Normal Prosecutor Juan Martinez Continues Whittling Away At Inconsistencies While Cross Examining Defense Psychologist Dr. Robert Geffner

It was a tense and awkward day in ‪#‎JodiArias‬' retrial Thursday as Maricopa County Prosecutor Juan Martinez whittled away at inconsistencies found in the convicted murderer's stories to various psychologists.
Martinez has been cross examining defense psychologist Dr. Robert Geffner for two days.
While Geffner fumbled through testimony on Wednesday, the expert witness seemed more aggressive in his testimony on Thursday.
Martinez hammered Geffner over the different dates Arias gave the psychologist as to when she and murder victim Travis Alexander began dating.
Arias told Geffner’s colleague she and Alexander began dating on February 2, 2007, but told Geffner it was January 2007.
The two then began a big debate over what constitutes a boyfriend/girlfriend relationship. Is it having sex? Does having sex make it exclusive? If a couple is broken up, can they see other people? What constitutes officially being broken up?
Martinez pointed out that Arias and Alexander were broken up when she was peeping through his windows and saw him and a date kissing.
Martinez also pointed out to jurors that Geffner and other psychologists only have Arias’ word and Arias’ journal saying a relationship even existed.
Geffner conceded.
The two also argued over the different dates Alexander allegedly told Arias she was a loser.
As he did in Arias’ 2013 murder trial, Martinez showed Arias never wrote about the traumatic event in her diary.
Geffner told jurors under the “law of attraction,” it’s not unusual for Arias not to write negatively.
But Martinez showed jurors excerpts where Arias complained about Alexander saying his head was messed up.
Under questioning, Geffner conceded again there were no police or medical reports to back up the claim of abuse by Alexander, only Arias’ word.
By late afternoon, Martinez was showing inconsistencies in Arias’ psychiatric evaluations over the past six years.
He also focused on the evaluation done by Dr. Richard Samuels, who testified in Arias’ 2013 murder trial.
While jurors were out of the courtroom, defense attorney Jennifer Wilmott argued the evaluation was done while Arias was still lying about murdering Travis Alexander.
Arias first told police she was not in Arizona when Alexander was murdered, but after sex photos were discovered with a time stamp, Arias recanted and told a tale of how two masked intruders murdered Alexander and she escaped and was too afraid to report it.
By the time of her murder trial, Arias had changed her story a third time, claiming Alexander had attacked her and she stabbed him 27 times, sliced his throat and shot him in self-defense.
The death penalty sentencing re-trial resumes on Monday January 26 at 9:15 a.m.

Normal Defense Rests In Jodi Arias Case

The defense in the Jodi Arias case has now rested, and the sentencing retrial may finally be winding down.

Arias will not be going back on the witness stand. A few months ago, Arias testified in secret without the media or public present.
But the Arizona Supreme Court said she couldn't do that. Now, she's decided not to finish what she started.

Arias told Judge Sherry Stevens that since she can no longer testify without the public present she would rather stay silent until the end of the trial when she can address the jury in her own way without any lawyer questions.
Legal expert Dwane Cates said it's a win for the defense team that Arias will not have to be cross-examined by prosecutor Juan Martinez.

"We're talking about humanizing her, making her a person for the jury," Cates said. "Jurors have a hard time putting female defendants to death to begin with and the more she becomes a person the harder it will be for them to vote for the death penalty."

On the witness stand Tuesday was one of Alexander's ex-girlfriends, Deanna Reid. She testified that Alexander never physically abused her, disputing a defense witness statement that Alexander had hit Reid.
At one point Reid got a little hostile on the witness stand, telling one of Arias' lawyers that she is the one misleading the jury.


Testimony will continue Wednesday afternoon.

On Monday, prosecutor Juan Martinez pulled out all stops to discredit defense witness Robert Geffner.
Martinez and Geffner, a psychologist, got into a heated back-and-forth argument about domestic violence and the difference between a "shove" and a "push."

Arias, who initially denied she killed Alexander, would eventually admit that she killed him in self-defense, but jurors didn't buy into that claim.

The trial, which has generated an online and cable news audience nationwide, is expected to last through January, Stephens said last week.

There was some powerful testimony in the Jodi Arias sentencing retrial as a doctor referred to Arias as a "stalker."

Prosecutor Juan Martinez called an expert witness after a parade of defense witnesses.

The prosecutor is trying to convince the jury that Arias deserved the death penalty for the murder of her ex-boyfriend Travis Alexander.

