Can this freak GET any creepier? Man, every news release I read grosses me out more and more. Poor Susan. I would have scooped those boys up and ran away YEARS ago!! Why did she stay- did she love disgusting Josh that much? If so, Love is definately blind.
Now I am all skeeved out and have to try to eat breakfast. {{shivver}}

The voyeurism and pornography trial for the father-in-law of missing West Valley City mother Susan Powell has been pushed back to March 2012.

A Pierce County Superior Court judge in Tacoma, Wash. on Thursday granted a motion to continue the Nov. 16 trial date scheduled for 61-year-old Steve Powell. The judge set a new tentative trial date of March 20 and continued a so-called omnibus hearing in the case to Jan 12. At that hearing the judge can rule if certain evidence will be admissible at trial.

Prosecutor Grant Blinn said Thursday the trial date was pushed back to allow Powell’s recently appointed defense attorneys more time to prepare their case. Powell, who is being held in the Pierce County jail on a $200,000 cash or bond bail, did not appear in court, Blinn said.

Steve Powell is charged with 14 counts of voyeurism and one count of possessing an image of minors engaged in sexually explicit conduct. Blinn said during a court hearing last month that Powell took images over a 10-year span, with the court case focusing on voyeurism episodes from 2006 and 2007.

Powell is being represented by attorneys Mark T. Quigley and Travis R. Currie. Both are attorneys with the Pierce County Department of Assigned Counsel.

Sheriff’s deputies from Tacoma, Wash., arrested Powell on Sept. 22 after detectives from West Valley City served a search warrant on his Puyallup home, which he shared with his son, Josh; his grandsons; and his adult children Alina Powell and John Powell. Detectives were looking for potential evidence in the case of Susan Powell and found images of the woman taken surreptitiously by Steve Powell, prosecutors have alleged.

Steve Powell has said his daughter-in-law made sexual advances toward him — allegations disputed by Susan Powell’s friends and family. Powell made national television appearances where he stated that he had romantic feelings for his daughter-in-law and that he wished their relationship had been more intimate than it was.

Susan Powell had reportedly told her husband’s sister, Jennifer Graves of West Jordan, that Steve Powell made her uncomfortable and sent her inappropriate nude photos of men in a package containing photos of her favorite movie star. Graves has said her sister-in-law also said that Steve Powell made remarks about Susan Powell "sharing" herself with him and his son.

Susan Powell disappeared from her home in West Valley City on Dec. 6, 2009. Josh Powell has been the only publicly named person of interest in the case, although West Valley City police also have said there are other persons of interest in the case who have not been publicly named.

Steve Powell has declined jailhouse interview requests from The Salt Lake Tribune. He is currently in the county’s main jail and, with the exception of his attorney, is allowed to meet with visitors for only one hour a week.

Ed Troyer, a spokesman for the Pierce County Sheriff’s Office, said at the time Powell was charged that Pierce County investigators had reviewed only 5 to 10 percent of the computers, photographs and videos seized from Powell’s home on Aug. 25.

Troyer said on Oct. 10 that police are continuing to sift through evidence and that more charges against Powell are possible.

"We have not brought anything else forward to the prosecutor’s office yet. We are continuing to work on it," Troyer said.

Meanwhile, a custody dispute continues in Washington’s juvenile court system over Powell’s two grandsons, Charlie, 6, and Braden, 4. The boys were taken and placed in the custody of their maternal grandparents following Powell’s arrest. A judge allowed the boys to be placed with Susan Powell’s parents, Chuck and Judy Cox, while Josh Powell continues to be investigated to determine if he had any involvement in voyeurism and illicit pornography with his father.

In a series of declarations filed in that case recently, two of Steve Powell’s children wrote they were surprised their father was arrested and asked the judge determining the fate of Charlie and Braden to not punish Josh Powell for his father’s actions.

"The arrest comes as a surprise to all individuals I have talked to, especially those closest to my father," wrote Michael Powell, 29, who is a student living in Minneapolis, in court documents. "Everyone is of course saddened by it. The charges are not consistent with the way I know my father to behave."

Michael Powell wrote that he and his siblings do not intend to post bail for their father.

Josh Powell also wrote in a court declaration that he was unaware of his father’s illegal behavior and said he can provide a safe environment for his children.

Graves, who is estranged from her father and siblings, said last month that she was relieved her father was arrested so he could not victimize other people. She said Steve Powell has a pornography addiction and she and her husband made it a point to never leave their children alone with Steve Powell because of his history of questionable behavior.

She wrote in a declaration in support of having her nephews live with the Coxes that as a 12-year-old, she went on a work trip with Steve Powell and that he watched a television show involving naked women while she was in the room.

