Casey Anthony trial date set for May 9, 2011/ Baez makes motion to supress party photos of Casey and Cindys 911 call

ORANGE COUNTY, Fla. -- A trial date was set in the case against Casey Anthony Monday. In an order signed by Judge Strickland, Casey’s trial has been set for May 9, 2011.

Judge Strickland set a timeline for the issues that need to be addressed, including depositions of expert witnesses which need to be completed no later than September 30, 2010. The evidence must be reviewed by defense expert witnesses no later than October 31, 2010.

Casey Anthony’s defense must also list all expert witnesses she intends to call, file motions related to the forensic evidence found and reports prepared by expert witnesses no later than November 30, 2010.

Anthony has been in jail since October 2008 and faces the death penalty for allegedly murdering her daughter Caylee.

The murder trial of a Florida mother charged with murdering her 2-year-old daughter won't start until May 2011, almost three years after the toddler disappeared.

The judge in Casey Anthony's first-degree murder case set the date Monday as part of the trial's proposed schedule. Anthony's attorneys have asked the judge to move the trial from Orlando to South Florida but the judge hasn't ruled on that request.

Anthony has pleaded not guilty and says a baby sitter kidnapped her daughter Caylee. The toddler was last seen in June 2008, but she wasn't reported missing until a month later.

Her remains were found in woods near her house in December 2008 after a months-long search.

That is way, way too long. We all thought it would start this summer. That is still 14 months away!

Maybe by the time she goes to trial that long stringy hair will be like Rapunzel and she can escape from her jail cell. I'm just saying.

No Jeanne...with all the weight she's putting on...she may not be able to fit through the door, never mind a window!

Isnt that just too much about the length of time
for this trial? Speaking of her hair, how do you get a
haircut in jail? I know prison is a different thing but
can she ask for someone to at least cut it a little.
They certainly arent going to let her near a scissors!

Looks like the judge is through allowing this whole mess to drag on and on. Sortta seems the judge KNOWS where the prosecution is at this point, and figure the defense shouldn't be far behind, but I's betting it is. No doubt because of the funding. You know Jose isn't going give her any free time.

A lot can happen between now and then - we might be looking at an entirely new defense team. After all, if there is no more money, and Jose and the rest have
all milked this case for as much publicity as possible
they might all slowly bow out.

Casey Anthony's defense attorneys have filed a motion requesting that a jury never see photos of the young mother partying while her toddler was missing.
Anthony, 23, is jailed on first-degree murder charges in the death of her daughter, Caylee. Caylee was 2 years old when she was reported missing in July 2008 after being missing for a month. Her remains were found five months later.
Anthony's defense said they want Judge Stan Strickland to bar the prosecution from showing a jury photos of Anthony drinking beer and partying during the month between Caylee's disappearance and when she was reported missing.
In the motion, the defense said photos of her partying while Caylee is missing are too prejudicial. The defense also argued that photos of Anthony partying prior to Caylee's disappearance are irrelevant.
The defense is also asking the judge to prevent a jury from hearing Anthony's mother's frantic calls to 911 reporting Caylee missing and from seeing certain witness statements made by Anthony's parents, friends and detectives.
In the 911 call made by Cindy Anthony, the grandmother tells a dispatcher she wants her daughter arrested.
In the call, Cindy Anthony speculates that her daughter's car smells like a dead body. The defense argued that the comments are pure speculation and cannot be used in court.
Other comments made by Casey Anthony's parents characterize her as a liar and a thief.
The defense said these items would make a jury prejudicial and deny Anthony the right to a fair trial.
Casey Anthony's attorneys cited specific case law to argue why these pieces of evidence should be kept out of the hands of the jury. They said all the potentially prejudicial evidence has been analyzed and dissected in the media and they fear a witness will take the stand and share their own personal opinions about Casey Anthony, which is generally not allowed in court.

What! I guess I am no lawyer, but "too prejudicial"...I don't get it. These pics post-murder are relevant...they are FACT. They are the case! How can you dismiss FACT. It may taint the jury pool? Isn't the whole point to prove your case w/ facts? She never reported her daughter missing! She didn't care! She was enjoying herself---out partying!! t's a FACT!

They will request but the judge will deny, because you are right, it is relevant.

Meanwhile, Strickland signed an order scheduling the trial to begin on May 9, 2011.

Anthony's defense also recently filed a motion asking Strickland to declare Anthony indigent and have the state cover the defense's costs.

It was revealed on Friday that Anthony has already paid her defense team more than $111,000, but it was not clear where that money came from.

Anthony recently pleaded guilty to check fraud that occurred prior to her arrest on murder charges. In addition, her parents are facing foreclosure on their Orange County home.

Local 6 legal analyst Mark O'Mara said it is possible that Anthony used money from selling photos, videos or information while Caylee was missing.

"Anything that she may have had that she ended up selling to media may well have been the source of the money," O'Mara said.

O'Mara said it would not be illegal for Anthony to have profited from selling photos or videos while Caylee was still missing.

A New York law prevents people from profiting from their crimes. It was passed after the so-called Son of Sam killer, David Berkowitz, tried to profit from his crimes.

"Florida has a similar statute, but it requires you to be convicted," O'Mara said.

Gainesville mass-murderer Danny Rolling inspired the Florida law when he tried selling art and other materials he produced after he was convicted of killing five college students.

Anthony has not been convicted of murder, so the law does not apply to her.

However, the law states that even before conviction, Anthony and other accused criminals would not be allowed to pay their attorneys with money they obtained illegally. For example, an accused drug dealer could not use money earned from dealing drugs to pay an attorney.

"If it came from an illegal source, then it can be seized by the court," O'Mara said. "There's no allegation here (that) what she got was from an illegal source."

