Subway SUSPENDS Jared Fogle and scrubs him from its website after child porn raid
July 7, 2015
Subway has officially suspended its relationship with Jared Fogle, after FBI agents raided the pitchman's home Tuesday morning in connection to a child pornography investigation.
According to a statement from the company, both Fogle and Subway agreed that this was the 'appropriate step to take'.
'Subway and Jared Fogle have mutually agreed to suspend their relationship due to the current investigation. Jared continues to cooperate with authorities and he expects no actions to be forthcoming,' the statement reads.
Fogle, 37, was detained outside his Zionsville, Indiana home at 6:30am when a special task force showed up with a search warrant. The weight-loss icon's wife and two young kids left just before the raid, and authorities say that Fogle is not under arrest at the time, WTHR reports.
The raid on Tuesday comes more than a month after the executive director of Fogle's childhood obesity charity - the Jared Foundation - was arrested on child pornography charges.
Russell Taylor, 43, was arrested in May on seven counts of production of child pornography and one count of possession of child pornography
It's unclear if the Tuesday raid on Fogle's home was in any way related to Taylor's arrest.
Authorities first started investigating Taylor after receiving a tip from a woman who had been exchanging sexual text messages with the suspect.
She became concerned and called police after Taylor sent her a message, asking if she wanted to see pictures of young girls.
A subsequent search of Taylor's home in Indianapolis turned up more than 400 videos with child pornography, stored on computers and other devices in the home office.
Four minors have been identified as victims in the case, according to court documents.
Following Taylor's arrest, the Jared Foundation cut all ties with the former executive director and Fogle issued a statement saying he was 'shocked' by the allegations.
Following his arrest, Taylor was formally charged in court on May 4 and held at the Marion County jail.

Jared Fogle isn’t behind bars because the FBI has nothing on him ... according to his camp.
Fogle's legal team tells us there's a very good reason we didn't see the feds marching the ex-Subway spokesman out of his Indiana home this week. They say they're confident the FBI raid turned up nothing that incriminates Fogle.
It's unclear where the investigation stands -- we reached out to the U.S. attorney’s office, and they were extremely tight-lipped ... not even acknowledging there's a probe.
Fact is, Jared isn't in custody ... but the damage has been done -- Subway quickly suspended its relationship with him, and charities have run for the hills.

Porn King in College?? This is old news!
MARCH 12, 2010
As a student at Indiana University, Bloomington, Fogle ran a little business out of his dorm room, renting porn videos to fellow students for the bargain price of $1. (When contacted by gossip site TMZ about this, a Subway spokesperson denied having any knowledge of the story and, when pressed on the issue, said Jared was "unavailable" for comment.)

