...........On or before the 11th day of July, 1991 and the 31st day of December, 1991, in the County of Contra Costa, the crime of FORCIBLE LEWD ACT UPON A CHILD, in violation of PENAL CODE SECTION 288(b)(1), a Felony was committed by Nancy Garrido, who did willfully, unlawfully, and lewdly commit a lewd and lascivious act upon and with the body and certain parts and members thereof of Jane Doe, a child under the age of fourteen years, with the intent or arousing, appealing to, and gratifying the lust, passions, and sexual desires of the said defendant and the said child, by use of force, violence, duress, menace, and threat of great bodily harm........

Nancy Garrido Misses "Family," Lawyer Says

The attorney for Nancy Garrido, accused along with her husband of the kidnap and rape of Jaycee Lee Dugard, said she felt that "they'd become a family."

During the 18 years since her abduction at age 11, Dugard gave birth to two daughters by Phillip Garrido and lived with them in a backyard tent complex behind the Garrido's California home. The girls had reportedly been told that Dugard was their sister.

Gilbert Maines, Nancy Garrido's court-appointed attorney, said she missed the girls and "was distraught, frightened, [and] appeared to be a little lost.

"I would describe her like a ship without a rudder," he told "Early Show" co-anchor Harry Smith.

Maines said he's had limited time to talk with Garrido - just an hour and a half in the five days since taking the case - but indicated he may argue that she was just a victim in the ordeal as well.

Maines also said it would likely take "professional help" for him to get Garrido to open up to him so he could formulate a defense strategy.

Garrido's Sexual Spree May Date to '72

Phillip Garrido, accused of kidnapping an 11-year-old girl in 1991 and imprisoning her in a shed for nearly two years, may have started his spree of sexual crimes as far back as 1972, police said.

Garrido, then 21, gave a 14-year-old girl drugs and then sexually assaulted her multiple times, Antioch Police Lt. Leonard Orman told NBC's The Today Show on Thursday. The victim refused to testify about the incident, and the charges against Garrido were dropped, Orman said.

Officials believe this is the third victim that Garrido has raped in the last 37 years -- and they're looking for more. Garrido and his wife, Nancy, are accused of kidnapping and raping Jaycee Dugard in 1991 and using her as a sex slave her for 18 years. Garrido fathered two of Dugard's children. Dugard and her children were reunited with her family last week.

In 1976, Garrido was convicted of kidnapping and raping Katherine Hall, who says Garrido handcuffed her and imprisoned her in a storage unit for eight hours.

I saw a picture of the the Garrido's when they were very young. They just looked like a couple of normal young kids. It sure went south from there. I hope they will be locked up for life!

RIVERSIDE Terry Probyn took a brush to her daughter's blond hair and slowly combed through it – a tender ritual she had not performed in 18 years, when her girl, Jaycee Lee Dugard, was just 11.

Reunited with Jaycee last week in Northern California, Probyn got to play mother again to the girl who was snatched away from her – touching her hair, kissing her face, delighting at the sound of her voice.

Dugard, told court he stalked girls at schools

Phillip Garrido admitted that starting in 1968 he hung around schools and pleasured himself while "watching young females."

"I have done it by the side of schools, grammar schools and high schools, in my own car," Garrido said in court testimony obtained Tuesday by The Daily News.

Asked how old these girls were, Garrido replied, "From 7 to 10."

Jaycee kidnapper recorded 'twisted' love songs about little girls
Phillip Garrido recorded two CDs full of love songs he'd written about his fascination with young girls.

The man accused of kidnapping Jaycee Lee Dugard gave the discs to Marc Lister, a former customer of his printing business three years ago, because he knew people in the music business.

The CD, entitled Voices Are Real, contains 20 songs that Garrido, left, reportedly wrote while he was in prison.
One disturbing lyric apparently blames a little girl for making him fall victim to her sexual allure, and reads: “The way she walks, yeah, subtly sexy/What can I do? I fall victim too/A little child, yeah, look what you do.”

Mr Lister said: “It's a little bit twisted. It's not right.”

ANTIOCH, Calif. (AP) - A sheriff's spokesman says a bone fragment pulled from the backyard of a homewhere kidnapping suspect Phillip Garrido once stayed is probably human.
Contra Costa County Sheriff's Department spokesman Jimmy Lee said Tuesday that was the assessment of a forensic expert who performed tests on the fragment recovered last week.
Lee says it is not unusual to recover Native American remains in the area.
But the department has asked the state crime lab to perform DNA tests to determine the bone's age and who it might have belonged to.
Investigators discovered the shard in the yard of the home next to the one where Garrido and his wife, Nancy, allegedly held Jaycee Dugard captive for 18 years.
For a brief time in 2006, Garrido took care of the neighboring house while it was vacant and sometimes camped in the yard.

