Darrin Daily accused of arranging group sex assaults in OR on Craigslist/ Defendants get slap on the wrist

Darrin Vaughn Daily was arrested Tuesday in what police described as a diabolical Craigslist group sex scheme that advertised sex with underage girls, including a 4-year-old, to interested adults.

Daily was the mastermind in the group sex advertisements, according to Newberg-Dundee Police Department spokesman Tim Weaver. Three other men and one woman were also arrested in the investigation.

Daily’s arrest came after police seized his personal computer. Police say they discovered multiple images of two girls, ages 4 and 14, being sexually assaulted. The 14-year-old was tied up in one image; in another, she was forced to copulate with a dog, Weaver told KGW on Wednesday.

The arrests came after another girl, a 15-year-old, came forward and accused Daily of getting her drunk and stoned on marijuana in early September, and then coercing her into group sex with other adults and a dog.

Four others were also arrested in the case: 34-year-old Robert D. Thompson of Portland, 41-year-old David Garcia of McMinnville, and 43-year-old Patricio Moreno of Forest Grove. Alisa Nice, a 31-year-old McMinnville woman, was arrested late Tuesday, booked into Yamhill County Jail.

All face various charges involving the sexual assault of underage girls.

Investigators did not say how Daily knew the three young victims.

The 14-year-old girl told investigators that Daily took photos of her while she was raped, according to Weaver. Daily also photographed her having sex with his dog, the victim told police.

Daily had posted at least one and possibly several Craigslist ads inviting other adults to have sex with her, the victim told police.

The 4-year-old was currently in care at a child abuse assessment center in McMinnville.

Daily faces various sex abuse-related charges, including rape, assault and sex abuse involving animals.

He was booked into Yamhill County Jail and scheduled to make his first court appearance next week.

Weaver said the evidence seized from Daily’s computer and other media storage was critical to the investigation.

Those poor kids.. how horrific. This is just sick sick and really makes me even more Leary about Craigslist. I use to let people come to my house or vice versa, I would never let them in, but after all the sick stuff I hear, including the Craigslist killer, I always meat at a public location to sell or pick up items!!

Another girl, 14, later told police she visited Daily every other weekend from February to this past Labor Day weekend and they usually had sex, according to court documents released Wednesday. She said Daily once tied her up in what she and Daily called "raping her" although she was consenting to it.

Under Oregon law, a person under 16 is not old enough to consent to sex with someone older than 18.
She also said that Daily posted ads on Craigslist seeking men "interested in engaging in group sex with her," according to the documents, and that she had sex with men and a woman at Daily's home. The 14-year-old also said Daily took pictures of her having sex with his dog.

Detectives who analyzed Daily's computer found images of the girl having sex with adults and the dog.
The 15-year-old told police she had met Daily at a swimming pool, and that Daily's daughter, who was with him, asked her to visit, according to court documents. When she visited she smoked marijuana with him and he provided alcohol, according to the documents. She said Daily "got too high," took her to a bedroom and they had sex.

Neighbors said Daily had moved into the apartment early this year, appeared to have no job, rarely left and had frequent visitors. They say his two daughters and a small dog named Buddy lived with him.
The allegations shocked the sedate community in Oregon's renowned wine country.

Daily is being held on $1 million bail in the Yamhill County Jail. He is accused of rape, sodomy, sex abuse, sexual assault of an animal, delivery of marijuana to a minor, online sexual corruption of a child, endangering the welfare of a minor and using a child in a display of sexually explicit conduct.

In addition to the photo and evidence found on the computer of 14 and 15 year old girls being abused, police also uncovered images showing a 4 year old being abused as well. That child is being taken care of at a child abuse “assessment center” at this time. The mother of the four year old was a friend of Daily and she stated the following to reporters:

“Never saw it coming at all. He was a good friend of ours, a nice guy,” she said Wednesday.

The mother said she was furious when she found out about the images of her daughter being sexually abused.

The 4-year-old will go before a grand jury later this week, she said.

“I want him gone. I want him locked away for a very long time and I want his life as miserable as he’s made ours,” she said.

craigslist needs to remove its' personals, and/or people meeting people areas. I use the list to sell and purchase items, and have never had any sort of problems. I think all of the horrible things are being posted through the personal adds.

An Oregon man accused of using Craigslist to arrange group sex with a 14-year-old girl and photograph it has been indicted on new charges involving a 4-year-old girl.
Lisl Miller, deputy district attorney for Yamhill County, said the new charges involve three separate incidents with the 4-year-old. Miller declined to comment further.
The indictment graphically describes the alleged conduct, but other details, such as how Daily knew the girl, were not disclosed.

