Pediatrician Emilio Luna Charged With the Distribution of Child Pornography

PHOENIX -- A Sun City pediatrician has been arrested and charged with distributing child pornography.
Emilio Luna, 40, who works at Desert Valley Pediatrics, was arrested Wednesday after FBI investigators found he was sharing thousands of files of suspected child pornography in a public peer-to-peer system online, according to the U.S. attorney’s office.
Police searching the Sun City home Luna shared with his parents confiscated computers, DVDs and $15,550 in cash that was stashed in Luna’s closet, according to federal court records. Luna was using the name "Speedy69" on his computer, police said.
Records also showed FBI agents working this child pornography investigation discovered Luna may have shared approximately 10,000 files online; a number of those files contained pornographic photos of underage boys.
The executive director of Desert Valley Pediatrics, Chris O’Connell, said Luna had only been working at the practice since January, and that there were no indications of any problems. “Obviously, as pediatricians, we are disgusted by the allegations, which are against every belief that we as pediatricians hold dear,” O'Connell said.
A conviction for distributing child pornography carries a maximum penalty of 20 years in prison, a $250,000 fine or both. The prosecution is being handled by Assistant U.S. Attorney Brian E. Kasprzyk of Phoenix.

Executive Director Chris O’Connell said Luna no longer is employed with the pediatric practice, which has three offices in the West Valley. O’Connell and Desert Valley Pediatrics issued a statement saying they were “disgusted by the allegations, which are against every belief that we as pediatricians hold dear." Luna started to work at Desert Valley in January. The O’Connell statement said the practice did not notice any unusual behavior from Luna and they are fully cooperating with the investigation.
The Arizona Medical Board, which regulates medical doctors in the state, had not received any other complaints or taken any disciplinary actions against Luna before this event, said Lisa Wynn, executive director of the board.
“We’re hopeful to get a practice restriction today,” she said.
She continues to work with the U.S. Attorney’s Office to confirm Luna will not be any threat to children in the area of providing health care, she said. “We are in the early stages of collecting that information.”

Pediatrician Suspect in Child Porn Case was Sole User of Computers, Feds Allege; Graphic Complaint Describes Images
Dr. Emilio Luna, the west Phoenix pediatrician accused of distributing child porn on a public file-sharing system, was the only one who had used his laptop computer, federal agents allege.
A complaint filed by agents in court gives more details as to why Luna was arrested, and what kinds of photos he was freely offering the world from his computer. See our post about Luna from earlier this afternoon, if you haven't read it already.
Luna, who has also worked in El Paso, lives at home with his elderly parents in the 10700 block of West Peoria Avenue in Sun City, states the complaint obtained by New Times. When agents went to the house this week, they found that Luna's father has dementia and his mother, a Spanish speaker, has no idea how to use a computer.
The investigation began in June when FBI agent Rajiv Patel signed onto GigaTribe and spot-checked other users on the system. He noticed that someone using the handle "Speeedi69" was sharing a massive amount of data, 10,000 files totaling 920 gigabytes, so Patel browsed some of the shared images and spotted the child porn. He selected 15 of the images and downloaded them to his computer.
Five of the images are described in the complaint. All five involved pre-adolescent boys engaged in sexual poses; in three cases, adult men are in the pictures, too.
The feds traced the Internet connection through Cox Communications back to Luna and later raided the Sun City house, seizing a desktop and laptop computers that belonged to Luna.
Authorities aren't sure if any of the kids in the pictures were patients of Luna's.

CAUTION
Dr. Emilio Luna, who is under indictment for five counts of distribution of child pornography, fled house confinement on September 12, 2010. Luna, a pediatrician in Phoenix, Arizona, was identified as allegedly sharing child pornography on a peer-to-peer (P2P) network.
On September 9, 2010, Luna was granted a pretrial release which stipulated house confinement with electronic monitoring. During this pretrial period, Luna was allowed to leave his home for specific and approved reasons. On September 12, 2010, he was permitted to attend church services at 12:30 p.m. At approximately 8:30 p.m., Luna's abandoned vehicle, which contained bolt cutters and the electronic monitoring device, was found by local law enforcement in an abandoned parking lot. Luna may have fled to Texas, California, Illinois, or his birth city in Mexico.
A federal warrant for Emilio Luna's arrest was issued on September 12, 2010, by the United States District Court, District of Arizona, for pretrial release violation.
