A former Pleasant Grove doctor convicted of murdering his wife by drugging her and drowning her in a bathtub will appeal the decision handed down by jurors last weekend, his attorney said.

But before that happens, Martin MacNeill has other legal battles to fight. He is scheduled to return to a Provo court on Monday to answer other criminal charges.

“There will be an appeal, but I’m not going to do it,” defense attorney Randall Spencer said, adding that it’s not common or “prudent” for the attorney who handled the original case to also handle an appeal.

MacNeill, 57, does not yet have another attorney, and he doesn't have any money to pay fees, so “it’ll have to be somebody that does it pro bono or the public defenders,” Spencer said.

Prosecutors charged MacNeill with his wife’s death in 2012, five years after 50-year-old Michele MacNeill was found unconscious in the tub by her then 6-year-old daughter.

Just after 1 a.m. Saturday, a jury of five men and three women convicted MacNeill of murder and obstruction of justice, agreeing with prosecutors who said he overdosed his wife on painkillers and sleeping pills before holding her head under the water.

Sentencing is set for Jan. 7, 2014. MacNeill, the former clinical director of the Utah State Developmental Center, faces a possible prison term of 15 years to life on the murder charge and a term of one to 15 years for obstruction of justice.

Prosecutor Chad Grunander said such appeals are not uncommon.

“I think in almost any murder conviction case that goes to a jury, there’s going to be an appeal,” the deputy county attorney said. “I think we have a very strong record for appeal purposes.”

But sentencing and a pending appeal aren’t the only court appearances in MacNeill’s future. On Monday he’ll be back for a hearing in a separate sexual abuse case.

MacNeill's daughter Alexis Somers — the state’s star witness in the murder trial — has accused him of sexually abusing her in the months following her mother’s death. KSL does not typically name victims in sexual abuse cases, but Somers has previously spoken to reporters about the case.

MacNeill is charged with forcible sex abuse, a second-degree felony, and tampering with a witness, a third-degree felony. The case was initially dismissed and then refiled the same year about the same time MacNeill was charged with identity theft in federal court. That case resulted in a conviction and a four-year prison sentence.

Spencer also represents MacNeill in the sex abuse case. Judge Samuel McVey will hear oral arguments on a motion to continue Monday. A two-day jury trial is currently scheduled to begin Dec. 3.

“I just can’t do that trial in December. I’m emotionally and physically exhausted. I need some time to recuperate,” Spencer said Wednesday. “So the judge will hear my motion to continue and we’ll plan from there.”

Prosecutors intend to move forward with the case despite the murder conviction, said David Sturgill, the prosecutor in the sex abuse case.

“I’m willing to negotiate (a plea agreement) now,” said Sturgill, adding that MacNeill had not been willing to make a deal in the past. “If it’s a choice between dismissal and going forward, I’m ready to go forward, and I think Alexis is, too.”

Any decision about a plea agreement would be up to MacNeill, Spencer said.

In September of 2007, Somers filed a police report claiming there were two incidents of abuse in the three months following her mother’s death. In late May, she was asleep in her parents' bed when she woke to find her father fondling her and kissing her hand, charging documents state. He was supposed to have been sleeping on a couch.

Jumping from bed, Somers asked MacNeill what he was doing. “I’m sorry, I thought you were your mother,” he replied, according to the charges.

A similar incident allegedly occurred two months later during a family trip to California. Somers told police her father later apologized, but she feared her young sisters may not be safe in the home and sought legal custody of the four adopted girls.

During the custody fight, Somers recorded her telephone calls with MacNeill. In one exchange, MacNeill said he would let Somers have the girls if she agreed to sign a notarized statement denying that he had ever touched her inappropriately, court documents state. Somers refused, and in the ensuing argument MacNeill said he “was asleep when I did that,” the charges state.

In a police interview, MacNeill refused to answer questions, but upon hearing the allegations, he uttered: “A person can not be held accountable for their actions while they are asleep,” court papers say.

