After 10 days, attorneys on Monday finished their questioning of the state's star witness in the Seth Mazzaglia murder trial.

DOVER, N.H. — The ex-girlfriend of a man charged with raping and killing a University of New Hampshire college student left the witness stand Monday after 10 days of questioning.

Kathryn McDonough ended her testimony the way she began it: Insisting that she initially lied when she said 19-year-old Elizabeth "Lizzi" Marriott of Westborough, Massachusetts, died while the two of them were engaged in rough sex that involved restraints. She testified that her then-boyfriend, 31-year-old Seth Mazzaglia, choked Marriott after she twice rejected his sexual advances.

Mazzaglia is charged with first-degree murder. McDonough has pleaded guilty to hindering prosecution and is serving 1 ½ to three years in prison.

McDonough said she and Mazzaglia threw Marriott's body in a river that feeds into the ocean. Her body has never been found.

Lawyers for Mazzaglia spent a lot of their cross-examination pointing out inconsistencies between what McDonough told them at their first meeting and what she was telling the jury. Defense attorney Joachim Barth questioned McDonough extensively about whether she concocted the story blaming Mazzaglia to get years off her own sentence.

Mazzaglia was arrested Oct. 13, 2012. Two days later, McDonough told his defense team that she and Mazzaglia were both having sex with Marriott using rope restraints and breath-stopping techniques when Marriott had a seizure and died. McDonough testified at trial she concocted that story to protect Mazzaglia because she was still in love with him.

Mazzaglia is on trial for murdering UNH sophomore Lizzi Marriott

Today in court jurors hear from the defendant Seth Mazzaglia for the first time.

In a 20-minute jailhouse phone call, the 12 men and women of the New Hampshire jury hear Mazzaglia tell his now ex-girlfriend "I love you always and forever."

Kat Mcdonough and Mazzaglia also speak about opening a bank account for the defendant as well as make plans to marry. Mazzaglia remains calm throughout the entire phone call, even talking about when he will be released.  

Mazzaglia's ex-girlfriend is currently on the stand, but she's not testifying in Mazzaglia's defense. Mcdonough took a plea deal with the prosecution and is pointing the finger at the man she once promised to love "always and forever." In return, Mcdonough only gets up to three years in prison.

Last week, she told jurors Mazzaglia strangled, raped and murdered 19-year-old University of New Hampshire sophomore Lizzi Marriott.

Mcdonough has also testified to being sexually dominated and at times abused by her ex-boyfriend. She says she was the "submissive" in their BDSM relationship.

However, the defense has a different story. They say Mcdonough was not the victim she portrays herself to be. The defense says Mcdonough was the mastermind behind the entire murder plot.

This jailhouse phone call recording may be one of the only times jurors will get incite into this relationship.

DOVER, New Hampshire - The government's star witness in the murder trial of Seth Mazzaglia, accused of raping an killing a University of New Hampshire student in 2012, may be lying to avoid a long jail term, Mazzaglia's defense team argued on Wednesday.

The trial, which has riveted the New England state for weeks with details of the occult, sadomasochism and romantic betrayal, entered its final phase on Wednesday with the start of closing arguments.

State prosecutors have charged Mazzaglia, 31, in the murder of Elizabeth Marriott, who was a 19-year old UNH student when she disappeared in October 2012.

The state's star witness is Mazzaglia's ex-girlfriend, Kathryn McDonough, 20. She testified she lured Marriott to the apartment the couple shared as a sex offering to Mazzaglia, but that he strangled her and raped her lifeless body after she rejected his sexual advances.

Mazzaglia has denied the charges and his lawyers have sought to the undermine the credibility of McDonough, portraying her as a manipulator who changed her story to avoid a long prison sentence. Before her plea deal, McDonough first told attorneys that Marriott died from a seizure.

Under the plea agreement, McDonough is serving 18 months to three years in prison for charges that include witness tampering and hindering the investigation.

"She needs this more than anything. You don't think she's willing to lie?" defense attorney Joachim Barth told the jury in Strafford County Superior Court.

The soft-spoken McDonough said she and Mazzaglia put Marriott's body into a suitcase and dropped it into the Portsmouth harbor. Marriott's body has never been recovered.

Over 19 days of testimony, details emerged of a twisted fantasy life shared by the couple that featured multiple personas, tarot cards and visions of taking over the world. Mazzaglia never took the stand.

Mazzaglia is charged with first-degree murder and could face life in prison if found guilty by the jury.

Closing arguments in the Seth Mazzaglia murder trial Wednesday focused largely on the testimony of the central witness in the case.

DOVER, N.H. — A jury is set to begin deliberations today in the sensational bondage-sex murder trial of Seth Mazzaglia, who was called a “cold-blooded killer” by a prosecutor yesterday while his attorney tried one last time to label the state’s star witness as a liar.

