The man charged with kidnapping, raping and murdering 6-year-old Sierra Newbold late last month refused to appear in court Thursday.

Terry Lee Black, 41, refused to be transported to 3rd District Court from the Salt Lake County jail in connection with an unrelated robbery case. Judge Elizabeth-Hruby Mills did not immediately grant a prosecutor’s request for an order to bring Black to court for a Friday morning appearance. Defense attorney Ari Chino said he would try to meet with Black Thursday afternoon in hopes of convincing him to cooperate with officers.

Black is being held in the jail in lieu of $2 million bail. Jail inmates sometimes refuse to leave their cell to appear in court as a form of protest or delay tactic.

It was Black’s arrest for allegedly robbing a West Jordan Wells Fargo that police say that gave them a break in the murder investigation. A detective noticed dark stains on the man’s hands and clothes that looked like they could have come from the burned field behind the Newbold’s home. Police later took DNA swabs of Black’s genitals and found Sierra’s DNA profile, charges state.

On June 29 — three days after Sierra’s death — Black walked inside a Wells Fargo at 7869 S. Redwood and told a teller he needed $100, charges state. When the teller asked for identification, Black allegedly said, "This is a robbery." Black then held up four fingers, the charges state. The teller asked if he wanted $400 and he said that he wanted $4,000, according to court documents.

The teller told police she said she would need to go to the bank’s vault for the money and, when she turned around, Black walked out of the bank.

Chino, who was hired by Black’s family to represent the man in the robbery case, said the murder charge came as a surprise.

"I did not see it coming," he said Thursday, adding that is was "doubtful" he would represent Black in connection with the homicide.

Black lived a short distance from the Newbolds’ home and infrequently attended the same church events.

Police found Sierra’s body in a canal behind her home on June 26. According to charges filed earlier this week, home surveillance footage shows Black walking into the Newbold home around 3 a.m. and leaving eight minutes later, carrying something.

Those who know him say Black struggled with alcohol and would go on binges, sometimes for "weeks."

He’s had run-ins with the law in the past, though his previous charges were limited to misdemeanors.


In 2008, Black pleaded guilty to burglary for breaking into two cars near a Midvale TRAX station while he was drunk. When an officer found him sitting in one of the cars, he allegedly said he was looking for change for a TRAX ticket.

In 2006, he pleaded guilty to attempted forgery and intoxication.

On July 6, 1991, a drunken Black, then 19, broke out the windows on a Richfield apartment and then hid in a nearby garage, Richfield Police Chief John Evans said. As police arrested Black, one officer was cut by the man’s knife.

For the family of Sierra Newbold, the arrest of the man who allegedly walked into the Newbolds’ West Jordan home last month and kidnapped, raped and killed the child has "allowed at least a small measure of closure."

In a statement released to the media Wednesday, Brad Newbold, the 6-year-old girl’s father, thanked police and offered support for the family of Terry Lee Black, who was charged Tuesday with aggravated murder.

"We offer our sympathy to the Black family during this sad time since they, too, are grieving a loss," Newbold wrote. "We want everyone to know we hold no animosity in our hearts toward Terry Black’s wife and children."

According to charges filed Tuesday in 3rd District Court, a home surveillance video shows a man entering the Newbold’s home shortly after 3 a.m. on June 26. The figure walked out eight minutes later carrying something.

Sierra’s body was found five hours later in a nearby canal. Police found clothing belonging to the girl — pink pajama bottoms and her underwear — in a field near the canal, which had been blackened by a recent fire.

Black, 41, was arrested three days later after allegedly robbing a West Jordan bank. A detective noticed Black had black stains on his hands, knees and elsewhere on his clothing that looked liked they were from the burned field, police said.

After Black’s arrest, a swab from his genitals was obtained and compared to DNA from Sierra’s body. Examiners at the Utah State Crime Laboratory subsequently found Sierra’s DNA profile on the swab taken from Black, according to charges.

"We are still trying to comprehend and reconcile the newly revealed developments in the case," the Newbolds’ statement read. "We anticipate it will take a very long time to fully come to terms with what has occurred."

