When the search of a landfill was called off in June, it was unclear whether authorities want to pursue a murder case without the girl's body.

According to ABC15, Hunter will be charged with first-degree murder and child abuse.

Glendale Police Assistant Chief Rick St. John said Jerice Hunter was arrested at 1:30 p.m. on charges of first-degree murder and child abuse.
More information is expected to be revealed in a 4:00 p.m. press conference.

Jerice Hunter's attorney told CBS 5 News he doesn't know what new evidence was presented before the grand jury that indicted Hunter Thursday.

"We are confident with the indictment of Jerice Hunter today we will achieve our second goal of securing justice for Jhessye," said Glendale police Chief Debora Black at a news conference Thursday afternoon.

PHOENIX — The mother of an Arizona girl missing for nearly a year was re-arrested in the case Thursday on suspicion of first-degree murder and child abuse.

Police in the Phoenix suburb of Glendale announced at a news conference that Jerice Hunter was taken into custody without incident at her home in Mesa.

Hunter, 38, was indicted earlier in the day by a Maricopa County grand jury, even though the body of 5-year-old Jhessye Shockley hasn't been found.

Hunter's lawyer Scott Maasen said his client maintains her innocence.

"The indictment is not evidence," Maasen said. "There is no body in this case. Cases without finding bodies are very difficult cases."

County Attorney Bill Montgomery said his office "has successfully prosecuted cases in which the victim's body was never found."

"We now have the opportunity to seek justice for Jhessye and uncover the truth behind her disappearance," Montgomery added.

Investigators believe Shockley's body was disposed of days before Hunter reported her missing Oct. 11 and told police that she left Jhessye with the girl's older siblings while she ran an errand and returned to find her gone.

A 96-day search at a Phoenix-area landfill ended in late June without finding the girl's remains.


Glendale Police Chief Debora Black said at a news conference that Shockley's "final resting place" likely is at the bottom of the Butterfield Landfill in Mobile, south of Phoenix, but no additional searches are scheduled.

She said 280 officers sifted through more than 9,500 tons of trash from early February to late June without success.

"They worked tirelessly to accomplish two goals: to find Jhessye and to hold the person responsible for her disappearance accountable," Black added. "We are confident with the indictment and arrest, we will achieve our second goal of securing justice for Jhessye."

Hunter was arrested in November on suspicion of child abuse but later released from jail with the charge dropped. Prosecutors said then that they wanted to continue investigating and were worried that Hunter would not be eligible for a potential murder charge if she was convicted of abusing Shockley, a situation known as double jeopardy.

At the news conference, authorities said Hunter was arrested based on the collection of evidence in the case since October.

Police records show Jhessye's siblings told investigators in the days after her disappearance that Hunter allegedly abused her and kept the girl in a closet.

In October 2005, Hunter was arrested with her then-husband on child abuse charges in California. Hunter pleaded no contest to corporal punishment and served about four years in prison before she was released on parole in May 2010.

GLENDALE, AZ - Glendale police said they are confident that their evidence will lead to the conviction of Jerice Hunter in the murder of her daughter , Jhessye Shockley.
Hunter was arrested Thursday on charges of first degree murder and child abuse. Jhessye Shockley was 5 years old when she was reported missing in October 2011.
Authorities arrested Hunter at her home in Mesa Thursday afternoon. Police said she did not resist arrest.
She made her first court appearance later Thursday. Hunter remained quiet and allowed her lawyer to do most of the talking.
This is the second time Hunter has been arrested in connection with this case . Charges were dropped the first time. Police said they needed more time to build a case against her.
Tracey Breeden, spokeswoman with the Glendale Police Department, said they have forensic evidence in the case.
Breeden said additional information was provided after the first arrest that gave them a stronger case.
Breeden also said she could not go into further detail because she didn't want to jeopardize the case.
According to court documents, police believe Hunter killed Jhessye or caused serious physical injury between September 23, 2011 and October 4, 2011.
Police have said they believe Jhessye's body was disposed of days before her mother reported her missing at an apartment complex near Glendale and 45th avenues on October 11, 2011.
Here's a look at the timeline of events:
October 2011: Police, along with community members, launched a massive search for Jhessye. Fliers were passed out near Jhessye's home at 45th and Glendale avenues. An amber alert was issued. Federal agents became involved.

Police later called off the search. Right around the same time, ABC15 discovered Hunter had served prison time in California for child abuse years earlier.

In November, Hunter was arrested at her home in Glendale on child abuse charges. The charges were later dropped. Police said they received additional information and needed more time. The county attorney was concerned about a double jeopardy issue, according to Breeden. Double jeopardy is a procedural defense which prevents a person from being tried on similar charges twice.
In February 2012, police started a search at Butterfield landfill. They said Jhessye's body was dumped in a Tempe trash bin and transported to the landfill. After more than four months of sifting through tons of trash, police called off the landfill search. No body was recovered.

