The lawsuit was brought forth in the Lake County Courts in November of 2006 by the family members of Melinda Duckett, mother of the missing Trenton Duckett. Trenton Duckett was taken from his bedroom window in late August of 2006 while his mother and friends were watching a movie in the living room in Leesburg, Florida. The lawsuit is seeking an unspecified amount for damages stating that the Nancy Grace show inflicted emotional distress and also misappropriated the young mother's image.

Im not quite sure what to say about this. When someone is in emotional distress you dont ADD on top of it with more. It destroys people

I hope the family wins against her. I also hope that someone, somewhere convinces the B*tch to tone it down a little bit with how cruel she can be.

You know I wasn't blogging much or know much about the Duckett case. I know a child was taken, missing and the mother committed suicide. I think the Anthonys were supporting the family some way or another.
I look for the Anthonys to sue the pants off of her after Caseys trial.

As a viewer she has been pretty interesting showing nightly the happenings of the Caylee murder.

If it was my family..I would sue too.

You might be surprised at my take on this.

I do not blame Nancy Grace for Melinda Ducket's suicide. Yes, Nancy can be a bitch and yes, Nancy was interrogating her via phone. And yes, Nancy was basically accusing her of hiding something. However, no one made Melinda kill herself but Melinda. I was living in Florida at that time and I am here to tell you that Melinda Ducket was guilty in this all the way. I am not saying she killed Trenton. (You will have to read all the facts in this case) but will say that most that are knowledgeable of it believe she sold her son. Melinda was involved with some Oriental gang members and it is believed her son is overseas somewhere and that she waited to call the police until after he son was long gone.

She was a lot like Casey Anthony, a major party gal. And, a huge liar.

She was one disturbed individual and NG did not cause or contribute to her disturbed state. I believe she did in fact, murder little Trenton. If she had sold him, she would have simply run away, changed her identity, I think. Her family must have been aware of her lies and actions, yet did nothing. I see no reason for them to profit from her death. I certainly see no legitimate basis for sueing Nancy Grace for an interview with questions that needed to be answered. Afterall, at the time a child was reported missing/stolen and the last person to see him was Melinda. She agreed to be on the show and do the interview knowing full well what she would be asked. JMO

Among Grace's most revealing statements, as she struggled to disavow any responsibility for Duckett's death this week, was this one: "I do not feel our show is to blame for what happened to Melinda Duckett," Grace said Monday. "Melinda committed suicide before that interview ever aired." It speaks volumes about Grace's world view that in her mind, reality doesn't happen until and unless it's witnessed by her viewers. By the same token, she seems to believe there is no real justice, until it happens on her show.

I would agree with this. NG typically plans legal analysis, psychiatrist and victims advocate. She invited guest on her show then is rude to them, belittles them and cuts them off before they can finish. What she did to Elizabeth Smart was so out of line. Elizabeth tipped the table on NG. Good for her. Maybe this lawsuit will humble NG a bit and that would be a good thing.

I am going to review all of the videos and background on this before I give an opinion. However, I will say this. If this woman committed suicide because of the way NG treated her, she had someone guilt to begin with. I also think she had to have known how NG felt about her BEFORE she went on. She should NEVER have gone on her show to begin with, if she was that fragile! Doesn't anyone take responsibility for their OWN actions anymore. Everyone wants to blame someone else for their own decisions. I think this family may need to open their eyes and see what is in front of them.
Just MY opinion. And I reserve the right to change it at ANY time. LOL!

Wow that is the first time I ever read that transcript. I see a huge problem with Melinda's interview. She won't even say where she was with her Son that fateful Sunday. Everyone was right and her story just don't add up. Poor little boy. Where is he? :pale:

I think this lawsuit will be thrown out. This is an absolutely ridiculous claim. The family should read the transcript again. There is NO ABSOLUTELY, NO WAY, a child is taken out of the screen. Come on! Wow, talk about denial!
I've watched a ton of videos on this now, this morning and read the transcript and given this even the benefit of the doubt, trying to put myself in her families shoes. I just don't see how they can blame anyone except it being a tragedy all the way around. Or blame Melinda herself. Harsh??? Maybe. But I think she definitely knew something and/or was completely guilty. Again, my opinion, only!

Tracey276 I should have read the transcript first before this morning. I seriously had trouble finding it yesterday. Although I still feel NG should show more humbleness and manners I in no way hold her responsible for Melinda killing herself. Why has this case not been tossed out is what I want to know now.

The actual video used to be all over the internet but was taken down once NG was getting sued.

The problem with NG that I have on this is that NG did not air the MD interview live. She aired it the next day AFTER MD had committed suicide!! I thought that was really bad of her!

OCALA, Fla. — A Harvard professor says CNN Headline News host Nancy Grace's relentless questioning of a Florida mother three years ago contributed to her suicide, according to a filing in the family's wrongful death case.

Grace launched aggressive nightly coverage of 2-year-old Trenton Duckett's case shortly after he disappeared in 2006, usually with a collection of analysts. When the boy's mother, Melinda Duckett, appeared by telephone two weeks into the case, speculation was beginning to narrow on her possible involvement.

Dr. Harold J. Bursztajn, a clinical professor of psychiatry, wrote in a filing this week. that Grace "struck a highly accusatory tone."

The professor saw "a distraught young woman who is subject to repeated and increasingly sharp questioning by a hostile interviewer who displays increasing suspicion and anger towards Ms. Duckett."

The next day, the 21-year-old Duckett shot herself in the head.

"Her apparently unanticipated public humiliation on the nationally televised program in question was a substantial contributing cause of her suicide," Bursztajn wrote.

The family claims Grace's questioning, along with the network's decision to air the pre-taped interview the day Duckett committed suicide, inflicted severe emotional distress.

Grace and the network have denied any involvement in the suicide, and a CNN spokeswoman declined comment on the filing.