Assistant Attorney General Geoffrey Ward pleaded with jurors yesterday to keep their focus on the 31-year-old defendant, who is accused of strangling Elizabeth “Lizzi” Marriott on the night of Oct 9, 2012, after she allegedly rejected his advances during a game of strip poker.

“This case above all else is about the truth of ... this defendant,” Ward said. “Send him the message that you have seen through the lies, the coverups, the manipulation. Send him the message that you’ve seen through it all and know the truth about him that he is a cold-blooded killer.”

Mazzaglia’s ex-girlfriend, Kathryn “Kat” McDonough, 20, has testified that Mazzaglia strangled Marriott with bondage rope as he wore gloves after the 19-year-old Westboro native and University of New Hampshire sophomore twice denied his advances and failed to satisfy his appetite for sex games.

After securing a deal with the state, McDonough is serving no more than three years in prison for lying to investigators and witness tampering.

Defense attorney Joachim Barth countered that McDonough has lied repeatedly, even to his own office, when she initially told defense attorneys Marriott died from suffocation after consensual rough sex while she was on top of her.

“She has years of motivation. She has all the motivation of the beautiful things life has to 
offer,” Barth said referring to McDonough’s plea deal.

McDonough had testified that after strangling Marriott, they drove her body to Portsmouth, where they dumped her body into the Piscataqua River that feeds into the Atlantic Ocean. Marriott’s body has never been found.

But Ward said jurors don’t need to solely rely on McDonough’s word because for­ensic evidence such as Marriott’s DNA found on Mazzaglia’s underwear and Marriott’s hair found on a railing by the cliff where the body was discarded prove McDonough is telling the truth.

A 31-year-old Dover man was convicted today on two counts of first-degree murder in the October 2012 slaying of a University of New Hampshire student from Massachusetts.

The verdict in the case of Seth Mazzaglia, who killed Elizabeth “Lizzi” Marriott, 19, of Westborough, came in the middle of the first full day of jury deliberations after a lengthy trial replete with shocking and lurid testimony.

A jury found Mazzaglia guilty of first-degree murder by strangulation and also of first-degree murder while committing a felonious sexual assault, in Marriott’s Oct. 9, 2012, death in Dover.

Mazzaglia was also convicted of conspiring to tamper with witnesses and informants, and conspiring to falsify physical evidence, for his attempts to cover up the murder.

The jury, seven women and five men, said at noon today it had reached verdicts and announced them shortly after 1 p.m.

The case hinged on whether the jurors believed Mazzaglia’s former girlfriend, 20-year-old Kathryn McDonough, who testified that Mazzaglia strangled Marriott then raped her after she rejected his sexual advances.

McDonough testified that after the murder at the apartment that Mazzaglia and McDonough shared, she helped Mazzaglia dump his victim’s body in a suitcase off Peirce Island. Marriott’s body was never found.

McDonough, the state’s star witness, underwent a grueling cross-examination in which defense attorneys sought to raise doubts about her credibility. Under a plea deal in exchange for her testimony, she is serving a 1½-to-three-year sentence for conspiracy

The jury’s verdict brought a quick end to a trial that had included graphic testimony about Mazzaglia and McDonough’s relationship and shocking details about the horrific crime.

A prosecutor said in closing arguments that Mazzaglia was a cold-blooded killer.

“This defendant made clear if his sexual desires were not fulfilled, ‘the darkness’ would get the better of him,” Assistant Attorney General Geoffrey Ward said in closing arguments on Wednesday. “He was not in control of Lizzi, and he couldn’t stand it. And he killed her for it.”

Heartbroken dad thanks jury for guilty verdicts in NH murder case

DOVER, N.H. -- The heartbroken father of Elizabeth “Lizzi” Marriott thanked the jury today for sending his daughter's killer to prison for the rest of his life after what he called a "torturous" trial.

"Lizzi is gone. We are very grateful the jury returned a guilty verdict for first-degree murder because it will keep the convict in prison for the rest of his life," said Bob Marriott. "Keeping him off the streets protects the other young women who might have otherwise been additional victims."

Killer Seth Mazzaglia was found guilty on four counts -- two first-degree murder charges and witness tampering and falsifying evidence charges -- after the jury deliberated for only eight hours.

The jury found Mazzaglia guilty of murder by strangulation and murder following sexual assault. The details of those counts, the victim's dad added today between tears, was "devastating" for the family to hear.

"Unfortunately, a trial, even with a conviction, cannot console us for the loss of Lizzi," he added. "We will always miss her and wonder what could have been. In fact, the trial was torturous for us. The truth of what happened to Lizzi is horrendous..."

