10-Year-Old Girl Dies in After-School Fight Over a Boy

This is one of those stories that makes me want to lock up my children and never let them leave the house again, or move to a deserted island where no one could ever harm them. Something, somewhere where things like the tragic senseless death of 10-year-old Joanna Ramos aren't possible.

It happened in Long Beach, California, one day after classes at Willard Elementary School in February. According to the Los Angeles Times, Ramos and an 11-year-old schoolmate were reportedly arguing over what many fourth grade girls argue over -- a boy. They planned to meet after school and fight it out in an alley near the school, and that's when the plan went horribly wrong.

The whole fight lasted only about one minute, according to reports, and while a few punches were thrown, both girls headed home to their respective families shortly thereafter. Hours later, however, Ramos was dead from blunt-force head trauma.

The story is making headlines again because yesterday, it was announced that while her death was ruled a homicide, prosecutors won't file any charges against the 11-year-old. And while Ramos's mother expressed frustration over this move, it's difficult to see what good it would do anyway.

As horrible I feel for Ramos's family, I feel almost as awful for the 11-year-old who killed her. By all accounts both girls were fighting, and it could have easily gone the other way. Now she will have to live the rest of her life knowing that someone died at her hands. I can't even begin to imagine how one little mistake with such enormous consequences can forever alter someone's life. I image the struggle it must be to even go on for both families, though at least one still has their daughter there with them.

Was it an isolated freak incident? Sure, and tragic accidents happen every day to children, but this one doesn't shake me to my core any less. I think of my sweet, innocent 3-year-old daughter, and all of the hurdles and issues she will have to face in the future, and cases like this make it almost unbearable.

(Credit: CBS Los Angeles) (CBS/AP) LONG BEACH, Calif. - Prosecutors have decided not to bring charges against the 11-year-old girl who fought with a 10-year-old girl, who died following their after-school confrontation earlier this year.

In a statement Wednesday, police in Long Beach, Calif. said the Feb. 24 death of Joanna Ramos was a "fight between two children that ended with unintended and tragic results," but no crime was committed.

The Los Angeles County coroner's office previously labeled the case a homicide and said Joanna died of blunt force trauma to the head.

She was pronounced dead about six hours after she tussled with the 11-year-old girl in an alley near Willard Elementary School when classes ended.

"There's nothing they can do that's going to bring my daughter back, nothing. There's nothing I can do," Cecilia Villanueva said Wednesday, choking back tears.

Villanueva said she also felt for the other girl.

"Her life is not the same anymore. I'm not angry because it could have happened to the girl instead of to Joanna," she said.

Her family previously told The Associated Press that Joanna underwent emergency surgery for a blood clot on her brain and was resuscitated several times before she died.

The name of Joanna's 11-year-old combatant has not been made public.

Joanna's older sister, Vanessa Urbina, said Wednesday she was disappointed about the decision. The family knows little more about what prompted the fight than they did when it happened nearly two months ago, she said.

"There's nothing we can do, but I want charges on her," said Urbina, 17. "She killed my sister. She didn't mean to kill her, but she meant to hurt her."

The fight near the school didn't appear to be especially violent, no weapons were used, and neither girl was knocked to the ground, police have said.

Joanna had a bloody nose when she returned to her after-school program, according to witnesses, and had to be picked up early by a relative because she didn't feel well.

By the time Joanna got home, she was complaining of a headache and vomiting.

Before she passed out on the family's couch, she told her mother an 11-year-old girl had punched her in the head but refused to say more, Villanueva previously told the AP.

The death shook the school community at Willard Elementary, located in a working-class neighborhood just a few miles from a more affluent area of homes that front a bluff overlooking the Pacific Ocean.

LONG BEACH — Prosecutors declined Wednesday to file a charge against an 11-year-old Long Beach girl who fought with a 10-year-old classmate near their elementary school in February hours before the younger girl died.

The death of Joanna Ramos came after a "fight between two children that ended with unintended and tragic results," a Long Beach Police Department statement issued on Wednesday read.

