Man prosecutors say held key evidence in Waller case dies

CAPE GIRARDEAU, MO (KFVS) - The man state and federal prosecutors say held key evidence in the disappearance of Jacque Waller has died.

A local long-term care facility confirms Clay Waller's father, James Clay Waller Sr., passed away Tuesday morning.

Back in September, Assistant US Attorney Larry Ferrell said Clay confessed to his father he killed his estranged wife, then buried her body in a hole.

New search and rescue K-9 Unit in Cape Girardeau County

A new search team hits the ground running in Cape Girardeau County.

Members of the Cape Girardeau County Search and Rescue K-9 gathered for training Sunday afternoon at Cape County Park North.

The trained civilian resource now has 15 dogs and 25 people on the team.

Updated at 4 p.m. ET: The husband of a Missouri woman who has been missing for nearly a year was charged with first-degree murder Monday even though his estranged wife's body has not been found.
In a probable cause affidavit released Monday, law enforcement officials outlined why they believe Clay Waller, 41, lured his soon-to-be-ex wife to his home to kill her.
Officials also noted that they discovered Jacque Waller’s diary in her laptop, which was found close to where her Honda Pilot had been parked off a highway. In it, she wrote that Clay Waller had repeatedly threatened to kill her if she left him. She wrote, “He told me that a divorce would be my death sentence.”

Clay Waller was sentenced to five years in federal prison for threatening his wife’s sister in an online posting. Jacque Waller's sister is currently caring for the Wallers’ 5-year-old triplets.
"There is a bit of relief in knowing that charges have been brought against Clay Waller," Jacque Waller's father, Stan Rawson, said in a statement. "The case is now in the hands of the prosecuting attorney, and we are confident that we will now finally get justice for our girl."
The Wallers had been having marital trouble and were on the verge of divorce last June, Rawson told The Associated Press last year.
Jacque Waller and her triplets had moved into her sister’s home, and she had started seeing another man. Clay Waller, too, had a new partner.
On June 1, Jacque and Clay Waller met with their attorney. Jacque had agreed to let Maddox, one of the triplets, spend the day with his father. She called her sister to say she would return home immediately after picking up her son.
She never came home. Clay Waller’s girlfriend said Clay had asked her to take care of the boy for the night – the first time she had ever spent time alone with Maddox.
A neighbor said that on that day she saw Jacque Waller’s Honda Pilot in Clay Waller's driveway next to his red truck. His truck was hooked up to his boat, which he then drove away. Jacque was nowhere to be seen. That evening at 9:45 p.m., another neighbor, approached Clay Waller on his patio and said he had heard Jacque was missing. Waller, out of breath, said he'd just been on a bike ride.
Later, Jacque Waller's Honda Pilot was found on Interstate 55 with a flat tire. Police said the tire had been punctured after it had stopped running.
Clay Waller initially told police that they had been together because Jacque had come over for sex, that they had argued and she left on foot. Later, he told police that Jacque had a nose bleed when his head hit her nose, and that she had bled a lot.

More than 100 volunteers were searching again today for Jacque Waller, a 39-year-old mother of triplets missing for six weeks from her Missouri home. TODAY's Lester Holt speaks with Waller's parents about their fears and suspicions.
When police searched Clay Waller’s home, they found blood stains on the walls that had apparently been washed down. They also found green carpet from the hallway cut up in squares and stored beneath house. DNA analysis of blood stains on the carpet indicated that the blood matched Jacque Waller’s.
For hiding the carpet, Waller is also charged with tampering with evidence.
The FBI said last year that Clay Waller suggested to his father that he had broken Jacque Waller's neck and buried her in a hole that he dug in advance. But Clay Waller has not made any confession to police, and his father died before he could testify.
Waller was sentenced to five years in federal prison in December and is serving time at a prison in the state of Louisiana. He pleaded guilty in October to threatening Brennecke through an online posting.

Cape Girardeau County prosecutor Morley Swingle said one of the tampering charges alleges Clay Waller concealed his wife's body. The second alleges he "concealed bloodstained carpet from the hallway of his home" in Jackson, Mo., about 100 miles south of St. Louis.
Swingle said Missouri lets prosecutors seek the death penalty if at least one of 17 "aggravating factors" can be proven. He said none of the aggravating factors are involved in the Waller case.