The dad went on to say he understood the defense often uses every avenue, but "blaming the victim" hurt the family even more.

“Mr. Mazzagli, you are remanded into custody, sir,” said Judge Steven Houran after the jury forewoman read the unanimous verdicts.

Sentencing is scheduled for a later date where he faces life in prison without parole.

Houran thanked the jury for their service before the verdict was read, saying, “My observation is that you've served with patience and with dignity throughout this process. I appreciate and I .”

Mazzaglia killed and then raped the 19-year-old Marriott on Oct. 9, 2012, after she rebuffed his sexual advances while playing strip poker. The body of the Westboro native who was a sophomore at the University of New Hampshire has never been recovered.

Prosecution star witness Kathryn “Kat” McDonough -- the ex-girlfriend of the murderer -- said repeatedly in the past weeks that Mazzaglia killed Marriott and they both dumped her body in the ocean off Portsmouth. She was called a liar by the defense, but she stuck to her tale that Mazzaglia strangled Marriott with a bondage rope after the UNH student refused his advances following a game of strip poker.

The defense pressed McDonough on her first story, that she later recanted, that she was the one who killed Marriott after sitting on her face and smothering her during rough bondage sex. McDonough said she was telling a lie at the time.

Prosecutor Geoffrey Ward thanked jury and said of Marriott, "We all wanted to bring her home, but were unable to do so."

DOVER, N.H. — Seth Mazzaglia was sentenced to life in prison without parole, and ordered to pay restitution to the family of Elizabeth “Lizzi” Marriott, for raping and murdering the University of New Hampshire student from Massachusetts. The life in prison without parole sentence was mandatory under New Hampshire law.

Before the sentencing, family and friends delivered victim impact statements in court. The mother of Elizabeth “Lizzi” Marriott told Seth Mazzaglia today that she unequivocally hates him.

“I want you to know that I hate you unequivocally,’’ Melissa Marriott said.

The elder Marriott said that she and her 19-year-old daughter had a close relationship that survived traditional tensions between parents and teenagers, something that was bonded into place by journeys to her internship at the New England Aquarium.

Since her daughter’s disappearance and murder nearly two years ago, Melissa Marriott said she has stopped doing the things that she used to do with her daughter, such as trips to the mall, getting a manicures, or going to New Hampshire beaches.

“I can’t imagine going to the beach in New Hampshire again,’’ she said. “I rarely do anything that I did with Lizzi. It feels disloyal.’’

Fighting back tears, Melissa Marriott closed by saying: “I miss Lizzie every day. I know she is never coming home and even after 22 months I still have trouble comprehending that she is never coming home.’’


She paused and added, “It’s all because a cowardly 30-year-old man who could not deal with a confident young woman.’’

Speaking next was Marriott’s paternal grandmother, Charlotte Panneton. She read dictionary definitions of the words predatory, predator, and animal. And then she turned towards Mazzaglia and told him, “these three words describe you, Mr. Mazzaglia.”

She, too, said she struggles to come to grips with the death of her grandchild,

“I wake up each morning thinking, how can this be?” Panneton said. “My head knows. My heart does not.”

Also speaking was Marriott’s girlfriend, Brittany Atwood, who struggled for composure as she talked about losing the “love of my life.’’

“She was a bright light and always will be,” said Atwood. “She was good, sweet, and pure.”

After the friends and relatives of Marriot gave their statements, Mazzaglia stood and addressed the court,.

“I did not rape and murder Elizabeth Marriott,’’ Mazzaglia told Stafford County Superior Court Judge Steven Houran today after the judge heard victim impact statements from Marriott’s parents, grandmothers, uncles, girlfriend and friends.

Standing in green prison clothing, he added, “However, I do understand the Marriott family’s pain. And I did play a part in covering up her death, a mistake that I tried to correct. When investigators showed up, I showed them exactly where I left her body. Unfortunately they were unable to recover her. For that, I am truly sorry. My heart goes out to the Marriott family and I am very sorry for their loss. That is all.’’

Jurors earlier this year deliberated for about eight hours before finding Mazzaglia guilty of first-degree murder by strangulation and a second count of first-degree murder in connection with felonious sexual assault.

The month-long trial was dominated by one voice: Mazzaglia’s former girlfriend, 20-year-old Kathryn McDonough, who testified for 10 days. She said she lured Marriott, a Target co-worker, to the couple’s Dover apartment as a sexual offering for Mazzaglia, who had demanded another woman in the bedroom.

But McDonough said when her co-worker twice rejected Mazzaglia’s advances, he got angry. He selected a rope the couple used in bondage sex, strangled Marriott, and raped her lifeless body, McDonough said.
