Casey Anthony's legal team tells TMZ they will fight the judge who just rejected their claim that Casey served her probation for check fraud while she sat in jail during her murder trial ... and if they lose Casey will have to return to Florida in 11 days.

Anthony was sentenced to 1 year's probation for her 2010 check fraud conviction. The judge who sentenced her said in court the time Casey spent in jail would not count toward completing probation, but the order the judge signed mistakenly allowed Casey's probation to run concurrently with her time in the pokey.

A judge ruled on Friday that the judge who sentenced Casey clearly made an innocent mistake, and it wouldn't make sense to allow Casey to get credit for the time she was in jail. After all, the point of probation is to test how a person behaves when they are in the real world, not while they're locked up with few opportunities to misbehave.

But now her lawyers tell TMZ they will appeal Friday's ruling. If they win, it would mean Casey would get a huge break -- her probation would already be completed -- because of a technical error.

Casey's lawyers say if they lose their appeal ... they want her to serve her probation in a state other than Florida.

ORLANDO, Fla. -- The Los Angeles Examiner is reporting that Casey Anthony has signed a book deal and promises to reveal the identity of Caylee's father.

The website, citing anonymous sources, said Anthony will write the book with the help of a ghost writer.

The website said Anthony's multi-media deal includes a six-figure cash advance. It said she took this deal because she is afraid there will not be other offers because she cannot do book signings.

On Friday, Judge Belvin Perry upheld another judge's order that Anthony return to Orange County to serve one year probation on an unrelated check fraud conviction.

Anthony's attorneys are expected to appeal that order, but if Anthony does serve probation, she will be required to get a job. The Examiner speculated that a book deal could fulfill that requirement.

Anthony, 25, was released from the Orange County Jail on July 17 after completing a four-year sentence for four counts of lying to police. She was acquitted earlier the same month on felony charges that she abused and killed her 2-year-old-daughter, Caylee Anthony.

ORANGE COUNTY, Fla. -- New reports are emerging that Casey Anthony just signed a book deal worth hundreds of thousands of dollars, but her attorney said that's not true.

A Los Angeles newspaper claims Casey has agreed to a tell-all book and will receive a six-figure cash advance.

Los Angeles Examiner is attributing the report to anonymous sources. The website claims the book will reportedly contain the name of Caylee's father.

However, Casey's lead defense attorney, Jose Baez told Central Florida News 13 that the report of a book deal isn’t true.

A hearing next Thursday will reveal how much law enforcement wants to be reimbursed for searching for Casey's daughter, Caylee.

Judge Belvin Perry has made his decision about whether or not Casey Anthony will have to return to Orlando to serve the year’s probation that she was ordered to serve when she stood before Judge Stan Strickland and plead guilty to the stealing checks from her friend while her daughter, Caylee was missing.

Casey was sentenced to 412 days in jail and year probation to be served when she was released from jail. Somehow there was an error on the written order and the defense attorney’s argued that Anthony served her probation while in jail even though Judge Strickland verbally ordered it to be served once she was released. Once she was released last month from jail several questions were brought up as to why she wasn’t serving her probation which prompted Judge Strickland to amend his order demanding that Anthony return to Orlando to do her probation but Anthony’s attorneys are fighting it.

Judge Perry issued his order in writing that Casey Anthony must report to the Department of Corrections in two weeks to serve the supervised probation. He wrote that probation is meant to rehabilitate an individual and that serving probation while incarcerated would clearly thwart society’s interest in extracting a full, fair, and just punishment for the crime.

“To permit the Defendant, whose counsel was well aware that the probation was to begin upon the Defendant’s release from jail, to avoid serving probation now, would take a lawfully imposed sentence and make it a mockery of justice,” said Judge Perry.

He also went on to scold Jose Baez, Anthony’s lead attorney saying he as an officer of the court had a duty to intervene when it was apparent his client’s sentence was not being imposed according to the judge’s order.

“To additionally seek to use a scrivener’s error to achieve an end that was against the court’s intent, especially where both parties had argued the issue of when probation should commence, strikes at the very foundation of our justice system,” he stated in his written order.

Judge Perry says that Jose Baez violated his duty of candor, which is “the gold standard that all officers of the court – especially attorneys – must live by.”

He did note that the court was aware of the high probability that there have been threats made to harm Anthony so he is giving the Department of Corrections his authorization to make an exception and keep her address private while she is on probation.

