Wendi Andriano's husband became seriously ill and had to cease working. Allegedly resentful of her responsibilities, Wendi Andriano began frequenting bars and engaging in extramarital affairs.

As her discontent increased, she hatched a scheme to kill her husband and profit from his death. She asked her friends if they would pose as her husband so that she could obtain a life insurance policy. She researched the effects of various poisons and how to obtain them discreetly. Andriano ordered poison and had it sent to a separate business.

Andriano began slipping sodium azide capsules to her husband. In the early morning hours of October 8, 2000, Andriano called 911 to report that her husband was having a heart attack, but when paramedics arrived, she turned them away.

Several hours later, she again called 911 to report that she had stabbed and beaten him in self-defense. When paramedics arrived, they found Joe Andriano dead from repeated beatings and a stab wound to the neck. Weak from the poisoning and chemotherapy, he was unable to defend himself against Andriano, who struck him at least 20 times with a barstool before stabbing him in the neck.

Although Andriano claimed that she was physically and psychologically abused by her husband, none of her friends ever observed any signs of abuse.

Wendi Elizabeth Andriano (née Ochoa) is an American female prisoner currently on death row in Arizona for murdering her terminally ill husband Joe. She is incarcerated at the Lumley Unit in the Arizona State Prison Complex - Perryville. Her inmate number is #191593.[1]

Wendi Elizabeth Ochoa was born on August 6, 1970. In January 1994, she married Joseph Andriano. Not long into the marriage however, Joe fell ill. After many misdiagnoses, Joe was finally diagnosed with adenoid cystic carcinoma in 1998. At that time his illness had become terminal. Joe attempted holistic therapies for his illness, but by 2000 had resorted to chemotherapy. By that time, Wendi had given birth to two children and was working as an apartment manager, but she began to resent her increased responsibilities. She began to frequent bars and have affairs. She and her husband solicited a friend to pose as her husband during the pre-screening processes, although no life insurance was ever purchased.[2]

Crime

During the early morning hours of October 8, 2000, Wendi Andriano bludgeoned her 33 year-old husband Joe to death with a barstool and stabbed him in the neck with a 13-inch knife in the couple's Ahwatukee, Arizona apartment. His autopsy revealed that he had sustained 23 blows to the skull, and traces of sodium azide were also found in his system.[3]

Approximately one hour before Joe's murder, his wife Wendi had called 911 at the behest of a co-worker, claiming that her terminally ill husband was dying. When paramedics arrived however, Wendi turned them away, stating that Joe had a do-not-resusciate order, and that his wish was to die. Paramedics left the scene. One hour later, Wendi called 911 again, reporting that she had stabbed and beaten her husband to death in self-defense. She also made claims that her husband was physically and psychologically abusive toward her. However, being that Joe was weak from chemotherapy and the sodium azide poisoning, he was unable to defend himself. Wendi was charged with murder.[3]

Trial and Aftermath

Four years after the crime, on August 23, 2004, Wendi Andriano's murder trial began. Even though she had no prior criminal record,[1] she faced the death penalty for her crime. Prosecutors stated that Wendi's motive for murdering her husband was money. Evidence was brought up about how Wendi had tried to instate a life insurance policy on her terminally ill husband. In addition, prosecutors alleged that she was tempted by a potentially large yield from a medical malpractice lawsuit filed against Joe's doctors. They attempted to prove that Wendi used a pesticide, sodium azide, to poison her husband to appear as if Joe's death was the result of a heart attack.[4]

At the trial, Wendi testified in her own defense. For nine days on the stand, she testified that she had been battered by her husband. She also stated that her husband Joe flew into a rage after she told him about her affair. She said there was a struggle with the knife.[5]

Despite her dramatic testimony, on November 18, 2004, Wendi's jury found her guilty of first-degree murder. A month later came her sentencing. Due to the heinousness, cruelty, and depravation of the crime, and because the crime was financially motivated, she was sentenced to death by lethal injection on December 22, 2004.[4]

Wendi Andriano filed a post-conviction appeal in 2007, claiming that evidence of her affairs and efforts to buy life insurance policies for her ailing husband unfairly prejudiced her in front of the jury. She also claimed that jurors were not allowed to consider lesser charges, such as second-degree murder or manslaughter. Ultimately, her conviction was affirmed the Arizona Supreme Court in July 2007.[5]

As of 2011, Wendi Andriano is one of three women on Arizona's death row, along with Debra Milke and Shawna Forde.[6]

Wendi's case was profiled on the Oxygen Network program Snapped on June 2, 2011 and the Investigation Discovery program Deadly Women on September 9, 2011.