Trenton has still not been found, and Duckett is the only suspect.

Melinda was not singled out. NG can be very hard on people. Melinda Duckett did something with her Son and that is why she committed suicide. NG will be found not guilty. I had a thread going a while ago with some video's of the NG show in question. I can't find it.

It was Melinda Ducketts choice to go on Grace's show
and she could have taken the microphone off and walked away at anytime during the interview. She was
in a fragile state to begin with, probably because she was guilty of harming her child which is just my opinion. I think anyone who has ever seen Nancy Grace in action could hardly believe that they would be treated with kid gloves. I dont blame Nancy, people watch her because she does ask tough questons. How many times have we screamed out loud at the TV when some of these interviewers that have spoken to Cindy and George didnt ask any really tough questions?

Melinda ASKED to be on her show. I agree with you, Artgal..NG did NOT make Melinda Duckett commit suicide. This is ridiculous.

Melinda Duckett was guilty of, IMO, selling her son to a Korean gang. She knew the jig was up and after appearing on NG, killed herself. But it is NOT Nancy's fault.

I found this article about the police checking all the travelers going to Korea when Trenton disappeared.
They checked 12,000 manifests and found no evidence
that Trenton left the country. But of course, he could have been given to someone in the U.S. as well.

OCALA, Fla. -- WESH 2's interview with the lead investigator in the case of a missing Lake County toddler is sparking new information.

WESH 2 anchor Wendy Chioji interviewed Maj. Chris Blair of the Marion County Sheriff's Office on Monday, and detectives said they are still following up on phone calls and tips that continue to come in.

The case of Trenton Duckett, who was reported missing from his mother's Leesburg apartment on Aug. 27, has once again gained national attention.

MSNBC picked up the story on Tuesday, and ran several updates throughout the day about information gained from Blair's interview on WESH 2 News.

Detectives said they are now talking to experts in the field of adoptions from Korea.

Trenton's mother, Melinda Duckett, was adopted from Korea to a family in the U.S., and she had told at least one co-worker that she wanted to expose her son to the Korean culture.

Detectives said they want to try to understand the different culture in Korea to see how people there might react to a foreign child versus in the United States.

Investigators are also continuing to conduct follow-up interviews with the major players in the case.

Investigators said they have no evidence that Trenton is alive or dead or in Korea, but they continue to follow several theories and to work the case as if the toddler is alive.

Police are also looking over the passenger lists of U.S.-Korea flights from last summer. They said 12,000 people flew from the United States to Korea on the day Trenton disappeared, and detectives have to check all those names and all those flight manifests.

So far, they've found nothing to indicate Trenton ever left the country.

Melinda Duckett killed herself on Sept. 8 and she remains the prime suspect in her son's disappearance.

I have always thought he was alive. I think Trenton stayed in the US until the case "died down" and was then smuggled to the orient. I do feel for Josh. He has been through the ringer.

I would like to think he is still alive, but I don't. I think she killed him and dumped his tiny body in the woods where she drove that day. I don't think she would have committed suicide if not. Her suicide was not exactly a result of the interview with NG in my opinion, BUT it did make her realize everyone was onto her and were not going to believe her lies. I do not think NG can be faulted for it though, jmo.

Laga, if she dumped his body in the woods where she drove that day (are you talking when she went to Wendy's twice in the same day..the first time, Trenton is with Melinda..the second time..he was NOT) why didn't LE or anyone find the body?

They dont always find a body - but my question is this -
was her object to sell Trenton? She wouldnt have just given him away for nothing - did they find any money
after her suicide? I cannot see her killing herself if she sold the child. But why sell him if not for money, and if she got money was any found after her death?

There are several facts in this case that draw me to my conclusion. She put an ad in the local paper in hopes to sell his car seat 17 days before he went missing. Her trash was found to contain pictures of Trenton and toys, even the ultrasound image was in her trash, taken out by the two guys visiting her the evening she reported him kidnapped. She faked email from Josh and tried to implicate him. She purchased the gun she used to kill herself 2 days before an amber alert for Trenton was issued. Her Eclipse was reportedly spotted in the Okala National Forest the day before she reported the kidnapping and if she dumped him there I am not surprised his body was not found. I don't know how factual the Wendy's account is or the forest sighting, but it was reported. But the fact that she killed herself is the most incriminating piece of the puzzle. I think, a mother, no matter how distraught over a child’s disappearance and no matter how tough the media is on her, does not give up the hope that her child is coming home. To kill herself tells me she had no hope and knew he was not coming home and added to that the knowledge that her story was not being believed, she felt she had no reason to live. Even her suicide was cruel in my opinion, realistically it was a murder in her grandparents home. jmo

NANCY GRACE, HOST: Breaking news tonight. Is 2-year-old Florida boy Trenton Duckett alive? New details emerge in a parent`s worst nightmare, a 2-year-old boy tucked into his crib, mom in the next room with a video, then she says the window screen slashed, the baby gone. Almost immediately, police name mom Melinda Duckett the prime suspect. Tonight, a new witness who passes a polygraph with no hint of deception comes forward, giving us all hope baby Trenton is still alive. And tonight, investigators converge to join the search.
And a special guest later on, Glenn Beck speaking out on the newly reported O.J. Simpson interview on how to commit murder. Somebody tell me, did this guy get paid? And Beck on the radical Islam agenda.

First, is 2-year-old Trenton Duckett alive?

UNIDENTIFIED MALE: We have a witness. She believed that she saw Melinda. She remembered seeing little Trenton in the vehicle, and she asked about his name. She had an earpiece in her ear, and she said, Is it Denton? And Melinda corrected her.

We believe that it was possible during this time that she may have left that Wendy`s and actually met someone to hand Trenton off to another person to take.