Black, 41, was living with his wife and two teenage children in an apartment about a half-block from the Newbold’s home. Neighbors said he had made a few appearances at church events in the Newbold’s Church of Jesus Christ of Latter-day Saints ward over the past year and a half.

"I just can’t believe he’s involved in this," said Eldon Thomas, Black’s former landlord who is now a tenant at the Jordan Village Apartments.

Thomas said he knew Black and his wife and two children. He said they had moved to Utah from Arizona and lived in the apartment complex for eight years.

He said Black’s wife found out about the charges when they were announced by police Tuesday.


"She’s still stunned just like the rest of us are," Thomas said.

Thomas said Black had a problem with alcohol and went on binges for "weeks" every few months.

"He liked his alcohol," Thomas said.

"I don’t know if he’s realized what he’s done," Thomas said. "Something inside of his head was not completely there."

"I’m totally devastated. Gloria is just like a daughter," Thomas said of Black’s wife. "People need to realize that Gloria and the kids are victims."

Black’s previous criminal history is limited to misdemeanors. In 2008, he pleaded guilty to vehicle burglary for breaking into two cars parked at a Midvale TRAX station while he was drunk. According to court documents, a police officer found him sitting inside one of the cars; Black allegedly said he broke into the cars to look for change for a TRAX ticket.

In 2006, he pleaded guilty to attempted forgery and intoxication; a lewdness charge was dismissed.

In the early 1990s in Richfield, he pleaded guilty to assault on a police officer and paid fines for disorderly conduct and possessing alcohol as a minor. He also owes $15,200 in child support payments, according to court records.

Evidently, he has other children if he is paying child support. Wonder how old they are and Where they are. I certainly feel for his wife and kids! And, of course for the Newbold family. This is simply devastating! I still want to know if the sliding glass door was locked. Also, maybe it's just me but I find it strange they had surveillance INSIDE the home but didn't have an alarm.

SALT LAKE CITY — Extra bailiffs were positioned around Terry Lee Black as he stood at the podium and made a brief initial first appearance in Third District Court Friday.

Black, 41, is charged in two cases. In one, he is charged with aggravated murder, kidnapping and rape of a child in the death of 6-year-old Sierra Newbold. In the other, he is charged with robbery and possession of a stolen vehicle for allegedly robbing a bank just before he was arrested.

Black was originally scheduled to make an initial appearance on the robbery charge Thursday but refused to be transported from the Salt Lake County Jail to the Matheson Courthouse.

Friday, Judge Elizabeth Hruby-Mills ordered Black to make an initial appearance for both cases.

Extra security measures had to be taken, such as keeping Black isolated from the other prisoners. Wearing a yellow county jail jump suit with his hands shackled behind his back, a metal chain stretching around his stomach and his feet also in shackles, Black gave no response or short responses that were barely audible when the judge asked him if he could afford an attorney.

Attorney Ari Chino said he would continue representing Black in his robbery case but that someone from the Salt Lake Legal Defender's office needed to be appointed to represent him for the murder charge, a possible death penalty case.

"It's a huge case, it's going to be very, very expensive. I just don't think he can go forward with private counsel," Chino said.

Chino declined to comment on whether his client had expressed any remorse, explanation or said anything at all about the crimes for which he is accused. He said he was planning on talking to Black again Friday afternoon. Chino said he had gone through some of the evidence in the case as of Friday morning, but not all of it.

Black's family has expressed "shock" over what he is accused of doing, but otherwise have not said much about the case, Chino said.

Black is accused of going into Sierra's West Jordan home on June 26, strangling the young girl, sexually assaulting her and then drowning her in a nearby canal. He was arrested following a bank robbery three days later, also in West Jordan.

The next court date, a scheduling hearing, is slated for July 31 at 3rd District Court in West Jordan before Judge Mark S. Kouris.

A day after he refused to be transported from jail, the man accused of raping and murdering 6-year-old Sierra Newbold made his first court appearance Friday.

Terry Lee Black, 41, spoke seldom and softly during the short hearing in 3rd District Court. His hands were cuffed and secured close to a chain around his waist, and his belly hung below his yellow Salt Lake County jail uniform.