According to a separate police report, MacNeill told his daughters that “even though his wife is dead, he is still a sexual person and has desires that need to be met."

In his first appearance in court since being convicted of his wife’s murder, Dr. Martin MacNeill sat, chatting with other inmates until the judge called his case.

Then, his lawyer surprised the court by asking to withdraw from the forcible sex abuse case, where Dr. MacNeill is accused of groping a woman.

Randy Spencer said that while working on Dr. MacNeill’s murder trial, he became privy to his client’s emails. He found an email that he believes is exculpatory for his client — and it puts him in the position of being an attorney and a witness.

“I’m not saying I don’t want to represent my client,” Spencer told FOX 13 outside of court. “Not at all. I was just raising an issue that could potentially cause me to be a witness.”

Fourth District Court Judge Samuel McVey refused to let Spencer withdraw from the case, ordering both prosecution and defense to stipulate how the email would be used at trial. He did, however, grant Spencer a break — delaying the trial until February.

Spencer said outside court that the trial had been “grueling” for him.

Deputy Utah County Attorney David Sturgill said he respected the judge’s decision.

“The alleged victim in this case has been anxiously waiting for this case to be resolved for five, six years now. We’re a little disappointed it’s been continued,” he said.

The forcible sex abuse case was filed before Dr. MacNeill was charged with murder. It was then dismissed and refiled in 2009. Sturgill denied that the Utah County Attorney’s Office was continuing to prosecute it, just in case Dr. MacNeill’s murder conviction was overturned on appeal.

“No, it’s not an insurance policy at all,” Sturgill told reporters outside court. “The evidence hasn’t changed at all, it was just looked at with new eyes.”

Dr. MacNeill was convicted two weeks ago of murder and obstruction of justice in the 2007 death of his wife, Michele, so he could continue an affair with another woman. Prosecutors alleged he drugged her as she recovered at home from plastic surgery, lured her to a bathtub and drowned her.

Asked by FOX 13 how his client was doing, Spencer said: “Not well.”

Martin MacNeill was scheduled to stand trial for the second time this year starting Dec. 4, but his two-day trial for one count of forcible sex abuse has been pushed back to next year.

Randy Spencer, MacNeill's defense attorney, asked Fourth District Judge Samuel McVey to move the trial back to give him time to "recover both emotionally and physically" from MacNeill's four-week murder trial and also to give him time to prepare several legal motions in the case.

Spencer told McVey he could potentially be a material witness in the case because he is the only one who has seen an email written to MacNeill from his daughter Alexis Somers, which Spencer said Somers has denied writing in past hearings. Spencer said if that were the case, he would have to withdraw as MacNeill's attorney.

McVey said he wasn't inclined to let Spencer withdraw from the case and hopes that the defense and prosecution can come to some sort of agreement about the evidence.

Prosecuting attorney David Sturgill said that he didn't have any specific legal objections to the motion to continue but said delays are always detrimental.

"This case has been around quite some time," Sturgill said. "It is no secret memories fade, key witnesses become unavailable."

Spencer told media outside the courtroom the case was originally filed in 2007 but was dismissed just weeks before trial in 2008 because the state believed they didn't have enough evidence. Spencer said the case was then refiled when federal charges were brought against MacNeill in 2009. The charges were refiled in January 2009, but the case took a three-year hiatus while it was considered by the Utah Court of Appeals. Spencer said he argued in his appeal that the state hadn't produced more evidence since they dismissed the charges, but in September 2012 the appellate court ruled that MacNeill could stand trial.

MacNeill was originally charged with forcible sex abuse, a second-degree felony, and witness tampering, a third-degree felony, but Spencer said in court on Monday that the witness tampering had been dismissed, even though court records indicated MacNeill is still facing prosecution for that charge.

The trial has been moved to Feb. 4, but MacNeill will be back in court on the sex abuse case on Jan. 6 for a pre-trial conference, the same week he is scheduled to be sentenced for murder and obstruction of justice.