The FBI has subpoenaed lewd text messages between Subway's Jared Fogle and a former Subway franchisee
The FBI has subpoenaed an affidavit containing alleged texts between former Subway spokesman Jared Fogle and a former female Subway franchisee in which Fogle says he paid for sex with a 16-year-old girl, according to the former franchisee's attorney.
The former franchisee, a woman, shared the texts and her concerns about Fogle with Subway management at the time, her lawyer says, but Subway did nothing. Subway says it has no record of the woman's complaint.
The woman's lawyer, who asked to remain anonymous, said the FBI recently subpoenaed his law office for the text message conversations, which Business Insider has viewed.
In the messages, Fogle repeatedly asks the woman — a Subway franchisee at the time — to advertise herself on Craigslist for sex with other men.
He asks her if he can watch the sexual acts and tells her she can make about $500 per act.
The messages in the affidavit, which the attorney says were recorded from the woman's phone by a court reporter in 2008 and witnessed and verified by a notary public official, span from January 2008 to June 2008. Business Insider independently verified the authenticity of the affidavit. We also verified that a phone number in the document was registered to a Jared Fogle.
The woman was apparently in a sexual relationship with Fogle at the time. She became uncomfortable with the relationship as Fogle pushed her to post listings on Craigslist and detailed other trysts, according to her lawyer.
Wendy Osborne, spokeswoman for FBI's Southern Indiana branch, would not confirm or deny that the FBI has subpoenaed the messages.
Subway suspended its relationship with Fogle, a spokesman for the brand for the last 15 years, on July 7 after federal and state authorities raided his Indiana home. It has scrubbed every mention of Fogle from its website and stores.
The raid came months after an employee of Fogle's charitable foundation was arrested on child pornography charges, and Subway said at the time it believed the raid on Fogle's home was in relation to that case.
Fox59 and CBS also reported at the time — citing law enforcement sources — that the raid was related to a child pornography investigation.
Several weeks later, Fogle still hasn't been charged. In fact, the US attorney's office — which is now handling the case — won't even say if an investigation is or isn't underway.
According to the affidavit obtained by Business Insider, Fogle asked the former Subway franchisee in May 2008 to set up a meeting for him with her cousin. The cousin was underage at the time, according to the woman's lawyer.
"When can we find a time for me to talk to your cousin?" Fogle asks in a message dated May 1, 2008.
"Any more news with your cousin?" he asks the following day. "Tell me what u think about when u think of the three of us all together???"
Earlier, in April, according to the affidavit, Fogle asked the woman, "How young would you like?... Would you want to have an adventure like that?"
On June 19, the lawyer says that Fogle again asked the woman to advertise herself on Craigslist. She responds: "Is this the same website you found that 16 year old girl you that you f*****? ...I still can't believe you only paid $100 for her."
Fogle responds: "It was amazing!!!!"
She asks: "What part of her ad made you think she was selling sex?"
He says: "U will have to read them to see."
The age of consent in Indiana, where Fogle is resides, is 16 years old.
Fogle's attorney, Ron Elberger, who has been quick to respond to questions in the past, has not responded to calls and emails from Business Insider about the text messages.
The woman, who initially met Fogle at a Subway function, grew uncomfortable with the conversations over time and hired a lawyer — the same lawyer that Business Insider has interviewed — to determine whether the communication violated her franchiser-franchisee contract with Subway.
That's when the messages were extracted from her phone.
The woman reported the communications to Subway, her attorney says. Subway determined that no violations occurred, however, due to the fact that Fogle was not an employee of Subway — even though he was hired to do marketing for the brand.
The woman also contacted Subway's corporate office regarding the issue and she requested that Subway allow her to remove all marketing related to Fogle from her store, according to the lawyer.
She met with two levels of management, shared the messages with them, "and specifically requested not to have his imagery and merchandising related to him in her stores," the lawyer said. "She also specifically warned them that he should not be interacting with young people."
Subway continued to use Fogle in national advertising campaigns until the FBI raid on his home earlier this month.
When reached for comment, Subway said, "We have no record of this allegation."
A former journalist separately came forward earlier this month claiming that Fogle made inappropriate remarks to her about middle school girls.
Florida ABC affiliate WWSB reported: "According to the woman, Jared would often visit schools in Sarasota County, and allegedly told her numerous times that, 'Middle school girls are hot.'"
The woman, who asked to remain anonymous, claimed Fogle also made other remarks that made her uncomfortable, but she didn't go into detail on those conversations.
"They weren't jokes. They were very serious," she told WWSB.
The woman said she contacted the FBI about the comments and was later asked to wear a wire and record conversations with Fogle, according to the report.
Responding to the claims, Fogle's attorney, Ron Elberger, previously said "the story is a fabrication that lacks credibility."
Fogle first rose to fame as Subway's spokesman 15 years ago, after losing more than 200 pounds by eating their sandwiches. He has a net worth of $15 million, according to the New York Daily News.
Subway's decision to suspend its relationship with Fogle marks an end to the chain's most lucrative endorsement deal.
The company's chief marketing officer told the Daily News that Fogle is likely responsible for one-third to one-half of Subway's growth in the past 15 years.
In addition to his work for Subway, Fogle also started the Jared Foundation, a charitable group aiming to help children develop better eating and exercise habits.
Russell Taylor, the former executive director of Fogle Foundation, was arrested two months ago in Indianapolis on federal child-pornography charges following an April 29 FBI raid of his home.
More than 400 videos of child pornography were found in his possession, according to court documents reviewed by Business Insider.

