PALATKA, Fla. -- One of the key figures in the Haleigh Cummings investigation is expected to be sentenced Friday morning on drug charges.

Hank Croslin Jr. pleaded no contest to two trafficking charges after being arrested in January during a drug sting operation. He was arrested in January, along with his sister, Misty Cummings, his ex-brother-in-law, Ronald Cummings, and two other people.

Croslin could be sentenced to from 3 to 30 years in prison on the charges.

Authorities said the drug charges the family members are facing are not related to Haleigh's disappearance. Ronald Cummings' 5-year-old daughter went missing from her Satsuma home in February 2009. Misty Cummings, briefly Ronald's wife, was last person known to have seen Haleigh Cummings before she disappeared.

The kindergartner's body has not been found, but the Putnam County Sheriff's Office said earlier this year it believe she was killed and consider the ongoing case a homicide investigation.

tiny 4 logoChannel 4 has a crew in the courtroom for the sentencing hearing. This story will be updated as more information is available, with a full report on the local station at noon.

I've decided I want to keep the sentencing separate on the 3 key players; Misty, Ron and Tommy. Whatever he gets should be a pre-cursor to what Misty w/get.

Hank "Tommy" Croslin Jr. was sentenced Friday morning to 15 years in prison for trafficking in prescription drugs.

Tommy Croslin testified that he has a drug problem and that his use of prescription drugs began when he moved to Palatka in recent years. He said he has not taken drugs while in jail this year even though, he said, drugs were available.

Also testifying on his behalf were his ex-wife, Lindsy Collins, and his father, Hank Croslin Sr.

As Tommy Croslin walked out of the courtroom, his only comment was: "God is with me."

Hank Croslin Jr. (Tommy) sentenced to 15 years on drug charges/ UPDATE: Hank (Tommy) Croslin, Jr., denied reduction in drug sentence Empty Haleigh Cummings Update: Tommy Croslin Scores The Magic 15 In The Pen

Post by Nama Fri Aug 06, 2010 11:40 pm

Friday morning Tommy Croslin was back in court for the sentencing phase after pleading No Lo to two charges of drug trafficking. For months we have been hearing Tommy in jail house visits and telephone calls claiming that the maximum sentence he was going to receive was 36 months, and with time served, plus time for good behavior, he would be out in the blink of an eye.

That optimistic view came to a screeching halt this morning. Tommy Croslin was given 15 years behind bars, 10 years probation, and a heart stopping $50,000 fine.

15 seems to be coming a very favorite number in this drug case.

BNN is currently trying to get an eyewitness account of the sentencing, and we will bring you updates as soon as they become available.

We are still waiting for Misty Croslin to face her day in court, and most insiders seem to agree that this may be the one member of the group that may face an even stiffer penalty than the others have so far scored.

While the drug case is not directly connected with the search for Haleigh Cummings, it is a clear indicator that Law Enforcement are playing some very hardball with these people.

UPDATE: We did find a eyewitness to the court hearing. They have asked that we mention no names. We do say thank you to our source:

Tommy appeared shocked but Lindsy was the most visibly shaken. She testified on his behalf at the hearing. She stated the only reason for the divorce was due to family pressure. She spoke of what a “good” person and daddy he is. She also stated she still loves him and plans to be with him again when he gets out. This was, however, when she thought he was going to get 3 years. I don’t know how his sentencing will influence her plans now. She was in tears and waiting to speak with Tommy’s lawyer when I left. My heart was broken for Hank, Lisa and Lindsy. I felt that Tommy may have learned some things during his incarceration; but is still not ready to take full responsibility for his actions as evidenced to me by some of the untruthful answers he gave while under sworn testimony. Such a pitiful sight…..

I wonder how much of your sentence you have to actually serve in Florida? An entire family in jail for drugs. It is a sad commentary of what is going on in this country especially where "prescription" drugs are concerned. Here in L.A. the demand is huge by ordinary people you wouldnt think would be "hooked"
It seems that this group of law enforcement is much tougher on the Croslins than the OC group has been on the Anthony's particularly Cindy. If someone needed
to be charged with obstruction, perjury and now even mail fraud its Cindy. Why does she get a pass I wonder? If anyone knows how long on a 15 year sentence he would have to actually serve please post it. As we saw with Lindsey Lohan in L.A. probably about 1 hour! lol

I thought Tommy would get more than 15. I think he may have helped to get rid of HaLeigh's body and would rather take 15 than life or the DP. So, IMHO..we will NEVER know who killed HaLeigh or if she overdosed on their pills. By the time Tommy gets out, his kids will be grown and probably won't give a damn about him, Lindsay will be long gone (I also was not aware they were already divorced), the parents will probably have passed from overdosing and Misty will get the max of 85 years.

