One brother was free on bond and the other remained in jail Wednesday after being charged in connection with the disappearance of Tennessee nursing student Holly Lynn Bobo.
Jeffrey Kurt Pearcy, 42, was released on $25,000 bond after he pleaded not guilty Wednesday to tampering with evidence and accessory after the fact in the presumed death of Bobo, the cousin of country music star Whitney Duncan.
Pearcy's brother Mark Lynn Pearcy, 38, who is listed in Tennessee criminal records as a registered sex offender, remained in the Carroll County jail on the same charges.
Both brothers were arrested in late May but weren't arraigned until this week, when their possible connection to the high-profile case became public.
Two other men have been charged with murder and kidnapping in the actual disappearance of Bobo, a nursing student at the University of Tennessee-Martin who would now be 23. She was last seen by her brother outside the family's home in Darden in April 2011, and her body has never been found.
Investigators said in an affidavit that Jeffrey Pearcy showed a video to someone "that will prove to be beneficial in the prosecution of a current ongoing investigation being conducted by the Tennessee Bureau of Investigation."
Jeffrey Pearcy's attorney told NBC station WMC of Memphis that Pearcy has never seen a video of Bobo.
The TBI wouldn't reveal what's in the alleged video. In a short statement it emailed to several news organizations, it said, "We won't stop until we find a sense of justice and closure for the family and friends of Holly Bobo."

TBI believes video may help solve Bobo murder

Investigators have unveiled the first piece of possible evidence in the murder case involving Holly Bobo.
In a Henderson County court room Wednesday, Jeff Pearcy faced charges of accessory after the fact in connection with Bobo's death because of an alleged video.
The affidavit stated Pearcy "had shown a visual recording on an electronic device to an individual. According to the witness, this visual recording shows information that will prove to be beneficial in the prosecution of a current ongoing investigation being conducted by the Tennessee Bureau of Investigation."
Investigators believe whatever is on the video could help them solve the Bobo murder case. The problem, according to investigators, is the people who have the video refuse to hand it over.
Pearcy and his step-brother Mark Pearcy both face charges from the TBI in connection with the case. Both are charged with tampering with evidence and accessory after the fact.
The same witness who saw the video believes Mark Pearcy's voice is recorded on the video, according to the affidavit.
Neighbors said the TBI searched Mark Pearcy's property last week.
TBI investigators said the Pearcys are refusing to hand over the video, which Jeff Pearcy's attorney disputes.
Jeff Pearcy has a couple of prior driving offenses on his record. He's also been arrested in the past for contributing to the delinquency of a minor.
Mark Pearcy's criminal history is considerably longer, including vandalism, unlawful gun possession and statutory rape.
At age 24, Mark Pearcy pleaded guilty to having sex with a 14-year-old and is now on the state sex offender registry.
It's unclear why, after three years, this alleged video is now being acknowledged. It's also not known if the Pearcys knew Zachary Adams and Jason Autry, who have already been charged with kidnapping and murder in connection with Bobo's disappearance from her Darden, TN, home she shared with her family in April 2011.
Both Mark and Jeff Pearcy have pleaded not guilty and both have bonded out of jail. Jeff Pearcy has to wear an ankle monitoring system while out on bond. His bond was set at $25,000.
Jeff Pearcy's family reacted as they left the court room Wednesday morning.
"My daddy is innocent," shouted his daughter to reporters outside the court house.
Jeff Pearcy is believed to have possession of the recording or knows where it is, according to the affidavit.
Mark Pearcy will be in court on Monday.
Investigators aren't revealing any more details at this time.
In a statement to Channel 4 News, the TBI said Tuesday, "Out of respect for the judicial process, we cannot speak to the particular possible pieces of evidence in this case. We continue our work to follow the leads wherever they might lead. We won't stop until we find a sense of justice and closure for the family and friends of Holly Bobo."

Suspect in Holly Bobo case appointed public defender

One of two brothers charged in connection to the disappearance of nursing student Holly Bobo will have his preliminary hearing next week.
Wearing a bullet proof vest, Mark Pearcy appeared in a Decatur County courtroom Monday where a judge appointed Jackson attorney Michael Cash his public defender.
Now that he has representation, Pearcy’s preliminary hearing will take place next Monday.
Bobo went missing from her home outside Parsons, Tenn. on the morning of April 13, 2011.
Zachary Adams and Jason Autry are accused of kidnapping and murdering Bobo and Mark Pearcy and his brother Jeffrey are believed to possess a video that may help prove the charges.

