I think you're right..but doubt ANY judge would be 'sympathetic' to Hodi. She is probably hoping for a MALE judge so she can bat her eyes and put him in that hypnotic trance like she did w/Samuels and many more before him..cause that's how she rolls.

PHOENIX Jodi Arias' lawyers are asking a judge to sequester the jury in her second trial to shield the panel from the intense publicity that enveloped her first trial, which ended with a murder conviction but without a sentence.
Arias was convicted of first-degree murder May 8 in the 2008 stabbing and shooting death of boyfriend Travis Alexander in his suburban Phoenix home. The same jury failed to reach a decision on whether she should get the death penalty, setting the stage for a second penalty phase.
While the judge has yet to set a new trial date, Arias' attorneys filed a motion this week seeking to have the new panel sequestered "to ensure that the jury is not exposed to community and/or media influence."
The motion filed Thursday cites thousands of television news shows and newspaper articles about Arias throughout her roughly five-month trial, as well as a recent Lifetime movie about the case that attorneys said attracted 3.1 million viewers.
Arias' lawyers claim the same intense publicity will no doubt come with a second penalty phase and will hinder her ability to get a fair trial.
"This integrity is in the most danger of being compromised when the process is contaminated by outside influences," the attorneys wrote. "Given what took place in the last trial and the propensity for history to repeat itself, it is certainly beyond legitimate dispute that the threat to the integrity of the retrial is severe."
Prosecutors have not yet filed a response.
The motion comes on the heels of several others filed recently. One seeks to have the retrial moved out of the Phoenix metropolitan area because of excessive publicity and to prohibit live television coverage. Another motion filed last month seeks to have the judge compel all jurors eventually seated in the second trial to reveal their Twitter user names so Arias' lawyers can monitor their accounts to be sure they're not communicating about the case.
Under Arizona law, while Arias' murder conviction stands, prosecutors have the option of pursuing a second penalty phase with a new jury in an effort to get a death sentence. If the second jury fails to reach a verdict, the death penalty would be removed as an option, and the judge would sentence Arias to ether spend her entire life behind bars or be eligible for release after 25 years.
Arias, 33, admitted she killed Alexander, but claimed it was self-defense after he attacked her. Prosecutors argued it was premeditated murder carried out in a jealous rage after the victim wanted to end their affair and planned a trip to Mexico with another woman.

Like with her antics and the daily news coverage she really thinks she can get a jury that knows NOTHING?
The concept of knowing about a case but being able to make a fair decision is completely beyond Jodi's understanding. Because it requires TRUTH and she is incapable of that.

In just a few weeks, a jury could decide whether Jodi Arias will get the death penalty for the brutal murder of her ex-boyfriend Travis Alexander in 2008.
Considering the United States has executed just 13 women in the last 40 years, it would be highly unusual if she did get death.
Women committed fewer than 10% of all murders in America between 2000 and 2010, a Wall Street Journal analysis of crime data found. However, women defendants only make up 2% of death row, according to a recent report by the NAACP.
Even fewer women actually get executed, Death Penalty Information Center executive director Richard Dieter told Business Insider.
"There's just less enforcement of the death penalty at almost every stage for females," he said.
There are two major factors that contribute to the low number of women who get capital punishment, Dieter says: the nature of the crime and how juries view women in general. The death penalty is often used for killers who also commit other felonies like robbery or rape, law professor Victor Streib has previously told the LA Times.
Many of the murders women commit, on the other hand, involve people they're related to.
While women commit about 10% of murders, they were responsible for 35% of murders of intimate partners between 1980 and 2008. Most juries consider those crimes of passion arising from disputes — one-time offenses, Dieter said. Because of the high rate of domestic violence against women, though, juries don't give men the same benefit of the doubt.
On the other hand, most states consider killing a child an aggravating factor, or a reason for prosecutors to seek the death penalty. Hiring someone to do the work could also land a woman on death row. "If a woman hires someone, there's a coldness, a calculation. It's different than something that arises out of an argument," Dieter said.
Teresa Lewis, for example, plotted to kill her husband and stepson for the insurance money. "Instead of pulling a trigger on a gun, she pulled a couple of young men in to pull the trigger for her," prosecutor David Grimes told a judge at the time, The Washington Post reported. She was the first woman Virginia sentenced to die in more than 100 years.
But the second factor — the jury's perception of the "fragile" female psyche — can overpower aggravating factors. "It's just easier to convince a jury that women suffer emotional distress or other emotional problems more than men," Streib told the LA Times.
Take Susan Smith. She killed her two sons by backing her car into a lake while they sat in the backseat. But when the jury heard about her abusive childhood, they took pity on her, Dieter said. She only got a life sentence — with parole. In TruTV's coverage of her story, the headline reads: Child Murderer Or Victim?
"These 12 people [the jury] are asked to see if this person has any redeeming qualities. And they often see their own mother or wife or grandmother, not someone who will continue to be a threat to society," Dieter said. "Jurors just see women differently than men."
Of course, most women aren't going to argue for gender parity in the death penalty, Dahlia Lithwick has written in Slate. Only 59% of women favor the death penalty compared to 67% of men, according to a 2013 Gallup poll.
"For equality's sake, you think that women would want the death penalty pursued more often," Dieter said. "But of course, they don't."

