It is never a dull moment in the Jodi Arias trial. This is the trial of the State of Arizona versus Jodi Arias, trial for the murder of Travis Alexander. But the fact that it is such an intense case, with intense drama, every single day is the very reason this case has garnered an international an online audience. The human race is intrigued by drama, and there is no shortage in this case. Last year Jodi Arias was convicted of first degree murder of her lover Travis Alexander, and she has awaited sentencing since. Whether or not Jodi Arias is guilty is not a question in this trial, she is and always will be a convicted felon. Jodi's first jury in 2013 could not decide between life in prison or the death penalty, and thus this decision is the only task this current jury is faced with. Even so, based on how this trial has been going, it appears that some supporters of Jodi think this retrial of the sentencing phase is a retrial of her guilt. It is not. She is and always will be a convicted felon. In Monday's testimony before the Maricopa County Superior Court in Phoenix, Arizona, Jodi Arias put a sex expert on the stand in an effort to create an abuser out of the victim in this case. Eyewitness News 3 out of Arizona also reported on Nov. 17 that court was ended abruptly on Monday due to an emergency situation.

Testimony on Day 11 of the retrial of the sentencing phase of Jodi Arias centered around testimony from a clinical sex expert. Even so, this testimony was book ended with drama. On one end was drama over the pornography files we previously reported on that were allegedly found on the computer of Travis Alexander. On the other bookend was the drama of an emergency adjournment of court.

Reporter and legal expert Beth Karas told CBS 5 that as far as the emergency situation is concerned, "these kinds of things happen." She said,

"It could be something in the personal life of one of the defense attorneys, or Juan Martinez, or the judge. How unusual is it for the Jodi Arias case? It is very typical. This case moves at a snail's pace."

CBS 5 has also learned that the emergency situation had nothing to do with the actual case. It also had nothing to do with any of the jurors on the case. Before this happened however, there was enough drama in the court day to have everybody talking by the end of it.

Fox 10 for Arizona said yesterday that court started with a motion being filed by Juan Martinez on all of the pornography files allegedly found on the personal computer of Travis Alexander. Here is what we know about the computer, alleged pornography, and virus issue, and what we know about how each side feels about it. There may or may not have once been "thousands of porn files" on the personal computer of Travis Alexander.

If they existed, someone may or may not have accessed them on June 10, 2008. Travis Alexander died June 4, 2008. Both the State and the defense can agree that at least for now, the existence of those files is difficult to prove. Both the State and the defense can also agree that the "thousands of porn files" do not currently exist on the same computer. Neither side can agree on how files that may or may not have once existed, may or may not have disappeared.

The most recent motion from the defense on this issue alleges someone from the prosecution camp deleted the files that may or may not exist. The most recent motion from the State alleges that the alleged computer in question that belonged to the victim Travis Alexander allegedly had a software program on it that blocked porn.

The State is also alleging something that sounds like a hard drive switch. It is also being alleged that the hard drive that came back to the State after it was in the defense's hands, was not the hard drive of Travis Alexander.

Whose was it? We don't know for sure, but we do know there's someone named Tony missing a hard drive somewhere in Arizona. That's a true story. We also know that Juan Martinez was more than a little ticked about the hard drive switcheroo and has requested either the proper hard drive, or a meeting between Kirk Nurmi and the Ethics board.

There are many questions that stem from all of this, besides the obvious "how is this relevant" question. The most obvious one being, why would the prosecution have any interest in deleting "thousands of porn files" from the victim's personal computer? They had blood from Jodi Arias, they had a bloody palm print from Jodi Arias, they had blood from Travis Alexander and Jodi Arias combined.

They had her shoes at the scene. They had definitive proof from a rental car company and receipts that she was there. They also knew that she was the only one there, and that it is physically impossible to put 9 stab wounds in your back, and also shoot yourself in the head. They did not have any Ninja DNA. They also had the piece de resistance, the camera that took pictures the whole time. They didn't need it. But it helped.

Porn files don't. Porn files don't help either side, actually. So why would the prosecution spend the time, and the stake on their personal careers, deleting thousands of files from the victim's computer that have no relevance on this case? Why is the defense doing everything they can to get this into trial?

Monday's court session offered a hint. On the stand was an expert that has years of experience with sexual deviancy that offered her "expert opinion" on this case. Dr. Fonseca does not have years of experience on this case. She does allege to be an expert on Travis's best friends, Chris and Sky Hughes, and why they may or may not have said or written certain things, though we have learned she has never interviewed them once.

We also know she has never met Travis Alexander, the victim in this case, who actually is the best expert on this relationship. He saw the worst of it, up close and personal, and died because of it. But the defense doesn't want to talk about his story, those moments. They would rather discuss how he may or may not have used his computer, and read emails that also have no relevance to this case.

Today's "sex expert" testimony centered around emails and text messages before an unknown emergency put an abrupt halt in proceedings. Court reporter Beth Karas noted that the jurors were taking a lot of notes today. Text messages that were revealed today, revealed that Travis Alexander likes sex and were used as an attempt to show that Travis was emotionally abusive.

Of course anyone that watched the trial last year will remember that Jodi's original story was that he was physically abusive. That one didn't stick too well and so it appears this is the next defense they are trying to make stick. What this appears to translate to as an actual defense is, "Travis was a sexual deviant and thus was abusive to Jodi and thus she had not choice but to kill him."

One of the first emails read was one between Travis Alexander and a lover of his named Lisa Andrews. The portion that was read, was Travis writing,

"You told me to seduce you. I admit I do like to see you in that state….when I have control over you."

In addition to this email there were more. Yes, Dr. Fonseca testified Lisa Andrews was not the only girl that Travis was sexually attracted to. He had a "bank of emails" allegedly asking women for pictures. He did this while keeping Jodi Arias as his lover, and also having a girlfriend.

Gasp worthy? Not yet. All this tells us is that he enjoyed dating, and he enjoyed dating a lot. He was a 29 or 30 year old man through his relationship with Jodi, and by all accounts, was fairly clear with every woman where they stood with him. That does not make him a bad guy. Even if it did, that does not make him emotionally abusive, and it certainly isn't a motive for murder or a mitigating factor that makes it okay to do what she has confessed to doing.

But the defense was building and saving their "best" gasp worthy material for last. Dr. Fonseca then testified that the turning point between the relationship of Travis Alexander and Jodi Arias was when Jodi walked in to his bedroom one day and caught Travis masturbating to a picture of a little boy in underpants. Dr. Fonseca has not seen the picture Travis was allegedly masturbating to, nobody has.