Prosecution expert psychologist Janine DeMarte spent the day on the witness stand trying to tear down the image of Jodi Arias presented by the defense team: Jody as victim of an emotionally abusive Travis Alexander.

Defense experts said for weeks that Travis used her for sex, toyed cruelly with her emotions, and was obsessed with pornography.

Dr. DeMarte painted quite a different picture, patiently describing Arias as an insanely jealous stalker who had borderline personality disorder, fixated on Travis, and couldn't let go, spying on him, confronting other girls he dated, and prone to manic episodes of extreme happiness and despair.

Dr. DeMarte testified this eventually murderous behavior was not a result of post-traumatic stress disorder brought on by the way Travis treated Arias, and not a reaction to abuse at the hands of her family because there was no abuse.

Instead, Dr. DeMarte placed the blame squarely on Arias herself.


The prosecutor finished his direct examination, and now it is the defense's turn for cross-examination, which starts Thursday.

I'm reading tweets from the courtroom.
Basically Nurmi's been trying to tear down Dr. D's credentials, comparing her experience to the Defense's witness with 30 years experience.
Nurmi asking Dr.D the same questions just phrased a different way trying to coax the answer from her he wants. LOL! That's not happening. This lady's got serious wherewithal!
He wants her to answer questions about Travis and his exes. Implies her research is incomplete because she knows little about Domestic Violence in Travis childhood. Dr.D says she was evaluating #JodiArias, not Travis Alexander.

The penalty phase of the Jodi Arias trial could go on longer than the original trial itself. However, it may even be longer thanks to a surprise announcement by Judge Sherry Stevens.

According to Steve Krafft of Fox 10 News, Stevens announced at trial's end on Monday afternoon that she will question each member of the jury privately. She did not elaborate on the reasoning behind her decision, but Krafft contended that she might possibly be "looking into some kind of misconduct" within the jury.
"Jodi Arias [is] in court today," Krafft wrote on Twitter. "Jurors questioned privately by judge, [but] reason [is] unclear so far."

Aside from that announcement, psychologist and key prosecution witness Janeen DeMarte faced questions on the stand.
"Dr. Janeen DeMarte testified that Arias had a mental disorder, borderline personality disorder, but not a mental illness, and she knows the difference between right and wrong," Krafft wrote.
According to Krafft, DeMarte painted a picture of Arias as a stalker who ended up killing Travis Alexander. Like any other con, she argued, Arias tried to get away with the crime.

The jurors received an in-depth look into "the twisted and manipulative mind" of Arias, who was already convicted of the murder of 30-year-old Alexander. That's because DeMarte read through emails and texts sent between Arias and her former boyfriend.

"I haven't heard back from you," one email read in court.
DeMarte then turned her focus on one of Arias' journal entries. According to Stout and Berry, it was written after the murder took place.
"People are dropping my name about possibly having something to do with Travis' death....I don't understand it," Arias wrote in her journal. "I have been praying for his family and the detectives...This is difficult to write about.....I take comfort in knowing the truth will come out soon."
Jen Wood of Jen's Trial Diaries told CBS 5 AZ that Arias' journal entry was "extremely creepy." She argued that the writing also revealed something important too.
"It shows that Jodi Arias was having these conversations with Travis Alexander after she had murdered him, even going so far as saying, 'it's too bad the person that did it, hasn't been found yet,'" Wood said.

Krafft reported that defense attorney Kirk Nurmi tried to poke holes at DeMarte's credibility through a cross-examination, suggesting that she lacked the expertise to properly assess Arias.
"When did you become this guru of psychological certitude?" Nurmi asked to DeMarte.
Stout and Berry noted that Nurmi started yelling at DeMarte. Legal expert Beth Karas thought it was a "dangerous" strategy Nurmi used in cross-examining the psychologist.
"It can be dangerous to attack too much," Karas said. "Especially if the jurors think, 'why are you being so hard on her? She's not being evasive.'"

Krafft then reported that jurors asked questions about the trial, which were read by the judge.
"They asked how much she knew about treating domestic violence and sexual abuse, and why her tests of Arias are more accurate than the tests done by psychologists hired by the Arias defense team," Krafft wrote.

The sentencing retrial of Arias will resume on Wednesday.

Borderline Personality Disorder IS a "mental illness". Not all mental illness's mean that a person is "crazy". That being said, I was extremely impressed with DeMarte on the stand. She was extremely thorough and easy to understand.