"Pornography has been an issue in this family for three decades. When my parents divorced, pornography was an issue during the proceeding," Graves wrote. "Joshua knew about the pornography then and his statements presently that he knows nothing of our father’s pornographic inclinations and material is untruthful."

A hearing in the custody case is scheduled for next month.

A Washington state custody hearing for the children of missing West Valley City mother Susan Powell has been postponed until January.

A Pierce County Superior Court judge on Tuesday was supposed to hear an update in the custody case involving the children, ages 6 and 4. A judge last month granted temporary custody of the boys to Susan Powell’s parents, Chuck and Judy Cox, after Washington child-protection workers removed them from the care of their father, Joshua Powell.

"The hearing has been canceled due to a legal agreement," said the Coxes in a statement posted on the Friends and Family of Susan Cox Powell Facebook page Monday. "The children remain in state custody most likely through January. The grandparents welcome additional time with the boys." Huh?? Aren't they living w/Susan's parents??

The Coxes have also asked the court to appoint a guardian ad litem, an attorney who would represent the interests of the boys alone in court proceedings. The Coxes stated in their request that the children were having some difficulties with the custody situation.

The children had been living with their father since their mother’s disappearance on Dec. 7, 2009.

Police have so far named only Josh Powell as a person of interest in his wife’s case, though they say others are being considered.

In January 2010 Josh Powell moved from Utah to the Puyallup, Wash., home of his father, Steve Powell.

But Steve Powell was arrested Sept. 22 on allegations of voyeurism and child pornography. Police have said they are investigating who else living in the home may have known of Steve Powell’s activities.

Josh Powell has said he knows nothing about his wife’s disappearance or his father’s alleged crimes. A judge granted him weekly three-hour visits with his sons.

I found one link for you. The boys were placed with the state but temporarily are living w/ the Cox's. It's confusing for us, I can't imagine how confusing it is for those poor boys.

Last week in Washington state, the children were placed in foster care after their grandfather's home — where they were living along with their father — was arrested on charges of voyeurism and possession of child pornography. Then just two days ago, they were reunited with their maternal grandparents, whom they had not seen for quite some time.

I dont know about other states but here children in foster homes are considered in states custody. I would assume the Cox home is considered foster care for the time being. Im sure that DCF or what ever its called in Washington are watching these kids pretty close just because of the high profile case. I would say chances are good WHEN Josh is deemed unfit custody will go to the Cox family.

Yes, sly,. that is how it's worded for my grandson- my son's son- who my daughter has custody of while he and his wife get sober and their shit together. Nate is considered foster care b/c he is in state custody (which will become court ordered as soon as we get a court date) My daughter has primary physical custody, they get weekly visitation, and my daughter is considered a foster care provider under the "kinship program". (Thats where family members step up and say they are willing to take the child).
I pray they NEVER give custody back to Josh. {{shudder}}.
I wonder what problems the boys are having with the custody issues? Are they crying to go back to that snivelling Josh? Bet he and his creepy father did a major mind-eff on those kids.

I would think the kids probley do miss Josh. Im sure these sweet little guys dont understand anything thats going on. To have thier mom taken away from them and then to be removed from Josh has got to be taking its toll on these poor babies. We as adults understand its for thier good im sure they are just confused. I think from seeing the Cox family in interviews they will do everything in the world to make things ok for these boys Im sure they are getting them extensive counciling.

I agree I hope Josh will be deemed unfit. Those kids will adjust with time. I am sure they are in counseling.

I would think that counseling would be "court ordered". I tend to like the laws in Utah (except for polygamy... 🇳🇴 ) so here's hoping they are.

Agree w/you yet again, Sly. The boys Will adjust AS LONG AS THEY STAY W/SUSAN'S PARENTS AND ARE NOT ALLOWED TO GO BACK TO JOSH!

Father of Susan Powell says boys are fine, but he wants more information about their father

PUYALLUP, Wash. — The father of missing Utahn Susan Cox Powell says his grandsons are doing well living with him, but he wants information about his son-in-law's psychological evaluation, financial situation and information about whether he's moving.

In September, a Washington judge gave temporary custody of Josh and Susan Powell's two sons, ages 4 and 6, to Chuck and Judy Cox, Susan Powell's parents. The decision came following the arrest of Josh Powell's father, Stephen Powell, on voyeurism and child porn charges and in light of the ongoing investigation into the disappearance of Susan Powell.

A follow-up court hearing originally scheduled for Tuesday has been continued until next year.

But in newly filed documents, Chuck Cox updated the court on how his grandsons are doing at his Puyallup, Wash., house.

Cox noted that the boys were seeing both a counselor and a therapist who was working with them "on a number of issues," according to court documents.