Lisa Vance, Jhessye's cousin, expressed concern that they would not be able to give Jhessye a proper burial.
In response to this latest arrest Hunter's attorney, Scott Maasen, said all the facts are not out there yet.
"There hasn't been any information presented and that indictment has very general language. Nothing really specific about the facts here. Again, I think we are going to see that," Maasen said.
Maasen said he spoke with Hunter after the arrest. She's doing as well as she can given the situation, he said.

The mother of Jhessye Shockley pleaded 'not guilty' in court today regarding charges that she murdered the missing Arizona child. Officials have long believed Jerice to be responsible in Jhessye's disappearance, but the young girl's remains have never been located. Is the prToday was the arraignment of Jerice Hunter, who was arrested last week in connection to her daughter's disappearance. The disappearance of Jhessye Shockley is almost a year old and detectives in Arizona have searched tirelessly for the missing child. They truly believe that Hunter abused the little girl leading to her death before disposing of her body in a dumpster before reporting her missing.

Just because Jerice took a 'not guilty' plea, she could still wind up convicted of first degree murder and child abuse that she's been charged. Her criminal past combined with the testimony of her other children and the forensic evidence obtained in the investigation may get her locked away for good.osecution facing an uphill battle or is the state of Arizona going to throw the book at Hunter?

October 11 will mark one year since 5-year-old Jhessye Shockley was reported missing and now we're checking out new documents about the case.

One of the thing you realize as you comb through all of those pages is the incredible resources and effort Glendale PD put into finding 5-year-old Jhessye Shockley. 1,400 pages were released.

Page one involves the first call to Glendale police that Jhessye was missing by her mother, Jerice Hunter.

Hunter told a Glendale officer that upon returning to the family's apartment from running errands at about 5 p.m. that evening, she discovered Jhessye was gone and her older sisters didn't know where she was.

The police launched a search around the apartment near 45th Avenue and Glendale. What would follow was a month long search for Jhessye punctuated by accusations by the family that police botched the investigation.

Suspicions started to grow that perhaps the girl's own mother may have had something to do with her daughter's disappearance.

On November 20, 2011, police arrested Hunter in the disappearance of her daughter and the charge was child abuse.

Police say after interviewing Jhessye's older sisters, a horrifying story had emerged. A story of a mother enraged after Jhessye was found watching television with a little boy.

The sisters said Hunter beat Jhessye and put her in a closet with no food or water. They described a smell of death inside the closet -- this happened weeks before that October 11 call to the police reporting Jhessye missing. The sisters told police they had been lying because their mother told them to.

Despite this, Hunter was released from jail after eight days. Prosecutors cited a lack of evidence.

Police announced then they don't expect to find the girl alive.

In February, the department launched a daunting search for the girl's body in the Butterfield Landfill in Mobile, Arizona. After four months, they called the search off after finding nothing.

Then last month, on September 6, police re-arrested Hunter on child abuse and murder charges.

That is where we stand now -- Hunter is in jail for her daughter's murder.

Bail was set at $500,000. The big question is about evidence. Can they convict Hunter without a body? Glendale police believe they can.

Relatives of 5-year-old Jhessye Shockley told investigators that they noticed a burn mark that looked like it may have come from an iron or a stove and her teeth appeared to be knocked out.

Those and other details are revealed in the 1,400-plus-pages report Glendale Police released on Monday into the child's disappearance a year ago.

Jhessye's mother, Jerice Hunter, has been charged with the child's murder. Hunter, who had served time in a California prison for abusing her older children, reported her daughter missing Oct. 11, 2011. The girl's disappearance triggered a massive police effort to locate the girl but her body was never found.

Police looked for evidence of blood and other bodily fluids in the girl's apartment and found traces of spatter on walls and hand prints, but police stopped short of saying the remnants were from blood.

Investigators interviewed Hunter's cousins Tycora Cole, Mahogany Hightower and Victor Rice in the days after Jhessye was reported missing. All three worried for Jhessye's safety before she disappeared and Hightower had called Child Protective Services.

Cole and Rice broke down into tears during their interviews as they described one of the last times they saw their "princess" at a barbeque in April 2011, the report says.

Cole and Rice noticed that Jhessye had a burn mark, which Cole said looked like it may have come from an iron or a stove, and some of her teeth appeared to be knocked out. Cole told investigators the normally direct Jhessye became uncomfortable and hesitant when asked what happened to her teeth, according to the report.