Deputies say man charged with Holly Bobo's murder suicidal, assaulted officer
Zachary Adams, the man charged with the aggravated kidnapping and first-degree murder of Decatur County woman Holly Bobo, will now face charges for assaulting an officer, according to a report from the Chester County Sheriff's Department.
The report also said that Adams was overheard expressing the desire to kill himself in the Chester County jail where he is currently being held.
On Friday June 13, Chester County Sheriff Deputy Mark Griffin received an incident statement from corrections officer Mark Morris which stated that Morris had overheard Adams make suicidal comments, "specifically to throw himself from the highest point to which he could climb inside his cell," a report sent out from the sheriff's department today said.
"I advised second shift supervisor, Sgt Brown, to have (sic) Inmate Adams moved to a specialized cell so that he could be monitored and observed (sic) twenty-four hours perday to prevent him from injuring himself," Griffin wrote in the report.
Correctional officers Jordan Phelps, Keith Crowe and Cody Riley later made statements that the three of them entered Adams' cell in order to move him and that Adams refused and resisted.
The officers said Adams jerked away from Riley and struck Riley with his hand. The officers reported that Crowe sprayed Adams with a chemical agent in order to restrain him and that Adams continued to resist and struck Phelps "on or about the nose."
The officers stated that Adams was restrained, but continued to resist and "attempted to trip Crowe at least three times and had to be physically carried to the cell."
The report said Adams will be charged with assault.

New Questions About Rumored Video Evidence In Holly Bobo Case.

NASHVILLE, Tenn. - Evidence in the Holly Bobo case remains a mystery despite the fact authorities have arrested two suspects.
The Tennessee Bureau of Investigation won't tip it's hand, but NewsChannel 5 has uncovered new revelations about the role of a confidential informant and whether a key piece of video evidence may really exist.
NewsChannel 5 has learned that investigators believe there could be cellphone video showing Holly Bobo after she disappeared.
"I don't believe there is any video evidence," said Fletcher Long. Neither does his client Jason Autry,who along with Zach Adams is charged with killing Holly Bobo.
Since our exclusive interview with Autry -- he's remained off-limits, but he's kept in contact by mail.
Autry's followed recent developments on the case and insists there's no video of a crime he didn't commit.
Of course, you would expect to hear that from a murder suspect and his lawyer. We hear the same thing from Jeffrey Pearcy.
"There's nothing to any of this," said Pearcy.
He and his step-brother Mark were both arrested, charged and jailed for tampering with evidence.
A confidential informant or CI tipped the TBI that one of the brothers was seen or heard on a video with Holly Bobo after she disappeared ...
"It's ridiculous," said Pearcy. "I ain't got nothing to hide."
And maybe he doesn't. NewsChannel 5 has learned all state charges are expect to be dropped against the Pearcy brothers by the end of the month.
"This case will be over very shortly. Hopefully on the 29th," said Jeff Pearcy's attorney Olin Baker.
So, why would the TBI do that -- especially when NewsChannel 5 has learned that there may really have been a video?
The informant may have seen a video -- but she got it wrong.
Sources tell NewsChannel 5 there was a video which shows one of the Pearcy brothers with an ex-girlfriend who just happened to look like Holly Bobo. But it's not Holly Bobo.
If that's the case, did the TBI overreach in search of smoking gun?
"They got to be desperate. This case has been going on way too long," said Jeff Pearcy.
The TBI won't comment.
Of course it's possible there could be a video somewhere that shows Bobo after her abduction.
Such evidence could help in the case against Autry and Adams.
But Autry's attorney Fletcher Long feels arresting the Pearcy brothers on what might turn out to be a false tip is a sign of desperation by the TBI
"They still haven't solved this crime. They seem intent on arresting everyone in the western part of the state. I'd be quite nervous if I lived on that side of the river," said Long.
NewsChannel 5 has learned Mark Pearcy willingly turned over all of his cellphones from recent years to the TBI. The question is: Will agents find any video with Holly Bobo?
If they don't and there are no new developments then charges against the Pearcys are expected to be dropped by the end of the month.

