The two people charged with the 2009 death of 5-year-old Shaniya Davis both entered not guilty pleas in Superior Court this morning.
Mario Andrette McNeill and Antoinette Davis, Shaniya’s mother, both pleaded not guilty in separate appearances in court.
Both are charged with first-degree murder, rape of a child and other charges.
Both McNeill and Davis are due back in Superior Court in April to set a trial date.
Prosecutors allege that Davis sold her daughter as a prostitute to pay off a drug debt to McNeill on the morning of Nov. 10, 2009. McNeill took the girl from the family’s home in the Sleepy Hollow Mobile Home Park off Murchison Road at 5:47 a.m. and checked into a Comfort Suites hotel in Sanford at 6:11 a.m., West said.
At 7:33 a.m., McNeill got a tip that someone knew he had taken Shaniya and he left the hotel, West said. The child’s body was found off Walker Road near the Carolina Trace community in Harnett County on Nov. 16, 2009.

The two people charged with the 2009 death of 5-year-old Shaniya Davis both entered not guilty pleas in Superior Court this morning.

I hope the pair get at the VERY least, life in prison w/out the possibility of parole, but the way the courts seem to look at killing a child, in particular in North Carolina (as evidenced by our little Zahra Baker) I have severe doubts. Hope I'm wrong!!

The two people accused in the 2009 slaying of 5-year-old Shaniya Davis pleaded not guilty to charges in separate appearances in Superior Court this morning .
Mario Andrette McNeil , 31, and Antoniette Davis, 27, Shaniya's mother, are each charged with first-degree murder, first-degree rape of a child, child abuse, human trafficking and sexual servitude.
Davis is accused of giving her daughter to McNeil as payment for a drug debt, authorities said.
McNeil is accused of raping and strangling Shaniya and dumping her body in woods off Walker Road near the Carolina Trace community.
No action was taken at the arraignment hearings other than having the pleas formally entered.
A trial date is scheduled to be set during the April session of Superior Court.
McNeil, flanked by his lawyers, Harold "Butch" Pope of Whiteville, and Terry Alford of Spring Hope, was first to appear before Judge Jim Ammons.
McNeil, clad in a jail-issued orange jumpsuit, appeared to have a slight smile on his face as he answered Ammons' questions in a near-whisper.
McNeil, when asked by Ammons if he was aware he could be sentenced to death on the charged, nodded his head to indicate he did.
McNeil, a slightly-built man, was ushered out of the courtroom by bailiffs.
Davis, who is represented by Fayetteville lawyer D.W. Bray, sat through other proceedings for several minutes before her case was called.
Davis wore drab-brown jail-pants and a matching top with an orange shirt underneath and matching jail-issued flip-flops.
She stood beside Bray with her hands behind her back, her right hand clasping her left forearm.
Davis had shackles around her ankles.
Prosecutor Billy West has said he will not seek the death penalty for Davis.
The U.S. Constitution's Eighth Amendment says that defendants in felony murder cases cannot be sentenced to death if they did not kill, try to kill or intend to kill anyone.
West has said there is no indication that Davis intended for her daughter to die.
It was 6:53 a.m. on Nov. 10, 2009, when Davis, then living in a mobile home park off Murchison Road, called police and reported her daughter missing.
Authorities later learned that Davis sent Shaniya with McNeil at 5:47 a.m. and at 6:11 a.m., he and the child checked into a Sanford hotel.
McNeil and the girl left the hotel about 7:30 a.m.
The state Medical Examiner ruled that Shaniya died of asphyxiation.
Rescue workers and volunteers searched for a week before Shaniya's body was found near the Harnett-Lee county line.

McNeill has been smiling and laughing about this ever since the day he was caught. He has absolutely no remorse.