Team members of this parallel investigation by the Marion County sheriff`s office, along with Leesburg Police Department, Lake County sheriff`s office, the Federal Bureau of Investigation and the Florida Department of Law Enforcement are prepared to say that little Trenton is alive.

GRACE: Good evening, everybody. I`m Nancy Grace. I want to thank you for being with us tonight.

In a stunning development, Marion County police in Florida say they believe this little boy is still alive. To Court TV correspondent Jean Casarez. Explain.

JEAN CASAREZ, COURT TV: Well, law enforcement believes this woman, number one, is credible. And she -- her testimony, her statement is corroborated by the cell phone tower record. Remember, weeks ago, we heard about that. On Sunday, August 27, cell phone tower records placed her initially in Leesburg, Lake County, but then traveling to Marion County.

And at the time that those records show she was in Marion County, this witness is saying, Yes, I worked at a Wendy`s drive-through. A woman came through. I recognize that tattoo. I saw the little boy. I said, What`s his name? And I thought I heard Denton, and I said, It`s Denton? No, she said, it`s Trenton. And the woman is saying, I can`t forget that. And she has passed a polygraph.

GRACE: But that`s not the end of it, Art Harris. According to this Wendy`s employee, who reportedly passes a polygraph with, quote, "no hint of deception" -- and remember, this is August 27, the day the little boy was reported missing later that evening.

So the mom allegedly drives through with the baby in the car. As Jean Casarez says, the woman speaks to the mom. She recognizes and recalls very well her barbed-wire tattoo. It`s very noticeable on Melinda Duckett`s arm -- asked the name of the baby, gets it confused, Denton, the mom says, Trenton. But that`s not all.

ART HARRIS, INVESTIGATIVE JOURNALIST: That`s right.

GRACE: The mom comes back, Art!

HARRIS: She comes back, Nancy, about an hour later. The first trip was about 11:30 that morning. She orders something. And she comes back. The worker at Wendy`s notices Trenton is not in the car this time. And the mother comes back. Melinda buys some chicken nuggets.

So what the Wendy`s worker remembers is the first time she came through, she bought grown-up food. Doesn`t remember exactly what she bought, but she remembers the amount she spent. Police have gone back and they`ve checked the exact amount. This worker has an amazing ability to remember details about customers like that. And so she remembered the second trip, didn`t remember the amount of money she spent, but she got chicken nuggets.

Trenton was not in the car, and the theory is that she left Trenton with somebody. Police believe that there`s a conspiracy. She handed him off to somebody to keep him away from her husband. And maybe she forgot to buy him lunch, so gets him his little child`s food and then leaves. That is the one sighting alive of Trenton that day, giving police hope that...

GRACE: Whoa, whoa, whoa, whoa, whoa! Where`d she put the baby between the first Wendy`s visit and the second Wendy`s visit?

HARRIS: That`s the big question, Nancy, and that`s what investigators are doing, going back and totally revamping their assumptions in this case to believe that he`s now alive. And working from that assumption, they`re looking at her cell phone records and going back six months before they even began to look at records.

GRACE: OK. Joining me on the phone right now from Ocala, Florida, is a very special guest tonight, Major Chris Blair. He is with the Marion County sheriff`s office. And if you recall, the search had gone to Marion County because there was a possibility the two were sighted near a lake there. When that didn`t pan out, focus shifted back toward where Melinda Duckett lived. This Wendy`s, however, is in Marion County. This witness has been uncovered by Marion County police. And joining us is the sheriff, Major Chris Blair. Sir, thank you for being with us.

MAJ. CHRIS BLAIR, MARION COUNTY SHERIFF`S OFFICE: You`re welcome.

GRACE: You know, I`m just stunned. And a lot of people are asking why is she just coming out? She`s not just coming out. Isn`t it true that this lady witness came forward to you guys September 27?

BLAIR: That`s correct, Nancy. She made contact with the Bellview (ph) Police Department, located just south of our agency.

GRACE: And you know, a lot of people are also asking, Why haven`t we heard of this before? But Major Blair, isn`t it true, you get a tip, then you have to go over and interview the woman, say the next time she`s at work?. You have to take a detective over after that. Then you guys, I`m sure, investigated her story, corroborated her story, and finally reportedly got her in for a polygraph. That takes time.

BLAIR: Yes, ma`am. It sure does.

GRACE: Now, sir, how did the focus get off Marion County to start with?

BLAIR: Well, after we conducted the search at the lake, it wasn`t until a later time that we learned that the cell towers -- we received hits from Melinda Duckett`s phone records. So then after that was substantiated, it bought that back into Marion County. We then, with many, many detectives, covered the Marion County area in the direction of travel that Melinda took on August 27, trying to find witnesses and videotapes, and so forth.

GRACE: Major, hold on a second. We just put up a map to show viewers what you`re talking about. See the ATM? That is near Leesburg, near her home, at 10:49 AM. The Wendy`s, and correct me if I`m wrong, Major, is about seven to ten miles away. She`s there around 11:15-ish and about 20 minutes later. Then suddenly, she`s at the Paddock (ph) Mall area around noon. That`s where she is -- is sighted there. Excuse me. That`s where she gets a ping on the cell tower.

Now, explain to me your timeline, Major.

BLAIR: Well, she`s at the Leesburg ATM at 10:49, and we`re probably about 20 miles -- or 20 minutes north of Leesburg. So upon the time she arrived at the Wendy`s, it was around probably 11:15, according to the witness. She then said -- and I have to make a correction here, that the - - Melinda returned 20 minutes later. It wasn`t an hour, it was 20 minutes later without Trenton.

GRACE: So just 20 minutes later, the baby`s gone. Then she turns up by cell phone ping at the Paddock Mall cell tower. Yes?

BLAIR: Yes.

GRACE: OK. Major, what`s your theory? Where was Trenton 20 minutes later?