Casey Anthony must report to an Orange County probation officer no later than August 26, 2011 at noon or earlier if she wants to.

I hope she is ordered to find a legitimate job and not one going to her attorney’s office for 6 hours a day (to play on the computer or God knows what else) to make it look like she is working. I also hope she feels the fear that little Caylee felt when her life was taken from her, or at least something close to it.

Thank you, Judge Perry, for making this ruling. Casey needs to learn she can’t have everything her way especially when she broke the law. It is time she is treated like every other citizen here. You do the crime, you do the time!

Errors in a written order created confusion over the probation term initially, but now Perry claims Casey’s attorneys should have known she was not supposed to serve probation while she was behind bars.

But in the pending appeal, Casey's attorneys fired back about being chastised by Perry in a written order. They say the state was also notified long ago when Casey’s probation was being served in jail.

The heart of the argument is that Casey faces double jeopardy because the probation sentence was already carried out in jail.

They're urging the appeals court to stop what the defense claims is an illegal sentence.

The defense is expected to present a signed copy of the appeal to the court on Thursday. The court will then decide whether to hear the case.

The document was filed with the 5th District Court of Appeals in Daytona Beach.

Anthony's attorneys said the probation sentence would be illegal. They cited bias from the original judge in the case and mentioned an interview Judge Stan Strickland gave to WESH 2 News.

The motion also alleges double jeopardy and states Anthony has already served her punishment for the check fraud case.

Jose Baez, Casey Anthony's lawyer, is being investigated by the State Bar of Florida, for possible ethical violations -- specifically, hiding information from the court.

The probe was triggered over a dogfight involving Anthony's 2010 conviction for check fraud. She was placed on 1 year's probation, but the judge in the case made it clear on the bench -- the time Casey sat in jail awaiting her murder trial would not count toward the completion of probation.

Here's the problem ... the judge screwed up, and when he wrote the order placing Anthony on probation, it mistakenly read that the jail time would count toward completing probation.

Anthony's lawyers acted as if the written order was the final word, and as a result authorities -- who were in the dark -- determined Anthony had completed her probation.

The Chief Judge of the court lashed out at Baez, saying, "Our system of justice should never be in the position of rewarding someone who willfully hides the ball," adding, Baez may have violated "an attorney's duty of candor."

On Baez' part, he told the judge he did indeed know about the trial judge's error but felt he had no obligation to inform the court.

The State Bar of Florida is now investigating the matter.

Her attorney, Jose Baez, confirmed her return to Florida. Speaking to Fox News on Sunday night, Baez said Casey is preparing to start serving probation in Orange County if her appeal is denied.

Casey was sentenced to a year of probation in 2010 after she pleaded guilty to check fraud.

Her defense team appealed last week, claiming she has already fulfilled her probation while behind bars. But Judge Belvin Perry upheld a ruling by Stan Strickland, the judge who originally sentenced Casey, that the probation was supposed to start after her release.

Prosecutors have until noon Monday to respond to the appeal.

But if Judge Belvin Perry's ruling is upheld, Casey's probation begins Friday, and Baez said she is prepared to do what is necessary in order to complete the sentence.

"Whatever we end up working out with the Department of Probation, you can rest assured Casey Anthony will follow the letter of the law and serve her probation as the law requires her to do so," said Baez.

Sunday night here lead attorney Jose Baez told FOX News Channel's Geraldo Rivera that his client had returned to her home state because she's supposed to start serving probation for her check fraud conviction on Friday. "Were going to follow the law whatever the courts decide and I'm certain she'do what's asked of her if necessarry and hopefully it won't come to that," said Baez.

Baez also said that Anthony was in fact in Ohio and that the TMZ pictures of her were legitimate. "She has been with close friends of ours that have, are somewhat spiritual advisors, people who care and are trying to help her get on with her life."

Baez says Anthony has spoken with her parents but has not spoken to her brother Lee. "She's had limited contact with her parents."

Judge Belvin Perry ordered Casey Anthony to serve a year probation for her check fraud conviction last week and that ruling has been appealed.

I hate to argue with a dead horse, because it really doesn't matter, at least not to me, BUT, I am convinced those Ohio photos are NOT kc. I wish I had the tools to do a superimposition because I believe that would prove those photos are of a look-alike. Just comparing the ears in one of close-ups to a "known" ear of kc, it seems clear to me the ears are not the same.