LEXINGTON -- Sandra King said a good friend of hers, Jeffrey Pearcy, stayed with her for about six weeks over the summer and that around mid-May this year, Pearcy showed her a video of Holly Bobo tied up and crying.
Pearcy has been charged with accessory after the fact and tampering with evidence in the Bobo case. The state has alleged that Pearcy has knowledge of a video containing information about the case and that he hasn't turned it over to investigators.
Pearcy and his attorney, Olin Baker, have maintained that there is no video and that Pearcy is innocent. Pearcy has said before that he believes the TBI is just "gripping at straws" and that the investigation has ruined his life.
Baker told The Jackson Sun a couple of weeks ago that he believed the charges against Pearcy were going to be dropped due lack of evidence.
However, after a preliminary hearing in Henderson County General Sessions Court today, which included testimony from King and a Tennessee Bureau of Investigation special agent, the judge ruled there was enough evidence to send the case to the grand jury.
If Pearcy is indicted on the charges, he'll be arraigned in Circuit Court in October, Baker said.
The judge also ruled that a handgun, which was taken from Pearcy when he was arrested, could be returned to him because it's not connected to the charges and because Pearcy has a handgun carry permit and no prior felony convictions.
Mark Pearcy, Jeffrey Pearcy's brother, has been charged with the same offenses. He will be in court in August for his preliminary hearing. Mark Pearcy also has pleaded not guilty
King said she's known Jeffrey Pearcy for 19 years and that they are trusting friends.
From March to the end of May, King said, Pearcy and his two sons lived with her in Henderson County so his sons could finish school.
King said that sometime in mid-May of this year Jeffrey Pearcy showed her part of the alleged video. She said Pearcy told her that Zachary Adams sexually assaulted Bobo in the recording.
Adams has been charged with the murder and kidnapping of Bobo, who disappeared from her Decatur County home in April 2011. Adams has been held without bond since he was indicted in March.
"He (Jeffrey Pearcy) told me that Mark (Pearcy) had video of Zach (Adams) having sex with Holly Bobo," King testified.
When asked if she believed Pearcy, she said, "Jeff would never lie to me."
King testified that she asked to see the video, which was on a cell phone, and that she was able to identify Bobo and Adams through photos she had seen of them in the news.
While Pearcy was showing her the video, King testified, Pearcy called Adams a "sick bastard."
The video showed a woman tied up with her hands over her head, King said.
"It looked like Holly Bobo," she said. "It was a shock to see it."
King said she watched about 30 to 45 seconds of the video and saw the front of Adams "at a glance," but never saw a sex act take place.
After she saw part of the video, King said, she asked Pearcy to turn it off. She testified that she never saw the video or phone after that.
King said she waited a couple of weeks after seeing the video before she came forward to the TBI because she initially didn't want to get involved.
"I thought about those two boys," she said, referring to Pearcy's children.
When she decided to "do the right thing," and call authorities, King said, she was asked by TBI special agents, including Brent Booth, to make a phone recording of Jeffrey Pearcy talking to her about the video.
With three TBI agents at her house, King called Pearcy, she testified.
"I said, 'That video of Holly, if it had been you, I would have watched it,'" she told Pearcy over the phone, to which she said he replied "I know."
Brent Booth, a TBI special agent, testified that he has Mark Pearcy's phone and is waiting for the access code from Apple so he can access it. Booth said the TBI has been told a video is on the phone, but he doesn't know what the video is yet.
The TBI has recovered more than 20 phones looking for the video, but they haven't found, Booth said.
He didn't go into detail on whose phones they are, where they came from or what, if anything else, was found on them.
When Jeffrey Pearcy's attorney, Baker, questioned King, he revealed that Pearcy has an ex-wife, who also is named "Holly."
Baker argued that when King called Pearcy in the recorded call, she never said Bobo's last name, she only said "Holly," so Baker asked if she thought Pearcy may have been referring to his ex-wife when he replied.
King told Baker she's "100 percent sure it's Holly Bobo."
"His ex-wife does not have blonde hair," she said. "I never seen a video of his wife."
She said Pearcy told her his brother, Mark, had taken the video of Adams and Bobo.
After the hearing, Jeffrey Pearcy and Baker talked to reporters.
Pearcy said he believes King has made up the story because her son has been in prison for 14 years and has 24 years left on his sentence.
King said in court she was not paid to give this testimony to the TBI and that no one has promised her anything as far as her son being released early.
"I haven't seen a video. No one has seen this video that anyone is talking about," Jeffrey Pearcy said. He questioned why King hasn't been arrested since he believes she's the only person who has seen the alleged video.
Pearcy said he's not aware of a video of Bobo or of his ex-wife tied up.
"I've never seen a video," Pearcy said.
When asked what Pearcy thought King was referring to in their phone call when she said "If it had been you, I would have watched," Pearcy said he could "barely understand her."