Former Subway spokesman Jared Fogle reportedly has struck a plea bargain over federal charges, Indiana media reported Tuesday.

Sex at The Ritz Carlton and The Plaza Hotel!!
Fogle to Plead Guilty to Sex Acts With Minors, Child Porn
Longtime Subway pitchman Jared Fogle has agreed to plead guilty to allegations that he paid for sex acts with minors and received child pornography that he knew had been secretly produced by the former director of his charitable foundation, federal prosecutors said in court documents released Wednesday.
The agreement filed ahead of an expected court appearance by Fogle said he agrees to pay $1.4 million in restitution to 14 minor victims, who will each receive $100,000. Fogle will also be required to register as a sex offender and undergo treatment for sexual disorders.
The government has agreed not to seek a sentence of more than 12½ years in prison, and Fogle has agreed not to ask for less than five years, according to the documents, which say Fogle will plead guilty to one count of traveling to engage in illicit sexual conduct with a minor and one count of distribution and receipt of child pornography.
The Associated Press left messages seeking comment with Fogle attorney Ron Elberger.
Federal prosecutors allege in the documents that the married father of two traveled to pay for sex acts, including with minors, from 2007 until as recently as June and that he repeatedly planned business trips to coincide with his sexual pursuits.
On Nov. 3, 2012, Fogle allegedly paid a 17-year-old girl who he had found online to engage in sex acts while he was staying at the Plaza Hotel in New York City, according to the papers. Several months later, he again paid her for sex acts while staying at the Ritz Carlton Hotel, according to the document, which says the girl told Fogle her age when they first met and that he knew she was a minor.
After the first meeting, the document said, Fogle texted the girl and offered to pay her a fee if she could find him another underage girl to pay for sex acts.
During these discussions, Fogle "stated that he would accept a 16-year-old girl, while stating that the younger the girl, the better," the document said.
Between 2011 and 2013, Fogle also repeatedly sent text messages to other escorts, "soliciting them to provide him with access to minors as young as 14 to 15 years," the document said, adding that he would only make such requests after engaging in sex acts with the escorts to "insure that they were not undercover police officers."

His Remorse is that he got caught.....In MHO
Jeremy Margolis, Fogle's attorney, said when Fogle pleads guilty he will have taken responsibility for his actions.
Fogle, Margolis said, "expects to go to prison" and "expects to make amends."
As part of the deal, Fogle agreed to pay each of his victims $100,000 for a total of $1.4 million.
In a written statement, Margolis added: "Jared understands that he has hurt innocent people, vulnerable people, and his family. He has expressed remorse to me and to his loved ones, and will, when given the opportunity, express that remorse to this court and to the people he has harmed. His intent is to spend the rest of his life making amends."

Jared's Family issues statement regarding son’s ‘criminal behavior’
Fogle’s family issued this statement following his court hearing:
“Our family is shocked and profoundly disappointed in Jared’s abhorrent criminal behavior and we are very concerned for the well being of those affected by his conduct. At the same time, we are gratified that Jared is accepting responsibility for what he has done by agreeing to plea guilty to the charges filed today and by volunteering to make restitution to the victims. We are also gratified that he is seeking medical treatment. We hope that he will become healthy again and are confident that after he serves his sentence, he will continue to make amends. We look forward to the day that he rejoins our family and society.
We will not be granting any media interviews. Our plan is to comfort each other and heal and we ask that the media respect our family’s privacy during this very difficult time.”

Medical problem?.....sounds like it's more of a morality problem!
Fogle "knows that restitution can't undo the damage that he's done, but he will do all in his power to try to make it right," defense attorney Jeremy Margolis told reporters.
The married father of two, he added, has a "medical problem" and "expects to get well," but he did not elaborate.

Between 2011 and 2013, Fogle also repeatedly sent text messages to escorts, "soliciting them to provide him with access to minors as young as 14 to 15 years," the documents said, adding that he would only make such requests after engaging in sex acts with the escorts to "insure that they were not undercover police officers."

