EquuSearch Attorney Wants Casey To Confirm When Caylee Died

ORLANDO, Fla. -- Texas EquuSearch joined the attorneys for Zenaida Gonzalez on Monday in asking the judge to force Casey Anthony to answer questions.

The search group is just one of the entities suing Anthony. EquuSearch officials said they spent more than $100,000 on its search for Caylee and wants that money back.

Judge Lisa Munyon ended the hearing without a ruling, so attorneys said they still don't know if Anthony is going to be forced to start talking under oath.

One of the questions Texas EquuSearch said it wants Anthony to answer is "Who is Caylee's biological father?"

Attorneys said during Monday's hearing that the identity of Caylee's father may be related to exactly when the two-year-old girl died.

According to court officials, Anthony claimed the Fifth Amendment and declined to answer questions under oath.

Mark Wites, the attorney for Texas EquuSearch, said that Anthony's Fifth Amendment right should not extend to all of the questions she has so far refused to answer -- including the question of whether what her own attorney said in the opening statement of her criminal trial regarding Caylee drowning on June 16, 2008, is true.

"We want confirmation that what Jose Baez said in his opening statement is in fact the truth. He's an officer of the court, and he was her lawyer and her agent. He made those statements in a criminal trial, and we want confirmation from Casey Anthony that they're true," Wites said.

Wites said if Equusearch can get Anthony to admit she lied about her daughter being missing when she knew she was dead, it goes a long way to proving Equusearch's case that Anthony is responsible for the costs of the search for Caylee.

"The unfortunate fact of this case is that Casey Anthony will one day, if she has not already, financially profit from this case in terms of a book deal, a movie deal, photographs and videos -- and it may last as long as she lives," Wites said.

Casey is appealing her conviction for lying to police, and her attorney said that for her to answer such questions -- including when and what she knew about Caylee's death -- could cause her to incriminate herself.

"In the language of the Supreme Court, unless it's perfectly clear there's no possibility of incrimination, the Fifth Amendment applies," Anthony civil defense attorney Charles Greene said.

After the hearing, the attorney for Equusearch said the group's founder, Tim Miller, will not be deposed Tuesday despite attempts by Anthony's attorney to subpoena Miller to do so.
Casey's attorney said that if Miller doesn't show up, they'll move to have him held in contempt.

So I'm not sure why Miller needs to know Caylee's Bio dad or what that has to do with the money he spent looking for her.
But either way it doesn't matter, she so busy pleading the 5th and even if a Judge orders her to answer they can't trust anything that lying bitch says.

I doubt this would incriminate her since her own attorney who spoke for her Plainly said in opening statements that Caylee "drowned" on July 16, 2008. He said that is what his client told him..so What is the big deal about Casey affirming that?

I think knowing the bio dad may provide another witness to the whole issue at hand. I believe the attorneys have the right as well as a good reason to know who he is. Trouble is, I doubt if she knows.

... Maybe they should offer free DNA tests and a $10,000 reward for the winner of a "Who's Caylee's Daddy?" contest.

The head of Texas EquuSearch, the organization that launched massive searches for Caylee Marie Anthony, was a no-show Tuesday morning at a deposition in his civil case against the slain toddler's mother Casey Anthony.

Tim Miller's non-appearance was not a surprise, as his attorney, Marc Wites, told new reporters Monday that Miller had no intentions of being questioned under oath by Anthony's attorney.

Instead, Wites said, the parameters of Miller's deposition will be made at a hearing in January.

"The court will decide when Mr. Miller will be deposed, the scope of that deposition and how long it will last," Wites said.

But on Tuesday, Anthony's civil attorney, Charles Greene, said he was prepared for Miller to be questioned under oath.

"Since he's under subpoena [for Tuesday], I had no choice but to have a court reporter there and go forward, because his counsel wouldn't give me a new date," Greene said. "I wasn't trying to force Mr. Miller to appear today. I would have changed the date."

"We offered to change the date, let them get a hearing in advance, and to make all sorts of concessions, and they choose not to agree to anything," Greene said.

Greene said he will take the matter up with a judge at a Jan. 9 hearing.

"I believe the law in the state of Florida is you can't ignore a subpoena," he said.