It seems like wherever the defense likes to "keep their evidence" is a very windy place. But Dr. Fonseca, like all others on the defense team, take Jodi Arias at her word that this picture did at one point exist. We also know that Dr. Fonseca is being paid $300 an hour by the State of Arizona for her testimony.

This alleged "turning point", the pedophilia picture, was the beginning of the end for Jodi Arias and Travis Alexander, allegedly. This was in January 2008. The defense used this testimony to creep up to more testimony that alleged, or supported any notion, that Travis was into young girls, or young boys.

An instant message conversation was also brought up. That message was read out loud as follows,

"Friend: Sara is way too cute but a little young.

Travis: No such thing."

It was shortly after this was testified to that the sister of Travis Alexander, Samantha, had to leave the courtroom. The defense began working into their illusions of evidence that they feel point to Travis Alexander's pedophilia problem. Granted, as Jeff Gold from the Gold Patrol pointed out, the sex expert could not bring herself to use the actual word "pedophilia" or anything related to that word, but had no problem suggesting it.

She claimed that she "found more evidence" that showed "Travis had an interest for individuals under the age of 18." She referred to the infamous sex tape as that evidence where Travis stated that he liked 12 year old girls. A naked picture of Jodi was shown in pigtails, this was also "evidence" that the clinical psychologist feels shows Travis Alexander to be a pedophile. According to Michael Keiffer from the Arizona Republic, she also said,

"It would be foolish to ignore these things that keep popping up. It's difficult to hear…to testify to."

Does anyone else find it strange that someone that makes a living working out sexual deviancy with people, and spends all day every day talking about kinky sex with people, and has for years, but has a difficult time testifying to these very "uncomfortable" words? Maybe that's not what the doctor is uncomfortable testifying to. Maybe she's uncomfortable because she herself doesn't believe that her 2 examples of alleged pedophilia that "keep popping up", aren't actually examples of pedophilia?

But the dragging through the mud did not stop there. The defense had one more card in their sleeve to make Travis Alexander look like a real pervert. This was an email from a parent, asking Travis to stop emailing his child. According to ABC 15 tweeting live from the courtroom, an email with subject line "Lexy, the proof is in the pudding" from Damien Ashdown read,

"Stop emailing my 9-year-old daughter. Thanks."

We have since learned from the Facebook page The State vs Jodi Arias that this email actually has a reasonable context and explanation. A business colleague from Pre Paid Legal Services (PPL) said,

"Travis sent hundreds of emails out every month promoting his PPL business. I've sent the very same email out with the subject line 'the proof is in the pudding.' Obviously the email went to the wrong person. You have to be 18 to work with PPL so it had to be a wrong address. This was sent out through an automatic system so the child could have received several over many weeks and it's no wonder the dad asked that his daughter be removed."

After this testimony, Kirk Nurmi was of course obliged to put this email in context. He asked Dr. Fonseca if this email may have possibly had anything to do with Travis's business. She replied, "Possibly." What does this testimony do for the defense then?
Another member of the State of Arizona versus Jodi Arias page commented on this,

"This is exactly why her entire testimony is questionable. She's making accusations without investigating what was meant or caused these words on paper. She's just creating a story to follow Jodi's lies without verifying any of it."

She was not the only member of the public that had a very big problem with this testimony. Although the public has been well aware that the allegations against Travis were going to come out, they are still outraged now that it is happening. Kelly the Canadian writer over at the Really Big Mean Dog wrote about this yesterday as well, echoing the sentiments of many. She said she has serious questions about it.

"Questions like how is a paid expert allowed to give an opinion on a seven year old email with no context and without speaking with either of the people the email was between seeing as one of them is dead and the other was not approached. How is that not all just hearsay? How is there any foundation for the email?"

But alas, these were not the only questions the public was asking after yesterday's court testimony. David Erickson tweeted the same thing this reporter has been asking since all of these pornography and pedophilia evidence began. David said,

"I have no idea whether Travis Alexander liked young girls. I also have no idea how it's relevant to whether Jodi Arias should be put to death."

Surprisingly enough, it was not the pedophilia suggestions from the sex expert that created the real "gasp out loud" moment of the day. According to Jenn Wood from the Trial Diaries this occurred after the lunch break when court was brought to an emergency halt due to an emergency situation. Nobody really knows what the emergency situation entailed, but CBS 5 has confirmed it had nothing to do with the actual trial, or with any of the jurors.

Tweets from the reporters inside the courtroom can be seen in the slideshow here. Court will adjourn due to this emergency until Thursday of this week.

It is clear how the public supporting the prosecution feels about this chain of events. They are reacting as expected when unsubstantiated allegations of child porn rise to the occasion. How is the defense reacting?

The defense still believes Jodi Arias may be home by Christmas, and has hinted on social media that some interesting evidence is coming out this week that will lend some support to their claims, that "is the break that Jodi needed." On one social media page, a defense supporter wrote,

"There has been some drama happening . The defense has claimed witness tampering of some porn photos by none other than Flores [lead detective] and company!!!!! They want to get the case out already. This is the break that Jodi needed. Stay tuned for more details in the coming days . Stay strong, Jodi. LUV YA GIRL."

The Twitter account being managed for Jodi Ann Arias is also hinting at the same thing. Many may remember when we reported Jodi's parents Bill and Sandy Arias had posted a begging video for Jodi's appeals fund. That video was removed from YouTube for violating standards. For those that have missed the begging video by Jodi's parents, Jodi Ann Arias Twitter page has a link for that. The Jodi Arias Twitter page also tweeted this week,

"NEW FORENSICS EVIDENCE PROVES TA USED HIS P/C TO VIEW CHILD PORN! #JodiArias & the truth are NOT strangers after all.

Get the feeling that this week will have a lot of interesting revealing info at #JodiArias trial. The truth will set Jodi free."

In addition to this, Jodi Arias is asking whoever is tweeting on her behalf to make her tweets echo the possibility that she was an abused woman. One tweet from "Jodi Arias" this week was a quote from Susan B. Anthony. It said,

"A woman must not depend upon the protection of man, but must be taught to protect herself."

Is that what Jodi Arias is doing with these porn and pedophilia suggestions? Protecting herself? Jodi Arias trial is expected to resume on Thursday Nov. 20.