A reporter says Jared Fogle asked her to put hidden cameras in her children's rooms
Interview (VIDEO) between Anderson Cooper and Rochelle Herman on this link
When Rochelle Herman first heard Jared Fogle's alleged off-color comments about young girls, she was so disturbed, she knew she had to do something, she said.
She recorded conversations with him for the FBI.
Fogle, a pitchman for Subway at the time, was attending a health event at a school in Florida in 2007 when the incident occurred, Herman said. She was covering the event for a local station when Fogle made a random comment.
"He told me that he thought middle school girls were so hot," Herman said. "I was in shock ... I actually was questioning, 'Did I really just hear what I think I heard?' I looked over at my cameraman ... and he was just astounded," she said.
Herman saw Fogle numerous times over the years, and his comments and admissions got more brazen, she said.
"He talked about sex with underage children," she said. "It was just something that he really, really enjoyed," she said.
Herman said she notified law enforcement authorities, and the FBI asked her to wear a wire to record her conversations with Fogle.
For years, she said, she worked undercover with authorities to gather evidence against Fogle.
"He trusted me for unknown reasons," Herman told CNN's "AC360." "He had said to me numerous times over the course of years about having sex with minors."
He got so comfortable with Herman, she said, he included her children in their conversations.
"I had two young children at the time, and he talked to me about installing hidden cameras in their rooms and asked me if I would choose which child I would like him to watch," she said.
'I had to play a role'
Although she was horrified by his suggestion, she focused on gathering evidence to put him behind bars.
"During the time that I had with the FBI, I had to play a role. I had to play a certain part in order for Jared to be able to trust me and talk further into detail," she said.
The U.S. Attorney's Office in Indianapolis, where Fogle was based, said Herman's information was part of the federal investigation into the former pitchman.

Subway Re-Launching Investigation into Complaints Against Jared Fogle
Subway is re-launching its investigation into how much the company knew, if anything, about Jared Fogle’s improprieties, according to a statement sent by the company to PEOPLE earlier this week.
"When we first heard about an alleged complaint being made to the company about Jared Fogle, we immediately investigated and found no record that this was ever brought to our attention," Subway told PEOPLE in statement on Monday. "When we heard about the possibility of a second complainant, we began an investigation that is ongoing."
The first allegation of a complaint was made by a former Subway franchisee, who said she reported her concerns to Subway in 2008 after Fogle sent her texts allegedly saying that he paid a 16-year-old girl $100 for sex and also seemed to be interested in a kinky encounter with the woman and her underage cousin, according to a Business Insider report.
In an earlier statement to PEOPLE, Subway said: “We have no record that this alleged complaint was ever brought to our attention. Had it been, we would have taken immediate action.”
The second alleged complaint – which compelled Subway to re-open its investigation – was made several years ago by Rochelle Herman of Sarasota, Florida, who said that she also had tried to inform Subway about Fogle in 2010 or 2011, using the company's online comment form.
"I stated that Jared Fogle made inappropriate sexual remarks about my children," Herman tells PEOPLE. She was hoping to prompt an internal investigation of Fogle, she said.
She received a notification that the comment went through, but received no other response, she said.
"It's really a disturbing story," Herman told PEOPLE. "He wanted me to put cameras in their room," she said of her daughter then about 12, the son then around 13. "There's not even a word in the dictionary for how horrible it was."
Fogle's attorney, Jeremy Margolis, did not return a call for comment as of press time.
Fogle, 37, has admitted to having sex with at least two underage girls and to obtaining child pornography of 12 other children as young as 6 years old. He is scheduled to formally plead guilty in an Indianapolis federal courtroom on Nov. 19 and faces 5 to 12 1/2 years in prison.

Jared Fogle's Charity Reportedly Never Gave Out Any Grants
Former Subway pitchman Jared Fogle's charity was billed as a multi-million dollar effort to combat childhood obesity when it was launched in 2008, but it never gave out a single grant.
The Jared Foundation gave most of the money it did spend to its embattled executive director, Russell Taylor, USA Today reported.
The charity was supposed to shell out $2 million a year to schools and community organizations. But the foundation spent an average $73,000 per year from 2009 to 2013, USA Today reported, citing the organization's tax records. Sixty percent of that went to Taylor, and 26 percent is unaccounted for.

