ST. AUGUSTINE — The woman who was at home with Haleigh Cummings the night she disappeared told investigators she heard the girl being attacked, her attorney said Tuesday.
Attorney Robert Fields said 18-year-old Misty Croslin told investigators the attack came after her cousin arrived looking for a gun belonging to Haleigh's father, Ronald Cummings.
Croslin was living in a Satsuma mobile home with Cummings at the time. The two later married but then broke up.
Croslin told investigators she saw her cousin Joe Overstreet put the screaming child in a black bag, and she heard a van door open and close outside.
"Haleigh was a substitute" for the missing gun, Fields said.
Croslin hid beneath a sheet with Cummings' 3-year-old son during the attack, said Fields, speaking with reporters after her court appearance in St. Johns County on unrelated drug trafficking charges.
Fields did not immediately return follow-up phone messages or e-mails from The Associated Press.
In a statement, the Putnam County Sheriff's Office said authorities would not discuss any information about the case.
"The Haleigh Cummings investigation is far too important to be jeopardized by releasing this type of sensitive information," said Lt. Johnny Greenwood.
Previously, Croslin's family has said Overstreet was at the mobile home the night Haleigh disappeared.
He was arrested on drug charges last week in Tennessee, but he has never been charged or named as a suspect in Haleigh's disappearance.
His attorney, Shawn P. Sirgo of Nashville, Tenn., told The Associated Press on Tuesday that Overstreet had nothing to do with the child's disappearance.
He told The Florida Times-Union that Croslin has changed her story numerous times.
"I don't believe anything she said," he said.

After Croslin's plea hearing, Haleigh's mother, Crystal Sheffield, told reporters that she believes investigators are doing the best they can.
"Do I believe my daughter's dead? No," she said. "And until they show me something, I won't."

Misty had until today to tell the truth about HaLeigh. This is what she is allegedly saying, but from the above report, it says she told LE this back in January when she was arrested.
It's plausible..but I think there is a tad bit more to it, like Ron knowing what went down. Also, I think drugs was a factor IF this "story" is true.

I agree with you Wrap. I think this is VERY interesting. You know there is always a bit of truth in all their lies. Ron freaks out in the 911 call and says someone STOLE his daughter. Most people would say my daughter is MISSING (not knowing if she walked away or was abducted). To me, using the word STOLE makes me think he knew someone took her.
Also, remember Jr. saying he saw the "Black Man bouncing on the couch", could he have seen the black bag bouncing with little HL in it?? As hard as it is to think about this.... I think we are getting one more step closer to finding out what happened to her :(

This is a statement from the Putnam County police about what Misty's lawyer said:
The Putnam County Sheriff's Office has received numerous requests for an official comment regarding a statement made earlier today by Attorney Robert Fields. For those outlets not aware, Attorney Fields is legal counsel for Misty Croslin.
Attorney Fields made a statement to media outlets that after Misty Croslin's arrest, she informed investigators what happened the night Haleigh Cummings went missing, and what happened to Haleigh Cummings.
Since the onset of this investigation, the Putnam County Sheriff's Office has been asked to comment on information obtained during the investigation. The Putnam County Sheriff's Office has always taken the firm stance that any information obtained in this case is not to be released, and any investigative strategies will not be discussed. The Haleigh Cummings investigation is far too important to be jeopardized by releasing this type of sensitive information.

I feel sick. That is what I have believed from the start. That Joe raped Haleigh, hence the bouncing couch. And, then he took her for revenge. But, oh my God--I thought she was probally suffocated in the trailer. Never would I believe that someone could be so cruel to put an alive child in a bag screaming. I pray that is not true. However, these are all drug users. Anything is possible.