Day 10 of Jodi Arias trial: Former jurors watch testimony

There was more drama inside the courtroom of the Jodi Arias' sentencing re-trial Thursday.


But the big buzz had nothing to do with any testimony or expert witnesses.

All the talk centered around who showed up to watch the proceedings.

A couple of jurors, who helped convict Arias of first degree murder last year, came back to hear testimony in Arias' new trial, which will determine whether she gets life in prison or the death penalty.

Jen Wood, with Jen's Trial Diaries, has been following the Arias' case from the beginning.

"There's actually two jurors - two females that have been coming on and off," said Wood. "They were sitting on the public side, and now we've noticed they've moved right behind the family."

Another surprising development took place, when a woman in the gallery was escorted out of the courtroom.

At first, court officials thought she was taking pictures, or recording the proceedings on her cell phone.

However, CBS 5 has learned that the woman accidentally opened a video on her cell phone.

She was later allowed back in the courtroom.

Meanwhile, a clinical psychologist was back on the stand, answering questions from Arias' attorney.

Psychologist Miccio Fonseca, an expert in twisted sexual behavior, talked about murder victim Travis Alexander's issues with his Mormon faith and sexual desires.

Fonseca said that Alexander had a "Dr. Jekyll and Mr. Hyde" personality.

Defense attorneys are trying to show that Arias was the victim of emotional abuse.

As for a defense motion to throw the murder conviction out, a hearing will likely be later this month to discuss the thousands of pornographic images the defense claims were deleted from Alexander's computer while in the custody of Mesa police.

Jurors returned Wednesday after they were dismissed Nov. 5 when an Arizona appeals court ruling stayed a decision by Maricopa County Superior Court Judge Sherry Stephens to ban media and the public from the courtroom during testimony by the first defense witness, who wouldn't appear unless anonymity was granted.

Then, on Monday, defense attorneys filed a motion to have Arias' case dismissed, alleging that prosecutors and Mesa police hid and destroyed evidence.

Some legal experts have said there is a chance the case could be tossed out.

The motion alleges "prosecutorial misconduct" and contends that a computer forensic expert hired by the defense discovered that thousands of files were deleted from the computer of Arias' ex-boyfriend, Travis Alexander, while it was in police custody.

"Among the files that were deleted are several that are easily recognizable as pornographic websites," according to the motion.

That court document states that a forensic analysis revealed that the files were deleted during a three-hour period on June 19, 2009.

"Someone went into the computer without a 'write blocker' and sought to alter its content, and alter they did, with such a level of success that the state's deceit was not uncovered for several years," the motion stated.

Mesa police personnel testified previously that there was no pornography on Alexander's computer, and prosecutors disputed Arias' testimony that she had walked in on Alexander viewing pornography and he apologized for it.

The motion alleges "the state had full knowledge that Mr. Alexander's computer did contain a plethora of pornography and that this computer further contained evidence that Mr. Alexander had a sexual interest in children."

Judge Sherry Stevens has postponed making a decision on a defense motion.

Travis' sister said outside the courthouse on Wednesday that the allegations are absurd.

"I actually know the facts, I'm privy to some of the information that you guys aren't, and they're again mistaken," Samantha Alexander said. "The defense always releases stuff. My brother had a virus on his computer, that's all I want to say."

Prosecutor Juan Martinez told the judge no one in his office or the Mesa Police Department destroyed any files.

In fact - he pointed a finger at Arias' old defense team, saying they were the ones who had access to the computer and may have erased the files which may have been corrupted with some type of virus.

Arias fighting for life
Arias, who was convicted of first-degree murder in the death of Alexander, her ex-lover, is fighting for her life as this jury determines whether she should spend the rest of her life in prison or should be executed.

The jury that convicted Arias on May 8, 2013, was unable to reach a verdict in her sentencing and Stephens declared a mistrial on May 23, 2013.

The body of the 30-year-old Alexander was found in his Mesa apartment. He had been stabbed, his throat was slit and he had a gunshot wound to his forehead.

Arias, who initially denied she killed Alexander, would eventually admit that she killed him in self-defense, but jurors didn't buy into that claim.

Members of the current jury, which was selected from more than 400 potential jurors over several weeks, have been shown graphic photos of the crime scene, listened to interrogation tapes in which Arias produced a number of lies, and had a juror dismissed for asking a woman journalist in attendance if she was TV journalist Nancy Grace since the retrial began Oct. 21.

The trial, which has generated an online and cable news audience nationwide, is expected to last until early or mid-December.

PHOENIX - Convicted killer Jodi Arias is not wasting any time getting her appeal going.

Arias hired private investigator Dorian Bond with Bond Investigations to start the process of overturning her 2013 first-degree murder conviction.

The first jury was hung on whether to give her the death penalty or a prison sentence.  A second jury is now listening to evidence as it weighs the heavy decision.

"She is ready for this part to be over and so she is ready to move forward to the appeal process...the appeal process takes a long time. So we're just getting a jump on it," Bond says.

Arias is starting early since she still doesn't know whether she will be appealing a life or death sentence.

If jurors hand down a death sentence, Arias will get an automatic appeal at the expense of county tax payers, Bond tells ABC15. But if the jury decides on a life sentence she will have the opportunity to hire her own counsel.

In September, Arias' parents, Bill and Sandy Arias, took to YouTube to plea for donations to the family-run website.

"I'm surprised of people across the world that have sent her money," says Bond of Arias' supporters.

Bond could not reveal his current investigations but tells ABC15 there were several issues during the murder trial that could come up.

He points to Arias' love-hate relationship with lead counsel Kirk Nurmi.

"Now they have a better relationship but during the important part of the trial when she didn't want him leading her trial, she was actively trying to get him off the case. She felt that her grounds were valid and she felt the judge ignored her request," says Bond.

Another issue Bond says could come up is the large amount of media attention Arias received during the trial.

"She kind of revels in the media attention," Bond admits. Arias lined up media outlets for interviews as the first jury was deciding on her conviction.

But if turning on the media means freedom, Bond says they're prepared to bring up the issues.

Meanwhile the private investigator said Arias remains upbeat and positive.

"Usually when I see her she's happy to see me and wants to talk and then when its time to go she's 'OK, see you later' like she's going back to gardening or something like that, and she's going back to the Sheriff Joe Dungeon," says Bond.

Bond has been raked over the coals on the internet and on social media because of his position helping Arias.

He reminds the public it's just a job and if doesn't do it, someone else will.