How a rare sniffer dog was Jared Fogle's undoing
There are only five dogs in America trained to sniff out electronic devices, and one of them played a major role in Jared Fogle's downfall. Bear, a 2-year-old black Labrador, was able to sniff out a thumb drive that human investigators missed during a search of the former Subway spokesman's home last month, reports NBC News, which describes Bear as a "porn-sniffing dog." He can detect tiny memory cards easily and was trained with methods associated with "any other K-9 training, like with the narcotics or explosives or anything," his trainer tells WISH-TV. "You get the dog used to the odor and reward them as they indicate on it."
The lead prosecutor on the Fogle case tells NBC that Bear is a "key part of the team," though he doubted the pooch's abilities at first. "I thought I was being punked, but it does work," he says. The evidence, along with that was gathered by an FBI informant, helped secure Fogle's guilty plea on child-porn and underage sex charges. Bear has been a busy dog: NBC reports that he also played a role in the arrest of Olympic gymnastics coach Marvin Sharp. Bear's trainer, a deputy fire chief, sells dogs to law enforcement agencies when their training is completed, and Bear will soon be on his way to Seattle, where the police department contacted the trainer after hearing about the Fogle case.

Shame on Subway........the didn't want to risk losing their Cash Cow (Fogle)
A former franchisee alerted a Subway advertising executive in 2008 about her concerns about pitchman Jared Fogle, according to her lawyer.
Cindy Mills exchanged phone numbers with Fogle after they met at an event, said Robert Beasley, a lawyer in Florida who represents Mills. After Fogle began talking about paying for sex with minors, the lawyer said Mills alerted a regional Subway contact in Florida where her stores were based.
Later, he said Mills alerted Jeff Moody, who was in charge of the Subway Franchisee Advertising Fund Trust, which handles the company's marketing.
Subway did not respond to a request for comment late Thursday. The company has said it does not have a record of the complaints about Fogle by the former franchisee, which were previously reported by Business Insider. The publication initially kept Mills' identity anonymous at her request, but identified her on Thursday. It also identified Moody as the Subway executive she alerted.
Beasley said Mills became comfortable about coming forward after Fogle agreed on Aug. 19 to plead guilty to allegations that he paid for sex with girls as young as 16 and received child pornography. Mills was not immediately available for comment Thursday evening. But according to Beasley:
Fogle told her about paying for sex with minors on a trip to Thailand, and paying for sex with a 16-year-old he found on Craigslist.
She offered to show Moody the texts from Fogle, but Moody stopped her and said he didn't want to hear anymore.
Moody said he had dealt with similar comments, and reassured Mills that Fogle had met a teacher who would get him on the right track.
"To me, it was confirmation that they knew about it," Beasley said.
Beasley said Mills explored the idea of suing Subway, but that there is a "good bit of legal separation between Jared and Subway." Beasley said the company is structured in a way that insulates it from Fogle.
Phone numbers listed for Jeff Moody and Theresa Moody, who is listed as a property co-owner, were not answered Thursday. When reached by The Associated Press earlier this week, a woman who identified herself as Theresa Moody said Jeff Moody did not want to speak about the Fogle case.
Jeff Moody is currently CEO of Rita's Italian Ice, according to LinkedIn. Between 2007 and 2011, the site says he was CEO of Subway's franchise advertising fund, which is described as a company that handles marketing for the global Subway brand.
The agreement with Fogle released by prosecutors last week said Fogle will pay $1.4 million in restitution to 14 minor victims, who will each get $100,000. The document noted that the payments would not prevent any victims from pursuing civil litigation.
The government agreed not to seek a sentence of more than 12 1/2 years in prison, and Fogle agreed not to ask for less than five years.
The same day authorities announced the deal with Fogle, Subway said it had ended its relationship with its pitchman of 15 years. The company has also said it's investigating a second claim, made by a former journalist, that it was alerted to concerns about Fogle.
When prosecutors charged Fogle on Aug. 19, Assistant U.S. Attorney Steven DeBrota said that there were no charges or allegations at that time that anybody at Subway knew what Fogle was doing.
Fogle attorney Ron Elberger declined to comment Thursday. Tim Horty, a spokesman for the U.S. Attorney's office in Indianapolis, said the office cannot confirm the names of any of the sources the government used in its investigation of Fogle.