Another relative, Hunter's cousin Lisa Vance, said the woman was taking pills and "would sleep all day and ramble all night long" when she came to live with her after serving her prison sentence.

Vance also reported one of the children told her about instances of abuse in the home once Jhessye returned under her mother's care.

The child told her "that she knows for a fact that Jerice hadn't been treating Jhessye right," the report says. The child told the woman that Jhessye "had bruises all over" and that Hunter made Jhessye stay in a room for four weeks and only allowed her to come out if she needed to use the bathroom. The child also said Hunter fed Jhessye different food from the rest of other children, according to the police report.

Police learned from the grandmother of a 9-year-old girl who played at the Hunter residence that when she visited Hunter's house before Jhessye's disappearance, she came across the tot laying in a closet.

She described the girl as "bruised," according to police documents.

Upon serving a second search warrant at Hunter's apartment on the Nov. 21, forensic investigators said they searched for traces of blood evidence, vomit, feces and urine in Hunter's bedroom closet, according to the report.

Investigators discovered remnants of child- and adult-size hand prints as well as a spatter pattern on every wall with the exception of the wall behind the bedroom door, according to the report.

Glendale Police Department spokesman Brent Coombs would not confirm or deny that the substance that left those patterns was blood.

The documents show that at one point when investigators were combing through tons of garbage at the Butterfield Station Landfill in Mobile, they came across a black bag with what appeared to be children's clothing.

Another cloth backpack held several items with purple clothing, which happened to be Jhessye's favorite color.

Glendale Police sent the items to be tested; officials said Tuesday that none of the items are linked to the missing girl.

Hunter was arrested Sept. 6 at a Mesa apartment after a Maricopa County grand jury handed up an indictment on charges of first-degree murder and child abuse.

The mother of missing 5-year-old Jhessye Shockley disposed of a large, heavy and foul smelling suitcase days before the Glendale child was reported missing, according to a witness statement released with other investigation files Tuesday.

The Glendale Police Department released this week 1,400 pages from its investigation, which provided case details never before disclosed.

Jhessye's mother, Jerice Hunter, has been charged with the child's murder. Hunter, who had served time in a California prison for abusing her older children, reported her daughter missing Oct. 11, 2011. The girl's disappearance triggered a massive effort to locate the girl, but her body was never found.

Among the details recently released, investigators say a woman said she gave Hunter a ride to a Tempe apartment complex about 7 to 15 days before Jhessye's was reported missing. The witness told police Hunter disposed of the large suitcase, according to the report.

"When Jerice got into the car with the witness she apologized for the smell of the suitcase," the report said. "After they arrived at an apartment complex in the city of Tempe, Jerice Hunter took the large suitcase from the trunk of the vehicle and placed it into a dumpster."


Cadaver dogs indicated there was a scent of blood in the Gold color 4-door Chevrolet Lumina.

Documents released by police also show investigators looked for evidence of blood and other bodily fluids in the apartment where the girl lived and found traces of spatter on walls and hand prints, but police would neither confirm or deny that the substance that left those patterns was indeed blood.

Interviews with family members and friends show many were concerned for Jhessye's well being in the time leading up to her disappearance.

Investigators spoke to Hunter's cousins Tycora Cole, Mahogany Hightower and Victor Rice in the days after Jhessye was reported missing.

Cole and Rice broke down into tears during their interviews as they described one of the last times they saw their "princess" at a barbecue in April 2011, the report says.

Cole and Rice noticed that Jhessye had a burn mark, which Cole said looked like it may have come from an iron or a stove, and some of her teeth appeared to be knocked out. Cole told investigators the normally direct Jhessye became uncomfortable and hesitant when asked what happened to her teeth, according to the report.

Hunter's cousin Lisa Vance said the woman was taking pills and "would sleep all day and ramble all night long" when she came to live with her after serving her prison sentence.

Vance also reported that one of the children told her about instances of abuse in the home once Jhessye returned to her mother's care.

The child told her "that she knows for a fact that Jerice hadn't been treating Jhessye right," the report says. The child told the woman that Jhessye "had bruises all over" and that Hunter made Jhessye stay in a room for four weeks and only allowed her to come out if she needed to use the bathroom. The child also said Hunter fed Jhessye different food from the rest of other children, according to the police report.

Police learned from the grandmother of a 9-year-old girl who played at the Hunter residence that when she visited Hunter's house before Jhessye's disappearance, she came across the tot lying in a closet.

Don't know if anyone has read the 1400 page doc dump but there is some stunning info that's been released.

It's quite clear that Jerice killed her daughter and dumped her body. She also has a record for child abuse which she did time for. It sure took LE a long time to finally arrest her. I think she is toast.

