McCOOK, Nebraska -- The 19-year-old Bartley, Nebraska, man accused of killing a McCook girl in January has been deemed mentally incompetent to stand trial.
Red Willow County District Judge David W. Urbom Monday committed Stathis Kirkpatrick to the Lincoln Regional Health Center for mental health treatment until he is considered competent to stand trial for the murder of 14-year-old Kailee Nichole Clapp.

Kirkpatrick's defense attorneys earlier this month cited a recent psychological examination indicating that Kirkpatrick was not competent to stand trial.

What is wrong with him?

I sure hope they know what they're talking about, otherwise this kid just might get away with murder.

I would like to know the diagnosis too. I wonder do all states have the criteria for "not fit to stand trial" or "legally insane"? Seems like in any event it will always be a matter of opinion, even if the opinion is by a professional.

The other thing is that they said that they have to wait
until he becomes competent to stand trial. So he has a temporary insanity and they feel he is going to "recover"?

The extended family of Stathis Kirkpatrick, 18, accused of the first-degree murder of Kailee Clapp, 14, is speaking out to NTV, saying Kikpatrick has struggled mentally for a long time.

Early Life and New Mexico

Born in California, Kirkpatrick moved with his mother to Truth and Consequences, New Mexico, at a young age.

Before his third birthday, his aunt—Christine Scott of McCook—said he became a key witness in an investigation. "I had a little girl that was five months and three days old that was beaten to death by a babysitter," recalled Scott. "[Kirkpatrick and his cousin] were there when it had happened. To this day, it affects my son, and it affects Stathis."

Kirkpatrick was taken into custody by HHS, but three months later, was able to move back with his mother. His family says he developed post traumatic stress disorder, and was diagnosed with ADHD and bipolar disorder as well.

Years passed, and living in Las Cruces, New Mexico, Scott said Kirkpatrick was accused of rape. "Accusations were held against him in New Mexico stating that he had raped a girl. There was no evidence of him ever raping anybody," said Scott.

Moving to Nebraska to Get Help

Extended family said problems were increasing in Kirkpatrick's home with his stepfather—and troubles grew in his mind, they said. Kirkpatrick decided at age 18 it was time to move to Nebraska to live with extended family in Bartley.

"He came out here to get help," said Scott, "to get a closer-knit family that stood by him, because we knew he needed help."

His family says he now suffers depression and has blackout periods. Scott insists they are not caused by drugs, despite use of prescriptions and marijuana. Wanting to give him help, his grandmother of Bartley took him to to counselors and hospitals all over the state of Nebraska.

"We took him to the doctors and kept taking him to the doctors," said Scott, "and it made my mother go broke!"

But being 18, he was able to check himself out of mental hospitals, such as Richard Young of Kearney, when he felt they weren't helping.

Family/Girlfriend: Shocked and Confused; Supporting Kirkpatrick

Although his family said he suffered major meltdowns and paranoia, they said he had never had any violent tendencies. Kirkpatrick's girlfriend—Ashlee Garcia, 16—said she did not know Kailee Clapp and would like to clear her name of rumors stating she was involved in Kailee's death. "All I know is her face," said Ashlee. "I don't know where she lives; I don't know her phone number."

Ashlee is left with questions. "Why wouldn't it have been me?" she said. "He would've had chances over and over and over again. I would go to his house and it'd just be me and him. He would've had plenty of chances to do it."

"I really don't know what to believe, honestly," she said, when asked if she thought Kirkpatrick was guilty of murder.

Shocked and confused, Kirkpatrick's cousin, aunt, grandmother, and uncle, said they agree with Ashlee. "We are there," said his grandmother, Sharon DeValencia, "we're not defending Stathis [on his charges]; we're not saying he did do it, we're not saying he didn't do it," she said.

Through their tears they gave kind words to the family of 14-year-old Kailee Clapp, but no matter what anyone says, their love for a struggling 18-year-old won't go away.

"How can you love a monster like that", DeValencia said she's heard scoffers say, "where he's put you into shame?"

"We can't let our children walk alone no matter what they've done" is her response.

"You can't just shut love off," said Scott.