MacNeill was convicted of murdering his wife by a jury on Nov. 9 after a four-week trial. Spencer said MacNeill hasn't been doing well since the verdict came in.

"It is very tough on him to be convicted of something he always professed he didn't do," Spencer said.

MacNeill faces 15 years to life in prison on the murder charge and one to 15 years on the obstruction of justice charged when he is sentenced on Jan. 9th.

A judge ordered convicted wife-killer Martin MacNeill to undergo a mental competency evaluation, derailing his upcoming trial on sex abuse charges.

At the beginning of the hearing on Tuesday, Fourth District Court Judge Samuel McVey announced that a new ruling by Utah’s Court of Appeals essentially required him to order the mental health evaluation.

“Any time that trial counsel raises a bona fide doubt as to a defendant’s competency to stand trial, the trial court is required to order a full hearing into competency,” McVey announced. “So the court has no choice when that has happened.”

Last week, MacNeill’s defense attorney, Randy Spencer, filed a petition raising questions about his client’s mental state. Utah County prosecutors objected, suggesting it was a delay tactic to avoid the upcoming trial where MacNeill is accused of groping a woman.

Judge McVey’s decision halts the sex abuse trial, slated to begin next week. It was unknown late Tuesday if it were to affect his upcoming sentencing for the 2007 murder of his wife, Michele. Dr. MacNeill was convicted in a month-long trial of murder and obstruction of justice, accused of drugging and drowning her.

Shortly after being convicted, Dr. MacNeill attempted suicide by slashing his femoral artery with a disposable razor. Since then, Spencer said, his client’s mental state has deteriorated.

Outside of court, Michele’s family appeared frustrated by the delay.

“I think it’s ridiculous but, you know, that’s what the law states,” said the MacNeill’s daughter, Alexis Somers. “I don’t want this to come up in appeal later on, but he uses this mental illness card whenever it suits him.”

In court, Dr. MacNeill chatted with Spencer and then stared ahead as the proceedings went on. Judge McVey issued an unusual order prior to the hearing, forbidding TV cameras from filming the defendant in court.

“We have a motion for a change of venue for publicity and trial set in two weeks,” he wrote. “The court wishes to avoid current picture of defendant on television pending trial. Will allow video of trial, however.”

Given the fact that he 1) Killed his wife. 2) Introduced his lover to his children as the "New Nanny" 3) Moved her into the house he once shared with his murdered wife. 4) Falsified paperwork using the date of his wife's funeral as a wedding date for he and his lover. 5) Used his adopted daughter's identity 6) Allowed his lover to wear his deceased wife's clothing to COURT! 7) Sexually assaulted one of his daughters then claimed he mistakenly thought she was his wife.
Is there any doubt the guy is a nutcase?

On Monday, a competency review began in a separate case that is preventing Martin MacNeill from being sentenced for killing his wife.

Although it’s been almost five months since MacNeill, 57, was convinced of first-degree felony murder and second-degree obstruction of justice in the death of his wife, Michele MacNeill, sentencing was put on hold because of competency issues in a 2007 forcible sexual abuse case.

The former Pleasant Grove doctor’s previous court date with 4th District Judge Derek Pullan was delayed while MacNeill’s competency is probed in relation to a charge of forcible sexual abuse for allegedly putting his hands down an adult female relative’s pants.

MacNeill’s attorney, Randall Spencer, said MacNeill’s mental and physical health have deteriorated while he has been on suicide watch at the Utah County Jail and that his client has been unable to help him prepare for trial in the sexual abuse case. On Jan. 28, 4th District Judge Samuel McVey canceled MacNeill’s sex abuse trial and ordered a review from two mental health experts.

Provo • A competency review for Martin MacNeill, a former doctor recently convicted of killing his wife, was delayed Monday after mental health experts said they needed more time to evaluate the man.