Our View: Trying to find a trace of justice in Jhessye’s disappearance

One year ago, we waited with bated breath as Glendale police searched for a 5-year-old girl. The story of Jhessye Shockley captured our attention and broke our hearts.

The anniversary of Jhessye’s Oct. 11 disappearance came and went with so many unanswered questions. But we are closer to the truth and to justice.

Police have never found Jhessye’s body, ending their search in June with heavy hearts. They scoured landfills for months, dedicating time, money, energy and resources to the search.

The girl’s mother, Jerice Hunter, was arrested in September on suspicion of murder. Police believed Hunter disposed of Jhessye’s body before reporting her missing last October.

A Maricopa County grand jury indicted Hunter on charges of first-degree murder and child abuse. She pleaded not guilty to the charges.

But those nagging questions: Where is Jhessye? What tragedy fell upon that smiling, photogenic little girl?

And the biggest question: Why?

We know more today than a year ago. Details emerged from 1,400 pages of investigation files that recently were made public.

The children in the home reported to adults that Jhessye was kept in a closet and given food different from that given the other kids.

Witnesses reported seeing Hunter disposed of a large, foul-smelling suitcase days before she called police.

Relatives suspected abuse, noticing burn marks and bruises on Jhessye.

The answers we seek might not bring us comfort, but we can only hope they are answers that might bring some justice to this child’s tragic life.

The court process for Jerice Hunter -- the woman accused of murdering her 5-year-old daughter, Jhessye Shockley, before tossing her body in the garbage -- may take a bit longer now, since Hunter is short an attorney.

The public-information office at the Maricopa County Superior Court says Hunter's case has been continued, since her private attorney withdrew due to lack of payment.

Court records show Hunter's been represented by attorney Scott Maasen, who started representing Hunter in late 2011.

That was long before Hunter was actually arrested on charges of first-degree murder and child abuse in Jhessye's death, as she was arrested on a grand jury warrant in September.

The case will be continued until an attorney's appointed to Hunter, although she's scheduled to be back in court on February 15.

As you may recall if you followed this case, Jhessye was reported missing in October, 2011, and Glendale police -- operating under the belief that Jhessye's body was in a landfill -- announced the end of a search for the girl's body in late June, although police still believed she was in there, somewhere.

Hunter -- who's served prison time for child abuse before for abusing her other children -- had always been the prime suspect in Jhessye's death.

According to court documents previously obtained by New Times, Jhessye's 13-year-old sister told her foster parents that several weeks before the little girl was reported missing, Hunter called Jhessye a "ho" and dragged her into a bedroom, where they heard Jhessye screaming and crying.

She did this, police say, because she came home and found Jhessye watching TV with a boy from their neighborhood.

Jhessye's sister also told police about Hunter keeping Jhessye locked in the closet, according to the documents, as she'd give her sister water and let her out of the closet when Hunter was gone.

Jhessye's sister added that she was missing patches of hair, and the closet she was locked in smelled like "dead people."

Jhessye's sister also said that two days before Hunter reported Jhessye missing, she bought a bottle of bleach and cleaned her entire apartment, and scrubbed down a pair of shoes that she kept in the same closet Jhessye was locked in.

Since reporting her daughter missing on October 11, 2011, Hunter has proclaimed her innocence and blamed her daughter's disappearance on just about everyone.

Hunter was arrested in November on child-abuse charges related to Jhessye's disappearance, but she was released shortly thereafter since the charges weren't actually filed.

Up until her arrest on the murder charge, Hunter had been free to roam the streets.

Although Jhessye's body wasn't found, police said in late June that investigators believed they had enough evidence to charge Hunter. Maricopa County Attorney Bill Montgomery has said on several occasions that his office has successfully prosecuted murder cases without a body several times.

Still, how Jhessye was killed -- or why police believe Hunter killed her -- has been kept under wraps. Even the reports released by Glendale police, totaling hundreds of pages, didn't reveal those answers.

That probably won't come out until a trial, which could possibly get started later, now that a new attorney has to get caught up.

The woman accused of being linked to her child’s disappearance and death, Jerice Hunter, 39, will be receiving a new attorney. Hunter’s former attorney recently filed a motion Jan. 15 in a Phoenix court to withdraw from the case because he had not been paid. Hunter will be appointed another lawyer soon. Hunter has pleaded not guilty to charges of first-degree murder and child abuse.

Hunter first reported her 5-year-old daughter, Jhessye Shockley, missing Oct. 11, 2010. Hunter was not considered a suspect until police learned from her children there were reports of abuse in the home.
The mother was first arrested on suspicion of involvement in her daughter’s disappearance in November 2010. The charges were later dropped and Hunter was released. Police were waiting for more concrete evidence or proof of Jhessye’s body before trying to convict Hunter.