Misty Cummings pleads no contest to drug trafficking charges Tuesday in a St. Johns County courtroom.
ST. AUGUSTINE, Fla. -- As Misty Cummings pleaded no contest to another drug trafficking charge, the attorney for the 18-year-old says she has told investigators that her cousin put Haleigh Cummings in a black bag and took her away.
Misty's attorney, Robert Fields, said she has told investigators what happened in that Putnam County mobile home the February 2009 night that the 5-year-old disappeared.
Fields said Misty told detectives the day after she was arrested on the drug charges in January that her cousin, Joe Overstreet, and her brother, Hank Croslin Jr., came looking for a semi-automatic machine gun. Since the gun wasn't there, Overstreet took Haleigh as a substitute for the gun, the attorney said.
"According to Misty, Joe took Haleigh while Misty was laying in bed and covered herself up with a blanket," Fields told Channel 4 Tuesday morning outside the courtroom. "They were there for like seven minutes, appeared to be on drugs and Misty says she saw Joe put Haleigh in a black bag and she heard Haleigh scream."
Putnam County investigators have interviewed Overstreet in Tennessee, where he currently lives.
Joe Overstreet tells reporters in April he does not know what happened to Haleigh Cummings.
Overstreet was arrested last week on theft and drug charges, but he has never been called a suspect or a person of interest in the Haleigh Cummings case.
"Investigators are still working this case diligently, and we believe we will find out what happened to Haleigh, but it's going to take time," Lt. Johnny Greenwood, of the Putnam County Sheriff's Office, said Tuesday. "We don't know if the break in Haleigh's disappearance will come from behind bars or from the public."
"Everyone is considered a person of interest in Haleigh's disappearance except Crystal Sheffield and Ronald Cummings, Haleigh's parents," he added.
Tuesday marks the day Haleigh would have turned 7 years old. Her family planned a balloon release for Tuesday afternoon. Haleigh was 5 when she vanished from her home in Satsuma. Misty, who was Ronald's girlfriend when Haleigh disappeared, married and divorced him within eight months.
Authorities have maintained that the drug charges have no connection to the ongoing investigation of Haleigh's disappearance, which they now consider a homicide case.
Misty faced drug trafficking charges in two counties after an undercover St. Johns County deputy said she sold him 155 oxycodone pills on Jan. 8 at a gas station off of State Road 206.
She faces up to 25 years in prison on that charge, in addition to up to 200 years on the seven counts of drug trafficking she is facing in Putnam County.
An Amber Alert was issued Feb. 10, 2009, for 5-year-old Haleigh Cummings
Misty, Hank Croslin Jr., Ronald Cummings, Haleigh's father, and two others were arrested after the undercover sting and charged with selling prescription drugs.
Prosecutors have released surveillance videos they said shows undercover drug deals involving Misty and Ronald Cummings.
Court officials said that because this is her first arrest and because she is a youthful offender, Misty will likely be sentenced to 25 years or less. Sentencing on the St. Johns County case was set for Oct. 8 and Oct. 19 on the Putnam County charges.
Ronald Cummings is nearing a plea agreement, and Hank Croslin has already pleaded no contest to similar charges and was sentenced to 15 years in prison.
When entering the plea Tuesday morning, she asked the judge to call her by her maiden name, Misty Croslin.
Crystal Sheffield, Haleigh's mother, was in court Tuesday for Misty's drug plea.
"I think they're doing the best they can," Sheffield said of investigators. "Do I believe my daughter's dead? No. And until they show me something, I won't. Deep in my heart I know she's out there. And nobody knows the pain that I go through -- nobody. And they never will. I don't care who they are."
Misty's grandmother, Flora Hollars, who lives in Tennessee, said she thinks as long as she and her brother, Hank, are in jail, they won't tell what they know about Haleigh.
"I believe they'll do more talking out of jail," Hollars said in a phone interview Monday. "Look at how long it's been. They ain't said nothing."
Misty and Hank's mom and dad were also recently arrested and are in jail on drug charges. Hollars said with the entire family in jail, the chances of them talking are slim to none.
"I don't think they'll say anything as long as they're in jail," Hollars said. "If they were out, they might talk."
Hollars said she still believes Haleigh's body was dumped into the St. Johns River, and in her opinion, everyone in the Croslin family knows more than what they've admitted to.
"Misty is the one that told me they wrapped her in a bag and tied it with a yellow rope and dropped her into the St. Johns River," Hollars said.
Even with little to no physical evidence, deputies are treating Haleigh's disappearance as a homicide, and they're likely hoping that one of the Croslins will eventually crack while in jail.
"I think Ronald knows more than he's saying, too," Hollars said.