LEXINGTON -- Sandra King said a good friend of hers, Jeffrey Pearcy, stayed with her for about six weeks over the summer and that around mid-May this year, Pearcy showed her a video of Holly Bobo tied up and crying.
Pearcy has been charged with accessory after the fact and tampering with evidence in the Bobo case. The state has alleged that Pearcy has knowledge of a video containing information about the case and that he hasn't turned it over to investigators.
Pearcy and his attorney, Olin Baker, have maintained that there is no video and that Pearcy is innocent. Pearcy has said before that he believes the TBI is just "gripping at straws" and that the investigation has ruined his life.
Baker told The Jackson Sun a couple of weeks ago that he believed the charges against Pearcy were going to be dropped due lack of evidence.
However, after a preliminary hearing in Henderson County General Sessions Court today, which included testimony from King and a Tennessee Bureau of Investigation special agent, the judge ruled there was enough evidence to send the case to the grand jury.
If Pearcy is indicted on the charges, he'll be arraigned in Circuit Court in October, Baker said.
The judge also ruled that a handgun, which was taken from Pearcy when he was arrested, could be returned to him because it's not connected to the charges and because Pearcy has a handgun carry permit and no prior felony convictions.
Mark Pearcy, Jeffrey Pearcy's brother, has been charged with the same offenses. He will be in court in August for his preliminary hearing. Mark Pearcy also has pleaded not guilty
King said she's known Jeffrey Pearcy for 19 years and that they are trusting friends.
From March to the end of May, King said, Pearcy and his two sons lived with her in Henderson County so his sons could finish school.
King said that sometime in mid-May of this year Jeffrey Pearcy showed her part of the alleged video. She said Pearcy told her that Zachary Adams sexually assaulted Bobo in the recording.
Adams has been charged with the murder and kidnapping of Bobo, who disappeared from her Decatur County home in April 2011. Adams has been held without bond since he was indicted in March.
"He (Jeffrey Pearcy) told me that Mark (Pearcy) had video of Zach (Adams) having sex with Holly Bobo," King testified.
When asked if she believed Pearcy, she said, "Jeff would never lie to me."
King testified that she asked to see the video, which was on a cell phone, and that she was able to identify Bobo and Adams through photos she had seen of them in the news.
While Pearcy was showing her the video, King testified, Pearcy called Adams a "sick bastard."
The video showed a woman tied up with her hands over her head, King said.
"It looked like Holly Bobo," she said. "It was a shock to see it."
King said she watched about 30 to 45 seconds of the video and saw the front of Adams "at a glance," but never saw a sex act take place.
After she saw part of the video, King said, she asked Pearcy to turn it off. She testified that she never saw the video or phone after that.
King said she waited a couple of weeks after seeing the video before she came forward to the TBI because she initially didn't want to get involved.
"I thought about those two boys," she said, referring to Pearcy's children.
When she decided to "do the right thing," and call authorities, King said, she was asked by TBI special agents, including Brent Booth, to make a phone recording of Jeffrey Pearcy talking to her about the video.
With three TBI agents at her house, King called Pearcy, she testified.
"I said, 'That video of Holly, if it had been you, I would have watched it,'" she told Pearcy over the phone, to which she said he replied "I know."
Brent Booth, a TBI special agent, testified that he has Mark Pearcy's phone and is waiting for the access code from Apple so he can access it. Booth said the TBI has been told a video is on the phone, but he doesn't know what the video is yet.
The TBI has recovered more than 20 phones looking for the video, but they haven't found, Booth said.
He didn't go into detail on whose phones they are, where they came from or what, if anything else, was found on them.
When Jeffrey Pearcy's attorney, Baker, questioned King, he revealed that Pearcy has an ex-wife, who also is named "Holly."
Baker argued that when King called Pearcy in the recorded call, she never said Bobo's last name, she only said "Holly," so Baker asked if she thought Pearcy may have been referring to his ex-wife when he replied.
King told Baker she's "100 percent sure it's Holly Bobo."
"His ex-wife does not have blonde hair," she said. "I never seen a video of his wife."
She said Pearcy told her his brother, Mark, had taken the video of Adams and Bobo.
After the hearing, Jeffrey Pearcy and Baker talked to reporters.
Pearcy said he believes King has made up the story because her son has been in prison for 14 years and has 24 years left on his sentence.
King said in court she was not paid to give this testimony to the TBI and that no one has promised her anything as far as her son being released early.
"I haven't seen a video. No one has seen this video that anyone is talking about," Jeffrey Pearcy said. He questioned why King hasn't been arrested since he believes she's the only person who has seen the alleged video.
Pearcy said he's not aware of a video of Bobo or of his ex-wife tied up.
"I've never seen a video," Pearcy said.
When asked what Pearcy thought King was referring to in their phone call when she said "If it had been you, I would have watched," Pearcy said he could "barely understand her."

