Victims of Powell's voyeurism file suit against him/Will be released May 2013.

TACOMA, Wash. — Calling his actions "outrageous," "heinous," "disgusting" and "egregious," the attorney representing two young Washington girls followed through on her promise Wednesday to file a civil lawsuit against Steven Powell.
Seattle-based attorney Anne Bremner filed a lawsuit against Powell on behalf of two of his former neighbors, then ages 8 and 10, whom Powell videotaped from his own home through an open door while they were in their bathroom. In the digital images taken from the recordings, the girls were nude or partially nude.
"Steven Powell watched and filmed plaintiffs’ most intimate and private affairs as they bathed, used the toilet and changed their clothes," Bremner wrote in the lawsuit. "Steven Powell’s offensive and unlawful conduct of watching and filming plaintiffs’ most intimate private affairs was extreme and outrageous in that it went beyond all possible bounds of decency and is utterly intolerable in a civilized society."
Powell, 62, was convicted May 16 on 14 counts of voyeurism. He was sentenced last week to 30 months in prison after a judge dismissed two of those counts. He was served with notice of the civil suit just before he was sentenced, although it wasn't officially filed in court until Wednesday.
Powell is appealing his conviction on the grounds that the police search of his home that led to the discovery of thousands of images of the neighbor girls, young women around the Seattle-Tacoma area, and Susan Powell, was unconstitutional.
Because of Powell's actions, Bremner said her clients suffer "severe emotional distress and will continue to suffer severe emotional distress indefinitely." She called the girls' emotional scars "permanent and irreparable."
Bremner said the girls are seeking restitution for their counseling and general damages for emotional distress, but said, "They're not out to make money."
Rather than funds, the lawsuit was more about obtaining records, preventing Powell from repeating his actions and possibly forcing him to move from the neighborhood because the only asset he has left is his house, she noted.
In filing his notice of appeal on his conviction, Powell indicated his home was worth about $250,000 and his 2005 Plymouth Voyager about $4,000, but he did not have any income from interest or dividends, his checking and savings accounts were empty and he had no cash.
By filing a civil suit, Bremner said she is now able to request police records regarding the search of Powell's home on behalf of both the young girls and Chuck and Judy Cox, the parents of Susan Cox Powell who has been missing from Utah for 2 1/2 years and is presumed dead. Bremner also represents the Coxes.
The prime suspect in Susan Powell's disappearance is her husband, Josh Powell, who killed himself and murdered his two young sons in February.
Bremner said the civil suit would take an average of 18 months to complete. What's important, she said, is to make sure Steven Powell is out of the lives of the young girls and their family once and for all, and to get him out of the neighborhood where he committed the crimes.
Bremner believes the likelihood of Powell re-offending is high.

Steve Powell, the father-in-law of Susan Powell who last month was sentenced to 30 months in prison for voyeurism, will walk out of prison less than a year from now.
A Washington Department of Corrections spokeswoman on Friday said Powell has a release date of May 23, 2013. Spokeswoman Selena Davis explained in an email that Powell has been given credit for 535 days toward his sentence.
That includes the 271 days Powell spent in a jail in Tacoma, Wash., awaiting trial and sentencing, and 135 days for good behavior in the jail.
Corrections also is subtracting 169 days from Powell’s sentence because his offense was nonviolent, Davis explained.
That leaves Powell with 338 days to serve in prison.
Powell is at a prison in Shelton, Wash., where all new Department of Corrections inmates go to receive an evaluation before being transferred to another facility to serve the remainder of their term. Davis said there is a chance Powell will be shipped to a prison in another state.
Powell was a civilian employee of the Department of Corrections before his arrest in September, and the department may decide it is a conflict of interest to keep him in one of its prisons.
Powell is being held in administrative segregation due to the notoriety of his case, Davis said.
Also, Davis said Powell has been classified as "low risk" to commit another crime upon release.
Susan Powell was reported missing from her home in West Valley City on Dec. 7, 2009. Her husband, Josh Powell, was the only person of interest ever named by police.
He claimed he last saw his wife the night before as he left with their two sons, then ages 4 and 2, and went camping in the west desert during a snowstorm.
While investigating the disappearance, West Valley City police served a search warrant on Steve Powell’s home in Puyallup, Wash., where they found the photographs of the neighbor girls.
On Feb. 5 of this year, Josh Powell murdered his sons, Charlie and Braden, and killed himself in a fire at his rented home in Graham, Wash.
In May, a Pierce County, Wash., Superior Court jury found Steve Powell guilty of 14 felony counts of voyeurism. At the sentencing hearing two weeks ago, Judge Ronald Culpepper dismissed two counts, saying they appeared to be for multiple photographs taken in the same session.