Black, whose family had hired a private attorney to represent the man in a robbery case that police say eventually led to him as a murder suspect, will be appointed a public defender in the murder case.

"It’s a huge case," said defense attorney Ari Chino, who will remain as counsel in the robbery case. "It’s going to be very, very expensive."

Chino told reporters he spoke briefly with Black prior to Friday’s hearing, but only about the appointment of a public defender. Chino did not know why Black refused to be transported Tuesday and declined to comment on the specifics of the robbery defense.

Chino said Black’s family is experiencing "shock at what he’s been accused of."

Another hearing was set for July 31.

Salt Lake County prosecutor Robert Stott on Friday said his office is still investigating and gathering evidence in the murder case. Black has been charged with aggravated murder, a first-degree felony that carries the possibility of a death sentence, though prosecutors have yet to say if they will seek such a penalty. Prosecutors have until 60 days after a preliminary hearing to formally declare if they will seek death.

"At some future point, if we decide we want to seek the death penalty, we will give that notice," Stott said.

Two women's actions helped lead police to murder suspect of Newbold case

WEST JORDAN — Sara Davis didn't think at first that the dirty, odorous man who appeared to be walking with a limp when he came into her coffee shop on June 29 was the man who had just robbed a bank across the street 20 minutes earlier.

"He didn't strike me as someone who just robbed a bank at all. I mean, he was really strange," Davis recalled Thursday.

But she pointed police in the direction of where the man had walked off, and he was arrested by detectives within five minutes. A couple of days later, police and prosecutors announced that the man, 41-year-old Terry Lee Black, was also being charged with kidnapping and murder in the death of 6-year-old Sierra Newbold.

Black was scheduled to make his first appearance in court Thursday on charges of robbery and for possessing a stolen vehicle, but he did not show up. Prosecutor Paul Parker told 3rd District Judge Elizabeth Hruby-Mills that Black refused to be transported from the Salt Lake County Jail to the courthouse.

Black also has a hearing scheduled for Friday morning on the murder, kidnapping and rape charges and is expected to be compelled to attend.

While excellent detective work was being credited for helping solve the case, police also had help from two women, including Davis, who provided important information to detectives.

On June 29, police believe Black stole a Jeep Grand Cherokee parked at Deseret Industries, 7166 S. Redwood Road. The vehicle was shared by Melinda Ramsey and her boyfriend, Ryan Bridge. Bridge had parked his car in front of the store to run in and get his paycheck. When he came out 15 minutes later, the vehicle was gone.

The car was stolen while employees were gathered in the store for a morning meeting, something that happens at the same time each day.

"It's almost like he might have known everyone was busy at that time," Bridge speculated. "It's hard to say. He walked past and waited for everyone to go inside."

A store surveillance camera showed Black walking toward Bridge's Jeep, which was off camera, he said. Moments later, the vehicle was gone.

After Bridge called Ramsey and told her what had happened, Ramsey called her boss Rena Carder, and passed the news along to her.

About the same time, Carder was on her way to Wells Fargo Bank, 7869 S. Redwood Road, to make a deposit. When she got there, she spotted Ramsey's Jeep backed into a parking stall. She thought the stolen car had been abandoned and dialed the police department's non-emergency dispatch number.

What she didn't know was that inside the bank, prosecutors say Black had just robbed a teller of $100. When the man in the bank went back to the parking lot, Carder was still there and watched as he tried to get back into the Jeep.

"I said, 'I got two seconds to do something here, and that's to get in your face,'" said Carder.

She approached Black and told him, "No. That's not your car."

What stood out to Carder was how bad the man "stunk" and how dirty he was, she said.

Carder said Black "looked at me weird" and attempted to get in the vehicle again. That's when Carder again told him, "No!" She said Black gave a grunt and then walked away, wearing a coat Ramsey had left inside her vehicle. Carder took three cellphone pictures of Black as he was walking off. She watched as he walked across Redwood Road to a strip mall where he attempted to steal another vehicle parked in front of Gold's Gym, she said. He also dumped the coat he was wearing in the parking lot.