These Are The Only 12 Women Executed In America In The Past 40 Years
1.) Velma Barfield, a drug addict from North Carolina, forged her boyfriend's checks to fund her habit. Fearing he might find out about a $300 forged check, she poisoned his beer, the Associated Press reported. As the first woman sentenced to die in 22 years, Barfield eventually confessed to killing three others, including her own mother, The New York Times reported. She died by lethal injection in 1984.
2.) Karla Faye Tucker and an accomplice wanted to end three days of drug-induced shenanigans by stealing a motorcycle. So they killed the owner of the bike and his friend with a pickax in 1983, CNN reported. Sentenced to die for her crimes, Tucker became a born-again Christian and waited for a pardon until hours before her lethal injection. She was the first women Texas executed since the Civil War.
3.) Judy Buenoano poisoned her husband and drowned her son, earning her the name "black widow," CNN reported. Buenoano attempted to bomb her fiancè's car in 1983, which then led investigators to realize she had drowned her partially paralyzed son and poisoned her husband years earlier. She died in 1998 in Florida's electric chair.
4.) Betty Lou Beets shot and killed her fifth husband in 1983, CNN reported. She claimed she was a battered wife and killed him in self-defense in an attempt to get clemency from then Gov. George W. Bush. He rejected that claim. In 2000, Beets became the second woman executed in Texas since the Civil War.
5.) Christina Riggs tried and failed to kill her 5-year-old son and 2-year-old daughter by injecting them with potassium chloride, BBC reported. Instead, she smothered them with pillows. She died in 2000 — the first woman Arkansas executed in 150 years.
6.) Wanda Jean Allen got the death penalty by lethal injection for killing her lover Gloria Leathers, whom she met in prison, USA Today reported. The American Civil Liberties Union wrote a letter for her clemency. The letter said she had severe, untreated mental disabilities that prosecutors knew about but never revealed during court proceedings. When she died in 2001, she became the first black woman executed since 1954.
7.) Marilyn Plantz plotted with her lover and another man to kill her husband and collect on his $300,000 life insurance policy, BBC reported. The two men bludgeoned her husband to death while her children sat in another room. Jodi Arias trial hearing transcripts have been unsealed and have been released. It is becoming clear that the most dramatic moments are still coming to light. The transcripts show that one of the key witnesses never testified. Jodi Arias’ childhood friend, Patricia Womack, was supposedly under death threats, but the transcripts suggest that she may have bowed out at the last minute out of fear of what the prosecution would say about her.
Jodi Arias was working as a waitress while she was learning photography who jurors found guilty of the June 2008 premeditated first-degree murder in the violent murder of her ex-former boyfriend, Travis Alexander who was 30 at the time of the slaying. The killing was gruesome, in two minutes Jodi Arias stabbed her boyfriend almost thirty times, shot him in the face and slit his throat so violently his head almost came off.
Jodi Arias maintains that she acted in self-defense, but the jury didn’t want to hear it. For someone to do something this drastic, this quick, who had no history of violence, or indications what she could be capable of this kind of extreme violence, Jodi Arias must have something in her past that was triggered.
Judge Sherry Stephens dismissed the hung jury and ordered a status update on July 16 to see if the Jodi Arias trial will move into another penalty phase or if they will table the death penalty under a plea deal.
Jodi Arias lied to police about how her involvement with Alexander. Jodi Arias at first said she had nothing to do with his brutal death. Arias finally admitted that she did kill Alexander. She said she had to fight for her life when he attacked her during a nude photo shoot. The jurors did not believe Jodi Arias’ claims of self-defense, but they couldn’t decide whether to put her to death or sentences her to life in prison. Arias went on TV and said she preferred death to life in a cage. She changed her mind and asked for leniency for her family’s sake.
Judge Sherry Stephens hid some of the most contentious content of the trial in court sidebars that the public didn’t see in the highly-publicized live video feeds of the proceedings. The Arizona Republic got the trial transcripts and described the behind-the-scene happenings as very intense. Both sides looking for blood. The transcripts show that the prosecutor Martinez and Arias' defense team were at each other’s throats and resorted to insults many times. Arias' lawyers tried to get the prosecution cited for misconduct, but none of claims stuck.
The transcripts show that Patricia Womack never testified because she was supposedly under death threats. Womack refused to appear on the last day of court. Patricia Womack was a key final witness for Arias. The transcripts show that Martinez told the Judge that she had a drug problem and was skipping her trial date because she was afraid she could be found guilty of violating welfare regulations. Martinez is also heard saying that Womack was hiding money she made from pictures she had sold to a TV station.
Kirk Nurmi, one of Jodi Arias’ attorneys pleaded to Judge Stephens that the case should be thrown out, and that Arias should be retried because Womack refused to testify because she received "threats on her life if she were to testify on Ms. Arias' behalf."
Jodi Arias’ lawyers also requested the names of jurors’ Twitter accounts. The attorneys for Jodi Arias want to monitor the jurors’ Twitter accounts to make sure they’re not tweeting details about the Jodi Arias murder trial on the social media site.
The first Jodi Arias trial ended with a conviction but not a sentence. Jodi Arias' murder conviction stands. Under Arizona law, prosecutors have the option of pursuing a second penalty phase with a new jury to get the death sentence. If the second jury fails to reach a verdict, the death penalty would be removed as an option. The judge will then sentence Jodi Arias to life behind bars or be decide that she may be eligible for release after 25 years.