Prosecutors say they want porn charge against Steven Powell reinstated

Now, prosecutors have filed notice of their own appeal.

It's unclear, however, whether the appeals — which often take months or years to go through the system — will make any difference in how much time Powell serves since he's scheduled to be released next May.

Prosecutor Mark Lindquist said while his office is not appealing Powell's sentence, they are appealing the decision to dismiss that charge. Just because prosecutors won at trial doesn't mean they agree that every ruling during the case was correct, he said.
"We will likely appeal the dismissal of the child porn case and any other issues that are pertinent," he said. Those other issues may include rulings made on evidence as well as "various sentencing issues."
While Lindquist didn't say what those specific issues are, they could include:
• The removal of missing Utah mother Susan Powell from the trial. In several pre-trial rulings, Culpepper all but removed any mention of her. Prosecutors had wanted to present evidence that Steven Powell had taken voyeuristic pictures of his missing daughter-in-law and also recorded sexually explicit fantasies he had of her in his diaries.
• The dismissal of two charges at sentencing. The jury convicted Powell of 14 counts of voyeurism. But during the sentencing hearing, the judge dismissed two of those counts and sentenced Powell on 12 counts.
If a judge rules in the prosecution's favor regarding the dismissed child porn charge, Lindquist said his office would have to go through another court process if they wish to seek additional prison time.
Lindquist said the appeals process could take an estimated one to two years to complete. Yet Powell is scheduled to be released from prison in less than a year.

Steven Powell was convicted of spying on and taking unwanted pictures of two young neighbor girls while they were in their bathroom. The girls and their mother on Friday filed a summons, giving Powell 20 days to respond to the civil lawsuit filed against him in June.
Steven Powell, 62, was convicted May 16 on 14 counts of voyeurism. He was sentenced on 12 of those counts to 30 months in prison.
Since then, both sides of have filed appeals: Powell is appealing his convictions arguing that the search of his home that led to his arrest was unconstitutional; and prosecutors are appealing the dismissal of a possession of child pornography charge that had originally been filed against him.

Passages in newly released journals kept by Steven Powell vacillate between descriptive sexual fantasies to desperate vows of love for his daughter-in-law, Susan Cox Powell, who disappeared in 2009.
The Pierce County Sheriff’s Department on Tuesday released 2,721 pages of journals and investigative reports related to the Powell family.
Other heavily redacted court documents released Tuesday show detectives almost immediately classified Susan Powell’s disappearance as a murder and kidnapping, and focused on her husband, Josh Powell, as the suspect.
Little of that appears in Steven Powell’s journals. He instead focuses on his growing feelings for his daughter-in-law and seems to convince himself at times that she feels the same way even as she refuses to be around him.
Steven Powell was convicted in May of 14 counts of voyeurism for filming two neighbor girls, then 9 and 8, during 2007 and 2007. He lived in an adjacent house at the time and used a zoom lens to peer inside his neighbor’s window. He was sentenced to 2 1/2 years in prison.
His journals were evidence in his case.
He first writes about Susan Powell in January 2003, when he acknowledges his greatest problem and greatest pleasure is falling in love with her.
“The fact is, I can hardly control myself when it comes to her,” he wrote in loopy cursive.
He confides that he secretly recorded his daughter-in-law and regularly watched the video clips while he masturbated. Several entries detail him using a handheld mirror to spy on her under the bathroom door.
He also admits that others might view his sexual preferences as “sick.” Ya think?
Penning his fantasies about his daughter-in-law “represents the first time I’ve mentioned fetishes and what might be considered sociopathic. I mean, who looks under the bathroom door with a mirror?”
He also writes of a deepening love and obsession.
Powell secretly scanned her childhood journals so he could read them at night. He kept a drawer with items he swiped from her, including underwear and used leg waxing papers.