FGS, they need to wrap this up. The money that is being spent to decide if this monster deserves to die is beyond ridiculous! Even if she gets the DP, she will appeal it. We will NEVER actually see her get the needle. At this point, it's a moot point. Even if I were a family member I really believe after all this time it is worse sitting in court yet again having to see the horrific pics and listen to all the testimony and look at this bitch day in and day out. I doubt I'd be able to contain myself in court as a family member. Let her rot in prison. This is My Opinion Only.

Normal Arizona Surpeme Court Keeps Trial Open to Public, Declines Arias' Secret Testimony

The Arizona Supreme Court declined to hear an appeal from convicted murderer Jodi Arias in regards to testifying in secret at her sentencing retrial.

According to the Associated Press, Arizona's highest court denied Arias' petition for review without comment on Tuesday. That means a previous ruling by the Arizona Court of Appeals will stand.

"The appeals court overturned the trial judge's ruling that barred the public from being present during testimony from a witness that later was revealed to be Arias," the Associated Press wrote. "A transcript of the testimony was released last month."

Laurie Roberts of the Arizona Republic provided some background information that led to the Arizona Supreme Court's decision.

"In October, poor Arias felt she couldn't possibly explain to a jury why her life should be spared if she had to do so in public, so Maricopa County Superior Court Sherry Stephens closed the courtroom and kicked out the public and press," Roberts wrote. "All the public knew was that a mystery witness for Arias would not testify in public."

Roberts reported that the mystery witness turned out to be Arias herself. Arias told the judge that she received death threats in the mail, rendering her unable to "fully communicate what she wants to say."

"While we do not discount the volume or nature of Arias' mail or the fact that some people may wish he ill, her concern does not, as a matter of law, amount to an extremely serious substantive evil warranting closing the trial to the public and press," Judge Maurice Portley wrote for the three-judge panel.

Roberts stated that her paper, alongside other media outlets, sued to get access to the secret testimony. In the end, the Arizona Court of Appeals ordered Stephens to unseal the testimony transcript and end the secrecy.

There was no trial on Tuesday; Judge Sherry Stephens said she would call each juror individually into her chambers with attorneys present on both sides.
Whatever she talked about was evidently ironed out, all jurors were in court for Wednesday's action.

On the witness stand was Robert Brown, who used to be a computer forensics expert with the Mesa Police Department. He testified the porn and evidence of porn website being visited on Travis Alexander's computer got there because of viruses.

On cross-examination, the defense recited in detail the names of some porn links.

Jurors will have to decide if the porn on Travis Alexander's computer is a big deal or not when it comes to deciding whether Jodi Arias gets death or life in prison for murdering him.

In the afternoon, the trial drifted off course when prosecutors announced they wanted to call a defense expert witness in computers to testify for them, sparking objections from Arias's attorneys.

The defense then said it wants to put its psychologist experts back on the witness stand, but they can't do it right away, meaning the trial could stretch well into March.
That caused the judge to say she wants this trial to be finished.


There was a bit of a dustup in the court when the defense team said some court watchers taunted their mitigation specialist Maria De La Rosa by singing "La Cucaracha" while she walked outside the court. (It's funny... you know it is!)
But the court watchers say they broke into song while talking about a Mexican restaurant, and it had nothing to do with the mitigation specialist.

The Arias defense team said they wanted the court watchers out, but Judge Stephens said she had no knowledge of what happened, and that is where she left the matter.

Court resumes Thursday morning.

UGH!!!!!! Enough of this already. How much more does a jury need to make their decision?

Regardless what Travis had or didn't have on his computer, it still doesn't give this monster cause to kill him. Period.

Defense attorney Kirk Nurmi on Wednesday told Maricopa County Superior Court Judge Sherry Stephens the three people directed the comments to a member of his team on Monday.

Stephens then set the investigation in motion.

Normal Prosecution Rests But The Trial Is Still Far From Being Over

There were two witnesses that did testify Thursday.

Prosecutor Juan Martinez called Damian Ashdown to the witness stand. He said his 9-year-old daughter had received an e-mail from Travis Alexander. The defense team may have thought this meant some inappropriate contact with Alexander, but through questioning it came out the e-mail was an invitation for the daughter to work with Alexander's Pre-Paid Legal Services business.

