Baez will appeal the order - he will says its double jeopardy and they will have to have a hearing before Perry - its still up in the air, but I believe Perry will uphold Stricklands order and then it goes to an appeal

Attorney Jose Baez asked the court to give Anthony credit for time served and place her on probation in the check case. I am wondering if Strickland w/order NO Press. I would bet he does. It w/be a closed hearing but the press w/be outside and it w/be interesting to see if she is seen driving up w/Bozo.
I also wonder if the Ant's w/be allowed in the court.
I DO think Bozo w/attempt for an emergency hearing to push back her appearance w/in 72 hours. They are probably scrambling trying to find her a place to live in or around Orlando.

ORLANDO, Fla (Reuters) - Casey Anthony will be required to serve a year of probation for check fraud charges in light of a clarification made on Monday by the judge presiding over that case.
It is not known whether Anthony will be required to report for probation in Orlando, but the supervision will begin this week.
"The judge has sent a corrected order. She will be on probation after all," said Florida Department of Corrections spokeswoman Jo Ellyn Rackleff. "We haven't determined exactly when or where, but it will be within 72 hours."
Anthony, 25, was released from jail in Orlando last month without any restrictions placed on her freedom after her acquittal on a murder charge connected to the 2008 death of her 2-year-old daughter Caylee.
Her whereabouts have not been publicly disclosed in the weeks since her release.
The probation stems from a separate case. Anthony pleaded guilty in January 2010 to check fraud charges resulting from purchases she made after Caylee's death using the checking account of one of Anthony's best friends.
Anthony was sentenced to the 412 days she had already spent in jail, to be followed by a year of probation.
Jail officials concluded that her probation period was completed in the course of the 18 subsequent months she spent in jail awaiting trial on the murder charge.
But the judge who sentenced Anthony in the check fraud case has clarified his intent, said Leesa Bainbridge, spokeswoman for the clerk's office.

Just unreal!! I realize they lost Caylee and their daughter and YES..they probably did need a huge break. But rest assured, I would not be swimming w/the dolphins (although they are my favorite!) so close to the ending of the trial. IDK, they just bug me. I w/say that this was probably great therapy for George. I feel for him but that lying slut's mother is a whole other story.BJ wrote:

Casey Anthony lawyer due to fight probation order
According to Sanders, Anthony's attorney, Cheney Mason, will go to court Tuesday to file a motion to have Strickland disqualified from the case and the court order overturned.
The Orlando Sentinel reported Monday that Anthony's lawyers were expected to argue that she has already served the probation order while in jail.
Where will Anthony live?
If Anthony does return to Orange County, it's unclear where she would live.
According to Sanders, parolees must give an address or location so they can be supervised under Florida law.
The law also requires that the address be made part of the public record unless a special exception is made.
NBC-affiliate station WESH 2 reported that its legal analyst, Richard Hornsby, believed that if Anthony does serve probation, it will not be be very strict.
"It's not like she will have to wear a GPS monitor or have constant contact," the defense attorney said.
Anthony pleaded guilty in January 2010 to 13 counts in a check fraud case, NBC-affiliate station WESH.com reported.
She was sentenced to 412 days in Orange County Jail with credit for 412 days time served and was ordered to pay $5,517.75 in court costs, in addition to the year's probation.
NBC News obtained a copy of the amended documents, which explain that "the Defendant is to report to Probation upon release."
Under its terms, she must "make a full and truthful report to your [her] Probation Officer" not later than the fifth day of each month, pay the State of Florida at least $20 a month toward the cost of her supervision, not change her residence without consent and not carry any firearm or weapon without permission.

A new motion hopes to make public how Casey Anthony's defense spent $200,000 before Anthony was declared indigent.
Anthony was declared indigent in March 2010, meaning a state agency doled out taxpayer money for her defense.
Since that time, Anthony's defense has spent more than $125,000 in taxpayer funds for her first-degree murder trial.
Anthony is also seeking taxpayer money to pay for her appeal of four misdemeanor convictions on lying to authorities.
A new motion seeks to make public how Anthony's defense spent $200,000 before the indigency ruling. The money came from ABC News for photo licensing fees.
ABC has since said it will not pay such fees to possible interview subjects.
The new motion says while Judge Stan Strickland indicated that the list of how the money was spent was to be sealed, there was no written order sealing the document.

Circuit Judge Stan Strickland waited a year and a half to tweak his written order for Casey's sentence of one year probation for check fraud. He might have waited too long.
Strickland is on vacation for the next week and the defense is scrambling to figure out its next move as the Thursday morning deadline for Casey to check in with probation draws closer.
Strickland said, on Jan. 25, 2010, that Casey's probation was to start upon her release. But his signed written order didn't spell that out. Because of that, Casey was done serving her probation on Jan. 24th of this year.
When Casey walked out of jail last month she was free. But yesterday Strickland signed a new order giving her 72 hours, until Thursday morning, to report to the Department of Corrections to start her probation.
If she is serving probation, she has to check in on the fifth of every month, she can't leave Orange County without permission, and she'd have to find a job.
WFTV legal analyst Bill Sheaffer believes Strickland might not get a do-over. But even if he does, Sheaffer believes Casey can't be forced into a do-over of her probation.
Casey left prison last month after a jury acquitted her of murdering her 2-year-old daughter, Caylee. She was convicted of lying to detectives but released from jail because of time served. She has since disappeared from public view.