Allegedly, she did not intend for the child to die, only that she be tortured and violated. So at 5:47 she sent this helpless angel off with the killer. At 6:11 he checked into the hotel. At 6:53 she calls the police to report an abduction.
Here are my questions-
How was Shaniya going to be returned to her mother? Davis reported a missing child and had to know that police and even the FBI would be all over the area. Certainly McNeill would not risk getting caught returning the child.
McNeill got a tip that "someone knew he had taken the child". We can deduce who the "someone" was. The witness had to a) be awake at 5:47 and close enough to see Shaniya and McNeill leaving and b)know who McNeill was in the first place. The only person that fits this description would be Davis' 7 year old son, the only other person at home at the time. I believe he woke up when Davis came to get Shaniya and later asked his mother why McNeill was taking her. The mother probably freaked out and texted McNeill. See, this goes back to my question about how Shaniya was going to be returned. The entire jig was up. Davis knew her son would be questioned by the police and that he would implicate McNeill. So killing Shaniya really served no purpose since McNeill knew he had already been identified.
I believe that both Davis and McNeill planned for Shaniya to die from the beginning. This district attorney is weak and full of crap. Davis may have told police that she never intended for the girl to die, but she's a lying crackhead piece of ****. They both need to be executed.

:Loudmouth, I think you just answered your question. I doubt the "mother" had any sort of "plan" to get Shaniya back as her ONLY thought was Drugs. I doubt she even knew Shaniya that well as she had been raised by that no good father who had no business allowing his precious daughter to stay in that horrible trailer with this drug addicted mother and her drug addicted roommates. Thanks WrapItUp. I didn't realize she hadn't been back with the mother very long. I assumed she had been coming for summer, holidays, weekends, etc. This case makes me very angry.

From what I gather, she didn't spend much time w/the "mother" due to her being a drug addict and had been basically raised by the "father" and his sister..actually, I've read (and it is on one or Shaniya's threads) that her Aunt spent most of her time w/Shaniya. That is WHY I question this "father" allowing her to go to that drug and bug infested trailer.

I don't understand why Antoinette reported Shaniya missing after giving her away to settle a drug debt? I found this picture when I took a look back at the beginning of this case. Seeing it and knowing what happened to her next is gut wrenching.

Lindamarie, that is the part I don't understand. She reported Shaniya missing a little over an hour after McNeill took her. Was she trying to double cross him, or was she trying to get that phone call in before her neighbors started waking up and would be able to contradict her story about not having seen who took Shaniya?
Wrap, sounds like the so called father just wanted to be rid of her. My understanding is that Shaniya is the result of prostitution. So right away we know both parties involved are sleazy. I have also noticed that Davis appears to have gained quite a bit of weight. Which is odd because when she was arrested, she was pregnant and she was much thinner than she is in the latest photo. It makes me mad as hell knowing that a) the child she was carrying was in all likelihood born crack addicted and b) Davis is straight chilling in prison, eating snacks and growing fat off our our tax dollars.
While I do not agree with drug testing for all people that receive welfare benefits, I think all pregnant mothers should be tested. The reason for this is that the tax payers are going to pay BIG TIME when the child is born addicted to drugs. And I don't just mean pay with money! If you recall the Dunbar Village rape case, where a gang of teenagers assaulted a woman and forced her and her own child to perform sexual acts on each other? Three of the teenagers involved were born crack addicted. There are many other such cases, but to be honest with you the details of them all are so horrible I can't even post it here. But just to further make my point...Latasha Pulliam was born crack addicted. Need I say more?

I think, like many cases, Antoinette made a faux call to LE to report Shanyia missing when she knew damned good and well who had her. It was a drug deal and she was trying to cover her ass IMHO.

All of these cases just make me . How can you as a mother do this to such a beautiful child? Her low life father also. I know, it is the d**n drugs that they get addicted to. Their is just way too many cases this is happening in.