Jaycee Dugard case: Nancy Garrido's brothers tell TV show she was 'controlled' by husband
NEW YORK — The television show "Inside Edition" plans to air an interview today with two brothers of Jaycee Dugard kidnapping suspect Nancy Garrido.
Garrido and her husband Phillip Garrido have been charged with kidnapping and imprisoning Dugard for 18 years in their backyard near Antioch.
According to excerpts from the interview, David Bocanegra suggests his sister was "controlled" by Phillip Garrido.
"It's just really hard listening to people call my sister a monster...She's a really good person...She was just controlled by Phillip."
David Bocanegra and his brother Rey Bocanegra said they last spoke with Nancy three years ago and hadn't been able to get in touch with her for years before that.
They also said they think their sister belongs in jail.
"She knew right from wrong, and she needs to pay for what she did," Rey Bocanegra said. "She needs to get help...she belongs behind bars."

Media attention has focused on Phillip, however, Nancy is accused of being the individual who physically abducted Jaycee from a school bus stop in 1991. She was also allegedly responsible for holding Jaycee captive when Phillip was behind bars from April to August 1993, after his arrest for a parole violation.
The Ski Channel TV Network is reporting that Nancy has been placed in isolation because fellow inmates have threatened to rape and kill her. A source told the network she is “very lonely” and spends most of her time reading the Bible. She is also said to be very cooperative with the ongoing police investigation.

The investigation into Phillip Garrido, the man accused of kidnapping and raping Jaycee Lee Dugard, has taken another turn.

The Contra Costa County Sheriff's office said Friday that bone fragments dug up from the backyard of Garrido's Antioch, Calif., home and a neighboring property probably belonged to Native Americans buried a long time ago.

Sheriff's spokesman Jimmy Lee said that while scientists at a state forensics lab were unable to extract any DNA from the bones, an anthropologist concluded the fragments were likely human, but probably old.

Investigators uncovered the bones while searching for evidence in the kidnapping of Dugard, as well as other unsolved abductions and murders.

Garrido and his wife, Nancy, have been charged with kidnapping and rape in Dugard's 18-year disappearance.

Lee said investigators are looking into reports that Phillip Garrido was seen before his arrest with two young girls who were not the daughters he fathered with Dugard.

The information came from someone who knew Garrido, but so far detectives have not found any evidence to corroborate the sighting.

Anyone who may have seen Garrido recently in the company of two girls about 6- or 7-years-old should contact the Sheriff's office, Lee said.

A state appeals judge has blocked a lower court judge's order to remove Nancy Garrido's lawyer from her case. Nancy Garrido and her husband, Phillip Garrido, are charged with kidnpapping Jaycee Dugard and holding her captive for 18 years.

An El Dorado Superior Court Judge had ordered attorney Gilbert Maines off Nancy Garrido's case after witnesses said he had discussed loudly at a country club about a movie and book deal on the case. Garrido said she wanted Maines to stay on her case. On Wednesday, November 25, the Third District Court of Appeal in Sacramento set aside the lower court's decision.

Maines denied the allegation about discussing the case or possible book or movie deals and provided his own witnesses to back him up.

Phillip and Nancy Garrido are awaiting trial for the rape and kidnapping of Jaycee Lee Dugard, who was taken at age 11 in 1991, and discovered 18 years later in Antioch, California in 2009. The Garridos have pleaded not guilty to the charges, and a hearing is next scheduled for January 21 according to AP.

Nancy Garrido's original attorney, Gilbert Maines, was kicked off the case for allegedly discussing the case at a golf course, claiming he would make money, or strike a movie or book deal, after participating in the highly publicized case. He maintains that the accusations are false, and wants back on the case.

A closed hearing was held today, as witnesses testified about Maines' possible conflict of interest in the case. The decision to keep him on as Garrido's representation is in the hands of the appeals court.

Say what you will about Gilbert Maines -- and plenty of people have, recently -- but no one can say he's not a fighter.

The embattled former attorney for Nancy Garrido plans to return to court today in yet another bid to get back on the case.

"I'm doing what my client has asked me to do," Maines said Friday. "I don't have a choice."

So, the 69-year-old Placerville lawyer will be filing an appeal of his removal from the case in El Dorado Superior Court today.

It will mark the fourth time since November he has filed an appeal to continue representing Garrido, who is accused along with her husband, Phillip, of kidnapping Jaycee Lee Dugard from her South Lake Tahoe neighborhood in 1991, when Dugard was 11.

Judge Douglas Phimister, who is overseeing the Garrido case, appointed Maines as Nancy Garrido's defense attorney in August.

The same judge bounced him Nov. 5 in a closed session during which evidence was presented that Maines had boasted about writing a book on the case over cocktails at his Placerville country club.