I know it's late.....but I can't sleep. I was just thinking about the hearing set for Monday in the Jodi Arias case. It was reported that a 'Motion for Continuance' had been filed today. Many, myself included thought the defense had filed this motion. But what I'm finding out is that Juan Martinez filed this motion. Perhaps because he is still in verdict watch for his trial.....with the jury still deliberating. I'm sure the judge will grant this motion.....and I'm sure the defense won't object to it. But never say never.....they never cease to surprise us!
We will always remember Travis Alexander. He will always have a special place in our hearts. We've grown so fond of his precious family too. They have been thru so much and yet they still stand in such grace thru all of this. Please know we will be here for you all to the end of this trial....no matter how long it takes.
We will be Travis' voice, until his voice is finally heard. We simply want 'Justice for Travis'.......and we pray we will soon get that. We want to know that Travis can rest in peace.....and we want to know his murderer will be convicted and this phase of the trial will come to an end.
Leave your thoughts and comments to Travis' family as they frequent our page often. God be with you all Tanisha Sorenson and Harold and the other siblings. We are here for you all!

“The Court asked if the parties would be willing to discuss a potential settlement,” said Maricopa County Attorney spokesman Jerry Cobb. “Consistent with what the County Attorney has said all along, the State is always willing to discuss possible resolutions to the case. Neither side has presented an outline of an agreement or an official position to the Court.”
Cobb said the conference will be made in front of retired Maricopa County Superior Court Judge James Keppel.

Arias, 33, has already been found guilty of first-degree murder, and there are three sentencing options: death, natural life in prison, or life with a chance of release after 25 years.
Under state law, prosecutor Juan Martinez and his boss, County Attorney Bill Montgomery, need a jury to get a death penalty.
They do not need a jury or an agreement from Arias to get a life sentence; all they need to do is drop the intent to seek the death penalty and the decision would then go to Judge Sherry Stephens. And in the unlikely event that Stephens were to impose a sentence of 25 to life, there is no longer any mechanism to facilitate a release short of clemency granted by the governor.

If Arias is sentenced to life in prison, her appeals would go instead to the Arizona Court of Appeals, then to the Arizona Supreme Court and then back to Superior Court for what is referred to as “post-conviction relief.”
And what does Arias have to offer the state? Mostly avoidance of another several months of expense and judicial circus if she does not have to go back to trial.
Arias also has an evidentiary hearing this Friday, which, like the list of Arias’ mitigation witnesses, will be sealed.

Sounds to me as if her only choices are death or life without parole. Having been found guilty of 1st degree murder, she won't get parole in 25 years. I wonder how martinez feels about this settlement conference as opposed to going to a new penalty phase trial? If nothing else, they need to stipulate she can't be online through friends blogging and/or on twitter. And she can't write letters to Travis's family or she'll be torturing them for years to come.

I agree Sam. I don't think she can legally contact Travis' family anymore now that she's been convicted, but I'm not sure that's the law in AZ.
I noticed that there is an Evidentiary Hearing set for this Friday. The Defense wants something precluded from evidence that points to the "Mediating Factors" that qualify Hodi for the DP.
If they are unsuccessful getting this evidence excluded from the Penalty Phase it means 1 of 3 things for Martinez. 1)He's more motivated to move forward with the DP, 2)it locks Hodi into a life with no parole verdict, 3)it's a bargaining chip to make her agree not to go through with the appeal process.
The Defense spent the entire trial giving themselves grounds for an appeal, so I highly doubt they are willing to enter into a deal that would cause Hodi to give up that option.
Plus the state of AZ is paying for her Defense, so it's really only the District Attorney that's concerned with the trial costing the taxpayers more money. He's an elected official. It's in the best interest of his political career to get this over with.

Good Thursday October 3 morning dear family of fans,
New minutes regarding the trial for Travis were filed yesterday .
The parties have agreed the pretrial hearings and oral arguments scheduled for October 4, 2013 and October 18, 2013 should be closed to the public.
This is no surprise as this is what we anticipated . I expect all will be closed . We will know very little, if anything , until and if there is a new trial!
We trust Juan will fight as always , and make all the right decisions for Travis and his family. We so miss seeing him in this pursuit for justice.
It is nice to know and see Juan as he is involved with activities in his legal community. As a member of the Maricopa County Bar Association, he was a guest speaker at the 2013 Arizona Paralegal Conference at the Hyatt Hotel in Phoenix, held this past Friday.
He also read a proclamation that September 27th is now officially Paralegal Day in Arizona.
Congratulations Paralegals! They are so very important to Attorneys and our legal system.