BLAIR: Well, you know, we believe, due to the fact that Melinda is an obsessive-compulsive type person, she`s a planner -- she states in one of her letters that, I like to plan things. I think that there is a theory. And there`s multiple theories in this case, but I think that`s usual with major investigations. But a theory that we have is that there is a possibility that she conspired with individuals to pass Trenton off.

GRACE: You know what`s interesting, Major? The night that I interviewed her, it was an interview by phone. The husband was on air. She found out the husband, Josh, was giving an interview and then she decided she would come on, too. That night, she mentioned the very same thing, unsolicited to me, how she would never be caught short of change, that she always planned things out. She mentioned the very same thing you`re talking about right now, which really didn`t even fit into the question I had asked her.

But still, I don`t understand how her being a planner, and Trenton`s there at the Wendy`s, 20 minutes later he`s not -- why does that give you so much hope the baby is still alive?

BLAIR: Well, I think that we have to look at this, that there`s no indication that any harm has come to Trenton. I think that the Leesburg Police Department did an outstanding job on their investigation as far as looking at the scene. We weren`t privy to that information during the investigation. However, there`s no physical evidence.

GRACE: You know, another thing, Major, it just seems to me that we would have found something by now with the degree of investigation. We`re talking about the possibility that a 2-year-old Florida boy -- there`s been a massive search for this little boy, Trenton Duckett -- may still be alive. A new witness has emerged. Joining us is Major Chris Blair with the Marion County sheriff`s department there in Florida, who found the witness, interviewed the witness and has had the witness polygraphed, which she passed.

But speaking of Melinda Duckett, take a listen to this.

GRACE: Melinda, where had you been with him that day?

MELINDA DUCKETT, MISSING BOY`S LATE MOTHER: We had basically been out driving around. There`s something about a convenience store. I don`t know where that came into play because whenever I go out somewhere, you know, I always have gas or I`m not short-handed with anything, and I`m always prepared for it all. So...

GRACE: So where had you been that day?

MELINDA DUCKETT: We had been -- gosh, all through Lake County and up into Orange.

GRACE: Doing what?

MELINDA DUCKETT: Basically just shopping, going around, driving.

GRACE: Shopping where?

MELINDA DUCKETT: Well, we didn`t go anywhere specific.

GRACE: Well, I mean, if you went shopping, you had to go into a store. What store did you go into on Sunday?

MELINDA DUCKETT: We went throughout the county.

GRACE: Out to Mike Brooks, former D.C. cop, former fed with the FBI. Mike, what do you make of it?

MIKE BROOKS, FORMER D.C. POLICE, SERVED ON FBI TERRORISM TASK FORCE: I`ll tell you what, it sounds like the Marion County sheriff`s office has done a great job. In fact, I think the whole task force, Nancy, has done a phenomenal job with Leesburg, Lake County, Marion, the Florida Department of Law Enforcement and the FBI.

But there`s still a lot of work to be done. You know, they`re probably going to have to go back now and look at all of the cell phone records going back months and months because if she did meet up with somebody, the likelihood of her calling that person to meet them somewhere is going to be in the cell phone records somewhere on that map we saw, on some time. So if they -- he had -- she had to drop him off somewhere before she went back home and planned having the movie with those two guys because, remember, there were two guys that evening between 7:00 and 9:00. They also have been polygraphed and both of them have passed a polygraph.

Now, a law enforcement source close to the investigation told me today that, yes, this woman did pass a polygraph. She was non-deceptive on that she believes she saw Melinda and Trenton.

You know, I sure hope, everyone hopes that this is really a big -- a big break in this case, and I`m sure Josh does because he has just been on an emotional roller-coaster ride since all of this happened, Nancy.

GRACE: Speaking of Josh Duckett, joining us right now is Trenton`s father, Josh Duckett. Josh, welcome to the show. I`ll be seeing you tomorrow night there in Leesburg. We`ll be reporting live from the team Trenton headquarters Thursday and Friday night, all excited about this stunning news and hoping for the very best. Josh, what do you make of it?

JOSH DUCKETT, MISSING BOY`S FATHER: It`s a big break for us. I mean, I think that it`s going to generate a lot more people to want to help and a lot more people to keep their eyes open. I mean, we`ve felt all along that Trenton is alive and well, it`s just a matter of finding him. And now that law enforcement is saying the same exact thing that we`ve thought all along, I think it`s going to help a lot.

GRACE: Josh, when did you learn about this new witness at Wendy`s?

JOSH DUCKETT: I had heard stuff about her a few weeks ago.

GRACE: Do you know who she is?

JOSH DUCKETT: No.

GRACE: I`m not asking you her name. I don`t want to hear her name on the air, but...

JOSH DUCKETT: I don`t know who she is. I haven`t gotten all the details on her, but they have told me the story and everything that went along with it.

GRACE: Back to Major Chris Blair with the Marion County sheriff`s office. Have you personally interviewed the lady?

BLAIR: No, ma`am. One of my detectives has.

GRACE: What did he think of her?

BLAIR: It was a female detective, and she certainly did an excellent job with the interview. She also interviewed the management there, along with co-employees. They described this witness as uncanny. She has the ability to remember people and conversations. So I think, certainly, you know, she has a reputation of remembering people.

GRACE: Has she been a long-time employee?

BLAIR: She`s been there for some time.

GRACE: And a lot of people, again, are saying why is this just coming out? Well, he went missing August the 27th. The national media didn`t get ahold of it for a couple of weeks. And this woman comes forward September 27. So it`s not like she sat on her thumb for months and months on end.

Let`s go to the lines. Jeana in Ohio. Hi, dear.

UNIDENTIFIED FEMALE: Hi, Nancy.

GRACE: How are you? What`s your question?

UNIDENTIFIED FEMALE: My question is the same thing. Why now is this coming out with this lady? I mean, why now? I mean, and also, my question is, for the detective, did she know this person? Is there any indication if she knew this person?

