Times are good right now for Maricopa County prosecutor Juan Martinez. Fox 10 in Phoenix called him a “national celebrity” after Jodi Arias was convicted of first-degree murder this afternoon. Martinez, an Arizona State University law school graduate admitted to the bar in 1984, started enjoying the glitz and glam of perpetual CNN and local media cameras a bit too much however. He was accused of prosecutorial misconduct by Arias’ defense team after signing autographs and posing for pictures with people who are his….fans?

Our sister website The OP-NAT EYE has covered from the beginning the case of former Phoenix cop Richard Chrisman, who will finally go to trial at the end of July for shooting and killing unarmed Daniel Rodriguez and his dog back on October 5, 2010.

Martinez will be the prosecutor in this case, but don’t expect the same forceful, colorful attorney you saw in the Arias case.

Equally Damning Evidence

The only people who believe Jodi Arias is not guilty are (possibly) her family, those with an IQ that’s at least two standard deviations below the mean; and men who want to have sex with her. She lied from the very beginning, ultimately admitted she lied, and did herself no favors by taking various sexually-explicit pictures and recording phone sex conversations.

Now fast forward to the murder of Mr. Rodriguez by Chrisman. Police arrived at the trailer Rodriguez lived in after his mother called them to report a disturbance. Mr. Rodriguez knew his rights and when Chrisman arrived, he told the Phoenix cop to produce a warrant or leave his property. Chrisman responded by holding a gun to Mr. Rodriguez’s head and saying, “I don’t need  no warrant motherfucker.” Chrisman then electrocuted Mr. Rodriguez a few times with their government-issued torture toys before shooting and killing Rodriguez’s dog. Mr. Rodriguez, knowing he was dealing with a deranged killer, tried to get away on his bike, but could not. Chrisman then shot and killed the young man. Sergio Virgillio, the other cop present who witnessed the murder, said in the police report that he never felt Rodriguez posed any sort of threat to the officers. Virgillo said witnessing the murder was “the worst day of his life.” Chrisman was initially charged with aggravated assault before the charge was upgraded to second-degree murder a few weeks later.

Chrisman was also caught on tape planting drugs on a homeless woman before arresting her, and according to Fox 10, has “faced discipline multiple times” during his career.

Americans and Selective Murder

The people of the United States hate killers like Casey Anthony (found not guilty), OJ Simpson (found not guilty) and Jodi Arias (guilty). But the concept of “American exceptionalism” seems to plague the general population when it comes to murder in general. Arias, citing a psychologist, said “people have a need to persecute others” and get gratification out of it. She may not be far off.

We’ve already mentioned the OP-NAT EYE, which has covered a minimum of 500 murders by American police of unarmed individuals in the past four years. The victims are generally dismissed as “thugs” or some other minoritizing pejorative by media and Americans in general. The killers are always rewarded with paid vacations by the government, and are viewed as heroes by a good majority of the public.

*In other words, Americans condone murder if its done by people they are conditioned to believe have the privilege of doing so. For example, the Israeli army murdered 34 Americans back in 1967 in what can only be called a terror attack; and several Israelis were arrested in the United States shortly after 9/11 as suspects. Regardless, most Americans view the Zionist regime as a monarchy and don’t dare say anything truthful about them. Americans are also completely oblivious to the hundreds of thousands of people in the Middle East who have been (for lack of better term) exterminated by Washington D.C. imperial forces since 9/11.

No Cameras, No Color For Juan

It is safe to assume that CNN will not cover the trial of Chrisman, even though the man they made a celebrity (Martinez) is the prosecutor. In fact, cameras will likely be banned from the courtroom and the entire trial will be a back-page blurb with local media. Martinez knows that he cannot convict a cop of murder and keep his job and stature. It’s already extremely rare for a cop to be charged with any crimes at all, regardless of how brutal the killings or beatings are. Convictions are even rarer, and they always result in very short jail stays or probation. Martinez will not, and cannot, be as forceful with Chrisman as he was with Arias. *This would violate his oath to “the state” and frankly, its easier for him to yell at a woman in glasses than a cop. The fact that the victim is Latino – and the jury will consist of Arizonans who have repeatedly elected a sheriff who does not hide his feelings about said people; and a governor who once said Mexicans “behead” Arizonans in the desert – further guarantees the not-guilty verdict for Chrisman.