While one of the boys seemed to be complying with the therapist, the other has been "somewhat reluctant" to work with her, Cox said in his court filing. Although he is doing well in school, Cox said the boy was "having nightmares" and was "afraid of the dark."

Cox said the boys have been attending birthday parties, going to Chuck E Cheese, carving pumpkins, catching bugs, looking for frogs and playing with their cousins since they arrived in their grandparents' home.

He also said they were trying to abide by Josh Powell's request not to participate in certain activities with the boys or activities that he normally would have conducted with his sons or go places he would traditionally go with his boys such as Lowe's or Home Depot.

Cox said they have fulfilled Josh Powell's request not to take the boys to church or onto church property but wrote, "There are, however, a number of things we cannot comply with."

In court documents, Cox said his family continues to pray before each meal. The young boys are allowed to make their own choices on whether to participate. The Coxes also continue to hold a family night, when they talk to each other and play family games, he said.

"That is not going to change as part of our weekly lifestyle. I will not stay away from Lowe's or Home Depot," Cox said.

He said he would honor his son-in-law's request not to participate in workshop classes at those home improvement stores with the boys. Cox noted the restrictions placed on his family by Josh Powell "can be somewhat problematic," and used an example of the boys wanting to go swimming. He said he would be taking the boys to the YMCA to swim, whether or not that was something Josh Powell already did with them.

The court allows Josh Powell to visit his sons for three hours on Sundays. Cox said all visits have been held. But he noted that when the boys have returned from those visits, they were "obstinate and more openly defiant than normal."

Chuck Cox also filed a motion late last week asking for certain information about Josh Powell.

"It is my understanding that Mr. Powell has now signed an agreed dependency order. It is our hope that it is now the time for a guardian ad litem to be appointed pursuant to the third party custody action so that such an investigation can proceed," Cox said in court documents.

Cox also requested a copy of Josh Powell's psychological evaluation that he was ordered to undergo by the court and a financial declaration with supporting financial documentation.

He also noted in his motion that he believes Josh Powell "is moving or is in the process of moving" and that Josh Powell's mother had moved back to Washington from Utah and was living in the home of her jailed ex-husband where Josh Powell and some of his siblings live. Cox wants the court to order Josh Powell to disclose any change in address or contact information.

A hearing to decide custody of the Powell children is now scheduled for May.

Susan Powell has been missing since December 2009. Josh Powell has been named a person of interest in the case by West Valley police because they say he has not been cooperative. Powell has denied having any involvement with his wife's disappearance.

Did I miss something? Whats the deal with Josh not wanting the boys in Lowes or Home Depot? Is he afraid they will tell of something that he bought there that was used in Susans murder?

I think the reason why Josh didn't want the boys in Lowes, Home Depot and more is because it's something HE does w/ the boys and he didn't want the Coxes to do any of the 'special' things they did together. I'll look for a link.

IMO, Josh's visit's need to be supervised. I can see him "trashing" the Cox's and that is only messing w/those boys heads even more. They've been through MORE in their young years than most adults.

Josh should be ashamed of himself. He is ONLY thinking of HIM. He is a selfish bastard and I am being kind.

I'll find the link tomorrow, too tired tonight. I think I read somewhere up thread that the church Josh went/goes to is a take off of the Mormon church but I remember no details. I think Josh feels threatened by the Cox's taking the boys places that he and the boys frequented and enjoyed. MOO. Josh is a weinie.

Local law experts analyze the Powell custory battle

SALT LAKE CITY (ABC 4 News) - A Tacoma court commissioner says he won't decide on the custody of a missing Utah mom's two young boys until after Child Protective Services finishes its investigation.

Another hearing on Susan Powell's boys is scheduled for Wednesday.

A lawyer for her father argued Friday that the children should be removed from a home that their father, Josh Powell, shares with father, Steven Powell, who was arrested on voyeurism and child pornography charges.

A lawyer for the state attorney general confirmed that the boys had been placed in foster care.

KOMO-TV reports that at another court hearing Friday, a judge issued a permanent injunction forbidding Josh and Steven Powell from publishing any material from her journals and ordered them to return or destroy any journals already published.

Local attorneys Ivan LePendu and Tanya Lewis, along with law student Abby Dizon-Maughan discuss the custody battle for the children of Josh and Susan Powell.

When I first heard about Susan Powell, the Utah mother who went missing almost two years ago, the first thing I thought about were her two young boys. Her youngest son was only 2 years old when she first disappeared!

Losing your mother would be traumatic for any child, but I think it might be especially damaging for a toddler. The boys have been separated from their father, too, as of September. But the boys are living with their grandparents now, and the grandparents are doing something extremely important to help the boys cope: they're keeping regular routines.