His truck was hooked up to his boat, which he then drove away. Jacque was nowhere to be seen.

Sounds like her body is in a body of water and will probably never be found...If I were a juror, they have enough to convince me without a body...

Please forgive me for the above. I scanned 7 pages and had to copy and paste 21 pages as for some reason, the scanner only picked up two or 3 sentences on one scan. These are out of order as I thought if I put them all on one thread, it would not load. Don't know WHY my scanner didn't scan the entire page and left increments only for me to have to copy and paste via photobucket 21 pages. It's all there..just not in Exact order.

ST. LOUIS — Cape Girardeau County's prosecutor this week is expected to spell out the evidence against Clay Waller, who is accused of killing his estranged wife even though her body has not been found more than a year after she disappeared.

A preliminary hearing is Wednesday. Waller is charged with first-degree murder.

Prosecutor Morley Swingle said Monday that he'll call close to 20 witnesses at the hearing.

Waller's attorney did not respond to an interview request.
Jacque Waller was 39 when she was last seen alive on June 1, 2011. The couple was in the process of getting a divorce. Their triplets, now 6 years old, are living with Jacque Waller's sister, Cheryl Brenneke.

Clay Waller is already serving a five-year sentence for threatening Brenneke over the Internet.

JACKSON, Mo. (AP/KTVI) _ The Clay Waller court hearing turned violent following testimony on the stand Wednesday.
Waller’s son got into a fight with a witness during the lunch break for his father’s preliminary hearing. That witness apparently shouted at Clay Waller while on the stand.
Then during a lunch break, Waller’s son, JC, went to confront that man and punched him. A fight broke out between the two until police could break it up.
Clay Waller was in court, accused of killing his estranged wife Jacque, who went missing in June of 2011. Cape Girardeau County prosecutor Morley Swingle filed charges even though her body has not been found.
At the preliminary hearing, two men who worked with Waller both testified about threats. Matt Marshall said Waller was upset that Jacque Waller was seeing another man and said he would kill her rather than allow his kids to call another man “daddy.”
The preliminary hearing is to determine if the case should move forward. Associate Circuit Judge Gary Kamp did not make a decision at the hearing.

Clay Waller's attorney has filed a motion for a change of venue in his client's murder trial, backing up what he said previously -- that he thinks a barrage of local media coverage would prevent Waller from getting an impartial jury in Cape Girardeau County. The circuit clerk's office confirmed that lawyer Chris Davis filed the motion Thursday, but added that Judge Ben Lewis is not expected to rule on the motion until an already scheduled case review Oct. 22. Waller is charged with first-degree murder in the death of his estranged wife, Jacque, who disappeared last year. Prosecutors say Clay Waller killed his wife Jacque after a fight over a pending divorce and money, though no body has been found. Waller pleaded not guilty at his arraignment earlier this month.

Appeals panel upholds Waller's federal sentence
CAPE GIRARDEAU, Mo. (AP) — A federal appeals court has upheld the prison sentence of a Missouri man convicted of threatening his missing wife's sister.
The Southeast Missourian reports (http://bit.ly/Rl6ypb ) that the 8th Circuit Court of Appeals on Friday affirmed the five-year federal sentence imposed on Clay Waller in Oct. 2011. Waller was sentenced for making threats over the Internet to his sister-in-law.
Waller also faces a state charge of first-degree murder in the death of Jacque Waller, who disappeared June 1. Her body hasn't been found.
The federal appeals panel agreed with the lower court's decision to give Waller the maximum sentence on the threatening charge.
Clay Waller's attorney, Scott Tilsen, argued the court miscalculated sentencing guidelines, erroneously alleged Waller killed his wife and used the alleged murder to impose a maximum sentence

CAPE GIRARDEAU, MO (KTVI) – The remains of Jacque Waller have been found. The Cape Girardeau County Prosecuting Attorney confirms that the body was recovered by police on Wednesday. She had been missing since June, 1 2011.
The 39-year-old mother of triplets went missing after meeting with her estranged husband Clay Waller about their divorce. Her SUV was found abandoned near Fruitland, a few miles away from their home.
Authorities charged Clay Waller with first degree murder in the disappearance before the body was found. He is currently is serving a five-year term in federal prison after pleading guilty to threatening Jacque Waller’s sister in an Internet posting.
The couple’s triplets, now 7 years old, are living with Jacque Waller’s sister in St. Francois County.