Wrap, Davis was arrested shortly after Shaniya's body was found. But she was released on bail when it was discovered that she was about 6 months pregnant. She was free to have all the sex and drugs she wanted for nearly A WHOLE YEAR. She gave birth to a baby boy and it was not until a year later when she was put back in jail that the child was taken from her by the state. The 7 year old son that was at home when Shaniya was taken had been removed by CPS after the first arrest. So this woman sold one child but was allowed custody of a NEWBORN child for 5 months???
Davis is currently in PRISON. She has not been convicted of any crime yet, but there is a big concern for her saftey in the county jail (where most people are held pending trial) and only the prison has the resources to truly isolate her from the other inmates.

Bradley Lockhart (bio-dad) was an absentee parent who left his children (plural) with others to be raised instead of taking care of them physically or financially. In the above thread several people offered to care for Shaniya instead of him allowing her go be with her mother. They knew the child would be in danger... and Brad knew too!

Well it's April and there is still no court date scheduled for either Davis or McNeill. I really believe the reason that the court is dragging their feet in this case is because no family member is calling them every day demanding justice. It's like nobody cares about this little girl. Dragging it out like this plays into the mind games of filthy, worthless predators like McNeill. Look at any photo of him and you will see him smiling. But he won't be smiling when they strap his ass on that gurney and start the juices flowing...assuming we ever make it to trial in the first place.

The "father" should be raising hell. Only reason IMHO he Isn't is because he KNOWS had he not taken Shaniya there in the first place, she would be alive today.

loudmouth thanks for bumping this thread up. When I look at that picture of Shaniya "father" with tears in his eyes I get angry. Why is he not demanding justice? We cover some really disturbing stories here at VH. Shaniya case is right up there with Zahra story.

I am very frustrated with the lack of progress in this case. As of today Davis and McNeill have no scheduled court date even though the judge said their trial would begin this month.
Part of the reason that this case is not moving is because Shaniya has no grieving relatives calling the prosecutor every day and following up on the case. I'm sad that no one ever really cared about that little girl, except maybe her aunt. I'll be shocked if McNeill and Davis get court dates this year.

An autopsy determined that Shaniya died of asphyxiation and that injuries she suffered were consistent with a sexual assault. A medical examiner noted in the autopsy that investigators believe the girl was used to pay off a drug debt.
A Cumberland County grand jury indicted Antoinette Davis in July on charges of first-degree murder, indecent liberties with a child, felony child abuse, felony sexual servitude, rape of a child, sexual offense of a child by an adult offender, human trafficking and making a false police report. Mario Andrette McNeill will go on trial more than three years after Shaniya's death. The girl's mother also faces charges; her trial is scheduled for Feb. 18, too, but only one of the cases will go forward then, said Cumberland County District Attorney Billy West.
It hasn't been determined which trial will start first nor whether they will be conducted back-to-back.
The Shaniya Davis case made national headlines when her mother, Antoniette Nicole Davis, reported her missing to Fayetteville police in November 2009. Shaniya's body was discovered in the woods in Harnett County six days later.
McNeill, 32, faces multiple charges including murder, child rape, kidnapping, child abuse and human trafficking. He is being held without bail in the Cumberland County jail.
If convicted, he could be sentenced to death.
His trial likely will take two to three months, including jury selection, West said.
Davis, 28, is charged with murder, child abuse, sexual servitude, human trafficking, child rape and other charges. She is in jail with bail set at $3.5 million. Her trial likely will run about a month, West said.
She faces life in prison without parole if convicted.
While it typically takes a few years for a murder case to go to trial in Cumberland County, this one took longer than most.
West said there was a delay in his office receiving the investigative file from law enforcement because there were so many agencies involved, including the Police Department, Federal Bureau of Investigation, State Bureau of Investigation and the Lee County Sheriff's Office.
Also, West said, it was difficult to coordinate with the schedules of McNeill's lawyers, who are from out of town and spend most of their time defending clients in capital murder trials in numerous jurisdictions.
One of McNeill's lawyers has another capital case late this year, West said. If that trial runs longer than expected, the Shaniya Davis case will be delayed until March 11.

Antoniette Nicole Davis, her mother, and Mario Andrette McNeil both face murder charges. The trial has been scheduled for Feb. 18 according to a Fayetteville Observer report today. If convicted, McNeil could face the death penalty.