Texas EquuSearch wants to recoup more than $100,000 it spent looking for Caylee in the summer of 2008.

At that time, Anthony claimed her 2-year-old was kidnapped by a babysitter.

But during Anthony's first-degree murder trial this summer, defense attorney Jose Baez told jurors Caylee drowned in the family's pool and was never really missing.

Tim Miller, the head of Texas EquuSearch, did not show up for a deposition Tuesday in relation to his lawsuit against Casey Anthony.

Miller's lawyer said both sides had agreed to put off the deposition. He has filed an order of protection to delay Miller's deposition, but the judge hasn't ruled on it yet.

Miller was subpoenaed after arriving in Orlando to help with the search for missing mother Michelle Parker.

Anthony's attorney Charles Greene said he offered to give Miller's attorney a new date for the deposition, but he never got back to him.

Now Greene said he may seek an order holding him in contempt.

Greene said he will file paperwork telling the judge everything, including how he tried to get Miller's attorney to reschedule.

Greene said Miller's attorney is trying to make this case have a "circus like" feel.

The lawyer for EquuSearch said it would be unfair if his client is forced to give his deposition first.

Miller's lawyer was in court Monday, asking a judge to compel Anthony to answer questions without invoking her Fifth Amendment rights. EquuSearch is suing Anthony to get back money spent searching for her daughter, Caylee. Miller said Anthony knew where the child was the entire time.

Greene said this case is a sham.

"If it was a truthful case by a credible people who had searched for Caylee Anthony and this was really legitimate cause, we'd probably be taking a different position," Greene said.

Greene said he expects the judge to force Miller to be questioned under oath.

The question of whether Casey Anthony will be compelled to fully answer some or all questions in connection with the two lawsuits filed against her remains unanswered.

Circuit Judge Lisa T. Munyon heard arguments Monday from the Texas EquuSearch attorney suing Anthony as well as the young woman's civil attorney. But she has not ruled yet on whether 25-year-old Anthony will be made to answer any questions, under oath, regarding the whereabouts of her daughter Caylee Marie back in the summer of 2008.

Munyon indicated she may request additional information on this issue in a special, closed-door hearing that would not be public, or she may issue an overall order regarding the deposition issue.

TES, the volunteer search organization, is suing Anthony and wants her to answer questions on the record about what she knew about her daughter's 2008 disappearance. TES wants reimbursement for $110,000 spent on two, multiday searches conducted in September and November that year.

EquuSearch's efforts to get information from Anthony are very similar to those of Zenaida Gonzalez, who is suing her for defamation. Lawyers for both plaintiffs want Anthony to answer questions, and not be allowed to invoke her Fifth Amendment right.

But Anthony's lawyer Charles Greene argues that as long as Anthony appeals her four convictions for lying to law enforcement, she keeps her constitutional privilege and protection from self-incrimination.

Greene has asked for the private hearing with the judge to further make his argument. Outside court today, he said the other side's question about who Caylee's biological father is, is "designed for harassment" and no other productive purpose in the case.

Greene also denied that he or another civil attorney working on the Anthony case were shopping around her story for a large pay out.

"She's not trying to sell her story," Greene said. "She's not out there trying to sell anything."

Greene's statements came several days after reports that Los Angeles-based Scott Sternberg Productions has been pitching an interview with Anthony for $500,000 to $750,000.

Meanwhile, TES attorney Marc Wites said the "unfortunate reality of this case" is that Anthony will profit from her story with a book, a movie, photos or video. He said the purpose of the TES suit is to get at the truth and recover money for TES.

TES volunteers spent several days in 2008 searching for Anthony's missing 2-year-old daughter Caylee Marie Anthony. Anthony claimed the girl was kidnapped by a nanny named Zenaida Fernandez-Gonzalez. The nanny was determined to be fictitious.

During Anthony's criminal trial earlier this year, her criminal defense attorney Jose Baez said Caylee died in a drowning in the family pool. He made those and other bombshell revelations during his opening statement, but much of that statement was not supported by evidence or testimony brought out at trial.

"He made those statements in a criminal trial and we'd like confirmation from Casey Anthony that they're true," said Wites. He likened the situation to the O. J. Simpson case. Simpson did not testify at his criminal trial, but he was made to testify in the related, civil case.