GRACE: Good question. Let`s got out to Major Chris Blair. Major Blair, it`s my understanding that this lady employee at Wendy`s did not know Melinda Duckett prior to this, and what attracted her attention to Duckett was that -- Rosie (ph), can you pull up a picture of that tattoo? If you see that hanging out of the car window, you`ll probably remember it. It`s a very thick, dark, ink, barbed-wire-looking tattoo. And she actually had a conversation, Jeana, with Melinda Duckett about the name of the little boy. She got his name wrong because she had on her headset. It was a drive-through situation. She said Denton and Melinda Duckett reportedly corrected her, saying, No, it`s Trenton, not Denton. Twenty minutes later, the woman comes back through.

To Major Blair. Please explain for Jeana and others why it`s taken so long for this to surface to the press, anyway, and was she familiar with Melinda Duckett prior to the sighting?

BLAIR: Well, Nancy, I think you covered it in the opening that, you know, doing an investigation, we have to be cautious with witnesses, and certainly, we have to establish whether what they`re telling us is accurate or not. And we wanted to make sure that this person wasn`t fabricating any information.

So therefore, after we received the information, we did multiple interviews with the management and co-employees. Thereafter that, we decided to try to schedule a polygraph, which took some time to get it scheduled. Once it was scheduled, she took the polygraph. The results showed no deception at that time.

Sheriff Bean (ph) then decided to go ahead and have a joint meeting with law enforcement agencies to include the FBI, Florida Department of Law Enforcement, the Lake County sheriff`s office and the Leesburg Police Department. At that time, it was discussed at that time what information we had. Therefore, it was determined to go forward with this parallel investigative team.

GRACE: Right.

UNIDENTIFIED MALE: Team members of this parallel investigation by the Marion County sheriff`s office, along with the Leesburg Police Department, Lake County sheriff`s office, the Federal Bureau of Investigation and the Florida Department of Law Enforcement are prepared to say that little Trenton is alive. Why do we say that? Because no one has proven to us otherwise.

UNIDENTIFIED MALE: If there is a captor and they have little Trenton in their custody but they`re not sure how to get him returned, we want to encourage you to drop him off at a public place. Just drop him off somewhere to where we can bring him back home.

UNIDENTIFIED MALE: There`s many theories that surround this case, many, many theories. And I don`t think any one of us have the correct answer. And I think that our main focus is to put every effort out there to find Trenton.

GRACE: Stunning news tonight out of Florida, specifically Marion County. A newly emerged witness says she spotted Trenton Duckett with his mom the day he went missing. Now police lay it on the line, saying they believe Duckett is still alive.

Out to the lines. Shelly in Missouri. Hi, Shelly.

UNIDENTIFIED FEMALE: Hi, Nancy. How are you?

GRACE: Good, dear. What`s your question?

UNIDENTIFIED FEMALE: I was just wondering, have they ever decided how the screen -- whether it was cut from the inside or the outside...

(CROSSTALK)

UNIDENTIFIED FEMALE: ... from the bedroom where the baby was taken?

GRACE: You know, Jean, I`ve got a lot of questions about outstanding evidence, such as the screen and specifically the computer.

CASAREZ: Well, the screen, first of all, they could not decide if it was cut from the inside or the outside because it was a nylon mesh. And once it`s cut, it just sort of goes back together. The computer, the FDLE is using all of their tools to investigate that. They first had to look at what was deleted, if there was anything relevant there. Then they went to what was currently on the computer, and there was so much that I think they`re still going through it to see if there are any clues at all.

GRACE: So we still don`t have the computer back, right, Jean?

CASAREZ: No, they are still looking at it.

GRACE: Where were you? Why aren`t you telling us where you were that day? You were the last person to be seen with him.

MELINDA DUCKETT: We`ve already gone out and distributed the flyers and...

GRACE: Why? Why aren`t you telling us, giving us a clear picture of where you were before your son was kidnapped?

MELINDA DUCKETT: Because I`m not going to put those kind of details out.

GRACE: Why?

MELINDA DUCKETT: Because I was told not to.

GRACE: Ms. Duckett, you`re not telling us for a reason. What is the reason? You refuse to give even the simplest facts of where you were with your son before he went missing. It is day 12!

MELINDA DUCKETT: It`s all media. It`s not just here, it`s all media, period.

GRACE: Tonight, a stunning development out of Marion County, Florida. Is Trenton Duckett still alive? A newly emerged witness gives a sighting of Trenton the day he goes missing.

Out to the lines. Amy in Georgia. Hi, Amy.

UNIDENTIFIED FEMALE: Hi, Nancy. I was thinking about something. I have a 4-year-old daughter. And to this day, we have a baby monitor in her room and we have another receiving end in the living room and in our bedroom. And most units that you buy today have two receiving ends, so you can hear them, and you know, have them in two different rooms. And I`m thinking, surely, as young as he was, there had to be a baby monitor in his room, you know, that they probably would have had in the living room or the bedroom. Did the gentlemen that were in her house that night remember seeing, you know, or hearing anything? Because you can hear everything that comes over a baby monitor.

GRACE: You know, you sure can. What about it, Jean Casarez?

CASAREZ: We`ve heard nothing of a baby monitor. We only know there`s basically two ways that baby could have gotten out of the house. If you think that 10-inch cut in the screen the baby could have gotten out, that would be one way. Another way would be through the front door, but Melinda would have seen that, along with the two gentlemen as they watched the movies.

UNIDENTIFIED FEMALE: The witness stated that, while working in the drive-thru window of Wendy`s, that Melinda Duckett and Trenton had come through the drive-thru at one point between -- sometime between 10:30 -- or, I`m sorry, 11:30 and 12:30 that Sunday. She made a food order. She left. And about 20 minutes to 30 minutes later, Melinda Duckett came back through the drive-in, but did not have Trenton with her at that time.