Several points, if the defense contends she is in danger WHY was she strolling the streets alone? Why did the photo-journalist not approach her and ask questions?

I think the truth and answer is...TMZ agreed to stage the photo shoot with a look-alike making it look like it was a hidden camera secretly photographing her so there would be no backlash/boycot to TMZ. I think the defense team/kc agreed to the deal because there would be no danger to kc and they/she could make big bucks without public outcry.

That's my theory and I'm stickin' to it!

I agree Laga, that to me those were not photos of Casey. Shape of the body was wrong as well and I didnt think it looked a thing like her. I heard two different psychologists say that the photos were staged. The casual way that she walked down the street, the way she was shown right in the window of the shop, didnt at all represent a woman that was in prison for nearly three years and worried about her safety. It doenst make sense that it was her but it does make sense that it was a double.

Prosecutors filed a response on Monday afternoon in the Fifth District Court of Appeal to Casey's attorney's petition to prevent her from serving a one-year probation period for check fraud.

Circuit Judge Stan Strickland sentenced Anthony to a year of probation in January 2010 after she pleaded guilty to stealing checks from a friend. At the time, Strickland said Anthony should serve the probation upon her release, but those instructions never made it into a written order. Corrections officials interpreted the sentence to mean Anthony could serve the probation while she was in jail awaiting her murder trial, where she was acquitted in the death of her 2-year-old daughter, Caylee.

Strickland clarified in an order earlier this month that Anthony must begin her probation now that she is out of jail. He then recused himself from the case and turned it over to Judge Belvin Perry, who had presided over Anthony's murder trial. Perry upheld Strickland's order and Anthony's attorneys last week filed an appeal with the Fifth District Court of Appeals in Daytona Beach.

In the appeal, Anthony's attorneys accused Strickland of bias, citing an appearance on Nancy Grace's television show in which he said he was shocked by the murder trial verdict. Grace has been a vocal critic of Anthony.

The attorneys also argued Strickland couldn't amend the order since the probation sentence had already been completed. The order also violates double jeopardy since Anthony would be serving the same sentence twice, they said.

If the order is upheld, Anthony has until noon Friday to report to the probation office in Orlando, under the terms of Perry's order.

A Department of Corrections spokeswoman said Monday that there is a possibility that Anthony could report to a probation office in another part of Florida. Speaking in general terms, spokeswoman Gretl Plessinger said if a probationer who was sentenced in Orlando has established a residence in another part of Florida, the probationer could report to the probation office in that part of the state rather than return to Orlando. Plessinger, however, said she needed to double check with whether such circumstances would apply to Anthony's case under the terms of the judge's order.

Since her release from jail following her acquittal, Anthony has kept a low profile and her exact whereabouts have been a secret.

Attorney General Pam Bondi's office filed a response Monday opposing Anthony's efforts to stop a probation order from being enforced.

Anthony was ordered earlier this month to serve a year of probation for check fraud. Her attorneys have appealed to the Fifth District Court of Appeals in Daytona Beach, saying she already served the sentence while in jail awaiting her murder trial.

If the order is upheld, Anthony has until noon Friday to report to the probation office.

Bondi's office told the court of appeal that probation is not a right, but a grace for "a second chance" to live by the law and that sentencing is not "a game in which a wrong move by the judge means immunity for the prisoner."

Circuit Judge Stan Strickland ordered Casey to serve one-year of probation if she ever was released after her murder trial, but the written order the department of corrections received did not include the words "after release." Therefore court of appeal is deciding whether Casey's one visit by a probation officer at the jail equals serving a year's probation.

"I think Fifth District Court of Appeals is going to place great weight on Supreme Court decisions that were cited by the attorney general's office. We're talking about constitutional principles and those principles have been passed on by the highest court in the land," said WFTV legal analyst Bill Sheaffer.

The State Attorney General's Office argued in court papers filed Monday that Casey Anthony never served probation while in jail and should be made to serve that one year of state supervision now.

The AG's filing, adopted locally by Orange-Osceola State Attorney Lawson Lamar's office, is a response to an appeal raised last week by Anthony's defense.

The AG's response disputes the defense team's contention that Anthony served probation while in jail.

"The court originally imposed probation to be served following her release from incarceration," the AG's response states. "Legally, it is clear that a defendant cannot serve probation while incarcerated."