That's when police believe Black walked into High Point Coffee, 1735 W. 7800 South. He went to the counter and asked if they could break a $100 bill into five $20 bills.

"When he first came in, I don't know, he was really strange. He seemed kinda spacey, maybe not all there. He was wearing really dirty clothes. My first thought was, 'Where on earth did this man get $100?' And the weird thing was, he wasn't in any hurry. He was like wandering aimlessly almost," Davis said.

Black walked out the door, and then went back in and asked if they could break one of the $20 bills into four $5 bills.

Twenty minutes later, the police were in the coffee shop asking Davis and her boss if they had seen anything. At first, they didn't think the man in their shop was connected to the bank robbery because he wasn't running and didn't seem to be in any hurry. But after telling detectives what the man looked like — a tank-top, flip-flops, three-quarter shorts, and dirty — police said that was whom they were after.

After pointing officers in the direction the man was last seen walking, officers arrested him a short time later. A couple of days later, Black was charged in connection with Sierra's death.

"It crossed through both of our minds (that Black might be involved). ’Cause the police officer had mentioned when he came in that everyone was on edge from the case. I was like, 'Wow, wouldn't it be something if it were related?' When I found out it was in fact him — chills, like instantly I got chills. Extremely disturbing to think about what he had done, not even three days earlier. It was really sickening," Davis said.

Carder said she got emotional when she learned what Black was accused of doing.

"I cried. When the West Jordan officer called and thanked me (for my help), I cried. It was sad," she said. "I just wish I could have done it sooner. I'm glad the sick sucker is off the street."

Although she does not personally know the Newbold family, Carder lives in the same area as both the Newbolds and Black and knows others who live in the area and have children.

"I'm so glad they caught him," Carder said while expressing remorse for the Newbold family.

Neither Davis nor Carder believe they did anything special, and both credit the fast response of police and their hard work in solving the case.

Bridge, however, believes if Carder hadn't stood up to Black in the parking lot, he may have driven away and possibly committed more crimes against children.

"She's a hero. She saved our Jeep. She saved potential victims. She didn't have to be like that. But she took it upon herself to get our Jeep back," he said.

Carder said it's the police that deserve a "Thank you" and not her. But she's happy to have contributed and helped police find Black, apparently before he had washed forensic evidence off of himself.

Likewise, Davis said she would, "Really like to think if we hadn't pushed (police) in the right direction, he (still) would have been caught."

But she realizes it might not have happened as quickly as it did.

"It's cool to think I could have helped, because I'm so glad he's off the street," she said.

Black's attorney, Ari Chino, was hired by Black's family to represent him in the robbery case, but he said he does not know if he will be involved in the murder case.

"This is going to be a financially taxing case for my client," Chino said. "I don't have any comment on how he's doing or how he's reacting in relation to the new charges."

Black is also facing a single federal count of using force, violence or intimidation to take money from employees at the bank.

SALT LAKE CITY — The Salt Lake County District Attorney will be spending the next few months reviewing the case where a West Jordan man is being accused of raping and killing 6-year-old Sierra Newbold.

District Attorney Sim Gill says he has a big decision to make regarding Terry Lee Black and whether he is to make a capital case where Black could be executed if found guilty.

“We have not taken death off the table,” Gill told FOX 13 on Thursday.

Gill says capital punishment is always a serious consideration under the right circumstances and with the right kind of evidence.

“There has to be discussions with senior staff, discussions with family,” said Gill. “When you’re looking at a serious death-penalty case, it should be a very deliberate and deliberated process.”

A key member in the District Attorney’s Office staff, Robert Stott, has been prosecuting cases since the 1980s. Gill and Stott will be analyzing the Newbold case and learning as much as they can about Black.

When asked if Black could be tied to any other unsolved cases, Gill said he will not be looking at that.

“That’s going to be left to the individual law enforcement agencies and detectives who are working on those cases,” said Gill.

Two possibilities are the unsolved murders of Damiana Castillo in West Valley City and Sonia Mejia and her unborn child in Taylorsville. Both women were killed on Feb. 9 — Mejia in 2006 and Castillo in 2008.

In 2009 the same unknown killer was linked to both crimes through DNA, though no match has been found yet.