PHOENIX - Convicted Murderer Jodi Arias was back in court Thursday as the defense finished up testimony with expert psychologist Dr. Lucia Fonseca from San Francisco, California.

Fonseca has held jurors attention for days as she has poured through emails and text messages between victim Travis Alexander, his friends and Arias.

Fonseca refused to diagnose Alexander on the stand because she had never interviewed him, but still painted him as a sexually addicted womanizer who preyed on Arias and emotionally abused her with his double standards and dual lives.

“That's something that the prosecutor (Juan Martinez) is going to come back at on cross examination and say ‘Let's be real here,' you're trying to say I'm not diagnosing Travis Alexander yet you're laying out some pretty heavy deductions," said legal analyst and defense expert Hector Diaz.

Fonseca also told jurors Arias was a victim who "suffered in silence" at the hands of Alexander until she finally snapped on June 4, 2008 when she stabbed her former boyfriend 27 times, slashed his throat and shot him in the head. BS BS BS

Fonseca admitted the killing was vicious.

“I expect Mr. Martinez will take his time in cross examination to go back and make sure that the jury understands who the victim was in this case. Travis Alexander was the victim of an act at the hands of Jodi Arias,” predicted Diaz.

On cross examination, Martinez came out swinging very much the same way he did with Arias’ experts Alyce LaViolette and Dr. Richard Samuels during the 2013 murder trial.

He attacked Dr. Fonseca’s notion that Arias was a victim who suffered in silence, bringing up that as a teenager when Arias was slapped by her father Bill, she verbally swung back by saying “F---- you Bill” before leaving her Yreka home.


Martinez asked Fonseca if that was a sign of a victim suffering in silence.

He also pointed out that Fonseca could not diagnose or interview Alexander because he was dead and she chose not to interview Travis' friends, Chris and Sky Hughes, over their damaging emails.

Yet Fonseca pointed to alleged suicidal tendencies in Alexander's emails.

“The notion that maybe Jodi was the victim and not Travis was the victim, that's a very fine line that you walk as a defense counsel and it could backfire," explained Diaz.

If the jury was nodding with the last four trial days of testimony about emails and text messages, they got a wakeup call this afternoon because Juan Martinez took over questioning.

Dr. Miccio-Fonseca remained on the stand where Martinez handed her pages of documents that she said she had never seen. Every few words out of Martinez's mouth was followed by an objection from the defense. Miccio-Fonseca said she could not answer questions with "yes" or "no" without expounding and said Martinez wasn't giving her a chance to answer.

At one point the response she claimed she wasn't being allowed to finish was "I wasn't paying attention, can you repeat the --."

Martinez drew her in by examining two documents, having her point out the similarities and differences, count the words that didn't match, the responses that weren't in one, but were in the other. Then he handed her a document of an interview with Carl Arias. Miccio-Fonseca then confused Carl Arias (Jodi's brother) with Bill Arias (Jodi's father)

"You seem to be having problems with your memory," Martinez said.

If you believe Jodi Arias's expert, the murder came from a place of love.

Dr. LC Miccio-Fonseca was on the stand for another day, spending the morning reading almost every line in a long instant-message exchange between Travis Alexander and Arias. Alexander was angry, calling Arias a "whore," a "solid form of evil." Fonseca said Arias was a compliant participant in the relationship, excusing Alexander's behavior as had countless women before her. For three days she has sworn that Jodi Arias loved Travis Alexander and that he was living a split life, showing one side in public, something else entirely in private.

The question (and the point the defense was trying to make) is whether that's an abusive relationship.

On Twitter, I'm getting a lot of people who say, "Sounds like a normal relationship to me if the two people are mad at each other." Others are using it to vilify Alexander.

Let me ask you this: What would someone think about you if they read the angriest conversation you've ever had?

An appeals court has thrown out a ruling that barred the public from watching the first witness called by Jodi Arias at the convicted murderer's sentencing retrial.

The decision Wednesday by the Arizona Court of Appeals overturns the Oct. 30 ruling by Maricopa County Superior Court Judge Sherry Stephens and suggests that the previously unidentified witness may have been Arias herself.

Stephens had said the ruling was necessary because Arias' first witness, whom the judge refused to publicly identify, wouldn't testify unless the hearing was closed to the public. Some of the testimony by Arias' first witness was conducted in private. The Arizona Republic and three Phoenix TV stations — KPNX, KPHO and KTVK — protested the closure of the courtroom, arguing the First Amendment allows reporters to attend the trial.

Arias was convicted of murder last year in the 2008 death of former boyfriend Travis Alexander, but jurors deadlocked on whether she should be sentenced to life in prison or death. A new jury has been picked to decide her sentence.

The appeals court didn't offer an explanation in its ruling Wednesday at how it arrived at that decision. A more detailed ruling is expected in the future.

But the court suggested an answer to a question that stumped trial watchers: Who was the skittish witness who was allowed to testify in private?

The appeals court said Stephens order closed the courtroom to the public during "any testimony by Jodi Arias," though it's unclear whether the testimony was made by Arias herself or someone else on Arias' behalf.

"It underscores the importance of the public's right to attend criminal trials, particularly the testimony of a defendant in the sentencing phase of a capital trial," David Bodney, an attorney representing the news organizations, said of the ruling.

A call to Arias attorney Jennifer Willmott wasn't immediately returned Wednesday afternoon.

The decision to close the courtroom came after Stephens and the case's lawyers met behind closed doors at the start of Arias' case. Since then, Arias' lawyers have continued putting on their case, and Arias has yet to publicly testify at the sentencing retrial.

The Arias case has been marked by secrecy ever since the conclusion of the first trial, which turned in to a media circus as salacious and violent details about Arias and Alexander were broadcast live for people around the world.

Since then, the judge has held one secret hearing after another and barred the broadcast of footage from the sentencing retrial until after a verdict is reached. Arias' lawyers had argued that daily broadcasts of the trial would lead to defense witnesses backing out for fear of being harassed or threatened.

PHOENIX (AP) — Lawyers for Jodi Arias have asked a judge to take the death penalty off the table at her sentencing retrial because three witnesses on her behalf have refused to testify in open court.

The attorneys said in court filings last week that the witnesses fear they'll be harassed or threatened if they testify.

The lawyers say the refusal means Arias can't get a complete defense as a jury hears evidence over whether to sentence her to life in prison or death for the killing of her former boyfriend, Travis Alexander.

The three witnesses in question haven't been publicly identified, but defense attorneys have described them as a longtime Arias boyfriend, one of her former co-workers, and a person who was a friend of Alexander before he met Arias.