Although Utah investigators never publicly called Josh Powell a suspect in his wife’s disappearance, the documents released show they focused on him as soon as two days after she went missing. Passages in newly released journals kept by Steven Powell vacillate between descriptive sexual fantasies to desperate vows of love for his daughter-in-law, Susan Cox Powell, who disappeared in 2009.
The Pierce County Sheriff’s Department on Tuesday released 2,721 pages of journals and investigative reports related to the Powell family.
Other heavily redacted court documents released Tuesday show detectives almost immediately classified Susan Powell’s disappearance as a murder and kidnapping, and focused on her husband, Josh Powell, as the suspect.
Little of that appears in Steven Powell’s journals. He instead focuses on his growing feelings for his daughter-in-law and seems to convince himself at times that she feels the same way even as she refuses to be around him.
Steven Powell was convicted in May of 14 counts of voyeurism for filming two neighbor girls, then 9 and 8, during 2007 and 2007. He lived in an adjacent house at the time and used a zoom lens to peer inside his neighbor’s window. He was sentenced to 2 1/2 years in prison.
His journals were evidence in his case.
He first writes about Susan Powell in January 2003, when he acknowledges his greatest problem and greatest pleasure is falling in love with her.
“The fact is, I can hardly control myself when it comes to her,” he wrote in loopy cursive.
He confides that he secretly recorded his daughter-in-law and regularly watched the video clips while he masturbated. Several entries detail him using a handheld mirror to spy on her under the bathroom door.
He also admits that others might view his sexual preferences as “sick.” Ya think?
Penning his fantasies about his daughter-in-law “represents the first time I’ve mentioned fetishes and what might be considered sociopathic. I mean, who looks under the bathroom door with a mirror?”
He also writes of a deepening love and obsession.

I would think that Susan's parents would have rather had her divorced from Josh, religion or not, than living in this nightmare sham of a marriage and had their daughter and their precious grandsons still living and happy. Susan Powell's Father-in-Law Secretly Took 4,500 Pictures of Her
Wrapping up a year that has brought unimaginable frustration and heartbreak, Susan Powell's family marked the three-year anniversary of her disappearance at a ceremony this week near where her two sons are buried.
"It's a hard time of year," Susan's father, Chuck Cox, tells PEOPLE. "Our daughter's still missing. Someday, we will find out what happened to her."
He added that he is not sure what to make of a West Valley City, Utah, police announcement Thursday that their investigation into Susan's Dec. 6, 2009 disappearance remains active but "has been scaled down," with a reduction in the number of full-time investigators working the case.
The announcement came at the same time that more evidence emerged of the alleged obsession Susan's father-in-law, Steven Powell, had toward her. Authorities released nearly 4,500 pictures that they say he secretly took of her at home and elsewhere.
Cox says he's hopeful that the police are still doing everything possible to solve Susan's case, but he hasn't ruled out suing the department for failing to arrest Susan's husband, Josh Powell, for her murder.
More than two years after Susan's disappearance, Josh on Feb. 5 murdered the couple's two sons and committed suicide by blowing up his house.
Cox's lawyer, Anne Bremner, says Cox "goes back and forth" over whether to sue West Valley City. "He wants them to find her. A lawsuit can have a chilling affect on things."
Cox and Bremner say they do plan to file a lawsuit against the state of Washington for continuing to give Josh visitation with his children despite what they claim were mounting concerns regarding his mental stability.
Although Cox and the police believe that Josh Powell knew more than anyone what happened to Susan, they also strongly suspect that his father, Steven Powell, should still be looked at more closely.
The Coxes hoped Steve Powell's voyeurism trial in May would unearth some answers but it did not. Powell invoked his Fifth Amendment right against self-incrimination when asked in jail about Susan.
In numerous interviews with PEOPLE, Steve and Josh Powell denied any involvement in Susan's disappearance and have suggested that she ran off with another man.
Steve Powell was prosecuted for surreptitiously photographing his neighbor's young daughters (and is serving a 30-month sentence), but the investigation also unearthed journals in which Powell described his interest in his daughter-in-law, as well as the thousands of photos, which were released Thursday to the Associated Press.
In a journal entry, Steven Powell recalls a sexually charged dream in which Susan asks him, “Do you think I would make a good wife for you?” None of the pictures show Susan naked, although there are images of her crotch and backside.
"We think he knows exactly where our daughter is," Cox says.
Once Susan disappeared, Josh sold the family's home in Utah and moved with the boys into Steven Powell's house in Puyallup, Wash., only about two miles from the Cox family.
On Thursday, families streamed to Puyallup’s Woodbine Cemetery to remember the Powell boys and other children who died tragically and to dedicate a memorial: a bronze angel inspired by the novella The Christmas Box, in which strangers learn the value of love following a child’s death.
The novella's author, Richard Paul Evans, also attended the dedication. The memorial is on a hill overlooking the boys' gravesites 75 yards away.
"We get a lot of support from a lot of people and we're going to make it through," Cox says.