Investigators say this serial killer is either a juvenile or someone who never had their DNA put into a criminal database.

Despite Black’s lengthy criminal history, it appears his DNA may not have been in the Combined DNA Index System (CODIS) at the time of his arrest. His DNA information will more than likely be there now and detectives in the Mejia and Castillo murders say it is something they will take a look at to see if there is a connection.

SANDY — When tragedy strikes it affects more than just those directly involved. It affects family, friends, neighbors and strangers.

Those indirectly impacted by the murder of Sierra Newbold showed their support Saturday at a community fundraiser to benefit the Newbold family.

"Everything has been donated by what I call 'silent angels,'" James Canterbury, an organizer of the event and Carvers restaurant employee, said. "We just wanted to relieve what the family is feeling. We united as a staff."

Sponsored and organized by Carvers, the fundraiser featured a bake sale, silent auction and garage sale donated by local businesses and community members with all proceeds going to the Newbold family to try and offer comfort to the Newbold family during the impending trial of Terry Lee Black.

Black, 41, was arrested and charged July 10 in Third District Court with aggravated murder, child kidnapping and rape of a child for the June 26 murder of 6-year-old Sierra Newbold. It is believed that Black entered the Newbold home through a sliding glass door and left carrying Sierra a few minutes later.

Alison Leach, who co-owns Carvers with Bill DeJong said she was impressed by the willingness of people in the community to donate what they can.

"I went to Home Depot and asked them if there was anything they would donate," Leach said. "They let me go around the store and pick $400 worth of merchandise for the silent auction."

Leach also said she has had people donating as little as $5 because that is all they have.

"Everyone gives what they can," she said. "I think it helps them feel that they are helping in some way."

The silent auction featured items from a Vivent alarm system, a Real Salt Lake soccer jersey signed by the team, pre-season Jazz tickes among several other items donated from local businesses and people just wanting to help.

"We're actually Brad's (Sierra's father) cousin and I donated some things as well as purchased," Sharon Newbold said. "It's awesome to see the community out and willing to help."

Also showing their support for the Newbold family and the community was 25 members of the Utah chapter of the Ruff Ryder Lifestyle movement, a motorcycle crew.

"It's for the community. They need another riding crew today," Ruff Ryder member who identified himself as Seven said.

(KUTV) New information has been released in the investigation of the kidnapping, rape and murder of 6-year-old Sierra Newbold.

The search warrants in relation to the case were released on Tuesday to the Salt Lake Tribune.

In this case, the suspect, now booked for Sierra’s murder, may not have left the crime scene for hours. The surveillance video taken from the house shows someone going into the Newbold home just after 2am and, 3 ½ hours later, the suspect was spotted near the burned out field by Sierra’s house.

A homeowner, who lives close to the two burned out homes and the canal where Sierra’s body was found, says he saw a man out his kitchen window around 5:30 am –two hours before sierra was reported missing by her mother.

Joshua Farnworth told police he saw a man “Approximately 60 yards from the location where Sierra’s pajama bottoms and underwear were located.”

The man that Farnworth saw was later found to be Terry Lee Black. He is now booked in the Salt Lake County Jail for allegedly kidnapping, assaulting and murdering Sierra Newbold.

The neighbor, according to the search warrant, kept watching Black. He thought Black was going to “burglarize a truck,” but instead he picked up a bike and rode off.

Search warrants show that when detectives caught up with Black 9 days later he was allegedly covered in ash from the scene described by the neighbor.

The search warrants also show that while boarded windows were open at the burned homes, no evidence was found inside. Police immediately searched the area and found Sierra’s body because her mom said she’d been obsessed with the fire and had been asking to go see it since it had happened.

WEST JORDAN — A neighbor told police he saw a man acting oddly before he rode off on a bicycle the morning that 6-year-old Sierra Newbold was kidnapped and killed, according to newly released court documents.

Six sets of search warrants were unsealed Tuesday in 3rd District Court. The warrants reveal new details about the horrific death of Sierra and the arrest of Terry Lee Black, 41.