UNIDENTIFIED MALE: We have no physical evidence, Leesburg or the Marion County Sheriff`s Office, to support any harm coming to Trenton.

GRACE: So why give away or sell her baby? Is it true police now have a theory that Trenton Duckett is, in fact, alive, the 2-year-old little boy pictured here? Out to Andrea Macari, clinical psychologist, why sell or give away your baby?

ANDREA MACARI, INSTRUCTOR OF PSYCHOLOGY: Well, it`s the ultimate vindictive act, Nancy. Think about it. Not only does the father lose access to his child, but he is left with many unanswered questions. And it`s the unresolved nature of this crime which really makes it beyond the pale of understanding.

GRACE: To Mike Brooks, would we have found his remains by now?

BROOKS: Not necessarily, Nancy. You know, talking with the police down there, you know, they had focused their investigation, their ground searches in Ocala National Forest to the north of Leesburg and in south Lake County. It`s very, very rural. You know, hunting season apparently has started. No hunters have come across the baby, you know, any remains as of yet. So, you know, that`s why there`s still hope that he`s out there.

As well as investigators are quoting, again, her note that was left there, and the tone of the note that gives them continued hope that Trenton is still alive somewhere.

GRACE: But back to Andrea, how can we believe a single thing that Melinda Duckett ever said? I mean, this witness alone disproves her whole theory that she was driving through the Ocala National Forest. That was total B.S.

MACARI: But, you know, Nancy, I think there`s a reason why she presented herself as being this planner. Think. What we say, especially what we see on TV, we`re putting that forward for a reason. Maybe that was her subtle, quiet way of saying, "Hey, listen, what you think I really did is not what happened. I am such a planner that I did something that you`ll never be able to figure out."

GRACE: Back out to Josh Duckett, Trenton`s dad who is with us tonight. He`ll be joining us at Team Trenton Headquarters Thursday and Friday night. We will be taking your calls live.

Josh, there`s been a lot of confusion about that cut in the window screen. Explain.

J. DUCKETT: Yes, I was told through the Leesburg Police Department that it wasn`t just a 10-inch slit. It was actually cut down the side of the screen and across the bottom and then up the other side. So it was like three sides of a square or of a rectangle.

GRACE: What do we know about that, Major Blair?

BLAIR: I can`t respond to that, Nancy. That was conducted by the Leesburg Police Department.

GRACE: Is there any reason that the screen would have been cut at the crime lab, Major?

BLAIR: Yes, they would have went ahead and probably ran a test with different instruments that were collected from Melinda to see if they compared with each other.

GRACE: Because all along, Art Harris, we had been told and Josh had been told by police that there was a single 10-inch cut on the screen.

HARRIS: That`s right, Nancy. But let me think about -- if you think about the theory of the police, that she is so smart, could she have concocted that whole scenario at her house, using those two guys as an alibi? She tells them where Trenton is, in the back bedroom, but doesn`t show them Trenton. They don`t see Trenton.

This is a planned-out event all day long. She goes through this drive-thru, which is the only time anybody sees the child, and maybe she planned the whole thing out. So if you go back and look at her interview, even with you, Nancy, she is so elusive. She dodges every question you asked her about where she was that day. Who did she meet? Who did she hand Trenton off to? The police want to know. And was she covering that up so police don`t have a lead as to where to go that day to find out who she may have met?

GRACE: And what else do we have, Art, in your estimation -- you`ve covered so many cases -- that would suggest Trenton is still alive?

HARRIS: Well, Nancy, as the police said, you don`t have any DNA. You have no blood; you have no hair. You have nothing in her car that indicates foul play. And all of those negatives give people hope.

And so I think it`s a brilliant and creative way to look at a missing child case that he is alive. And, you know, use the bloodhounds, but also use the human bloodhounds, and look at this from the point of view of forensic psychology, where you have a woman, her , and how she may have thought she was smarter than everybody else.

GRACE: Out to Josh Duckett, Trenton`s dad with us. A caller earlier asked about a baby monitor, if she had had a baby monitor. Certainly, the guests watching the video that night would have heard the baby.

J. DUCKETT: Yes. To my knowledge, there was not a baby monitor.

GRACE: And, again, Josh, what did we find in the trash, that she had thrown away that very day she reported him missing?

J. DUCKETT: To my knowledge, there was toys, there were sonograms, baby food, snacks for babies. And to verify for the sonogram picture, I mean, it was said that there was numerous sonograms. There was numerous sonograms, but they weren`t of the same one. They were in different stages. The doctor that she went to for the sonograms was like a learning facility at the college, and they`d done it step by step, one sonogram every month.

GRACE: Out to Britney in Ohio. Hi, Britney.

CALLER: Hi, Nancy.

GRACE: What`s your question, dear?

CALLER: My question is: Why weren`t Melinda`s cell phone records traced back six to seven months prior to now, especially if she`s a planner? Why does it take so long to trace those?

GRACE: Out to our lawyers joining us tonight, Richard Herman and Renee Rockwell, we really don`t have any evidence, Renee, that they haven`t been traced back six or seven months. And if she were handing this baby off, Renee, clearly you would have seen those phone calls on a cell phone. What do you think?

RENEE ROCKWELL, DEFENSE ATTORNEY: Nancy, I am sure they are looking at, not only her cell phone, but her land line records, because -- and I`ve said all along, Nancy, that that baby is still alive. I think the hostility that she had against her husband was great enough to the point that she would give that baby away before she`d let him have him.

But it`s not what she says that interests me; it`s what she`s done. Like Josh said, she threw all this stuff away. This baby went missing on August 27th, and she kills herself in September. I don`t think that a mother would have killed herself with that baby in just a state of limbo. She at least knew where that baby was. Whether the baby is dead or given away, that woman knew where that baby was the day that she took her life. I`ve said it all along.