Investigators had largely focused their time on Susan Powell's husband, Josh, who killed himself and the couple's two young children earlier this year. Utah investigators said they can't discuss details of the case, but Washington state officials have said they believe Josh Powell killed his wife. They also say his father may know more about the disappearance than he's letting on.
Anne Bremner, an attorney for Susan Powell's parents, said they had expressed those concerns from the beginning about Steve Powell.
The family's concerns were exacerbated by how Steve Powell had acted around Susan Powell. And they escalated to a new level in the summer of 2011, when a search warrant at the home where Steve and Josh Powell lived found journals and photos suggesting that Steve Powell had an extremely sexual and emotional draw to his daughter-in-law.
The Associated Press reported Thursday that some 4,500 images in a folder dedicated to Susan Powell included shots of her out in public, apparently unaware that a camera was focused on her. Steve Powell wrote in journals that he took sexual pleasure in looking at videos and images he captured of her.
"Oh my god, those journals. I couldn't read them all," Bremner said. "The fact that Steven had that amazingly bizarre obsession with Susan - chronicled page after page - that alone would make him somebody you'd want to look that."
Sgt. Mike Powell, a spokesman for the police department in West Valley City, Utah, said he can't discuss details of the investigation but noted that the agency has spent countless hours on the case. The investigation remains active, though Powell said investigators have reduced their focus on the case.
Pierce County Prosecutor Mark Lindquist, who oversaw the voyeurism case against Steve Powell in Washington state, said Powell likely knows more than he's telling but that he's not a reliable person even if he did speak. Powell is in prison serving his voyeurism sentence and could be released as early as May.
"Barring new evidence emerging, we're done with Mr. Powell," Lindquist said.
Utah investigators say that Steve Powell has not cooperated with the Susan Powell investigation, but that still didn't initially trigger a more thorough assessment of him. In fact, an investigator said in one email obtained by AP that they did not take Steve Powell's cell phone or mobile internet card during the 2011 search at his home.
In early April 2012, a co-worker of Steve Powell's went public with her recollection that he talked about going on a snowy camping trip with his son and grandchildren in Utah around the time Susan Powell disappeared. She had previously emailed authorities about that conversation.
The day after Jennifer Silva told her story to AP, detectives in Utah began checking with officials at the Washington state Department of Corrections, where Powell had worked around the time Susan Powell disappeared. They began asking where Steve Powell was assigned and what clients he was working with in December 2009.