Daily will be first to face trial in child sex abuse case

The man arrested Sept. 11 in connection to a child sex abuse case is set for trial Nov. 10 in Yamhill County Circuit Court.
Appearing in front of Judge John Collins Monday, Darrin Daily, on the advice of his attorney, Al Hansen, didn’t waive his right to a speedy trial, which in Oregon means within 60 days of arrest.
Hansen told the judge that it was impossible for him to properly counsel his client on the best course of action as he hadn’t received evidence from the district attorney’s office through the discovery process. Deputy district attorney Lisl Miller told Collins that she was still awaiting a report from the Newberg-Dundee Police Department detective parsing through electronic devices seized last week from Daily’s Newberg residence.
Hansen also asked that Daily, 44, who is being held on $2 million bail in the county jail, be released on his own recognizance because of the delay in presenting discovery evidence. Collins denied that request.

Most of the suspects will have their next pretrial hearing Oct. 26.

A pair of suspects in a sex abuse ring will pursue separate trials, their attorneys announced Monday in Yamhill County Circuit Court.
Alisa Nice, 31, of McMinnville, waived her right to a speedy trial on the advice of her attorney, Janmarie Dielschneider, during a pre-trial conference.
“There’s more to come,” Dielschneider said of the release of evidence from the Newberg-Dundee Police Department during the discovery process. “Because of the seriousness of the charges, we’re requesting a 30-day continuance.”
Nice is charged with third-degree sodomy, third-degree sexual abuse, display of a child in sexual conduct, and second-degree sexual abuse, stemming from an NDPD investigation into minors’ reports of sex abuse at the hands of Newberg resident Darrin Daily, 44.
Daily is accused of sexually abusing two teen-age girls and a 4-year-old child, including posting a Craigslist advertisement that invited other adults to have sex with the girls. He faces 52 charges related to the accusation, including several Measure 11 charges.
Nice is one of four other suspects also alleged to have abused the girls. She is held on $160,000 bail in Yamhill County jail, and will be tried separately from Daily.
Also appearing in court Monday for a pre-trial hearing was another of the suspects, Robert Thompson, 34, of Portland, who is charged with three counts of using a child in a display of sexually explicit conduct, three counts of third-degree rape, and two counts of second-degree sexual abuse.
His charges also include Measure 11 crimes and he is being held in the county jail on $750,000 bail.
His attorney, Elana Flynn, requested a one-week continuance while filing a motion to sever — a request that Thompson’s trial also be conducted separately from that of Daily, whose trial is set for Nov. 10. He is being held in the Yamhill County jail on $2 million bail.

One of four suspects in a Craigslist sex-abuse sting will have his pretrial hearing process postponed until Nov. 30, as lawyers ready his defense.
Attorney Jeffrey Jones requested the stay for his client, David Garcia, 41, of McMinnville, after the Yamhill County District Attorney’s office delivered some 250 pages of documents to his office.
Garcia is charged with two counts third-degree rape and four counts of second-degree sexual abuse. The charges stem from an investigation by the Newberg-Dundee Police Department of Darrin Daily, 44, of 720 South River St.
NDPD Lt. Kosmicki wrote that the abuse came to light when a one of the minors, a 15-year-old girl, reported it to police.

The Newberg man arrested on allegations that he sexually abused two teen-age girls, will no longer stand trial Monday, but will appear in court for a pretrial hearing.
Darrin Vaughn Daily, 44, is held on $2 million bail at the county jail on a string of charges connected to his alleged abuse of 14- and 15-year-old teen-age girls. He is charged with seven counts of third-degree rape, three counts of endangering the welfare of a minor, three counts of unlawful distribution to a minor, one count of second-degree sexual abuse and one count of third-degree sexual abuse.
He’s accused of not only committing those crimes but also advertising sex romps on Craigslist, ads which were allegedly answered by four adults who have also been arrested. One of them, David Garcia of McMinnville, has since posted bail and will next appear in court in February.
Robert Dwain Thompson — charged with three counts of using a child in a display of sexual conduct (a Measure 11 crime), three counts of third-degree rape, and two counts of second-degree sex abuse — is in jail on $750,000 bail.
Alisa Marie Nice — charged with two counts of second-degree sex abuse, one count of third-degree sex abuse, one count of using a child in a display of sexual conduct and one count of third-degree sodomy — is in jail on $160,000 bail. Thompson and Nice will appear in court Jan. 4.
The remaining suspect, Patricio Moreno, is being held on $100,000 on four counts of second-degree sex abuse and two counts each of third-degree sodomy and rape. He is scheduled for a Dec. 14 appearance in court.