"You don't leave the people you love," said Ashlee. "You don't stop loving them because of something and you really don't leave them when they need you the most."

Ashlee Garcia said she has dropped out of alternative school and lost all of her friends over rumors and ridicule related to staying Stathis Kirkpatrick's girlfriend.

That is a haunting and sad story, it does add another dimension.

by my user name u should all realize i am kailees sister and im have every truth most of the news is wrong and some of is the truth i am here to tell the truth. i was there from begging to well i guess its not the end but i will be there until this murder has been put away where he belongs. They tell us this is going to be a long battle but my little sister WILL recive her justice.

i can only tell so much right now cause the information i have has to be held secret and i need to keep it that way until this trail is over. I can tell u some things and i can tell you everything up to that night. so here it is....Its thursday january 20th i pick my sister up from school and we go home, kailee loved to eat and eatting out was her favorite and eatting at my job was the best she would always get the same thing. Well on our way there my car broke down and i had to call some family to help, they couldnt get it fixed so now we had to use my moms car. We got to the restuant and kailee asked me"how do u know ur in love karen" i told her that u just know,that somthing inside feels differnt" She told me she was in love with her boyfriend Wesley. I smiled and was extremly happy for her. As sisters we fought all the time maybe even more than normal sisters fight but that night we got along not even one aguement. We got done eatting and i took her home and i went to my bfs house. My curfew was 1030. I got home looked in my sisters room the only light that was on was the glow of her ipod. i told her i was taking the dog upstairs with me and she said ok, i told her goodnight and went upstairs, i didnt even get to tell her that i loved her that night. In the morning i woke up at 630 to get ready for school, then laid back down until 7 when i wake kailee up to get ready for school. I walked into her room and she wasnt in there, it was like she made her bed, i looked under the covers and the only thing that was there was an ipod charger cord, i opened the door to the blackness of the bathroom but when i turned on the light she wasnt there eaither. I opend my moms door and asked her if kailee was in there with her because kailee didnt like the dark and somtimes kailee would sleep with mom. She said no and thats when we took action. From then we had a search party every little thing we heard we went until we found it to be a rumor. Lunch came no kailee, we had a bunch of people at our house. Trying to tidy up my mom and a few other ladies helped my mom take out the trash, thats when we discorverd the blood in the alley. Everyone thought kailee had run away but who runs away with there pjs on and slippers without packing a bag and no food with them expecailly my sister plus i knew she wouldnt what girl would run away after telling me she was in love. Supper was cooking and a guy drove through our alley and somthing was sparked in everyone a bunch of guys jumped in a truck after him, the next thing we heard was it was a stathis guy and he had went to the police station. It got dark, hours after supper why wasnt kailee comming home? Mom took me into another room and told me that they had found a body, thats when deep down i knew she wouldnt be home. i went into her room and cried for at least an hour. It was 1159pm when the police arrived at our house, with a crowed of people they had to move away from them and took me my dad and mom a few yards away, thats when they told us that my sister was"decesed" they told us they needed her dental records to comfirm it was her, but in my heart i knew it was her 1200am Offically january 22nd my 18th birthday we had to tell my family that kailee was found dead and burned.

now after reading this please feel free to ask questions some questions cant be answered but i will try my best to answer any

Once again im so sorry. That is one of the saddest things Ive ever heard. First of all never doubt your sister loved you or that she knew you loved her. Thats a sister thing!

I guess one of the biggest questions I have is how did he know Kailee? I just dont see anything like this being random. Also is there any indication his girlfriend knew or was involved?

If I ever ask anything you feel uncomfortable answering just say so. I would never want to make you feel uncomfortable!

kailee and stathis were mutal friends the thing about kailee was that she didnt care what someone looked like or what their rep was she always always found the good n everyone, last year kailee had a little crush on him and then she didnt like him like she liked had thout she would but she continued to be his friend but when kailee told stathis to leave her alone he did there was no stalking no asking her to be with him he moved on with ashlee. I am almost certin that ashlee has nothing to do with this i even think she knows less than all of us do i think she is blinded and confussed. And to clear this whole thing about her not knowing kailee she did trust me we went to the same youth group with her and i ve known ashlee for somtime now. i dont know her personally but everyone knows everyone here.