Computer expert Lonnie Dworkin took the stand, he testified for the defense during the first trial, and now the prosecutor wanted to question him about the SpyBot computer protection program Travis had among other things.

The defense then asked Dworkin about his examination of Travis's laptop. He said he found fragments of porn videos on it, long and clear enough to watch.

If prosecutors wanted to erase any connection between Travis Alexander and computer pornography, it didn't happen.


Court resumes next Wednesday; the judge told the jury there may be testimony as late as February 26.

OK, so there was porn on his computer. And?? So what? I would bet the majority of young men have at one time looked at porn. That doesn't make him a perv. At least this proves the State didn't delete anything. Next? Am so over this thing taking FOREVER!!! my 2 cents BS

I wondered the same thing about the 9 year old working at Prepaid Legal.
Also wondered how Travis came to have her email address.
It's strange and stranger still that it was Martinez that called her father to the stand and not the defense. I think that just like it's done with us, may cause questions among the jury.

Transcripts of sidebar conversations and closed-door hearings show Arias and attorneys for both sides were worried about people trying to get close to Arias, including trying to get access to her jail.

"A lot of crazy people come to the jail and try to visit me," Arias told the court.

Arias told Judge Sherry Stephens she believed she was in danger, even though she was in a jail cell. She said she had received threats informing her of what would happen to her if she said certain things during her testimony.

The transcripts also recount a disturbed man who had visited several jails and the offices of The Arizona Republic trying to reach Arias. In one instance, the man apparently claimed to be Arias's lawyer. The Republic told Arias's real lawyers about him.

Arias told Judge Stephens that all of these reasons impacted her ability to accurately defend herself on the stand. She claimed she was worried about what might happen to her depending on what she said, and that could lead to her stumbling.

The transcript shows Stephens initially rejected Arias's reasons. She then planned to compromise by closing the courtroom, but keeping the public viewing room open.

Arias still refused to testify and Stephens complied with the defense's request.

The judge at Jodi Arias' sentencing retrial felt the convicted murderer was being manipulative when she said she wouldn't testify unless the public was barred from the courtroom, but still kicked out the public over concerns over how an appeals court may view her refusal to testify.

In the private discussions over whether to close the courtroom, Maricopa County Superior Court Judge Sherry Stephens wanted to move news reporters and the public to a remote viewing room where they could still watch the proceedings but Arias couldn't see them. That proposal was rejected by Arias, who said she didn't want the public to have knowledge of her testimony. She cited threats she has received over the years.
"So I'm not able to testify in the way -- in the way that I would need to testify as far as being open and honest because of the pressure that I would feel because of these threats," Arias said.

Despite believing that she was being manipulated, Stephens said she was concerned that Arias wouldn't testify if her comments were open to the public. The judge said she wasn't sure whether an appeals court will conclude Arias' refusal to testify will be viewed as a voluntary waiver of her right to defend herself.

During the morning session, Judge Sherry Stephens announced that she had to excuse juror No. 5 and juror No. 12. No reason was given.
At this point, there are 14 jurors left on the panel.

The prosecution rested its case Feb. 12, and Maricopa County Superior Court Judge Sherry Stephens told the jury that testimony from rebuttal witnesses could come as late as Feb. 26.
The jury has been off since Thursday.
The defense rested its case Jan. 27.

Testimony has lasted two months longer than projected. The sentencing retrial began Oct. 21.

Travis was murdered June 2008. It is WAY PAST TIME for this to be over. His family lost him and all these years of their lives waiting for his killer to be punished.

Normal Arias Refuses To Allocute If She Can't Address The Jury Privately, Judge Stephens Denies The Request

Judge Sherry Stephens will read the final instructions to the jury on Tuesday morning. Then Kirk Nurmi and Juan Martinez will have their last opportunities to convince them to see the case from each of their views.

Nurmi, Jodi Arias' lead defense attorney, will explain the difficulties Arias has experienced in her life that led her to that fatal night back in June of 2008 when she murdered Travis Alexander. He will meticulously go through the mitigating factors and the testimony that supports each of those factors. In conclusion, he will ask the jury to sentence Arias to life.

Martinez will then have his chance to presumably reiterate the graphic details of the murder, complete with pictures, then move into attacking the credibility of Dr. Robert Geffner and the computer expert all while enforcing the conclusions of his experts, including Dr. Janeen Demarte. He will drive home the facts about the gas cans, the rental car, the hair color, the sheer brutality of the murder and the lack of credibility of the defense experts.