The 5th District Court of Appeal gave the state until noon Monday to respond in Anthony's probation case.

Her defense team wants the appellate judges to vacate Chief Judge Belvin Perry's order requiring her to report for probation Friday in her check-fraud case.

Her lawyers argue that she served the one-year probation while awaiting trial in the death of her daughter.

They maintain that, because her probation was applied while she was in jail, she cannot legally be made to serve another probation period.

In early 2010, Judge Stan Strickland ordered that she serve probation upon release from jail. But his intent was not translated in the written order. The Department of Corrections applied the probation while she was in jail.

But the AG's office countered Monday that Anthony never served her probation. The court, it argued, "was simply attempting to ensure the previously imposed, and never served, probation was begun."

The appeals court should affirm Perry's order because Anthony "has yet to serve the one year of probation she was ordered to complete," the AG's office concluded.

The defense has until noon Tuesday to file a reply.

Moments ago, the Fifth District Court of Appeal ruled that Casey Anthony must serve probation for check fraud.
She has until noon Friday to report to a probation office in the state. Attorney Jose Baez has said that Anthony has returned to Florida.

The court “ruled that sentencing is not a game and Casey Anthony cannot take advantage of a clerical error,” WFTV-Channel 9’s Kathi Belich reported at 5 tonight. “In a two-page ruling, it says she and her lawyers knew her probation was to start after her release. The court ruled she never served probation, so it’s not double jeopardy.”

WOFL-Channel 35’s Holly Bristow reported that the defense team has worked out a deal where she will report for probation secretly. “She will not have to walk into a place where everybody will know her. Her address will not be publicized,” Bristow reported. “So we likely will not know where she is living right now or where will be living in the future while she does serve this probation.”

Central Florida News 13’s Jacqueline Fell highlighted the court’s decision that a judge’s oral pronouncements take precedence over written orders. Judge Stan Strickland had said that Anthony’s probation was to begin after she left jail, but that point was lost because of a clerical error. Strickland later clarified his ruling, then recused himself from the case.

Casey Anthony Defense Fights Probation Order Watch Video

In the written order filed by the Fifth District Court of Appeals today, the judges reprimanded Anthony and her defense team for turning the sentencing process into a "game."

"The petitioner and her lawyers were well aware that her probationary placement was not to begin until her release from confinement. The petitioner may not, under these circumstances, take advantage of the administrative error of the Department of Corrections," the order states.

Defense attorney Baez and the rest of Anthony's team have previously admitted to knowing that the judge's original intentions were for Anthony to serve probation outside of jail, but argued that the Department of Corrections allowed Anthony to serve the probation and that the jurisdictional timeframe had passed to address this issue.

Casey Anthony's Safety May Be a Probation Issue

The attorney general fired back, arguing that Anthony never really served probation since it was served while in jail.

"Legally, it is clear that a defendant cannot serve probation while incarcerated," Attorney General Pamela Bondi and Assistant Attorney General Wesley Heidt wrote in a response filed in the Fifth District Court of Appeals on Aug. 22.

"The court was simply attempting to ensure the previously imposed, and never served, probation was begun...upon her release, she should have reported," the response stated.

Baez is being investigated by the Florida Bar for his handling of Anthony's sentencing, ABC Affiliate WFTV reported.

It's unclear if Anthony will be able to serve the probation out of state or what measures will be taken to protect her. Throughout her trial and following her acquittal, she's received death threats.

When issuing his order to report to a parole officer earlier this month, Perry alluded to her safety.

"This court is very mindful that it is a high probability that there are many that would like to see physical harm visited upon the defendant," Perry wrote in his Aug. 12 order for Anthony to return to Florida.

I'm not certain if it was her or not...
Whether it was or whether it wasn't, that video was certainly staged (as others here have mentioned) she looks directly at the person with the camera, and then goes inside the store and browses in the front window. Certainly doesn't look like she's in fear for her life.

Florida Department of Corrections officials report that Casey Anthony reported for probation Wednesday evening.

No other details were immediately released, but officials said more information would be available Thursday.

The Fifth District Court of Appeals ruled Tuesday Casey Anthony must report for probation by noon Friday.

Anthony could have gone to any office in the state. She can also ask to serve the probation in another state.

It's not an uncommon thing. The Department of Corrections tells News 13's Jacqueline Fell last month 6,579 people had their probation transferred.