"We expect the same thing to happen here," said Wites, whose firm is handling the case free of charge for TES.

If the Baez statements are true, it would confirm Anthony lied to TES's Tim Miller and many others; Wites agreed, "I think it goes a long way to proving our case and the Gonzalez case as well."

Texas EquuSearch is suing Anthony for the money it cost to search for her daughter, Caylee, back in 2008. The search group says Anthony knew where her daughter was the whole time.

But, lawyers for Equusearch will be on the defensive, arguing why group founder Tim Miller shouldn't be held in contempt of court.

Miller was a no-show for a scheduled deposition last month. His attorney says it's because Miller wasn't properly served.

ORLANDO, Fla. — A Florida judge has ruled that the founder of a Texas search organization suing Casey Anthony to recover more than $100,000 it says it spent searching for her missing daughter in 2008 must be deposed in his home state.

Judge Lisa Munyon said Monday that Texas EquuSearch's Tim Miller can be questioned by Anthony's lawyers in an individual capacity and also set a seven-hour time limit.

Casey Anthony's civil attorney argued this morning in a closed-door proceeding why his client shouldn't have to answer questions as part of the lawsuit filed against her by Texas EquuSearch, the organization that helped search for her daughter Caylee.

Charles Greene filed notice with the court that he would participate in what's referred to as an in-camera proceeding before Judge Lisa Munyon at the Orange County Courthouse at 9:30 a.m.

The notice said Texas EquuSearch's attorney would not appear or participate in the proceeding.

But Anthony's defense attorneys in her criminal case, Cheney Mason and Lisabeth Fryer, were present.

Texas EquuSearch organized large searches for Caylee in the summer of 2008, after Anthony told authorities her toddler was kidnapped by a babysitter.

During Anthony's first-degree murder trial last year, defense attorney Jose Baez told jurors in his opening statement that Caylee was never missing and she drowned in the family's pool.

ORLANDO, Fla. -- The attorney representing Casey Anthony in the civil lawsuits filed against her met with the judge behind closed doors Tuesday morning.

The meeting was in regard to a lawsuit by Texas Equusearch which is suing Anthony for the money it spent searching for her daughter Caylee in 2008.

Casey's lawyer, Charles Greene, asked the judge if they could meet in private so he could explain why Casey's fifth amendment right might be compromised if she answers the questions EquuSearch wants to ask her in a deposition.

The attorney for EquuSearch was not present at the meeting but Casey Anthony's criminal attorneys, Cheney Mason and Lisabeth Fryer did attend. Mason and Fryer represent Casey in her criminal case involving accusations that Casey lied to law enforcement.

Another hearing involving a lawsuit filed against Casey by Zenaida Gonzalez was also scheduled for Tuesday, but it disappeared from the court docket Tuesday morning indicating it was cancelled.

Gonzalez is suing Casey for Defamation and claims Casey ruined her life when Casey told police a nanny by the same name kidnapped her daughter.

A video journal taped by Casey emerged online earlier this month and now attorneys for Zenaida Gonzalez are complaining that if Casey can talk on the web, she should be able to answer questions in a deposition.

A hearing regarding that issue has not yet been held.

A hearing for Texas EquuSearch, the organization that helped search for Casey Anthony’s daughter, Caylee, proceeded Tuesday morning.

Texas EquuSearch is suing Anthony for money spent to search for Caylee in 2008.

Anthony’s civil attorney Charles Greene requested the hearing to explain to the judge why her Fifth Amendment privilege should apply to Texas EquuSearch’s deposition questions.

The hearing, which was closed-door proceeding, involved only the Texas EquuSearch case and not Zenaida Gonzalez’s defamation lawsuit.

There were no attorneys for EquuSearch present. Why NOT? I would be Livid if my attorney didn't show for this very important closed-door meeting! In addition to Greene, Anthony's criminal attorneys Cheney Mason and Lisabeth Fryer were present at the hearing. Mason and Fryer are working on Anthony's appeal for lying to police.

The Gonzalez hearing, which was scheduled for the same time Tuesday, appears to have been canceled, according to the court docket.