Hollars said she still believes Haleigh's body was dumped into the St. Johns River, and in her opinion, everyone in the Croslin family knows more than what they've admitted to.
"Misty is the one that told me they wrapped her in a bag and tied it with a yellow rope and dropped her into the St. Johns River," Hollars said.
Even with little to no physical evidence, deputies are treating Haleigh's disappearance as a homicide, and they're likely hoping that one of the Croslins will eventually crack while in jail.
"I think Ronald knows more than he's saying, too," Hollars said.

I remember on NG G'ma Hollar's saying she wasn't sure if Haleigh was still alive when she was thrown in the river. It is thoughts such as that, that keep me awake at night. The suffering she endured if indeed that is true. The only thing that gives me hope that she was not alive when put in that bag, is that Misty has changed her story before.

Cherylz, I completely agree with you. There mere though of that poor little girl being thrown in the river alive in a bag is too much to bear!! It's just like Caylee. Was she alive when Casey placed the duct tape over her mouth and nose? Even typing the words sickens me!
I think that Misty was too scared to call 911. She was probably wasted, and was afraid of Joe, her brother and for sure, Ronald. She's just a kid who has zero life skills. I blame Ronald Cummings for his daughter's death, along with the entire family for not taking care of the kids the way they should have. You just don't leave two children under the age of 5 with a 17 year old drug addict!!! Where were the grandmother's and great grandmother's then?????

Haleigh's grandmother, Teresa Neves, told Channel 4 Wednesday morning that she does not know what to believe.
On Tuesday, Misty's attorney, Robert Fields, said Haleigh's former stepmother has told investigators that her cousin, Joe Overstreet, put Haleigh in a black bag and took her away. Fields said Overstreet took Haleigh while Misty was lying in bed and covered herself up with a blanket. He said Misty heard Haleigh scream.

"People are starting to cooperate. That's why I've told people it's going to be just a matter of time, and we're going to accept any cooperation that we can get. So again, it's a good thing. People are starting to talk."

Also, as soon as Ron called her, she was reportedly there w/in 15 min. She lives approx 45 miles away. That is impossible. I think she knows more but not everything as I think Ron has fed her a line of b.s., too and of course she will believe anything he says.
I STILL think Ron is somehow involved in this gun thing. I think that IF this story is true, Misty or Tommy called Ron and told him what happened. For whatever reason, he told her to wait until he got home to call 911 and came up with the back door/brick/got up to go to the bathroom/get a drink of water story. This has to do with drugs, guaranteed.

I agree with Ms. Neves - it's really hard to believe anything Misty says anymore! She reminds me of that Aesop's fable: "The Boy Who Cried Wolf". However, nothing would surprise me about that mixed up family! One idea that just came to me (please forgive me if it has already been discussed), is that Misty may have "sold" Haleigh for drugs (similar to what happened to poor little Shaniya Davis). Either way, I feel that something dreadful has happened to little Haleigh & I hope & pray that the truth comes out soon!

Tommy Croslin's Attorney Says Croslin said Haleigh Likely Strangled
Tommy Croslin, one of three people believed to have been in a mobile home the night Haleigh Cummings disappeared, told investigators he thinks she was strangled by his cousin, his attorney said today.
Attorney James Werter, representing Croslin, who was sentenced to 15 years in prison this month, said Croslin told authorities in April that he believed Joe Overstreet strangled Haleigh after losing his temper in February 2009.
Overstreet, Croslin's cousin, was reportedly looking for a gun that belonged to Haleigh's father Ronald, but couldn't find it.
"The gun wasn't there. Joe Overstreet lost his temper and took or did something to Haleigh that evening," said Werter, citing Croslin's account of the night.
Werter said Croslin told this information to authorities in April, which led to a re-intensified search for the missing girl in the water near their Satsuma home.
"Tommy rode with (Joe Overstreet) to where Joe Overstreet disposed of the body off that dock, which was the subject of search in April," said Werter.
Werter said while Croslin claimed to be with Overstreet that night, "Tommy had not act of participation."
Earlier this week, after the "no contest" plea by Misty Croslin on her drug charges, her attorney told Misty's side of what happened.
Misty was in the home babysitting Haleigh and her younger brother.
She said Tommy and Overstreet came in looking for the gun, then went after Haleigh while Misty and the younger brother hid under the covers.
Misty said Haleigh was screaming and fighting back, then became quiet, and she next heard the door to the house open and close, then the door to a van open and close.
She said she saw Overstreet put Haleigh in a bag.
Haleigh has been the subject of an Amber Alert ever since.
Werter said his client has not had contact with his sister, making each story more believable.
"The two of these people have not been in contact with each other while in jail, so it was not like they are collaborating on stories," said Werter. "It gives it more credibility through there may be variances. That is a normal thing with different witnesses seeing different things."
The information about Tommy came after Werter spoke about Tommy's reaction to his prison sentence.
He said Croslin was "shocked" at his recent sentence of 15 years in prison on two drug charges, one for possession and one for trafficking.
Werter plans to appeal the sentence.