Police later received a tip leading them to believe Hunter disposed of the child’s body in a trash dumpster in Tempe, which would be emptied at Butterfield Station Landfill, in Mobile, just west of the City of Maricopa.
A four and one-half month search of the landfill produced no results. An estimated $750,000 was spent on the search, and police and the public were all wondering what had become of little Jhessye.

Hunter was later rearrested by police Sept. 6, after a grand jury submitted an indictment against her. To this day, police maintain they believe Jhessye’s final resting place to be the landfill and that Hunter is their main and only suspect in the girl’s disappearance.

Hunter’s other children told police after Jhessye’s disappearance that their mother abused the girl and kept their younger sibling in a closet.

Hunter has a record of child abuse. She previously served four years in a California prison in 2005 for child abuse. She was later released on parole in May 2010.

Glendale Police Department spokesperson Tracey Breeden said now that the Maricopa County Attorney’s Office is handling Hunter’s upcoming trial, the Glendale Police Department cannot speak on the investigation until the trial begins. Breeden estimates it would take approximately two to three years before the case officially comes to trial. WTF

It's a case that captivated the valley -- the disappearance of little Jhessye Shockley. Now, sixteen months after she was last seen, there is still no sign of the Glendale girl.

Police believe she is dead and that her mother, Jerice Hunter, killed her. Hunter is now behind bars, and for the first time since being charged with little Jhessye's murder, she went before FOX 10's cameras.

Hunter has pleaded not guilty to first degree murder, but her defense was turned upside down last week when her lawyer dropped her.

That was just one of the issues we discussed from her cell.

Because her case is still ongoing, Hunter would not go into specifics with me about her case -- about whether or not she killed her own daughter and where the girl's body might be. But she did talk about having to find a new attorney, and also about what she calls an unfair portrayal of her in the media.

She says it's so bad she's had to go into protective custody in the Estrella Jail.

"It would be really great if people would get to know me before judging," says Hunter.

It's been nearly 5 months since Jerice Hunter was charged with the heinous crime of killing her 5-year-old daughter Jhessye.

Glendale police believe Hunter dumped the body in a trash bin and that it eventually ended up in a landfill. Despite an exhaustive search, Jhessye's body has never been found.

Hunter maintains her innocence, but the allegations haunt her inside the Estrella women's jail.

"I experience a great deal of harassment from the other inmates here just based on the way I've been played out in the media," she says. "I'm in the cell by myself because I requested it, I requested protective custody just so I would alleviate the gossip and rumors spreading cause I have not had my day in court yet and I have been tried and convicted by the public and media."

She's an accused child killer and a convicted child abuser -- all fueling her image of a monster -- an image she rejects.

"I'm very personable, I'm human, I have emotions like everyone else. I'll give you the shirt off my back, lot of people know that about me."

And now Hunter is dealing with a setback to her defense. Her attorney Scott Maasen withdrew from the case because he has not been paid.

"Prayerful, hopeful. I'm not despairing although it's hard, it's very hard considering what has transpired in court this past week for me. I've been given a public defender. That's nice but I'm still staying prayerful and hopeful."

"What does the future hold for you, you think?" I asked.

"The blessings of almighty God, the answers to all his promises and his children are yes and Amen… I'm no different than anyone else."

Hunter has been assigned a public defender and her trial will continue.

Seems these murderer's w/"always give you the shirt off their back.' Inmates don't like child killers. Now, if she had killed a man, they would be singing her praises as in the JA case.

PHOENIX -- The Valley mother accused of killing her 5-year-old daughter will get to wait a little longer before she receives a trial date.

On Friday, a Maricopa County Superior Court Judge granted Jerice Hunter’s new legal team more time to review evidence in her case.

Hunter, whose previous attorney stepped down last month claiming he hadn’t been paid, now has a pretrial conference set for April 15.

Hunter has been accused of killing her daughter, Jhessye Shockley, in what has become one of the state’s more high profile homicide cases.

Glendale police have alleged that Hunter killed Shockley in the fall of 2011 and then placed her body in a Tempe trash bin.

Hunter was first arrested in November 2011, but was released a few days later when authorities decided not to file child abuse charges.

Detectives would later receive a tip that Shockley had been killed and dumped in the trash.

Authorities spent four months searching for Shockley’s body in the Butterfield Landfill, which is just south of the Valley. They called off the search last June when they didn’t find Shockley’s body.

Shockley’s body has yet to be found, but police still arrested Hunter for a second time this past September.
She was charged with first degree murder and child abuse.

Hunter has entered a not guilty plea to both charges.

A $3 million notice of claim was filed this week against the state of Arizona, Child Protective Service and the Glendale Police Department, alleging their “gross” negligence led to the “wrongful” death of 5-year-old Jhessye Shockley.