Strickland questioned defense attorney Jose Baez behind closed doors after the state questioned whether he stood to profit from any entertainment deals. At that time, the judge found that the defense, however it has been paid, has done nothing wrong.

Strickland has not ruled on the motion requesting that Casey Anthony be declared indigent, but O'Mara predicted he will approve the request, because denying it could be seen as preventing her from getting the defense she needs in a death penalty case.

Lawyers said the costs could reach half a million dollars by the time the case is over.

What in the world does "too prejudicial mean"?
The photographs are incontrovertable proof of
Casey's state of mind after her child disappeared.
How is that prejudicial? Its proof of a fact and not by
a witness testifying but from a photograph that shows her happy and dancing. As to Cindy's 911 call - again
how in the world can he try to get it excluded?

Baez is right in that these pictures might prejudice the jurors.

I cannot understand how they can suppress these photos = they are crucial to the case. Casey maintains her child was kidnapped - the prosecution
needs these photos to prove that this is not the behavior of a mother whose child has been kidnapped.
I can see if they wanted to drag in witnesses to her PAST behavior making her look like an unfit mother,
that would be prejudicial, but to supress photos of her
after Caylee went missing just doesnt make sense, at least to me.

I just heard on CNN that Baez said that the photos of Casey partying at Fusion were taken before Caylee went missing. He needs to PROVE it. Did Casey think Caylee was hiding underneath her friends skimpy outfit? Is that why she's SO close? Looking for Caylee.................

I believe that the photographer who took them can prove that they were taken afterwards

He seems to think that all "evidence" should be thrown out...... Is he going to dress Casey in a cute little blouse with a Peter Pan collar and ask the jury is this looks like a girl that could have committed this horrible crime.....case closed? My last comment was wrong. Baez actually said that MOST of the pictures at Fusion were taken before Caylee went missing. He does admit the pictures of Casey in the blue dress were taken after Caylee went missing.

Remember the frantic 911 call made by Casey's mom Cindy back in July 2008? "There's something wrong. I found my daughter's car today and it smells like there's been a dead body in the damn car," Cindy Anthony told a 911 dispatch operator. Casey's lawyers are asking the judge to throw it out so, so a jury could never hear it. The defense's argument, that there was not an emergency at the time the call was made. The defense argues that 2-year-old Caylee had already been missing for 31 days. Therefore, they argue the call is neither spontaneous or reliable.

That's not all the defense doesn't want a jury to see. Remember the photos of Casey partying? The defense says only the pictures captured of Casey wearing a blue dress were snapped during the time that Caylee was missing. According to the photographer, pictures of Casey partying in that blue dress were taken June 20-21 at Fusion night club. That was less than a week after Caylee was last seen alive.

"These pictures do not bear a single issue in this case," according to Casey's defense team. "Their only value is to paint a picture of an irresponsible, drunken, promiscuous and wild defendant." The defense states that those pictures contain "inflammatory imagery that would unfairly prejudice Miss Anthony before a jury."

The defense also asks the judge to throw out all "hearsay" statements between Casey's friends and family. The defense categories those into hearsay that would categorize Casey Anthony as a thief, a liar or a bad mother.

The defense has asked that the state respond to these motions within one month.

Ha! Well even that one picture will damage her
because it shows that she was not concerned at all
about her child within one week she was missing.
Its true, you can tell from the length of Caseys hair
that some of those pictures were taken before, and I dont think the prosecution really needs them. However
they are out in left field on the 911 call - not an emergency? It seems that Baez and company have
decided to start throwing out whatever they can and see if something sticks against the wall. IMO, they
really have no credible explanation of Caseys behavior that would satisfy a jury and they know it so they will
try to get whatever they can to supress. But they really are sunk.

I just read through Baez's motions and (guess what?) I disagree with most of his points. Sindy's 911 calls were "spontaneous utterances" in my opinion. Even though her call was made 31 days following KC's claim that Caylee was kidnapped, Sindy had just found out about this.

As to the photos taken before Caylee's murder, I agree they aren't relevant and are possibly prejudicial. I don't, however, think that the prosecution planned to use these anyway. The photos at Fusion taken while Caylee "was missing" do show KC's state of mind and her motive. She wanted to party, not be a mom. I believe these shouldn't be suppressed.

Im watching NG and they are talking about the Haleigh Cummings case and showing Misty in her jailhouse tapes - talk about prejudicial! Misty has admitted on these tapes for all the world to see
that she sold drugs and they have video of her selling the drugs and she pled not guilty! Arent these tapes and videos "prejudicial" to poor poor Misty? Nope
they are what we used to call proof!

We once discussed the implications if Cindy and Casey had an argument the night before LE thinks Caylee died.
Bringing up that this could be considered the probable cause for Caylee's murder.
We heard this for only a short time and then the Anthony's started raving on that no such event ever took place.

One of the things that Baez wants suppressed is Lee Anthony's sworn statement that a physical confrontation happened between his mother and sister, the 15th, Father's Day evening.
Those people were sayen alot in the beginning... before they all started lying to protect Casey. Adding insult to injury they sell Caylee's pictures to pay for her mother's defense.

As far as those pictures are concerned if they have pics of KC before and after Caylee was born they can say look "She went right back to partying like she was doing before she had a baby." She wasn't searching in anguish for her kidnapped baby.

Cindy's voice during that 911 call, sounded like she seriously believed that some unheard of Nanny had taken Caylee. More proof... what a diabolical and successful liar Casey Anthony is. I've said it before and I'll say it again,
KC got away with lying to her daddy the cop and her over bearing mother so many times she figured she could lie her way out of murder too.
