Judge to Decide Whether or Not to Try as Adult 15-Year-Old Suspected of Killing a 9-Year-Old

The 15-year-old who killed or caused the death of 9-year-old Elizabeth Olten, according to her lawyer, has extenuating "circumstances." Barring the 15-year-old being mentally challenged to the point of not knowing right from wrong, however, it would be difficult to see what kind of "circumstances" could exist that would not have the judge render the decision to have the girl tried as an adult. That the 15-year-old suspect had the wherewithal to secrete the body in the woods implies mental presence of knowledge of right and wrong, which means that Valentine might be looking toward a non-nurturing environment as a defense for his client.

And his reference to the girl as a "child" is manipulative, not factual. Fifteen years places a person developmentally in the stages of adolescence and young adulthood. The judge will no doubt order a psychiatric evaluation to determine the suspect's soundness of mind, temperament, and mental capacity.

But where to draw the line? Not knowing the circumstances of Elizabeth Olten's death or the manner in which she died, it is difficult to determine how the judge might proceed. And the decisions that the judge will make cannot be simple, either. A girl's future hangs in the balance. Questions need to be answered. How was the crime committed? What were the circumstances? How should matters proceed for an adjudication to be effectively rendered? How does one protect the rights of the individual? Does society need to be protected from the suspect?

In short, how does one find justice for the death of a 9-year-old girl?

Elizabeth Olten Suspect Hearing Open to the Public
COLE COUNTY - A Cole County judge ruled the certification hearing for the suspected killer of Elizabeth Olten will be open to the public.
In a closed-door meeting Wednesday, Cole County Judge John Beetem decided to open the hearing next month to determine if the suspect in Olten's death can stand trial as an adult.

By opening the November hearing, the judge will permit the general public to attend. If the suspect is tried as an adult, the suspect's name and gender will be public information. Authorities have asked media not to release this information about the suspect.

The suspect's attorney said Wednesday the publicity from the Olten's death will make it impossible for his client to get a fair trial. The prosecution said the Missouri Supreme Court previously ruled this type of hearing be open because of the severity of the crime.
Beetem also held a closed detention hearing and decided to continue holding the juvenile suspect in custody.

The family of the nine-year-old said their final goodbyes Wednesday at a private service.

As the wait continues for the November 18 certification hearing for the teen suspect accused of murdering Elizabeth Olten, we are learning more about this teen girl suspect through alleged social networking websites and online profiles.

The teen girl suspect has an alleged YouTube page where a profile is listed and a number of videos are posted. One of the subjects under the profile is hobbies. The hobbies listed on the teen girl suspect’s alleged page? The words “cutting” and “killing people”. Also on the page are a couple of homemade videos that are equally disturbing, including a video allegedly showing the teen suspect getting shocked by an electric fence, and laughing about it! It has not been confirmed that this is the teen suspect’s YouTube page, and the last time the user of that page logged onto the website was a year ago.

First there’s YouTube, then there’s twitter.

The teen suspect’s alleged twitter page was found, and although the postings have since been deleted, we have learned some of what was allegedly posted on that twitter page. Some of the discussions on the twitter page included talk of “addiction”, and “terrors”. We do not know for sure if this is the teen girl suspect’s twitter page, but if it is, it paints a scary portrait of a girl accused of premeditated first degree murder in the slaying of 9 year old Elizabeth Olten. It has not yet been determined if the teen will ultimately be tried in adult court – that decision is upcoming…the certification hearing just weeks away.

I saw that video of her purposely shocking herself on the electric fence. (I've accidentally done that and it was a highly unpleasant feeling.) While the worlds been watching these videos on utube and twitter, where are the parents of these children? What in the hell?
She could do that to herself and her brother... one can only guess what terror Elizabeth felt.
I hope that Karma dishes out a similar form of Terror on this girl one day very soon. :lightning:

I think they are right to keep her incarcerated... she is likely to get hurt by others if she is freed.

or hurt herself. try her as an adult. IMO. she is no longer an innocent child. she knew right from wrong.