ST. LOUIS – The husband of Jacque Sue Waller, whose body was discovered nearly two years after going missing, is expected to plead guilty in her disappearance, according to KFVS.
Clay Waller is set to make the plea during a court hearing on Thursday, according to the report.
Jacque Sue Waller’s body was found on Wednesday in the Mississippi River across from Cape Girardeau.
The Cape Girardeau County prosecutor’s office issued a one-paragraph statement saying police had found the body
“It has been confirmed that the body is that of Jacque Sue Waller,” the statement read. It didn’t say where or how the body was found. A woman answering phones at the prosecutor’s office said no further comment would be made, citing an ongoing investigation.
Sue and Clay Waller had nearly finalized a divorce when she disappeared on June 1, 2011. He was charged last year with first-degree murder and faces trial in September.
Jacque Waller’s sister, Cheryl Brenneke, has custody of their 7-year-old triplets.
In a statement on their Facebook page Waller’s family confirmed “with a heavy heart” that Jacque Waller’s remains were found. The statement said funeral arrangements have not been made.
“We thank everyone of you who has supported us and assisted us in this terrible nightmare,” the statement read.
Messages seeking comment from a spokeswoman for Waller’s family were not returned, but Brenneke told the Southeast Missourian newspaper that she was in shock.
“You anticipate how you’re going to feel for two years,” Brenneke said. “You just can’t prepare yourself, really. You just can’t.”
Authorities said the couple had been living apart for about three months—she was living in Ste. Genevieve County, he was living in Jackson. They met with an attorney about divorce proceedings on June 1, 2011. Police said they argued then about financial problems.
By that evening, Jacque Waller’s relatives were becoming worried because they had not heard from her. Her father, Stan Rawson, has said his daughter had previously confided to Brenneke that Clay Waller had threatened her.
Jacque Waller’s Honda Pilot was found along Interstate 55 a day after she disappeared. Several searches since then have turned up sporadic leads, including the discovery of her purse near where the car was found.
The FBI said last year that Clay Waller suggested to his father that he had broken Jacque Waller’s neck and buried her in a hole that he had dug in advance. But Clay Waller has not made any confession to police, and his father died before he could testify.
At a preliminary hearing in July on the murder charges against Clay Waller, then-prosecutor Morley Swingle outlined a case built largely around circumstantial evidence: potential motives of both jealousy and greed; blood splatter found at Clay Waller’s house; apparent efforts to hide a blood-stained carpet in a crawl space; and Waller’s history of anger and resentment toward his wife.
During the hearing, Edwin Rhodes, an acquaintance of Clay Waller, recalled that about two months before Jacque Waller’s disappearance, Clay Waller told him, “I ought to just kill her.”
Clay Waller pleaded guilty in late 2011 to threatening Brenneke over the Internet. He is serving a five-year federal term.

JACKSON, MO (KFVS) -
Clay Waller pleaded guilty to second degree murder of his estranged wife Jacque Waller.

He was sentenced to 20 years in the Missouri Department of Corrections.

"20 years in prison is not what you deserve, but it will have to do," said Judge Benjamin Lewis.

The stipulations of the plea deal were that Waller had to provide the location of the body, law enforcement had to find the body, and he had to recount how he killed Jacque.

JACKSON, Mo. — A frustrated judge, begrudging prosecutors and chagrined family members all conceded Thursday that offering a plea deal to a southeast Missouri man accused of killing his estranged wife, a mother of 5-year-old triplets who was missing for almost two years before her body was found last week on an island in the nearby Mississippi River, was inadequate.

But it was the best option available, they said, because 42-year-old James Clay Waller II was the only person who could lead authorities to Jacque Waller's body, while ensuring a conviction and offering grieving family and friends closure for the 39-year-old mother who disappeared in 2011.