What’s Next For Martinez

Martinez may not even prosecute this case. His 15-minutes have officially began ticking and he must take full advantage to maximize his Federal Reserve note reward. Marcia Clark, the main prosecutor in the OJ Simpson murder case, took a two-year leave of absence after the acquittal before resigning with a reported $4 million book deal. Christopher Darden, the other prosecutor in the Simpson case, quit his job with the L.A. County District Attorneys Office after the acquittal and became a professor at Cal State University. He was also a media darling for cable news, frequently appearing on CNN, Fox News, Court TV and several other networks.

*It would make the most (financial) sense for Martinez to “retire” now and not even place himself in a case he knows he can’t win. Americans love their police and Martinez would turn off most of his fans by even attempting to convict him. The system as a whole would also prefer not to have a new “celebrity” drawing attention to a trial that has been decided since Mr. Rodriguez’s death in 2010.

Jodi Arias has said repeatedly she would rather die than spend the rest of her life in jail. Whether its Martinez or some other prosecutor, Richard Chrisman will not have to endure either.

Wow, I disagree with that article too, I love good cops, but this guy Chrisman sounds like bad news and if I was on the jury I'd vote to convict him.

Alright our little trial junkies, we are bringing to you some news regarding the next case that will bring many spectators back to the craziness of the courthouse.  With the Jodi Arias trial continuing, being delayed, having a possible plea, expecting the unexpected and deemed as the trial that just won’t die (no pun intended) there is another criminal in town.  The frenzy is related to a case that will play out right  inside the same venue of the Maricopa County Courthouse that has been set to start at the end of July.  Some wonder why this case is receiving so much attention, well outside the fact that it entails a corrupt cop, I can say that the primary draw is due to the prosecutor who has grown in popularity as the world has watched him attack the Jodi Arias case with vigor, compassion and animation.  There were times the heat rose high as he poked and prodded the witnesses to the point even the defense grew weary.  This prosecutor is Juan Martinez, the short man who knew deep within his soul that Jodi Arias was guilty of premeditated murder and would do everything he could to show Travis Alexander’s family what justice looked like.  Watching this circus of a trial, Juan has garnered many new fans and supporters followed by a myriad of nicknames, including here at The Trial divas where we crowned him with the name of Juanalicious!!  Taking the notoriety of Juan, his skills as an attorney and couple it with a case of a corrupt cop, we have goose bumps knowing what this defendant has to face.  For these reasons we will leave Jodi to her cell while she continues her search for a fake druggie friend to testify in support of her in retrial of sentencing phase and excitingly put the date of Juan’s next show on the calendar.
Now before the Chrisman trial begins on July 31, 2013 let’s do a breakdown of exactly what happened and why this officer should have been removed from the Phoenix Police Department month’s before his arrest, perhaps saving the life of a person who did not deserve to die.  Richard Chrisman had been an officer for nine years and during these nine years he did a thorough job of tainting his image in a negative manner.  He is most notably criticized for his ability to land on the Brady List for planting drugs on a homeless woman and later saying he only did it as a joke.  What is it with jokes and the criminal justice system?  I guess this doesn’t make a knock-knock joke look so bad.  Now for those who are not familiar with the Brady List it is essentially a list where officers who have participated in misconduct end up.  Not all officers land on this exclusive list, no… it takes a special kind of cop who acts out in a more severe manner to earn a coveted spot and Chrisman was so extraordinary he was able to achieve that position.  For people like you and I, it would not be a proud achievement, however I don’t think he seemed to be phased by it as he continued his misconduct out in the field.
These dismissive actions were more apparent on the afternoon of October 5, 2010 when Richard Chrisman and his partner Officer Vergillo responded to a domestic violence call.  Elvira Fernandez had called 911 to report her son, Danny Rodriguez, was throwing items in her home and needed assistance.  Assuming the officers would help calm her son down she felt calling for help was the best thing to do.  Upon the arrival of Chrisman and Officer Virgillo they attempted to confront twenty-nine year old Rodriguez in the front of his mother’s trailer.  Rodriguez halted the officers and informed them they could not come inside the house without a warrant.  Now this is the point where a normal officer would proceed with caution and talk to Rodriguez with a goal of defusing the situation.  Well not Chrisman, he apparently forgot about his prior misconduct while he pulled out his service pistol, grabbed Rodriguez and put the gun to his head while yelling that he didn’t need a warrant.  Somewhere after this event they all cooled down enough to the point where they ended up inside the trailer.
Shortly after being inside Chrisman crossed the line performing his first evil act of the day by shooting his gun, killing the family dog.  It was noted in the police report that the dog was not violent nor was the dog attempting to attack Chrisman leaving no threat or valid reason for him to fire his gun.  Shortly after the dog died Chrisman did not stop there and proceeded to shoot Rodriguez killing him in his home and in front of his very own mother.  Chrisman could not even claim self defense as Rodriguez was never armed with any sort of weapon.  Chrisman was arrested the same day for aggravated assault charges.  The most fascinating part to the case lies in Officer Virgillo.  Even though he appeared on scene to assist Chrisman, Virgillo was responsible for informing the Phoenix Police Department that Chrisman acted in misconduct.  Are we shocked?  No more shocked than hearing Jodi Arias lied again.  There was already an established pattern Chrisman had displayed of inappropriate behavior and yet other than being on the Brady List he had only been slapped on the hand.  Of course Chrisman never expected to meet an honest officer who would defend the innocent and that is just what he found in Virgillo.  After Chrisman’s arrest the county attorney added second degree murder and cruelty to an animal to his aggravated assault.  The gut wrenching part is the cruelty to animals is only a misdemeanor.
As this case has transpired through the last few years, Officer Virgillo has testified that there was no imminent threat, especially since Rodriguez was not armed therefore no reason for Chrisman to fire his gun.  It was an incident that could have and should have been avoided.  Through the trial there will be evidence supporting these facts and information revealed regarding the protection the Phoenix Police Department attempted to provide Chrisman while chastising Virgillo for telling the truth.  There was a large struggle in getting Chrisman terminated from the department even though he killed a man.  This trial will in fact bring many in the community who already have a negative attitude toward law enforcement to band together in support of Rodriguez and yet we may be surprised by the support Chrisman may receive due to the bond and codes inside these police agencies.  Even though we can’t predict the outcome just yet, one thing you can be confident in is that the Trial Divas will be there front and center to watch this case unfold and the magic of Mr. Juan Martinez as he grills these witnesses in the same manner he always does.  Let’s just hope Chrisman has not been talking with Jodi Arias and can answer a question with more than “I don’t remember”….until the trial begins, The Trial Divas xoxo