More from Cindy Mills
Mills says Fogle admitted to her that he'd had sex with minors, telling her about trysts with child prostitutes between the ages of 9 and 16 years old in Thailand and the US.
Mills previously told Business Insider that Fogle allegedly tried to get her to sell herself for sex on Craigslist. When she first spoke with us, she requested anonymity. She said she didn't want more press attention at the time. But now that Fogle's case has been exposed, she says she feels comfortable using her name.
Mills says she shared this information with Subway in 2008 but that the company ignored her complaints. That's when she decided to hire a lawyer.
"I thought, 'This man has a lot of money. Subway has a lot money. They have made each other a lot of money,'" Mills said. "I was worried. I was scared to death."
She asked her lawyer, Robert Beasley, to explore legal action against Subway for a potential breach of the franchiser-franchisee contact.
But Subway couldn't be found culpable, Beasley said, because Fogle wasn't an employee of Subway. Fogle was employed by the Subway Franchisee Advertising Fund Trust, or SFAFT.
SFAFT, which is in charge of Subway's global marketing, is legally viewed as a separate entity from Subway — even though it shares the same address as the company headquarters.
"They have pretty well isolated themselves from Jared's acts," Beasley told Business Insider. "We couldn’t find an avenue to pursue where it would connect his acts and statements to any legal liability to Subway. Combine that with [Mills'] unwillingness to get out in public and say this and you end up staying silent."
Subway didn't respond to a request for comment on this story.
The company said Wednesday that Subway is investigating whether executives knew about Jared Fogle's sexual interest in children it is investigating whether executives were aware of Fogle's interest in children.
Mills says Moody cut her off in the middle of the conversation, saying, "Please don't tell me any more."
He indicated that he had dealt with similar complaints in the past, according to Mills.
"He said, 'Don't worry, he has met someone. She is a teacher and he seems to love her very much, and we think she will help keep him grounded,'" Mills recalls.
Mills says she didn't drop the issue after her alleged conversation with Moody.
She says she also contacted a regional Subway manager tasked with making sure franchisees have all appropriate signage and advertising in their stores.
Mills says she asked the manager — whose name she couldn't recall — if she could remove all Jared Fogle signage from her store.
"Every time I would see him on TV in a commercial with his arms around these children, it would kill me," Mills said. "I couldn’t stand it anymore."
Mills says her request to remove Fogle marketing from her store was denied.
Mills says she went on to share her concerns about Fogle with two additional SFAFT executives at a Subway-sponsored NASCAR event in Phoenix, which she attended with her stepson. She'd won tickets to the event because she was a franchisee.
Mills said she was terrified that Jared might show up. She says she pulled two SFAFT executives aside and told them everything. They assured her that Fogle wasn't scheduled to attend the event.
When asked why she never went to law enforcement with her concerns, Mills said it was because she was terrified of Fogle's money and influence. She says she was also concerned about her job with Subway.
"I thought, 'No one is going to believe me, he looks like the all-American boy' — but he's not," she said.
Mills says the last time she saw Fogle was at Subway's annual convention in 2011, held in San Francisco that year.
Mills was seated in a giant ballroom at a dinner with hundreds of guests when she spotted Moody and Fogle walking toward her, she recalls.
They took a seat next to each other at the table beside hers, according to Mills.
"I felt so uneasy," Mills said.
Not long after, Mills sold her Subway franchises and got out of the business.
She says she decided to come forward with her story in hopes of inspiring others at Subway with information about Fogle's past to come forward as well.