Clay Waller was given a 20-year prison sentence Thursday after pleading guilty to second-degree murder and admitting in a barely audible voice – inside a packed Cape Girardeau County courthouse – that he'd murdered the triplet's mom. The shaken inmate struggled to admit choking his wife to death before dumping her body on an island on the Illinois side of the Mississippi River nearly two years ago.

Before being sentenced, Clay Walker also listened to his 7-year-old son publicly disown him for life, calling his father a "big, fat jerk."

"You killed our mom," the child said in a taped statement. "I thought you were a good guy. Now I know you're not ... I wish you weren't my dad."

Few left the courthouse satisfied with the outcome. Both Jacque Waller's sister and Circuit Judge Benjamin Lewis said they weren't happy with the lighter sentence, but had few options. The plea was conditional on Clay Waller II leading investigators to his wife's body and his confession in court. Her body wasn't found until May 29 in Alexander County, Ill., and Clay Waller continued to share details about the killing with investigators earlier this week.

"I did not want this deal," said Waller's sister, Cheryl Brenneke, who has custody of the triplets and plans to adopt the two girls and one boy. "My mother and father and these children deserved to bury her, though."

Lewis acknowledged that "there will be a number of people critical of this plea agreement. However none of those critics could provide the body of Jacque Waller."

"That is not what you deserve, but it will have to do," he said in handing down the 20-year sentence. Under the original charge, Waller could have faced the death penalty or life in prison without parole.


Clay Waller is serving a five-year term in federal prison for threatening Brenneke over the Internet. His sentence in the murder case will run concurrent with the federal case, officials said. Under Missouri law, he must serve at least 85 percent of his sentence – or 17 years – minus time served.

He was originally charged with first-degree murder and arrested in April 2012 even though her body had not yet been found. He had faced a September trial in Cape Girardeau County Circuit Court.

"It's bitter, because Jacque Waller was sentenced to death, and her family was sentenced to life without Jacque," said Cape Girardeau Sheriff John Jordan.

Prosecutors said they insisted on at least a 20-year sentence, though Waller's public defenders tried to negotiate a more favorable deal. County prosecutor Chris Limbaugh said he expects Waller to serve the entire 20 years.

"It was decided that it was more important to get Jacque back," he said.

Jacque Waller had been missing since June 1, 2011, the same day the couple met with a divorce lawyer and argued over money after living apart for the previous three months.

Her Honda Pilot was found along Interstate 55 a day after she disappeared, its tires slashed, after the car had been seen the day before at Clay Waller's home. Several searches since then turned up sporadic leads, including the discovery of her purse near where the car was found.

The FBI said last year that Clay Waller suggested to his father that he had broken Jacque Waller's neck and buried her in a hole that he had dug in advance. But Clay Waller had previously not made any confession to police, and his father died before he could testify.

Waller spoke softly as he admitted guilt, his voice barely audible in the packed Jackson courtroom. He kept his back turned as Brenneke spoke, facing the judge but glancing downward while fidgeting in place.

"We got in an argument," he said, describing an assault on his wife at the Jackson home he was living in after the couple split. "I lost my temper."

But investigators said Waller already had planned to kill his wife, digging a 6-foot hole in the sand the previous day and scouting out the burial location via helicopter. Jordan said Clay Waller lured his wife to his home by convincing her that their son was there. Instead, the child was with Clay Waller's girlfriend.

Jordan said Waller was motivated in part by jealousy. Before her death, Jacque Waller had again found love with a new boyfriend, and the couple planned to move in together, her sister said Thursday.

Brenekke spoke to Waller with rage and contempt, her voice quavering.

"To someone who has always considered himself the smartest guy in the room, you just look like a skinny, washed up, murdering con man to everyone in this room," she said. "I knew immediately that you killed my sister."

After Brenneke spoke, Waller heard the taped statement by his son in which the child said, "I never want to see you again for my entire life."

Stan Rawson, Jacque Waller's father, said the family accepted the plea deal in order to remove the uncertainty over their daughter's fate. He said Jacque Waller was a long-time victim of domestic abuse, and blamed himself for not taking his daughter's warnings about Clay Waller's temper seriously.

"She thought she could control him," Rawson said. "Needless to say, she couldn't."

