A former Los Angeles County sheriff's deputy is scheduled to go on trial Monday on charges he tortured, beat and sexually assaulted his wife and another man he believed to be her lover, leaving the man brain damaged, and mutilating both for life, prosecutors said.

Robert A. McClain's trial is slated to begin Monday in a Santa Ana courtroom more than three years after he is accused of tricking his wife into introducing him to the man. He then held the couple captive overnight at an Irvine apartment complex, where he beat them, forced them to undress at knife point and ordered the woman to castrate her younger suitor, according to prosecutors.

McClain, 38, in 2008 was a sworn deputy when he allegedly sodomized his wife and chopped off her hair with the knife, prosecutors said. The ex-Marine faces potential multiple life sentences if convicted of the mayhem, torture, kidnapping and sexual assault charges.

With McClain having entered pleas of “not guilty” and “not guilty by reason of insanity,” the trial will be held in two phases. During the initial phase jurors will hear evidence about the alleged crimes and the prosecution must prove beyond a reasonable doubt that the defendant is guilty of those crimes.

If McClain is convicted, the case would go to the second phase, the sanity phase, in which the same jury considers evidence to determine if the defendant was legally sane at the time of the crime.

For McClain to be considered legally insane, the defense must prove that the defendant had a mental disease or defect when he committed the crime and that this defect kept him from understanding the nature of his act or that it was morally or legally wrong.

Prosecutors said the nine-hour ordeal began about 9 p.m. on Sept. 28, 2008, when McClain's wife told him she was leaving him for the younger man, whom she met while working in the leasing office of the apartment complex where he lives.

McClain then used a ruse to persuade his 31-year-old wife to introduce him to the 23-year-old man.
During the course of the attack, McClain allegedly forced both victims to undress and then tried to force his wife to "orally copulate both him and [the other man]," according to prosecutors. McClain also wielded a gun during the ordeal. McClain also ordered his wife to castrate the younger man, and she "fearfully pretended to follow his instructions," prosecutors said.

Prosecutors said the younger man suffered several knife wounds to his groin area. McClain also allegedly urinated on the victims and sodomized the man with a knife, prosecutors said.

After slashing the man's face with the knife, prosecutors said, McClain fled the scene, forcing his wife to go with him. McClain then sexually mutilated his wife with the knife, chopped off her hair, and ultimately drove her back to their Irvine home, prosecutors said.

The next morning at 5 a.m., the wife was able to escape the house with the couple's four children and drive to a nearby hospital for help, authorities said. A cleaning crew discovered the other victim in the leasing office of the apartment complex about two hours later and called 911.

At the time of the attack, the male victim's aunt told The Times, "I think my nephew came across pure evil. It is hard to believe that there is that much anger and hate in someone."

Both victims are still suffering the aftereffects of the savage attack, prosecutors said. The man suffered brain damage, several bone fractures in his face, excessive blood loss and numerous stab wounds.

His mouth had to be wired shut and he spent months re-learning to walk and talk, according to prosecutors. The wife also suffered several injuries, prosecutors said.

A Southern California woman gave graphic testimony Tuesday in the torture trial of a former sheriff's deputy accused of ordering her to castrate her lover during a savage assault.

The woman was married to defendant Robert McClain, a former Los Angeles County sheriff's deputy, at the time of the vicious attack, and pretended to castrate her 23-year-old boyfriend as the husband watched, prosecutors previously said.

Through tears, the woman told jurors that she pleaded with her jealous husband to stop his violent two-hour rampage in September 2008 for the sake of his career and their children, the Orange County Register reported.

McClain didn't listen, she reportedly testified, and instead beat her boyfriend to the point of brain damage and slashed his body with a knife.

The unidentified woman said her enraged hubby tried to have sex with her, ordered her to have sex with the badly injured boyfriend and demanded the castration as a sick form of retribution.

According to the Register, the woman told jurors that McClain, 38, was fully aware he was committing a crime when he ambushed and assaulted the couple at the Irvine, Calif., building where the wife worked and the boyfriend lived.

The younger wife was 31 at the time of the attack and had just asked for a divorce, prosecutors said.

"I am gonna do at least 15 years in jail for this," she quoted her former husband as saying, the Register reported.

"I am gonna get it while I can" he reportedly said, referring to the sex demand.