MacNeill’s attorney, Randall Spencer, asked for the competency evaluation in January, arguing that his client’s mental and physical health have deteriorated while he has been on suicide watch at the Utah County jail. He questioned whether MacNeill can help him prepare for trial in a sexual abuse case unrelated to the murder case involving his wife, Michele MacNeill.

In the sex abuse case, MacNeill, 57, is charged with one count of forcible sex abuse, stemming from accusations that he put his hands down an adult female relative’s pants in 2007.

In late January, 4th District Judge Samuel McVey cancelled a February trial in the sex abuse case and ordered for two mental health experts to evaluate the former doctor. But on Monday, McVey said the Department of Human Services reported that they needed 35 more days to complete the evaluation.

An April 28 date was set instead for the competency review.

Competency issues in Martin MacNeill’s sex abuse case also has halted all court proceedings in the murder case. Although it’s been almost five months since Martin MacNeill was convicted of first-degree felony murder and second-degree felony obstruction of justice in the death of his wife, a sentencing date has not been set because of the competency evaluation.

This latest delay in the sex abuse case, which was filed nearly five years ago, has been frustrating for Michele MacNeill’s family.

"I’m just tired of it," said Linda Cluff, Michele MacNeill’s sister. "I’m getting fed up with it."

Spencer wrote in a motion that Martin MacNeill — who has suffered from schizophrenia and bipolar disorder since his late teens — has been kept in isolation since he attempted to cut his femoral artery on Dec. 5.

"Frankly, I think it’s miraculous he wasn’t successful," Spencer said outside of court.

Spencer said his client is only given a robe to wear and sleeps on a thin mat under bright lights while kept in isolation. These conditions have led to Martin MacNeill’s deteriorated mental and physical health, according to the attorney.

In the murder case, Spencer filed a motion to arrest judgment, arguing that a federal inmate lied on the stand about a possible early release he received in exchange for his testimony, and that prosecutors did not disclose that a deal was in the works.

Prosecutors countered that no "secret deal" had been planned, and implied that the inmate may have been released, in part, due to concerns for his safety after Spencer addressed the inmate by name inadvertently during the trial — which was being broadcast live by CNN.

The federal inmate testified during MacNeill’s four-week trial that the defendant confessed to him that he drugged his wife, 50-year-old Michele MacNeill, and then drowned her a bathtub at their Pleasant Grove home on April 11, 2007.

Arguments regarding the motion to arrest judgment were cancelled last month, and an April 3 date was set instead for oral arguments.

Dr. Martin MacNeill, convicted of killing his wife and now facing a sex abuse charge, has been found mentally competent to face trial.

At a hearing Monday afternoon here in Fourth District Court, Judge Sam McVey set a July 2 trial date after two evaluations found Dr. MacNeill mentally able to assist with his defense. Questions about his mental state were raised after he attempted suicide inside the Utah County Jail last year.

“I’m just anxious to get this over with and to move on and have all this behind us,” said Alexis Somers, Michele MacNeill’s daughter.

Defense attorney Randy Spencer sought to delay the trial, telling Judge McVey he had numerous motions pending in the case. The judge insisted that a trial date be set.

Those motions include an accusation that Utah County authorities destroyed an audio recording of an interview with the alleged victim, and a request by Spencer that he be paid.

Somers said it was another attempt to delay the trial.

“This happened seven years ago and there’s been delay after delay after delay and Judge McVey sees through some of Randy’s stunts,” she told FOX 13.

Meanwhile, Utah County prosecutors said they were hoping to proceed with sentencing for Dr. MacNeill over the murder of his wife, Michele. Last hear, he was convicted by a jury of drugging and drowning her inside their home in 2007.

Defense attorneys have filed a motion to arrest judgment, claiming that an inmate witness cut a deal with prosecutors and it should have been disclosed. Prosecutors were confident they would proceed with sentencing.