Maines denied the allegation and appealed his removal to the Superior Court and then the 3rd District Court of Appeal in Sacramento.
The issue has bounced between the trial court and the appellate court, with Phimister receiving new allegations against Maines in a closed hearing on Dec. 29.

Maines has spent more time fighting to stay on the case than the lawyers involved have spent in court discussing the substance of the actual kidnapping, rape and conspiracy charges facing the Garridos.

Maines can't contact Garrido directly in the El Dorado County jJail while waging his battle, because technically he no longer represents her. Instead, he has had to work through the interim attorney appointed by Phimister - Stephen Tapson.

Maines said he has obtained a new declaration from Garrido indicating she wants Maines as her lawyer. That material will be filed todaytues along with other points Maines will argue. He said he will ask that his filing be sealed because the judge so far has kept the other proceedings in this fight under seal.

Maines said his latest appeal will focus on the basic question of whether a client can be denied the attorney she wants.

"The issue is: Can the court remove appointed counsel at any time it wants to for any reason it wants?" Maines said. "My client says she doesn't see that I've done anything wrong, and she wants her lawyer back."

The Garridos' next court hearing is scheduled for Thursday and likely cannot proceed without the attorney issue settled.

If Maines loses his appeal in Superior Court, he will proceed to the 3rd District appellate court, he said. Meanwhile, he intends to be in court Thursday along with Nancy Garrido's current interim attorney.

PLACERVILLE, CA - The attorney appointed to defend accused kidnapping suspect Nancy Garrido was removed from the case last week, according to El Dorado County Superior Court documents.
Defense lawyer Gilbert Maines was removed from the case last Thursday by judge Douglas Phimister following a closed-court meeting between the judge, Garrido, Maines, and court security and staff, according to the minute order of the meeting on the court's Web site.
While Maines was removed as Garrido's attorney, Phimister ordered the removal be stayed until after a Nov. 30 hearing.
The court documents don't indicate why Maines was removed, but the decision was made the day after the court received unspecified "confidential evidence."
All records of the hearing were ordered sealed.
Maines, 68, was appointed by the court to defend Nancy Garrido just before the 54-year-old woman and her husband Phillip were arraigned in August on 29 counts in connection with the 1991 kidnapping of then 11-year-old Jaycee Dugard.
The couple both entered not guilty pleas in El Dorado Superior Court to all the charges, including forcible abduction, rape and false imprisonment. Their next scheduled court appearance on the charges was set for Dec. 11.
In August, Maines told News10 that his client was scared in her cell at the El Dorado County Jail, contemplating the thought of spending the rest of her life behind bars.
"She's a bit distraught. You have to understand that until this I don't think she's even ever had a speeding ticket. She's never had a traffic ticket until this thing happened," Maines said.

The woman accused of kidnapping Jaycee Dugard and helping keep her captive in a backyard compound for 18 years sent the message via her new attorney Thursday.
Nancy Garrido was in an El Dorado County courtroom Thursday, where a judge set her bail at $20 million and appointed a new attorney, Stephen Tapson, to represent her in the high-profile case.
After the Thursday hearing, Tapson passed along a message from Garrido.

"Mrs. Garrido asked me to tell you to tell -- or at least if Jaycee, or Angel or Starlet see this -- that she misses them and loves them, and wishes she could see them." Tapson said. "But obviously that's not going to happen for awhile."
Garrido and her husband, Phillip, have both pleaded not guilty to 29 felony counts of kidnapping, forcible rape and false imprisonment in connection with the 1991 case. His bail was set at $30 million in September. The couple is due again in court on March 25.

The judge in the Jaycee Dugard kidnapping case agreed to set bail for Nancy Garrido during a brief hearing Thursday, but it's unlikely she'll be leaving jail anytime soon.

Judge Douglas Phimister set Garrido's bail at $20 million because, he said, he considers her to be a flight risk and a danger to the community. Garrido's husband, Phillip, remains in El Dorado County Jail on a no-bail hold.

Both are accused of the 1991 kidnapping of Dugard, then 11, in South Lake Tahoe. Dugard was freed last August after living for years in the Garridos' backyard with two daughters fathered by Phillip Garrido.

Phimister also formally removed Gilbert Maines as Nancy Garrido's appointed attorney and replaced him with Placerville attorney Stephen Tapson. Phimister noted an affidavit from Nancy Garrido asking that Maines remain on the case, but the judge said he had the right to remove an attorney if he feels it's in the defendant's best interest.

Phimister initially fired Maines in November after receiving reports Maines had boasted publicly about the case and a possible book deal. A series of hearings and appeals had kept his status in limbo since then.

Outside the courtroom, Maines said he planned to file another appeal, first with the presiding judge of El Dorado County Superior Court and then, if necessary, with a state appeals court. Maines continued to insist Nancy Garrido has the right to the counsel of her choosing.

