The Trumbull County Children Services Board is being sued by the biological father of a toddler who was murdered by her foster mother while under CSB's supervision.
Thomas Cross, of Garrettsville, filed the federal lawsuit on Friday. He names Trumbull County CSB, commissioners, Trumbull County, the woman convicted of his daughter's murder, as well as two unnamed employees of CSB.
The first count outlined in the lawsuit is for deprivation of civil rights. Cross claims that on Nov. 4, 2008, Trumbull County CSB had his paternal rights terminated despite the fact he was not notified of the hearing. Cross claims in his lawsuit that during supervised visits with 21-month-old Tiffany Sue Banks Cross, he complained to CSB that she had bruising and there was dog hair in her baby formula, but the agency never responded to his concerns.
He also claims in his lawsuit that prior to Tiffany Sue's death on April 2, 2009, CSB was informed of other harmful acts perpetrated against children in the care of Tiffany Sue's foster mother, Bonnie Pattinson. On Nov. 4, 2009, Pattinson pleaded guilty to involuntary manslaughter for the child's death.
The lawsuit claims that the recent publicity surrounding the alleged rape of a 13-month-old girl by her parents during a supervised visit at CSB allowed Cross "to understand he could challenge both the severance of his parental rights and be appointed administrator of a child who died with a potential estate." The child who was allegedly raped was the sister of Tiffany Sue Banks Cross.
The second count of the lawsuit is for the wrongful death of Tiffany Sue and claims CSB showed indifference to the child and failed to properly train or supervise Pattinson.
Cross is seeking compensatory damages of more than $100,000, as well as punitive damages of $1 million.
The lawsuit was filed by David Engler, who also is representing Loretta Banks, the grandmother of the child who was allegedly raped while under CSB's care.
Trumbull County Commissioner Dan Polivka and CSB executive director Nick Kerosky both said they have not seen the lawsuit and could not comment.
