​The hits keep coming for the folks at Arizona Child Protective Services -- the latest child killed by a person the agency has investigated in the past is 1-year-old Aleigh Torres, who police say was murdered by her mother's boyfriend, 22-year-old Miguel "Angel" Garcia.

According to court records obtained by New Times, Glendale police were called on Sunday about an unresponsive 1-year-old at an apartment in the 6100 block of 60th Avenue.

When police arrived, they found Aleigh not breathing. She was taken to Maryvale Hospital, where she was pronounced dead.

Detectives spoke to Garcia, who initially told them he was watching Aleigh -- and her three siblings, ages 6, 4, and 2 -- while the children's mother, Kerrie Serivano, was at work.

Garcia claims he put the girl down for a nap and then saw the other children fighting, so he left Aleigh's bedroom to tell them to quiet down.

After about five minutes, he initially told police, Garcia didn't hear anything coming from Aleigh's room. When he checked on her, he found her unresponsive and making "gurgling" noises.

As we mentioned, CPS has investigated Garcia -- as well as Serivano -- in the past. When Aleigh died, the three other children were taken into the agency's custody as police investigated the girl's death.

Similar to the Jhessye Shockley disappearance (which you can read about here), once in foster care, the siblings told their foster families what really happened the day Aleigh died.

The kids told their foster families -- and later police -- that Garcia was mad at the 1-year-old because she was crying. So he wrapped her up in a blanket and stuck her in a closet. When she was taken out of the closet, Aleigh's siblings later told police, she was purple.

Garcia was arrested and re-interviewed by police yesterday. After telling detectives the same story he'd initially told them, he changed his tune when told the other siblings said he put the girl in a closet.

Garcia admitted to wrapping the girl in a blanket and leaving her in the closet. He told police he's done it in the past, too.

Garcia was booked into jail on one count each of first-degree murder, manslaughter, and child abuse. He's being held on $450,000 bond.

GLENDALE, Ariz. -- Police have arrested a Glendale man in connection with the death of his girlfriend's little daughter.
Sgt. Brent Coombs and Officer Tracey Breeden of the Glendale Police Department said Miguel Garcia told investigators he found the 15-month-old girl not breathing after she had been put down for a nap Sunday morning.
Garcia, 22, was babysitting the toddler and his girlfriend's three other children, ages 6, 5 and 2, while she was at work. He later told an officer he was trying to get the kids to go to sleep so he could take a nap.

According to police, Garcia scooped up the little girl and ran to a neighbor's home. That's when 911 was called. Neighbors were doing CPR when officers arrived. The toddler was taken to Maryvale Hospital, where she was pronounced dead. Doctors said there were no obvious signs of trauma.

While the cause of death is still pending, Coombs and Breeden said homicide detectives developed probable cause to arrest Garcia in connection with the little girl's death. He was taken into custody late Thursday morning and booked on one count of second-degree murder.

Coombs and Breeden said the toddler's mother is not a suspect in the case.

Police are not releasing any information about the victim or her siblings, but according to court paperwork, there were previous police reports associated with Garcia and his girlfriend. Those reports spawned Child Protective Services investigations in 2010.

CPS placed the victim's three siblings with separate foster families the night the little girl died. Court documents show that one of the siblings talked to her foster mother about what happened to the toddler.

According to the probable-cause statement, the girl said Garcia was angry with the toddler for crying. She said Garcia wrapped the victim in a blanket and put her in the closet. The little girl was blue and unresponsive and she was taken out of the closet. The child says that's when Garcia took the victim the the neighbor's home.

Court papers say interviews with the other two siblings revealed the same information.

The officer who talked to the girls said when confronted with the details, Garcia admitted that their story was true.
"He said he didn't think he wrapped [the little girl] too tightly," the probable-cause statement reads.

The officer said Garcia told him he had put the child in the closet one other time.

The investigation is ongoing.

At the time of his arrest, Garcia was already on probation for discharging a firearm at a home.

A judge set Garcia's bond at $450,000. A status conference has been scheduled for Dec. 22, and a preliminary hearing for Dec. 27.

dont know If I can do this one. My best friends grandson was tied up and tortured in a closet,by his moms boyfriend, hits a little close to home.

I think there's more to this story then we know just yet. Couldn't a 15 month old child get out of a blanket that was simply wrapped around them? Was she bound by something other than that? Was she conscious when she was put into the closet?

I'm sorry Sly's, that's so sad.

A Glendale man accused of killing his girlfriend's baby daughter by wrapping her in a blanket and putting her in a closet has been investigated on prior child-abuse accusations, authorities said.

Miguel Garcia, 22, was booked Thursday into the Fourth Avenue Jail. Garcia, who is being held on a $450,000 bond, faces charges of first-degree murder, second-degree murder, child abuse and manslaughter.

A probable cause statement from the Maricopa County Attorney's Office said Garcia was baby-sitting his girlfriend's four children on Dec. 11 at an apartment near 59th Avenue and Bethany Home Road while she was at work. Authorities said Garcia initially told officers that he found 15-month-old Aleigh Torres unresponsive and making "gurgling noises" about five minutes after putting her in an empty bedroom to take a nap.

He said he then took her to the home of a neighbor, who called 911. A dispatcher instructed the caller on how to perform CPR while rescue workers were en route, but the child was pronounced dead on arrival at Maryvale Hospital at 51st and Campbell avenues in Phoenix.

Court documents say Garcia and the child's mother, Karrie Scrivano, have prior run-ins with police that prompted investigations by Child Protective Services in 2010.

Upon learning of Aleigh's death, CPS officials removed the three other children, ages 2, 5 and 6, and placed them in foster homes.

"Later Sunday night, detectives were contacted and told that one of the kids had been talking to her foster mother about what happened," court documents said. "She made statements indicating that Miguel Garcia got angry at Aleigh for crying. He then wrapped her in a blanket and put her in the closet. When Aleigh was removed from the closet she was blue in color and unresponsive."

When authorities interviewed the other kids, they reported hearing their sister's cries from inside the closet, but Garcia had told them "not to open the closet door, not to touch Aleigh, and not to let her out."

When police brought Garcia to police headquarters Thursday and confronted him with the accusations, investigators said he admitted to wrapping her in a blanket and putting her to sleep "face down" in the closet "because it was a quiet place."

Police said Garcia told them he had done the same thing once in the past.

"Miguel acknowledged that the kids woke up early that day, and he was trying to get them to sleep so he could take a nap also," the document said.