“We look forward to arguing our case. We’ve argued it in writing, we’ll argue it in court and we’re confident that we will prevail,” said deputy Utah County Attorney Chad Grunander.

Doctor guilty of killing wife faces sex-abuse case

PROVO, Utah (AP) — A Utah doctor convicted of killing his wife will go to trial next month on a sex abuse charge after a judge on Monday refused his attorney's request to dismiss the case because investigators lost a recording of an interview with the accuser.

Martin MacNeill, 58, is charged with forcible sexual abuse of an adult relative in a 2007 incident prosecutors said happened one month after his wife was found dead. He maintains his innocence.

The former doctor was found guilty of murder in November for the death of his wife, Michele. MacNeill overmedicated her after a face-lift and left her to die in a bathtub, prosecutors said. MacNeill's attorneys said she could have died of natural causes. No cause of death was determined.

That trial generated widespread publicity nationwide, leading MacNeill's attorney, Randy Spencer, to ask Monday for a change of venue for the sex abuse trial next month. Fourth District Judge Samuel McVey denied the request, saying prospective jurors in other large counties in the state are just as likely to be familiar with the case.

As for the lost recording, Spencer argued Monday in a Provo courtroom that it is vital evidence and said authorities were grossly negligent for misplacing it.

"That's the kind of conduct our criminal justice system cannot tolerate," Spencer said of the lost seven-year-old tape.

David Sturgill of the Utah County Attorney's Office acknowledged that there is no excuse but said it didn't necessitate dismissing the case.

McVey said authorities were negligent in losing the tape but didn't see proof it was done on purpose or in bad faith. In denying the motion, McVey said a detective's written report of what the accuser said provides an adequate recap.

The Associated Press doesn't normally identify alleged victims of sexual crimes.

MacNeill sat silent and motionless in court Monday, wearing a red- and white-striped prison jumpsuit. He only spoke at the end of the hearing, when he mentioned to Spencer to ask the judge to give him permission to shave and shower for the trial, set for July 2.

McVey granted the request. In December, MacNeill left a suicide note and slit a major leg artery with a disposable razor, court documents show. Utah County jail officials intervened to save his life.

During Monday's hearing, Sturgill said the victim will testify that she confronted MacNeill about the sex abuse the day after it happened. She will recount how MacNeill acknowledged committing the act, apologized and said he thought the woman was his dead wife, Sturgill said.

Outside court, Spencer declined to comment on the allegations that MacNeill said he believed the woman was his dead wife.

MacNeill is still waiting to be sentenced in the murder case due to several motions that have caused delays.

A woman who claims she was sexually abused by convicted wife-killer Dr. Martin MacNeill tearfully testified about the encounter at his latest trial.

The woman, whom FOX 13 is not naming because she is an alleged victim of sexual abuse, said the abuse happened about a month after Michele MacNeill died back in 2007. Not sure why her name is being retracted from this article. Her name and claim against HER FATHER has been widely publicized.

“She was murdered,” the woman testified of Michele, crying.

The alleged victim said she was cleaning out Michele’s things from her bedroom while Martin MacNeill watched TV. She fell asleep, fully clothed, on the bed when she was awakened.

“I could feel (Martin MacNeill’s) hand rubbing my buttocks. He had one of my hands, my left hand, he was licking it and kissing it,” the woman testified.

The woman said she slapped his hand away and asked him: “What are you doing?”

“He said, ‘Oh, oh, I’m sorry. I’m sorry,’” she told the jury. “He said, ‘I thought you were (Michele).’”

The woman testified that she left the bedroom and slept in another room.

“I was disgusted,” she said. “That was just another horrible thing to have to worry about now.”

A five woman, three man jury has been selected to hear the latest trial for Dr. MacNeill, who was convicted last year of killing his wife, Michele, so he could continue an affair with another woman.

Prosecutors accused the Utah County doctor of drugging and drowning Michele inside their Pleasant Grove home in 2007.