However, according to media reports, a skull was found not far from property owned by the family of Zach Adams, who is charged with kidnapping and murder in the Bobo case.
Adams and Jason Autry, who faces similar charges in the case, have both pleaded not guilty.
Two brothers, Jeffrey Kurt Pearcy and Mark Pearcy, also face charges of tampering with evidence and accessory after the fact in the case.
CBS affiliate WVLT reports the skull found was taken in for DNA testing and it could take until Tuesday for results.
The skull was found Sunday in a remote area just off I-40 in the small community of Holladay, less than six miles away from the home of Adams, according to the station. The find was reportedly made by two people digging for the herb ginseng.
"If it is Holly that would bring some closure to the family but right now, any speculation would be wild speculation," Decatur County Sheriff Keith Byrd told the station.
According to Byrd, there are only two missing people in Decatur County - and one of them is Bobo.

Authorities in Tennessee say that a human skull discovered over the weekend in rural Decatur County was that of nursing student Holly Bobo, who disappeared in April 2011.
Tennessee Bureau of Investigation Director Mark Gwyn told a news conference late Monday that Bobo's remains were found near her home in the town of Parsons, approximately 110 miles east of Memphis.
Two men discovered the skull Sunday, approximately 10 miles from property owned by the family of Zachary Adams, who has been charged in Bobo's kidnapping and murder. Authorities had previously searched the area this past March. Adams has pleaded not guilty, as has Jason Autry, who is also facing murder and kidnapping charges.
Bobo was 20 when she disappeared. Her brother told police that he saw a man dressed in camouflage leading her away into the woods. Investigators and volunteers scoured the woods and fields of the town of about 2,400 for clues, but her remains were not immediately found.
Gwyn has said the Bobo investigation has been the most expensive and exhaustive in TBI history, and it's not over yet.
Since Bobo disappeared, the small town of Parsons and surrounding areas in West Tennessee tried to support the family, putting up pink ribbons on lampposts, mailboxes and storefronts. Bobo was wearing a pink shirt and carrying a pink purse before she disappeared.
Recently elected District Attorney Matt Stowe said his office was preparing to seek a possible death penalty in the case. A decision is expected in coming weeks, after he consults with the Bobo family, he said.
"The evidence is voluminous," Stowe said. "We are going to make sure that everyone who played a part in the heinous crime that has attacked the peace and dignity of the state of Tennessee faces a consequence for that."
Stowe said the Bobo family would be issuing a statement Tuesday.
Before the news conference Monday, the Bobo family was trying to remain calm and let authorities do their job, said their attorney, Steve Farese.
"You can imagine the emotional roller-coaster that they've been on," Farese said.
Two brothers, Jeffrey Kurt Pearcy and Mark Pearcy, also face charges of tampering with evidence and accessory after the fact in the case. Both men have said they are not guilty.
Farese told reporters Tuesday that Bobo's relatives now want privacy as the investigation continues.
"We believe we have the right to mourn privately as a family, and as a community," he said. "Now is a time for grieving. Please honor our request."
Decatur County Sheriff Keith Byrd said the case has rocked the community and vowed to hold accountable all those responsible for the young woman's death.