The Maricopa County Attorney's Office, which is prosecuting Arias, declined to comment on the request to throw out the death penalty.

Arias was convicted last year of murder in Alexander's 2008 death, but jurors deadlocked on her punishment. A new jury is deciding her sentence.

An appeals court decision last week overturned a ruling that closed the courtroom as Arias' first witness testified. Her lawyers previously said the witness would testify only in a closed courtroom.

PHOENIX -- Another juror has been dismissed from the Jodi Arias sentencing retrial. No explanation was given for the dismissal of Juror No. 3.

Prior to that announcement, defense witness and clinical psychologist Dr. L.C. Fonesca was back on the stand for the trial's 16th day.

Picking up where he left off Monday, prosecutor Juan Martinez focused on Fonseca's credibility - or lack thereof - and Tuesday was no different as he questioned her about her memory after she seemed unable to answer a yes-or-no query.

At one point during the day, Fonseca called the relationship between Arias and the man she was convicted of murdering as an "erotic bomb."

That relationship, described in oftentimes lurid detail during the original trial, is once again front and center in the courtroom.

The jurors had several questions for Fonseca Tuesday, most of them about the relationship between Arias and Alexander. One juror asked if Alexander asked Arias to keep their relationship quiet. Fonseca answered that it was an implied request.

While Arias claimed she killed Alexander in self-defense, Martinez has worked hard to prove the state's position that she was a woman scorned and that Alexander's murder was premeditated.

The prosecutor showed two separate texts from Alexander to Arias. One said, "I want you to understand how evil I think you are." The other said, "You are the worst thing that ever happened to me."

The afternoon session ran long as Martinez and defense attorney Kirk Nurmi discussed an issue with Judge Sherry Stephens in chambers.

The Arias trial has garnered national - even worldwide - attention. A jury convicted her of murder on May 8, 2013, and while they found her eligible for the death penalty, they could not unanimously agree to hand down the sentence.

Because of that, Stephens declared a mistrial in the penalty phase of the trial.

After months of legal wrangling, a new jury was eventually impaneled, and a retrial of the sentencing phase began on Oct. 21. It is expected to last until the middle of the month.
In the meantime, rumors that Arias herself will once again take the stand continue to swirl.
While the jury will not be back in court until Monday, there are two evidentiary hearings this week -- one each on Thursday and Friday.

I've read several articles today trying to get a handle on why juror #3 was dismissed. The media have deemed her "The Book Writer" because she was constant in her note taking and hardly ever looked up from her writing. (I thought that was interesting)

No real proof, but I think #3 got dismissed because of a question pertaining to porn pictures on Travis' computer. If I'm not mistaken all discussions about the computer and what may or may not have been on it, have been held outside of the Jury's presence. Such a question would lead the Defense and Prosecution to believe that #3 was watching or reading media coverage of the trial, which we all know is a big NO NO.

On another topic: There seems to be some confusion by the media about a term used by Psychologist L.C. Miccio-Fonseca, which was it?

"It's an erotic bomb"
or
"It's an erotic bond"
The statement concluded with:
"It's powerful."
Not that the difference matters much.

At least one of the jurors is questioning "The Dirty Little Secret" theory, by asking if Travis publicized any of his relationships on social media sites. The answer was no. That response basically squashed Stabby's claim.

More details have emerged about the latest juror to be dismissed from the Jodi Arias sentencing retrial.
Judge Sherry Stephens announced at the end of a long afternoon break that Juror No. 3 was dismissed from the retrial without giving an explanation.
It turns out that the juror, who has been identified as Melissa Lenette Garcia, was kicked off the case due to a recent arrest.
The 36-year-old woman was arrested on Black Friday and charged with issuing a bad check, making her the third juror to get the boot from the high profile murder trial.

In October, one of the 12 original jurors was let go due to an ongoing family emergency on the first day of the retrial.
The next day, a second juror was removed for talking to a reporter that she thought was HLN talk show host Nancy Grace. Juror No. 9 was immediately dropped from the case and Maricopa County Judge Sherry Stephens reiterated to the remaining jurors that they are prohibited from discussing the case, watching TV, consuming news media and using social media.

In the end, even a Mesa Police computer technician admitted that there was pornography on a computer that belonged to Jodi Arias' victim, Travis Alexander.

The hearing stretched out over three days in three separate weeks in Maricopa County Superior Court. It ended Thursday afternoon, and now it is up to Judge Sherry Stephens to decide whether to drop the prosecution's intent to seek the death penalty because of prosecutorial misconduct.

She has questions to answer.

How did it come to pass that there was so much porn when a Mesa Police detective and a police computer expert had testified in Arias' first trial that there was none?

And who deleted tens of thousands of files? Was it a deliberate act of misconduct by police or prosecutors? A stupid mistake when the computer was turned on without following basic crime scene and evidence rules? Or a wanton lie by the defense computer experts?

Arias' attorneys, Jennifer Willmott and Kirk Nurmi, and their forensic expert, Bryan Neumeister, led the court through a description of the porn sites that had been visited and the computer viruses that had infected Alexander's computer because of porn viewing.

Prosecutor Juan Martinez tried over the course of the three days to blame a prior defense team for the deletions and then accused Neumeister.

Neumeister said Martinez lied and told the prosecutor repeatedly that he didn't understand computers.

On Thursday, Martinez presented another Mesa Police expert and focused on "clones" that had been altered by Neumeister. Willmott objected repeatedly that the clones were irrelevant because the alterations were the natural by product of analysis; the original copy was unchanged, she said, and they still were full of porn.

Perry Smith, the Mesa Police expert, admitted that there was porn.

During her first trial, Mesa police officers testified that there were no viruses or pornography on Alexander's computer. Martinez called Arias a liar for saying there was. And he took Arias to task for alleging that Alexander was sexually attracted to children and that she had walked in on him while he was masturbating to photos of young boys. Martinez roundly drubbed Arias for the allegation.

In closing arguments Thursday, Nurmi said the state should not be allowed to continue going forward with the death penalty because the case is based on testimony that's not true.

"Let's put an end to this circus," he said Thursday. "Any further proceedings will be based on false evidence," he added.

"This case is more about prosecutorial misconduct than it is about evidence," he said.

Martinez countered by saying "This is a fact-driven inquiry." Those facts, he said, show "no misconduct at all."