PROVO — After deliberating for just over two hours, a jury of five women and three men on Thursday found convicted wife-killer Martin MacNeill guilty of sexually abusing his own daughter.

Dr. MacNeill showed no emotion as the verdict was read. His accuser, Alexis Somers, hugged her relatives as she sat in the courtroom.

FOX 13 typically does not name sexual abuse victims without their consent. However, after her testimony Thursday, Somers said she wished to speak about the case, calling her father “a murderer and sexual predator.”

“I’m relieved. It was the right verdict. He’s a sexual predator and there’s some justice,” Somers told reporters outside court.

Somers claimed her father had sexually abused others, but she refused to elaborate.

In her testimony, Somers claimed she had been cleaning out her mother’s bedroom after her death in 2007 when she fell asleep on the bed. She said she was awakened by her father, who had his hand down her pants, groped her buttocks and was “licking and kissing” her hand.

Under cross-examination Thursday, defense attorneys claimed Somers had a vendetta against her father — accusing him of murdering her mother, Michele. MacNeill’s defense attorney, Randy Spencer, noted that she waited to report the abuse until she was going to lose custody of her siblings.

“I was feeling panic, horror, fear that my sisters were not safe,” she told the jury. “They were at the home of someone who just murdered my mom.”

Somers’ sister, Rachel MacNeill, also testified against her father claiming that during a family meeting shortly after the incident, Martin MacNeill admitted “something had happened.”

Spencer also questioned Rachel’s account, saying she did not report the alleged abuse to anyone. He pointed to an email where she raised concerns about a “nanny” his father had hired, a woman who turned out to be his mistress.

“You don’t mention any sexual things,” he told her.

“Or him murdering my mother,” she snapped back.

Dr. MacNeill was convicted last year of drugging and drowning his wife, Michele, so he could continue an affair with another woman. He faces up to life in prison when he is sentenced on that charge.

MacNeill faces up to 15 years in prison on the sex abuse charge. Outside court, Spencer told FOX 13 he anticipated an appeal.

“Of course he’s very disappointed,” Spencer said of MacNeill. “Not terribly surprised in the way he’s been treated in the judicial system, but he’s very disappointed.”

UPDATE: Convicted Killer Martin MacNeill Found Guilty Of Sexual Abuse ! Empty Sex Abuse Sentencing For Martin MacNeill Delayed

PROVO, Utah — Sentencing for Dr. Martin MacNeill, convicted of forcible sex abuse, has been delayed.

Both prosecutors and defense attorneys agreed to the delay on Monday. Prosecutors requested time to respond to a new defense motion to toss the case.

Alexis Somers, the victim in the case, left the courthouse frustrated.

“We just want to move on and we want him to face justice,” she told FOX 13 as she walked out with her aunt, Linda Cluff.

Somers accused MacNeill of groping her back in 2007, shortly after the death of her mother. Defense attorney Randy Spencer claimed that a tape-recorded interview that police did with her was lost, and a police report summarizing that interview was handed over far too late.

“That made it impossible for us to use Alexis’ own statements to cast reasonable doubt which i believe was abundant during the case,” he said.

Spencer has asked for the entire sex abuse case to be dismissed.

“I don’t believe we can have a new trial that would guarantee my client a fundamental fairness in the system when the police department has lost the most critical piece of information for a defendant who has been charged with a he said-she said type of case, that being the recorded statement of the alleged victim,” he told FOX 13.

Utah County prosecutors left the courthouse declining to comment.

MacNeill is also awaiting sentencing in the 2007 murder of his wife, Michele. Prosecutors contend he drugged and drowned her inside their Pleasant Grove home, so he could carry on an affair with another woman.

FOX 13 typically does not name sex abuse victims, but after her father was convicted she chose to speak publicly about it.

“I definitely want closure and I know there’s a lot of other people out there who have been victimized by my father who would like to see him held accountable and get some of that closure as well,” Somers said.