"My original goal was to find Holly. My new goal is to see to it the people who did this are punished," Decatur County Sheriff Keith Byrd said.

And both are fully invested in seeking justice for Holly Bobo.
In fact, Sheriff Keith Byrd believes more people are involved in Holly's death.
"We believe there are and more arrests will be forthcoming," Byrd said.

"I came into office nine days ago prepared to try a murder case with no body. I now have a body so it's gonna be much easier" Stowe said.
"We're gonna hunt these people 'til we find 'em. They can run but they can't hide," Byrd said.

The younger brother of the man accused of kidnapping and killing Decatur County woman Holly Bobo has now been charged with rape, along with previous tampering with evidence charges.
The Tennessee Bureau of Investigation announced that John Dylan Adams, 26, was indicted on the charges this morning by a special Decatur County Grand Jury. The news release said that on Sept. 17, "Adams admitted to TBI agents that he was involved in the forcible rape of Holly Bobo on April 13, 2011, at the address of 235 Adams Lane in Holladay, TN, in Decatur County."
Dylan Adams has been charged with two counts of rape, according to the indictment in the Decatur County Circuit Court.
Sept. 17 also was the day Adams was arrested on a tampering with evidence charge after the TBI said Adams told an agent that he had disposed of evidence on the day Bobo was kidnapped.
"On September 17, 2014, this agent heard Dylan Adams tell other agent with the Tennessee Bureau of Investigation that on April 13, 2011, Dylan Adams disposed of item(s) he knew possessed evidentiary value relating to Holly Bobo," a warrant said. "This offense did occur in Decatur County."
John Dylan Adams, known as Dylan, is the brother of Zachary Rye Adams, who is charged with the felony murder and aggravated kidnapping charges in connection to Bobo's death. A second man, Jason Autry, also is charged with murder and kidnapping in the case. Bobo's partial remains were found in the woods of northern Decatur County last month.
The most recent charges against Dylan bring to light pieces of the TBI's case against the men charged in the Bobo case, placing Bobo in the Adams residence on Adams Lane the morning she disappeared, according to the agency. The TBI first said that Dylan disposed of evidence at the Adams home that morning and now that he participated in Bobo's rape.
The charges against the younger Adams brother both come from alleged confessions to the TBI, after Adams had previously been detained in federal custody on gun charges. The younger Adams brother's name came into the news early on after the arrest of his brother.
Zach Adams, 30, was charged earlier this year with trying to coerce Dylan not to talk about the Bobo case. A warrant on that coercion of a witness charge indicated that Dylan Adams was "a witness in a judicial proceeding involving the crimes of first-degree murder and especially aggravated kidnapping in Decatur County."
While he was in the Chester County Jail in March, Zach allegedly asked another inmate to pass a message to his brother, who was at that time being held in the Obion County Jail, a TBI agent said in a warrant.
Zach Adams asked the inmate to, "Tell my brother he is the one who started this (expletive) and if he don't shut his mouth he will be in the hole beside her," according to the warrant. Adams gave the message on March 4 to an inmate who was going to be transferred to Obion County, the warrant says.
The federal gun indictment against Dylan Adams said he was an unlawful user of controlled substances or an addict.
The Madison County Sheriff's Department arrested Dylan Adams on the federal charges in Madison County on Sept. 25, 2013, and turned him over to the U.S. Marshals Service after an arrest warrant was issued on Sept. 16, 2013.
But members of the Adams family have said that Dylan Adams was actually being housed in Memphis and had been working in cooperation with the TBI on the case since early in the year. Family members have told The Jackson Sun that details Dylan Adams has told the TBI have likely brought about several of the developments in the case, but that they fear Adams' IQ, in the low 70s, has left him vulnerable and easily swayed.
Moss Miller, the first cousin of the mother of Zachary and Dylan Adams, has said Dylan Adams is "a grown man with the IQ of a 10-year-old."
After news broke of the new rape charges against Dylan Adams today, Miller responded with the same defense of the younger Adams brother.
"We are under the impression, in his mental state, he could be coerced to say anything," Miller said. "(After he was brought in for questioning on the Bobo case) they wouldn't let him eat or drink. I would be reluctant to think that this (the rape charge) is true. We are under the impression they are coercing him to say that."
District Attorney General Matthew Stowe said today he is appreciative of the hard work of the TBI to move the case forward.
"We are grateful to the TBI and the grand jury for helping us take one more modest step on the long road to justice for Holly," he said.
The TBI declined to comment further today.