Each attorney will refer the jury to the instructions and explain why Arias deserves death or life.

The jury will be confronted with a lot of argument and a lot of information, though one thing they will not be confronted with is Arias herself.

In a criminal case the defendant has the opportunity to allocute once they have been found guilty. In other words, Arias has the chance to formally address the jurors directly and say almost anything she wants. She can apologize, give reasons for what she did, rant, cry, ask for forgiveness, declare her innocence or be defiant; and she can do it all without being subject to cross examination. She did this in the last trial with her PowerPoint presentation. Some criticized it by saying it was devoid of remorse, but it could have been the reason the jury hung.

In court Monday Judge Stephens addressed Arias directly and stated that it was her understanding from speaking to Nurmi and Jennifer Willmott that Arias didn't want to allocute. Arias responded by explaining she did want to address the jury but she wanted to do so in private.

The judge explained to her that wasn't allowed due to the Court of Appeals decision that she wasn't allowed to testify in secret. Arias responded by stating it was her belief that "testimony" was different than "allocuting" so the decision didn't apply.


Splitting hairs.

Judge Stephens offered to close the courtroom and mandate the media and public view her allocution from the viewing room on the first floor of the courthouse. Arias refused this offer by stating her reasons for wanting to do this in secret were the same as she explained to the court in October.

Judge Stephens then asked her a series of questions to make sure Arias understood her rights and the ramifications of her decision including asking her if she had taken medication.(LOL!) Arias stuck to her guns and refused to address the jury unless it was in secret.

So, what exactly are the reasons for Arias wanting to address the jury in secret?

Those reasons were discussed behind closed doors back on Oct. 30, 2014 immediately before her two days of secret testimony.

Arias explained to the Judge:

"Well, I have received several threats over the last few years. A lot of crazy people come to the jail and try to visit me, and some of the threats are of the nature very specific as far as different things that I — if you say this, than this; and if you say that, than that. I can give you some specifics if you want…So I'm not able to testify in the way — in the way that I would need to testify as far as being open and honest because of the pressure that I would feel because of these threats…I don't think I would be able to testify…knowing that my testimony would be out there as well because it could affect me in the future."

Judge Stephens responded, "So it is not just the presence of the public and the media in the courtroom that you find intimidating? It is the fact that they will hear what you have to say, period. That is of concern to you?"

To which Arias agreed.

Later in the conference Nurmi jumped in and added "[B]ut at the same time we have to judge the concerns Miss Arias has from her psychological shortcomings. Like I said at bench, we have a diagnosis of Post-Traumatic Stress Disorder. We have a diagnosis of Borderline Personality Disorder. So we are not dealing with the mind of a mentally stable woman who has these concerns. So when she is advancing these concerns — whether they may seem illegitimate to all of us, they are legitimate to her; and I point that out because then the legitimacy to her affects her ability to move mitigation forward, to present a full and complete case for her life." Nurmi jumped all over Stabby's refusal to beg for her life as proof of her mental instability. Only because all else has failed. No one believed her claims that Travis abused her, which was the lead for her entire defense. They should have gone with an insanity defense to begin with... I think that is at least more believable!

Arias also explained, "It is about am I able to express the truth in the way I need to express it or will that be cramped because of the pressure that I'm feeling because of the threats that I have received."

The arguments swayed Judge Stephens, although just before closing the courtroom and allowing Arias to testify in secret, she did admit on the record that, "Well, I acknowledge that I believe this is a manipulative tactic; and I have concerns about the genuine reason for the request to close the proceedings."

As of right now Arias has decided she won't address the jury; however, that doesn't mean she won't change her mind overnight. If she does appear in court on Tuesday asking to address the jury my guess is that Judge Stephens will allow her to do so. After all, it is a capital case. Stabby's foot stomping demands to the judge didn't work this time around. I'm willing to go out on a limb and say that because she didn't get her way she will face the jury after all. Let's hope not because it's been mentioned in media reports this opens up the possibilities of Martinez producing more evidence and the circus will go on even longer.


Bottom line -- if Arias doesn't change her mind and if Nurmi and Martinez finish their arguments, Tuesday could be the beginning of the very end of this trial.

Normal Judge Stephens Approves Live Broadcast Of Jodi Arias Verdict !!!

Maricopa County Superior Court Judge Sherry Stephens on Tuesday approved a media request to broadcast live the verdict in the sentencing retrial of convicted murderer Jodi Arias.

