The second of four Columbus women convicted of killing a man while fleeing the Upper Valley Mall in a hit-and-run accident will be released from prison today.

About 11 a.m. today, Clark County Common Pleas Court Judge Douglas Rastatter signed an order for Mahogany Patterson to be released from the Dayton Correctional Institution, Patterson’s attorney Paul Kavanagh said.

Kavanagh said Patterson should be being released later today.

Her release comes days after her co-defendant ToneishaGunnell’s conviction was overturned by the Supreme Court. In a 4-3 decision, the court ruled that Rastatter erred when he declared a mistrial in Gunnell’s 2007 trial. That error violated Gunnell’s rights against double jeopardy – a rule that forbids someone being tried twice on the same charge – when she was convicted in 2009.

In 2010, Patterson took a plea deal and was sentenced to 10 years in prison. Patterson and Gunnell along with Alicia McAmont and RenadaManns were accused of stealing a car in Columbus on June 7, 2005, and taking $3,500 worth of clothing from Macy’s at the Upper Valley Mall. With store security in pursuit, the four allegedly sped away, hitting and killing John Deselem as he either stepped off the curb or attempted to stop them.

Gunnell and McAlmont were sentenced to 18 years to life in prison. Both appealed their sentences on the same grounds. But McAlmont is still waiting to be released.

Manns pleaded guilty in 2010 and dropped her appeal in the case. She was sentenced in 2010 to 11 and a half years.

Here is another case that is hard for me to digest as being right. These girls stole a car, was stealing clothing in Macy's and then hit and killed an innocent man at the Mall and they are being released. This man and his loved ones are the victims here, not these four girls. angry

COLUMBUS, Ohio —

The Supreme Court of Ohio ruled today that the retrial and conviction of a Columbus woman on charges of murder and other offenses in Clark County violated her right against double jeopardy.

In September 2010, Toneisha Gunnell, one of four women convicted twice in a fatal hit-and-run at the Upper Valley Mall in Springfield, was released from prison by order of an Ohio Court of Appeals.

Gunnell was one of four women convicted twice in the hit-and-run death of John Deselem at the mall in 2005.

The Second District Court of Appeals ordered Gunnell’s release on the basis of double jeopardy, and the Clark County’s prosecutor appealed the ruling to the Ohio Supreme Court.

In a 4-3 opinion authored by Chief Justice Maureen O’Connor, the court affirmed a decision of the Second District Court of Appeals that vacated the convictions of Gunnell which agreed with the lower court and upheld the decision

Gunnell’s attorney told News Center 7 that Gunnell could be released from Dayton Correctional Institution as soon as this morning.

in June of 2005, Gunnel and three others, Alicia McAlmont, Renada Manns and Mahogany Patterson, stole thousands of dollars worth of clothes from the Springfield Macy’s, according to reports.

As they fled, their car hit and killed Deselem in the parking lot of the Upper Valley Mall.

They were tried a total of three times. The first trial was thrown out on appeal. The second was declared a mistrial and all were convicted at the third trial last year.

Manns and Patterson pleaded guilty and are serving prison time. Their deals gave up their rights to appeal.

If the first trial was thrown out on appeal then they can be tired again legally, if the second ended in a mistrial then I do not understand why at the third trial it's double jeopardy. What am I missing here? Besides the fact that the victim's rights once again don't seem to matter.

Raine, I don't understand it either. Just like I do not understand another trial here a while back where the Ex-Prosecutor, James Berry that hit a man in the road and killed him, kept going and he got off. If that would have been just anyone, they would be in prison.

I just don't understand all of this legal stuff I guess.

Those girls took off after they hit that man, I remember it clearly in 2005. They announced on the TV that there was a manhunt for them. We were getting ready to leave our house and I was very afraid to do so. I was not sure exactly what way they went and yes it could have been close to us. Really wasn't all that far anyways.

I think it is terrible though that they are getting off.