What a POS Waller is! He made sure his four children would never have their Mother, he never opened his mouth to LE as to what happened to Jacque which must have tortured her family for these past two years which in turn probably forced them to agree to this plea of just 20 years. I hope one of the prisoners in prison takes care of this POS ensuring that he never gets a chance to do this to someone else! MOO!

A funeral and burial will be held Saturday for Jacque Rawson Waller. The closure comes more than two years after the Farmington native went missing.

Jacque’s husband, Clay Waller, was in court today for a plea hearing. He has been charged with her murder. The two were separated and had just visited a divorce lawyer when Jacque disappeared on the afternoon of June 1, 2011.

The Cape Girardeau Prosecuting Attorney's office confirmed last Thursday that a body found on Devil’s Island, a land mass in the Mississippi adjacent to Cape Girardeau, was that of Jacque Waller.

After the announcement, the family posted a statement on Facebook. “It is with a heavy heart I deliver this message. Our daughter, mother, sister and friend has been found. God has planned everything well to place us in this very moment.

“God guided the law enforcement officials, searchers, K9s and most of all the prayers being sent to the prison to weigh heavily on (Clay’s) mind. We thank everyone of you who has supported us and assisted us in this terrible nightmare... God Bless you all!”

Jacque’s sister, Cheryl Brenneke, who has custody of Jacque’s seven-year-old triplets, said she told the children the news Thursday morning, adding it was the hardest thing she’s ever done. She said the children seemed stunned but okay.

Numerous searches for Jacque had been held in the past two years. Her Honda Pilot was found the day after her disappearance. The SUV was abandoned on the northbound shoulder of Interstate 55 near the Fruitland/Jackson exit.

Jacque, 39 at the time, had been working at Blue Cross in Cape Girardeau and living with her sister in Ste. Genevieve County. She had plans to move back to the Farmington area where she grew up and where her family lives.

Even before Jacque’s body was found, the family believed there was enough evidence to find Clay Waller guilty of first-degree murder. The bloody carpet and the statements he made to an FBI agent about the carpet is one key piece of evidence, they said.

Prosecutors had said that Clay Waller suggested to his father that he had broken Jacque Waller’s neck and buried her in a hole. His father died before he could testify.

STE. GENEVIEVE — Jacque Sue Rawson Waller, 39, of St. Genevieve, Mo. passed away June 1, 2011, in Cape Girardeau County. She was born December 26, 1971, in Bonne Terre, Mo.

Preceded in death by: Grandparents, Robert and Dorothy Rawson; Fred and Ruby Boren; and a sister Patricia Ann Rawson.

Survived by: Parents, Stanley V. Rawson and Ruby ‘Boren’ Rawson of Bonne Terre; three children Avery Waller, Maddox Waller, and Addison Waller of Ste. Genevieve; step-son J.C. Waller of Chaffee, Mo.; two sisters, Cheryl Brenneke and husband Bob of Ste. Genevieve, Melissa Goodson and husband Joe of Farmington; brother, Rob Rawson and wife Nanci of Farmington; numerous nieces, nephews, other relatives and friends also survive. Special friend Richard Herbst of Farmington.

Member of the Leadington Freewill Baptist Church.

Visitation will be Saturday June 8, 2013, at Esther Baptist Church from 9 a.m. - 1 p.m. Funeral service Saturday, June 8, 2013, at 1 p.m. at Esther Baptist Church with Rev. Vernon Long officiating. It was a somber day as family and friends who gathered at Ester Baptist church in Park Hills to say goodbye to Jacque Sue Rawson -Waller. On Saturday, flowers, hugs and tears and filled the church packed with hundreds of mourner.

CAPE GIRARDEAU COUNTY, Mo. (KSDK) - On Thursday, Clay Waller pleaded guilty to second-degree murder. He was sentenced to 20 years in prison.

A press conference was held at 3:30 p.m. to praise law enforcement, prosecutors, and the family. Sheriff John Jordan with the Cape Girardeau County Sheriff's Office called Thursday a "bittersweet ending." Sweet because Clay Waller had to admit to being a murderer in public, and sweet because the family now has Jacque back and can honor her with a proper burial.

Sheriff Jordan went on to say it is bitter because Clay Waller's punishment does not fit his crime. He was sentenced to 20 years in prison, while Jacque was sentenced to death, and her family was sentenced to life without Jacque.