Investigators also expanded their assessment of Steve Powell in April 2012, analyzing his phone and SIM card. Investigators also explicitly asked for his emails from 2009.
The AP first requested those emails, which are public record, in 2011.

We know from a voyeurism case that sent Steve Powell to prison that he had an extremely sexual and emotional draw to his daughter-in-law.
Powell was convicted of voyeurism involving two neighbor girls. He is currently serving his sentence and could be released as early as May.
AP also discovered he had more than 4,500 images in a folder dedicated to Susan included shots of her out in public, apparently unaware that a camera was focused on her. He wrote in journals that he took sexual pleasure in looking at videos and images he captured of her.
West Valley City police refused an interview on the public records AP has obtained, saying it is still an active investigation.
Earlier this year one of Steve Powell's co-workers reported to police she remembered him talking about going on a snowy camping trip with his son and grandchildren in Utah around the time Susan disappeared.

Steven Powell can't go back to his home, corrections officials say
PUYALLUP, Wash. — The Washington Department of Corrections says Steven Powell cannot move back into his old neighborhood where the crimes he was convicted of took place.
Powell, 62, is currently serving a prison sentence after being convicted of 14 counts of voyeurism in May of 2012. A Tacoma jury found him guilty of taking photographs of two neighbor girls, then ages 8 and 10, with a telephoto lens while they were nude or partially nude in their bathroom. Powell is currently incarcerated at the Monroe Correctional Complex.
He was eligible for early release Thursday. But under Washington state law, an inmate must first submit an "offender release plan" and have it approved by the Corrections Department. That plan must include details such as where he plans to live and work once he's released.
According to Powell's offender release plan, obtained by the Deseret News through a public records request, the Washington Department of Corrections has denied his request to return to live in his Puyallup home because of community concerns.
In the report, officials refer to the thousands of images seized from Powell's room by police of young girls who were filmed without their knowledge, and how the pictures focused mostly on the girls' buttocks and breasts. The report also mentioned the images of missing Utah mother Susan Cox Powell, his daughter-in-law, that were found in his house.
One part of the report also noted that Powell does not "have a verified high school diploma," although he said he has both a diploma and a college degree.
According to his release agreement that a judge signed when Powell was sentenced, he will not be allowed to have any contact with his victims once he is released and will be banned from possessing any camera or video recording equipment, sexually explicit materials, joining any social media Internet sites such as Facebook, and unsupervised Internet access including on mobile devices.
He will be required to obtain approved employment and living arrangements, enter a "state approved sexual deviancy treatment program," submit to polygraph and plethysmograph tests, register as a sex offender for 10 years in the county he is living in, and submit a DNA sample.
As part of their investigation into the disappearance of Susan Powell, the West Valley Police Department collected letters Steve Powell wrote to his children while incarcerated. Some of those letters were among documents released this week by the department.
Initially, Powell wrote that he did not have interest in moving back into his Puyallup house. His daughter, Alina Powell, actually encouraged her father not to move back into the house because of safety concerns and so that the house wouldn't become "a lightning rod for media."
But after the suicide of his son Michael Powell, in February, Steven Powell seemed to change his mind. In recent letters to his daughter, he wrote that he planned to live downstairs.
"I will feel more comfortable if I can be around family," he wrote. "At my age, I need family support more than the average person who is leaving this institution. Anyway, let's do whatever we can so that I can come home."
Powell also wrote in a letter dated April 15 that if he wasn't allowed to move back home, he would consider simply living in his van.
The report did not say if Powell, who worked as a civilian delivery driver for the Department of Corrections before his arrest, had a job lined up once he is released.
In his letters from prison, Powell noted that his family was struggling financially to make house payments. Since his arrest, his children Alina and John Powell have lived in the home. Powell's ex-wife, Terri Powell, also reportedly moved in recently, according to family members.
Once an offender release plan is approved, an inmate will then have to spend 35 more days in prison while preparations are made for his release, such as notifying victims as well as law enforcement in the area that he is about to move there.
If a release plan is never approved, Powell would still get out of prison in April of 2014, the maximum time on his sentence.