Stephens' announcement came as closing arguments and final jury instructions were scheduled to begin.

The verdict will be streamed live on cbs5az.com whenever it comes in.

On Monday, just hours after Maricopa County Superior Court Judge Sherry Stephens dismissed two jurors, Arias informed the court she would not make a final plea to the jury to spare her life.

The jury will decide whether Arias deserves the death penalty or should spend the rest of her life in prison for the murder of her ex-lover, Travis Alexander.

The prosecution rested its case Feb. 12 and the defense rested its case Jan. 27. The sentencing retrial began Oct. 21.

The jury spent the afternoon deliberating and then went home for the day at around 4:30 p.m. Deliberation lasted only 3 hours and 20 minutes.
The panel will resume deliberations Thursday at 9 a.m.

Nite: This part.. *"Stop emailing my 9yo daughter" Juan reminds jury DT expert included email in opinion of TA, & man said on stand email was spam. (I'm still unclear what this refers to)

The organization that Travis represented and did seminars for sent out pamphlets and letters for donations and evidently one went to a wrong name on the list. It was sent to a "Mary Smith" (made up name), and went to a different "Mary Smith" who was just a 9 year old. It was just a case of junk mail going to a wrong address. The dad was upset his daughter was getting this "begging for donations" type letter. But Travis had nothing to do with sending it personally, it just went to a mailing list that had that name or address wrong.

It took 9 days for the jury to give Scott Peterson the DP.

Hopefully this jury is going over the evidence from the first trial and reviewing the facts instead of what Stabby made up.
There are more women than men on the jury this time around.

I think Juan did a good job showing them that Travis was scared and suffered horribly before he died.

Normal Are The Deliberations In The Jodi Arias Case Taking Too Long ?

March 2, 2015

The State v. Jodi Arias jurors finished Day 3 of their deliberations with no verdict.
This brings their deliberating time to approximately 16 hours.


Let's put this into perspective. The first jury deliberated approximately 15 hours in the guilt phase where they had to decide whether Jodi Arias was guilty of first degree pre-meditated murder.

That same jury deliberated only an hour-and-a-half (approximately) in reaching its decision that there was an aggravating factor which put the option of death on the table.

Finally, they deliberated approximately just under 14 hours in the mitigation phase of the penalty phase, which resulted in no decision at all -- a hung jury.

Hope still exists that this jury will in fact reach a unanimous decision. However, it could be argued that for every minute that passes, the more entrenched they become in their individual position and there will be no decision.

After all, if they were all in agreement wouldn't they have stopped deliberating by now?

Maybe, or maybe they have made their decision and just want more evidence to support their decision.

What's different this go-around that is causing this jury to deliberate even longer than the last one?

Granted, I can't read the jurors' minds and I haven't been standing outside the deliberation room with a glass to the door, but I'm going to throw a couple of guesses out there.

First, the amount of time the jury was confronted with evidence of the murder itself. I think this is a very big issue. In the first phase back in 2013, the jurors heard months of testimony in regard to the actual killing of Travis Alexander and the events leading up to June 4, 2008. They also heard days of testimony about Arias' actions after she killed Alexander. This came through the state's witnesses but also through Juan Martinez's cross examination of Arias herself. One would think there was no doubt or questions in the jurors' minds of what happened before, during and after the killing in the first phase. The phrase "beat a dead horse" comes to mind.

In this re-trial of the penalty phase the jurors only heard about the killing itself for five days. That was the time Martinez took to present evidence of the underlying murder. That's a far cry from the amount of time the previous jury experienced. This reduction in time as a possible factor that's increasing deliberation time is supported by the fact the jurors asked for an exhibit list from the trial. This tells me they're probably going through evidence the first jury was privy to that they were not -- that they may be piecing exhibits together to get more of the story and to answer the lingering questions they have about the crime itself. If this is true, then the deliberations just might take a Very. Long. Time.

And you have to ask, did the state do an adequate job laying the facts out there?

Second, the mitigating factors put forth by the Arias defense are different this time. In 2013 the mitigating factors presented to the jury were:

1. Arias was 27 years old at the time of the offense.
2. Arias has no prior criminal history.
3. Arias was a good friend.
4. Arias lacked support from her family.
5. Arias suffered abuse and neglect as a child and as an adult.
6. Arias tried to make the best of her life.
7. Arias consistently tried to improve herself.
8. Arias is a talented artist.
I think most would agree that the majority of those factors don't seem to be strong mitigating factors. With that being said, the jury did hang, so perhaps the list is stronger than I think.