"The Little Men's Club"
In 2007, Jared Fogle and a small group of men were sharing stories in the VIP section of a local Indy bar.
Among those men was Fogle's close friend and foundation director Russell Taylor. The content of those stories: The men's sexual exploits – especially their trips to Thailand.
Dubbed by themselves "The Little Men's Club," the group would often meet at a Broad Ripple bar between 2007 and 2009.
According to a source, who spoke on condition of anonymity with Call 6 Investigator Rafael Sanchez, Fogle would often travel within the U.S. with a member of the group to watch his back and keep him out of the media.
"Very few outsiders and, umm, you know, they'd hang out together and they had these common interests that they were all, you know, exploring together. And that was their thing," the source said. "And when it's a small group of people, you have more control over what gets out, who talks about what and whatever. And it's probably in their best interests for none of them to talk."
Members of the club attended Fogle's annual Labor Day barbecues at his Zionsville home.
The source said there was a hope that when Fogle got married in 2010 and started having children things would change.
"I feel like I was duped," they said. "I even defended him early on in all this, and for the truth to come out now, you know, I feel let down and I feel I was made a fool of. I bought his image."

Trying to protect their Cash Cow
Subway: Review Finds 'Serious' Complaint About Jared Fogle
The Subway restaurant chain said Friday it received a "serious" complaint about Jared Fogle when he was the company's spokesman but that the complaint did not imply any criminal sexual activity.
The company announced in a statement that it has completed an internal investigation into whether it was alerted to concerns about Fogle, who agreed last month to plead guilty to allegations he paid for sex acts with girls as young as 16 and had received child pornography. The company has severed its ties to him.
Subway's investigation included a review of more than a million online comments and interviews with past and present employees and managers with both the company and an advertising fund, the statement said.
Subway spokeswoman Kristen McMahon said the company received the "serious" complaint in 2011 from former Florida journalist Rochelle Herman-Walrond, who says she worked with the FBI to record Fogle expressing interest in sex with minors. The company's statement said that while the complaint "expressed concerns about Mr. Fogle," it included "nothing that implied anything about sexual behavior or criminal activity involving Mr. Fogle." McMahon would not elaborate on the nature of the complaint.
Nevertheless, the company said it regrets the complaint was "not properly escalated or acted upon," according to the statement.
"It is important to note that the investigation found no further evidence of any other complaints of any kind regarding Mr. Fogle that were submitted to or shared with SUBWAY," the statement said.
Telephone calls by The Associated Press to Herman-Walrond seeking comment on Subway's statement were not immediately returned Friday night. Fogle's lawyers also did not respond to requests for comment.
It's unclear how Herman-Walrond knew Fogle, who lives in suburban Indianapolis. Authorities in Indiana would not say whether she was part of their investigation into him. But Fogle's plea agreement mentions that witnesses in Florida, Georgia and Washington state provided recordings and information it says show Fogle "repeatedly discussed with them his interest in engaging in commercial sex acts with minors or stated that he has done so in the past."
Separately, a lawyer for former Subway franchisee Cindy Mills said she alerted an executive in charge of the company's advertising in 2008 after Fogle began talking to her about paying for sex with minors. The attorney said Mills also shared her concerns with a regional Subway contact in Florida, where she is based.
The executive, Jeff Moody, has denied being aware of Fogle's criminal sexual conduct. The company has said it does not have a record of any complaints by the former franchisee.
Attempts to reach Mills' attorney on Friday were unsuccessful.