FAYETTEVILLE (WTVD) -- A judge denied a motion Friday that would have prohibited prosecutors from seeking the death penalty against 5-year-old Shaniya Davis' accused killer.
Mario McNeill is charged with kidnapping, rape and first-degree murder in connection with the girl's 2009 death. He has pleaded not guilty.
Shaniya Davis' mother, Antoinette Davis, is also charged in connection with her daughter's death.
In November 2009, Antoinette Davis reported her daughter missing from her Cumberland County home. She told police someone had taken the little girl. Days later, Shaniya's body was found in a ditch in Lee County.
Investigators have said Antoinette gave Shaniya to McNeill to settle a drug debt.
A security camera captured McNeill with the 5 year old in his arms waiting for an elevator inside a motel in Sanford. He allegedly assaulted and choked the girl to death before dumping her body.
On Friday, Judge Jim Ammons also denied a motion to strike the first-degree murder charge against McNeill.
His defense team's request for a 60-day continuance in the case was also denied by the judge. They have not yet decided if they will present evidence at trial.
Jury selection is slated to start February 18 and is expected to take two to three weeks.

A Cumberland County judge denied a request by Mario Andrette McNeil's lawyers to delay the capital murder trial by 60 days. Jury selection will begin Feb. 18.
The child's mother, Antoniette Nicole Davis, is accused of handing over the child to McNeil to settle a drug debt in November 2009. She also faces charges including murder.
The case captured national attention after Davis first reported the child missing from their trailer off Murchison Road. Police say Davis fabricated the story after selling her daughter to McNeil, who assaulted the child in a Sanford hotel before killing her and dumped the body along N.C. 87 in Harnett County. The body was found six days later.
McNeil, 32, faces multiple charges including child rape, kidnapping, child abuse and human trafficking. He faces the death penalty if convicted. The trial likely will take two to three months, including jury selection, the district attorney has said.
McNeil, who remains in jail without bail, did not speak during his hearing Friday. Wearing an orange inmate jumpsuit, goatee and long dreadlocks, he sat by his defense team of Terry Alford and Harold "Butch" Pope. McNeil swiveled in his seat during the 35-minute hearing, appearing at times to smirk as his lawyers went through motions.
Prosecutors could have decided to try Davis before McNeil. Her trial will come at some point after McNeil's. District Attorney Billy West declined to comment on whether Davis will be called to testify against McNeil.
Superior Court Judge Jim Ammons denied a request by McNeil's lawyers to remove the possibility of the death penalty. Ammons said he would decide which photographs from the crime scene and autopsy can be shown to jurors, in response to a defense motion that none be shown.
"We just didn't want any photographs presented to the jury before you've had a chance to review," Pope said.
There won't be, Ammons responded.
Ammons denied a request for a 60-day continuance from the defense. Alford said his team had learned the FBI lab still has evidence in the case that the lawyers haven't reviewed. HOW could that be? This is Ridiculous!
"That's one reason we're asking for continuance," he said.
Alford said the defense received Friday morning 28 disks of materials, including surveillance video from Sleepy Hollow Mobile Home Park, where the Davises lived, and the Comfort Suites in Sanford.
Alford said he wanted his team to have adequate time to peruse previously unavailable FBI and SBI materials.
"There may not be any new material in those disks," he said, "but we would like to review them."
He told Ammons that the defense was trying to locate a geologist to study soil samples from where Shaniya's body was found.
Assistant District Attorney Robby Hicks told the judge "there's nothing new" in the FBI materials - raw data from cell phones. Prosecutors had received that today, he said, and the defense would be getting it next week. She just wanted to save her own ass acting like the scared mom who's child got kidnapped! You summed their twisted "train of thought" perfectly. Bottom line, drugs were more important to this pathetic excuse for a mother. And, she was pregnant when her precious daughter was being molested and dumped on the side of the road.