McClain is charged with aggravated mayhem, torture and sodomy and faces up to life in prison if convicted, the Orange County District Attorney said.

The woman testified she had no idea her 245-pound, ex-Marine husband was planning an attack when he asked to meet her boyfriend in person shortly before 10 p.m. that September night.

"All I am gonna do is shake his hand," she said he told her, according to the Register.

Once the meeting started, the lovers were quickly overpowered, guided to a back lunchroom of the building's leasing office and forced to undress at knifepoint, prosecutors previously said.

The wife said McClain showed no mercy for the much smaller, 145-pound boyfriend, an aspiring musician who had moved from Missouri and auditioned for "American Idol."

"Look at this white boy," she quoted McClain as saying, according to the Register. "You're cheating on me for this? This is what you're leaving me for?"

While her boyfriend never resisted, he screamed in pain and seemed to fade in and out of consciousness, she said.

She said McClain beat and slashed her when she tried to shield him.

The wife said McClain also gave her a gun and ordered her to try four times to shoot either him or the boyfriend.

She said she pointed it in the general direction for three tries and then at McClain for the fourth - but the gun had no bullets.

McClain became enraged at her choice of target and beat them further with the butt of the gun, she reportedly said.

McClain then forcibly sodomized the wife, chopped off her hair with the knife and forced her back into their car as he fled the scene, prosecutors said.

She managed to escape with the couple's children around 5 a.m. the next morning, authorities said, and a cleaning crew found the boyfriend in the office two hours later.

The boyfriend reportedly suffered several bone fractures and numerous stab wounds and needed intensive therapy to relearn basic skills.

McClain has pleaded not guilty by reason of insanity

IRVINE, Calif. (KTLA) -- A former L.A. County Sheriff's deputy convicted of raping and torturing his wife and her lover has been sentenced to 4 consecutive life terms in prison.

The handed down the sentence Friday, saying Robert McClain exhibited "callousness" and "extreme violence" in an hours-long attack on his wife and her lover.

"This is one of the worst things I have seen in a long time," Superior Court Judge Gary Paer said at McClain's sentencing.

The jury deliberated less than two hours before agreeing Robert McClain was sane during the attack the night of Sept. 28, 2008 in an Irvine leasing office break room.

McClain, who is also a former Marine, had pleaded not guilty by reason of insanity to the Sept. 28, 2008 attack.

He was convicted in May of aggravated mayhem, torture, forcible oral copulation, spousal rape, sodomy by force and false imprisonment.

Prosecutors say the attack took place after McClain's unidentified wife announced she was leaving him for a 23-year-old man who lived in the Irvine apartment complex where she worked.

McClain asked his wife to take him to meet the young man.

The two of them went to the young man's apartment about 10 p.m., but McClain then led the pair to the leasing office, which has a kitchenette area, Orange County District Attorney spokeswoman Farrah Emami said.

Court records allege McClain repeatedly punched and kicked the victims and forced them at knife-point to undress and ordered them to engage in a sex act.

At one point, prosecutors said, the deputy ordered his wife to castrate the young man.

She "fearfully pretended to follow his instructions," Emami said.

McClain then used the knife to repeatedly slice the man's face.

Authorities say the attack spanned nearly nine hours.

Once they left the leasing office, McClain allegedly forcibly sodomized the woman, chopped off her hair with the knife and then drove her back to their Irvine home, Emami said.

Police were called to the leasing office around 7:30 a.m. on Monday by a cleaning crew.

They found the 23-year-old victim bleeding and unconscious on the floor.

While investigating the attack on the man, police learned that the deputy's wife had driven herself and her 4 children to a hospital around 5 a.m. where she reported the assault.

The father of the injured man said his son's face was beaten so severely that he could hardly recognize him.

Both victims are still suffering the effects of the savage attack, prosecutors said.

The man suffered brain damage, several bone fractures in his face, excessive blood loss and numerous stab wounds.

His mouth had to be wired shut and he spent months re-learning to walk and talk, according to prosecutors.

The wife also suffered several injuries.

I had heard about this case since it happened right here but had never heard the details of this cruel and vicious attack. And this was a L.A. County Sheriff Deputy, no way does he ever deserve to be outside of those four walls. We have a lot of shooting/beatings by cop here in L.A. and it looks like we just got rid of one evil one.