Police referred all media inquiries to the Los Angeles County District Attorney's office. DA spokeswoman Sandi Gibbons said her office couldn't comment on the decision because the case involved a juvenile.

Joanna was pronounced dead on Feb. 24, about six hours after she fought with another girl in an alley across the street from Willard Elementary School, 1055 Freeman Ave., after school had ended for the day but before Ramos went to her after-school program.

Her mother, Cecilia Villanueva, said officials met with the still grieving family Wednesday morning, but she didn't know many details about the fight and chose not to ask because it was too painful.

"There's nothing they can do that's going to bring my daughter back, nothing. There's nothing I can do," she said, choking back tears.

Villanueva also said she felt for the other girl.

"Her life is not the same anymore. I'm not angry because it could have happened to the girl instead of to Joanna," Villanueva said.

The name of the 11-year-old wasn't released by police because she is a minor and because no charge was filed.

At the time of the incident, Ramos' family said the fight might not have been fair because Ramos, who moved with her family to Long Beach from Hawaiian Gardens about two years ago, was being bullied.

Villanueva said in February that her daughter came home from her after-school program early on Feb. 24 feeling nauseous and suffering from a headache. When she asked her what was wrong, the mother said, Ramos told her another girl, who she described as her enemy, had punched her in the head.

Villanueva described in heart-breaking detail how she sat helplessly in the back seat of the family's car and watched her 10-year-old daughter turn blue as her husband raced them to St. Mary Medical Center in a panic.

The Los Angeles County Coroner's Department ruled Ramos' death a homicide and cited the cause as blunt force trauma to the head. The autopsy report, however, remained under a security hold Wednesday, said Coroner's Chief Craig Harvey.

A friend of Ramos and fellow student at Willard Elementary said in February the fight was planned by the girls ahead of time at school.

"They were fighting over a boy. I told the teacher and she said she would talk to the (school) counselor and all the girls on Monday," said Stephanie Guadalupe Soltero.

She and other students said Ramos had to fight the 11-year-old, who they said had taunted Ramos with names and faces and had goaded her into the fight.

Multiple sources close to the investigation, however, told the Press-Telegram that it became clear in the course of the investigation that Ramos was the bully and it was the 11-year-old who was forced into the confrontation.

"In the end it's still just a playground fight that went horribly wrong," said one source, speaking on condition of anonymity.

News of the death stunned many in the neighborhood where the small school sits, near 10 th Street and Obispo Avenue.

Residents in the working-class community expressed surprise again Wednesday, after the decision to not file a charge was announced.

The school itself was closed Wednesday with the students and staff still on spring break. A spokesman for the Long Beach Unified School District declined comment on the decision and directed all questions to the District Attorney's Office.

Edgar Gonzalez, 31, who attended Willard as a child and now lives across the street from the school, said the 11-year-old who fought with Ramos should face some form of discipline.

"It's just very sad," he said. "Somebody should be held accountable - if not the little girl, then her parents. Parents have an influence on their children."

The death has also left Gonzalez with serious concerns for the safety of his son, who is scheduled to start preschool at Willard in July, he said.

Robin Huntley, whose grandson is in kindergarten at Willard, believes the 11-year-old should have faced a charge to discourage other children from resorting to violence.

"So if someone hurts my grandson, does that mean they won't be charged?" asked Huntely, whose family has owned her small, historic home in the neighborhood since 1901.

"We have to put a stop to this violence, but police are doing nothing," Huntley said. "It sends the wrong message to the community."

I can't believe the parents said this could have happened to the other girl. Well, it Didn't!! And, it just goes to show us that even though she did not fall to the ground, the punch or punches that were thrown were enough for this poor little thing to DIE!!!

Some of us have grandchildren that w/be starting school next year or are already in school and it scares the hell out of me!!

No kidding wrap. Their daughter payed for it with her life. The 11 yr old should not be allowed to get off free like it never happened. WTH are they thinking?