Martinez said that the defense attorneys were pointing the finger at the prosecution and "perhaps they should point it at themselves, he said.

Judge Sherry Stephens took the matter under advisement and informed the lawyers that the jury will return and the trial will resume on Monday.

Arias' attorneys claim Mesa police destroyed some key evidence on the computer of victim and Arias' former lover Travis Alexander.

And there has been an ongoing legal battle about whether Arias and three other witnesses, the identities of which the defense wants to protect, will be required to testify in public.

The jury has been given more than a week off while Judge Sherry Stephens considers the defense motion, and testimony is expected to continue Monday morning.

TLMS Only difference IMHO is that as much as I cannot Stand Casey Anthony, she is staying out of the public eye..this maniacal murderer, Arias, will Not..she w/have a field day..and I firmly believe she w/write a tell all book, make tons of money and eventually kill again..she is a true psychopath!

PHOENIX (Reuters) - Convicted murderer Jodi Arias was the mystery witness allowed to testify in secret at her sentencing retrial in Arizona because of fears for her safety after her lawyers said she received death threats, court papers showed on Tuesday.

A state appeals court ruled last month that the judge had been wrong to close those proceedings to the public, and the appeals court on Tuesday confirmed suspicions that Arias herself had been the witness in question.

The 34-year-old former waitress from California could get the death penalty after being found guilty last year of murdering her former boyfriend at his Phoenix-area home in 2008.

A three-member panel of the Arizona Court of Appeals said Arias was permitted to testify in secret on Oct. 30 after her lawyers said she received death threats and argued that media coverage would affect her ability to think and answer questions.

The panel said the trial judge, Maricopa County Superior Court Judge Sherry Stephens, agreed to the request from Arias' legal team despite feeling manipulated by the defendant.

The appeals court said the defense attorneys failed to prove there was a "clear and present danger" requiring that her testimony be given behind closed doors, and it ordered a transcript be released to the public.

Media organizations had appealed Stephens' decision. Defense lawyers said they planned to challenge the state appellate court's ruling in the Arizona Supreme Court.

Arias says she acted in self-defense when she killed 30-year-old Travis Alexander, who was found dead in a shower at his home. He was stabbed multiple times, his throat was slashed, and he had been shot in the face. Prosecutors said she murdered him in a jealous rage.

The jury that convicted Arias later deadlocked on the death penalty. A new jury is hearing testimony and if it also deadlocks, the judge will sentence Arias to life in prison or life with the possibility of parole after 25 years.

Attorneys allege the state is violating evidence laws by not releasing the reports.

Agree!
Even IF those files were once on Travis' computer they disappeared long before Jodi's story morphed into the BS she's claiming now.

And really what difference does it make in the big picture of things? Looking at Porn/child or any other sort, isn't an offense punishable by death. And just like any other person on the face of the earth she cannot self appoint herself judge, jury and executioner.

Jodi was stalking, recording, threatening, vandalizing and illegally entering Travis' home. Then as if those offenses weren't enough, she premeditated the brutal act of stabbing, shooting and slicing his throat with firm intention of murdering him.
That is beyond a doubt Punishable by Death.

The State vs Jodi Arias ~ Travis Alexander murder trial

The ‪#‎JodiArias‬ sentencing retrial is stuck like a plane on the tarmac in winter weather.
Monday's court proceedings, like much of the trial, were carried on out of earshot of the press and public.
And the continued delay centered on just that. Arias' defense attorneys have petitioned the Arizona Supreme Court to turn back an order by the Arizona Court of Appeals to release transcripts of testimony Arias gave in a closed courtroom.
Even the discussion of the appeal is secret.
The trial resumed Monday, after more than two weeks off for the holidays.
As attorneys for the media waited to argue for release of the testimony, the first words that Maricopa County Superior Court Judge Sherry Stephens uttered on the record were, "Counsel, please approach," summoning the prosecutor and defense attorneys to her bench for a secret discussion.
Fifteen minutes later, when the lawyers left the bench, Stephens immediately said, "We are at recess for five minutes." When the recess was over, she summoned the attorneys to her chambers.
Then she sent the jury home and postponed the hearing on transcript release, pending word from the higher court. Also at issue were witness interviews that one or the other side says it needs to conduct before the witnesses take the stand.
Earlier Monday, Willmott, filed a petition in the Arizona Supreme Court for a stay of the Court of Appeals opinion, once again arguing that Arias' right to due process and a fair trial outweigh the media's First Amendment right to access.
Stephens asked that Willmott and her colleague, Kirk Nurmi, consult with her by 4 p.m. Monday to determine whether the jury should return and the trial resume Tuesday.

Testimony postponed in Jodi Arias sentencing retrial

PHOENIX (AP) — Testimony that was expected to resume Monday in Jodi Arias' sentencing retrial was postponed to let lawyers interview a witness whose identity hasn't been revealed.

Jurors were sent home Monday shortly after they returned to court following a more than two-week holiday break.

Although the witness's identity hasn't been revealed, prosecutor Juan Martinez said in court papers that he wanted to interview a defense witness who examined a laptop belonging to Arias' former boyfriend, Travis Alexander.

Arias was convicted of murder last year in Alexander's 2008 death, but jurors deadlocked on whether she should be sentenced to life in prison or receive the death penalty. A new jury has been picked to decide her sentence.

Prosecutors said Arias attacked Alexander in a jealous rage after he wanted to end their affair and planned a trip to Mexico with another woman. Arias has acknowledged killing Alexander but claimed it was self-defense after he attacked her.

Arias' attorneys are seeking to dismiss the case by alleging that authorities destroyed thousands of files on Alexander's computer — including files from pornographic websites — that would have been beneficial in defending Arias. Her attorneys, who alleged Alexander had treated their client in a sexually humiliating manner, say the missing computer files deprived Arias of a fair trial.

Maricopa County Superior Court Judge Sherry Stephens and the case's lawyers held private discussions Monday before the judge announced that jurors were sent home for the day. The trial will not be in session Tuesday.

Attorneys for Arias also have asked the Arizona Supreme Court to put the trial on hold while they appeal a lower court's ruling over Stephens' Oct. 30 decision that barred the public from watching the testimony of Arias' first defense witness, who was later revealed to be Arias herself.

Stephens had said the move was necessary because Arias' first witness was skittish and wouldn't testify unless the hearing was closed to the public.

Despite her reservations during the penalty phase, Arias has actively courted the spotlight since she was arrested in 2008, including interviews on "48 Hours" and "Inside Edition" after her arrest, and a series of media interviews after the jury convicted her of murder.

