CNN's attorney, David Bodney, continues to argue before the Court (Judge Stephens) to have media coverage/live coverage in all of the hearings and her trial. They are presenting legal briefs for live coverage.

One of Mr. Bodney's arguments is in regards to the fact that Jodi Arias did media interviews herself.

Who can forget her numerous interviews she did.....after the guilty verdict....demanding makeup, her hair done, wearing a sweater and DEMANDING that they were not to show her below the waist because she had on jail stripes and chains? Yep, she sure was worried about the media then, wasn't she?

Convicted murderer Jodi Arias slammed rumors about her family and told the world via Twitter on Thursday that she is trying to file for bankruptcy.

Arias wrote, “That rumor that somehow my family profited from my trial? Absurd.”

She added, “I'm filing for bankruptcy (if I can ever afford to do so).”

Jodi, who is facing life in prison or a death sentence for killing ex-boyfriend Travis Alexander, failed to further explain the rumors about her family.

While Arias continues to sell her artwork online, she isn’t likely to cash in on her notorious crime.

Arizona’s Son of Sam law prevents criminals from profiting through book and movie deals.

Next up, Jodi, her defense attorney and prosecutors will meet October 24 to discuss a possible settlement that could take the death penalty off the table.

PHOENIX - Jodi Arias has sought the spotlight at every turn, granting national television interviews in the months after her arrest, another on the day of her conviction, and about a half dozen the day jurors began deliberating whether she should live or die for her crimes.

Now facing a retrial to determine her sentence, Arias' lawyers are asking a judge to bar live TV coverage inside the courtroom, an irony not lost on prosecutors and a lawyer representing CNN.

"She has voluntarily thrust herself into the vortex of this public controversy," the news network's attorney, David Bodney, told the judge at a hearing Friday. "It is unfair to deprive the public ... because someone can't control her own speech."

Arias was convicted of first-degree murder May 8 in the 2008 stabbing and shooting death of boyfriend Travis Alexander in his suburban Phoenix home. The same jury failed to reach a decision on whether she should get the death penalty, setting the stage for a second penalty phase.

Arias' attorneys are arguing that the same intense publicity that enveloped her trial will no doubt come in the second penalty phase as well, hindering her ability to get a fair trial. They also are seeking to have the new jury sequestered, citing thousands of television news shows and newspaper articles about Arias throughout her roughly five-month trial, as well as a Lifetime movie about the case that attorneys said attracted 3.1 million viewers.
In addition, Arias' lawyers want the retrial moved out of the Phoenix metropolitan area because of excessive publicity, and they want the judge to compel all jurors eventually seated to reveal their Twitter user names so the accounts can be monitored to ensure jurors aren't communicating about the case.
Arias herself has operated a Twitter account, even throughout the trial, using a third party to post comments on her behalf as she remains jailed. As of Friday, she had more than 78,000 followers.
In one recent motion, prosecutors shot back, noting that the defense efforts fail to acknowledge Arias' "own role in creating publicity about the trial."
"She cannot create what she now considers a problem and then expect the court to change its procedure to solve the problem," the motion read.
The judge excluded the press and the public from the remainder of Friday's hearing, despite objections from various media outlets. No rulings have yet been issued on any of the defense motions.

Under Arizona law, while Arias' murder conviction stands, prosecutors have the option of pursuing a second penalty phase with a new jury in an effort to get a death sentence. If the second jury fails to reach a verdict, the death penalty would be removed as an option, and the judge would sentence Arias to ether spend her entire life behind bars or be eligible for release after 25 years.
Arias, 33, admitted she killed Alexander but claimed it was self-defense after he attacked her. Prosecutors argued it was premeditated murder carried out in a jealous rage after the victim wanted to end their affair and planned a trip to Mexico with another woman.

There will be an ORAL HEARING held in Phoenix, AZ, Maricopa County tomorrow. This will be another 'closed hearing' to the public and/or media. It is a closed hearing on the motions but none of the motions have yet to be decided.

How many times has Jodi Arias lucked out throughout the beginning of her trial and hearings? She has lucked out time and time again in her fight to avoid the death penalty for killing Travis Alexander after the judge in her case has delayed her trial time and time again.

Judge Sherry Stephens moved the hearing date forward, allowing Jodi Arias a reprieve from her impending retrial in the sentencing phase after a jury found her guilty of extreme cruelty and first degree murder but deadlocked over the death penalty.

Jodi, 34, has been in the Maricopa County Jail since 2008 where she is able to communicate with fans on the outside and continues to Tweet sarcastic notes to her thousands of followers.

Her defense attorneys, Kirk Nurmi and Jennifer Willmott, have submitted multiple motions to delay the hearing, to restrict the juror’s social media access, to have them sequestered and to deny live media coverage of the trial.

They are also seeking a change in venue, arguing that the exposure of Jodi’s trial in the area precludes her from receiving a fair trial.

Jodi will automatically get life in prison if the second jury is unable to reach a unanimous verdict. Judge Stephens would then decide whether she is given life without parole or life with the eligibility of parole after 25 years.