I can't imagine how traumatizing the last two years have been for Susan Powell's kids. When my son was 2, his bond with us was probably the most important thing in his life. He was like a yo-yo, clinging to me one minute, and then running off to explore the world. Feeling safe and secure with his parents gave him the confidence to test his brand-new independence.

Take away that security and small children can feel vulnerable and unsafe. That's why I'm so glad Susan's parents have stepped in to care for them. They have established meal times, bed times, and activities, according to a report they filed as part of the custody battle they are fighting with the boys' father, Josh Powell. "We do have family night where we play games and talk to one another. That is not going to change as part of our weekly lifestyle," says the boys' grandfather, Chuck Cox. The boys are getting therapy, and that's important, too. But I think having a stable home life is just as important for helping these small boys cope with the confusion and stress swirling around them.

That's why I hope the boys' grandparents keep custody with the kids. Josh Powell lost custody of the boys in September when his father (with whom he lives) was arrested on voyeurism and child porn charges -- yeesh! If that's really what's been going on in that home, it's all the more reason to keep the boys with their maternal grandparents! But regardless, life seems safer and more supportive at the grandparents' house. My heart breaks for those two little boys, but I think those regular family dinners are going to help get them through these troubled times.

Do you think Susan Powell's kids are better off with their grandparents than with their father? Have you seen regular routines help small children cope with stress?

I saw how my kids at 2, 3 and 5 yrs old immediately changed when I left their abusive father and moved to a shelter, then to our own place, then to another state. The difference in their feeling SAFE was as profound in them as it was in me. We established regular routines and knowing what to expect, away from all of the CRAZY, did them a world of good.

So yes, I believe.!!!!

The father of missing Utahn Susan Cox Powell says his grandsons are doing well living with him, but he wants information about his son-in-law's psychological evaluation, financial situation and information about whether he's moving.

In September, a Washington judge gave temporary custody of Josh and Susan Powell's two sons, ages 4 and 6, to Chuck and Judy Cox, Susan Powell's parents. The decision came following the arrest of Josh Powell's father, Steven Powell, on voyeurism and child porn charges and in light of the ongoing investigation into the disappearance of Susan Powell.

A follow-up court hearing originally scheduled for Tuesday has been continued until next year.

But in newly filed documents, Chuck Cox updated the court on how his grandsons are doing at his Puyallup, Wash., house.

Cox noted that the boys were seeing both a counselor and a therapist who was working with them "on a number of issues," according to court documents.

While one of the boys seemed to be complying with the therapist, the other has been "somewhat reluctant" to work with her, Cox said in his court filing. Although he is doing well in school, Cox said the boy was "having nightmares" and was "afraid of the dark."

Chuck and Judy Cox agreed to take in the children of Josh and Susan Cox Powell after their grand father, Steven Powell, was arrested on charges of child pornography.
Cox said the boys have been attending birthday parties, going to Chuck E. Cheese, carving pumpkins, catching bugs, looking for frogs and playing with their cousins since they arrived in their grandparents' home.

He also said they were trying to abide by Josh Powell's request not to participate in certain activities with the boys or activities that he normally would have conducted with his sons or go places he would traditionally go with his boys such as Lowe's or Home Depot.

Cox said they have fulfilled Josh Powell's request not to take the boys to church or onto church property but wrote, "There are, however, a number of things we cannot comply with."

In court documents, Cox said his family continues to pray before each meal. The young boys are allowed to make their own choices on whether to participate. The Coxes also continue to hold a family night, when they talk to each other and play family games, he said.

"That is not going to change as part of our weekly lifestyle. I will not stay away from Lowe's or Home Depot," Cox said.

He said he would honor his son-in-law's request not to participate in workshop classes at those home improvement stores with the boys. Cox noted the restrictions placed on his family by Josh Powell "can be somewhat problematic," and used an example of the boys wanting to go swimming. He said he would be taking the boys to the YMCA to swim, whether or not that was something Josh Powell already did with them.

The court allows Josh Powell to visit his sons for three hours on Sundays. Cox said all visits have been held. But he noted that when the boys have returned from those visits, they were "obstinate and more openly defiant than normal."

Chuck Cox also filed a motion late last week asking for certain information about Josh Powell.

Josh Powell, who is being called a person of interest in the disappearance of Susan Cox Powell, is allowed to visit his children for three hours every Sunsday. Chuck Cox says that the boys are more "openly defiant" after visiting with their father.
"It is my understanding that Mr. Powell has now signed an agreed dependency order. It is our hope that it is now the time for a guardian ad litem to be appointed pursuant to the third party custody action so that such an investigation can proceed," Cox said in court documents.