Attorney Dwane Cates filed the claim - the first step toward a lawsuit - on behalf of the Glendale girl’s future estate represented by three family members who helped raise Jhessye for the first four years of her life.

Glendale Police spokeswoman Tracey Breeden said the department doesn’t comment on litigation matters. Officials from the state and CPS did not immediately respond.

Jerice Hunter, the girl’s mother, reported to police that her daughter went missing in October 2011, triggering a massive search. Her body was never found.

Hunter, who served four years in a California prison for child abuse, was indicted and arrested for Jhessey’s death in September.

Hunter successfully regain custody of Jhessye from her caregivers when she arrived to Arizona in 2010. Cate’s clients are Tycora Cole, Mahogany Hightower and Ida Vance, who are Jhessey’s family members.

Cates said his clients were reluctant to hand the girl over to her mother but was forced to by police.

Cates said his clients soon suspected Hunter was mistreating Jhessye and called Glendale Police to report the abuse, including when Jhessye had her two bottom teeth knocked out in April 2011.

Cates said in the claim the police never investigated, never conducted a child welfare check and turned the information over to CPS.

“The Glendale Police Department literally took no further action until Jhessye went missing,” Cates said in the claim.

He said his clients also contacted CPS several times to report abuse, which conducted interviews but closed the investigation, leaving Jhessey with her mother.

Cates said CPS and Glendale Police both had access to Hunter’s child abuse records in California and could have done more but instead “simply closed the case.”

“Had the Glendale Police Department and Child Protective Service done their jobs, Jhessye would be alive today,” the claim said. “The inaction by Child Protective Service, Glendale Police Department and the State of Arizona amounts to willful and wanton conduct on the part of all the parties involved.”

Cates said in the claim that if the case goes to trial, he is confident a jury would award a $10 million judgment for damages.

“How do you determine what the life of a child is worth?” Cates said. “How do we put an amount on her never getting married, never having children and having lived a short abusive life after being given to her mother. Jhessye would have had all these possible things if all parties involved would have not been so grossly negligent.”

The agencies looked and searched for her for months in garbage and landfills in sweltering heat might I add. I think they did all they could and Then some! My only beef is that they took way too long to arrest the mother.

PHOENIX - The relatives of a 5-year-old Glendale girl who police believe was murdered are preparing to sue the agencies that were supposed to protect her.
Jhessye Shockley was reported missing in October 2011 by her mother, Jerice Hunter.
Glendale police believe Hunter, who was once convicted of child abuse, actually killed Jhessye and disposed of the body.
Now, Jhessye’s family members are suing Child Protective Services and the Glendale Police Department claiming the agencies committed “gross negligence” when they failed to investigate possible abuse which ultimately lead to the child’s “wrongful death.”
“We really wish we could sue them and they'd give baby Jhessye back,” said their attorney Dwane Cates, “but they can't.”
Cates told ABC15 his clients, Tycora Cole, Mahogany Hightower and Ida Vance, are asking for money because that is their only means of recourse for Jhessye’s future estate. “The only thing that the law provides for is for money and so we have to ask for money,” he said.
The relatives, who helped raise Jhessye before she was back in Hunter’s care, are asking for $3 million.

Didn't her Mother have custody of Jhessye when Jerice was in prison for four years? Am I correct in remembering that her Mom just gave Jhessye back to Jerice w/o going thru' CPS? I might be mixing my cases up but that's what I remember. I think I also remember relatives reporting Jerice to CPS and LE while the child was still alive but they did nothing? If my memory is correct then I sure as heck do not mind seeing them sue! I know later on agencies searched for weeks in the landfill for Jhessye but that was way after the fact and after relatives complained that CPS and LE did nothing prior.

This was not Jerice Hunter's first rodeo in prison. She was in prison for child abuse IIRC. I think the entire family except for the kids are f'd up. Some of the kids even said how Jerice abused Jahessye.

True. But I thought there were relatives who tried to get Jhessye just prior to her being gone for good. I should read up thread, it's really possible I have my cases mixed up. I know, it's from listening to JA for so many days!

This whole story is just so messed up.
3 million dollars could be put towards improving and staffing these agencies so that they can provide the proper care and supervision on the mounting cases they have.

The relatives of a 5-year-old Glendale girl who police believe was murdered are preparing to sue the agencies that were supposed to protect her.
Jhessye Shockley was reported missing in October 2011 by her mother, Jerice Hunter.
Glendale police believe Hunter, who was once convicted of child abuse, actually killed Jhessye and disposed of the body.
Now, Jhessye’s family members are suing Child Protective Services and the Glendale Police Department claiming the agencies committed “gross negligence” when they failed to investigate possible abuse which ultimately led to the child’s “wrongful death.”
“We really wish we could sue them and they'd give baby Jhessye back,” said their attorney Dwane Cates, “but they can't.”