Jacque's father, Stan Rawson, held up a picture of Jacque and said how much he, her family, and her triplets love her. He said he cannot brag enough about the prosecutors and law enforcement, and the job they did working the case.

Rawson said they were fortunate because from day one they knew who the perpetrator was. He said there was no doubt in their minds Clay Waller was responsible, and knew after 24 hours she was not going to come home alive.

He also praised Jacque's co-workers, calling them a pack of "ravenous wolves," who intended to find Jacque, help the kids, help the family, and help in any other way possible. They wanted to keep the case on the hot burner, and not let anyone rest until she was brought home.

Rawson said he never thought Clay was capable of murdering Jacque.

"It's my fault she's dead today. We didn't take her seriously. I should have done something to stop it. I honestly didn't think he would do it," Rawson said. Jacque had told him Clay would kill her. "He's not gonna do that," Rawson said he told her.


Rawson offered to have a talk with Clay, but Jacque discouraged that, saying it would only make the situation worse.

He also thanked the more than 18,000 supporters on the Facebook page Find Jacque S Waller. Those people were always encouraging, and he said it feels good to know so many people cared and were behind the family.

"Clay Waller didn't get everything he deserved, but he did deserve everything he got," said Rawson.

During a question and answer portion of the press conference, Lt. David James said at this point they do not believe Clay Waller had any accomplices, though there are still many questions Clay would not answer during his interview on Monday.

Authorities also detailed the location Jacque's body was found. She was found in a channel between Devil's Island and the main bank, just to the southeast of the channel, down river. Her body was buried approximately six feet deep in sand. Investigators and cadaver dogs had been in the area searching for her remains, but she was not found sooner because of the depth of the burial and the sand.

It was confirmed Clay Waller had dug the hole he buried Jacque in the day before he killed her. He told investigators during his interview on Monday he had dug holes on other occasions, but then decided not to kill her.

Waller's motive for the murder was anger and jealousy that Jacque had a new boyfriend. Waller was upset at the thought of another man raising his children.

Authorities say he had lured Jacque to his home under false pretenses. He told her their son, Maddox, was at his home and that Jacque needed to pick him up. Maddox was actually at Waller's girlfriend's home.

According to the Facebook page Find Jacque S Waller, visitation will be held Saturday, June 8 at 9 a.m. at Esther Baptist Church. A graveside service will begin at 1 p.m. at Woodlawn Cemetery in Leadington, Mo.

As for the key pieces of evidence, both officers point to video that shows Clay Waller hosing out and using 409 to clean a boat the night after Jacque disappeared.

"The way he was washing the boat and spending so much time on the center of the boat would have been powerful to a jury," said James.

It's a boat Waller admitted to launching in the Mississippi River to take Jacque Waller's body, which was in a trash can, to a beach area near Devil's Island in southern Illinois.

He was planning to kill her long before he gathered the nerve to actually carry it out... digging more than one grave. That's chilling.
IMO 20 years isn't enough time for him to serve for her murder.

No it is NOT long enough. I read up thread that Jacque's family did NOT like this plea deal but they wanted her body so they had no choice, to make a deal with the devil.
He should never be allowed out, he's a monster and he'll do it again! Anyone who has dug 'several graves' before and then decide not to kill the person then, we do not need on the streets!

Clay Waller will likely be transferred back into the custody of federal authorities sometime this week before he heads to state prison for his second-degree murder conviction in the death of his estranged wife, Jacque Waller. Federal authorities previously held him for a federal Internet threat conviction. He received a maximum five-year sentence for an something he wrote in 2011 to Jacque Waller's sister, Cheryl Brenneke, saying he would kill her. U.S. Marshals will coordinate a transfer of Waller to state prison at a later date. According to online court records, Clay Waller's state prison sentence will run "concurrent with any sentence currently serving."

I somehow missed the word 'concurrent' when reading/posting that Waller only received twenty years for brutally strangling his wife to death.

I am fuming! So his five year federal sentence will be ran at the same time his twenty year state is! I don't know why those sentences could not have ran consecutive since one is a federal and the other is state! So wrong!!!!! angry