I think those 3 are the key players and that all 3 know what happened to precious Haleigh. It sounds like Haleigh "got in the way" that awful night.
Big difference in the 2 stories is that Misty said she was screaming in the bag, whereas Tommy said she was likely strangled then put in the bag. Why in God's name did Misty not tell the truth from the get-go? Why did she not call 911 right away? And, why are they not arresting Joe?

There is yet another version of events emerging from the night Haleigh Cummings disappeared.
The attorney for Hank Croslin Jr. said that Hank's cousin Joe Overstreet killed Haleigh in her Satsuma home because he couldn't find the gun he was looking for.
"He took the body down to the dock and then he came back without the body, so there you have it," said attorney James Werter, "At the dock that night, Joe Overstreet put Haleigh in the river."
Werters' statements back up what Misty Croslin's attorney said earlier this week. Misty's attorney said her brother and cousin took Haleigh as a replacement for the gun.
Werter said Croslin rode in a van with Overstreet while Haleigh's body was in back.
"Haleigh was quiet, limp and not moving, like she was sleeping," Werter said.
Werter claims that Overstreet threatened Croslin's life.
"(Croslin) stayed in the vehicle in the passenger seat. He didn't drive. He didn't help in any sort of fashion. Joe was ordering him around, 'Come on. Let's go. Come on. Do this.'," Werter said.
The lawyer claims that Putnam police threatened to prosecute Croslin which is why he won't let him tell his story. He wants immunity for Croslin.
"My advice to him is that he does not talk because they keep threatening him with felony murder charges, which are unfounded and unwarranted. So how can I let him talk in that situation? How can I let him say he even held a door open for Joe as he carried out the body? That would make him, technically speaking, an accessory after the fact. I can't let him talk with even that stupid little threat." Werter said.
Joe Overstreet and his attorney were unavailable for comment Thursday.

Amen!!!! If I am repeating myself, please forgive me. The FBI and PCSO have been to Joe Overstreet's home twice. Plus, there is a pic of Joe and Misty putting up missing flyers the day after HaLeigh went missing. If anyone can find it..Joe nor Misty look freaked out at all.Those two had months to conspire. I am a believer in that is you break the law then you should pay the price. But equating murder to a bottle of pills seems ridiculous. Should the laws be rethought?

ANSWER: I cannot visit Hank yet because I don’t have a picture id. My daughter-in-law, Chelsae came down while I was in jail and got my car and everything I had, even my purse. My SS card, drivers license, birth certificate and everything is with her. I came out of the jail in borrowed clothes. She even had the clothes I was arrested in. I can’t visit Tommy or Misty because I can’t leave the county until my fines are paid.
Q – I heard a rumor that Tommy and Misty can not currently even send letters to each other. Is this true?

Following yesterdays article BNN received several emails from people wanting to help Lisa Croslin. She does not need a hand out, she needs a hand up. She needs some good counselling, and a job, she also needs to be far away from the drug scene.
I am sure that there are people that will read this article and say “what a pointless interview, there is nothing new”. If you say that, then you need to take a deep breath and think. Most of us live in relative luxury, we have our computers, TV’s, food in the refrigerator, and even though life is hard, a roof over our heads.
I spent a number of years working with the homeless, people who have nothing but what they can carry. It is heartbreaking, and alas it is all too common today.
Lisa can not visit her husband Hank, or her children Misty and Tommy. She wants to go straight, to get away from the drug scene, but with her world in collapse can she succeed? Or to put this question another way, if you were in her position could you go straight?
Lisa’s answer to my final question was somewhat shorter than I had hoped for. I am being told by other sources that the reason Misty and Tommy cannot exchange letters is once again due to an identification issue. For reasons beyond sanity, Misty must produce a birth certificate as proof of identification! Do the jail authorities think that she is not Misty Croslin? My mind boggles!

