Casey Anthony defense -strategy of diminished capacity?

This new lawyer specializes in medical testimony - I was thinking about this and
LKB specializes in "forensic" testimony. As there was no soft tissue discovered
on poor little Caylee's remains, then when would medical testimony come in unless describing the effect of the duct tape and how it could kill someone if placed as it was on the skull? Im not sure. However is it possible this attorney might have been brought in to question doctors about a persons diminished capacity and how that might mitigate a death sentence? Lets face it, Casey's lawyers really have no defense and they know it. The nanny store isnt even going to be used as no one in the world is going to buy it and it would be torn to shreds by the prosecution. How
to defend her? By attacking the physical evidence and maybe some witnesses
stating what a great mother she was? I dont think any of that is going to fly
and it seems that they are stating that if she is found guilty they will present a diminished capacity defense. With all those pictures of her partying and the witnesses who will state she was having a wonderful time after Caylee's death
I dont think thats going to go over either.

ORLANDO, Fla. -- In court papers filed on Thursday, a new member of Casey Anthony’s defense indicated she would be entering the case as co-counsel, not just in a limited capacity as earlier stated.

Ocala attorney Dorothy Clay Sims filed paperwork on Wednesday indicating she would only be cross-examining expert witnesses.

Sims travels the country advising plaintiff players on aggressively cross-examining defense medical experts. She also has a business that allows lawyers to get real time feedback via the Internet while defense doctors testify.

“When it comes to cross examining psychologists, psychiatrists and medical doctors she brings a lot to the table and is definitely an asset,” said Orlando defense attorney Richard Hornsby, who is not connected to the case.

Hornsby said Sims could help spare Anthony’s life in the penalty phase of the trial.

If Anthony is found guilty, Hornsby said that the defense may present expert testimony saying that she was suffering from some sort of diminished mental capacity.

“The fact that Casey has had a psychologist or psychiatrist visit her in jail suggests the defense has their mental health mitigators in place, but they won't file their notice until the last minute,” Hornsby said.

The state gets to have its own psychological experts examine Casey and offer testimony in the case, subject to Sims cross examination.

Yep...they will probally go w/ untreated mental illness, such as PPD or bipolar illness. Having a controlling mother as CA. Hence, the "ugly coping" afterwards. They will say she went into a fugue state--she was out of touch w/ reality. That along with her claims of having been sexually abused as a child. Their goal will prob. be to spare her life.

Well that explains why she has been brought in to this case. Should this post be merged with the other one talking about a new defense attorney?

Casey is what 24 now? As long as she gets at least
40 years I will be ok with it. I actually would rather have her get a long sentence than death.

artgal I am with you. But in my own words death is to good for KC. As long as her sentence keeps her locked up until she is too old to ever have babies again I can live with that. 40 or 50 yrs should help her untreated mental illness.

I think today Yuri Melich is being deposed. That will probably be fun. The reason I got interested in this case was because of the day I saw Casey bring brought into court in that blue hoodie. It was the expression on her face that I wont ever forget. There was no fear, no grief, no sadness, or even outrage that she was accused, but instead one of arrogance and annoyance that she was being brought in. I thought, this, from a twenty year old? Who acts like that?
Ill never buy she didnt know what she was doing - Casey knew exactly what she was doing.

LM, up to you. We have so many thread on this case I often wonder if it matters. I know we try to keep things organized.

I saw on JVM that Melich WAS deposed today. Bozo can depose until he is blue in the face for all I care.