Cates told ABC15 his clients, Tycora Cole, Mahogany Hightower and Ida Vance, are asking for money because that is their only means of recourse for Jhessye’s future estate. “The only thing that the law provides for is for money and so we have to ask for money,” he said.
The relatives, who helped raise Jhessye before she was back in Hunter’s care, are asking for $3 million.

Investigators still haven't found the body of Jhessye Shockley, but they do believe her mother is the killer.

For the first time, we're hearing what Jerice Hunter told investigators in the days after she reported her daughter missing.

These interviews took place in the hours after Jhessye was reported missing. As you'll see, detectives are very skeptical as Hunter denies everything.

"I didn't harm my baby."

A pregnant Jerice Hunter got emotional as a Glendale detective pressed her on the whereabouts of her daughter.

Detective: "Did you do anything to hurt Jhessye?"

Hunter: "No."

Detective: "Deliberately?"

Hunter: "No."

Detective: "Accidentally?"

Hunter: "No."

Detective: "How about something you didn't even realize was happening?"

Hunter: "No."

Detective: "And you didn't know what to do?"

Hunter: "No, sir. I did not harm my baby."

In the wide ranging interviews, the detective gets Hunter to admit she spent time in a prison in California for hitting her children with an extension cord.

"When I whopped her, it left marks and you can't leave marks or nothing when you are disciplining your children, but I did not know honestly that I was messing up," said Hunter.

Hunter reported Jhessye missing on October 11, 2011. She claimed Jhessye was home sick from school in the days leading up to the 9-1-1 call.

But police found holes in her story, like cancelled doctors appointments for Jhessye and the fact she was out of school for three and a half weeks -- much longer than Hunter claimed.

Detective: "I am telling you what their record show. September 22nd."

Hunter: "That has got to be a mistake. My baby has been at school..my baby has been at school."

Police didn't buy any of Hunter's story. About a month after the initial report, they brought her back in.

She was wearing her slippers and a robe.

Before she was arrested, a detective read her rights and tried to get more out of her.

Detective: "I think it is important for your children to be truthful and honest."

Hunter: "I have been and I don't want to say anything else until an attorney is present. And whatever that is, need to read it."

With that, police stopped asking questions.

Hunter's own children ended up telling police that she beat and locked Jhessye in a closet and that the closet smelled like death.

Hunter pleaded not guilty to murder. She is in jail awaiting trial.

The grandmother of Jhessye Shockley said she won’t get custody of the missing girl’s siblings.

Shirley Johnson told The Republic that the Arizona Attorney General’s office had argued in Maricopa County Juvenile Court during a months-long tug-of-war over the children that she was unable to protect them from their mother Jerice Hunter, who is in jail awaiting trial in the death of her daughter Jhessye, who authorities believe was murdered.

Hunter was indicted in September by a Maricopa County grand jury on charges of first-degree murder and child abuse. Authorities have said she killed Jhessye and put her body in a dumpster and then reported her missing to police in October 2011.

Court proceedings and records involving dependency matters are not open to the public or media to protect the anonymity of the children. Stephanie Grisham, press secretary for the Attorney General’s Office, declined to comment on the case, citing the same concern, and Nicole Moon, a spokeswoman for the state’s Child Protective Services, declined comment.

Hunter had six children including Jhessye — an adult son who now lives on his own, a child who was born after Jhessye’s disappearance, and three other children ages 7, 11 and 16, Johnson said.

The three children were taken by Child Protective Services shortly after Jhessye was reported missing in 2011. The child who Hunter had been carrying for eight months when Jhessye disappeared was taken by CPS workers after her birth.

Johnson said she worries about the children’s welfare under foster care, saying the youngest has had bad foot infections that went untreated and had somehow suffered a broken arm. She said the younger two had been in four different foster homes and that the oldest child had attempted suicide twice.

Johnson had a hand in raising the children before Jhessye disappeared after child-abuse charges against Hunter surfaced in 2005. Police records show California authorities had allowed Jhessye’s three older siblings to live with Johnson when Hunter served several years in a California prison for abusing the children. Jhessye was raised by other family members.

Hunter’s cousin Lisa Vance, who helped raise Jhessye while Hunter was in prison, said she told court officials that Johnson should not have custody of the children. Vance said that the oldest child had accused the grandmother of being physically abusive and that she did not want to return to her home.

Vance said authorities were particularly concerned that if the children were returned to Johnson, she would take them to visit Hunter in jail, which they felt would be detrimental.