The Arizona Court of Appeals threw out Stephens' ruling and ordered transcripts of Arias' secret testimony to be released, though they haven't yet been made public. A hearing over the transcript is set for Thursday morning.

Arias attorney Jennifer Willmott said in court papers that the appeals court ruling lets the media's First Amendment rights trump her client's right to a fair trial.

I'm having trouble understanding why Stephens is going to such lengths to protect Stabby's testimony. I mean really what could she have possibly told this Jury that we haven't heard from her already. What's the big secret ?

The judge in Jodi Arias' sentencing retrial is postponing the release of Arias' closed-courtroom testimony in her sentencing retrial.

In a ruling that overturned Judge Sherry Stephens' decision barring the public from watching Arias' testimony, the Arizona Court of Appeals has ordered the transcripts released.

A lawyer for media organizations on Thursday requested release of the transcripts.

However, Stephens said she won't do that until the state Supreme Court rules on defense lawyers' motion to pause the retrial while they appeal the Court of Appeals' ruling.


The Arias defense team continues to try and convince the jury that Arias was a victim and suffered from some type of mental illness in the hope jurors might give her life in prison and not the death penalty.

Legal experts believe the Arias defense team is trying to show that the convicted killer has a personality disorder that was brought on by a lifetime of physical and emotional abuse, which could be a mitigating factor in the jury's decision to sentence Arias to death or life in prison.

Convicted murderer Jodi Arias has lost a bid to put her sentencing retrial on hold while she appeals a court's ruling over the public's access to her trial.

The denial Thursday by the Arizona Supreme Court means a transcript of Arias' closed-door testimony on Oct. 30 is one step closer to being released.

Earlier Thursday, Maricopa County Superior Court Judge Sherry Stephens said she wouldn't rule on a request by news organizations to release a transcript of the closed-door testimony until after the state's high court chimed in on Arias' request to pause the trial.


Arias was convicted of murder last year in the 2008 death of former boyfriend Travis Alexander, but jurors deadlocked on whether she should be sentenced to life in prison or receive the death penalty. A new jury was picked to decide her sentence.

Stephens closed the courtroom to the public during the testimony of Arias' first defense witness, who was later revealed to be Arias herself. The judge had explained that the move was necessary because the then-secret witness was skittish and wouldn't testify unless the hearing was closed to the public.

An appeals court threw out Stephens' ruling closing the courtroom and ordered transcripts of Arias' testimony to be released. Arias' attorneys are appealing that decision.

Meanwhile, Stephens allowed a witness on behalf of Arias to testify Thursday under a pseudonym.

Will the Jodi Arias sentencing retrial be over by Monday?

On Friday, her defense attorney, Kirk Nurmi, made a last-ditch effort to have the prosecution's intent to seek the death penalty thrown out, his motion alleging prosecutorial misconduct and inability to get witnesses to testify on Arias' behalf because of a court ruling forbidding testimony in a closed courtroom.

Maricopa County Superior Court Judge Sherry Stephens said that she would rule by Monday.

Arias has already been found guilty of first-degree murder for killing her lover, Travis Alexander, who was found dead in the shower of his Mesa home in June 2008, with a bullet in his head, nearly 30 stab wounds and a slit throat.

Her first trial took place in 2013, but the jury was unable to reach a unanimous verdict as to whether she should be sentenced to life or death.

A second jury was seated in September, and Nurmi and his co-counsel, Jennifer Willmott, have been trying to present "mitigation" witnesses who might convince the jury to spare Arias' life. If death is taken off the table because of the pending motion, Arias must be sentenced to life in prison and there would be no need to continue the current proceedings.

Nurmi's argument rests largely on how police and prosecutors handled a computer belonging to Alexander that was taken into evidence at the crime scene. And he claimed that they knowingly misrepresented the content of the computer hard drive and failed to turn over copies they had made of it.

•While the computer was in custody of Mesa police, it was turned on and off twice without taking proper precautions for handling evidence, which resulted in files being accidentally altered or deleted from the hard drive.

•During Arias' 2013 guilt-or-innocence trial, and during the present sentencing retrial, Mesa police officers testified under oath that the computer was free of pornography and computer viruses. Prosecutor Juan Martinez used that testimony to refute Arias' assertions that Alexander was sexually attracted to young boys and he branded her a liar for saying the porn and viruses were there.

Mesa police have since admitted that the computer did have significant amounts of pornography and viruses despite the earlier testimony by the trial's case agent and a police forensic expert.

"Under what law would the state be allowed to go forward and seek the death penalty based on false testimony?" Nurmi asked.

•Just last month, Nurmi learned that Mesa police had made a mirror image of the computer's hard drive in 2008, before some of the alterations took place, but had never provided it to the defense. The prosecution is legally and ethically obligated to turn over evidence, especially if it may cast a more favorable light on the defendant.

"The state has confessed to illegal behavior," Nurmi said. "The only option is to dismiss death against Ms. Arias."

Martinez claimed that there was no harm done to Arias' case. And he said that there was no way to prove who had actually viewed the pornography on what he described as a "communal computer."

But Nurmi's computer experts said repeatedly in recent hearings that the pornography would be hard to miss, and that the computer had an unusual number of "cleaning programs" that had likely been installed by Alexander to mask or erase the porn-viewing history.

Eventually the withheld evidence will derail any death sentence on appeal if Stephens does not dismiss it, Nurmi said.

"She will never be executed," he said.

In November, Stephens granted Arias' defense motion to allow witnesses to testify out of sight of the press and public. The Arizona Republic, 12 News and other media outlets sued for access and won in the Arizona Court of Appeals. Earlier this week, the Arizona Supreme Court refused to postpone that ruling while it was being appealed.

On Thursday, Stephens ordered the release of transcripts of the two closed-trial days with a witness who turned out to be Arias herself. Those transcripts are expected to be made public next week.

But Nurmi said in Friday's hearing that 14 of Arias' mitigation witnesses will refuse to testify if they have to do so in public.

Martinez countered that the witnesses could be subpoenaed and forced to testify, or that they could have been interviewed on video or prepared affidavits.

Nurmi claimed that Arias has been denied her right to a fair trial.

"It's game over," he said. "She cannot present a good defense."

Stephens took the matter under advisement.

If she rules against Arias, trial will resume Monday.

A judge was expected to decide Monday if the death penalty should be taken off the table for convicted murderer Jodi Arias.