Gonzalez is suing Anthony for defamation, claiming her life was ruined after Anthony linked her to Caylee Anthony's disappearance in 2008. WHY was it cancelled? The media gets on my nerves. If they don't Know, they should state, "At this time, we have no information why it was cancelled but are working diligently to find out", or words to that effect. grrrr

Behind closed doors today in the Case against Casey.

Both of Casey Anthony’s criminal and civil lawyers had a brief meeting with Judge Lisa Munyon Tuesday morning.

Attorney Cheney Mason was there with Lisabeth Fryer and attorney Charles Greene.

The judge asked for the meeting to have the lawyers explain more about why Casey should be allowed to take the 5th Amendment and not answer questions in the civil case being brought by Texas EquuSearch.

"We're entitled to meet with the judge and explain confidentially why the question could lead to incriminating evidence because if we explained it publically, we could wave the very privilege were trying to protect," said attorney Charles Greene.

There was no word on what was discussed in that private hearing or what, if any, decision was made.

Cheney Mason would not comment on recent reports that Jose Baez isn't working with Casey anymore. And neither attorney would comment on these recent videos of Casey that have surfaced.

Casey Anthony will have to answer two questions for Texas EquuSearch. Just two.

Judge Lisa Munyon ruled Tuesday that Anthony was still entitled to invoke the Fifth Amendment on many of the questions Texas EquuSearch wants to ask her as part of their lawsuit. The group is suing Anthony. They contend she wasted their money and resources because they say she knew all along her daughter was dead.

The judge did rule, however, that Anthony could be compelled to answer two "admissions":

Admit that you did not observe or hear George Anthony call 911 at any time to report that he or you had discovered that Caylee Marie Anthony had drowned in the swimming pool at your parents' house on or about June 16, 2008.

Admit that you were aware in September 2008 and October 2008 that EquuSearch was conducting searches for your daughter, Caylee.

She has 10 days to provide answers to these admissions.

Anthony was found guilty last July of four counts of lying to the Orange County Sheriff's Office regarding her daughter's death. Since she is appealing that conviction, her attorneys have long insisted that she cannot answer any questions until her appeals have been exhausted.

Anthony is also facing a defamation lawsuit against a woman named Zenaida Gonzalez.

Casey Anthony has answered two questions a Judge ruled earlier this week she had to answer.

Tuesday, Judge Lisa Munyon ruled Casey must answer two “admissions”:

Admit that you did not observe or hear George Anthony call 911 at any time to report that he or you had discovered that Caylee Marie Anthony had drowned in the swimming pool at your parents' house on or about June 16, 2008.

Admit that you were aware in September 2008 and October 2008 that EquuSearch was conducting searches for your daughter, Caylee.

Anthony's attorney Charles Greene said in court documents Casey responded to the two questions about her daughter.

After a judge's order, Casey Anthony responded Friday to two questions in the lawsuit brought against her by Texas EquuSearch, the group's director confirmed.

EquuSearch's Tim Miller said on Friday that Anthony acknowledged the first of the "admissions" approved by a judge in the case days ago, denying a second.

Miller said Anthony admitted she didn't observe or hear her father call 911 to report the discovery that daughter Caylee had drowned in a swimming pool in June 2008.

She denied, however, that she was aware in September 2008 and October 2008 that EquuSearch was actively conducting search operations for her 2-year-old daughter.

Anthony is appealing convictions for lying to law enforcement, and has invoked her right against self-incrimination to avoid questioning in her civil suits.

She was forced to respond to two of EquuSearch's requests after Judge Lisa Munyon ruled this week that her responses would not implicate her criminally.

Miller says he talked with Anthony multiple times about the searches in 2008. He says Anthony was aware of the efforts, but he isn't surprised she's denying it now.

"Nothing would surprise me coming out of Casey's mouth," Miller said, adding that he "spent a lot of time with Casey in [her parents'] house before she was arrested."

TES organized searches for Caylee in 2008, after Casey Anthony said her toddler had been kidnapped. EquuSearch is suing to recoup the money spent.

Anthony's criminal defense lawyer Jose Baez said during her murder trial that the child drowned in the family's backyard pool. She was acquitted of murder in July.

Casey Anthony opens up again and manages to astound many again.

She has people talking about one of her answers in Texas EquuSearch’s lawsuit against her. The group searched for Anthony’s daughter, Caylee, in 2008, and looks to recoup money spent on those efforts.