On Tuesday, Judge Caroll Tichenor told the lawyers of a man accused of child sexual abuse that at their next meeting he would expect them to make a decision on whether to go to trial or not.
Darrin Daily, 44, at the center of an alleged pedophile ring using Craigslist to peddle sex with a teen-age girl, was in court for his seventh pretrial hearing.
Arrested in September after a second teen-age girl told police that she had been molested by him, Daily has been slowly making his way through the court system. Represented by Bernt “Al” Hansen of McMinnville from the onset, Daily will also have Paula Lawrence as a co-counsel. She is also a McMinnville attorney.
Lawrence, whose firm defended the McMinnville junior high school students involved in the spanking case three years ago, had just been assigned to the case. She requested one month before the next hearing in order to familiarize herself with the details.
Tichenor, who has made it clear he doesn’t like an endless series of pretrial hearings, agreed to Lawrence’s request. However, he informed Lawrence and Hansen that by the time they appear in court next he would expect them to either file a not-guilty plea and prepare for trial or accept a plea offer from the district attorney’s office if one is made.
Also appearing in court Monday was Alisa Nice, accused of answering the Craigslist ad and having had sex with one of the teen-age girls. Her counsel, Janmarie Dielschneider, asked and was granted a judicial conference Feb. 23.
Also arrested in the case were Robert Thompson, 34, Patricio Moreno, 43, and David Garcia, 41. Garcia was allowed to post bail shortly after his October arrest; the other four suspects remain in jail.
The five cases, which were originally packaged together, were severed at the behest of the lawyers for the four accused of having answered the Craigslist ad. Daily has been charged with the most egregious crimes, including numerous counts of rape, and will likely to see his case disposed of first.

An Oregon woman has been sentenced to five months in jail after pleading guilty to her role in videotaped sex with a 14-year-old girl.

A prosecutor said a polygraph test supported the claim by Alisa Nice that she believed the girl was 18 or older.

The 31-year-old Nice is 1 of 5 people charged in a case that began with an investigation of a man who used Craigslist to solicit others to participate in sex acts.

The man accused of organizing the crimes, 44-year-old Darrin Daily of Newberg, faces 53 sex and drug counts, including one involving the family dog and others involving a toddler.

Nice pleaded guilty to sex abuse and sodomy charges involving the 14-year-old, and must register as a sex offender under the plea deal.

A man arrested in connection with the Craigslist case pled guilty Monday to charges of third-degree rape and second-degree sexual abuse.
Judge Cal Tichenor sentenced Patricio Moreno, 43, to three months in jail and five years on probation as part of a plea agreement with the district attorney’s office. Moreno had been charged with seven counts of second-degree sex abuse and two counts of third-degree rape.
Deputy district attorney Lisl Miller told Tichenor in her summary of the facts that “this defendant, the state believes, was never aware of her age.” The victim in this case is a 14-year-old girl who was the girlfriend of Darrin Daily, 44, who advertised sex romps with her on Craigslist.
Moreno was brought to one such event by co-defendant David Garcia, 42, Miller said, and “he was told and believed the victim was above 18.” In a pretrial hearing Garcia’s counsel told the court his client had inquired via e-mail about the girl’s age and was told she was 18 before he engaged in sexual acts with her.
As she had done during the sentencing of fellow codefendant Alisa Nice, Miller told the court the victim appeared to be 18. “He did not know her age,” she said of Moreno. Indeed, he passed a polygraph test indicating that not only did he not know her true age, but that it was the only occasion on which he’d had sex with a minor.
Miller read a brief statement from the victim saying she had only encountered Moreno twice and that both times it was at Darrin Daily’s house.
“I’m very sorry,” Moreno told the judge, “I made a bad mistake.”
Moreno, who has been incarcerated since Oct. 5, will be required to register as a sex offender and will be on probation for five years. As part of his sentencing agreement he also agreed, as Nice had, to testify truthfully against his former co-defendants.
Daily, charged with 53 counts, is scheduled for a March 15 status conference.
Garcia, who is out on bail, has been charged with two counts of third-degree rape and six counts of second-degree sex abuse. He is scheduled for a pretrial conference March 15.
Robert Dwain Thompson, 34, has received a plea offer of 10 years prison time.

One of the five people who had been facing various charges in what prosecutors said was a sex abuse ring organized in Oregon by using Craigslist has been sentenced to 40 days in jail.
The News-Register in McMinnville reported that 42-year-old David Garcia of Lafayette pleaded guilty Monday in Yamhill County Circuit Court to four counts of misdemeanor sex abuse for his role in the case.
Deputy District Attorney Lisl Miller had recommended a 60-day sentence.
Garcia must register as a sex offender and he agreed to aid the state in the prosecution of the remaining two defendants, 44-year-old Darrin Daily of Newberg and 34-year-old Robert Thompson of Portland.
Last fall, police located three men accused of responding to Daily's Craigslist advertisement and having sex with a teen. Police arrested Thompson, of Portland; Garcia, of McMinnville; and Patricio Moreno, of Forest Grove on sex abuse charges.