Instead, Superior Court judge Sherry Stevens put the decision on hold.

"Because this is such a high profile case, she wants to be very careful about what she does," said legal expert Dwayne Cates. " Also - this is going to be in the Court of Appeals for the next 20 years. When she makes a ruling she wants to make sure she's legally correct, and she has a good basis for what she does. I believe she is just being careful."

Defense attorney Kirk Nurmi told Maricopa County Superior Court Judge Sherry Stephens on Friday that a number of issues have come up that have made it impossible for his client to receive a fair trial.

He claims prosecutors withheld key evidence and 14 witnesses have been afraid to come forward because the court won't protect their identity.

And he said her conviction was based on false testimony.

More specifically, a Mesa police officer testified during the original trial no pornographic material was found on the computer of murder victim Travis Alexander, Arias' ex-lover, when in fact testimony revealed pornographic images were there.

Arias' attorney insisted the false information hindered her case and the judge has no choice but to have the state no longer seek the death penalty.

Mesa Police Det. Estaban Flores acknowledged on the witness stand Monday, that evidence was found to indicate that pornographic websites had been accessed on Alexander's computer.

Prosecutors had told the judge that there was no intentional mishandling of evidence, and that Arias' attorneys have made no real effort to subpoena those 14 witnesses who might have been afraid to come forward and testify.

Transcripts closer to release

In another potential development, transcripts from Arias' secret testimony are expected to be released on Tuesday.

Last week, the Arizona Supreme Court denied Arias' request to delay her trial, which meant that the transcripts from her closed-door testimony in October were closer to being released.

But the transcripts, which the media has been fighting to be made public, can't be released until the notes from the court reporters are turned over to the Clerk of the Court to be recorded and put into the proper format for release.

The court's decision also means a Jan. 16 status conference will not be held.

In a ruling that overturned Stephens' decision barring the public from watching Arias' testimony, the Arizona Court of Appeals ordered the transcripts released.

A lawyer for media organizations Thursday requested release of the transcripts from her closed-door testimony Oct. 30 and Nov. 3, from which the media and public were barred.

However, Stephens said she wouldn't do that until the state Supreme Court ruled on defense lawyers' motion to pause the retrial while they appeal the Court of Appeals' ruling.

The oft-interrupted proceedings in the Arias sentencing retrial resumed Thursday morning as the jury continued to determine whether Arias deserves life in prison or the death penalty.

Jodi described her home life and that mean ole wooden spoon her mom carried around in her purse. She claims that before her birth her mom smoked weed that day and might have been smoking during the entire pregnancy, but she has no proof of that.
She said when she was 4 she saw a mirror with white powder on it in her parent's room. That she knows now was cocaine. The day her uncle got married her dad took cocaine as a party gift.
She talks about her childhood, where they lived, when she became interested in art, etc. (present tense) "My mom and I don't get along at all. We just don't mix." Remember when she was pleading to the jury she pointed to her parents and said it would hurt them if she was given the death sentence?

IMHO, the only burning question I have is: Why didn't Travis' roomate(s) smell his body? He was dead 4 days (IIRC) before he was discovered..I realize the house is big but really....also..guess no one did any laundry or cooked? Just can't imagine..

She knew what she was doing before, during and immediately after..she wasn't in the infamous fog for 2 years...it's just ridiculous..

PHOENIX - An Arizona judge has denied a defense motion to dismiss a notice by prosecutors that they intend to seek the death penalty against Jodi Arias, who was convicted in the 2008 killing of her ex-boyfriend.

Maricopa County Superior Court Judge Sherry Stephens issued the ruling late Wednesday afternoon.

Arias was convicted in 2013 of killing Travis Alexander. But jurors deadlocked on whether she should be sentenced to life in prison or death.

A new jury was picked to decide her sentence, and her sentencing retrial is ongoing.

Arias' lawyers had argued that authorities destroyed computer evidence that would have benefited their client.

The judge in the Jodi Arias sentencing retrial has denied a motion to take the death penalty off the table.

Arias' lawyers appeared to make a strong case when they filed a motion to take the death penalty off the table.

But late Wednesday afternoon, Judge Sherry Stephens ruled it wasn't strong enough, which means the trial will proceed.

Legal expert Dwayne Cates doesn't think the judge's ruling will make much difference. He noted it's very unusual for a jury to sentence a woman to the death penalty.

"They seem to be more sympathetic for women than men," Cates said. "They don't see women as being as big a monster as they see men that do the same crime and that's why very few women on death row and very few women will be put on death row." BS!!!

The sentencing retrial was supposed to wrap up one month ago. Instead, Stephens told the jury Wednesday to expect this case to run through next month.

Things got a little heated in the courtroom as defense attorney Kirk Nurmi once again accused prosecutor Juan Martinez of misconduct.

Martinez fired back, telling Arias' attorney to quit attacking the prosecutor when "you are failing at something."

There are no witnesses scheduled for Thursday or Friday and Monday is a holiday. The trial will continue Tuesday morning.

The Arias trial has garnered national - even worldwide - attention.

On May 8, 2013, a jury convicted her of murdering Alexander, and while they found her eligible for the death penalty, they could not unanimously agree to hand down the sentence.

Because of that, Stephens declared a mistrial in the penalty phase of the trial.

After months of legal wrangling, a new jury was eventually impaneled, and a retrial of the sentencing phase began Oct. 21. It is expected to last until the middle of the month.

In the meantime, rumors that Arias herself will once again take the stand continue to swirl.

PHOENIX (KSAZ) - The Jodi Arias sentencing retrial resumed on Tuesday with Dr. Robert Geffner back on the witness stand.
Dr. Geffner testified in detail today... looking into the contents of Travis Alexander's messages to not just Jodi Arias... but other girls.messages which veered from flirtatious to frankly sexual in nature.

He also testified about Jodi' Arias' attempts to break up with Travis, only to seek to reunite with him.

This afternoon there was a nearly hour-long sidebar battle between prosecutor Juan Martinez and the Arias defense team over affidavits from witnesses the defense team wants to use to try to convince a jury that Jody's life should be spared.

Finally Dr. Geffner started reading from those affidavits. In one, a witness said he saw Travis Alexander holding former girlfriend Deanna Reed down on a couch...saying "get it out of your "bleeping" head I won't marry you."

A witness in another affidavit said Travis admitted to him that he had child pornography on his computer and said it was because he had been
assaulted at the age of 12 by an older adolescent.
