(Stockton, CA) -- The Tracy, California woman accused of killing eight-year-old Sandra Cantu earlier this year is getting help from a high-profile attorney.

Michael Burt has joined Melissa Huckaby's defense team and is a litigator who has had several high-profile clients including Yosemite Killer Cary Stayner and Richard Ramirez, also known as the Night Stalker.

Huckaby was in court on Friday where her lawyers updated the judge on their progress in preparing the former Sunday school teacher's defense.

Huckaby is accused of the March rape and murder of Cantu, who was a playmate of Huckaby's own young daughter.

Cantu's body was discovered in a suitcase in an irrigation pond after a massive search.

The Sunday school teacher accused of murdering and raping 8-year-old Tracy, Calif. girl, Sandra Cantu, will stand trial on Oct. 18, 2010.
Melissa Huckaby, who was a neighbor of the Cantu family, allegedly kidnapped Sandra on Mar. 27, raped her, and then murdered the little girl. She is accused of then stuffing her inside a suitcase and placing the luggage near a drained irrigation ditch. Sandra's body was found Apr. 6.
Judge Linda Loftus also set a date for a hearing on a motion to suppress evidence to take place on Feb. 16, 2010. That hearing will likely last two weeks, according to the Contra Costa Times.
The prosecutor has said that if Huckaby is convicted, he will seek the death penalty.

While in court on Friday, Huckaby's attorney, Michael Burt, requested an order that “would require the sharing of information on how the grand jury members were selected and instructed, as… one issue is that the grand jury may have been misinstructed,” according to the Times.

the only way that melissa huckaby can get off is if they figure out that another person, maybe a male figure in her life or family was actually doing the assault or forcing her to do all these things.

i know they had enough evidence to arrest her, and of course i know she KNOWS something, but right now i dont believe they have ruled out that someone else was present, am i right?

The next court appearance for Melissa Huckaby, the woman accused of killing and raping an 8-year-old Tracy girl, has been pushed back to March.
Huckaby was originally scheduled to appear in a Stockton courtroom last Friday. She will now will return March 29 to confirm the date for a hearing on a defense motion to suppress evidence — tentatively scheduled for April 12.
Thomas Testa, the prosecutor handling the case, said Monday that Huckaby's public defender Sam Behar had asked Judge Linda Lofthus for the continuation.
"I said I had no objection because he had some valid reasons," Testa said, but did not elaborate.
Behar's request does not affect the Oct. 18 trial date set for Huckaby, Testa said.
A grand jury has indicted Huckaby, 28, on murder with three enhancements — kidnapping, lewd and lascivious acts on a child under 14 and rape by instrument — in connection with Sandra's death. A second count charges Huckaby with a sex crime with a child 10 years or younger.
Huckaby has also been indicted on two counts of furnishing a harmful substance and one count of child endangerment for two unrelated drugging cases involving another Tracy girl and a Hayward man.
She has pleaded not guilty to all counts
The San Joaquin County District Attorney's Office has said it will seek the death penalty if Huckaby is convicted of murder.

The Tracy Police Department's internal affairs probe was revealed in a court document filed by Huckaby's attorney, Deputy Public Defender Samuel Behar.

Behar indicated he will be making a motion to suppress a statement made by Huckaby to Det. Timothy Bauer April 10. According to Behar, Huckaby's statement was used to obtain search warrants.

Huckaby, 29, is charged with the kidnap, rape and murder of the 7-year-old girl whose body was found in a suitcase that had been dumped in a farm pond.

Behar said he learned in a January memo from Deputy District Attorney Thomas Testa that several Tracy police detectives were being investigated by the police department to determine whether any internal rules were violated in gathering the statement from Huckaby. Huckaby's statement was apparently triggered by a comment made to her by Det. Nate Cogburn, according to the court filing.

Behar indicated he had additional facts supporting his motion to suppress evidence that, for reasons of confidentiality, could only be provided directly to the judge in person.

All parties in the Huckaby case are forbidden by a gag order to comment outside of court. The next court hearing in set for March 29.