We can only hope.....that tomorrow will move us closer to a trial date for the final phase of her trial, the penalty phase. At this point, we are almost sure it will be 2014 before we see a trial setting. In the meantime, Jodi continues to tweet.....in her own sarcastic ways. We are ready for this to be over!

It’s a phrase more often associated with famed painters and artists than convicted murderers, but Jodi Arias’ art website has announced that they were releasing a “limited edition” print run of her latest jailhouse drawing, “Sailing at Sunset.”
“She’s able to have access to paper and purchase color pencils, and if she wants to release her property to someone outside, she can,” said Chris Hegstrom, spokesman for the Maricopa County Sheriff’s Office that oversees Arias’s incarceration.
Arias was found guilty in May of stabbing and shooting to death her ex-boyfriend, Travis Alexander. The jury that convicted her could not agree whether Arias should receive the death penalty, and so Arias has not yet been sentenced. She remains in a women’s prison in Maricopa County, Ariz., where she is forbidden from using cell phones or computers.
Still, Arias has managed to Tweet and sell artwork online anyway, according to her websites. Attempts to contact the owners of JodiArias.com have not been returned. Arias’ friend Donavan Bering claimed she was running the Twitter account during the trial, but Bering could not be reached by ABC News today for comment.
In January, shortly after Arias’ murder trial began, her artwork appeared on eBay listed at prices of $300 to $400. It is unclear how much her current drawings cost. At that time, descriptions listed with the art noted that the profits would go to costs associated with the trial, including paying for Arias’ family to travel from their homes in California to Arizona for the five-month trial.
The current drawings listed on JodiArias.com are portraits of celebrities, women’s faces, and nature scenes.
“She’s not physically running a business from our jail,” Hegstrom said. “I can’t stop her from talking on the phone or releasing property.”
It is unclear where the money from profits ends up, though Hegstrom said people outside of the jail can put money in Arias’ commissary fund.
The Twitter account under Arias’ name recently sent a message saying Arias was bankrupt. She also tweeted that her parents and aunt and uncle were bankrupt, but deleted the latter messages from the account shortly thereafter.
Arias’s parents did not return calls from ABC News seeking comment.
Hergstrom warned that sheriff’s office officials cannot verify that the drawings are actually done by Arias.

A judge has ruled that the public and media will not be allowed at a settlement conference Oct. 24 in the trial of convicted murderer Jodi Arias.

Judge Sherry Stephens issued the written order Monday morning, citing intense media coverage in her ruling.

"The court finds there is a compelling interest that overcomes the right of public access," Stephens said in her ruling.

Stephens said an open proceeding "presents a clear and present threat to the due administration of justice, specifically, the right of the parties to a fair penalty phase trial by an impartial jury."

Stephens said, "Specifically, there is a substantial probability that publication of information provided during this settlement conference could taint the jury pool and significantly impact the parties' ability to effectively present matters at trial."

Stephens also said the presence of the public or media might inhibit the free flow of information, "including statements by the victims and/or the defendant.

"This is especially important here since the only issue for the jury will be penalty," she said.

Attorneys on Friday morning were in court to hear motions on her upcoming sentencing retrial.

The hearing is closed to the public.

Maricopa County officials say no settlement has been reached in the Arias case, but there are plans for the attorneys to meet next week to discuss a possible plea deal.

Maricopa County Attorney spokesman Jerry Cobb said the settlement conference will be made in front of retired Maricopa County Superior Court Judge James Keppel.

Settlement conferences are usually handled by a judge other than the one who presides over the case.

Arias' attorneys filed a motion to block live video cameras from the sentencing phase, which would be a radical departure for the case that drew interest from around the world.

The death penalty trial was broadcast live on cable news networks and streamed online, including on cbs5az.com/live.

Arias was found guilty May 8 of first-degree murder in the death of her ex-boyfriend Travis Alexander, but jurors couldn't agree on a sentence, and Stephens declared a mistrial in that portion.

A new jury could decide if Arias will serve life in prison or receive a death sentence.

I can't believe Sheriff Joe is letting her get away with selling limited edition art, or any art. It's just ridiculous that she is profiting off of Travis's death. I would think Travis's siblings could block her from making money off him.

I really hope they don't block cameras from the whole final penalty phase. I want to see her face when they give her their verdict. Either way it goes, she hopefully won't be able to draw and sell her drawings once she is transferred to prison.

Jodi Arias will be back in court Thursday morning as attorneys will meet with the judge to discuss the status of the penalty phase retrial.

But cameras will not be in the court room -- the conference is closed to the public and media, but Jodi herself has been putting the case in the public eye by operating a Twitter account and still tweeting through a third party.

Jodi Arias, who admitted to killing her boyfriend Travis Alexander in 2008, is broke. She has even taken to Twitter to appeal to the general public to give her money.