I agree that he should not go anywhere near Payallup. In fact, I don't think he should be allowed in Washington State, Utah or Oregon.
HOW did he get in w/the Dept of Corrections w/out a hs diploma? Background checks are done for anyone working in law enforcement..no matter in what capacity. This floors me. Evidently, this LE agency is lenient and that's an understatement.
He should have NO access..supervised or unsupervised, to the web/FB/cable tv. He should not even be allowed to have a cell w/a camera. He, IMHO, should NOT be allowed out of prison unless he goes into some type of home for sex offenders (if there is such a thing) or the nearest "funny farm". MOO.

IIRC he was w/ the corrections dept for a long time. Maybe they were more lax then about checking on people? Crazy! I remember the first time I read that he worked for the corrections dept it floored me.
I agree, I wish he would go to a special home for S.O.'s although I doubt anything like that exists so his butt should rot in jail. Unfortunately they have to release him next year.

OLYMPIA, Wash. — Steven Powell, the father of Josh Powell, was released from a Washington state prison Sunday.
Powell has served a little less than two years for several counts of voyeurism he was charged with in 2012 for taking inappropriate photos of young neighbor girls in their home in Washington.
This weekend marks the end of Powell’s prison sentence.
Law enforcement found the photos of the neighborhood children during a search of Powell’s home for evidence about his missing daughter-in-law, Susan Cox Powell, who disappeared from her home in West Valley City in December of 2009. Powell’s daughter, Jennifer Graves, testified against her father and has said in the past she’s got some fears he may retaliate once he’s free.
“He would definitely have to have a spirit of vengeance to be coming after somebody, Chuck or us, he would actively have to give up the rest of his life to achieve that, but so I don’t think he’s going to at this point,” she said.
Susan Cox-Powell has never been found, but her father, Chuck Cox, and Jennifer Graves continue to search, despite West Valley City announcing they have closed their investigation.
Powell will be required to wear a GPS locator for at least the first 30 days of his community supervision.
He will also be required to attend a sex-offender treatment program and follow the terms of his community supervision.

The parents of Susan Cox Powell, the missing Utah mother of two, have started to comb through her father-in-law's former home in Washington state, where they have found not only tragic reminders of the past but also potential clues to her disappearance.
Bike helmets meant to protect two small heads, a beloved children's book, computer files and articles of clothing were among the items recovered over Memorial Day weekend from Steven Powell's former residence.
"To the Powells, those things appear to be nothing more than junk," said author Gregg Olsen, who visited the house with the family. "It indicates just how much they really cared about the boys and their mother."
Olsen and Rebecca Morris, who wrote If I Can't Have You: Susan Powell, Her Mysterious Disappearance, and the Murder of Her Children, were among those who visited Steven Powell's former residence over the weekend.
Steven Powell, the father of Susan Powell's husband, Josh Powell, hasn't lived at the residence since 2011. He was arrested that year on several counts of voyeurism after police found inappropriate photos of young women and girls from the neighborhood in his home.
Two victims of the voyeurism recently purchased the home and have permitted the Cox family to go through it.
The Cox family told HuffPost that among the items of interest they found is a box that contains computer-coding files. The family said they hope the files might contain information that could help the FBI get at files on a heavily encrypted computer previously owned by Josh Powell, as investigation agents have been struggling to access those for several years.
Not every item is considered a potential clue. Children's toys and articles of Susan Powell's clothing are simply painful reminders for the missing woman's family.
"It is sickening to see so many reminders of Susan and her boys left behind by Steven Powell's family," Olsen told The Huffington Post.

Sadly I doubt that Susan's body is buried on this property, but I have hopes that information can be found there or on the computers, that will lead the Cox's to where she can be found. Anything is worth checking out as far as I'm concerned and the Cox's unending search is testament to the love they hold for their daughter.