I hope that the baby is alive, and I think he is alive. And I`m looking at what she`s done to make me think that she`s given him away and has not killed him. Look at her note that she writes about him. She says she talks about him growing up and growing older. That baby is still alive, Nancy.

GRACE: What about it, Richard Herman?

RICHARD HERMAN, DEFENSE ATTORNEY: Nancy, I`ve got to disagree with Renee on this. I think that this woman was so distraught -- and you look at the planning that day, the traveling, the cell phone towers. I mean, she was completely all over the place, frantic.

I think this woman -- she went to the length of killing herself. I think she had a major problem with her husband here. And I just think that the breaking news today should be received with cautious optimism. I know law enforcement is seeking to energize the public with this information to show that the baby is alive, but I tell you, Nancy, this is a very tough case. And I hope they find this little boy, but I fear for the worst on this one.

GRACE: To Jean Casarez, what will we learn when we ever get back the computer?

CASAREZ: Well, the computer, she wrote a lot of poetry on the computer. She wrote letters on her e-space. And all of that communication, the rhyming that she did can maybe gauge some hints, because she was labeled a perfectionist and a planner. Maybe it will have some clues.

GRACE: Josh Duckett, do you feel that he`s alive?

J. DUCKETT: Yes, I`ve stayed confident this whole time. And I`m a strong believer, and I have a lot of faith that he`s alive and well. It`s just a matter of finding him.

I think, a mother, no matter how distraught over a child’s disappearance and no matter how tough the media is on her, does not give up the hope that her child is coming home. To kill herself tells me she had no hope and knew he was not coming home and added to that the knowledge that her story was not being believed, she felt she had no reason to live. Even her suicide was cruel in my opinion, realistically it was a murder in her grandparents home. jmo.

Headline News host Nancy Grace can be videotaped while answering questions in a lawsuit accusing the TV personality of pushing a Leesburg single mom to commit suicide, a federal magistrate ruled Tuesday.

But lawyers representing the estate of Melinda Duckett must not share the recording with "any third party" or disclose any portion of the testimony in the court file without the magistrate's permission.

The order could keep Grace's testimony a secret among the lawyers until the case goes to trial.

Magistrate Gary R. Jones outlined the conditions in a five-page ruling after lawyers for Grace asked Monday to bar cameras from the depositions she is scheduled to give Thursday in Atlanta.

Keeping video cameras out, Grace's lawyers argued, would avoid "annoyance, embarrassment, oppression, and undue harm should the videotape be released prior to trial for purposes unrelated to the litigation," according to the emergency motion filed in U.S. District Court in Ocala.

The magistrate did not rule on whether Grace was at risk of embarrassment or other harm from being videotaped.

"The court need not…determine whether the disclosure of Ms. Grace's videotape deposition to the public would result in the evils complained of by Defendants," Jones wrote. "The Plaintiffs in their response advise the court that they had agreed (and continue to agree) to a protective order."

Duckett's estate is suing Grace and CNN in federal court, accusing the legal commentator and her TV talk show of "intentionally inflicting emotional distress" on the mother of missing 2-year-old Trenton Duckett.

Melinda Duckett, 20, shot herself in the head on Sept. 8, 2006, at her grandparents' home in The Villages, hours before her interview with Grace was scheduled for broadcast on HLN, a division of Cable News Network.

Grace, a former prosecutor in Georgia and a Court TV personality, has denied that Duckett experienced "mental abuse" on the Headline News program that delved into the boy's disappearance from his bedroom.

Law-enforcement investigators had questioned Duckett about her son, who was reported missing Aug. 27, 2006. Leesburg police have since called the young mother their only suspect in the case.

The boy has not been found.

Videotaping depositions gives lawyers another way of preserving the sworn, pre-trial testimony of witnesses. Lawyers for the Duckett estate have not objected to video of their witnesses answering questions from Grace's lawyers.

"It's kind of an understood thing that they aren't going to be released," said Duckett lawyer Kara Skorupa. "I would expect that hers would be no different."

Skorupa said she found Grace's opposition to videotaped depositions "ironic" but would not elaborate.

The case is set for trial in July.

Grace's cable show has promoted and broadcast an array of crime-news issues, including special programs entitled "Caught on Tape!" that featured the videotaped testimony of Casey Anthony's parents, Cindy Anthony and George Anthony, taken during depositions for a civil lawsuit.

Anthony, 23, is accused of killing her daughter in 2008. She has pleaded not guility.

Grace is also the subject of the stage play "Tot Mom" by Oscar-winning director Steven Soderbergh. The play explores how Grace covered Casey Anthony's case and is based on transcripts of Grace's show, court documents and published reports.

Grace has been ordered to sit for a deposition on Thursday with a camera rolling .. according to a judge's order obtained by TMZ.

Grace and CNN are being sued by the parents of a woman who committed suicide after appearing on Grace's TV show. The parents claim Grace accused the woman of being responsible for the disappearance of her son.

The parents sued Grace and CNN for wrongful death, but Grace did not want her deposition taped because she feared clips would appear on TV and online, taking her out of context and splicing bits and pieces together to make her look bad -- sound familiar?

The judge ruled that Grace's depo can be videotaped, but the tape cannot be released to the media or anyone else without the court's permission.

The judge said since the parents' lawyer agreed not to release the video to third parties without court approval, there was no need to address "the evils" Grace complained of -- that "disclosure of the videotape of Ms. Grace's deposition" was designed to "harass, embarrass and intimidate Ms. Grace and corrupt the jury pool."

The deposition will be taken in Atlanta on Thursday. Makeup!

Nancy Grace is scheduled to be deposed Thursday in the Melinda Duckett wrongful death lawsuit. In an ironic twist, she wants all cameras barred from the deposition.