Black is accused of entering Sierra's house, 2383 W. 7095 South, just after 2 a.m. on June 26 through an open sliding glass door. The incident was captured on the Newbold family's home surveillance camera.

Prosecutors say Black grabbed Sierra and sexually assaulted her in a nearby field that had been blackened from a fire that burned just three days earlier. Sierra's body was later found floating face down in a nearby canal. The medical examiner determined the cause of death to be drowning.

Neighbor Joshua Farnsworth was standing at his kitchen window that overlooked the burned field about 5:30 a.m. that day, when he spotted a man about 50 yards from where Sierra's body was eventually located and 60 yards from where Sierra's pink Sponge Bob pajamas were found in the burnt field, the search warrants state.

"The male was hunched over at the waist holding his hands out in front of him and appeared to be rocking back and forth," investigators wrote.

The man then walked over to an abandoned truck where he picked a bicycle off the ground and rode off, the warrants state. Farnsworth described the man to investigators as having dark skin, a heavier build, short dark hair, wearing a baggy shirt and long shorts below the kneecaps.

Sierra's pink pajama bottoms were found 100 to 150 yards away from where her body was found. Her body was found in the canal along with a purple blanket that was missing from her room. Sierra's body "appeared to have been pushed up into the reeds on the bank of the canal," a warrant states.

Black was arrested after allegedly stealing a car and robbing a bank on Redwood Road three days later. As he walked back to the stolen vehicle in the parking lot after police say he got $100 from a bank teller, he was confronted by Rena Carder who happened to be stopping by the bank at the same time. She recognized the vehicle as her friend's car.

After confronting Black and telling him he wasn't going to take the vehicle again, Black walked off. As he did, Carder took pictures of him on her cellphone.

Black was arrested a short time later. While being interviewed, investigators noted the black soot on his legs was consistent with the burned field where Sierra's clothing was found. His description was also similar to the one given by Farnsworth.

Search warrants were served at Sierra's house, on her parents' vehicles, on one of the boarded-up homes burned by the recent fire, on cellphone towers in the area and on Black himself.

Suspected blood and other DNA evidence was collected from forensic detectives off of Black's shorts and underwear, according to court documents. Detectives also swabbed different parts of Black's body, took fingernail clippings and a cigarette butt, according to court records.

When interviewing Black, police said he told them he had been kicked out of his apartment by his wife but refused to say when or where he had been staying, a warrant states.

When detectives interviewed Gloria Black, Terry's wife, she said he had left their West Jordan apartment — located a short walk away from Sierra's house — on June 20 wearing the same clothes he was wearing when he was arrested on June 29, according to the warrants.

Black is charged with capital murder, child kidnapping and rape, all first-degree felonies, in Sierra's death. If convicted, he could face the death penalty. Black's next court hearing is scheduled for Oct. 9.

Prosecutors on Friday filed new charges against the man accused of kidnapping and murdering 6-year-old Sierra Newbold, saying he abused another girl a few years ago.

Terry Lee Black, 41, was charged with two more counts of sexual abuse of a child and two more counts of aggravated sexual abuse of a child. Documents filed with the new charges state the abuse happened sometime between 2007 and 2009.

A girl who would have been 11 or 12 years old at the time attended a sleep over with members of Black’s family. Black, according to court documents, entered the bedroom where the girl was sleeping and touched her breasts, put his hands down her underwear and forced her hands to touch his genitals.

The next summer, court documents claim, Black lured the same girl to his apartment and again put his hands down her pants.

The Salt Lake County district attorney on July 10 charged Black with aggravated murder, child kidnapping and rape of a child in the Sierra case. She was reported missing from her West Jordan home and was found dead on June 26.

Court documents and prosecutors in that case claim the girl was abducted from her home, then beaten, raped, strangled and thrown into a canal, where she drowned. Black lived about a block from Sierra’s home and was arrested June 29 in an unrelated bank robbery case. Detectives observed black soot on his hands and clothing similar to what was in the field where some of Sierra’s clothes were found.

After Black’s arrest, a swab from his genitals was obtained and compared to DNA from Sierra’s body. Examiners at the Utah State Crime Laboratory subsequently found Sierra’s DNA profile on the swab taken from Black, according to court documents.

