the conviction.

"(Alexis) was simply an immature victim that you took advantage of after you injected her with drugs," Judge Hadley told Millerberg, according to the newspaper. "Frankly, the conduct that bothers me the most was the conduct after, that things could have been done to make it less horrendous than it was, but they weren't."

Millerberg, of North Ogden, pleaded guilty in Ogden’s 2nd District Court to obtaining a prescription illegally, obstructing justice and abuse or desecration of a human body — all third-degree felonies.

The 41-year-old woman faces up to five years in prison on each count when she is sentenced on Aug. 21, though prosecutors said in court that they will recommend that the sentences run concurrent to one another.

The victim, Alexis Rasmussen, died of an apparent overdose the night of Sept. 10, 2011, after she was injected with methamphetamine and heroin by Eric Millerberg, Dea Millerberg’s husband.

Weber County Attorney Dee Smith said Wednesday that Dea Millerberg’s guilty pleas were a "fair resolution" to the case, since Millerberg testified against her husband at his February trial.

"She provided a lot of information," Smith said. "A lot of testimony that allowed us to solve this."

Eric Millerberg, 38, was sentenced to life in prison in March. He was convicted of child-abuse homicide, obstructing justice, desecrating a human body and having unlawful sexual activity with Alexis.

During Eric Millerberg’s three-day jury trial, Dea Millerberg took the stand and testified against her husband of nearly 10 years.

She recounted that on Sept. 10, 2011, she picked up Alexis to baby sit their kids, but instead she got high with the teen and her husband.

Through the night, Eric Millerberg injected Alexis with drugs three times, Dea Millerberg testified — once in the teen’s neck. The three also attempted to have sex together, the woman testified, but they were too high.

Shortly after her husband injected Alexis for the third time, Dea Millerberg testified that the teen began to complain of being cold and shaky. The teen took a bath, and afterward, the Millerbergs helped her into the couple’s bed, then the adults went outside to smoke.

When they returned, they found Alexis was not breathing. Dea Millerberg, who was at the time a licensed nurse, said she attempted CPR, but the girl never responded.

In a panic, the Millerbergs weighed their options. Ultimately, they decided to dump the teen in a remote part of Morgan County near the Taggart exit of Interstate 84.

Alexis was missing for 38 days before Eric Millerberg’s friend, Eric "Peanut" Smith, broke the case for police. He testified that he helped Eric Millerberg move the girl’s body on Sept. 12, 2011 — a day after the Millerbergs initially dumped it.

Smith led police back to the girl’s badly decomposed body in October 2011.

The girl was found with her legs folded against her in a fetal position, her lower half stuffed into a garbage bag.

Dea Millerberg was granted "use immunity" in her husband’s trial, meaning her testimony couldn’t be used against her.

Charges were never filed against Smith, who made a deal with police in exchange for leading them to the girl’s body.