The younger brother of the man accused of kidnapping and killing Decatur County woman Holly Bobo has now been charged with rape, along with previous tampering with evidence charges.
The Tennessee Bureau of Investigation announced that John Dylan Adams, 26, was indicted on the charges this morning by a special Decatur County Grand Jury. The news release said that on Sept. 17, "Adams admitted to TBI agents that he was involved in the forcible rape of Holly Bobo on April 13, 2011, at the address of 235 Adams Lane in Holladay, TN, in Decatur County."
Dylan Adams has been charged with two counts of rape, according to the indictment in the Decatur County Circuit Court.
Sept. 17 also was the day Adams was arrested on a tampering with evidence charge after the TBI said Adams told an agent that he had disposed of evidence on the day Bobo was kidnapped.
"On September 17, 2014, this agent heard Dylan Adams tell other agent with the Tennessee Bureau of Investigation that on April 13, 2011, Dylan Adams disposed of item(s) he knew possessed evidentiary value relating to Holly Bobo," a warrant said. "This offense did occur in Decatur County."
John Dylan Adams, known as Dylan, is the brother of Zachary Rye Adams, who is charged with the felony murder and aggravated kidnapping charges in connection to Bobo's death. A second man, Jason Autry, also is charged with murder and kidnapping in the case. Bobo's partial remains were found in the woods of northern Decatur County last month.
The most recent charges against Dylan bring to light pieces of the TBI's case against the men charged in the Bobo case, placing Bobo in the Adams residence on Adams Lane the morning she disappeared, according to the agency. The TBI first said that Dylan disposed of evidence at the Adams home that morning and now that he participated in Bobo's rape.
The charges against the younger Adams brother both come from alleged confessions to the TBI, after Adams had previously been detained in federal custody on gun charges. The younger Adams brother's name came into the news early on after the arrest of his brother.
Zach Adams, 30, was charged earlier this year with trying to coerce Dylan not to talk about the Bobo case. A warrant on that coercion of a witness charge indicated that Dylan Adams was "a witness in a judicial proceeding involving the crimes of first-degree murder and especially aggravated kidnapping in Decatur County."
While he was in the Chester County Jail in March, Zach allegedly asked another inmate to pass a message to his brother, who was at that time being held in the Obion County Jail, a TBI agent said in a warrant.

NASHVILLE, Tenn. -- The attorney representing Jason Autry, one of the men charged in the murder and kidnapping of Holly Bobo, has been suspended by the Tennessee Supreme Court.
John Herbison was suspended Thursday after allegations over client misconduct. According to the Board of Professional Responsibility, which oversees lawyers in Tennessee, Herbison failed to communicate with two clients and did not file an appeal for a third.
According to the Associated Press, The Supreme Court's Board of Professional Responsibility said in a statement that Herbison's suspension will begin Nov. 30. Herbison will be on active suspension for 60 days followed by probation and required to pay around $3,900 in fines.
Autry is due back in court Dec. 17., at which time Herbison will still be banned from practicing law. Fletcher Long of Nashville is also on Autry’s defense team.
Herbison is also one of the defense attorneys representing Brandon Vandenburg, one of four former Vanderbilt football players charged with rape. That trial is set to begin Jan. 12.
According to the website Long & Herbison PLLC out of Clarksville, Herbison has been licensed since October of 1987.