If you look at the expression on Tommy's face, he is good with it. Better than life in the big house.

And since when can a prisoner wear sunglasses in court? Hell, even regular people cannot wear sunglasses in court. I have now seen it all!!

Good question. I don't think he would have or his lawyer would have tried that tactic. I think he knew for certain if he left his alleged knowledge or actions in getting rid of HaLeigh out of the picture, he would be better off.

15 Years for Hank

By Kristin Chambers
Published: Saturday, August 7, 2010 12:48 AM EDT

Hank "Tommy" Croslin Jr., a key player in the Haleigh Cummings case, was sentenced to 15 years behind bars Friday morning on drug trafficking charges.

Croslin, who turned 24 this week, was deemed guilty by Circuit Judge Terry LaRue for two counts of trafficking in prescription pills.

Croslin will also serve an additional five years for a possession case, and will undergo 10 years of drug offender probation following his release.

In the two-hour hearing, Assistant State Attorney Jason Lewis called a Florida Department of Law Enforcement supervisor to the stand, where a description of the drug transaction was relayed.

While being secretly video-recorded on Dec. 22, an undercover police officer, Croslin and his sister, 18-year-old Misty Croslin, drove to a location in Satsuma to find narcotics pills.

After a few unsuccessful attempts, Croslin parked at the McDonald's in Palatka and purchased 45 oxycodone pills, valued at $650, from a vehicle across the street, Travis Smith, a supervisor with the Florida Department of Law Enforcement, said. Where would they get that kind of money? They could have paid rent with that and fed their kids!

Following Smith's testimony, Lewis described Croslin as a "typical drug trafficker" due to his behavior, number of sources and knowledge of the drug.

With his parents looking on in handcuffs following their own recent arrests on drug charges, Croslin admitted that he started smoking pot at 12 and became addicted to narcotic pills when he moved to Palatka two years ago.

His father, Hank Croslin Sr., testified that his son grew up in the drug environment.

"We always thought best of him - he's the one who we thought would make it," Croslin said.

Though he said he has been offered drugs while in jail, he said has been drug free since the time of his arrest on Jan. 21.

Defense Attorney James Werter said Croslin was fueled by his addiction and deserves no more than three to five years.

"Tommy's problem is that he's addicted to pills," Werter said. "If it wasn't for the trafficking charge he would be in drug court today."

The state argued that Croslin deserved the maximum sentence of 30 years in prison.

"These are the kind of drugs that kill people, and they are dangerous, and he puts them on the streets," Lewis said. "He is not only a danger to his family, but the community at large."

LaRue leaned toward the state, adding that Croslin continued drug trafficking after being allowed to bond out of jail three times last year.

"Not only is Hank Croslin Jr. a user of drugs and addicted to drugs, but he is a drug dealer, pure and simple," LaRue said.

LaRue added, "it is almost unbelievable" that Croslin would commit the crime with disregard for his association in the public eye.

With little emotion on his face, Croslin simply stated, "God is with me" as he was led through the hall outside the courtroom.

His mother cried as she sat guarded by a bailiff while Croslin's ex-wife, Lindsy Collins, wept for her children's father.

The Haleigh Cummings case was brought up several times during the hearing, including the fact that Croslin has come forward with information several times, but has not led law enforcement to any evidence.

"The whole meat and potatoes on the Haleigh Cummings investigation is what happened that night," Smith said. "We have yet to have heard what truthfully happened ... With Misty and Tommy, every time we interview them it's a different story. We don't know what the true story is because we can't tell who's lying."

Lewis said Croslin is still a suspect in the Haleigh case and that the state does not consider him as being cooperative.

Later outside, Annette Sykes, Haleigh's great-grandmother, said she believes he knows more than he is revealing about what happened the night of Feb. 10, 2009, when Haleigh was reported missing.

