UPDATED: 1:27 pm EDT August 5, 2010

U.S. Marshals have captured a suspect in connection to the disappearance of 19-year-old Brittney Kustes.

Marshals caught up with Roy Vernon Elwell II at about 8:30 p.m. Wednesday at the Gospel Kingdom campground off Highway 44 in Bullitt County.

Police said Elwell was at a relative's RV.

Authorities believe Elwell was with Kustes when she was missing for nearly two weeks before being reunited with her family.

Elwell was interviewed by Bullitt County Sheriff's Department detectives who said he was "rambling and talking in circles."

Detective Scotty McGaha said Elwell denies kidnapping Kustes, and he has not been charged in her disappearance.

Investigators said they are still working to substantiate statements they have received.

During the 13 days Kustes was missing, she told family members she was locked in a bedroom of a Glasgow-area home.

Police said Elwell is a registered sex offender with a violent criminal history.

Family members said that when Kustes arrived at University Hospital after her rescue, she had injuries from being choked and scratches on her legs from being in the woods. She was also malnourished.

Detectives have interviewed Kustes at length about what happened during the 13 days she was missing.

They're being very tight-lipped about what their investigation has revealed and will not say what, if any, charges Elwell could face in connection with Kustes' disappearance.

Deputies said Elwell is also being investigated by Kentucky State Police in connection with an unrelated death investigation.

That death took place at a home where Elwell and Kustes were allegedly seen during the time the 19-year-old was missing, officials said.

Deputies said Elwell was taken to Louisville for questioning after his arrest.

Kustes' mother said Brittney smiled a bigger smile than the family had seen from her in some time.

Roy Vernon Elwell II Not Charged In Connection To The Disappearance of 19-year-old Brittney Kustes/ UPDATE: Brittney Kustes in jail Empty Bullitt judge jails Brittney Kustes

Post by Nama Thu Aug 12, 2010 11:45 pm

A Bullitt County woman who was at the center of a statewide search for two weeks has been arrested herself.

Bullitt Circuit Judge Rodney Burress ordered 19-year-old Brittney Kustes to serve 30 days in jail for violating the conditions of a drug court program. The charges are unrelated to her recent disappearance.

Kustes, who was missing from July 17 to July 30, she said she was held against her will by Roy Vernon Elwell, Junior, a 34-year-old registered sex offender. Kustes says at first she went willingly, but then claims she was beaten and not allowed to leave.

The U.S. Marshals arrested Elwell on August 4, but he is not charged in Kustes' disappearance. However, the investigation is ongoing.

A woman whose family said she was kidnapped is now in police custody.
Brittney Kustes, 19, was the focus of a regionwide search for nearly two weeks. She returned home a week and a half ago.
Kustes was booked into the Bullitt County Detention Center Tuesday afternoon.
Laurie Kustes, Brittney's mother, said Tuesday Brittney showed up eight minutes late for her weekly drug court hearing.
"i think it's ridiculous. I think it's just -- it's absurd," said Laurie Kustes.
Bullitt County Circuit Court Judge Rodney Burress ordered Brittney Kustes to spend the next 30 days in jail.
"She goes to court and she's eight minutes late. So now she's in jail for 30 days," Laurie Kustes said. "It's almost like a joke. We're like, 'Are you serious? Did she fail a drug test?' No. 'Did she not show up?' No. She was eight minutes late."
"I've always kind of, one of my things is you could have had a criminal past, but that does not make you not a victim of a crime," said Bullitt County Sheriff's Detective Scotty McGaha.
This is Brittney Kustes' second arrest since her return home.
During the nearly two weeks Brittney Kustes was reportedly missing, a bench warrant was issued for her arrest after she missed a drug court hearing on July 20.
She was ordered to serve 14 days on home incarceration with a GPS ankle monitor for the violation.
Brittney Kustes was ordered to complete drug court in a plea agreement on charges stemming from an arrest in July of last year.
Hillview police said Brittney Kustes was a passenger in a vehicle where oxycodone pills and marijuana were found in a purse. She and the other occupant both claim the purse belonged to the other.
"Everybody's treated the same," McGaha said. "Everybody's entitled to their day in court."
Brittney Kustes and another woman are cooperating with detectives in the investigation of Roy Vernon Elwell concerning the kidnapping claims.
"In some way, he probably did prey on those people, thinking that they're vulnerable, they're not going to come forward," McGaha said.
Elwell was arrested last week.
In police interviews, Elwell has denied kidnapping Kustes, but admitted to keeping Kustes in Monroe County.
Detective Scotty McGaha said Kustes had no way of getting home.
Right now, Elwell is not charged in Kustes' disappearance.
Detectives said any charges would likely be filed in Monroe County.