Cox also requested a copy of Josh Powell's psychological evaluation that he was ordered to undergo by the court and a financial declaration with supporting financial documentation.

He also noted in his motion that he believes Josh Powell "is moving or is in the process of moving" and that Josh Powell's mother had moved back to Washington from Utah and was living in the home of her jailed ex-husband where Josh Powell and some of his siblings live. Cox wants the court to order Josh Powell to disclose any change in address or contact information.

A hearing to decide custody of the Powell children is now scheduled for May.

Susan Powell has been missing since December 2009. Josh Powell has been named a person of interest in the case by West Valley police because they say he has not been cooperative. Powell has denied having any involvement with his wife's disappearance.

As Utah authorities work to solve the mysterious disappearance of Susan Cox Powell, Washington officials are focused on another unresolved problem: what’s best for her two young sons.

For now, Charlie, 6, and Braden, 4, are living with Chuck and Judy Cox, their maternal grandparents, in Puyallup, Wash. But where they will live permanently depends on the outcome of two court cases.

A Jan. 19 review hearing is set in the child welfare action brought by the state’s Division of Children and Family Services. A judge will then review how the boys are doing; what progress their father, Josh Powell, has made in addressing safety concerns; and whether any new services are needed.

“Everything is on the table at those review hearings,” said John Long, senior counsel in the Washington Attorney General’s Office.

Filings in that case are confidential, but according to a document filed as part of the second court case — a custody petition filed by the Coxes — Josh Powell recently signed an agreed dependency order that eliminates the need for a trial. That order likely spells out alternative plans for the boys’ future, including what their father must do to get them back.

In their case, Cox asked the court in mid-November to appoint a guardian ad litem, who represents children’s interests in court proceedings, so a custody investigation may begin. He also asked that they be allowed to review Josh Powell’s psychological evaluation.

Pierce County Sheriff’s deputies removed the boys from the Puyallup, Wash., home they shared with their father, grandfather Steve Powell and other relatives on Sept. 22. That same day, Steve Powell was arrested on charges of voyeurism and possession of child pornography; he remains in jail.

After five days in a foster home, the state temporarily placed the boys with the Coxes. During a shelter hearing on Sept. 28, Judge Kathryn J. Nelson ordered that the children remain in state custody and with the Coxes, citing the allegations against Steve Powell and the ongoing investigation of their mother’s disappearance. To date, no charges have been filed against Josh Powell in either matter, and he has denied involvement in both his wife’s disappearance and his father’s activities.

During the September hearing, Josh Powell described himself as a “superior” parent who has worked hard to create a loving, stable home and keep his sons engaged in numerous activities. That claim was supported by affidavits from his mother, three siblings, family friends and a local pastor, who all described the boys as happy, well-adjusted and vibrant children despite missing their mother.

Since then, Joshua Powell has had three-hour weekly, supervised visits with his sons. In his recently filed affidavit, Chuck Cox said the boys return from those visits “obstinate and more openly defiant than normal.”

“We have simply tried to accommodate and quickly get a handle over the boys’ attitudes and tempers after visits,” Chuck Cox said in the affidavit.

He described the older boy as “somewhat depressed” and “somewhat reluctant” to work with a therapist who visits their home weekly. Cox also said the boy complained on one occasion that “we don’t do anything.” Since the boys moved into their home, Cox said they have engaged in such activities as “playing in the field, catching bugs, looking for frogs, going to see Reptile Man, playing with cousins, attending birthday parties” and visiting a local zoo.

Lisa Kelly, a University of Washington Law School professor and director of its Children and Youth Advocacy Clinic, said it is not unusual for children to have an adjustment after visits with a parent.

“It is just something that is disconcerting to children for any number of reasons,” said Kelly, from missing a parent to being upset at having to spend time with them.

Josh Powell claims sons’ grandparents turning them against him

Josh Powell has asked a judge to move his sons to a neutral caretaker, claiming in newly filed court documents that his missing wife’s parents are turning their two sons against him and have even encouraged the boys to call him "Josh" rather than "Daddy."

He also objected to medical and counseling information the Coxes shared in their court bid to get permanent custody of the boys, describing the move as an attempt to "weaponize my children" in ways that were harmful. Powell also says the release of the information is an invasion of their privacy.

In the court papers filed Monday in Washington, Powell represents himself. Powell is the husband of missing West Valley City woman Susan Powell and was reportedly the last person to see the mother of his two sons alive. He has also been the only person of interest police have named in her disappearance two years ago this week.