Vance said Johnson still defends her daughter against the accusations.

Johnson posted an open letter on Friday to a Facebook page devoted to Jhessye asking for legal help.

“Truly I have been on a long roller coaster journey just trying to keep my family together,” she wrote.

She wrote that when Jhessye disappeared, “My daughter left them alone while she ran an errand.”

She continued that “when she returned home, Jhessye ... was gone.”

Johnson said she doesn’t know why authorities believe the children would be in danger under her care with Hunter currently in jail.

“They think I wouldn’t protect them from Jerice because (she) is my daughter,” she said.

Sitting here shaking my head. Seems abuse is the NORM in this "family". To think that one of her children wanted to take their life is so darned SAD!!

I hope that Juan Martinez has this case as the State prosecutor. This woman IMO is a cold blooded killer, already has been in prison for child abuse and the grandmother needs to back off. I hope the kids can get into a good foster home even if they are split up but can see each other. What a sad, sad case!! And, where is little Jhessye? I doubt she will EVER be found! I know Maricopa County spent many, many hours in the horrible AZ heat going through landfills and came up empty. So SAD!!

Normal Trial For Missing Child Jhessye Shockley Begins

The trial of State v. Jerice Hunter commenced Wednesday in Judge Rosa Mroz's courtroom.

The proceedings started with the court clerk reading the charges to the jury. Those charges are child abuse and murder under a theory of felony murder.

The state is alleging that in the course of abusing Jhessye Shockley, Hunter caused the death of her five-year-old daughter. The state is not seeking the death penalty, which could be the result of the fact that Shockley's body has never been recovered.

Next came the reading of the preliminary jury instructions.

Promptly after reading these instructions to the jury, Judge Mroz turned her attention to the audience and politely, though curtly, told them that if anyone approaches any of the jurors they will be removed from the courtroom and not allowed back in. (Judge Mroz was also the judge assigned to the most recent proceedings in the State v. Debra Milke case.)

I can already tell this trial will not run into the same problems the State v. Jodi Arias trial did.

All seats in the South Court Tower courtroom were initially filled, though one person -- Hunter's father -- had to be removed from the courtroom because he was chuckling during the state's opening statement.

Even if his behavior was a result of his disbelief of the comments, his actions were especially offensive considering it was during the state's explanation of what Shockley had allegedly endured.

The prosecutor went through a detailed timeline of the events that occurred before and after Shockley's death, emphasizing what witnesses would be called and what their testimony would entail. The state focused on the alleged lies Hunter told the cops after she reported her daughter missing, and more importantly, the details that she failed to disclose.

The state's opening also included the fact little Jhessye had been absent from school for a number of days prior to the missing persons 9-1-1 call.

Throughout her opening, prosecutor Jeanette Gallagher emphasized what the officers had done and why, possibly to take the wind out of the defense's sails of the inevitable argument of shoddy police work. She explained to the jury that forensic evidence does have its limitations.

Lastly came the details of the intensive and lengthy search at the Butterfield Landfill that lasted 96 days and involved over 9,574 tons of garbage. Unfortunately this massive search failed to uncover any relevant evidence.

After the noon recess it was the defense that was able to finally address the jury. Lead defense attorney Candace Shoemaker started by telling the jury that there were two witnesses who saw Shockley the day the missing persons call was made and that one of those witnesses saw her taken by an unknown female.

The defense emphasized that before any of this happened there was a CPS investigation due to complaints it had received about Hunter and the result was that there was no abuse. She followed that up by explaining there is a tremendous amount of emotion involved in this case and they need to remember that when evaluating witness testimony.

Hunter's attorney then discussed the key testimony of Jhessye's older sister. She explained how Jhessye disappeared when her older sister was supposed to be watching her and that her sister's feelings of guilt were strong. So strong that her guilt caused her to direct the blame somewhere else, namely onto Hunter.

Counsel touched on the testimony of the witness who allegedly drove Hunter to the apartment complex in Tempe where she threw away a suitcase in a dumpster while wearing plastic gloves. It is believed the suitcase contained little Jhessye's decaying body.

Counsel told the jury to pay attention to this testimony as they will see that this witness's timeline doesn't make sense and that there was no evidence discovered to corroborate her story.

The defense ended its opening statement by simply stating the state's case is completely circumstantial and Hunter did not kill her daughter. In fact, she still holds out hope Jhessye is alive.

This case captured the attention of Arizonans when little Jhessye went missing and it will no doubt continue to capture our attention.

We want answers, we want to know what happened, we want to know who is responsible. It will be up to 12 of the nine women and seven men sitting in the jury box to decide if the answer is that Hunter so abused her little daughter that she killed her.