OMG yours and Kailee's story just broke my heart! You have been thru' things that most of us don't ever have to go thru' in a lifetime. I am so sorry. How is your Mom doing? I can't imagine losing my child and in such a horrible way. What a good sister you are, following this thru' to the end and I so think that the end should be that Stathis being locked up for the rest of his life.
This whole trial deal must be so hard on you and your Mom and of course the rest of your family, I don't know how any of you get thru' the day..... I'm sorry that Stathis had a bad life but that does not excuse ending someone's life and especially the way he ended Kailee's. Has his parents accepted the fact that he brutally murdered your sister? My mom is strong she has her days but with the family helping a a BIG help from God we have held in there yes this the hardest thing i will ever have to go through, but i did it not on my own with kailee still by oursides and god nothing really can defet us. I agree with u my brother has the same stuff going on as stathis he is almost identical from stathis but my brother dont use his illness as a crutch and my brother could never kill someone i agree with you a bad life dosnt excuse from taking my innocent sister.This whole ordeal has made our family come together and it has also touched so many ppls lifes in a positive way. I think the family has and hasnt accepted that he killed my sister i think that they know he did it but i think they dont understand that he needs to be punished and locked away. Well for those who are spirtual pray pray and more pray for those who are not just keep her alive tell others about what happend maybe help someone out, or just simply judge less then we all know we do, thats what my sister did , i really just hope people dont forget that this could happen anywhere at anytime .

Good questions Nitespinr. It sure seems like the girlfriend was behind or involved in what happened to Kailee.

1st question-no he did not come into my house kailee had a door in her room that went outside, when i was looking around her rooom that morning it was slightly open which told me she thought she would come back
2nd Question-kailee always talked to me about things and she talked about him long ago but after she said she didnt like him she never brought him up again,she was in love with Wesley
3rdQuestion-all i can say about the ipod was she had it with her when she left the house on her own will

5thquestion-he went to the police station by himself then after questioning he was arrested
6thquestion-no i dont speak to her eventhough i live a building away from her in an apartment complex, i have nothing to say to her
6thquestion-She had to get up early that morning to go to an appointment in another town hours away from mccook, she has bad back problems and she recently had surgrey to help her back, plus from what the police has told us in secret about her so i believe she has nothing to do with the murder of my sister
7th question-she might have but it wasnt ment for my sister, when u call someoone a fag its usally posed at a guy, she probly did post this but not toward my sister, kailee and ashlee wernt friends on facebook so kailee wouldnt have even seen this post.

i just know that ashlee didnt have anything to do with this i just know that if she was more involved the police would have arrested her too, plus shes the one who told police that he wasnt at her place the night of the murder, she was the one who put him in the cuffs, i really dont think she was involved.

aww that is so sweet i am glad that there really are wonderful people online , it really helps when people ask me questions to me its like a healing process i go through i need to keep her alive in any way possiable and when people ask me questions about her or the trail it makes me think i am helping to keep her alive. There is no greater pain than loosing a loved one and one who didnt even get to live but 14 years.

Kailee's sister, it might be good for you to keep a journal, writing down all your feelings and memories. Your kindness, love and understanding in your posts are palpable.

ive seriously have been thinking about writting a book but i guess that might have to wait until this trial is over so this book will have an ending, right now i would say that it only has a begging and start to a middle but definitly no end just yet

No, you are wrong....the reason I suggested you write is because in your posts your talent is there and plain to see. Don't think of it as writing a book, like you have to think the whole thing start to finish...just write what you are feeling and the book will take form on its own. No matter how it evolves, the process will be good for you, I promise.

Karen, my brother was a huge part of my life. He was 8 years older than I and he took care of me, loved me, taught me so much. He died suddenly and unexpectedly.

I lived several states away and on the long drive to his funeral, I replayed as many days of my life with him as I could. I promised myself I would write a book about his life, so everyone would know what a fantastic and remarkable brother and person he was. It has been many years now and I still have not started that book. I want to, I try to, but I can't. I can not explain why.

I will make a promise to you, if you start yours, I will start mine, we can encourage each other. Would you accept a deal like that?