Black remains in the Salt Lake County jail in lieu of $2 million bail.

SALT LAKE CITY — The Salt Lake District Attorney has filed additional child abuse charges against a man accused of killing a child.

Terry Lee Black is the primary suspect in the June rape and murder of 6-year-old Sierra Newbold, of West Jordan.
Investigators have been working on this since Black was charged in connections with Sierra’s case.

The new charges are from a different alleged victim who came forward after seeing Black in the news.

Black now faces four new counts of felony aggravated child sex abuse. Two of the counts are first degree felonies, the other are second degree.

The alleged victim, who was 10 or 11 at the time, says she was friends with Black’s daughter and that he sexually abused her during a summer sleepover three to five years ago. She did not report it at the time.

The same girl told investigators that the following summer, Black lured her over to his apartment, claiming it was for a play-date with his daughter. But when the girl arrived, she said Black was the only one there and that he molested her.
The arrest of Black in June prompter the girl to come forward. She is now a teenager.

Prosecutors said they are glad this person cam forward and claim the allegations are especially important in establishing their claims that Terry Lee Black was a child sex predator well before he allegedly raped and killed Sierra.

Newbold's Alleged Killer Slapped With New Charges
41 year-old Terry Lee Black, already jailed for allegedly kidnapping, raping and killing 6 year-old Sierra Newbold of West Jordan back in June, now faces four new felony charges after a teenage girl told police recently that Black sexually abused her.

According to court documents filed in Utah's Third District Court, the girl, now 16, told police in West Jordan that the alleged abuse happened when she was about 11 years old and a friend of Black's daughter who is about the same age.

The girl said during a sleepover at the Black home, Black went into the girls' bedroom and while his own daughter slept, he reached under her shirt and touched her, then reached into pants and touched her again. The court documents say Black then told the girl to reach into his pants and touch him.

The new allegations have led to four new felony child abuse charges for Black. His case in the Newbold murder is still pending, his attorney recently requested a public defender for Black telling the court that case could become very expensive, especially if prosecutors seek the death penalty.

Man charged in June rape, murder of girl allegedly molested another girl years before.

The man accused of killing 6-year-old Sierra Newbold was arraigned Wednesday on charges he sexually abused another young girl.

Terry Lee Black, 41, is charged in 3rd District Court with two felony counts each of sexual abuse of a child and aggravated sexual abuse of a child stemming from allegations he molested a girl age 11 or 12 on two occasions between 2007 and 2009.

In the first alleged instance, the girl was attending a sleepover with members of Black’s family. Black entered the bedroom where the girl was sleeping and touched her breasts, put his hands down her underwear and forced her to touch his genitals, charges state.

The next summer, court documents claim, Black lured the same girl to his apartment and again put his hands down her pants.

During a brief court appearance on Wednesday, Black was assigned a public defender. His next court appearance on the sex charges will be Sept. 11 in West Jordan.

Black was charged last month with aggravated murder, child kidnapping and rape of a child in the case of Sierra Newbold. On June 26, Black allegedly abducted Sierra from her West Jordan home — about one block from his own home — and beat, raped and strangled her before throwing her into a nearby canal, where she drowned.

Three days later, Black was arrested on suspicion of an unrelated bank robbery. Investigators saw soot and debris on his clothing and hands that was similar to what was in a field where Sierra’s clothes were found. Lab results showed Black’s DNA matched DNA found on Sierra’s body, prosecutors said.

Black’s next court appearance in the murder case will be at a scheduling conference Oct. 9 in West Jordan. He is being held in the Salt Lake County jail in lieu of $2 million bail.

Sierra Newbold's accused killer faces new charges

SALT LAKE CITY (ABC 4 news) - The man accused of killing 6-year-old Sierra Newbold was in court Wednesday, facing new charges that he sexually abused another young girl.

Black is being charged with two counts of aggravated sexual abuse of a child, as well as two other counts of sexual abuse of a child.

Judge Mark Kouris ruled Black met qualifications to be appointed a defender after his attorney declared he had over $10,000 in debt, with no assets that would cover that amount.