Now let's look at the mitigating factors that were presented by Kirk Nurmi just last week:

1. Arias has no prior criminal history.
2. Arias was just 27 years old at the time she killed Travis Alexander.
3. Arias is remorseful.
4. Arias suffered both physical and emotional abuse as a child.
5. Arias suffered both physical and emotional abuse during her relationship with Travis Alexander.
6. The abusive nature of Arias' relationship with Travis Alexander caused her to suffer extreme emotional distress.
7. Arias has been diagnosed with Post-Traumatic Stress Disorder.
8. Arias has been diagnosed with Borderline Personality Disorder.
9. Arias' psychological makeup impaired her ability to cope with the tumultuous relationship she had with Alexander.


Although some of the factors are the same, it's clear that the most recent list is stronger than the first. The change in the mitigating factors could be what is keeping one or all of the jurors confident in their positions.

What's not clear is what the jurors are doing back in the deliberation room. We will continue to speculate based on the length of the deliberation time, the questions the jury asks, the looks on their faces when they take breaks, who it is that takes breaks together, and any other little thing that comes up.

What's clear is the interest in this trial and in justice (regardless of what your idea of justice is) is still very strong and people all around the globe are waiting and waiting and waiting on the decision of these eight women and four men.

It's all BS. The juror's know not only did she kill him but she butchered him. Literally. She was sane at the time. She's NOT on trial for the insanity plea.

All it takes is one juror holding out on giving her the DP. How frustrating for TA's family.

PERRYVILLE, Ariz. - FOX 10 has received an inside look at where Jodi Arias will be headed after her sentencing retrial is wrapped up.

Hours after learning her sentence, she will be taken to the Perryville Prison's Lumley Unit.

Her new cell will have a painted blue floor, a small bunk with a thin vinyl covered mattress, some shelves, and a porcelain sink and toilet. It's in the maximum security unit at Perryville Prison and life or death; it's where Arias will live.

"So it doesn't matter to her life or death, because the death row, there's so few women, only two of them, they are in the midst of where the maximum security inmates are housed," said Arizona Department of Corrections Director Charles Ryan.

Arias will spend six hours a week in recreation time outdoors in a fenced in area. At first it has to be alone, and with death it will stay that way. Arias will be confined to her cell and receive her meals through a slot in the door.

But if Arias gets life in prison, her time at Perryville will improve fairly quickly.

After a month of perfect behavior, she is eligible to spend $80 a week in the prison store for food and supplies. She can eat breakfast and dinner in the dining area with other inmates, and get a job that pays her between 10 and 50 cents an hour. And she will be able to do origami and pencil drawing activities. Arias will also be able to attend group counseling sessions with 11 other inmates, but during those she will be locked in place.

"Their ankles are in cuffs; there is a slide bar over that, so they could not get out over the chair to try and attack or touch another inmate," he said.

The corrections staff at Perryville have been preparing for Arias' arrival by telling officers to keep a professional distance from her. They say they will be watching her and her interaction with other inmates very closely.

"This is a high-profile inmate, I think the concern about possible manipulation is legitimate and better to be forwarned than not," said Ryan.

Jurors weighing a death sentence for Jodi Arias have reached an impasse, a Maricopa County Superior Court judge said Tuesday, before giving them a special instruction in an effort to resolve the case.

Judge Sherry Stephens delivered the impasse instruction on Tuesday afternoon after more than 19 hours of deliberations on Arias’ fate. The instruction orders jurors to try to reach a verdict, if possible, or to tell the judge that additional deliberation would not be helpful.

The impasse instruction, according to the State Bar of Arizona, is delivered to juries after a judge determines they have reached an impasse and are in “apparent need of help.”

The instruction tells jurors that attorneys for both sides and the judge are in a position to help them navigate the nitty-gritty legal issues, but is not meant to coerce them into reaching a verdict.

“During your deliberations, you should not hesitate to reexamine your own views and change your opinion if you become convinced that it is wrong,” the instruction says, according to the wording provided by the state bar. “However, you should not change your belief concerning the weight or effect of the evidence solely because of the opinions of your fellow jurors, or for the mere purpose of returning a verdict.”

If jurors still can’t reach a verdict, they may submit a list of written questions to the bailiff, and the judge and attorneys will try to answer them.