I assume if she is on probation for one year if she doesnt show up and the defense doesnt get a court order to stay, then they could hold her in contempt? or maybe put her back in jail? This ought to be interesting.
I assume if she doesnt show up there will be a huge outcry as Mason will be showing his client is "above the law".

If she does not show up for court she will most definitely have a warrant out for her arrest. I think if Mason is not granted this new emergency Order (and he won't be) she will show up. She has to. Bozo and Mason don't want a warrant hanging over their knuckle heads.

Awaiting the murder trial. She was originally arrested for lying to the police and I believe child neglect. She was formally arrested for Murder 1 on Oct 14, 2008.Or was she in jail for those three years awaiting the murder trial??????

Anthony has several relatives who live in Ohio -- but it's unclear if she has spent time them. Sources extremely close to Anthony tell us she has been bouncing around the country ever since her release from jail after being acquitted of murdering her daughter.

I think TMZ has paid an actress who looks like Casey to walk around and take these shots - what can they do to them? Standing in a window in the clothing store for everyone to see while shopping? I dont think so - walking around a town that she is not familiar with?

OHIO -- New photos of Casey Anthony reportedly spotted strolling through Columbus, Ohio were posted on a celebrity news website early Wednesday morning.

TMZ.com posted pictures on its website and said the pictures are of Casey walking down a sidewalk over the weekend. (See TMZ's Casey Anthony Incognito Photos)
She was spotted wearing an Ohio State University hat and sunglasses.
TMZ says she has been bouncing around the country since her release. The website didn't say how it obtained the pictures or if it paid for them.
Casey has family in Ohio and reportedly took a flight there on a jet owned by her uncle's car dealership the night of her release.

The wftv article now says she went to Ohio in a jet owned by her Uncles car dealership? That would be Georges brother. I cant believe he would send a jet for Casey after what she said about George and I also dont believe he owns a jet. Before they said it was Todd Macaluso's jet.

Yes, I dont believe its her - its someone who has studied her walk and also chewing very obviously wouldnt you say? Also to stand in the window when she knows shes a hunted women? I dont think so

Department of Corrections to hold 11:30 a.m. briefing to discuss Casey Anthony's probation.
An emergency hearing may be held today to determine if Casey Anthony should be made to serve probation following a recent amended order by Judge Stan Strickland.
Attorneys for Casey Anthony filed an emergency motion for a hearing late Tuesday "to quash, vacate and set aside" Judge Strickland's recent amended order regarding Anthony's probation.
Strickland, the judge who initially presided over Anthony's check fraud and murder cases, won't be the one taking up the matter — he entered an order today recusing himself from the case. His order reassigned the matter to Chief Judge Belvin Perry, who presided over Anthony's first-degree murder trial.
Meanwhile, Casey Anthony's lead defense attorney Jose Baez this morning on NBC's Today Show told host Matt Lauer his client has completed the terms of her probation and called the judge's order "confusing."
He also said probation poses "an issue with safety."
The Department of Corrections will hold a media briefing at 11:30 a.m. in Orlando to discuss the issue.
In the motion, defense attorney Cheney Mason says Strickland's amended order was "made with a reckless disregard for Ms. Anthony's due process and civil rights."
The attorneys reacted after Strickland signed amended court documents Monday requiring Anthony to serve one year of supervised probation — as he originally intended when he sentenced her in a check-fraud case in January 2010.
That amended order gave Anthony 72 hours to report to probation, meaning she would have until early Thursday to report.
But Mason's emergency motion argues Strickland lost jurisdiction in this case because the amended order was made more than 60 days after his original one.
The motion goes on to say: "Ms. Anthony actually did serve probation, as evidence(d) by her record with the Florida Department of Corrections. Any second sentence for probation imposed will be in violation of Ms. Anthony's rights of protection against double jeopardy under both the Florida state and United States Constitution."

ORANGE COUNTY, Fla. -- A judge who ordered Casey Anthony to serve a year of probation for check fraud now that she is out jail is stepping down from the case.

Earlier this week, Strickland ordered Casey back to Orlando to meet a probation officer to start a year of probation.
Casey has vanished from public view since her acquittal last month on charges of murdering her 2-year-old daughter.
Strickland sentenced Casey to probation in January 2010 for using checks stolen from a friend. Corrections officials interpreted the sentence so that she served the probation while in jail awaiting her murder trial
But Casey's defense team claims Strickland's order to force Casey to come home for probation is a year too late and not valid.
Strickland said, on Jan. 25, 2010, that Casey's probation was to start upon her release. But his signed written order didn't spell that out. Because of that, Casey was done serving her probation on Jan. 24, 2011.
Strickland says he meant the probation period to start upon her release.
Casey's lead attorney, Jose Baez, told NBC's "Today" show Wednesday that bringing Casey back to Florida from an undisclosed location would just add to what he called the "circus-like atmosphere" around her case.
He says she would be in danger and need security if she has to return to Florida under the judge's order.
A defense motion for an emergency hearing to quash, vacate and set aside the court's probation order was filed Wednesday, but a hearing has not been set.

A hearing is supposed to be held today but she had better be in Orlando anyway just in case. Judge Perry is fair but tough, lets see what he does.