A scheduling conference with Judge Kouris has been set for September 11, 2012 at 8:45 a.m. in West Jordan courtroom 31.

WEST JORDAN — The night of June 26th 2012, a 6-year-old girl from West Jordan was kidnapped from her own bed and her body was found in a nearby canal. The horrific story haunted the dreams of people across the country. Today our hearts are still captured by Sierra Newbold.

Brad and Kathy Newbold both spoke about Sierra at a memorial ceremony held in her honor in October.

"No matter how small, people are people and she was a person," said Brad Newbold, Sierra's father.

Sierra's mother Kathy remembers her daughter fondly.

"I could see Sierra sitting on the bench with a big smile, just very happy," Kathy said.

The morning of June 27th, Kathy called 911 saying their sliding door was open and her daughter was not in her bed. An entire community began the search for Sierra.

"It's a crime you just can't imagine-- someone coming into their home, taking your daughter out right under your nose and killing her," said neighbor Lee-Ann Luke. "You just can't imagine it."

Sierra's body was found in a nearby canal. It took three days for police to find and arrest 41-year-old Terry Black, who was a neighbor and member of the Newbold's LDS ward.

It's a crime you just can't imagine-- someone coming into their home, taking your daughter out right under your nose and killing her. You just can't imagine it.

"I'm not going to say that it's not divine intervention. I myself believe it as divine intervention," said Doug Diamond, West Jordan Police Chief.

Police arrested Black on an unrelated robbery. Once in custody, they started putting pieces together. They learned he lived in an apartment complex near the canal where Sierra's body was found and he had charcoal on his pants also found on Sierra's pajamas. A forensics test concluded Black was their suspect.

"My heart, my mouth, everything just dropped when I looked and saw that it was Terry," said Eldon Thomas, neighbor or Black.

Black has been charged with first degree aggravated murder, child kidnapping, and rape of a child.

A status review hearing is scheduled for March 4th and the preliminary hearing is set for July 29th. If the judge finds probable cause, the case will then head to the district court where they will determine a trial date.

Terry Lee Black, 41, was ordered to appear in 3rd District Court for a preliminary hearing on July 29. Prosecutors anticipate at least three full days of testimony from witnesses and experts that will include DNA and crime scene analysis.

Black is charged with aggravated murder, child kidnapping and rape of a child in the Sierra Newbold case. He is also charged with molesting another girl several years before, and robbing a bank. The hearing will cover all of these charges.

It’s been a year since Antolin Garcia Torres, 22 of Morgan Hill, was arrested and charged with the kidnap and murder of 15-year-old Sierra LaMar.
Absurdly, Torres has not even entered a plea in the case.
This is a textbook example of why the public is so frustrated with the justice system which is replete with multiple stops and very few starts.
There are, of course, legitimate reasons for delays, but the system has become one that recognizes the drop of a pin as a reason to stall for months.
It’s time for judges like Superior Court Judge Sharon Ann Chatman to use the gavel and authority invested in the justice system to move cases along, not just in high-profile cases like this but in general. Unfortunately, the system is training the lawyers such that they believe they are in total control regarding when cases will move forward. It’s a culture that breeds inefficiency and frustration among those – like Sierra LaMar’s family – who are waiting for the wheels of justice to turn.
Though it may be a political gamble – nobody within the justice system wants to anger a judge – District Attorney Jeff Rosen should strongly consider bringing some heat to bear when it comes to cases that are on the stall track to nowhere. Contrary to apparent current thinking, justice and reasonable speed are not mutually exclusive.
Making the case against unreasonable requests for delays is serving the public. Who in the justice system, for example, would not draw a parallel between the difficulty in fielding a jury and the slow-boat-to-China nature of the justice system?
Of course there will be the familiar refrain that justifies the ad infinitum delays with “We don’t want to give them grounds for appeal.”
Denial of unreasonable delay requests should not be grounds for appeal. The sooner that message begins to be delivered by judges and district attorneys, the sooner the public’s faith in the justice system will once again become strong.
Without an insistence that the wheels of justice move more quickly, the slope to injustice for victims, their families and the public will become ever more slippery.