"I believe that he does, I don't know why he won't tell it, I really don't know, I believe that both he and Misty know - I don't have a doubt in my mind," Sykes said. Then WHY did she allow Misty to reside in her home?

Haleigh was reported missing by Misty Croslin 3:27 a.m. on Feb. 10, 2009.

No trace of the blond-haired 5-year-old has been found, despite massive searches by law enforcement officers and volunteers on land and water.

Haleigh's disappearance initially was described by authorities as a child-abduction case. At the conclusion of the three-day April search, Putnam County Sheriff Jeff Hardy officially labeled it a homicide.

In January, Ronald Cummings, Haleigh's father, Misty Croslin, Hank Croslin Jr., Cummings' cousin Hope Sykes and a former search volunteer Donna Brock of Orlando were arrested following a month-long narcotics investigation into the trafficking of prescription pills.

Cummings is working out a plea agreement with his attorney to drop two of five drug trafficking charges, and is scheduled for a hearing on Aug. 20.

Sykes, 19, was sentenced to 15 years in prison in April, while Misty Croslin faces seven counts of trafficking in Putnam. Her last chance to make a plea deal is Aug. 16.

This really makes me believe that Tommy had a big hand in what happened to Haleigh...If revealing what he knows would get him more than 15 years, then he must have been directly involved...UNLESS he really thought that he was only gonna get 3 years, and now wishes that he had told more about what he knows....IDK

A key figure in the Haleigh Cummings case lost his bid Monday for a reduced sentence on oxycodone trafficking charges.

Hank "Tommy" Croslin Jr. had petitioned to cut the 15-year jail term he received in August, with his attorney suggesting three to five years was more consistent with similar cases in Putnam County.

"Fifteen years might be a bit of overkill," defense attorney James Werter told Circuit Judge Terry LaRue.

But LaRue wasn't moved.

"I gave considerable consideration to it," the judge said of the sentence.

Croslin's sister, Misty, was babysitting Haleigh when the child was reported missing Feb. 10, 2009. No trace of the blond-haired kindergartner has been seen since and authorities say they believe she was killed.

An undercover investigation, complete with high-quality videos of illegal prescription drug sales late last year, quickly bore fruit, in stark contrast to the missing child-homicide probe. Several people close to the Haleigh case were jailed on drug charges in January.

Hank Croslin Jr., 24, was arrested on two counts of trafficking.

His sister, Misty, faces seven counts in Putnam County and another St. Johns County, and is slated to be sentenced later this month.

Ronald Cummings, Haleigh's father, in August was sentenced to 15 years after authorities dropped three of the five charges against him.

His cousin, 19-year-old Hope Sykes, received a 15-year prison term in April.

During Monday's hearing, LaRue reiterated his surprise that Hank Croslin Jr. and the others would engage in the sales since they were in the public eye.

"I had trouble believing that they could do that, and I still do," LaRue said.

The judge said he felt the 15-year sentence was fair.

"It was drug dealing," he said. "No doubt about it."

As he did last month, Werter blamed Croslin's problems on his home environment and drug addiction. He said Croslin had tried to "break the cycle he grew up in."

Members of Croslin's family sat in the front row of the courtroom. Some sobbed during the hearing.

Behind them sat members of Haleigh Cummings' family, several wearing T-shirts or holding photos of the child.

Prior to the 20-minute hearing, Marie Griffis, Haleigh's maternal grandmother, hugged Ronald's mother outside the courtroom and after the hearing they stood talking in the shade outside the courthouse.

Ronald Cummings mother said she supported Croslin's sentence.

"They're not in here getting a reduced sentence and I don't think he should have either," she said.

Asked about her son, Neves said, "I don't even think he should have been in there but that's how it goes."

In August, a prosecutor said Hank Croslin Jr. remained a suspect in the Haleigh case.

Defense attorneys recently said he and his cousin, Joe Overstreet of Tennessee, went to the Cummings home in Satsuma looking for a gun and not finding it, Overstreet abducted Haleigh and dumped her body in the St. Johns River.

Overstreet has not been named as a suspect in the case and has not been charged. He was recently jailed on drug charges in Tennessee.