I would love to feel sorry for Lisa Croslin. I really want to. But, you know..when you have two of your three children in jail and you are living basically homeless and you somehow get a $20.00 bill in your hands and go by crack, I have Zero, Zilch, Nada pity for her or for them.
IF she is serious about staying clean, she should have someone write the show on A&E, "Intervention". Due to this being high profile, they might assist in putting her in rehab. That is what she needs. Why is it that drug abusers always find religion when they are in a place where they cannot get to their drugs? I really don't mean to offend anyone..and if a person gets and STAYS clean and finds their God in the process, that is awesome!! ~wrap~

Wrap, I agree with your comments, but I'm wondering what you meant about Lisa Croslin getting $20.00 and buying crack with it? I never heard about that before! I really hope that she is serious about getting her life straightened out... I guess we will believe it when we see it!!

She and her husband were arrested for trying to buy crack. Now, she is out of jail but hubby is still there. They had been basically homeless. We have the jail tapes where Hank Sr. is talking about how no one will hire him as everyone knows who he is, bla bla bla. There are pics (I am not sure which thread but do a search in the search engine) of them living in some shelter. And, they get a $20 somehow and go buy crack. Heck, Leonard Padilla even bought them a $3,000 Ford Taurus to help them out. They don't appreciate it. They just want their drugs! I bet that car isn't even around anymore.

Late last night Jan and I received a phone call. It was a call that while not unexpected, was to say the least not one that I thought would come so soon. As the phone call wound down the inevitable question of when was I going to publish reared its ugly head. My decision was to ‘Sleep on it’. The news had no direct bearing on the search for Haleigh Cummings, a few hours delay on releasing the story would not have any effect on the case.
Last Tuesday Lisa Croslin was released from the Putnam County jail, the ‘Crack’ buying charges had been dropped. She had no possessions, not even any street clothes. A good Samaritan loaned her some clothes. Lisa has no where to go, she has no home, and alas her most of her family all seems to be residing behind bars. Her solution was to return to the same boarding house that she had been living in with her husband Hank before the ‘crack’ incident. It is unclear as to the exact details, however she was told that she could stay there for three days. Maybe the Croslin’s still had a credit on a room?
The next day the good Samaritan found Lisa Croslin a more stable environment. A place where she could be safe, and away from the drug scene. There was a price associated with her stay, it was not money, but rather a zero tolerance policy to alcohol and drugs.
Last nights phone call revealed a number of facts that I found very disturbing. Lisa Croslin was at a local emergency facility, drunk, and higher than a kite on Xanax. She was released at some point overnight.
Her whereabouts at this time are unknown. She is no longer welcome at the shelter that she was staying at because of the zero tolerance policy. She is not at the the boarding house, through someone ‘on the ground’ we have been told that she is not welcome back there either.
While none of this story is likely to come as any big surprise to readers that have been following the Haleigh Cummings case, there are questions that still need to be answered.
The Xanax apparently was prescription rather than bought off the street. Of the 90 tablets obtained a few days ago, only 17 remained in the bottle last night. This is a usage of more than 10 per day! Who was the doctor that could possibly prescribe 90 tablets to an addict?
Where did Lisa Croslin get the money from to buy the drugs? And where did the money for the booze come from?
Lisa herself mentioned two names last night. These names were relayed to Jan and I from the good Samaritan. I was shocked to say the least. As I have been unable to confirm or deny the allegations yet, I will leave the names out at this stage. One I feel was just trying to be another good (if misguided) Samaritan, the other conjures up more sinister journalistic ambitions. I hate it when he does that.
It would be easy to throw Lisa Croslin back in jail, but what does that solve? She doesn’t need punishment, she needs help! If you see her on the street, give her something to eat, help her find a safe place to stay, but DO NOT enable her with money.
I do know that Lisa Croslin does read Jan and my articles on occasion. So Lisa, if you read this, we both are very concerned. Find some help. Find it quickly. You told us that spending 30 days behind bars was an awakening. The next trip might be far longer.