State authorities took custody of Charlie, 6, and Braden, 4, on Sept. 22, the same day Steve Powell, their grandfather, was arrested on charges of voyeurism and possession of child pornography. After five days in a foster home, the boys were moved to the Coxes’ home in Puyallup, Wash. A Pierce County judge approved the temporary placement on Sept. 28.

Powell said the Coxes continue to engage in a "very hostile media campaign" against him, have spread lies and are unable to keep their opinions about him to themselves.

"The Coxes are coaching my sons in ways that are clearly intended to destroy our loving relationships as a natural family unit," Powell wrote in Monday’s declaration. "...By living in the Cox house, the boys are exposed to the Coxes’ overwhelming attitude of hatred toward me and it is seriously traumatizing my children. There is considerable evidence that the Coxes make explicit comments to and around my sons reflecting their attitude."

Powell claims the Coxes are using his sons to pass messages to him or extract information, which is "very damaging to my sons emotionally."

He alleges the boys learned about a photo album that’s the subject of a lawsuit, and that one of his sons asked for it to be returned during a visit. He also claims he learned from them that the Coxes were trying to obtain his new address, so he told the boys never to show anyone where he lives, the court papers show.


"By being with the Coxes, my sons are caught in the middle of a very hostile war of words and emotions," he wrote.

Powell said his oldest son has started to have nightmares since being placed with the Coxes. Powell claims the nightmares are "obviously stress related."

He said his sons are increasingly acting out while in the Coxes’ care and are angry because they have to return to the Cox house when they’d rather come home with him.

"As their natural father, I am the most important person in my sons’ lives and they are acting out because they feel attacked as the Coxes make diligent efforts to destroy our bonds with one another," he wrote.

In the Sept. 28 hearing, the judge stayed the Coxes’ custody petition, saying the child welfare case initiated by the state would take precedence; all documents filed in the child welfare case are confidential.

But in mid-November, the Coxes asked the judge to take several steps to get their case moving, including appointing a guardian ad litem and sharing information from the child welfare case with them.

In a declaration filed in the Coxes case, Powell said the judge should reject all those requests and enforce the stay in that case.

"The Coxes have failed to show that I am an unfit parent and therefore have not even demonstrated the right to continue this action," Powell said. "To the contrary, CPS has found me worthy of reunification with my sons as soon as possible and they are increasing my visitation with my sons."

The Coxes, Powell said, are attempting to "derail this goal."

Husband of missing Utah mom Susan Cox Powell: In-laws turning sons against me

SALT LAKE CITY — The husband of missing Utah mom Susan Cox Powell says her parents are turning the couple’s children against him.

Josh Powell filed a court declaration this week in Pierce County, Wash., asking the 4- and 6-year-old boys to be moved to a neutral caretaker. He says Chuck and Judy Cox, who have custody, have an “irrational vendetta” against him that’s putting stress on the boys.

Susan Powell vanished in December 2009 at age 28. Josh Powell has been named a person of interest but denies involvement in his wife’s disappearance.

The boys were living with their father and grandfather before the grandfather was arrested on voyeurism and child pornography charges.

Cox attorney Anne Bremner tells the Deseret News the Coxes are providing a safe home for the boys.

Please don't call him Daddy or any variation thereof, any man can be a father, it takes someone special to be a "daddy". I prefer to think of him as a sperm donor, nothing more. Anyone who would put their children in the home of a sexual pervert cannot possibly love them. At least not the same kind of 'love' that we all know as 'love'. I suspect that FREAK Josh is a pervert like his father also. I hope Josh never again has any kind of contact w/ his kids, supervised or not. He can still poison their minds with a supervised visit. Aren't these two statements contradictory?

Josh Powell has asked a judge to move his sons to a neutral caretaker, claiming in newly filed court documents that his missing wife’s parents are turning their two sons against him

He said his sons are increasingly acting out while in the Coxes’ care and are angry because they have to return to the Cox house when they’d rather come home with him.

Which one is it, Joshie? Make up your mind!

He's such a liar he can't keep up with his own crap. I suspect statement #1 is true in a way, of course the Cox's aren't telling the boys what a wonderful man their father is, I am sure they aren't trashing him but also not going along with the same bullchit Josh has been feeding them.

And I doubt #2 is accurate, those boys feel love and security where they are now, why would they want to return to dysfunction junction??

You know the most ridiculous of all is his statement that Susan ran away with someone and is now AFRAID to come home. Really, Josh? She's afraid to stop all the speculation about if shes alive or dead, where she is, and afraid to see her own beloved boys? Doubt that. His lies are downright stupid. wish he would just shut up. If he ain't telling where he put her body, who cares what the hell he has to say anymore?

Months after arrest, Susan Powell's father-in-law still in jail

It appears the father-in-law of missing Puyallup mom Susan Powell has either run out of money, or friends.