Rochelle Herman-Walrond
There’s a Tampa Bay area connection to the Jared Fogle story. The former Subway pitchman pleaded guilty to having sex with minors and it was a Sarasota woman who helped the FBI bring him to justice.
Rochelle Herman-Walrond is a former journalist who met Jared Fogle around ten years ago.She interviewed him on her radio and television programs, and the pair worked together at charity events. The two became friends.
“I thought he was a nice guy. I thought he was a nice guy with a great story,” recalled Walrond.
But soon it all changed when he said a crude remark during a school event. She said, “He told me how hot middle school girls were.”
Over time, Fogle would spontaneously describe his sexual encounters with children. Walrond said, “Gender didn’t make a difference to him, the younger the better. And then when indicated what age are you mostly interested in, seem to be around age 11.” She added, “I think he’s a monster.”
She doesn’t truly know why he opened up to her. “I think he was trying to see if I would be interested, he felt very comfortable with me,” she said.
Truthfully, Walrond was horrified and approached the FBI. She said for four years she secretly recorded conversations with him, playing along to see what he would say. “He had a lot of these sexual fantasies with children.” She added, “He categorically listed ways that he would develop relationships with children and entice them to do sexual things with him.”
During one trip, he asked her to help him out. Walrond said, “He wanted me to arrange a party for him, a kids party.” She made up a list of children, ages 7 to 11. And he shared his true desires. “He wanted to get the children and have sexual intercourse with them.”
While working as an FBI informant, she put on a façade. But hearing these disgusting desires took its toll. She said, “After the conversations I would break down, I would cry. I had two small children at the time, and I did it in their name because I would want someone to do that for me.” “You have to put yourself in a position where it goes against your grain and against your morals but you’re doing it for the better good.”
She’s happy that Fogle pleaded guilty this week. “I feel relieved; I was very scared that he was going to get off with just child pornography charges and I’m very grateful that he did confess.” He faces up to 12 ½ years in prison. But Walrond wishes he could be put away for much longer. “I think that our laws should be changed I think he should spend a lifetime in prison, he has 14 victims out there.”
Going through this was a personal hell for Walrond. “People are raped physically, and I’m not taking anything from them. But being mentally raped year after year, day after day, it’s horrible. You can’t escape it.” She also would like to hear from him one more time. “I would like an apology because it’s mentally draining,” she said.

So.....two different woman were working with the authorities and turned over text messages and recorded phone calls. Why the hell did it take FOUR years to take this man down? I don't get it.
From up-thread ^^:
The FBI has subpoenaed an affidavit containing alleged texts between former Subway spokesman Jared Fogle and a former female Subway franchisee in which Fogle says he paid for sex with a 16-year-old girl, according to the former franchisee's attorney.
The former franchisee, a woman, shared the texts and her concerns about Fogle with Subway management at the time, her lawyer says, but Subway did nothing. Subway says it has no record of the woman's complaint.

Jared Fogle's Secret Audio Tapes: 'I Like All Ages'
10/29/2015
In audio recordings released for the first time on today's episode of Dr. Phil, former Subway pitchman Jared Fogle is heard telling a woman who posed as his confidant why they should fly across the globe for a potential sexual exploit: "It would just make things a lot easier -- if we're gonna try to get some young kids with us."
When asked by the woman, Rochelle Herman-Walrond, a former journalist who spent over four years secretly recording their conversations, what age children he prefers, Fogle responds: "I like all ages. That's the thing, I mean, I like all of them."
Herman-Walrond, who says she was cooperating with the FBI to gather evidence against Fogle, presses: "What makes it different from one age to another?"
"It depends who is ready for what," Fogle is heard saying before talking about getting children "as sexed up as we can."
Fogle, 38, agreed to plead guilty to traveling to engage in paid sex with minors and distribution and receipt of child pornography. A father of two, he is scheduled for sentencing November 19, and prosecutors are seeking a sentence of between 5-12 years in prison. He as so many before him is being slapped on the wrist by or legal system. Even if he receives the max (12 years), he'll be 50 when he's released.
In the video above, Herman-Walrond asks Fogle, "I want to know what turns you on the most: the young girls or the young boys?"
Fogle responds, "You know, both of them do." He can then be heard revealing to Herman-Walrond a potential plan for luring children, saying, "And then we get a little closer, and a little closer, and a little closer. And before you know it, it just starts to happen."
Herman-Walrond says she first met Fogle in 2006 when he was a guest on her local Florida radio show, and she immediately became concerned when he mentioned that he found middle school girls attractive. She says that following her journalist instincts, she started a friendship with Fogle to dig deeper, and she claims he continued to make comments about his sexual interest in children. She says she then contacted the FBI and spent five years "role playing" and recording her conversations with Fogle.

Re: Jared Fogle, Subway spokesman, investigated for child porn/ Child-porn plea set for ex-Subway spokesman Jared Fogle
I would feel better if he had to pay for psychotherapy for as long as the victims want/need it instead of $100,000 each. That's still money for sex.

Thanks for posting spayneuteryourpets. I'd feel better if he was required to serve time, pay for the lifelong psychological care of his victims (CHILDREN!!), and pay them restitution as well.
