POTTAWATOMIE COUNTY, Oklahoma - A 3-year-old girl is at the center of a child abuse investigation in Pottawatomie County.

Someone hurt Charlotte Kauley so badly that she suffered a skull fracture and subdural hematoma sometime around March 26.

Charlotte is currently at the Children's Center in Bethany following a long stay at OU Children's Hospital. She is learning how to walk again and retraining the left side of her tiny body after a terrible blow to the head.

"It's a miracle that she's still here," said Beth Marsh, Charlotte's mother.

Charlotte's parents are divorced and she was hurt while visiting her dad in Shawnee.

"It was really the hardest thing I've ever seen. She's my baby you know," said Marsh, explaining the first time she saw Charlotte at the hospital.

The Absentee Shawnee Tribe Police told News 9 the woman who was watching Charlotte filed a police report that said burglars broke into the home, but investigators said there has been no explanation about Charlotte's injuries. Police have only said they are still investigating.

"She was put back in a bed to die and I just can't even think of what was going through her mind and how much pain she was in, not knowing if someone was going to find her before she died," said Marsh.

Marsh started a Facebook page to get answers and justice for her daughter.

"What would go through your mind to do something like that to an innocent, beautiful child," asked Marsh.

Marsh said Charlotte's recovery will take a lot of occupational and physical therapy and she wants someone to be held responsible.

"You are going to pay dearly for this dearly, very, very dearly, not only with the justice system, but afterlife as well," Marsh warned.

No one has been arrested or charged. Police said they still need to interview some people, including Charlotte, and they are working closely with the Pottawatomie County District Attorney's Office.

The probable cause affidavit said Lisa Botone is accused of hurting Charlotte Kauley so badly, the child nearly died.


A felony charge of child abuse has been filed against a Pottawatomie County woman accused of injuring her stepdaughter.

The probable cause affidavit said Lisa Botone is accused of hurting Charlotte Kauley so badly, the child nearly died. The affidavit said Charlotte's dad rushed the 3-year-old girl to the emergency room on March 27 after he got home from work and found her unresponsive.

Doctors said Charlotte had a fractured skull, subdural hemorrhage, as well as bruising, knots and abrasions on her body.

News 9 first introduced Charlotte when she was learning how to walk again at the Children's Center in Bethany. Her injuries led to paralysis on the left side of her body.

Absentee Shawnee Tribe Police said Botone reported a burglary the day Charlotte was injured at the family's Tecumseh home. The affidavit said Botone reported her credit cards were stolen and used fraudulently.

Police said they found surveillance video that showed Botone was the one using her own credit cards during the two transactions. Investigators also said they found other surveillance video from Botone's neighborhood that showed the family's house and no one was around the home the night of the reported break-in.

Police said Botone still does not have an explanation for Charlotte's injuries and told them "it is all blurry." Charlotte is now in Virginia with her mother, Beth Marsh, and nearly done with physical therapy.

"She's pretty much back to 100%. I mean, she doesn't need it anymore at all," said Marsh.

Marsh said she is glad to hear about Botone's arrest warrant.

"I feel like it's been so long already. I mean, I feel like it should have happened right away. It seemed like a clear-cut case that we all knew what happened," Marsh explained.

Investigators said through their interviews, they learned that Botone lied about the amount of prescription narcotics she was getting. They said in the affidavit she visited multiple doctors and multiple pharmacies throughout the state to get hundreds of prescription narcotics.

Investigators said in court documents the day of Botone's reported "blackout" with Charlotte, Botone was positive for opiates. Charlotte's father, Mitchell Kauley, said he wants justice for his daughter and the person responsible to be held accountable.

Botone has not yet been booked into the Pottawatomie County Jail.

A Tecumseh woman formally charged with child abuse by injury stands accused of causing injuries that led to her stepdaughter suffering a hematoma on her brain and paralysis on one side, court documents show.

Lisa L. Botone, 31, is charged in Pottawatomie County District Court and is being held in the Pottawatomie County Public Safety Center on a $250,000 bond. She is accused, on or between March 25 and March 26, while being a person responsible for the health, safety and welfare of a 3-year-old, of maliciously injuring that child. The injuries included multiple bruises throughout her body, a subdural hematoma to her brain and paralysis to the left side of the child’s body, the filed charges read.

According to the arrest warrant, the child had been staying a couple weeks with her father and stepmother at the time she was injured. She was taken to St. Anthony Shawnee Hospital with bruising and knots on many areas of her body, abrasions on her knees along with medical records showing a fracture on the right side of her skull along with a subdural hemorrhage. The child was airlifted to Children’s Hospital in Oklahoma City.

Records show that the child’s stepmother, identified as Botone, was alone with the child the night before, with the affidavit listing that the father is the one who brought the child to the Emergency Room when he had trouble waking her up the next morning.

In relation to this case, investigators interviewed Botone about the events that led to the child’s injuries, where Botone said she put the child into the bathtub.

“Then it is all blurry, I don’t remember getting her out, I don’t remember putting on her clothes,” the affidavit reads.
Botone recalled running the water for the child’s bath but didn’t know what could have happened; the last thing she remembered was putting the child in the water and being awakened the next morning, the affidavit reads.

Also mentioned as part of this case is the fact that the Absentee Shawnee Tribal Police Department also responded March 26 to a burglary call at Botone’s Tecumseh home, where they obtained a statement that her home was burglarized and two items — an ATM care and a child support card — were taken.

Botone disputed at least two transactions from the ATM card; investigators obtained surveillance video of the transactions and determined those purchases were made by Botone herself and found no evidence the cards had been stolen, the warrant reads.

During her interview with investigators about the child’s injuries, Botone continuously said she didn’t know what happened to the child and could not remember, the warrant reads.

The affidavit also shows that through recorded interviews, investigators found that Botone was “continuously deceptive” about the amount of prescription narcotics she had obtained, with reports showing she had visited multiple doctors and pharmacies throughout the state to obtain hundreds of prescription narcotics. The day of the child’s injuries, Botone tested positive for opiates, the warrant shows.

Botone’s next court date on the child abuse count hasn’t yet been scheduled.