A judge's order is blocking all of Casey Anthony's personal information, like her address.

The order said at the January, 2010 hearing, Judge Stan Strickland, the judge at the time, agreed with the defense in open court that probation would begin after a release from jail, if she was acquited.

Casey Anthony, the young Orlando mother acquitted of killing her toddler daughter, reported for probation on Wednesday in Florida in a check fraud case, the Department of Corrections said.

Anthony, 25, voted the most hated American in a celebrity poll after a jury found her not guilty in July of the 2008 death of her 2-year-old daughter Caylee, dropped from public view following her release from jail. Her lawyers confirmed she had moved out of state.

But earlier this month, a judge ordered Anthony to return to Florida to report for a year of probation for a different crime -- check fraud charges she admitted to in 2010.

"Casey Anthony reported to probation in Florida on Wednesday evening," the Florida Department of Corrections said in a statement.

Another statement would be released on Thursday, it said.

Confusion has swirled around that case. Earlier this week, Anthony's lawyer told Fox News his client was back in Florida in a safe location.

The original judge in the check fraud case told Anthony she must serve her probation after her release from jail. But his intent was not written into the final sentencing order, leading officials to allow Anthony to complete her probation while she sat in jail awaiting trial for the murder charge.

The judge, Stan Strickland, filed a clarified version of the sentencing order on August 1, following Anthony's July 17 release.

Her lawyers, seeking to have that order quashed, argued the court had no jurisdiction to tell Anthony to serve probation now and that it violated her rights against double jeopardy.

Geraldo Rivera predicts that viewers have “a reasonable expectation” of seeing ”the country’s least popular woman” when Casey Anthony reports for probation on Friday. (Sorry, Geraldo..you were Wrong!)

Jose Baez has said that Anthony has been in Florida for a week, Fox News’ Rivera told WOFL-Channel 35.

Rivera dismissed as “sour grapes” that Judge Stan Strickland clarified his ruling that Anthony should serve a year’s probation for check fraud after she left jail.

But Rivera added that Chief Judge Belvin Perry and the appellate court agreed with Strickland. “Maybe I owe Judge Strickland an apology,” Rivera said.

Rivera said there have been ”legitimate death threats” against Anthony after she was acquitted of first-degree murder in the death of her daughter, Caylee. “She is so widely reviled. There are still very, very bitter and harsh feelings toward her,” Rivera said. ”I do believe they’ll get their pound of flesh in this instance.”

WFTV-Channel 9’s Kathi Belich said it’s not likely Anthony will report for probation in Orlando. “There are 156 probation offices across the state, and the Department of Corrections says it won’t disclose the one the convicted felon chooses, because it will have to be in the Florida county where she plans to live,” Belich said.

Anthony will serve probation "somewhere in the state of Florida," though the exact location of her probation office is being kept secret over concerns for her safety.

Casey Anthony is receiving extra security measures from the Florida Department of Corrections because she is "one of the most hated women in America," a probation spokeswoman said today.

Anthony reported to a probation officer for the first time Wednesday at 6 p.m., said Gretl Plessinger of the Florida Department of Corrections. She will serve a year's probation for her conviction in a check fraud case that preceded her first degree murder trial. The Florida woman has received death threats since she was acquitted of charges that she murdered her 2-year-old daughter Caylee.

"The visit lasted a little over an hour. The probation officer laid out for her in detail the conditions of the court. She understood those conditions. She told the probation officer that she intended to do well on probation. She was polite and cooperative," Plessinger said.

Anthony, 25, met with the officer without her attorneys present. It's unclear if she arrived at the probation office alone or with someone. Anthony must report to her probation officer once a month within the first five days of the month. To keep Anthony's location unknown, her information will not be entered into the state database of parolees.

"Because of the death threats against her and the court orders, we are taking security into consideration in this case certainly and we will not be disclosing the location or anything that will lead to the discovery of her location. But she will be treated like every other offender in that if she doesn't follow the court orders, we will immediately notify the court," Plessinger said.

The DOC of any state would have to accept KC as a probationer & agree to her terms of probation. It is highly doubted any state wants that liability, & add her to the all ready overloaded case load.

Casey's life on the outside might be much worse than what her life on the "inside" might have been. I think she got exactly what she asked for when she was found not guilty and you know what they about that........be careful what you ask for; you just might get it! Karma is working overtime!