Known for his aggressive approach to prosecuting cases, Maricopa County Attorney Juan Martinez has faced some criticism for his intense cross-examination of murder defendant Jodi Arias. However, Martinez’s tough style has proven to be successful, as he has already prosecuted one of the three women currently on Arizona’s death row.

Back in 2004, Wendi Andriano was found guilty of the 2000 murder of her terminally ill husband, 33-year-old Joseph Andriano. During her trial, Martinez characterized Andriano as a manipulative, cheating wife who killed her cancer-stricken husband in an “especially cruel” way, according to the East Valley Tribune. On the contrary, Andriano’s defense attorneys painted her as a meek and battered wife desperate for affection, the Tribune reported.This is NOT Juan Martinez's first rodeo. These cases are very similar.

Two years before he was killed, Joseph Andriano was diagnosed with metastatic adenoid cystic carcinoma. At that time, the cancer had spread to his lungs and his condition was deemed terminal. He had no choice but to stop working. Resentful of her responsibilities as a wife and mother of two young children, Martinez argued Andriano hatched a scheme to kill her husband and profit from his death, according to court documents.

In the early morning hours of October 8, 2000, Andriano called 911 to report that her husband was having a heart attack at their Ahwatukee Foothills, Arizona home. However, when paramedics arrived, Andriano turned them away, screaming at them to leave. Hours later, Andriano called 911 again to report that she had stabbed and beaten her husband in self-defense, according to court documents. Responding paramedics entered the couple’s apartment and found Joseph Andriano lying on the floor in a pool of blood.

A medical examiner determined Joseph Andriano was struck 23 times in the back of the head with a bar stool, court documents state. Defensive wounds on his hands and wrists indicated that he was conscious for at least part of the attack. He also sustained a slit to his throat, and trace amounts of the pesticide sodium azide were found in his blood and gastric contents.

Based on the blood spatter and other evidence, a Phoenix police detective believed that Joseph Andriano was lying down when he was being struck with the bar stool, and he did not get up during the attack, court documents state. Furthermore, it was determined he was too weak from the poisoning and chemotherapy to defend himself.

Four years after the killing, Wendi Andriano’s trial began on August 23, 2004. Andriano took the witness stand in her own defense, testifying about the day of the killing and the events that she claimed forced her to take her husband’s life in order to save her own.

Andriano testified that on the day she killed her husband, he voluntarily ingested sodium azide and stabbed himself in the neck after learning she had a one-night stand with another man. crazy3 Andriano said she beat her enraged husband repeatedly with a bar stool in the midst of a violent struggle between the two.

While prosecutor Martinez presented evidence suggesting Andriano masterminded the scheme behind her husband’s death, Andriano testified that her husband was the one that devised a plan to end his own life. Andriano claimed that she purchased the sodium azide under a false name and tried to purchase extra life insurance at the insistence of her husband.

However, when Martinez grilled Andriano, asking her to explain how the sodium azide got inside a pot of soup and bowls found in her apartment following her husband’s death, she could not.

“You put that in the food didn’t you?” Martinez asked Andriano her trial, according to the East Valley Tribune.

“No sir,” Andriano said.

"It was in the soup, though, wasn’t it?" Martinez asked.

“That’s what the tests say," Andriano replied.

On November 18, 2004, a jury found Andriano guilty of one count of first-degree murder. She was sentenced to death by lethal injection on December 22, 2004.

Jodi Arias, currently on trial for the 2008 alleged murder of her ex-boyfriend, has also taken the stand in her own defense and has submitted to days of cross-examination by Juan Martinez. Arias claims she stabbed Travis Alexander 29 times, shot him in the face and slit his throat from ear to ear in self-defense.

With the end of Arias’ trial approaching, Martinez is fighting to prove Arias is guilty of the premeditated murder of her ex-boyfriend. If she is convicted of first-degree murder, he will then be responsible for convincing the jury that Arias should face the same sentence he obtained for Wendi Andriano.

I hope a, that she's convicted of first degree and b, that she gets the DP but I think the DP is a stretch. If I had to bet, I'd bet she does not get it just because of how people are now days. I know she's described as pretty, I suppose she is but all I see is one ugly person because of what I know but for a pretty female, it does make me doubtful.

I don't find her pretty at all. In fact, I never did. FAKE is the word that comes to mind when I see her pics..either as a platinum blond or as a brown haired mouse.

A long time ago I thought she was pretty but that is when I first heard about this case. By the time details emerged she turned very ugly to me. That's what I meant.