Tennessee investigative agency says it has finished evidence analysis in Holly Bobo case

MEMPHIS, Tenn. – Authorities say they have completed their analysis of more than 460 pieces of evidence in the case of a woman whose partial remains were found three years after her disappearance, possibly bringing defense attorneys a step closer to seeing how prosecutors have linked their clients to her.
Two men, Zachary Adams and Jason Autry, were arrested last spring and charged with murder and kidnapping in the case of Holly Bobo, a nursing student who was 20 when she disappeared from her house in April 2011. In October, John Dylan Adams was charged with raping Bobo. All have pleaded not guilty.
No trial has been set and the defendants' lawyers have filed a motion to dismiss the charges. The attorneys said they had not received any evidence linking their clients to the crime. Tennessee Bureau of Investigation spokesman Josh DeVine said Thursday that some hair samples have been sent to the FBI for testing, but the TBI has analyzed all the evidence it has received.
Still, it was unclear when the defense would receive any information. District Attorney Matt Stowe told The Associated Press that they would get the evidence they're requesting "at some point."
At the time of Bobo's disappearance, her brother told police he saw a man dressed in camouflage leading her into the woods near her home in Parsons, located about 110 miles east of Memphis. Last September, more than three years later, authorities said two men searching for ginseng found Bobo's skull in a wooded area not far away.
Bobo's disappearance and the subsequent lengthy search attracted national attention as authorities distributed posters with her photograph throughout the South.
Prosecutors have not said whether they plan to seek the death penalty. Hearings scheduled for this month have been postponed to an undetermined future date.
Jennifer Lynn Thompson, Adams' attorney, says state prosecutors have not even told her who found Bobo's remains or where they were found.
"I do not understand what is happening," Thompson said. "I have never before been involved in a case where there is no information about why my client was charged."
In the motion to dismiss, Thompson and Fletcher Long, Autry's lawyer, asked the judge to force prosecutors to produce "all dental record analysis and forensic studies" performed on the skull.
Adams has been in jail since March and Autry has been in jail since April. At a court hearing Dec. 17, Decatur County Circuit Judge Creed McGinley expressed concern that prosecutors had not yet provided key evidence to defense attorneys. He ordered the state to begin turning it over by Dec. 24.
Thompson says the state missed that deadline.
Then, TBI Director Mark Gwyn — who has said the Bobo investigation has been the most exhaustive and expensive in agency history — announced he was suspending all work on the case after District Attorney Matt Stowe accused TBI agents of misconduct.
Stowe took office Sept. 1 after defeating District Attorney Hansel McCadams, who had indicted Adams and Autry.
The dispute was only resolved after Stowe stepped down from the case and Jennifer Nichols, a Shelby County attorney who was Stowe's co-counsel on the case and who had worked with death-penalty cases, was appointed as a special prosecutor. She is the third prosecutor in the case, which Stowe said is unusual.
He said the fact that multiple prosecutors have been involved, plus the complex nature of the case, have contributed to the delays.
"We're talking about terabytes and terabytes of information," he said.
Attorney Steve Farese, who represents the Bobo family, said the recent developments in the case are "different" than in other cases, and he acknowledged that the family is concerned with how the case is going.
"But they understand that this is a tedious process and they want to make sure everyone has their t's crossed and their i's dotted and to get this thing done right," Farese said.
Later, Farese added: "No one should lose focus that this is about justice."

Suspect in Holly Bobo case found dead
A man who authorities had threatened to indict in the Holly Bobo case has been found dead, his attorney told WSMV-TV today.
Shayne Austin reportedly took his own life out of state, Austin's attorney Luke Evans told the Nashville TV station.
Austin signed an immunity agreement in March with prosecutors in the Holly Bobo murder and kidnapping case in Decatur County. Austin was never indicted, but according to court documents, prosecutors revoked his immunity agreement and told Evans they planned to indict Austin because he had not been truthful with investigators.
"It's unfortunate the government came in and made allegations without basis," Evans told WSMV-TV. "People had to live with those allegations ... under the cloud of those allegations."
Austin signed the immunity agreement after the Tennessee Bureau of Investigation indicted Zach Adams on charges of the murder and kidnapping of Bobo. A second man, Jason Autry, was indicted on the same charges in April.
After prosecutors revoked Austin's immunity agreement, Evans filed a lawsuit trying to prevent the state from indicting Austin. A chancery court judge decided she did not have jurisdiction over the suit in May and referred it to circuit court. Further court proceedings on the suit have not been held.
Bobo, 20, was abducted from outside her Decatur County home in April 2011. Her partial remains, including her skull, were found in September 2014, the TBI has said.