It is no secret that Nancy Grace has been sued by the family of Melinda Duckett, the 21-year-old mother of Trenton Duckett, the 2-year-old Florida boy that went missing in 2006. Melinda Duckett shot herself the day after a taped interview with Nancy Grace and just hours before said

The family filed a wrongful death lawsuit against Grace two months after Duckett's death, accusing the host and her show, "Nancy Grace," of the "intentional infliction of emotional distress" that led to the suicide. The former prosecutor is scheduled to give her deposition in an Atlanta courtroom Thursday, but her lawyers filed a motion Monday to bar any and all recording devices from the deposition.

Nancy Grace has made a career of grilling people on and off camera. As a prosecutor for the Atlanta-Fulton County, Georgia District Attorney's office, she cross-examined and deposed serial killers, serial rapists, serial child molesters, and arsonists. As a current affairs show host, she has used her prosecutorial style to go after many of her guests in interviews on the show. Melinda Duckett, whose son, Trenton, had disappeared less than two weeks prior to the interview, was one of those guests. During a taped phone conversation, Nancy Grace adamantly asked, "Where were you? Why aren't you telling us where you were that day?"

But Melinda Duckett was different than most of Grace's guests. Instead of denouncing Nancy Grace, granting interviews explaining herself and/or decrying Grace's intimidating methods, Melinda Duckett shot herself the next day.

Many, including ABC News, are noting the irony of a person who has made their fame questioning people on camera not wanting to have her deposition filmed because of the potential "annoyance, embarrassment, oppression, and undue harm should the videotape be released prior to trial for purposes unrelated to the litigation."

Might Melinda Duckett's family's attorneys not argue that it was that very "undue harm" that may have pushed the already distraught mother to kill herself?

And it seems almost hypocritical that Nancy Grace's lawyers submit a motion to bar cameras because: "The risks associated with releasing deposition videotapes prior to trial are high due to video's unique ability to be abused as they can be cut and splice and used as

'sound bites' and taken wholly out of context." Every "Nancy Grace" show is replete with "sound bites" and cut and spliced material that could potentially be taken out of context.

Whether or not the judge sides with Nancy Grace and CNN (they are represented by the same lawyers) on the matter, the Melinda Duckett wrongful death lawsuit seems ill fated. To state that Nancy Grace's questioning, no matter how intimidating or forceful, caused Melinda Duckett to kill herself is a cause-and-effect that precludes Duckett's past medical history, her state of mind, her behavior following Trenton Duckett's disappearance leading up to her suicide, and various other factors that may have contributed to the commission of the act.

Nancy Grace probably defended herself best on ABC's "Good Morning America" a week after Melinda Duckett committed suicide. "Any interview followed hours and hours of police interrogation of Melinda Duckett," the unapologetic commentator said. "Unfortunately, Melinda Duckett had attempted suicide in the past.

"While I sympathize with her family and know as a first-hand victim of crime myself, you look for somebody to blame, anybody. And today the family is blaming me... But I would suggest their efforts go towards finding this baby."

Trenton Duckett has never been found.

The judge will rule on the camera barring motion Tuesday.

I wonder why Nancy would NOT want camera's while being depo'd. She sure loves the spotlight any other time.

The video of the deposition will not be released per judges order.

And some of the things NG said about this case, I have never heard before and I've followed this case from the get-go.

So it's ironic that the host of HLN's highest-rated show doesn't want video cameras to record her when she's questioned in a wrongful death lawsuit brought by the estate of a former guest on the "Nancy Grace" show.

The estate of Melinda Duckett, the mother of missing 2-year-old Leesburg, Fla., boy Trenton Duckett, is suing Grace, accusing the legal commentator and her show of "intentional infliction of emotional distress" that led Duckett to commit suicide.

Grace's attorneys, who also represent CNN in the lawsuit, filed an emergency motion in U.S. District Court in Ocala on Monday to bar cameras during Grace's scheduled deposition Thursday. The judge is expected to rule on the motion today.

By keeping video cameras out, Grace's lawyers argue they would avoid "annoyance, embarrassment, oppression, and undue harm should the videotape be released prior to trial for purposes unrelated to the litigation," according to the motion obtained by the Orlando Sentinel.

"It is indeed ironic," Kara Skarupo, one of the attorneys who represent Duckett's estate, her parents and sister, told ABCNews.com. "They allege we've been courting the media, which is completely ridiculous. The irony is she is out there on TV every day."

Skarupo said Grace's lawyers would like video cameras to be stricken entirely, but if the judge does allow her deposition to be recorded, they "want us to sign a blood pact that it won't get out."

A spokeswoman for CNN declined to comment on the matter.

Grace was a prosecutor for nearly a decade in the Atlanta-Fulton County, Georgia District Attorney's office on felony cases involving serial murder, serial rape, serial child molestation, and arson.

Duckett's parents, Bethann and William Eubank, along with her aunt Kathleen Calvert, filed a lawsuit against Grace two months after Melinda's Sept. 7, 2006 appearance on the "Nancy Grace" show.

During Grace's interview, which was taped with Duckett on the phone, the talk show host pounded her desk and demanded, "Where were you? Why aren't you telling us where you were that day?"

The following day, Duckett shot herself in the head just hours before her interview with Grace was broadcast on HLN.

Investigators had also questioned the 21-year-old mother about her missing son. The boy has never been found.

Grace was unapologetic when she appeared on "Good Morning America" a week after Duckett's suicide.

"If anything, I would suggest that guilt made her commit suicide," Grace told ABC News' Chris Cuomo. "To suggest that a 15- or 20-minute interview can cause someone to commit suicide is focusing on the wrong.

My thoughts exactly, any other time NG is in front of the camera, armed and dangerous.
Melinda committed suicide because of her actions, not the actions of NG!!! IMO!