A former Phoenix police officer charged with murder and animal cruelty acknowledged Wednesday under intense cross-examination that he was the aggressor in the early stages of a domestic violence call before he shot and killed a man and his dog, but he noted it was his job to try to restrain a resisting suspect.

Richard Chrisman has pleaded not guilty to second-degree murder, aggravated assault and animal cruelty charges. He maintains the October 2010 shootings of Daniel Rodriguez, 29, and his pit bull, Junior, were justified because Rodriguez reached for the officer's gun during a tussle and tried to attack him with a bicycle.

Authorities say Chrisman abused his police powers by killing an unarmed man who posed no threat to officers. He was fired from the Phoenix Police Department about five months after the shooting.

On Chrisman's second day of testimony before a Phoenix jury, prosecutor Juan Martinez aggressively questioned the former officer's recollection of the shooting while accusing him of fabricating key elements of the case.

"Do you have problems with your memory LOL! Man is it foggy in Arizona!! about this very significant incident?" Martinez snapped.

"It was three years ago, and I don't remember everything about it," Chrisman replied.

"He never touched you, did he?" Martinez asked pointedly.

"Yes, he did," Chrisman responded.

"And when he tries to get away from you a second time, you're the one who escalates the situation when you pulled your gun?" Martinez asked.

"I pulled out my gun, yes," Chrisman said.

"I don't get to run away," the former officer later explained. "My job is not to run away from criminals who don't want to be apprehended."

Later, Martinez emphasized loudly that Chrisman's "job is not to kill people."