Steven Powell, 61, has been in the Pierce County Jail since his arrest on voyeurism and child pornography charges on Sept. 23, 2011.

"He's being held on $200,000 bail," said Pierce County Prosecutor Mark Lindquist. "He'd have to convince a bail bondsman that he has collateral in the amount of $200,000."

But Powell, who had a pre-trial hearing Thursday, would have to post just a fraction of that amount to be released before his March 20 trial date.

He was arrested after police from West Valley City, Utah searched his Puyallup home and uncovered thousands of images and videos of children and women taken without their consent.

"They were actually looking for evidence in the ongoing homicide investigation regarding Susan Powell, but in the course of this search, they found thousands of videos, over 100 of which appear to have been shot by Steven Powell," Lindquist told KIRO Radio in September. "The photographer focuses on the women's buttocks, breasts."

The search came a short time after Powell had gone on national television to admit that he had a sexual relationship with his daughter-in-law before she disappeared.

"Susan was very sexual with me," Powell told ABC's Good Morning America. "We interacted in a lot of sexual ways because Susan enjoys doing that."

Susan Powell disappeared from her Utah home in Dec. 2009. Her husband, Josh Powell, has been a person of interest in the case. However, he denies involvement and believes Susan ran off with another man.

TACOMA, Wash. — The trial of Steven Powell on charges of voyeurism and possession of child pornography is expected to last a week and Powell is expected to fight the allegations.

On Thursday, a final court hearing was held in Tacoma before Powell's trial is scheduled to begin March 20.

Powell, the father of Josh Powell and father-in-law of Susan Cox Powell, the West Valley mother of two who has been missing for more than two years, was arrested in September and later charged in Pierce County Superior Court with 14 counts of voyeurism and one count of possession of child pornography.

Steven Powell is accused of using a telephoto lens to take pictures of his neighbors' young children without their knowledge while they were in a bathroom.

According to court documents filed during an omnibus hearing on Thursday, Steven Powell's defense attorneys indicated the general nature of their defense would be "general denial." Other possible answers available to defense attorneys, but not chosen, were "alibi," "consent," "insanity" and "diminished capacity."

A box on the court papers labeled, "Defense has received a plea offer from the state," was left unchecked.

The court papers also say Steven Powell has no known prior criminal convictions.

Attorneys are requesting a jury trial that is expected to last six to eight days. Powell has remained in the Pierce County Jail since his arrest.

Josh Powell, who is trying to win back custody of his two young boys after a court ordered them to be temporarily placed with Susan Powell's parents, Chuck and Judy Cox, recently filed a notice with the court indicating he had moved out of his father's house. Powell told the court he has a new primary address in Puyallup, Wash.

Sister-in-law: Josh Powell needs to ‘fess up' to what he did

PUYALLUP, Wash. — While Susan Cox Powell's parents are under a court mandated gag order and can't speak with the media, Susan's sister is not.

Denise Cox said Thursday she's glad her nephews are safe, and she can't wait until Josh Powell is charged for what she believes he did to her sister.

"We don't miss that chance to remind them of their mom, because they were 2 and 4 when she went missing and I don't want them to forget her," Denise said, describing the time she spends with Susan's two young sons.

Denise also wears a necklace with a wolf on it every day around her neck. It's a daily reminder that her little sister is still missing.

Susan's two young sons are currently in the care of the women's parents, Chuck and Judy Cox. Their father, Josh Powell, lost custody last year after his father, Steven Powell, whom he was living with, was arrested on charges of voyeurism and child porn.

Denise believes Josh was also involved. "I know he's not innocent in this," she said. "I know he knew all that."

Josh has been fighting to regain custody of his boys. A custody review hearing was scheduled for Thursday to see if he had met all of the judge's demands. But a massive storm crippled western Washington state and cancelled court.

Denise says the boys are exactly where they belong. "They're doing so well with my parents, and it's nice because I can actually see them whenever I want," she said. "And for those two years, he kept them from us. It hurt."

Denise says her sister and Josh had had marital problems for years before she vanished — that Josh was manipulative and physically violent toward Susan.

"(Susan) called me crying and said that he had pushed her and she was scared," Denise recalled. She says she told Susan to "take the boys, go somewhere and I'll come get you, and she didn't. She wouldn't do it."

Denise believes Josh is responsible for her sister's disappearance.

"Quit being a little girl," she said. "Fess up to what you did to my sister and turn yourself in and help us out. Let us have some closure."

According to CBS affiliate KIRO, sexually explicit images were found on a home computer that belongs to Josh Powell.

On Wednesday, a judge ruled that Powell must undergo a psycho-sexual evaluation and a lie detector test, noting the "extreme child porn" found in the home where Josh was living with the two boys and his parents after his wife's disappearance.