Phimister set the next date for the continuing pre-preliminary hearing for March 25.

There's no timetable as to when the case will go to trial, or if Phillip and Nancy Garrido will be tried together or separately.
Susan Gellman, Phillip Garrido's attorney, said at this point, there are some chances for settlement along the way. However, she said that a trial date is probably a couple of years away from when the incident actually happened.

Sounds like Phil has been working on his insanity plea for some time now. They cannot let him plead insanity after being caught committing the same crime he was imprisoned for to begin with!

(CNN) -- A California sex offender suspected of abducting a girl in 1991 and keeping her captive for 18 years is suffering from "serious mental illness," defense attorneys say in court papers.

"It appears that Phillip Garrido has been hearing [the] voices of angels for years," said documents filed Wednesday in El Dorado County Superior Court.

The court papers dispute prosecutors' asserting that Garrido is a "master manipulator" who is still trying to influence his victim.

Garrido, 58, and his wife, Nancy, are charged with 29 felony counts in the kidnapping of Jaycee Dugard, who was 11 when she was snatched from the street in front of her house in South Lake Tahoe, California.

She was 29 when found in August at the Garridos' home in Antioch, about 120 miles from her home. Prosecutors allege that Garrido fathered two daughters with Dugard during her captivity.

Both Phillip Garrido, who was a registered sex offender on parole at the time of his arrest in August, and Nancy Garrido have pleaded not guilty to the charges against them.

In a filing earlier this month, prosecutors called Garrido a "master manipulator," citing journal entries made by Dugard. They also said Garrido's attorneys were attempting to contact Dugard, whose location they are trying to keep secret, and asked the court to impose a protective order barring such contact. A judge refused to immediately grant the request, setting a hearing for Friday.

Garrido's public defenders, Rick Meyer and Susan Gellman, said Dugard, who is identified in court papers as Jane Doe, told investigators following Garrido's arrest that he had a "self-described ability to understand the voices of angels. ... One of the children disclosed this as well, describing how the voices would keep him up at night, and how the angels lived underground and spoke to him from this location."

The filing points to Garrido's "manifesto," entitled "Origin of Schizophrenia Revealed," which he prepared in the days and weeks before his arrest and addressed to the FBI. He took it "from law enforcement agency to law enforcement agency, calling attention to himself in a way that could [and ultimately did] lead to his arrest," the attorneys said.

Garrido went to the campus of the University of California, Berkeley, accompanied by his two daughters with Dugard, to get a permit to stage a demonstration of his ability, the documents said. University employees brought about his arrest after contacting his parole officer, saying they thought Garrido's behavior was odd.

"Mr. Garrido's illness was not subtle at all," the documents said. "Obviously the campus police at the University of California, Berkeley were able to perceive the clear signs of mental illness and took some action instead of ignoring them."

Prosecutors, the defense said, have discussed the "cover stories" told by Dugard and the children when Garrido was summoned to the parole office the following day and questioned. Authorities maintain such lies were evidence of Garrido's manipulation, according to the documents.

"In reality, it appears that everyone was very frightened by what could happen. They were afraid they would be separated and lose each other," the defense said. "Even the children made up stories; there was a sense of panic. They were trying to protect each other. One of the children was so nervous she got sick."

Asked several times who was the father of the children, Garrido told several different stories, his attorneys said. "The agent's report is helpful in showing how manipulative Mr. Garrido is not."

Further evidence of Garrido's mental illness is his repeated contact with the news media, according to his attorneys. "Contacting the media against the advice of counsel when one is facing criminal charges as serious as these shows an inability to cooperate with counsel and an inability to appreciate the function of the criminal justice system," the attorneys said. "In short, Mr. Garrido's contacts with the media, when his attorney tells him not to have them, are not manipulations at all, but evidence that he may not be competent to be a defendant."

Garrido believes that Dugard is part of his "transformation" and his "disclosure," the documents said. "Mr. Garrido believes that he and Jane Doe once had a plan to launch a Web site wherein Mr. Garrido's ability to speak to angels would be revealed to mankind. He remains confused as to why that has not happened."

The attorneys said they had not attempted to contact Dugard, but sent a letter to her former attorney without knowing he was no longer representing her.

Prosecutors said a sentence in that letter, conveying that Garrido harbored no ill will toward Dugard or the children and "loves them very much," was interpreted as a manipulation attempt. Defense attorneys maintained it was not. "There has been no intimidation or harassment of any kind," they wrote.

Authorities maintain Dugard does not want to speak to Garrido or his attorneys. She has that right, the defense attorneys said, and the court can refuse to disclose her location.

"However, in a case like this, it would make settlement far more difficult if counsel were forever foreclosed from approaching the idea of contact again," the attorneys said. If the court will not disclose Dugard's location, they requested a representative be appointed for communication purposes.