Melissa Huckaby's attorney wants to delay an April suppression hearing, because he has yet to receive the results of a probe into alleged misconduct by a Tracy police detective, court papers say.
San Joaquin County Deputy Public Defender Sam Behar said in a motion filed Wednesday that for "strategic reasons" he also has not viewed physical evidence in the case, and he needs to obtain numerous items from the court's file.
Huckaby, 29, awaits a death penalty trial on charges she kidnapped, raped and murdered 8-year-old Sandra Cantu one year ago. She is also charged with drugging a 7-year-old girl and a 37-year-old man.
In court Monday, Behar and San Joaquin County Deputy District Attorney Thomas Testa are to say if they are ready for the April 12 hearing on a motion Behar filed to suppress evidence collected against his client for reaching the trial.
Through his request for more time, Behar said he will ask San Joaquin County Superior Court Judge Linda Lofthus for a closed-door hearing to explain specifically why he needs the delay.
Among reasons for the delay, Behar said he has not received the results of an internal probe into Tracy police Detective Nate Cogburn.
Behar has said Cogburn and several other Tracy officers fell under investigation to determine if the detective violated Huckaby's constitutional rights the day she was arrested by making an undisclosed comment to her.
Behar said in court papers that he wants to delay the hearing to a date "deemed suitable by the court."

A hearing to suppress evidence in the case against the woman accused of kidnapping, raping and killing 8-year-old Sandra Cantu has been postponed for the second time.
Melissa Huckaby's public defender asked for more time Monday to prepare for the hearing, which was tentatively set to begin April 12.
San Joaquin County Superior Court Judge Linda Lofthus agreed. Parties will return to court May 10 to set a new date for the evidence hearing. That hearing is expected to last about a week.
Huckaby, 29, appeared with her public defender Sam Behar in a Stockton courtroom in a red jail jumpsuit. Her long hair cut had been cut into a short, curly style, and she had gained several pounds since her last court appearance in December.
This is the second time Behar asked for additional time to prepare for the suppression hearing. The original hearing was set for Feb. 16. In January, Behar asked for more time because, according to court records, he had not reviewed all the evidence and wanted to get information about an internal investigation by Tracy Police about what a detective said while getting a statement from Huckaby. Her statement was then used to prepare search warrants.
Prosecutor Thomas Testa did not object to the delay since it will not affect Huckaby's Oct. 18 trial date. Lofthus encouraged both sides to prepare to start trial that day.

on March 27, 2009. After a 10-day search, the girl's body was found in a black suitcase in a pond not far from the Orchard Estates Mobile Home Park, where the second grader and Huckaby were neighbors.

The attorney for Melissa Huckaby received a delay Monday for a hearing at which he is expected to argue that pieces of evidence investigators collected against his client should be kept out of her death-penalty trial.

Huckaby's appearance was strikingly different from the last time she stepped into a Stockton courtroom. The 29-year-old now has short, curly hair and has gained considerable weight since her arrest on charges she kidnapped, raped and murdered Sandra Cantu, 8, of Tracy, whose disappearance one year ago Saturday sparked a countywide search and gained national attention.

In her pervious hearing in the San Joaquin County Superior Court, Huckaby had long brown hair. At her April 2009 booking, the 5-foot 3-inch defendant weighed a slight 125 pounds.

During the hearing, Huckaby sat in court mostly expressionless. She continues to wear red clothes from the San Joaquin County Jail, indicating that she is a high-security inmate.

In the hearing, San Joaquin County Deputy Public Defender Sam Behar asked the judge for more time. He appears to be preparing an attack on investigators based on an allegation that a Tracy police detective violated Huckaby's rights.

San Joaquin County Deputy District Attorney Thomas Testa said he did not oppose the delay as long as it does not change the October trial date.

San Joaquin County Superior Court Judge Linda Lofthus granted Behar's request, setting Huckaby's next hearing for May 10. That's when attorneys and the judge will set a date for the suppression hearing.