Susan Powell has been missing since 2009 and the couple's two sons have been in the custody of her parents, although Powell is allowed supervised visits several times a week.

"We're relieved that the children will be with us, for now," said Chuck Cox, Susan's father.

Powell's attorney says that the images found on his client's computer were not illegal, but rather "in poor taste."

Last September, Powell's father, Steve Powell, was arrested on child pornography charges. The Associated Press reported that papers from Steve Powell's 1992 divorce indicated that child porn was a factor in the breakup of his marriage.

Josh Powell has a big decision to make. His wife is the former Puyallup woman who went missing from their Utah home two years ago. A judge says she won't consider Powell's request for custody of the couple's children until he undergoes a psycho-sexual evaluation. Listen to a report from Tim Haeck.

It's an exam typically conducted by a psychologist, licensed by the state as a sexual offender treatment provider. Bellevue criminal defense attorney Robert Perez says the exam is invasive, embarrassing and unpleasant.

"A person who goes through one of these experiences is asked about virtually every development in their life, their childhood history, their family history, their educational history and, of course, every intimate detail of their sexual history," said Perez.

The goal is to find out if the subject is a sexual deviant, if they're dangerous and if they are amenable to treatment.

Josh Powell has been trying to win back his two sons ever since his father was arrested last September for voyeurism and possession of child pornography. Powell and his children were living with Steve Powell in Puyallup at the time.

This week, a Pierce County judge told Josh Powell she would consider his request for custody, but only after he underwent this evaluation. Powell's attorney argued against the evaluation saying there is no proof that the child porn belonged to Josh Powell.

Attorney Perez says judges sometimes require the psycho-sexual evaluation to cover their backsides.

"No judge wants to be on the front page the next day being the judge that let somebody out of jail or made a decision in a case and then this person goes sideways," said Perez.

Psycho-sexual evaluations are not foolproof but they do involve questions to determine if a subject is being truthful.

"A doctor will sometimes come back to me and tell me: 'This guy's results on this test tell me that he should be drooling and walking on his hands and knees, and he's not, he's obviously faking,'" said Perez.

The exams usually include a polygraph test but attorney Perez opposes them calling them "unreliable."

The evaluations are often required by the court before a plea agreement or sentencing of a sex offender. In the case of Josh Powell, it's voluntary and there are risks.

"You're exposing yourself to the most intimate details of your life to a stranger and you don't know what's going to happen to this report," said Perez, who points out that the findings are subject to release under the state's open records law.

If Powell really wants to regain custody of his children, he might have no choice but to submit to the psycho-sexual evaluation.

For now, Powell's sons, ages 5 and 7, are living with their grandparents, the parents of Susan Cox Powell, who disappeared from her Salt Lake City-area home two years ago. Josh Powell is a suspect but denies any role in his wife's disappearance and has not cooperated with Utah detectives investigating the case.

Exam will unveil Josh Powell’s sexual history, preferences

Josh Powell last week suffered a setback in his quest to regain custody of his two children from his in-laws, Chuck and Judy Cox.

A Washington state judge ruled the husband of missing West Valley City woman Susan Cox Powell must undergo a psychosexual evaluation by a court-appointed examiner in light of explicit images found on a computer taken from the Powells’ West Valley City home during a 2009 police search.

Pierce County Superior Court Judge Kathryn J. Nelson ruled Charlie, 7, and Braden, 5, should remain with their maternal grandparents until at least the end of July. But what is a psychosexual evaluation and how could its results shape Josh Powell’s future?

“It’s kind of like a sexual profile of the individual. It’s a risk-assessment tool,” explained Mary Fan, a law professor at the University of Washington. “In Washington state, you see it in a number of decision points in the court process.”

While more commonly used in criminal proceedings where judges must assess how likely a defendant is to reoffend or determine housing and treatment, the evaluations can also be ordered in civil matters.

In Washington, licensed evaluators may examine police reports, child protective services information, criminal correctional history, interviews with the client and his family, and other data. At a minimum, they must address a description of the allegations against a person; a person’s sexual history and preferences; previous attempts to remediate problem behavior; and risk factors that may lead them to repeat problem behavior.

Risk factors can include a person’s stress level, alcohol and drug use, mood, sexual patterns, use of pornography, social and environmental influences, medical history, relationships, employment, education and family history.

Besides undergoing a paper-and-pencil evaluation, Josh Powell may possibly be subjected to a penile plethysmograph — which measures the bloodflow to a penis. The plethysmograph is administered with a strain gauge, which measures an erection response while a person is shown slides and tapes of normal sexual behavior as well as deviant acts.
