ORLANDO, Fla. -- Equusearch founder Tim Miller has agreed to be deposed by Casey Anthony's defense team.

A hearing was held on Friday to discuss Miller's status as a material witness in the murder case against Anthony and which documents would be turned over.

At that hearing, Anthony's defense team announced its defense strategy. Attorney Jose Baez argued that Miller’s search near where Caylee's remains were later found proves that the toddler's remains were not in the wooded area at that time. Baez said that since Anthony was in jail, she could not have placed Caylee's body there.

Anthony is charged with first-degree murder in her daughter, Caylee's, death. Caylee was 2 when she was reported missing in July 2008.

After months of searching, Caylee's remains were found in a wooded area off Suburban Drive in East Orlando.

The area is near Anthony's family's home, and an Equusearch search had gone near the area but never actually searched the location where the remains were later found.

Anthony is being held at the Orange County Jail.

Anyway, now that all the TES records will be available to the defense, I believe that they will conduct a search for someone who will welcome the opportunity to get their name in lights and "verify" that they indeed searched the site of the remains. Unfortunately this opens up another way to plant doubt in the minds of the jury. (It wouldn't fool me though!)

ORANGE COUNTY, Fla. -- The defense team scored a small victory in the case against Casey Anthony on Thursday. Tim Miller, founder of EquuSearch, has agreed to testify as a defense witness.

"That the attorney for Timothy Miller … has agreed to present Timothy Miller as a representative of Texas Equusearch (TES) for deposition in Orlando, Florida," Judge Stan Strickland wrote in the order (read it).

However, the defense will only get search records pertaining to the 32 volunteers who searched near the spot where Caylee's remains were ultimately found and they have to pay for the records.

"That the documents of the thirty-two (32) searchers, which were referenced by Mark E. NeJame as counsel for Timothy Miller and (TES) at the hearing on August 21, 2009, are to be disclosed to both the State and Defense," the judge further wrote in the order.

The defense wanted records from all 4,000 volunteers who looked for Caylee, but the judge denied that.

"That all documents related to all the other searchers working with or under Texas Equusearch are not to be disclosed," Judge Stan Strickland wrote.

Casey's lawyers claim someone else dumped the remains near her home when Casey was in jail. She's still there, facing a possible death sentence for her daughter's murder.

Prosecutors in the case against Casey Anthony recently handed over hundreds of new documents to Anthony's defense team according to documents obtained by Eyewitness News on Tuesday.

Prosecutors gave the defense (read document) over 2,000 pages of evidence, eight more Photobucket files, as well as FBI records. The defense also received a photo investigators took of a tattoo Casey got on her back after Caylee disappeared that reads "La Vita Bella," Italian for "a beautiful life."

It's unclear when that evidence will be released to the media.

The prosecution also added two new people to its list of witnesses (see the names). One of those witnesses took pictures of the search for Caylee with the search group EquuSearch.

The defense wants to show that someone besides Casey dumped Caylee's body by saying EquuSearch searched the crime scene and didn't find anything before or after Casey was already in jail.

The defense team is also trying to push back Casey's trial for check fraud until after the murder trial. The documents filed (read motion | amended) say attorneys don't expect the murder case to go to trial until after June 2010.