The Justice4jodi.com website explains why Arias has made the appeal, explaining that legal fees have basically exhausted her funds:

This trust is for payment of the beneficiary’s legal expenses related to the appeals of her pending criminal case, including without limitation; attorney fees, investigator fees, expert-witness fees, transcript and filing fees. Please note: any donations made are not tax-deductible.

Jodi Arias is due in court today for a possible settlement which could remove the death penalty as an option from the agenda. In which case the judge would decide between life and natural life in prison.

More than four months of testimony passed until a jury found Jodi Arias guilty of murder. Although the legal system also meant that she was eligible for the death sentence the jury could not agree unanimously to give it to her.

Bill Montgomery, the Maricopa County Attorney, said that the state is still seeking the death sentence against Jodi Arias but would consider resolving the case without another trial.

No cameras will be allowed in the courtroom today as the hearing is closed to the public and the media. Jodi Arias seems to be keen to put the case back in the news and to get some public attention, and as per her Tweet, hopefully a bit of cash.

It remains to be seen what the outcome of Thursday’s court hearing will be and whether Arias will receive the death penalty or a lighter sentence.

Jodi Arias, who has been convicted of first-degree murder in the 2008 death of her boyfriend, Travis Alexander, but has not yet been sentenced, filed motions in Maricopa County Superior Court Tuesday to fire her main defense attorney.
Arias said in a 12-page handwritten narrative that her lead attorney, Kirk Nurmi, had not seen her since May 23, the day the jury reached an impasse on whether to sentence her to life or death. She claimed that she attempted to fire him in June as well, but Judge Sherry Stephens did not grant her request.
Arias writes that Nurmi has an “utter poverty of people skills,” and “has little to no tolerance for my emotional and psychological shortcomings.” She offered, as an example, her emotional reaction when the defense played in open court a lurid recording of a phone call between Arias and Alexander; Arias said she wanted the tape to be played in a closed courtroom only to the jury and not to the general public.
Nurmi could not immediately be reached for comment on Arias’s motion.
Arias, however, speaks kindly of her second-chair attorney, Jennifer Willmott, who she said has borne the brunt of the work in the case.
Arias was in court today for a settlement conference before retired Maricopa County Superior Court Judge James Keppel. A court spokesperson relayed the message that no agreement had been reached and that Keppel was referring the case back to Stephens. The lack of a deal was not surprising, given that there is not much room for negotiation: Arias is already convicted of first-degree murder, which carries the options of a death sentence, natural-life sentence, or life with a chance of release after 25 years.
A death sentence can only be imposed by a jury, so the only discussion points would have been whether the County Attorney’s Office would drop the intent to seek the death penalty and whether Arias would waive further appeals.
Earlier, Nurmi declined comment on the settlement conference, as did Maricopa County Attorney Bill Montgomery.
In his regular press conference Wednesday, Montogery explained that he did not personally attend the settlement conference as he originally intended, because the “case is no different than any other case,” he said. “I don’t see it as an important enough case to where I have to be personally involved to where I can’t have the prosecutor who’s responsible for the case take care of it himself.”
Arias, 33, was convicted of first-degree murder for killing Alexander in June 2008. Alexander, 30, was found dead in the shower of his Mesa home. He had a slit throat, a bullet in his head and nearly 30 stab wounds in his body. Arias admitted killing him but claimed she acted in self-defense. Because the jury could not reach agreement on whether to sentence her to life or death, Arias faces a sentencing retrial.
Arias has another court hearing scheduled for Nov. 1.

No deal was reached during Thursday's settlement conference for Jodi Arias, according to Maricopa County Attorney's Office spokesman Jerry Cobb.

The case is proceeding to the retrial penalty phase.

Lawyers on both sides of the Arias case were in court for the closed-door meeting as they tried to work out a settlement that could have put an end to one of the most-watched murder trials in history.

"She did the right thing from a legal standpoint," said defense attorney and legal analyst Ulises Ferragut who has closely followed the case. "I don't think this is necessarily, 'Jodi wants the spotlight.' I think this was a well-rehearsed and choreographed legal strategy."

Ferragut says as a result of her decision Thursday, she will retain all of her rights to appeal in the future. If she's sentenced to death, her case would automatically be reviewed by the Arizona Supreme Court, and could go all the way to the U.S. Supreme Court.

"Historically, the percentage of cases that get overturned on appeal for death row inmates is much greater, almost 50-percent conviction rate, that is overturned," Ferragut said. "Whereas, if she is not given death, her appeal chances are much lower."

No date has been set for a penalty phase retrial. A judge must first rule on a number of motions filed in the case. A new jury must then be seated.

After more than four months of testimony, a jury convicted Arias of first-degree murder in May. While they found her eligible for the death penalty, they could not unanimously agree to sentence her to it.

Since then, prosecutors and Arias' defense team have been preparing to retry the penalty phase. Arias' first-degree murder conviction is not at issue -- only her sentence.

A spokesman for the family of Travis Alexander told 3TV Thursday that they're pleased with prosecutor Juan Martinez and the county attorney's handling of the case. However, there will be no comment until the end of the sentencing phase.