In an answer revealed Friday, Anthony said she was not aware Texas EquuSearch was looking for the child in September and October 2008. Of course, that information was all over the news then.

But maybe Casey wasn’t watching. Or maybe she was fogged in on Planet Casey.

Tim Miller, director of Texas EquuSearch, scoffed at Anthony’s response in an interview with WESH-Channel 2. “Of course, she knew,” Miller said. ”She got our business card when we walked in the door [of the family home]. We gave her a flier to get her approval, that she approved the wording on the flier. Yes, yes, she knew.”

The other Anthony response in the EquuSearch lawsuit: She did not observe or hear her father, George, call 911 to report that Caylee had drowned in the family swimming pool in 2008.

In July, Anthony was acquitted of murder in the toddler’s death. At the trial, her defense said Caylee drowned.

Texas EquuSearch asks: If that was the case, why was there a need for a search for Caylee?

It will come down to another trial wont it? And both George and Cindy probably Leondard Padillar or the women that lived with Casey for a while will have to testify that Casey knew about the searches - I cannot understand how her lawyers could let her perjure herself when in this case, its going to be so easy to prove that she knew about the searching. Does anyone know how much TES is suing her for?

The search group is just one of the entities suing Anthony. EquuSearch officials said they spent more than $100,000 on its search for Caylee and wants that money back.

Apparently, short of a Tibetan monk with his foot stuck in a craggy Himalayan mountain side for months while he subsisted on lichens and prayed for a long fall season, Casey Anthony has admitted in a civil suit deposition that in September and October of 2008 she was the most clueless person (save the monk) on Earth. She had no idea people were looking for her missing daughter.

Yep, that’s right. Despite the fact her lunatic, lie-filled “Zenaida took my baby” story resulted in one of the largest U.S. missing person ground searches in history – live-streamed on Orlando media outlets if not national news coverage - she didn’t know. Despite the fact that she had already sat for about a month in jail with Sheriff’s investigators wanting her to tell them something that resembled the truth so they could find her baby, and despite the fact she was locked away in her parents’ home on house confinement during bond, and despite the fact that grass won’t grow in her parents’ yard for the next decade from the foot traffic of protesters hanging outside the house demanding to know where her baby was…and despite she had two bail bondsmen camping in an RV in front her house and a female one living with her – all of them wanting her to tell them the truth so they could find her baby -

she didn’t have a clue when Tim Miller and Lisa Hoffman with Texas Equusearch walked into her parents’ Orlando home they were there to search for Caylee Marie Anthony.

She obviously didn’t realize that when they put a map down on the kitchen table and her dad asked her to mark a location that Tim and his searchers should look that he was referring to “look for Caylee” not the friggin Easter Bunny, or Waldo, or whatever the hell it was she wants to claim she thought they needed help with.

I guess the dumb bitch thought they were there for a tea party and the map was a tablecloth.

We know the television worked in the Anthony house because Tracy McLaughlin has confirmed they watched the news and TV series. The friggin searches were broadcast! Oh, I forgot, she was busy talking about knock-out drugs and making bracelets with her new BFF.

Anyway, there’s a $110,000 on the line here. That’s the amount of money Tim Miller states TES expended in the searches during 2008 for a baby whose mother has admitted now through her lawyer during statements Jose Baez made in her murder trial she knew was already dead and pitched in a swamp like yesterday’s trash. Tim Miller was invited to perform the searches by Cindy Anthony. Then Cindy turned ugly-ape mean on him when he refused to play ball (look for a living Caylee – which makes Cindy almost look more clueless than the Tibetan monk, at least, but not nearly as clueless as what Casey’s trying to pull off now).

There is one thing that Casey Anthony did admit to having a clue on…that in her pack-of-lies story about Caylee drowning in the pool (or being drowned in the pool because it appears Casey’s okay with implying George actually DROWNED Caylee in the pool) the only other question Casey answered in the civil deposition was that she never saw her father call 911 after he allegedly found Caylee drowned in the pool….which means, Casey has admitted that she knew help was not sought and chose not to seek it herself AND that in doing so (if we want to travel down this fabricated rabbit hole) guaranteed her daughter was dead and then chose not to report it. There’s never any getting out of that one from this point forward.