The prosecutor also accused Chrisman of shooting in haste instead of holstering his weapon and trying to physically stop the man from wielding the bicycle.

"You had time to holster your gun, didn't you?" Martinez said.

"No, I did not," replied Chrisman, who concluded his testimony Wednesday afternoon.

On Tuesday, Chrisman detailed for jurors how he and another officer arrived at the scene and made contact with a woman who had called authorities to report that her son, Rodriguez, had become violent. Chrisman said he learned before arriving that Rodriguez had a criminal history of drug use and weapons offenses, which elevated his awareness of what he sensed could become a dangerous encounter.

Chrisman said he and another officer received permission from the suspect's mother to enter their trailer, but Rodriguez refused to let them in at first. Chrisman eventually entered the home, and got into an altercation with the man as he refused to come outside to speak with officers.

Meanwhile, Chrisman testified, the man's pit bull was becoming aggressive, at one point lunging toward him, leading Chrisman to shoot the dog twice.

Amid tears, Chrisman explained how pepper spray and his stun gun failed to stop the suspect's aggressive behavior and screaming as the two then struggled, and Rodriguez picked up a bicycle from the living room floor.
"He was going to smash my brains in. ... I fired two rounds, center mass," Chrisman said.
Rodriguez died at the scene.


Martinez has accused Chrisman of manipulating the scene, lying about when he arrived and not following protocol.

Chrisman's testimony has run counter to that of the other officer who was at the scene. That officer previously told jurors that Chrisman was on a tear the moment he got to Rodriguez's door, then pulled out his gun and pressed it to the suspect's head. Chrisman has denied the allegations. The other officer also told jurors the suspect was backing away and was no longer a threat when Chrisman opened fire.
Chrisman has accused the officer of not being there to help with the struggling suspect inside the trailer, and at one point, even taking a personal call on his cellphone during the incident.
Opening statements in Chrisman's trial began in early August.

PHOENIX - (AP) -- A former Phoenix police officer has been convicted of aggravated assault in the shooting deaths of an unarmed man and his dog during a domestic dispute call three years ago.
Jurors hearing the case against Richard Chrisman failed to reach a verdict on the more serious charge of second-degree murder, along with an animal cruelty charge. They deliberated for about four days.
Chrisman was charged after his partner said he fatally shot 29-year-old Danny Rodriguez and his dog without justification during an October 2010 confrontation inside a south Phoenix mobile home. The now-39-year-old Chrisman was later fired.

A judge has set a December sentencing date for a former Phoenix police officer convicted of aggravated assault.

Richard Chrisman was charged with second-degree murder, animal cruelty and assault after he fatally shot an unarmed 28-year-old man and his dog during a 2010 domestic violence call.

The jury convicted Chrisman of assault in September but failed to reach verdicts on the other two counts. Chrisman will be sentenced on the assault conviction Dec. 20. He faces anywhere from five to 15 years in prison.

A retrial on the second-degree murder and animal cruelty charges is set for Jan. 27.

Chrisman maintains he shot in self-defense.

Chrisman's partner testified the man wasn't a threat at the time of the shooting.

A judge on Wednesday also denied a defense request to set aside the assault conviction.

PHOENIX - A former Phoenix police officer has been sentenced to a total of seven years in prison on assault and manslaughter charges after the fatal 2010 shooting of man during a domestic violence call. When 29-year-old Danny Rodriguez's Mother called 911, I'm sure she never imagined that the Officer dispatched to defuse the situation would shoot and kill her son and his dog. Chrisman will only see 7 years in prison for murder! IMO that's another disgraceful act carried out by our Judicial System and gives a whole new meaning to the phrase "Copping a Plea"

The judge sentenced Richard Chrisman on Friday to seven years for manslaughter and five years for the assault, but both sentences will run concurrently.

Chrisman was convicted of aggravated assault in September, but jurors failed to reach verdicts on second-degree murder and animal cruelty charges.

He later pleaded guilty to manslaughter to avoid another trial on the remaining counts.

Chrisman was accused of fatally shooting an unarmed man and his dog during a 2010 domestic violence call.

Chrisman says it was self-defense but another officer told jurors the situation had been defused before Chrisman shot the man.