As Tim Miller stated concerning Casey’s claim she was clueless as to why they were there…

Of course she knew…she got our business card when we walked in the door.

Tim Miller stated that while in Orlando he and others from TES spent approximately 12 hours over a 4 day period in the Anthony home with Casey.

I loathe liars…especially stupid ones….and Tim’s not the liar in this deal.

Wites & Kapetan Back in Court to Review Complaint Filed Against Casey Anthony

Texas Equusearch’s lawsuit against Casey Anthony has brought the parties to court several times since the complaint was filed last summer. Wites & Kapetan is reviewing the complaint filed against Ms. Anthony.

Ms. Anthony admitted that the first statement is true, and denied that the second statement is true.

Texas Equusearch’s lawsuit (Case# 2011-CA-8475) against Casey Anthony has brought the parties to court several times since the complaint was filed last summer. At the outset, Casey Anthony moved to dismiss the case, and Texas Equusearch opposed the motion to dismiss. The court held a hearing, and issued an order denying Mrs. Anthony’s motion. The order required Texas Equusearch to slightly modify its complaint, which the organization quickly did.

Texas Equusearch then asked Mrs. Anthony to answer written questions, known as interrogatories and requests for admissions. When she refused, Wites & Kapetan, P.A. filed a motion to compel her to do so, and the court held hearings on the issue in December 2011 and January 2012. The court recently ruled on the motion, granting in part and denying in part Texas Equusearch’s motion. The Court’s order requires Casey Anthony to admit or deny two statements, including (1) “Admit that you did not observe or hear George Anthony call 911 at any time to report that he or you had discovered that Caylee Marie Anthony had drowned in the swimming pool at your parents’ house on or about June 16, 2008” and (2) “Admit that you were aware in September 2008 and October 2008 that EquuSearch was conducting searches for your daughter, Caylee.” Ms. Anthony admitted that the first statement is true, and denied that the second statement is true.

Further, Casey Anthony attempted to compel Mr. Miller to appear for a deposition in Orlando, Florida. Mrs. Anthony, through her counsel, served Mr. Miller with a subpoena for the deposition while he was in the Orlando airport. Her lawyers argued that they could depose Mr. Miller, in his individual capacity – and not as a representative of TES – in Orlando because they had served the subpoena there. Texas Equusearch and Mr. Miller filed a motion for protective order, arguing that under Florida law an individual may only be deposed in the county where they reside. The court agreed, and ruled that if Mrs. Anthony wishes to depose Mr. Miller in his individual capacity, such deposition must be in Texas, in the county where Mr. Miller resides. The Court also ruled that if the parties cannot agree on the scope of Mr. Miller’s deposition, a Special Master will be appointed to oversee the deposition.

Mr. Wites reports that Texas Equusearch continues to pursue the case, which is not presently set for trial.

ORLANDO, Fla. — Casey Anthony's civil lawyers said they were victorious on Friday in their fight against Texas EquuSearch, which is suing Casey for more than $100,000.
The search group said that's how much they spent on searches after Casey claimed her daughter Caylee was alive and missing.
Casey's civil lawyers convinced Circuit Judge Lisa Munyon to allow them to question EquuSearch founder Tim Miller under oath about the conversation he said he had with Casey.
Casey later claimed during her murder trial that Caylee had been dead all along, after drowning accidentally in the family swimming pool.
Casey's lawyers want to grill Miller about his claim in his lawsuit that Casey told him Caylee was alive and asked him to find her.
But Casey's lawyers claim Miller made several public statements to the contrary.
Volunteers came from all over the country to help EquuSearch look for Caylee, who won the hearts of people everywhere.
Casey claimed a nanny took off with Caylee, and even though Casey's story was full of contradictions and changes, EquuSearch came to Central Florida twice to lead massive searches that cost more than $100,000.
Casey was acquitted.
"Every person who was present during this meeting when this conversation allegedly took place denies that it ever occurred and this involves others than just members of the Anthony family," said Casey's lawyer, Charles Greene.
The judge still hasn't ruled on EquuSearch's request to have a special master, or a lawyer who would serve as a referee for the deposition, since there is no judge present.
